为了规范法规、规章备案审查工作，提高备案审查能力和质量，加强对法规、规章的监督，维护社会主义法制的统一，根据《中华人民共和国立法法》的有关规定，制定本条例。
These Regulations are formulated in accordance with the relevant provisions of the Legislation Law of the People's Republic of China to standardize the filing and review of regulations and rules, improve the capacity and quality of filing review, strengthen the supervision of regulations and rules, and safeguard the unity of the socialist legal system.
本条例所称法规，是指省、自治区、直辖市和设区的市、自治州的人民代表大会及其常务委员会依照法定权限和程序制定的地方性法规，经济特区所在地的省、市的人民代表大会及其常务委员会依照法定权限和程序制定的经济特区法规，上海市人民代表大会及其常务委员会依照法定权限和程序制定的浦东新区法规，海南省人民代表大会及其常务委员会依照法定权限和程序制定的海南自由贸易港法规，以及自治州、自治县的人民代表大会依照法定权限和程序制定的自治条例和单行条例。
For the purposes of these Regulations, "regulations" refer to local regulations formulated by the people's congresses and their standing committees of provinces, autonomous regions, municipalities directly under the Central Government, and cities divided into districts and autonomous prefectures in accordance with statutory authority and procedures; special economic zone regulations formulated by the people's congresses and their standing committees of the provinces and cities where special economic zones are located in accordance with statutory authority and procedures; Pudong New Area regulations formulated by the Shanghai Municipal People's Congress and its Standing Committee in accordance with statutory authority and procedures; Hainan Free Trade Port regulations formulated by the Hainan Provincial People's Congress and its Standing Committee in accordance with statutory authority and procedures; and autonomous regulations and separate regulations formulated by the people's congresses of autonomous prefectures and autonomous counties in accordance with statutory authority and procedures.
本条例所称规章，包括部门规章和地方政府规章。部门规章，是指国务院各部、各委员会、中国人民银行、审计署和具有行政管理职能的直属机构以及法律规定的机构(以下统称国务院部门)根据法律和国务院的行政法规、决定、命令，在本部门的权限范围内依照《规章制定程序条例》制定的规章。地方政府规章，是指省、自治区、直辖市和设区的市、自治州的人民政府根据法律、行政法规和本省、自治区、直辖市的地方性法规，依照《规章制定程序条例》制定的规章。
For the purposes of these Regulations, "rules" include departmental rules and local government rules. Departmental rules refer to rules formulated by the ministries, commissions, the People's Bank of China, the National Audit Office, and directly affiliated agencies with administrative functions, as well as agencies prescribed by law (hereinafter collectively referred to as "State Council departments"), within their respective authorities in accordance with laws, administrative regulations, decisions, and orders of the State Council, and in accordance with the Regulations on the Procedure for Formulating Rules. Local government rules refer to rules formulated by the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, and cities divided into districts and autonomous prefectures in accordance with laws, administrative regulations, and local regulations of their respective provinces, autonomous regions, or municipalities directly under the Central Government, and in accordance with the Regulations on the Procedure for Formulating Rules.
法规、规章备案审查工作应当坚持中国共产党的领导，坚持以人民为中心，坚持有件必备、有备必审、有错必纠，依照法定权限和程序进行。
The filing and review of regulations and rules shall adhere to the leadership of the Communist Party of China, adhere to a people-centered approach, adhere to the principles that all documents that should be filed must be filed, all filed documents must be reviewed, and all errors must be corrected, and shall be conducted in accordance with statutory authority and procedures.
法规、规章公布后，应当自公布之日起30日内，依照下列规定报送备案：
After regulations and rules are promulgated, they shall be submitted for filing within 30 days from the date of promulgation in accordance with the following provisions:
(一)地方性法规、自治州和自治县的自治条例和单行条例由省、自治区、直辖市的人民代表大会常务委员会报国务院备案；
(1) Local regulations, autonomous regulations and separate regulations of autonomous prefectures and autonomous counties shall be submitted by the standing committees of the people's congresses of provinces, autonomous regions, or municipalities directly under the Central Government to the State Council for filing;
(二)部门规章由国务院部门报国务院备案，两个或者两个以上部门联合制定的规章，由主办的部门报国务院备案；
(2) Departmental rules shall be submitted by the State Council department to the State Council for filing; rules jointly formulated by two or more departments shall be submitted by the leading department to the State Council for filing;
(三)省、自治区、直辖市人民政府规章由省、自治区、直辖市人民政府报国务院备案；
(3) Rules of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall be submitted by the respective people's governments to the State Council for filing;
(四)设区的市、自治州的人民政府规章由设区的市、自治州的人民政府报国务院备案，同时报省、自治区人民政府备案；
(4) Rules of the people's governments of cities divided into districts and autonomous prefectures shall be submitted by the respective people's governments to the State Council for filing, and simultaneously to the people's government of the province or autonomous region for filing;
(五)经济特区法规由经济特区所在地的省、市的人民代表大会常务委员会报国务院备案，浦东新区法规由上海市人民代表大会常务委员会报国务院备案，海南自由贸易港法规由海南省人民代表大会常务委员会报国务院备案。
(5) Special economic zone regulations shall be submitted by the standing committees of the people's congresses of the provinces or cities where the special economic zones are located to the State Council for filing; Pudong New Area regulations shall be submitted by the Standing Committee of the Shanghai Municipal People's Congress to the State Council for filing; Hainan Free Trade Port regulations shall be submitted by the Standing Committee of the Hainan Provincial People's Congress to the State Council for filing.
