总 则
General Provisions
为了加强海洋观测预报管理，规范海洋观测预报活动，防御和减轻海洋灾害，为经济建设、国防建设和社会发展服务，制定本条例。
These Regulations are formulated to strengthen the administration of marine observation and forecasting, regulate marine observation and forecasting activities, prevent and mitigate marine disasters, and serve economic construction, national defense construction, and social development.
在中华人民共和国领域和中华人民共和国管辖的其他海域从事海洋观测预报活动，应当遵守本条例。
Marine observation and forecasting activities conducted within the territory of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China shall comply with these Regulations.
海洋观测预报事业是基础性公益事业。国务院和沿海县级以上地方人民政府应当将海洋观测预报事业纳入本级国民经济和社会发展规划，所需经费纳入本级财政预算。
The marine observation and forecasting undertaking is a basic public welfare undertaking. The State Council and the local people's governments at or above the county level in coastal areas shall incorporate the marine observation and forecasting undertaking into their respective national economic and social development plans, and include the necessary funds in their respective fiscal budgets.
国务院海洋主管部门主管全国海洋观测预报工作。
The marine administrative department of the State Council shall be responsible for the nationwide administration of marine observation and forecasting.
国务院海洋主管部门的海区派出机构依照本条例和国务院海洋主管部门规定的权限，负责所管辖海域的海洋观测预报监督管理。
The regional offices of the marine administrative department of the State Council shall, in accordance with these Regulations and the authority prescribed by the marine administrative department of the State Council, be responsible for the supervision and administration of marine observation and forecasting in the sea areas under their jurisdiction.
沿海县级以上地方人民政府海洋主管部门主管本行政区毗邻海域的海洋观测预报工作。
The marine administrative departments of the local people's governments at or above the county level in coastal areas shall be responsible for the marine observation and forecasting work in the sea areas adjacent to their respective administrative regions.
国家鼓励、支持海洋观测预报科学技术的研究，推广先进的技术和设备，培养海洋观测预报人才，促进海洋观测预报业务水平的提高。
The State encourages and supports scientific research on marine observation and forecasting, promotes advanced technologies and equipment, trains marine observation and forecasting personnel, and promotes the improvement of the professional level of marine observation and forecasting.
对在海洋观测预报工作中作出突出贡献的单位和个人，给予表彰和奖励。
Units and individuals that have made outstanding contributions in marine observation and forecasting work shall be commended and rewarded.
海洋观测网的规划、建设与保护
Planning, Construction, and Protection of the Marine Observation Network
国务院海洋主管部门负责编制全国海洋观测网规划。编制全国海洋观测网规划应当征求国务院有关部门和有关军事机关的意见，报国务院或者国务院授权的部门批准后实施。
The marine administrative department of the State Council shall be responsible for formulating the national marine observation network plan. The formulation of the national marine observation network plan shall solicit opinions from the relevant departments of the State Council and relevant military authorities, and shall be implemented after approval by the State Council or the department authorized by the State Council.
沿海省、自治区、直辖市人民政府海洋主管部门应当根据全国海洋观测网规划和本行政区毗邻海域的实际情况，编制本省、自治区、直辖市的海洋观测网规划，在征求本级人民政府有关部门的意见后，报本级人民政府批准实施，并报国务院海洋主管部门备案。
The marine administrative departments of the people's governments of coastal provinces, autonomous regions, and municipalities directly under the Central Government shall, based on the national marine observation network plan and the actual conditions of the sea areas adjacent to their respective administrative regions, formulate the marine observation network plans of their respective provinces, autonomous regions, or municipalities directly under the Central Government. After soliciting opinions from the relevant departments of the people's government at the same level, they shall submit the plans to the people's government at the same level for approval and implementation, and report them to the marine administrative department of the State Council for recordation.
修改海洋观测网规划，应当按照规划编制程序报原批准机关批准。
Any amendment to a marine observation network plan shall be submitted to the original approving authority for approval in accordance with the planning formulation procedures.
编制海洋观测网规划，应当坚持统筹兼顾、突出重点、合理布局的原则，避免重复建设，保障国防安全。
The formulation of a marine observation network plan shall adhere to the principles of overall planning, highlighting key points, and rational layout, avoiding duplicate construction, and ensuring national defense security.
