为了加强人民调解委员会的建设，及时调解民间纠纷，增进人民团结，维护社会安定，以利于社会主义现代化建设，制定本条例。
These Regulations are formulated to strengthen the construction of People's Mediation Committees, timely mediate civil disputes, enhance people's unity, maintain social stability, and facilitate socialist modernization.
人民调解委员会是村民委员会和居民委员会下设的调解民间纠纷的群众性组织，在基层人民政府和基层人民法院指导下进行工作。
A People's Mediation Committee is a mass organization established under a villagers' committee or a residents' committee to mediate civil disputes, and it operates under the guidance of the grassroots people's government and the grassroots people's court.
基层人民政府及其派出机关指导人民调解委员会的日常工作由司法助理员负责。
The judicial assistant is responsible for guiding the daily work of the People's Mediation Committee by the grassroots people's government and its dispatched agencies.
人民调解委员会由委员三至九人组成，设主任一人，必要时可以设副主任。
A People's Mediation Committee shall consist of three to nine members, with one director, and may have a deputy director if necessary.
人民调解委员会委员除由村民委员会成员或者居民委员会成员兼任的以外由群众选举产生，每三年改选一次，可以连选连任。
Members of the People's Mediation Committee, except those concurrently held by members of the villagers' committee or residents' committee, shall be elected by the masses, with elections held every three years, and may be re-elected.
多民族居住地区的人民调解委员会中，应当有人数较少的民族的成员。
In areas inhabited by multiple ethnic groups, the People's Mediation Committee shall include members from minority ethnic groups.
人民调解委员会委员不能任职时，由原选举单位补选。
When a member of the People's Mediation Committee is unable to hold office, a by-election shall be held by the original electoral unit.
人民调解委员会委员严重失职或者违法乱纪的，由原选举单位撤换。
A member of the People's Mediation Committee who is seriously derelict of duty or violates laws and disciplines shall be removed by the original electoral unit.
为人公正，联系群众，热心人民调解工作，并有一定法律知识和政策水平的成年公民，可以当选为人民调解委员会委员。
An adult citizen who is impartial, maintains close ties with the masses, is enthusiastic about people's mediation work, and possesses a certain level of legal knowledge and policy understanding may be elected as a member of the People's Mediation Committee.
人民调解委员会的任务为调解民间纠纷，并通过调解工作宣传法律、法规、规章和政策，教育公民遵纪守法，尊重社会公德。
The tasks of the People's Mediation Committee are to mediate civil disputes and, through mediation work, publicize laws, regulations, rules, and policies, and educate citizens to abide by the law and respect social ethics.
人民调解委员会应当向村民委员会或者居民委员会反映民间纠纷和调解工作的情况。
The People's Mediation Committee shall report to the villagers' committee or residents' committee on civil disputes and mediation work.
人民调解委员会的调解工作应当遵守以下原则：
The mediation work of the People's Mediation Committee shall adhere to the following principles:
(一)依据法律、法规、规章和政策进行调解，法律、法规、规章和政策没有明确规定的，依据社会公德进行调解；
(1) Mediation shall be conducted in accordance with laws, regulations, rules, and policies; where laws, regulations, rules, and policies have no clear provisions, mediation shall be conducted in accordance with social ethics;
(二)在双方当事人自愿平等的基础上进行调解；
(2) Mediation shall be conducted on the basis of the voluntary and equal participation of both parties;
(三)尊重当事人的诉讼权利，不得因未经调解或者调解不成而阻止当事人向人民法院起诉。
(3) The parties' right to litigation shall be respected, and no party shall be prevented from filing a lawsuit with the people's court because mediation has not been conducted or has failed.
人民调解委员会根据当事人的申请及时调解纠纷；当事人没有申请的，也可以主动调解。
The People's Mediation Committee shall mediate disputes promptly upon application by the parties; if no application is made, it may also mediate on its own initiative.