国务院部门，省、自治区、直辖市和设区的市、自治州的人民政府应当依法履行规章备案职责，加强对规章备案工作的组织领导。
State Council departments and the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, and cities divided into districts and autonomous prefectures shall perform their duties of filing rules in accordance with the law and strengthen the organization and leadership of the filing of rules.
国务院部门法制机构，省、自治区、直辖市人民政府和设区的市、自治州的人民政府法制机构，具体负责本部门、本地方的规章备案工作。
The legal affairs agencies of State Council departments and the legal affairs agencies of the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, and cities divided into districts and autonomous prefectures shall be specifically responsible for the filing of rules within their respective departments or localities.
国务院备案审查工作机构依照本条例的规定负责国务院的法规、规章备案工作，履行备案审查监督职责，健全备案审查工作制度，每年向国务院报告上一年法规、规章备案审查工作情况。
The filing review working body of the State Council shall, in accordance with these Regulations, be responsible for the filing of regulations and rules with the State Council, perform the duties of filing review and supervision, improve the filing review working system, and report to the State Council annually on the filing and review of regulations and rules for the preceding year.
国务院备案审查工作机构应当通过备案审查衔接联动机制加强与其他机关备案审查工作机构的联系，在双重备案联动、移交处理、征求意见、会商协调、信息共享、能力提升等方面加强协作配合。
The filing review working body of the State Council shall, through a filing review linkage mechanism, strengthen contacts with the filing review working bodies of other organs, and enhance collaboration and coordination in areas such as dual filing linkage, referral for handling, solicitation of opinions, consultation and coordination, information sharing, and capacity improvement.
依照本条例报送国务院备案的法规、规章，径送国务院备案审查工作机构。
Regulations and rules submitted to the State Council for filing in accordance with these Regulations shall be sent directly to the filing review working body of the State Council.
报送法规备案，按照全国人民代表大会常务委员会关于法规备案的有关规定执行。
The submission of regulations for filing shall follow the relevant provisions of the Standing Committee of the National People's Congress on the filing of regulations.
报送规章备案，应当提交备案报告、规章文本和说明，并按照规定的格式装订成册，一式三份。
The submission of rules for filing shall include a filing report, the text of the rules, and an explanation, and shall be bound in the prescribed format in triplicate.
报送法规、规章备案，应当同时报送法规、规章的电子文本。
When submitting regulations and rules for filing, the electronic text of the regulations and rules shall also be submitted simultaneously.
报送法规、规章备案，符合本条例第二条和第八条第二款、第三款、第四款规定的，国务院备案审查工作机构予以备案登记；不符合第二条规定的，不予备案登记；符合第二条规定但不符合第八条第二款、第三款、第四款规定的，暂缓办理备案登记。
If the submission of regulations and rules for filing complies with Articles 2 and 8, paragraphs 2, 3, and 4 of these Regulations, the filing review working body of the State Council shall register the filing; if it does not comply with Article 2, the filing shall not be registered; if it complies with Article 2 but does not comply with Article 8, paragraphs 2, 3, and 4, the filing registration shall be deferred.
暂缓办理备案登记的，由国务院备案审查工作机构通知制定机关补充报送备案或者重新报送备案；制定机关应当自收到通知之日起15日内按照要求补充或者重新报送备案；补充或者重新报送备案符合规定的，予以备案登记。
If the filing registration is deferred, the filing review working body of the State Council shall notify the enacting authority to supplement or resubmit the filing; the enacting authority shall, within 15 days from receipt of the notice, supplement or resubmit the filing as required; if the supplemented or resubmitted filing complies with the requirements, the filing shall be registered.
