总则
General Provisions
为了预防、控制和消灭血吸虫病，保障人体健康、动物健康和公共卫生，促进经济社会发展，根据传染病防治法、动物防疫法，制定本条例。
These Regulations are formulated in accordance with the Law on the Prevention and Control of Infectious Diseases and the Animal Epidemic Prevention Law, with a view to preventing, controlling and eliminating schistosomiasis, ensuring human health, animal health and public health, and promoting economic and social development.
国家对血吸虫病防治实行预防为主的方针，坚持防治结合、分类管理、综合治理、联防联控，人与家畜同步防治，重点加强对传染源的管理。
The State adopts the principle of prevention first in the prevention and control of schistosomiasis, adheres to the combination of prevention and control, classified management, comprehensive treatment, joint prevention and control, simultaneous prevention and control of humans and livestock, and focuses on strengthening the management of infection sources.
国务院卫生主管部门会同国务院有关部门制定全国血吸虫病防治规划并组织实施。国务院卫生、农业、水利、林业主管部门依照本条例规定的职责和全国血吸虫病防治规划，制定血吸虫病防治专项工作计划并组织实施。
The competent health department of the State Council shall, together with the relevant departments of the State Council, formulate the national schistosomiasis prevention and control plan and organize its implementation. The competent departments of health, agriculture, water resources, and forestry of the State Council shall, in accordance with the duties prescribed in these Regulations and the national schistosomiasis prevention and control plan, formulate special work plans for schistosomiasis prevention and control and organize their implementation.
有血吸虫病防治任务的地区(以下称血吸虫病防治地区)县级以上地方人民政府卫生、农业或者兽医、水利、林业主管部门依照本条例规定的职责，负责本行政区域内的血吸虫病防治及其监督管理工作。
In areas where schistosomiasis prevention and control tasks exist (hereinafter referred to as schistosomiasis prevention and control areas), the competent departments of health, agriculture or veterinary, water resources, and forestry of the local people's governments at or above the county level shall, in accordance with the duties prescribed in these Regulations, be responsible for the prevention and control of schistosomiasis and the supervision and management thereof within their respective administrative regions.
血吸虫病防治地区县级以上地方人民政府统一领导本行政区域内的血吸虫病防治工作；根据全国血吸虫病防治规划，制定本行政区域的血吸虫病防治计划并组织实施；建立健全血吸虫病防治工作协调机制和工作责任制，对有关部门承担的血吸虫病防治工作进行综合协调和考核、监督。
The local people's governments at or above the county level in schistosomiasis prevention and control areas shall uniformly lead the schistosomiasis prevention and control work within their respective administrative regions; formulate schistosomiasis prevention and control plans for their respective administrative regions based on the national schistosomiasis prevention and control plan and organize their implementation; establish and improve the coordination mechanism and work responsibility system for schistosomiasis prevention and control, and conduct comprehensive coordination, assessment, and supervision of the schistosomiasis prevention and control work undertaken by relevant departments.
血吸虫病防治地区村民委员会、居民委员会应当协助地方各级人民政府及其有关部门开展血吸虫病防治的宣传教育，组织村民、居民参与血吸虫病防治工作。
Villagers' committees and residents' committees in schistosomiasis prevention and control areas shall assist local people's governments at various levels and their relevant departments in carrying out publicity and education on schistosomiasis prevention and control, and organize villagers and residents to participate in schistosomiasis prevention and control work.
国家鼓励血吸虫病防治地区的村民、居民积极参与血吸虫病防治的有关活动；鼓励共产主义青年团等社会组织动员青年团员等积极参与血吸虫病防治的有关活动。
The State encourages villagers and residents in schistosomiasis prevention and control areas to actively participate in activities related to schistosomiasis prevention and control; encourages social organizations such as the Communist Youth League to mobilize young league members and others to actively participate in activities related to schistosomiasis prevention and control.
血吸虫病防治地区地方各级人民政府及其有关部门应当完善有关制度，方便单位和个人参与血吸虫病防治的宣传教育、捐赠等活动。
Local people's governments at various levels and their relevant departments in schistosomiasis prevention and control areas shall improve relevant systems to facilitate the participation of units and individuals in activities such as publicity, education, and donations for schistosomiasis prevention and control.
国务院有关部门、血吸虫病防治地区县级以上地方人民政府及其有关部门对在血吸虫病防治工作中做出显著成绩的单位和个人，给予表彰或者奖励。
The relevant departments of the State Council, the local people's governments at or above the county level in schistosomiasis prevention and control areas, and their relevant departments shall commend or reward units and individuals that have made remarkable achievements in schistosomiasis prevention and control work.

血吸虫病防治地区根据血吸虫病预防控制标准，划分为重点防治地区和一般防治地区。具体办法由国务院卫生主管部门会同国务院农业主管部门制定。
Schistosomiasis prevention and control areas shall be divided into key prevention and control areas and general prevention and control areas according to the schistosomiasis prevention and control standards. The specific measures shall be formulated by the competent health department of the State Council jointly with the competent agricultural department of the State Council.
血吸虫病防治地区县级以上地方人民政府及其有关部门应当组织各类新闻媒体开展公益性血吸虫病防治宣传教育。各类新闻媒体应当开展公益性血吸虫病防治宣传教育。
The local people's governments at or above the county level in schistosomiasis prevention and control areas and their relevant departments shall organize various news media to carry out public welfare publicity and education on schistosomiasis prevention and control. 血吸虫病防治地区县级以上地方人民政府教育主管部门应当组织各级各类学校对学生开展血吸虫病防治知识教育。各级各类学校应当对学生开展血吸虫病防治知识教育。
The competent education departments of the local people's governments at or above the county level in schistosomiasis prevention and control areas shall organize schools at all levels and of all types to carry out education on schistosomiasis prevention and control knowledge for students. 血吸虫病防治地区的机关、团体、企业事业单位、个体经济组织应当组织本单位人员学习血吸虫病防治知识。
State organs, social organizations, enterprises, institutions, and individual economic organizations in schistosomiasis prevention and control areas shall organize their personnel to learn schistosomiasis prevention and control knowledge.