编制海洋观测网规划，应当将沿海城市和人口密集区、产业园区、滨海重大工程所在区、海洋灾害易发区和海上其他重要区域作为规划的重点。
In formulating a marine observation network plan, coastal cities, densely populated areas, industrial parks, areas where major coastal projects are located, areas prone to marine disasters, and other important areas at sea shall be taken as the key points of the plan.
海洋观测网规划主要包括规划目标、海洋观测网体系构成、海洋观测站(点)总体布局及设施建设、保障措施等内容。
A marine observation network plan mainly includes the planning objectives, the composition of the marine observation network system, the overall layout and facility construction of marine observation stations (points), and safeguard measures.
海洋观测网的建设应当符合海洋观测网规划，并按照国家固定资产投资项目建设程序组织实施。
The construction of the marine observation network shall conform to the marine observation network plan and shall be organized and implemented in accordance with the procedures for the construction of national fixed asset investment projects.
海洋观测站(点)的建设应当符合国家有关标准和技术要求，保证建设质量。
The construction of marine observation stations (points) shall comply with relevant national standards and technical requirements to ensure construction quality.
国务院海洋主管部门和沿海县级以上地方人民政府海洋主管部门负责基本海洋观测站(点)的设立和调整。
The marine administrative department of the State Council and the marine administrative departments of the local people's governments at or above the county level in coastal areas shall be responsible for the establishment and adjustment of basic marine observation stations (points).
有关主管部门因水利、气象、航运等管理需要设立、调整有关观测站(点)开展海洋观测的，应当事先征求有关海洋主管部门的意见。
Where relevant competent departments need to establish or adjust observation stations (points) for marine observation due to the management needs of water conservancy, meteorology, shipping, etc., they shall solicit opinions from the relevant marine administrative departments in advance.
其他单位或者个人因生产、科研等活动需要设立、调整海洋观测站(点)的，应当按照国务院海洋主管部门的规定，报有关海洋主管部门备案。
Where other units or individuals need to establish or adjust marine observation stations (points) for production, scientific research, or other activities, they shall report to the relevant marine administrative department for recordation in accordance with the provisions of the marine administrative department of the State Council.
海洋观测站(点)及其设施受法律保护，任何单位和个人不得侵占、毁损或者擅自移动。
Marine observation stations (points) and their facilities are protected by law, and no unit or individual may occupy, damage, or move them without authorization.
国务院海洋主管部门、沿海县级以上地方人民政府海洋主管部门，应当商本级人民政府有关部门按照管理权限和国家有关标准划定基本海洋观测站(点)的海洋观测环境保护范围，予以公告，并根据需要在保护范围边界设立标志。
The marine administrative department of the State Council and the marine administrative departments of the local people's governments at or above the county level in coastal areas shall, in consultation with the relevant departments of the people's government at the same level, delimit the marine observation environmental protection scope of basic marine observation stations (points) in accordance with the management authority and national standards, announce it to the public, and set up markers at the boundaries of the protection scope as needed.
禁止在海洋观测环境保护范围内进行下列活动：
The following activities are prohibited within the marine observation environmental protection scope:
(一)设置障碍物、围填海；
(1) Setting up obstacles, reclamation;
(二)设置影响海洋观测的高频电磁辐射装置；
(2) Installing high-frequency electromagnetic radiation devices that affect ocean observation;
(三)影响海洋观测的矿产资源勘探开发、捕捞作业、水产养殖、倾倒废弃物、爆破等活动；
(3) Activities such as mineral resource exploration and development, fishing operations, aquaculture, waste dumping, and blasting that affect ocean observation;
(四)可能对海洋观测产生危害的其他活动。
(4) Other activities that may cause harm to ocean observation.
新建、改建、扩建建设工程，应当避免对海洋观测站(点)及其设施、观测环境造成危害；确实无法避免的，建设单位应当按照原负责或者批准设立、调整该海洋观测站(点)的主管部门的要求，在开工建设前采取增建抗干扰设施或者新建海洋观测站(点)等措施，所需费用由建设单位承担。
New construction, renovation, and expansion projects shall avoid causing harm to ocean observation stations (points) and their facilities and observation environment; if it is truly unavoidable, the construction unit shall, before the start of construction, take measures such as building anti-interference facilities or establishing new ocean observation stations (points) as required by the competent department that originally approved or adjusted the station (point), and the costs shall be borne by the construction unit.