经备案登记的法规、规章，由国务院备案审查工作机构按月公布目录。
The filing review working body of the State Council shall publish a monthly directory of regulations and rules that have been registered for filing.
编辑出版法规、规章汇编的范围，应当以公布的法规、规章目录为准。
The scope of edited and published compilations of regulations and rules shall be based on the published directory of regulations and rules.
国务院备案审查工作机构对报送备案的法规、规章进行主动审查，并可以根据需要进行专项审查。主动审查一般应当在审查程序启动后2个月内完成；情况疑难复杂的，为保证审查质量，可以适当延长审查期限。
The filing review working body of the State Council shall conduct proactive review of regulations and rules submitted for filing, and may conduct special reviews as needed. Proactive review shall generally be completed within two months from the initiation of the review procedure; if the circumstances are complex and difficult, the review period may be appropriately extended to ensure review quality.
国务院备案审查工作机构发现法规、规章存在涉及其他机关备案审查工作职责范围的共性问题的，可以与其他机关备案审查工作机构开展联合调研或者联合审查，共同研究提出审查意见和建议。
If the filing review working body of the State Council discovers that regulations or rules involve common issues falling within the scope of filing review responsibilities of other organs, it may conduct joint research or joint review with the filing review working bodies of other organs, and jointly study and propose review opinions and suggestions.
国家机关、社会组织、企业事业单位、公民认为地方性法规同行政法规相抵触的，或者认为规章以及国务院各部门、省、自治区、直辖市和设区的市、自治州的人民政府发布的其他具有普遍约束力的行政决定、命令同法律、行政法规相抵触的，可以向国务院书面提出审查建议，由国务院备案审查工作机构研究并提出处理意见，按照规定程序处理。
State organs, social organizations, enterprises, institutions, and citizens who believe that a local regulation conflicts with an administrative regulation, or that a rule or other universally binding administrative decision or order issued by a department of the State Council, or by the people's government of a province, autonomous region, municipality directly under the Central Government, a city divided into districts, or an autonomous prefecture conflicts with a law or administrative regulation, may submit a written review suggestion to the State Council. The State Council filing review working body shall study the suggestion, propose an opinion, and handle it in accordance with the prescribed procedures.
国务院备案审查工作机构对报送国务院备案的法规、规章，就下列事项进行审查：
The State Council filing review working body shall review the following matters concerning regulations and rules submitted for filing to the State Council:
(一)是否符合党中央、国务院的重大决策部署和国家重大改革方向；
(1) Whether they conform to the major decisions and deployments of the Party Central Committee and the State Council and the national major reform direction;
(二)是否超越权限；
(2) Whether they exceed authority;
(三)下位法是否违反上位法的规定；
(3) Whether a lower-level law violates the provisions of a higher-level law;
(四)地方性法规与部门规章之间或者不同规章之间对同一事项的规定不一致，是否应当改变或者撤销一方的或者双方的规定；
(4) Where local regulations and departmental rules, or different rules, have inconsistent provisions on the same matter, whether one or both provisions should be changed or revoked;
(五)规章的规定是否适当，规定的措施是否符合立法目的和实际情况；
(5) Whether the provisions of a rule are appropriate and whether the prescribed measures conform to the legislative purpose and actual circumstances;
(六)是否违背法定程序。
(6) Whether statutory procedures have been violated.
国务院备案审查工作机构审查法规、规章时，认为需要有关的国务院部门或者地方人民政府提出意见的，有关的机关应当在规定期限内回复；认为需要法规、规章的制定机关说明有关情况的，有关的制定机关应当在规定期限内予以说明。
When the State Council filing review working body reviews a regulation or rule and considers it necessary to seek opinions from a relevant State Council department or local people's government, the relevant organ shall reply within the prescribed time limit; if it considers it necessary for the enacting organ of the regulation or rule to explain relevant circumstances, the relevant enacting organ shall provide an explanation within the prescribed time limit.
国务院备案审查工作机构审查法规、规章时，可以通过座谈会、论证会、听证会、委托研究、实地调研等方式，听取国家机关、社会组织、企业事业单位、专家学者以及利益相关方的意见，并注重发挥备案审查专家委员会的作用。
When the State Council filing review working body reviews a regulation or rule, it may, through means such as symposiums, demonstration meetings, hearings, commissioned research, and field research, solicit opinions from state organs, social organizations, enterprises, institutions, experts and scholars, and interested parties, and shall pay attention to leveraging the role of the filing review expert committee.
