Regulation on the Management of Ozone-Depleting Substances

(Promulgated by Decree No. 573 of the State Council of the People's Republic of China on April 8, 2010; first revised in accordance with the Decision of the State Council on Amending and Repealing Certain Administrative Regulations on March 19, 2018; second revised in accordance with the Decision of the State Council on Amending the Regulation on the Management of Ozone-Depleting Substances on December 29, 2023)

为了加强对消耗臭氧层物质的管理，履行《保护臭氧层维也纳公约》和《关于消耗臭氧层物质的蒙特利尔议定书》规定的义务，保护臭氧层和生态环境，保障人体健康，根据《中华人民共和国大气污染防治法》，制定本条例。

This Regulation is formulated in accordance with the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, with a view to strengthening the management of ozone-depleting substances, fulfilling the obligations under the Vienna Convention for the Protection of the Ozone Layer and the Montreal Protocol on Substances that Deplete the Ozone Layer, protecting the ozone layer and the ecological environment, and safeguarding human health.

本条例所称消耗臭氧层物质，是指列入《中国受控消耗臭氧层物质清单》的化学品。

For the purposes of this Regulation, 'ozone-depleting substances' refer to chemicals listed in the China List of Controlled Ozone-Depleting Substances.

《中国受控消耗臭氧层物质清单》由国务院生态环境主管部门会同国务院有关部门制定、调整和公布。

The China List of Controlled Ozone-Depleting Substances shall be formulated, adjusted, and published by the competent department of ecological environment of the State Council jointly with the relevant departments of the State Council.

在中华人民共和国境内从事消耗臭氧层物质的生产、销售、使用和进出口等活动，适用本条例。

This Regulation applies to activities such as the production, sale, use, and import/export of ozone-depleting substances within the territory of the People's Republic of China.

前款所称生产，是指制造消耗臭氧层物质的活动。前款所称使用，是指利用消耗臭氧层物质进行的生产经营等活动，不包括使用含消耗臭氧层物质的产品的活动。

For the purposes of the preceding paragraph, 'production' means the activity of manufacturing ozone-depleting substances. 'Use' means the activity of utilizing ozone-depleting substances for production and operation, excluding the activity of using products containing ozone-depleting substances.

消耗臭氧层物质的管理工作应当坚持中国共产党的领导，贯彻党和国家路线方针政策和决策部署。

The management of ozone-depleting substances shall adhere to the leadership of the Communist Party of China and implement the Party's and the state's guidelines, policies, and decisions.

国务院生态环境主管部门统一负责全国消耗臭氧层物质的监督管理工作。

The competent department of ecological environment of the State Council shall be responsible for the supervision and management of ozone-depleting substances nationwide.

国务院商务主管部门、海关总署等有关部门依照本条例的规定和各自的职责负责消耗臭氧层物质的有关监督管理工作。

The competent department of commerce of the State Council, the General Administration of Customs, and other relevant departments shall be responsible for the relevant supervision and management of ozone-depleting substances in accordance with the provisions of this Regulation and their respective duties.

地方人民政府生态环境主管部门和商务等有关部门依照本条例的规定和各自的职责负责本行政区域消耗臭氧层物质的有关监督管理工作。

The local people's government ecological environment authorities and commerce and other relevant departments shall, in accordance with the provisions of these Regulations and their respective responsibilities, be responsible for the supervision and management of ozone-depleting substances within their administrative regions.

国家逐步削减并最终淘汰作为制冷剂、发泡剂、灭火剂、溶剂、清洗剂、加工助剂、杀虫剂、气雾剂、膨胀剂等用途的消耗臭氧层物质。

The state shall gradually reduce and ultimately eliminate ozone-depleting substances used as refrigerants, foaming agents, fire extinguishing agents, solvents, cleaning agents, processing aids, pesticides, aerosol propellants, expansion agents, and other purposes.

禁止将国家已经淘汰的消耗臭氧层物质用于前款规定的用途。

It is prohibited to use ozone-depleting substances that have been phased out by the state for the purposes specified in the preceding paragraph.

国务院生态环境主管部门会同国务院有关部门拟订《中国履行〈关于消耗臭氧层物质的蒙特利尔议定书〉国家方案》(以下简称国家方案)，报国务院批准后实施。

The ecological environment authority under the State Council shall, together with the relevant departments under the State Council, formulate the 'China National Plan for Implementing the Montreal Protocol on Substances that Deplete the Ozone Layer' (hereinafter referred to as the National Plan), which shall be submitted to the State Council for approval before implementation.