处于同一水系或者同一相对独立地理环境的血吸虫病防治地区各地方人民政府应当开展血吸虫病联防联控，组织有关部门和机构同步实施下列血吸虫病防治措施：
The local people's governments in schistosomiasis prevention and control areas that are located in the same water system or the same relatively independent geographical environment shall carry out joint prevention and control of schistosomiasis, and organize relevant departments and institutions to simultaneously implement the following schistosomiasis prevention and control measures:
(一)在农业、兽医、水利、林业等工程项目中采取与血吸虫病防治有关的工程措施；
(1) Adopting engineering measures related to schistosomiasis prevention and control in agricultural, veterinary, water conservancy, forestry and other engineering projects;
(二)进行人和家畜的血吸虫病筛查、治疗和管理；
(2) Conducting screening, treatment and management of schistosomiasis in humans and domestic animals;
(三)开展流行病学调查和疫情监测；
(3) Carrying out epidemiological investigation and epidemic surveillance;
(四)调查钉螺分布，实施药物杀灭钉螺；
(4) Investigate the distribution of Oncomelania snails and implement drug mollusciciding;
(五)防止未经无害化处理的粪便直接进入水体；
(5) Prevent untreated feces from directly entering water bodies;
(六)其他防治措施。
(6) Other prevention and control measures.
血吸虫病防治地区县级人民政府应当制定本行政区域的血吸虫病联防联控方案，组织乡(镇)人民政府同步实施。
The people's government at the county level in schistosomiasis prevention and control areas shall formulate a joint prevention and control plan for schistosomiasis within its administrative region and organize the synchronous implementation by the people's governments at the township (town) level.
血吸虫病防治地区两个以上的县、不设区的市、市辖区或者两个以上设区的市需要同步实施血吸虫病防治措施的，其共同的上一级人民政府应当制定血吸虫病联防联控方案，并组织实施。
Where two or more counties, cities not divided into districts, or municipal districts, or two or more cities divided into districts in schistosomiasis prevention and control areas need to implement schistosomiasis prevention and control measures synchronously, the common people's government at the next higher level shall formulate a joint prevention and control plan for schistosomiasis and organize its implementation.
血吸虫病防治地区两个以上的省、自治区、直辖市需要同步实施血吸虫病防治措施的，有关省、自治区、直辖市人民政府应当共同制定血吸虫病联防联控方案，报国务院卫生、农业主管部门备案，由省、自治区、直辖市人民政府组织实施。
Where two or more provinces, autonomous regions, or municipalities directly under the Central Government in schistosomiasis prevention and control areas need to implement schistosomiasis prevention and control measures synchronously, the relevant people's governments of the provinces, autonomous regions, or municipalities directly under the Central Government shall jointly formulate a joint prevention and control plan for schistosomiasis, report it to the competent departments of health and agriculture under the State Council for record, and organize its implementation by the people's governments of the provinces, autonomous regions, or municipalities directly under the Central Government.
在血吸虫病防治地区实施农业、兽医、水利、林业等工程项目以及开展人、家畜血吸虫病防治工作，应当符合相关血吸虫病防治技术规范的要求。相关血吸虫病防治技术规范由国务院卫生、农业、水利、林业主管部门分别制定。
In schistosomiasis prevention and control areas, the implementation of agricultural, veterinary, water conservancy, forestry and other engineering projects, as well as the prevention and control of schistosomiasis in humans and livestock, shall comply with the requirements of relevant technical specifications for schistosomiasis prevention and control. The relevant technical specifications for schistosomiasis prevention and control shall be formulated separately by the competent departments of health, agriculture, water conservancy, and forestry under the State Council.
血吸虫病重点防治地区县级以上地方人民政府应当在渔船集中停靠地设点发放抗血吸虫基本预防药物；按照无害化要求和血吸虫病防治技术规范修建公共厕所；推行在渔船和水上运输工具上安装和使用粪便收集容器，并采取措施，对所收集的粪便进行集中无害化处理。
Local people's governments at or above the county level in key schistosomiasis prevention and control areas shall set up distribution points at concentrated berthing places for fishing boats to distribute basic prophylactic drugs against schistosomiasis; construct public toilets in accordance with harmless treatment requirements and technical specifications for schistosomiasis prevention and control; promote the installation and use of fecal collection containers on fishing boats and water transport vehicles, and take measures to conduct centralized harmless treatment of the collected feces.
县级以上地方人民政府及其有关部门在血吸虫病重点防治地区，应当安排并组织实施农业机械化推广、农村改厕、沼气池建设以及人、家畜饮用水设施建设等项目。
Local people's governments at or above the county level and their relevant departments in key schistosomiasis prevention and control areas shall arrange and organize the implementation of projects such as agricultural mechanization promotion, rural toilet renovation, biogas digester construction, and construction of drinking water facilities for humans and livestock.
国务院有关主管部门安排农业机械化推广、农村改厕、沼气池建设以及人、家畜饮用水设施建设等项目，应当优先安排血吸虫病重点防治地区的有关项目。
When arranging projects such as agricultural mechanization promotion, rural toilet renovation, biogas digester construction, and construction of drinking water facilities for humans and livestock, the relevant competent departments under the State Council shall give priority to relevant projects in key schistosomiasis prevention and control areas.
血吸虫病防治地区县级以上地方人民政府卫生、农业主管部门组织实施农村改厕、沼气池建设项目，应当按照无害化要求和血吸虫病防治技术规范，保证厕所和沼气池具备杀灭粪便中血吸虫卵的功能。
In schistosomiasis prevention and control areas, the health and agriculture authorities of local people's governments at or above the county level shall, when organizing the implementation of rural toilet renovation and biogas digester construction projects, ensure that toilets and biogas digesters have the function of killing schistosoma eggs in feces in accordance with harmlessness requirements and schistosomiasis prevention and control technical specifications.