海洋观测与资料的汇交使用
Ocean Observation and Data Submission and Sharing
从事海洋观测活动应当遵守国家海洋观测技术标准、规范和规程。
Entities engaged in ocean observation activities shall comply with national technical standards, specifications, and procedures for ocean observation.
从事海洋观测活动的单位应当建立质量保证体系和计量管理体系，加强对海洋观测资料获取和传输的质量控制，保证海洋观测资料的真实性、准确性和完整性。
Entities engaged in ocean observation activities shall establish a quality assurance system and a metrological management system, strengthen quality control over the acquisition and transmission of ocean observation data, and ensure the authenticity, accuracy, and completeness of ocean observation data.
海洋观测使用的仪器设备应当符合国家有关产品标准、规范和海洋观测技术要求。
Instruments and equipment used for ocean observation shall comply with relevant national product standards, specifications, and technical requirements for ocean observation.
海洋观测计量器具应当依法经计量检定合格。未经检定、检定不合格或者超过检定周期的计量器具，不得用于海洋观测。对不具备检定条件的海洋观测计量器具，应当通过校准保证量值溯源。
Ocean observation measuring instruments shall be legally verified for metrological verification. Measuring instruments that have not been verified, have failed verification, or have exceeded the verification period shall not be used for ocean observation. For ocean observation measuring instruments that do not meet the conditions for verification, traceability shall be ensured through calibration.
国家建立海上船舶、平台志愿观测制度。
The State establishes a voluntary observation system for ships and platforms at sea.
承担志愿观测的船舶、平台所需要的海洋观测仪器设备由海洋主管部门负责购置、安装和维修；船舶、平台的所有权人或者使用权人应当予以配合，并承担日常管护责任。
The ocean observation instruments and equipment required for ships and platforms undertaking voluntary observation shall be purchased, installed, and maintained by the ocean administrative department; the owner or user of the ship or platform shall cooperate and assume daily management and maintenance responsibilities.
从事海洋观测活动的单位应当按照国务院海洋主管部门的规定，将获取的海洋观测资料向有关海洋主管部门统一汇交。
Entities engaged in ocean observation activities shall, in accordance with the provisions of the competent department of ocean under the State Council, uniformly submit the ocean observation data obtained to the relevant ocean administrative department.
国务院海洋主管部门和沿海县级以上地方人民政府海洋主管部门应当妥善存储、保管海洋观测资料，并根据经济建设和社会发展需要对海洋观测资料进行加工整理，建立海洋观测资料数据库，实行资料共享。
The competent department of ocean under the State Council and the ocean administrative departments of local people's governments at or above the county level along the coast shall properly store and preserve ocean observation data, process and organize ocean observation data according to the needs of economic construction and social development, establish an ocean observation database, and implement data sharing.
海洋观测资料的汇交、存储、保管、共享和使用应当遵守保守国家秘密法律、法规的规定。
The submission, storage, preservation, sharing, and use of ocean observation data shall comply with laws and regulations on the protection of state secrets.
国家机关决策和防灾减灾、国防建设、公共安全等公益事业需要使用海洋观测资料的，国务院海洋主管部门和沿海县级以上地方人民政府海洋主管部门应当无偿提供。
When state organs need ocean observation data for decision-making, disaster prevention and mitigation, national defense construction, public safety, and other public welfare undertakings, the competent department of ocean under the State Council and the ocean administrative departments of local people's governments at or above the county level along the coast shall provide it free of charge.
国际组织、外国的组织或者个人在中华人民共和国领域和中华人民共和国管辖的其他海域从事海洋观测活动，依照《中华人民共和国涉外海洋科学研究管理规定》的规定执行。
International organizations, foreign organizations, or individuals conducting ocean observation activities within the territory of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China shall comply with the provisions of the Regulations of the People's Republic of China on the Administration of Foreign-Related Marine Scientific Research.