国务院生态环境主管部门根据国家方案和消耗臭氧层物质淘汰进展情况，会同国务院有关部门确定并公布限制或者禁止新建、改建、扩建生产、使用消耗臭氧层物质建设项目的类别，制定并公布限制或者禁止生产、使用、进出口消耗臭氧层物质的名录。

The ecological environment authority under the State Council shall, based on the National Plan and the progress of ozone-depleting substance phase-out, together with the relevant departments under the State Council, determine and publish the categories of construction projects that are restricted or prohibited from new construction, renovation, or expansion for the production or use of ozone-depleting substances, and formulate and publish a list of ozone-depleting substances that are restricted or prohibited from production, use, import, and export.

因特殊用途确需生产、使用前款规定禁止生产、使用的消耗臭氧层物质的，按照《关于消耗臭氧层物质的蒙特利尔议定书》有关允许用于特殊用途的规定，由国务院生态环境主管部门会同国务院有关部门批准。

If it is truly necessary for special purposes to produce or use ozone-depleting substances that are prohibited from production or use as specified in the preceding paragraph, approval shall be obtained from the ecological environment authority under the State Council together with the relevant departments under the State Council, in accordance with the provisions of the Montreal Protocol on Substances that Deplete the Ozone Layer regarding permitted uses for special purposes.

国家对消耗臭氧层物质的生产、使用、进出口实行总量控制和配额管理。国务院生态环境主管部门根据国家方案和消耗臭氧层物质淘汰进展情况，商国务院有关部门确定国家消耗臭氧层物质的年度生产、使用和进出口配额总量，并予以公告。

The state implements total quantity control and quota management for the production, use, import, and export of ozone-depleting substances. The ecological environment authority under the State Council shall, based on the National Plan and the progress of ozone-depleting substance phase-out, consult with the relevant departments under the State Council to determine the annual total production, use, import, and export quotas for ozone-depleting substances in the country, and shall announce them.

国家鼓励、支持消耗臭氧层物质替代品和替代技术的科学研究、技术开发和推广应用。

The state encourages and supports scientific research, technological development, and promotion of alternatives and alternative technologies for ozone-depleting substances.

国务院生态环境主管部门会同国务院有关部门制定、调整和公布《中国消耗臭氧层物质替代品推荐名录》。

The ecological environment authority under the State Council shall, together with the relevant departments under the State Council, formulate, adjust, and publish the 'China Recommended List of Alternatives to Ozone-Depleting Substances'.

开发、生产、使用消耗臭氧层物质替代品，应当符合国家产业政策，并按照国家有关规定享受优惠政策。对在消耗臭氧层物质淘汰工作中做出突出成绩的单位和个人，按照国家有关规定给予奖励。

The development, production, and use of alternatives to ozone-depleting substances shall comply with national industrial policies and shall enjoy preferential policies in accordance with relevant state regulations. Units and individuals that have made outstanding achievements in the phase-out of ozone-depleting substances shall be rewarded in accordance with relevant state regulations.

任何单位和个人对违反本条例规定的行为，有权向生态环境主管部门或者其他有关部门举报。接到举报的部门应当及时调查处理，并为举报人保密；经调查情况属实的，对举报人给予奖励。

Any entity or individual has the right to report to the competent ecological environment department or other relevant departments any violation of the provisions of this Regulation. The department receiving the report shall promptly investigate and handle the matter, and keep the reporter confidential; if the report is verified to be true, the reporter shall be rewarded.

消耗臭氧层物质的生产、使用单位，应当依照本条例的规定申请领取生产或者使用配额许可证。但是，使用单位有下列情形之一的，不需要申请领取使用配额许可证：

Entities that produce or use ozone-depleting substances shall apply for a production or use quota permit in accordance with the provisions of this Regulation. However, entities that use ozone-depleting substances under any of the following circumstances are not required to apply for a use quota permit:

(一)维修单位为了维修制冷设备、制冷系统或者灭火系统使用消耗臭氧层物质的；

(1) Maintenance entities using ozone-depleting substances for the maintenance of refrigeration equipment, refrigeration systems, or fire extinguishing systems;

(二)实验室为了实验分析少量使用消耗臭氧层物质的；

(2) Laboratories using small amounts of ozone-depleting substances for experimental analysis;

(三)海关为了防止有害生物传入传出使用消耗臭氧层物质实施检疫的；

(3) Customs using ozone-depleting substances for quarantine to prevent the introduction or spread of harmful organisms;

(四)国务院生态环境主管部门规定的不需要申请领取使用配额许可证的其他情形。

(4) Other circumstances specified by the competent ecological environment department of the State Council where a use quota permit is not required.

