Regulations on the Protection and Management of Wild Medicinal Material Resources

野生药材资源保护管理条例

This regulation governs the collection, hunting, and management of wild medicinal materials in China, establishing a three-level protection system for endangered species.

为保护和合理利用野生药材资源,适应人民医疗保健事业的需要,特制定本条例。

These Regulations are formulated to protect and rationally utilize wild medicinal material resources and to meet the needs of the people's medical and health care undertakings.

Any unit or individual that collects, hunts, or deals in wild medicinal materials within the territory of the People's Republic of China must comply with these Regulations, unless otherwise provided by the State.

TranslationArticle 5

The list of wild medicinal material species under State key protection shall be formulated by the State pharmaceutical administration department in conjunction with the wildlife and plant administration departments under the State Council.

在国家重点保护的野生药材物种名录之外,需要增加的野生药材保护物种,由省、自治区、直辖市人民政府制定并抄送国家医药管理部门备案。

Translation

For wild medicinal material protection species that need to be added beyond the list of State key protected species, the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall formulate them and send a copy to the State pharmaceutical administration department for record.

采猎、收购二、三级保护野生药材物种的,必须按照批准的计划执行。该计划由县以上(含县,下同)医药管理部门(含当地人民政府授权管理该项工作的有关部门,下同)会同同级野生动物、植物管理部门制定,报上一级医药管理部门批准。

TranslationArticle 7

Those who collect, hunt, or purchase Grade II and Grade III protected wild medicinal material species must do so in accordance with an approved plan. Such plan shall be formulated by the pharmaceutical administration department at or above the county level (including the county level, the same below) (including the relevant department authorized by the local people's government to manage this work, the same below) in conjunction with the wildlife and plant administration departments at the same level, and submitted to the pharmaceutical administration department at the next higher level for approval.

采猎二、三级保护野生药材物种的,不得在禁止采猎区、禁止采猎期进行采猎,不得使用禁用工具进行采猎。

TranslationArticle 8

Those who collect or hunt Grade II and Grade III protected wild medicinal material species shall not engage in collection or hunting in prohibited collection areas or during prohibited collection periods, and shall not use prohibited tools for collection or hunting.

前款关于禁止采猎区、禁止采猎期和禁止使用的工具,由县以上医药管理部门会同同级野生动物、植物管理部门确定。

Translation

The prohibited collection areas, prohibited collection periods, and prohibited tools mentioned in the preceding paragraph shall be determined by the pharmaceutical administration department at or above the county level in conjunction with the wildlife and plant administration departments at the same level.

采猎二、三级保护野生药材物种的,必须持有采药证。

TranslationArticle 9

Those who collect or hunt Grade II and Grade III protected wild medicinal material species must hold a collection permit.

取得采药证后,需要进行采伐或狩猎的,必须分别向有关部门申请采伐证或狩猎证。

After obtaining a collection permit, if logging or hunting is required, a logging permit or hunting permit must be applied for from the relevant departments respectively.

采药证的格式由国家医药管理部门确定。采药证由县以上医药管理部门会同同级野生动物、植物管理部门核发。

The format of the collection permit shall be determined by the State pharmaceutical administration department. The collection permit shall be issued by the pharmaceutical administration department at or above the county level in conjunction with the wildlife and plant administration departments at the same level.

The establishment of national or local wild medicinal material resource reserves must be approved by the State Council or the local people's government at or above the county level.

Translation

To establish a wild medicinal material resource reserve within a national or local nature reserve, the consent of the competent department of the national or local nature reserve must be obtained.

进入野生药材资源保护区从事科研、教学、旅游等活动的,必须经该保护区管理部门批准。进入设在国家或地方自然保护区范围内野生药材资源保护区的,还须征得该自然保护区主管部门的同意。

TranslationArticle 12

Those who enter a wild medicinal material resource reserve to engage in scientific research, teaching, tourism, or other activities must obtain approval from the management department of that reserve. Those entering a wild medicinal material resource reserve located within a national or local nature reserve must also obtain the consent of the competent department of that nature reserve.

For Grade I protected wild medicinal material species that are naturally eliminated, their medicinal parts shall be managed and operated by pharmaceutical companies at all levels, but shall not be exported.

Grade II and Grade III protected wild medicinal material species that are under State planned management shall be uniformly managed and operated by the China National Pharmaceutical Corporation; the remaining species shall be purchased according to plan by the county pharmaceutical company at the place of origin or its entrusted unit.

The medicinal parts of Grade II and Grade III protected wild medicinal material species shall be exported under a limited quota, unless otherwise provided by the State.

Units or individuals that have made outstanding achievements in protecting wild medicinal material resources shall be given spiritual encouragement or a one-time material reward by the pharmaceutical administration departments at all levels in conjunction with the relevant departments at the same level.

违反本条例第六条、第七条、第八条、第九条规定的,由当地县以上医药管理部门会同同级有关部门没收其非法采猎的野生药材及使用工具,并处以罚款。

Those who violate the provisions of Articles 6, 7, 8, and 9 of these Regulations shall have their illegally hunted wild medicinal materials and tools confiscated and be fined by the local pharmaceutical administration department at or above the county level in conjunction with the relevant departments at the same level.

违反本条例第十二条规定的,当地县以上医药管理部门和自然保护区主管部门有权制止;造成损失的,必须承担赔偿责任。

Those who violate the provisions of Article 12 of these Regulations may be stopped by the local pharmaceutical administration department at or above the county level and the competent department of the nature reserve; if losses are caused, they must bear compensation liability.

Those who violate the provisions of Articles 13, 14, and 15 of these Regulations shall have their wild medicinal materials and all illegal gains confiscated and be fined by the administrative department for industry and commerce or relevant departments.

保护野生药材资源管理部门工作人员徇私舞弊的,由所在单位或上级管理部门给予行政处分;造成野生药材资源损失的,必须承担赔偿责任。

TranslationArticle 21

Staff members of the departments managing the protection of wild medicinal material resources who engage in malpractice for personal gain shall be given administrative sanctions by their unit or the superior administrative department; if losses to wild medicinal material resources are caused, they must bear compensation liability.

当事人对行政处罚决定不服的,可以在接到处罚决定书之日起十五日内向人民法院起诉;期满不起诉又不执行的,作出行政处罚决定的部门可以申请人民法院强制执行。

If a party disagrees with an administrative penalty decision, it may file a lawsuit with the People's Court within 15 days from the date of receipt of the penalty decision; if no lawsuit is filed and the decision is not executed within the time limit, the department that made the administrative penalty decision may apply to the People's Court for compulsory enforcement.

If the destruction of wild medicinal material resources is serious and constitutes a crime, the judicial authorities shall pursue criminal liability according to law.

The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may formulate implementation rules in accordance with these Regulations.