人民调解委员会调解纠纷可以由委员一人或数人进行；跨地区、跨单位的纠纷，可以由有关的各方调解组织共同调解。
Mediation of disputes by the People's Mediation Committee may be conducted by one or several members; disputes involving multiple regions or units may be mediated jointly by the relevant mediation organizations.
人民调解委员会调解纠纷，可以邀请有关单位和个人参加，被邀请的单位和个人应当给予支持。
When mediating a dispute, the People's Mediation Committee may invite relevant units and individuals to participate, and the invited units and individuals shall provide support.
人民调解委员会调解纠纷，应当在查明事实、分清是非的基础上，充分说理，耐心疏导，消除隔阂，帮助当事人达成协议。
When mediating a dispute, the People's Mediation Committee shall, on the basis of ascertaining the facts and distinguishing right from wrong, fully reason, patiently guide, eliminate estrangement, and help the parties reach an agreement.
调解纠纷应当进行登记，制作笔录，根据需要或者当事人的请求，可以制作调解协议书。调解协议书应当有双方当事人和调解人员的签名，并加盖人民调解委员会的印章。
Mediation of disputes shall be registered, and records shall be made. A mediation agreement may be prepared as needed or at the request of the parties. The mediation agreement shall be signed by both parties and the mediator(s) and affixed with the seal of the People's Mediation Committee.
人民调解委员会主持下达成的调解协议，当事人应当履行。
The parties shall perform the mediation agreement reached under the auspices of the People's Mediation Committee.
经过调解，当事人未达成协议或者达成协议后又反悔的，任何一方可以请求基层人民政府处理，也可以向人民法院起诉。
If the parties fail to reach an agreement after mediation or renege after reaching an agreement, either party may request the grassroots people's government to handle the matter or file a lawsuit with the people's court.
基层人民政府对于人民调解委员会主持下达成的调解协议，符合法律、法规、规章和政策的，应当予以支持；违背法律、法规、规章和政策的，应当予以纠正。
The grassroots people's government shall support mediation agreements reached under the auspices of the People's Mediation Committee that comply with laws, regulations, rules, and policies; and shall correct those that violate laws, regulations, rules, and policies.
人民调解委员会调解民间纠纷不收费。
The People's Mediation Committee shall not charge any fees for mediating civil disputes.
人民调解委员会委员必须遵守以下纪律：
Members of the People's Mediation Committee must abide by the following discipline:
(一)不得徇私舞弊；
(1) They shall not engage in malpractice for personal gain;
(二)不得对当事人压制、打击报复；
(2) They shall not suppress or retaliate against the parties;
(三)不得侮辱、处罚当事人；
(3) They shall not insult or punish the parties;
(四)不得泄露当事人的隐私；
(4) They shall not disclose the privacy of the parties;
(五)不得吃请受礼。
(5) They shall not accept invitations to meals or gifts.
各级人民政府对成绩显著的人民调解委员会和调解委员应当予以表彰和奖励。
People's governments at all levels shall commend and reward People's Mediation Committees and mediators that have achieved outstanding results.
对人民调解委员会委员，根据情况可以给予适当补贴。
Appropriate subsidies may be given to members of the People's Mediation Committee based on circumstances.
人民调解委员会的工作经费和调解委员的补贴经费，由村民委员会或者居民委员会解决。
The working expenses of the People's Mediation Committee and the subsidy expenses for mediators shall be borne by the villagers' committee or residents' committee.
企业、事业单位根据需要设立的人民调解委员会，参照本条例执行。
People's Mediation Committees established by enterprises and institutions as needed shall implement these regulations by reference.
本条例由司法部负责解释。
These Regulations shall be interpreted by the Ministry of Justice.
本条例自发布之日起施行。1954年3月22日原中央人民政府政务院公布的《人民调解委员会暂行组织通则》同时废止。
These Regulations shall come into force as of the date of promulgation. The Provisional General Rules for the Organization of People's Mediation Committees promulgated by the former Government Administration Council of the Central People's Government on March 22, 1954 shall be abolished simultaneously.