消耗臭氧层物质的生产、使用单位除具备法律、行政法规规定的条件外，还应当具备下列条件：

In addition to meeting the conditions prescribed by laws and administrative regulations, entities that produce or use ozone-depleting substances shall also meet the following conditions:

(一)有合法生产或者使用相应消耗臭氧层物质的业绩；

(1) Having a legitimate record of producing or using the corresponding ozone-depleting substances;

(二)有生产或者使用相应消耗臭氧层物质的场所、设施、设备和专业技术人员；

(2) Having the premises, facilities, equipment, and professional technical personnel for producing or using the corresponding ozone-depleting substances.

(三)有经验收合格的环境保护设施；

(3) Have environmental protection facilities that have passed acceptance inspection;

(四)有健全完善的生产经营管理制度。

(4) Have a sound and complete production and operation management system.

将消耗臭氧层物质用于本条例第六条规定的特殊用途的单位，不适用前款第(一)项的规定。

Units that use ozone-depleting substances for special purposes as specified in Article 6 of these Regulations are not subject to the provisions of item (1) of the preceding paragraph.

消耗臭氧层物质的生产、使用单位应当于每年10月31日前向国务院生态环境主管部门书面申请下一年度的生产配额或者使用配额，并提交其符合本条例第十一条规定条件的证明材料。

Units that produce or use ozone-depleting substances shall, before October 31 each year, submit a written application to the competent department of ecological environment under the State Council for the production quota or use quota for the next year, and submit the certification materials proving that they meet the conditions specified in Article 11 of these Regulations.

国务院生态环境主管部门根据国家消耗臭氧层物质的年度生产、使用配额总量和申请单位生产、使用相应消耗臭氧层物质的业绩情况，核定申请单位下一年度的生产配额或者使用配额，并于每年12月20日前完成审查，符合条件的，核发下一年度的生产或者使用配额许可证，予以公告，并抄送国务院有关部门和申请单位所在地省、自治区、直辖市人民政府生态环境主管部门；不符合条件的，书面通知申请单位并说明理由。

The competent department of ecological environment under the State Council shall, based on the total annual production and use quotas of ozone-depleting substances in the country and the performance of the applicant in producing or using the corresponding ozone-depleting substances, determine the production quota or use quota for the applicant for the next year, and complete the review before December 20 each year. If the conditions are met, it shall issue the production or use quota license for the next year, make an announcement, and send a copy to the relevant departments of the State Council and the competent department of ecological environment of the province, autonomous region, or municipality directly under the Central Government where the applicant is located; if the conditions are not met, it shall notify the applicant in writing and explain the reasons.

消耗臭氧层物质的生产或者使用配额许可证应当载明下列内容：

The production or use quota license for ozone-depleting substances shall contain the following contents:

(一)生产或者使用单位的名称、地址、法定代表人或者负责人；

(1) The name, address, legal representative or responsible person of the production or use unit;

(二)准予生产或者使用的消耗臭氧层物质的品种、用途及其数量；

(2) The type, purpose and quantity of ozone-depleting substances permitted for production or use;

(三)有效期限；

(3) Validity period;

(四)发证机关、发证日期和证书编号。

(4) Issuing authority, date of issuance and certificate number.

消耗臭氧层物质的生产、使用单位需要调整其配额的，应当向国务院生态环境主管部门申请办理配额变更手续。

Production and use units of ozone-depleting substances that need to adjust their quotas shall apply to the competent department of ecological environment under the State Council for handling quota change procedures.

国务院生态环境主管部门应当依照本条例第十一条、第十二条规定的条件和依据进行审查，并在受理申请之日起20个工作日内完成审查，符合条件的，对申请单位的配额进行调整，并予以公告；不符合条件的，书面通知申请单位并说明理由。

The competent department of ecological environment under the State Council shall conduct review in accordance with the conditions and bases specified in Articles 11 and 12 of these Regulations, and complete the review within 20 working days from the date of accepting the application. If the conditions are met, the quota of the applicant unit shall be adjusted and announced; if not, the applicant unit shall be notified in writing with reasons.