血吸虫病防治地区的公共厕所应当具备杀灭粪便中血吸虫卵的功能。
Public toilets in schistosomiasis prevention and control areas shall have the function of killing schistosoma eggs in feces.
县级以上人民政府农业主管部门在血吸虫病重点防治地区应当适应血吸虫病防治工作的需要，引导和扶持农业种植结构的调整，推行以机械化耕作代替牲畜耕作的措施。
The agriculture authorities of people's governments at or above the county level shall, in key schistosomiasis prevention and control areas, adapt to the needs of schistosomiasis prevention and control work, guide and support the adjustment of agricultural planting structures, and promote measures to replace livestock farming with mechanized farming.
县级以上人民政府农业或者兽医主管部门在血吸虫病重点防治地区应当引导和扶持养殖结构的调整，推行对牛、羊、猪等家畜的舍饲圈养，加强对圈养家畜粪便的无害化处理，开展对家畜的血吸虫病检查和对感染血吸虫的家畜的治疗、处理。
The agriculture or veterinary authorities of people's governments at or above the county level shall, in key schistosomiasis prevention and control areas, guide and support the adjustment of breeding structures, promote the enclosure and pen-raising of livestock such as cattle, sheep, and pigs, strengthen the harmless treatment of manure from enclosed livestock, carry out schistosomiasis examination of livestock, and treat and dispose of livestock infected with schistosoma.
禁止在血吸虫病防治地区施用未经无害化处理的粪便。
It is prohibited to apply untreated feces in schistosomiasis prevention and control areas.
县级以上人民政府水利主管部门在血吸虫病防治地区进行水利建设项目，应当同步建设血吸虫病防治设施；结合血吸虫病防治地区的江河、湖泊治理工程和人畜饮水、灌区改造等水利工程项目，改善水环境，防止钉螺孳生。
The water conservancy authorities of people's governments at or above the county level shall, when carrying out water conservancy construction projects in schistosomiasis prevention and control areas, simultaneously construct schistosomiasis prevention and control facilities; in combination with river and lake management projects, human and livestock drinking water, irrigation area renovation and other water conservancy projects in schistosomiasis prevention and control areas, improve the water environment and prevent the breeding of Oncomelania snails.
县级以上人民政府林业主管部门在血吸虫病防治地区应当结合退耕还林、长江防护林建设、野生动物植物保护、湿地保护以及自然保护区建设等林业工程，开展血吸虫病综合防治。
The forestry authorities of people's governments at or above the county level shall, in schistosomiasis prevention and control areas, carry out comprehensive schistosomiasis prevention and control in combination with forestry projects such as returning farmland to forest, construction of the Yangtze River shelterbelt, wildlife protection, wetland protection, and nature reserve construction.
县级以上人民政府交通主管部门在血吸虫病防治地区应当结合航道工程建设，开展血吸虫病综合防治。
The transportation authorities of people's governments at or above the county level shall, in schistosomiasis prevention and control areas, carry out comprehensive schistosomiasis prevention and control in combination with waterway engineering construction.
国务院卫生主管部门应当根据血吸虫病流行病学资料、钉螺分布以及孳生环境的特点、药物特性，制定药物杀灭钉螺工作规范。
The health authority of the State Council shall, based on schistosomiasis epidemiological data, the distribution of Oncomelania snails and characteristics of their breeding environment, and drug properties, formulate work specifications for drug snail elimination.
血吸虫病防治地区县级人民政府及其卫生主管部门应当根据药物杀灭钉螺工作规范，组织实施本行政区域内的药物杀灭钉螺工作。
The county-level people's government and its health authority in schistosomiasis prevention and control areas shall, in accordance with the work specifications for drug snail elimination, organize and implement drug snail elimination work within their administrative regions.
血吸虫病防治地区乡(镇)人民政府应当在实施药物杀灭钉螺7日前，公告施药的时间、地点、种类、方法、影响范围和注意事项。有关单位和个人应当予以配合。
The township (town) people's government in schistosomiasis prevention and control areas shall, 7 days before implementing drug-based snail elimination, announce the time, location, type, method, affected scope, and precautions of the drug application. Relevant units and individuals shall cooperate.
杀灭钉螺严禁使用国家明令禁止使用的药物。
It is strictly prohibited to use drugs explicitly banned by the state for snail elimination.
血吸虫病防治地区县级人民政府卫生主管部门会同同级人民政府农业或者兽医、水利、林业主管部门，根据血吸虫病监测等流行病学资料，划定、变更有钉螺地带，并报本级人民政府批准。县级人民政府应当及时公告有钉螺地带。
The health administrative department of the county people's government in schistosomiasis prevention and control areas, together with the agriculture or veterinary, water conservancy, and forestry administrative departments of the same level, shall delineate and modify snail-infested zones based on epidemiological data such as schistosomiasis monitoring, and report to the people's government at the same level for approval. The county people's government shall promptly announce snail-infested zones.
禁止在有钉螺地带放养牛、羊、猪等家畜，禁止引种在有钉螺地带培育的芦苇等植物和农作物的种子、种苗等繁殖材料。
It is prohibited to graze livestock such as cattle, sheep, and pigs in snail-infested zones, and to introduce seeds, seedlings, or other propagating materials of plants such as reeds and crops cultivated in snail-infested zones.
乡(镇)人民政府应当在有钉螺地带设立警示标志，并在县级人民政府作出解除有钉螺地带决定后予以撤销。警示标志由乡(镇)人民政府负责保护，所在地村民委员会、居民委员会应当予以协助。任何单位或者个人不得损坏或者擅自移动警示标志。
The township (town) people's government shall set up warning signs in snail-infested zones and remove them after the county people's government decides to lift the snail-infested zone designation. The warning signs shall be protected by the township (town) people's government, and the local villagers' committees and residents' committees shall assist. No unit or individual may damage or move the warning signs without authorization.
在有钉螺地带完成杀灭钉螺后，由原批准机关决定并公告解除本条第二款规定的禁止行为。
After snail elimination is completed in a snail-infested zone, the original approving authority shall decide and announce the lifting of the prohibitions specified in the second paragraph of this article.
