为了发挥中国人民解放军(以下称军队)在抢险救灾中的作用，保护人民生命和财产安全，根据国防法的规定，制定本条例。
These Regulations are formulated in accordance with the provisions of the National Defense Law to give full play to the role of the People's Liberation Army (hereinafter referred to as the armed forces) in emergency rescue and disaster relief, and to protect the safety of people's lives and property.
军队是抢险救灾的突击力量，执行国家赋予的抢险救灾任务是军队的重要使命。
The armed forces are the assault force for emergency rescue and disaster relief, and it is an important mission of the armed forces to perform the tasks of emergency rescue and disaster relief assigned by the state.
各级人民政府和军事机关应当按照本条例的规定，做好军队参加抢险救灾的组织、指挥、协调、保障等工作。
People's governments at all levels and military organs shall, in accordance with the provisions of these Regulations, do a good job in the organization, command, coordination, and support of the armed forces' participation in emergency rescue and disaster relief.
军队参加抢险救灾主要担负下列任务：
The armed forces participating in emergency rescue and disaster relief mainly undertake the following tasks:
(一)解救、转移或者疏散受困人员；
(1) Rescuing, transferring, or evacuating trapped persons;
(二)保护重要目标安全；
(2) Protecting the safety of important targets;
(三)抢救、运送重要物资；
(3) Rescuing and transporting important materials;
(四)参加道路(桥梁、隧道)抢修、海上搜救、核生化救援、疫情控制、医疗救护等专业抢险；
(4) Participating in professional rescue operations such as road (bridge, tunnel) repair, maritime search and rescue, nuclear, biological, and chemical rescue, epidemic control, and medical aid;
(五)排除或者控制其他危重险情、灾情。
(5) Eliminating or controlling other critical dangers and disasters.
必要时，军队可以协助地方人民政府开展灾后重建等工作。
When necessary, the armed forces may assist local people's governments in post-disaster reconstruction and other work.
国务院组织的抢险救灾需要军队参加的，由国务院有关主管部门向中国人民解放军总参谋部提出，中国人民解放军总参谋部按照国务院、中央军事委员会的有关规定办理。
If emergency rescue and disaster relief organized by the State Council requires the participation of the armed forces, the relevant competent department of the State Council shall submit a request to the General Staff Headquarters of the People's Liberation Army, and the General Staff Headquarters of the People's Liberation Army shall handle the matter in accordance with the relevant provisions of the State Council and the Central Military Commission.
县级以上地方人民政府组织的抢险救灾需要军队参加的，由县级以上地方人民政府通过当地同级军事机关提出，当地同级军事机关按照国务院、中央军事委员会的有关规定办理。
If emergency rescue and disaster relief organized by a local people's government at or above the county level requires the participation of the armed forces, the local people's government at or above the county level shall submit a request through the local military organ at the same level, and the local military organ at the same level shall handle the matter in accordance with the relevant provisions of the State Council and the Central Military Commission.
在险情、灾情紧急的情况下，地方人民政府可以直接向驻军部队提出救助请求，驻军部队应当按照规定立即实施救助，并向上级报告；驻军部队发现紧急险情、灾情也应当按照规定立即实施救助，并向上级报告。
In the event of an emergency situation of danger or disaster, the local people's government may directly submit a request for assistance to the stationed troops, and the stationed troops shall immediately provide assistance in accordance with the provisions and report to their superiors; if the stationed troops discover an emergency danger or disaster, they shall also immediately provide assistance in accordance with the provisions and report to their superiors.
抢险救灾需要动用军用飞机(直升机)、舰艇的，按照有关规定办理。
If emergency rescue and disaster relief requires the use of military aircraft (helicopters) or naval vessels, the matter shall be handled in accordance with the relevant provisions.
国务院有关主管部门、县级以上地方人民政府提出需要军队参加抢险救灾的，应当说明险情或者灾情发生的种类、时间、地域、危害程度、已经采取的措施，以及需要使用的兵力、装备等情况。
When the relevant competent department of the State Council or a local people's government at or above the county level requests the participation of the armed forces in emergency rescue and disaster relief, it shall specify the type, time, location, extent of harm, measures already taken, and the required troops and equipment for the danger or disaster.
县级以上地方人民政府组建的抢险救灾指挥机构，应当有当地同级军事机关的负责人参加；当地有驻军部队的，还应当有驻军部队的负责人参加。
The emergency rescue and disaster relief command organization established by a local people's government at or above the county level shall include the responsible person of the local military organ at the same level; if there are stationed troops in the locality, the responsible person of the stationed troops shall also be included.
军队参加抢险救灾应当在人民政府的统一领导下进行，具体任务由抢险救灾指挥机构赋予，部队的抢险救灾行动由军队负责指挥。
The armed forces participating in emergency rescue and disaster relief shall operate under the unified leadership of the people's government, with specific tasks assigned by the emergency rescue and disaster relief command organization, and the military's rescue and relief operations shall be commanded by the armed forces.
县级以上地方人民政府应当向当地军事机关及时通报有关险情、灾情的信息。
A local people's government at or above the county level shall promptly notify the local military organ of information concerning relevant dangers and disasters.
在经常发生险情、灾情的地方，县级以上地方人民政府应当组织军地双方进行实地勘察和抢险救灾演习、训练。
In areas where dangers and disasters frequently occur, the local people's government at or above the county level shall organize military and local parties to conduct on-site surveys and emergency rescue and disaster relief exercises and training.