消耗臭氧层物质的生产单位不得超出生产配额许可证规定的品种、数量、期限生产消耗臭氧层物质，不得超出生产配额许可证规定的用途生产、销售消耗臭氧层物质。

Production units of ozone-depleting substances shall not produce ozone-depleting substances beyond the varieties, quantities, and validity period specified in the production quota license, and shall not produce or sell ozone-depleting substances beyond the uses specified in the production quota license.

禁止无生产配额许可证生产消耗臭氧层物质。

It is prohibited to produce ozone-depleting substances without a production quota license.

依照本条例规定领取使用配额许可证的单位，不得超出使用配额许可证规定的品种、用途、数量、期限使用消耗臭氧层物质。

Units that obtain a use quota license in accordance with these Regulations shall not use ozone-depleting substances beyond the varieties, uses, quantities, and validity period specified in the use quota license.

除本条例第十条规定的不需要申请领取使用配额许可证的情形外，禁止无使用配额许可证使用消耗臭氧层物质。

Except for the circumstances specified in Article 10 of these Regulations where no application for a use quota license is required, it is prohibited to use ozone-depleting substances without a use quota license.

下列单位应当按照国务院生态环境主管部门的规定办理备案手续：

The following units shall go through the registration procedures in accordance with the provisions of the competent department of ecological environment under the State Council:

(一)消耗臭氧层物质的销售单位；

(1) Sales units of ozone-depleting substances;

(二)从事含消耗臭氧层物质的制冷设备、制冷系统或者灭火系统的维修、报废处理等经营活动的单位；

(2) Units engaged in business activities such as maintenance, disposal, etc., of refrigeration equipment, refrigeration systems, or fire extinguishing systems containing ozone-depleting substances;

(三)从事消耗臭氧层物质回收、再生利用或者销毁等经营活动的单位；

(3) Units engaged in business activities such as recovery, recycling, or destruction of ozone-depleting substances.

(四)国务院生态环境主管部门规定的不需要申请领取使用配额许可证的消耗臭氧层物质的使用单位。

(4) Users of ozone-depleting substances that are not required to apply for a use quota permit as stipulated by the competent department of ecological environment under the State Council.

前款第(一)项、第(二)项、第(四)项规定的单位向所在地设区的市级人民政府生态环境主管部门备案，第(三)项规定的单位向所在地省、自治区、直辖市人民政府生态环境主管部门备案。

The entities specified in items (1), (2), and (4) of the preceding paragraph shall file records with the competent department of ecological environment of the people's government at the districted city level where they are located; the entities specified in item (3) shall file records with the competent department of ecological environment of the people's government of the province, autonomous region, or municipality directly under the Central Government where they are located.

除依照本条例规定进出口外，消耗臭氧层物质的购买和销售行为只能在符合本条例规定的消耗臭氧层物质的生产、销售和使用单位之间进行。

Except for import and export conducted in accordance with these Regulations, the purchase and sale of ozone-depleting substances may only be carried out among entities that produce, sell, or use ozone-depleting substances in compliance with these Regulations.

消耗臭氧层物质的生产、使用单位，应当按照国务院生态环境主管部门的规定采取必要的措施，防止或者减少消耗臭氧层物质的泄漏和排放。

Entities that produce or use ozone-depleting substances shall take necessary measures as stipulated by the competent department of ecological environment under the State Council to prevent or reduce the leakage and emission of ozone-depleting substances.

从事含消耗臭氧层物质的制冷设备、制冷系统或者灭火系统的维修、报废处理等经营活动的单位，应当按照国务院生态环境主管部门的规定对消耗臭氧层物质进行回收、循环利用或者交由从事消耗臭氧层物质回收、再生利用、销毁等经营活动的单位进行无害化处置。

Entities engaged in the maintenance, disposal, or other operational activities of refrigeration equipment, refrigeration systems, or fire extinguishing systems containing ozone-depleting substances shall, in accordance with the provisions of the competent department of ecological environment under the State Council, recover, recycle, or hand over ozone-depleting substances to entities engaged in the recovery, recycling, or destruction of ozone-depleting substances for harmless disposal.