医疗机构、疾病预防控制机构、动物防疫监督机构和植物检疫机构应当根据血吸虫病防治技术规范，在各自的职责范围内，开展血吸虫病的监测、筛查、预测、流行病学调查、疫情报告和处理工作，开展杀灭钉螺、血吸虫病防治技术指导以及其他防治工作。
Medical institutions, disease prevention and control institutions, animal epidemic prevention supervision institutions, and plant quarantine institutions shall, in accordance with the technical specifications for schistosomiasis prevention and control, carry out monitoring, screening, prediction, epidemiological investigation, epidemic reporting and handling, snail elimination, technical guidance for schistosomiasis prevention and control, and other prevention and control work within their respective responsibilities.
血吸虫病防治地区的医疗机构、疾病预防控制机构、动物防疫监督机构和植物检疫机构应当定期对其工作人员进行血吸虫病防治知识、技能的培训和考核。
Medical institutions, disease prevention and control institutions, animal epidemic prevention supervision institutions, and plant quarantine institutions in schistosomiasis prevention and control areas shall regularly conduct training and assessment of their staff on schistosomiasis prevention and control knowledge and skills.
建设单位在血吸虫病防治地区兴建水利、交通、旅游、能源等大型建设项目，应当事先提请省级以上疾病预防控制机构对施工环境进行卫生调查，并根据疾病预防控制机构的意见，采取必要的血吸虫病预防、控制措施。施工期间，建设单位应当设专人负责工地上的血吸虫病防治工作；工程竣工后，应当告知当地县级疾病预防控制机构，由其对该地区的血吸虫病进行监测。
Construction units undertaking large-scale construction projects such as water conservancy, transportation, tourism, and energy in schistosomiasis prevention and control areas shall, in advance, request disease prevention and control institutions at or above the provincial level to conduct a health survey of the construction environment, and take necessary schistosomiasis prevention and control measures based on the opinions of the disease prevention and control institutions. During construction, the construction unit shall assign dedicated personnel to be responsible for schistosomiasis prevention and control work on the construction site; after project completion, the construction unit shall inform the local county-level disease prevention and control institution, which shall monitor schistosomiasis in the area.
疫情控制
Epidemic Control
血吸虫病防治地区县级以上地方人民政府应当根据有关法律、行政法规和国家有关规定，结合本地实际，制定血吸虫病应急预案。
Local people's governments at or above the county level in schistosomiasis prevention and control areas shall, in accordance with relevant laws, administrative regulations, and relevant state provisions, and in light of local realities, formulate schistosomiasis emergency plans.
急性血吸虫病暴发、流行时，县级以上地方人民政府应当根据控制急性血吸虫病暴发、流行的需要，依照传染病防治法和其他有关法律的规定采取紧急措施，进行下列应急处理：
When an acute schistosomiasis outbreak or epidemic occurs, local people's governments at or above the county level shall, based on the need to control the outbreak or epidemic, take emergency measures in accordance with the Law on the Prevention and Treatment of Infectious Diseases and other relevant laws, and carry out the following emergency responses:
(一)组织医疗机构救治急性血吸虫病病人；
(1) Organize medical institutions to treat patients with acute schistosomiasis;
(二)组织疾病预防控制机构和动物防疫监督机构分别对接触疫水的人和家畜实施预防性服药；
(2) Organize disease prevention and control institutions and animal epidemic prevention supervision institutions to administer preventive medication to persons and livestock that have been in contact with infested water;
(三)组织有关部门和单位杀灭钉螺和处理疫水；
(3) Organize relevant departments and units to kill Oncomelania snails and treat infested water;
(四)组织乡(镇)人民政府在有钉螺地带设置警示标志，禁止人和家畜接触疫水。
(4) Organize township (town) people's governments to set up warning signs in snail-infested areas, prohibiting persons and livestock from contacting infested water.
疾病预防控制机构发现急性血吸虫病疫情或者接到急性血吸虫病暴发、流行报告时，应当及时采取下列措施：
When a disease prevention and control institution discovers an acute schistosomiasis epidemic or receives a report of an acute schistosomiasis outbreak or epidemic, it shall promptly take the following measures:
(一)进行现场流行病学调查；
(1) Conduct field epidemiological investigations;
(二)提出疫情控制方案，明确有钉螺地带范围、预防性服药的人和家畜范围，以及采取杀灭钉螺和处理疫水的措施；
(2) Propose an epidemic control plan, specifying the scope of snail-infested areas, the scope of persons and livestock requiring preventive medication, and measures for killing snails and treating infested water;
(三)指导医疗机构和下级疾病预防控制机构处理疫情；
(3) Guide medical institutions and lower-level disease prevention and control institutions in handling the epidemic.
(四)卫生主管部门要求采取的其他措施。
(4) Other measures required by the competent health department.
有关单位对因生产、工作必须接触疫水的人员应当按照疾病预防控制机构的要求采取防护措施，并定期组织进行血吸虫病的专项体检。
Relevant units shall, in accordance with the requirements of disease prevention and control institutions, take protective measures for personnel who must come into contact with epidemic water due to production or work, and shall regularly organize special physical examinations for schistosomiasis.
血吸虫病防治地区地方各级人民政府及其有关部门对因防汛、抗洪抢险必须接触疫水的人员，应当按照疾病预防控制机构的要求采取防护措施。血吸虫病防治地区县级人民政府对参加防汛、抗洪抢险的人员，应当及时组织有关部门和机构进行血吸虫病的专项体检。
Local people's governments at all levels and their relevant departments in schistosomiasis prevention and control areas shall, in accordance with the requirements of disease prevention and control institutions, take protective measures for personnel who must come into contact with epidemic water due to flood control and flood rescue. The county people's government in schistosomiasis prevention and control areas shall promptly organize relevant departments and institutions to conduct special physical examinations for schistosomiasis for personnel participating in flood control and flood rescue.