国际组织、外国的组织或者个人在中华人民共和国领域和中华人民共和国管辖的其他海域从事海洋观测活动，应当遵守中华人民共和国的法律、法规，不得危害中华人民共和国的国家安全。
International organizations, foreign organizations, or individuals conducting ocean observation activities within the territory of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China shall comply with the laws and regulations of the People's Republic of China and shall not endanger the national security of the People's Republic of China.
任何单位和个人不得擅自向国际组织、外国的组织或者个人提供属于国家秘密的海洋观测资料和成果；确需提供的，应当报国务院海洋主管部门或者沿海省、自治区、直辖市人民政府海洋主管部门批准；有关海洋主管部门在批准前，应当征求本级人民政府有关部门的意见，其中涉及军事秘密的，还应当征得有关军事机关的同意。
No unit or individual may, without authorization, provide ocean observation data and results that are state secrets to international organizations, foreign organizations, or individuals; if it is truly necessary to provide them, approval shall be obtained from the competent department of ocean under the State Council or the ocean administrative department of the coastal province, autonomous region, or municipality directly under the Central Government; before granting approval, the relevant ocean administrative department shall seek the opinions of the relevant departments of the people's government at the same level, and if military secrets are involved, the consent of the relevant military authorities shall also be obtained.
海洋预报
Marine Forecasting
国务院海洋主管部门和沿海县级以上地方人民政府海洋主管部门所属的海洋预报机构应当根据海洋观测资料，分析、预测海洋状况变化趋势及其影响，及时制作海洋预报和海洋灾害警报，做好海洋预报工作。
The marine forecasting institutions affiliated with the competent department of ocean under the State Council and the ocean administrative departments of local people's governments at or above the county level along the coast shall, based on ocean observation data, analyze and predict the trends of marine conditions and their impacts, timely produce marine forecasts and marine disaster warnings, and carry out marine forecasting work.
国务院海洋主管部门和沿海县级以上地方人民政府海洋主管部门所属的海洋预报机构应当适时进行海洋预报和海洋灾害警报会商，提高海洋预报和海洋灾害警报的准确性、及时性。
The marine forecasting institutions affiliated with the competent department of ocean under the State Council and the ocean administrative departments of local people's governments at or above the county level along the coast shall conduct timely consultations on marine forecasts and marine disaster warnings to improve the accuracy and timeliness of marine forecasts and marine disaster warnings.
海洋预报和海洋灾害警报由国务院海洋主管部门和沿海县级以上地方人民政府海洋主管部门所属的海洋预报机构按照职责向公众统一发布。其他任何单位和个人不得向公众发布海洋预报和海洋灾害警报。
Marine forecasts and marine disaster warnings shall be uniformly released to the public by the marine forecasting institutions affiliated with the competent department of ocean under the State Council and the ocean administrative departments of local people's governments at or above the county level along the coast, in accordance with their respective responsibilities. No other unit or individual may release marine forecasts or marine disaster warnings to the public.
国务院有关部门、沿海地方各级人民政府和沿海县级以上地方人民政府有关部门应当根据海洋预报机构提供的海洋灾害警报信息采取必要措施，并根据防御海洋灾害的需要，启动相应的海洋灾害应急预案，避免或者减轻海洋灾害。
The relevant departments of the State Council, local people's governments at all levels along the coast, and the relevant departments of local people's governments at or above the county level along the coast shall take necessary measures based on the marine disaster warning information provided by the marine forecasting institutions, and, according to the needs of marine disaster prevention, activate corresponding marine disaster emergency plans to avoid or mitigate marine disasters.
沿海县级以上地方人民政府指定的当地广播、电视和报纸等媒体应当安排固定的时段或者版面，及时刊播海洋预报和海洋灾害警报。
The local radio, television, and newspapers designated by the local people's governments at or above the county level along the coast shall arrange fixed time slots or sections to promptly broadcast and publish marine forecasts and marine disaster warnings.
广播、电视等媒体改变海洋预报播发时段的，应当事先与有关海洋主管部门协商一致，但是因特殊需要，广播电视行政部门要求改变播发时段的除外。对国计民生可能产生重大影响的海洋灾害警报，应当及时增播或者插播。
If radio, television and other media change the broadcast time of marine forecasts, they shall reach consensus with the relevant marinecompetent authority in advance, except when the radio and television administrative department requires a change due to special needs. For marine disaster warnings that may have a significant impact on national economy and people's livelihood, timely additional broadcasts or insertions shall be made.