经审查，地方性法规同行政法规相抵触的，由国务院备案审查工作机构移送全国人民代表大会常务委员会工作机构研究处理；必要时由国务院提请全国人民代表大会常务委员会处理。
Upon review, if a local regulation conflicts with an administrative regulation, the State Council filing review working body shall transfer the matter to the working body of the Standing Committee of the National People's Congress for study and handling; if necessary, the State Council shall submit the matter to the Standing Committee of the National People's Congress for handling.
地方性法规与部门规章之间对同一事项的规定不一致的，由国务院备案审查工作机构提出处理意见，报国务院依照《中华人民共和国立法法》的有关规定处理。
Where local regulations and departmental rules have inconsistent provisions on the same matter, the State Council filing review working body shall propose an opinion and report to the State Council for handling in accordance with the relevant provisions of the Legislation Law of the People's Republic of China.
经审查，认为规章应当予以纠正的，国务院备案审查工作机构可以通过与制定机关沟通、提出书面审查意见等方式，建议制定机关及时修改或者废止；或者由国务院备案审查工作机构提出处理意见报国务院决定，并通知制定机关。
Upon review, if a rule is considered to need correction, the State Council filing review working body may, through communication with the enacting organ or by issuing a written review opinion, suggest that the enacting organ promptly amend or repeal the rule; or the State Council filing review working body may propose an opinion and report to the State Council for a decision, and notify the enacting organ.
部门规章之间、部门规章与地方政府规章之间对同一事项的规定不一致的，由国务院备案审查工作机构进行协调；经协调不能取得一致意见的，由国务院备案审查工作机构提出处理意见报国务院决定，并通知制定机关。
Where departmental rules, or departmental rules and local government rules, have inconsistent provisions on the same matter, the State Council filing review working body shall coordinate; if no consensus can be reached through coordination, the State Council filing review working body shall propose an opinion and report to the State Council for a decision, and notify the enacting organ.
对《规章制定程序条例》规定的无效规章，国务院备案审查工作机构不予备案，并通知制定机关。
For invalid rules as stipulated in the Regulations on the Procedures for Rulemaking, the State Council filing review working body shall not accept the filing and shall notify the enacting organ.
规章在制定技术上存在问题的，国务院备案审查工作机构可以向制定机关提出处理意见，由制定机关自行处理。
If a rule has technical drafting issues, the State Council filing review working body may propose an opinion to the enacting organ, and the enacting organ shall handle it on its own.
规章的制定机关应当自接到本条例第十八条、第十九条、第二十条规定的通知之日起30日内，将处理情况报国务院备案审查工作机构。
The enacting organ of a rule shall, within 30 days from receipt of the notice under Articles 18, 19, and 20 of these Regulations, report the handling status to the State Council filing review working body.
法规、规章的制定机关应当于每年1月31日前将上一年所制定的法规、规章目录报国务院备案审查工作机构。
The enacting organ of a regulation or rule shall, before January 31 each year, submit the catalog of regulations and rules enacted in the previous year to the State Council filing review working body.
对于不报送规章备案或者不按时报送规章备案的，由国务院备案审查工作机构通知制定机关，限期报送；逾期仍不报送的，给予通报，并责令限期改正。
If a rule is not submitted for filing or is not submitted on time, the State Council filing review working body shall notify the enacting organ to submit within a specified time limit; if still not submitted after the time limit expires, a notice shall be given, and a deadline for correction shall be ordered.
国务院备案审查工作机构应当加强对省、自治区、直辖市人民政府法制机构规章备案审查工作的联系和指导，通过培训、案例指导等方式，推动省、自治区、直辖市人民政府提高规章备案审查工作能力和质量。
The State Council filing review working body shall strengthen contact and guidance with the legal affairs institutions of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government regarding the filing review of rules, and through training, case guidance, and other means, promote the improvement of the capacity and quality of rule filing review work by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government.
省、自治区、直辖市人民政府应当依法加强对下级行政机关发布的规章和其他具有普遍约束力的行政决定、命令的监督，依照本条例的有关规定，建立相关的备案审查制度，维护社会主义法制的统一，保证法律、法规的正确实施。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, in accordance with the law, strengthen supervision over rules and other universally binding administrative decisions and orders issued by lower-level administrative organs, establish relevant filing review systems in accordance with the relevant provisions of these Regulations, maintain the unity of the socialist legal system, and ensure the correct implementation of laws and regulations.
本条例自2024年11月1日起施行。2001年12月14日国务院发布的《法规规章备案条例》同时废止。
These Regulations shall come into force on November 1, 2024. The Regulations on the Filing of Regulations and Rules promulgated by the State Council on December 14, 2001 shall be simultaneously abolished.