血吸虫病防治地区县级以上地方人民政府卫生、农业或者兽医主管部门应当根据血吸虫病防治技术规范，组织开展对本地村民、居民和流动人口血吸虫病以及家畜血吸虫病的筛查、治疗和预防性服药工作。
The competent health, agriculture, or veterinary departments of local people's governments at or above the county level in schistosomiasis prevention and control areas shall, in accordance with the technical specifications for schistosomiasis prevention and control, organize the screening, treatment, and preventive medication work for local villagers, residents, and floating population for schistosomiasis, as well as for livestock schistosomiasis.
血吸虫病防治地区省、自治区、直辖市人民政府应当采取措施，组织对晚期血吸虫病病人的治疗。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government in schistosomiasis prevention and control areas shall take measures to organize the treatment of patients with advanced schistosomiasis.
血吸虫病防治地区的动物防疫监督机构、植物检疫机构应当加强对本行政区域内的家畜和植物的血吸虫病检疫工作。动物防疫监督机构对经检疫发现的患血吸虫病的家畜，应当实施药物治疗；植物检疫机构对发现的携带钉螺的植物，应当实施杀灭钉螺。
Animal epidemic prevention supervision institutions and plant quarantine institutions in schistosomiasis prevention and control areas shall strengthen the quarantine work for schistosomiasis in livestock and plants within their administrative regions. Animal epidemic prevention supervision institutions shall implement drug treatment for livestock found to be infected with schistosomiasis through quarantine; plant quarantine institutions shall implement snail eradication for plants found to carry Oncomelania snails.
凡患血吸虫病的家畜、携带钉螺的植物，在血吸虫病防治地区未经检疫的家畜、植物，一律不得出售、外运。
Any livestock infected with schistosomiasis or plants carrying Oncomelania snails, as well as livestock and plants that have not been quarantined in schistosomiasis prevention and control areas, shall not be sold or transported out.
血吸虫病疫情的报告、通报和公布，依照传染病防治法和动物防疫法的有关规定执行。
The reporting, notification, and publication of schistosomiasis epidemic situations shall be carried out in accordance with the relevant provisions of the Law on the Prevention and Control of Infectious Diseases and the Animal Epidemic Prevention Law.
保障措施
Safeguard Measures
血吸虫病防治地区县级以上地方人民政府应当根据血吸虫病防治规划、计划，安排血吸虫病防治经费和基本建设投资，纳入同级财政预算。
Local people's governments at or above the county level in schistosomiasis prevention and control areas shall, in accordance with the schistosomiasis prevention and control plans and programs, arrange for schistosomiasis prevention and control funds and capital construction investment, and incorporate them into the fiscal budget at the same level.
省、自治区、直辖市人民政府和设区的市级人民政府根据血吸虫病防治工作需要，对经济困难的县级人民政府开展血吸虫病防治工作给予适当补助。
The people's governments of provinces, autonomous regions, municipalities directly under the Central Government, and cities divided into districts shall, based on the needs of schistosomiasis prevention and control work, provide appropriate subsidies to county-level people's governments with economic difficulties in carrying out schistosomiasis prevention and control work.
国家对经济困难地区的血吸虫病防治经费、血吸虫病重大疫情应急处理经费给予适当补助，对承担血吸虫病防治任务的机构的基本建设和跨地区的血吸虫病防治重大工程项目给予必要支持。
The state provides appropriate subsidies for schistosomiasis prevention and control funds and emergency response funds for major schistosomiasis outbreaks in economically difficult areas, and provides necessary support for the basic construction of institutions undertaking schistosomiasis prevention and control tasks and for major cross-regional schistosomiasis prevention and control projects.
血吸虫病防治地区县级以上地方人民政府编制或者审批血吸虫病防治地区的农业、兽医、水利、林业等工程项目，应当将有关血吸虫病防治的工程措施纳入项目统筹安排。
When preparing or approving agricultural, veterinary, water conservancy, forestry and other engineering projects in schistosomiasis prevention and control areas, local people's governments at or above the county level in schistosomiasis prevention and control areas shall incorporate relevant schistosomiasis prevention and control engineering measures into the overall project planning.
国家对农民免费提供抗血吸虫基本预防药物，对经济困难农民的血吸虫病治疗费用予以减免。
The state provides free basic anti-schistosomiasis preventive drugs to farmers, and reduces or exempts the treatment costs for farmers with economic difficulties.
因工作原因感染血吸虫病的，依照《工伤保险条例》的规定，享受工伤待遇。参加城镇职工基本医疗保险的血吸虫病病人，不属于工伤的，按照国家规定享受医疗保险待遇。对未参加工伤保险、医疗保险的人员因防汛、抗洪抢险患血吸虫病的，按照县级以上地方人民政府的规定解决所需的检查、治疗费用。
Persons infected with schistosomiasis due to work reasons shall enjoy work-related injury benefits in accordance with the provisions of the Regulations on Work-Related Injury Insurance. Schistosomiasis patients who participate in basic medical insurance for urban workers and whose illness is not work-related shall enjoy medical insurance benefits in accordance with state regulations. For persons who are not covered by work-related injury insurance or medical insurance and contract schistosomiasis due to flood control or flood fighting, the required examination and treatment costs shall be resolved in accordance with the provisions of local people's governments at or above the county level.
血吸虫病防治地区县级以上地方人民政府民政、医疗保障部门对符合救助条件的血吸虫病病人进行救助。
The civil affairs and medical security departments of local people's governments at or above the county level in schistosomiasis prevention and control areas shall provide assistance to schistosomiasis patients who meet the conditions for assistance.
国家对家畜免费实施血吸虫病检查和治疗，免费提供抗血吸虫基本预防药物。
The state provides free schistosomiasis examination and treatment for livestock, and provides free basic anti-schistosomiasis preventive drugs.
血吸虫病防治地区县级以上地方人民政府应当根据血吸虫病防治工作需要和血吸虫病流行趋势，储备血吸虫病防治药物、杀灭钉螺药物和有关防护用品。
Local people's governments at or above the county level in schistosomiasis prevention and control areas shall, based on the needs of schistosomiasis prevention and control work and the epidemic trend of schistosomiasis, stockpile schistosomiasis prevention and control drugs, snail-killing drugs, and related protective supplies.