广播、电视和报纸等媒体刊播海洋预报和海洋灾害警报，应当使用国务院海洋主管部门和沿海县级以上地方人民政府海洋主管部门所属的海洋预报机构提供的信息，并明示海洋预报机构的名称。
When radio, television, newspapers and other media publish marine forecasts and marine disaster warnings, they shall use information provided by the marine forecast institutions affiliated with the State Council's marinecompetent authority and the marinecompetent authority of coastal county-level and above local people's governments, and clearly indicate the name of the marine forecast institution.
沿海县级以上地方人民政府应当建立和完善海洋灾害信息发布平台，根据海洋灾害防御需要，在沿海交通枢纽、公共活动场所等人口密集区和海洋灾害易发区建立海洋灾害警报信息接收和播发设施。
Coastal county-level and above local people's governments shall establish and improve marine disaster information release platforms, and establish marine disaster warning information reception and broadcast facilities in densely populated areas such as coastal transportation hubs and public activity venues, as well as in areas prone to marine disasters, based on the needs of marine disaster prevention.
国务院海洋主管部门和沿海省、自治区、直辖市人民政府海洋主管部门应当根据海洋灾害分析统计结果，商本级人民政府有关部门提出确定海洋灾害重点防御区的意见，报本级人民政府批准后公布。
The State Council's marinecompetent authority and the marinecompetent authority of coastal provinces, autonomous regions, and municipalities directly under the Central Government shall, based on the results of marine disaster analysis and statistics, consult with the relevant departments of the people's government at the same level to propose opinions on determining key marine disaster defense areas, and submit them to the people's government at the same level for approval before publication.
在海洋灾害重点防御区内设立产业园区、进行重大项目建设的，应当在项目可行性论证阶段，进行海洋灾害风险评估，预测和评估海啸、风暴潮等海洋灾害的影响。
When establishing industrial parks or conducting major project construction in key marine disaster defense areas, a marine disaster risk assessment shall be conducted during the project feasibility demonstration stage to predict and assess the impact of tsunamis, storm surges, and other marine disasters.
国务院海洋主管部门负责组织海平面变化和影响气候变化的重大海洋现象的预测和评估，并及时公布预测意见和评估结果。
The State Council's marinecompetent authority is responsible for organizing the prediction and assessment of sea level changes and major ocean phenomena that affect climate change, and shall promptly publish prediction opinions and assessment results.
沿海省、自治区、直辖市人民政府海洋主管部门应当根据海洋灾害防御需要，对沿海警戒潮位进行核定，报本级人民政府批准后公布。
The marinecompetent authority of coastal provinces, autonomous regions, and municipalities directly under the Central Government shall, based on the needs of marine disaster prevention, verify the coastal warning tide levels and submit them to the people's government at the same level for approval before publication.
法律责任
Legal Liability
国务院海洋主管部门及其海区派出机构、沿海县级以上地方人民政府海洋主管部门，不依法作出行政许可或者办理批准文件，发现违法行为或者接到对违法行为的举报不予查处，或者有其他未依照本条例规定履行职责的行为的，对直接负责的主管人员和其他直接责任人员依法给予处分；直接负责的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任。
If the State Council's marinecompetent authority and its regional offices, or the marinecompetent authority of coastal county-level and above local people's governments, fail to lawfully make administrative licenses or issue approval documents, fail to investigate upon discovering illegal acts or receiving reports of illegal acts, or otherwise fail to perform their duties in accordance with these regulations, the directly responsible supervisors and other directly responsible personnel shall be given disciplinary sanctions according to law; if the directly responsible supervisors and other directly responsible personnel constitute a crime, criminal liability shall be pursued according to law.
国务院海洋主管部门及其海区派出机构、沿海县级以上地方人民政府海洋主管部门所属的海洋预报机构瞒报、谎报或者由于玩忽职守导致重大漏报、错报、迟报海洋灾害警报的，由其上级机关或者监察机关责令改正；情节严重的，对直接负责的主管人员和其他直接责任人员依法给予处分；直接负责的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任。
If the marine forecast institutions affiliated with the State Council's marinecompetent authority and its regional offices, or the marinecompetent authority of coastal county-level and above local people's governments, conceal, falsely report, or due to dereliction of duty cause major omissions, errors, or delays in reporting marine disaster warnings, their superior organs or supervisory organs shall order corrections; if the circumstances are serious, the directly responsible supervisors and other directly responsible personnel shall be given disciplinary sanctions according to law; if the directly responsible supervisors and other directly responsible personnel constitute a crime, criminal liability shall be pursued according to law.