省军区(卫戍区、警备区)、军分区(警备区)、县(市、市辖区)人民武装部应当及时掌握当地有关险情、灾情信息，办理当地人民政府提出的军队参加抢险救灾事宜，做好人民政府与执行抢险救灾任务的部队之间的协调工作。有关军事机关应当制定参加抢险救灾预案，组织部队开展必要的抢险救灾训练。
The provincial military command (garrison command, garrison district), military sub-command (garrison sub-command), and county (city, municipal district) people's armed forces department shall promptly grasp information on local dangers and disasters, handle matters concerning the participation of the armed forces in emergency rescue and disaster relief as proposed by the local people's government, and coordinate between the people's government and the troops performing emergency rescue and disaster relief tasks. Relevant military organs shall formulate plans for participating in emergency rescue and disaster relief and organize troops to carry out necessary rescue and relief training.
军队参加抢险救灾时，当地人民政府应当提供必要的装备、物资、器材等保障，派出专业技术人员指导部队的抢险救灾行动；铁路、交通、民航、公安、电信、邮政、金融等部门和机构，应当为执行抢险救灾任务的部队提供优先、便捷的服务。
When the armed forces participate in emergency rescue and disaster relief, the local people's government shall provide necessary equipment, materials, and apparatus, and dispatch professional and technical personnel to guide the troops' rescue and relief operations; railway, transportation, civil aviation, public security, telecommunications, postal, and financial departments and institutions shall provide priority and convenient services to the troops performing rescue and relief tasks.
军队执行抢险救灾任务所需要的燃油，由执行抢险救灾任务的部队和当地人民政府共同组织保障。
The fuel required for the armed forces to perform emergency rescue and disaster relief tasks shall be jointly organized and ensured by the troops performing the tasks and the local people's government.
军队参加抢险救灾需要动用作战储备物资和装备器材的，必须按照规定报经批准。对消耗的部队携行装备器材和作战储备物资、装备器材，应当及时补充。
If the armed forces participating in emergency rescue and disaster relief need to use operational reserve materials and equipment, approval must be obtained in accordance with the provisions. Consumed equipment and materials carried by the troops, as well as operational reserve materials and equipment, shall be replenished in a timely manner.
灾害发生地人民政府应当协助执行抢险救灾任务的部队做好饮食、住宿、供水、供电、供暖、医疗和卫生防病等必需的保障工作。
The people's government of the disaster-affected area shall assist the troops performing emergency rescue and disaster relief tasks in providing necessary support such as food, accommodation, water supply, power supply, heating, medical care, and sanitation and disease prevention.
地方人民政府与执行抢险救灾任务的部队应当互相通报疫情，共同做好卫生防疫工作。
Local people's governments and the troops performing emergency rescue and disaster relief tasks shall notify each other of epidemic situations and jointly carry out health and epidemic prevention work.
军队参加国务院组织的抢险救灾所耗费用由中央财政负担。军队参加地方人民政府组织的抢险救灾所耗费用由地方财政负担。
The expenses incurred by the armed forces in participating in emergency rescue and disaster relief organized by the State Council shall be borne by the central finance. The expenses incurred by the armed forces in participating in emergency rescue and disaster relief organized by local people's governments shall be borne by local finances.
前款所指的费用包括：购置专用物资和器材费用，指挥通信、装备维修、燃油、交通运输等费用，补充消耗的携行装备器材和作战储备物资费用，以及人员生活、医疗的补助费用。
The expenses referred to in the preceding paragraph include: expenses for purchasing special materials and equipment; expenses for command communications, equipment maintenance, fuel, transportation, etc.; expenses for replenishing consumed portable equipment and operational reserve materials; and subsidy expenses for personnel living and medical care.
抢险救灾任务完成后，军队有关部门应当及时统计军队执行抢险救灾任务所耗费用，报抢险救灾指挥机构审核。
After the completion of emergency rescue and disaster relief tasks, the relevant military departments shall promptly calculate the expenses incurred by the armed forces in performing the tasks and submit them to the emergency rescue and disaster relief command organization for review.
国务院有关主管部门和县级以上地方人民政府应当在险情、灾情频繁发生或者列为灾害重点监视防御的地区储备抢险救灾专用装备、物资和器材，保障抢险救灾需要。
The relevant competent departments of the State Council and local people's governments at or above the county level shall reserve special equipment, materials, and supplies for emergency rescue and disaster relief in areas where dangers and disasters occur frequently or are designated as key disaster monitoring and defense areas, to ensure the needs of emergency rescue and disaster relief.
军队参加重大抢险救灾行动的宣传报道，由国家和军队有关主管部门统一组织实施。新闻单位采访、报道军队参加抢险救灾行动，应当遵守国家和军队的有关规定。
The publicity and reporting of the armed forces' participation in major emergency rescue and disaster relief operations shall be uniformly organized and implemented by the relevant competent departments of the state and the military. News units interviewing and reporting on the armed forces' participation in emergency rescue and disaster relief operations shall comply with the relevant regulations of the state and the military.
对在执行抢险救灾任务中有突出贡献的军队单位和个人，按照国家和军队的有关规定给予奖励；对死亡或者致残的人员，按照国家有关规定给予抚恤优待。
Military units and individuals that make outstanding contributions in performing emergency rescue and disaster relief tasks shall be rewarded in accordance with the relevant regulations of the state and the military; those who die or become disabled shall be given pensions and preferential treatment in accordance with the relevant regulations of the state.
中国人民武装警察部队参加抢险救灾，参照本条例执行。
The participation of the Chinese People's Armed Police Force in emergency rescue and disaster relief shall be implemented with reference to these Regulations.
本条例自2005年7月1日起施行。
These Regulations shall come into force as of July 1, 2005.