血吸虫病防治地区县级以上地方人民政府应当加强血吸虫病防治网络建设，将承担血吸虫病防治任务的机构所需基本建设投资列入基本建设计划。
Local people's governments at or above the county level in schistosomiasis prevention and control areas shall strengthen the construction of the schistosomiasis prevention and control network, and include the basic construction investment required by institutions undertaking schistosomiasis prevention and control tasks in the basic construction plan.
血吸虫病防治地区省、自治区、直辖市人民政府在制定和实施本行政区域的血吸虫病防治计划时，应当统筹协调血吸虫病防治项目和资金，确保实现血吸虫病防治项目的综合效益。
When formulating and implementing schistosomiasis prevention and control plans within their administrative regions, the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government in schistosomiasis prevention and control areas shall coordinate schistosomiasis prevention and control projects and funds to ensure the comprehensive benefits of schistosomiasis prevention and control projects.
血吸虫病防治经费应当专款专用，严禁截留或者挪作他用。严禁倒买倒卖、挪用国家免费供应的防治血吸虫病药品和其他物品。有关单位使用血吸虫病防治经费应当依法接受审计机关的审计监督。
Schistosomiasis prevention and control funds shall be used exclusively for their designated purposes, and it is strictly prohibited to withhold or divert them for other uses. It is strictly prohibited to illegally buy, sell, or misappropriate drugs and other items provided free of charge by the state for schistosomiasis prevention and control. Units using schistosomiasis prevention and control funds shall accept audit supervision by audit authorities in accordance with the law.
监督管理
Supervision and Management
县级以上人民政府卫生主管部门负责血吸虫病监测、预防、控制、治疗和疫情的管理工作，对杀灭钉螺药物的使用情况进行监督检查。
The health administrative department of the people's government at or above the county level shall be responsible for the management of schistosomiasis monitoring, prevention, control, treatment, and epidemic situations, and shall supervise and inspect the use of drugs for killing Oncomelania snails.
县级以上人民政府农业或者兽医主管部门对下列事项进行监督检查：
The agriculture or veterinary administrative department of the people's government at or above the county level shall supervise and inspect the following matters:
(一)本条例第十六条规定的血吸虫病防治措施的实施情况；
(1) The implementation of schistosomiasis prevention and control measures as stipulated in Article 16 of these Regulations;
(二)家畜血吸虫病监测、预防、控制、治疗和疫情管理工作情况；
(2) The monitoring, prevention, control, treatment, and epidemic management of livestock schistosomiasis;
(三)治疗家畜血吸虫病药物的管理、使用情况；
(3) The management and use of drugs for treating livestock schistosomiasis;
(四)农业工程项目中执行血吸虫病防治技术规范情况。
(4) The implementation of schistosomiasis prevention and control technical specifications in agricultural engineering projects.
县级以上人民政府水利主管部门对本条例第十八条规定的血吸虫病防治措施的实施情况和水利工程项目中执行血吸虫病防治技术规范情况进行监督检查。
The water conservancy administrative department of the people's government at or above the county level shall supervise and inspect the implementation of schistosomiasis prevention and control measures as stipulated in Article 18 of these Regulations and the implementation of schistosomiasis prevention and control technical specifications in water conservancy projects.
县级以上人民政府林业主管部门对血吸虫病防治地区的林业工程项目的实施情况和林业工程项目中执行血吸虫病防治技术规范情况进行监督检查。
The forestry administrative department of the people's government at or above the county level shall supervise and inspect the implementation of forestry projects in schistosomiasis prevention and control areas and the implementation of schistosomiasis prevention and control technical specifications in forestry projects.
县级以上人民政府卫生、农业或者兽医、水利、林业主管部门在监督检查过程中，发现违反或者不执行本条例规定的，应当责令有关单位和个人及时改正并依法予以处理；属于其他部门职责范围的，应当移送有监督管理职责的部门依法处理；涉及多个部门职责的，应当共同处理。
When the health, agriculture or veterinary, water conservancy, and forestry authorities of the people's governments at or above the county level discover, during supervision and inspection, any violation or non-compliance with these regulations, they shall order the relevant entity or individual to promptly correct the violation and handle it according to law; if it falls within the scope of duties of another department, it shall be transferred to the department with supervisory and management responsibilities for handling according to law; if it involves the duties of multiple departments, they shall handle it jointly.
县级以上人民政府卫生、农业或者兽医、水利、林业主管部门在履行血吸虫病防治监督检查职责时，有权进入被检查单位和血吸虫病疫情发生现场调查取证，查阅、复制有关资料和采集样本。被检查单位应当予以配合，不得拒绝、阻挠。
When performing their duties of supervision and inspection over schistosomiasis prevention and control, the health, agriculture or veterinary, water conservancy, and forestry authorities of the people's governments at or above the county level have the right to enter the entity under inspection and the site of a schistosomiasis epidemic to investigate and collect evidence, consult and copy relevant materials, and collect samples. The entity under inspection shall cooperate and shall not refuse or obstruct.
血吸虫病防治地区县级以上动物防疫监督机构对在有钉螺地带放养的牛、羊、猪等家畜，有权予以暂扣并进行强制检疫。
The animal epidemic prevention and supervision institutions at or above the county level in schistosomiasis prevention and control areas have the right to temporarily impound and conduct compulsory quarantine on livestock such as cattle, sheep, and pigs that are grazed in areas with snail habitats.
上级主管部门发现下级主管部门未及时依照本条例的规定处理职责范围内的事项，应当责令纠正，或者直接处理下级主管部门未及时处理的事项。
If a higher-level competent authority discovers that a lower-level competent authority has failed to handle matters within its scope of duties in a timely manner in accordance with these regulations, it shall order correction or directly handle the matters that the lower-level competent authority failed to handle in a timely manner.