设立、调整海洋观测站(点)未按照规定备案的，由有关海洋主管部门责令限期改正，处2万元以上10万元以下的罚款；不符合海洋观测网规划的，责令限期拆除；逾期不拆除的，依法实施强制拆除，所需费用由违法者承担。
If the establishment or adjustment of ocean observation stations (points) is not filed as required, the relevant marinecompetent authority shall order corrections within a specified period and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; if it does not conform to the ocean observation network plan, it shall be ordered to dismantle within a specified period; if it is not dismantled within the specified period, compulsory dismantling shall be carried out according to law, and the costs shall be borne by the violator.
违反本条例规定，有下列行为之一的，由有关海洋主管部门责令停止违法行为，限期恢复原状或者采取其他补救措施，处2万元以上20万元以下的罚款；逾期不恢复原状或者不采取其他补救措施的，依法强制执行；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任：
In violation of these regulations, any of the following acts shall be ordered by the relevant marinecompetent authority to cease the illegal act, restore the original state or take other remedial measures within a specified period, and a fine of not less than 20,000 yuan but not more than 200,000 yuan shall be imposed; if the original state is not restored or other remedial measures are not taken within the specified period, compulsory enforcement shall be carried out according to law; if losses are caused, compensation liability shall be borne according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)侵占、毁损或者擅自移动海洋观测站(点)及其设施的；
(1) Encroaching upon, damaging, orwithout authorization moving ocean observation stations (points) and their facilities;
(二)在海洋观测环境保护范围内进行危害海洋观测活动的。
(2) Conducting activities harmful to ocean observation within the protected range of ocean observation environment.
违反本条例规定，有下列行为之一的，由有关主管部门责令限期改正，给予警告；逾期不改正的，处1万元以上5万元以下的罚款：
In violation of these regulations, any of the following acts shall be ordered by the relevant competent department to correct within a specified period and given a warning; if correction is not made within the specified period, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed:
(一)不遵守国家海洋观测技术标准、规范或者规程的；
(1) Not complying with national ocean observation technical standards, specifications, or procedures;
(二)使用不符合国家有关产品标准、规范或者海洋观测技术要求的海洋观测仪器设备的；
(2) Using ocean observation instruments and equipment that do not meet relevant national product standards, specifications, or ocean observation technical requirements;
(三)使用未经检定、检定不合格或者超过检定周期的海洋观测计量器具的。
(3) Using ocean observation metrological instruments that have not been verified, have failed verification, or have exceeded the verification period.
违反本条第一款第二项、第三项规定的，责令限期更换有关海洋观测仪器设备、海洋观测计量器具。
If the provisions of items (2) and (3) of the first paragraph of this article are violated, the relevant ocean observation instruments, equipment, and metrological instruments shall be ordered to be replaced within a specified period.
从事海洋观测活动的单位未按照规定汇交海洋观测资料的，由负责接收海洋观测资料的海洋主管部门责令限期汇交；逾期不汇交的，责令停止海洋观测活动，处2万元以上10万元以下的罚款。
If a unit engaged in ocean observation activities fails to submit ocean observation data as required, the marinecompetent authority responsible for receiving ocean observation data shall order submission within a specified period; if submission is not made within the specified period, the ocean observation activities shall be ordered to cease, and a fine of not less than 20,000 yuan but not more than 100,000 yuan shall be imposed.
单位或者个人未经批准，向国际组织、外国的组织或者个人提供属于国家秘密的海洋观测资料或者成果的，由有关海洋主管部门责令停止违法行为；有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。
If a unit or individual, without approval, provides ocean observation data or results that are state secrets to international organizations, foreign organizations, or individuals, the relevant marinecompetent authority shall order cessation of the illegal act; if there is illegal income, the illegal income shall be confiscated; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例规定发布海洋预报或者海洋灾害警报的，由有关海洋主管部门责令停止违法行为，给予警告，并处2万元以上10万元以下的罚款；构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
If marine forecasts or marine disaster warnings are issued in violation of these regulations, the relevant marinecompetent authority shall order cessation of the illegal act, give a warning, and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; if the act constitutes a violation of public security administration, public security administration penalties shall be imposed according to law; if a crime is constituted, criminal liability shall be pursued according to law.
广播、电视、报纸等媒体有下列行为之一的，由有关主管部门责令限期改正，给予警告；情节严重的，对直接负责的主管人员和其他直接责任人员依法给予处分：
If radio, television, newspapers and other media commit any of the following acts, the relevant competent department shall order corrections within a specified period and give a warning; if the circumstances are serious, the directly responsible supervisors and other directly responsible personnel shall be given disciplinary sanctions according to law:
(一)未依照本条例规定刊播海洋预报、海洋灾害警报的；
(1) Failing to publish marine forecasts and marine disaster warnings in accordance with these regulations;
(二)未及时增播或者插播对国计民生可能产生重大影响的海洋灾害警报的；
(2) Failing to timely add or insert marine disaster warnings that may have a significant impact on national economy and people's livelihood.
(三)刊播海洋预报、海洋灾害警报，未使用海洋主管部门所属的海洋预报机构提供的信息的。
(3) Broadcasting marine forecasts or marine disaster warnings without using information provided by the marine forecasting institution affiliated with the competent marine department.
附 则
Supplementary Provisions
本条例下列用语的含义是：
For the purposes of these Regulations, the following terms have the meanings specified:
(一)海洋观测，是指以掌握、描述海洋状况为目的，对潮汐、盐度、海温、海浪、海流、海冰、海啸波等进行的观察测量活动，以及对相关数据采集、传输、分析和评价的活动。
(1) Ocean observation refers to activities of observing and measuring tides, salinity, sea temperature, waves, currents, sea ice, tsunami waves, etc., for the purpose of understanding and describing the state of the ocean, as well as activities of collecting, transmitting, analyzing, and evaluating related data.
(二)海洋预报，是指对潮汐、盐度、海温、海浪、海流、海冰、海啸、风暴潮、海平面变化、海岸侵蚀、咸潮入侵等海洋状况和海洋现象开展的预测和信息发布的活动。
(2) Marine forecasting refers to activities of predicting and releasing information on ocean conditions and phenomena such as tides, salinity, sea temperature, waves, currents, sea ice, tsunamis, storm surges, sea level changes, coastal erosion, and saltwater intrusion.
(三)海洋观测站(点)，是指为获取海洋观测资料，在海洋、海岛和海岸设立的海洋观测场所。
(3) Ocean observation stations (points) refer to ocean observation sites established in the ocean, on islands, and along the coast to obtain ocean observation data.
(四)海洋观测设施，是指海洋观测站(点)所使用的观测站房、雷达站房、观测平台、观测井、观测船、浮标、潜标、海床基、观测标志、仪器设备、通信线路等及附属设施。
(4) Ocean observation facilities refer to observation stations, radar stations, observation platforms, observation wells, observation vessels, buoys, submersible buoys, seabed bases, observation markers, instruments and equipment, communication lines, and ancillary facilities used by ocean observation stations (points).
(五)海洋观测环境，是指为保证海洋观测活动正常进行，以海洋观测站(点)为中心，以获取连续、准确和具有代表性的海洋观测数据为目标所必需的最小立体空间。
(5) Ocean observation environment refers to the minimum three-dimensional space necessary to ensure normal ocean observation activities, centered on ocean observation stations (points), with the goal of obtaining continuous, accurate, and representative ocean observation data.
中国人民解放军的海洋观测预报工作，按照中央军事委员会的有关规定执行。
The ocean observation and forecasting work of the Chinese People's Liberation Army shall be carried out in accordance with the relevant provisions of the Central Military Commission.
海洋环境监测及监测信息的发布，依照有关法律、法规和国家规定执行。
Marine environment monitoring and the release of monitoring information shall be carried out in accordance with relevant laws, regulations, and state provisions.
本条例自2012年6月1日起施行。
These Regulations shall come into force on June 1, 2012.