法律责任
Legal Liability
县级以上地方各级人民政府有下列情形之一的，由上级人民政府责令改正，通报批评；造成血吸虫病传播、流行或者其他严重后果的，对负有责任的主管人员，依法给予行政处分；负有责任的主管人员构成犯罪的，依法追究刑事责任：
If a local people's government at or above the county level falls under any of the following circumstances, the higher-level people's government shall order correction and circulate a notice of criticism; if it causes the spread or epidemic of schistosomiasis or other serious consequences, administrative sanctions shall be imposed on the responsible persons in charge according to law; if the responsible persons in charge constitute a crime, criminal liability shall be pursued according to law:
(一)未依照本条例的规定开展血吸虫病联防联控的；
(1) Failing to carry out joint prevention and control of schistosomiasis in accordance with these regulations;
(二)急性血吸虫病暴发、流行时，未依照本条例的规定采取紧急措施、进行应急处理的；
(2) When acute schistosomiasis outbreaks or becomes epidemic, failing to take emergency measures or conduct emergency response in accordance with these regulations;
(三)未履行血吸虫病防治组织、领导、保障职责的；
(3) Failing to fulfill the duties of organizing, leading, and ensuring schistosomiasis prevention and control;
(四)未依照本条例的规定采取其他血吸虫病防治措施的。
(4) Failing to take other schistosomiasis prevention and control measures in accordance with these regulations.
乡(镇)人民政府未依照本条例的规定采取血吸虫病防治措施的，由上级人民政府责令改正，通报批评；造成血吸虫病传播、流行或者其他严重后果的，对负有责任的主管人员，依法给予行政处分；负有责任的主管人员构成犯罪的，依法追究刑事责任。
If a township (town) people's government fails to take schistosomiasis prevention and control measures in accordance with these Regulations, the superior people's government shall order correction and circulate a notice of criticism; if the failure causes the spread or epidemic of schistosomiasis or other serious consequences, the responsible person in charge shall be given administrative sanctions according to law; if the responsible person in charge constitutes a crime, criminal liability shall be pursued according to law.
县级以上人民政府有关主管部门违反本条例规定，有下列情形之一的，由本级人民政府或者上级人民政府有关主管部门责令改正，通报批评；造成血吸虫病传播、流行或者其他严重后果的，对负有责任的主管人员和其他直接责任人员依法给予行政处分；负有责任的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任：
If the relevant competent departments of the people's government at or above the county level violate these Regulations in any of the following circumstances, the people's government at the same level or the relevant competent department of the superior people's government shall order correction and circulate a notice of criticism; if the violation causes the spread or epidemic of schistosomiasis or other serious consequences, the responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; if the responsible person in charge and other directly responsible personnel constitute a crime, criminal liability shall be pursued according to law:
(一)在组织实施农村改厕、沼气池建设项目时，未按照无害化要求和血吸虫病防治技术规范，保证厕所或者沼气池具备杀灭粪便中血吸虫卵功能的；
(1) When organizing the implementation of rural toilet renovation or biogas digester construction projects, failing to ensure that the toilets or biogas digesters have the function of killing schistosomiasis eggs in feces in accordance with harmless treatment requirements and schistosomiasis prevention and control technical specifications;
(二)在血吸虫病重点防治地区未开展家畜血吸虫病检查，或者未对感染血吸虫的家畜进行治疗、处理的；
(2) In key schistosomiasis prevention and control areas, failing to conduct livestock schistosomiasis inspections, or failing to treat or dispose of livestock infected with schistosomiasis;
(三)在血吸虫病防治地区进行水利建设项目，未同步建设血吸虫病防治设施，或者未结合血吸虫病防治地区的江河、湖泊治理工程和人畜饮水、灌区改造等水利工程项目，改善水环境，导致钉螺孳生的；
(3) When conducting water conservancy construction projects in schistosomiasis prevention and control areas, failing to simultaneously construct schistosomiasis prevention and control facilities, or failing to improve the water environment in conjunction with river and lake management projects, human and livestock drinking water, irrigation area renovation and other water conservancy projects in schistosomiasis prevention and control areas, resulting in the breeding of Oncomelania snails;
(四)在血吸虫病防治地区未结合退耕还林、长江防护林建设、野生动物植物保护、湿地保护以及自然保护区建设等林业工程，开展血吸虫病综合防治的；
(4) In schistosomiasis prevention and control areas, failing to carry out comprehensive schistosomiasis prevention and control in conjunction with forestry projects such as returning farmland to forest, construction of the Yangtze River shelterbelt, wildlife and plant protection, wetland protection, and nature reserve construction;
(五)未制定药物杀灭钉螺规范，或者未组织实施本行政区域内药物杀灭钉螺工作的；
(5) Failing to formulate specifications for chemical snail killing, or failing to organize the implementation of chemical snail killing work within their administrative region;
(六)未组织开展血吸虫病筛查、治疗和预防性服药工作的；
(6) Failing to organize and carry out schistosomiasis screening, treatment, and preventive medication work;
(七)未依照本条例规定履行监督管理职责，或者发现违法行为不及时查处的；
(7) Failing to perform supervision and management duties in accordance with these Regulations, or failing to investigate and deal with illegal acts in a timely manner;
(八)有违反本条例规定的其他失职、渎职行为的。
(8) Other acts of dereliction of duty or malfeasance in violation of these Regulations.
医疗机构、疾病预防控制机构、动物防疫监督机构或者植物检疫机构违反本条例规定，有下列情形之一的，由县级以上人民政府卫生主管部门、农业或者兽医主管部门依据各自职责责令限期改正，通报批评，给予警告；逾期不改正，造成血吸虫病传播、流行或者其他严重后果的，对负有责任的主管人员和其他直接责任人员依法给予降级、撤职、开除的处分，并可以依法吊销有关责任人员的执业证书；负有责任的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任：
If a medical institution, disease prevention and control institution, animal epidemic prevention supervision institution, or plant quarantine institution violates these regulations under any of the following circumstances, the competent health department, agriculture or veterinary department of the people's government at or above the county level shall, within their respective duties, order correction within a time limit, circulate a notice of criticism, and give a warning; if correction is not made within the time limit, causing the spread or epidemic of schistosomiasis or other serious consequences, the responsible persons in charge and other directly responsible personnel shall be given demotion, removal from office, or expulsion according to law, and the practice certificates of the relevant responsible persons may be revoked according to law; if the responsible persons in charge and other directly responsible personnel constitute a crime, criminal liability shall be pursued according to law:
(一)未依照本条例规定开展血吸虫病防治工作的；
(1) failing to carry out schistosomiasis prevention and control work in accordance with these regulations;
(二)未定期对其工作人员进行血吸虫病防治知识、技能培训和考核的；
(2) failing to regularly conduct training and assessment of schistosomiasis prevention and control knowledge and skills for their staff;
(三)发现急性血吸虫病疫情或者接到急性血吸虫病暴发、流行报告时，未及时采取措施的；
(3) failing to take timely measures upon discovering an acute schistosomiasis epidemic or receiving a report of an acute schistosomiasis outbreak or epidemic;
(四)未对本行政区域内出售、外运的家畜或者植物进行血吸虫病检疫的；
(4) failing to conduct schistosomiasis quarantine on livestock or plants sold or transported out of their administrative region;
(五)未对经检疫发现的患血吸虫病的家畜实施药物治疗，或者未对发现的携带钉螺的植物实施杀灭钉螺的。
(5) failing to administer drug treatment to livestock found to be infected with schistosomiasis through quarantine, or failing to eliminate snails found on plants carrying Oncomelania snails.
建设单位在血吸虫病防治地区兴建水利、交通、旅游、能源等大型建设项目，未事先提请省级以上疾病预防控制机构进行卫生调查，或者未根据疾病预防控制机构的意见，采取必要的血吸虫病预防、控制措施的，由县级以上人民政府卫生主管部门责令限期改正，给予警告，处5000元以上3万元以下的罚款；逾期不改正的，处3万元以上10万元以下的罚款，并可以提请有关人民政府依据职责权限，责令停建、关闭；造成血吸虫病疫情扩散或者其他严重后果的，对负有责任的主管人员和其他直接责任人员依法给予处分。
If a construction unit, when building large-scale projects such as water conservancy, transportation, tourism, or energy in schistosomiasis prevention and control areas, fails to first request a health survey from a disease prevention and control institution at or above the provincial level, or fails to take necessary schistosomiasis prevention and control measures based on the opinions of the disease prevention and control institution, the competent health department of the people's government at or above the county level shall order correction within a time limit, give a warning, and impose a fine of not less than 5,000 yuan but not more than 30,000 yuan; if correction is not made within the time limit, a fine of not less than 30,000 yuan but not more than 100,000 yuan shall be imposed, and the relevant people's government may be requested, within its authority, to order suspension of construction or closure; if the spread of schistosomiasis epidemic or other serious consequences are caused, the responsible persons in charge and other directly responsible personnel shall be given sanctions according to law.
单位和个人损坏或者擅自移动有钉螺地带警示标志的，由乡(镇)人民政府责令修复或者赔偿损失，给予警告；情节严重的，对单位处1000元以上3000元以下的罚款，对个人处50元以上200元以下的罚款。
If a unit or individual damages or moves without authorization a warning sign in a snail-infested area, the township (town) people's government shall order restoration or compensation for losses and give a warning; if the circumstances are serious, a fine of not less than 1,000 yuan but not more than 3,000 yuan shall be imposed on the unit, and a fine of not less than 50 yuan but not more than 200 yuan shall be imposed on the individual.
违反本条例规定，有下列情形之一的，由县级以上人民政府卫生、农业或者兽医、水利、林业主管部门依据各自职责责令改正，给予警告，对单位处1000元以上1万元以下的罚款，对个人处50元以上500元以下的罚款，并没收用于违法活动的工具和物品；造成血吸虫病疫情扩散或者其他严重后果的，对负有责任的主管人员和其他直接责任人员依法给予处分：
If, in violation of these regulations, any of the following circumstances occurs, the competent health, agriculture or veterinary, water conservancy, or forestry department of the people's government at or above the county level shall, within their respective duties, order correction, give a warning, impose a fine of not less than 1,000 yuan but not more than 10,000 yuan on the unit, and a fine of not less than 50 yuan but not more than 500 yuan on the individual, and confiscate the tools and articles used for the illegal activities; if the spread of schistosomiasis epidemic or other serious consequences are caused, the responsible persons in charge and other directly responsible personnel shall be given sanctions according to law:
(一)单位未依照本条例的规定对因生产、工作必须接触疫水的人员采取防护措施，或者未定期组织进行血吸虫病的专项体检的；
(1) a unit fails to take protective measures for personnel who must come into contact with epidemic water due to production or work in accordance with these regulations, or fails to regularly organize special physical examinations for schistosomiasis;
(二)对政府有关部门采取的预防、控制措施不予配合的；
(2) Failing to cooperate with the prevention and control measures taken by relevant government departments;
(三)使用国家明令禁止使用的药物杀灭钉螺的；
(3) Using drugs explicitly prohibited by the state to kill Oncomelania snails;
(四)引种在有钉螺地带培育的芦苇等植物或者农作物的种子、种苗等繁殖材料的；
(4) Introducing seeds, seedlings, or other propagation materials of reeds or other plants cultivated in snail-infested areas;
(五)在血吸虫病防治地区施用未经无害化处理粪便的。
(5) Applying untreated feces in schistosomiasis prevention and control areas.
附则
Supplementary Provisions
本条例下列用语的含义：
The meanings of the following terms in these Regulations are:
血吸虫病，是血吸虫寄生于人体或者哺乳动物体内，导致其发病的一种寄生虫病。
Schistosomiasis is a parasitic disease caused by schistosomes parasitizing the human body or the bodies of mammals, leading to illness.
疫水，是指含有血吸虫尾蚴的水体。
Infected water refers to water bodies containing schistosome cercariae.
本条例自2006年5月1日起施行。
These Regulations shall come into force as of May 1, 2006.