从事消耗臭氧层物质回收、再生利用、销毁等经营活动的单位，以及生产过程中附带产生消耗臭氧层物质的单位，应当按照国务院生态环境主管部门的规定对消耗臭氧层物质进行无害化处置，不得直接排放。

Entities engaged in the recovery, recycling, destruction, or other operational activities of ozone-depleting substances, as well as entities that produce ozone-depleting substances as by-products during production processes, shall conduct harmless disposal of ozone-depleting substances in accordance with the provisions of the competent department of ecological environment under the State Council, and shall not directly discharge them.

从事消耗臭氧层物质的生产、销售、使用、回收、再生利用、销毁等经营活动的单位，以及从事含消耗臭氧层物质的制冷设备、制冷系统或者灭火系统的维修、报废处理等经营活动的单位，应当完整保存有关生产经营活动的原始资料至少3年，并按照国务院生态环境主管部门的规定报送相关数据。

Entities engaged in the production, sale, use, recovery, recycling, destruction, or other operational activities of ozone-depleting substances, as well as entities engaged in the maintenance, disposal, or other operational activities of refrigeration equipment, refrigeration systems, or fire extinguishing systems containing ozone-depleting substances, shall keep complete original records of relevant production and operational activities for at least three years, and shall submit relevant data in accordance with the provisions of the competent department of ecological environment under the State Council.

生产、使用消耗臭氧层物质数量较大，以及生产过程中附带产生消耗臭氧层物质数量较大的单位，应当安装自动监测设备，与生态环境主管部门的监控设备联网，并保证监测设备正常运行，确保监测数据的真实性和准确性。具体办法由国务院生态环境主管部门规定。

Entities that produce or use relatively large quantities of ozone-depleting substances, as well as entities that produce relatively large quantities of ozone-depleting substances as by-products during production processes, shall install automatic monitoring equipment, connect it to the monitoring equipment of the competent department of ecological environment, and ensure the normal operation of the monitoring equipment and the authenticity and accuracy of the monitoring data. Specific measures shall be formulated by the competent department of ecological environment under the State Council.

国家对进出口消耗臭氧层物质予以控制，并实行名录管理。国务院生态环境主管部门会同国务院商务主管部门、海关总署制定、调整和公布《中国进出口受控消耗臭氧层物质名录》。

The State controls the import and export of ozone-depleting substances and implements a list management system. The competent department of ecological environment under the State Council, together with the competent department of commerce under the State Council and the General Administration of Customs, shall formulate, adjust, and publish the 'List of Import and Export Controlled Ozone-Depleting Substances of China'.

进出口列入《中国进出口受控消耗臭氧层物质名录》的消耗臭氧层物质的单位，应当依照本条例的规定向国家消耗臭氧层物质进出口管理机构申请进出口配额，领取进出口审批单，并提交拟进出口的消耗臭氧层物质的品种、数量、来源、用途等情况的材料。

Units that import or export ozone-depleting substances listed in the China Import and Export Controlled Ozone-Depleting Substances List shall, in accordance with the provisions of these Regulations, apply to the national administrative agency for the import and export of ozone-depleting substances for import and export quotas, obtain an import and export approval document, and submit materials on the types, quantities, sources, uses, and other information of the ozone-depleting substances to be imported or exported.

国家消耗臭氧层物质进出口管理机构应当自受理申请之日起20个工作日内完成审查，作出是否批准的决定。予以批准的，向申请单位核发进出口审批单；未予批准的，书面通知申请单位并说明理由。

The national administrative agency for the import and export of ozone-depleting substances shall complete the review within 20 working days from the date of accepting the application and decide whether to approve it. If approved, it shall issue an import and export approval document to the applicant unit; if not approved, it shall notify the applicant unit in writing and state the reasons.

进出口审批单的有效期最长为90日，不得超期或者跨年度使用。

The validity period of the import and export approval document shall be a maximum of 90 days and shall not be extended beyond the period or used across years.

取得消耗臭氧层物质进出口审批单的单位，应当按照国务院商务主管部门的规定申请领取进出口许可证，持进出口许可证向海关办理通关手续。列入必须实施检验的进出口商品目录的消耗臭氧层物质，由海关依法实施检验。

Units that have obtained the import and export approval document for ozone-depleting substances shall, in accordance with the provisions of the competent commerce department of the State Council, apply for an import or export license and go through customs clearance procedures with the import or export license. Ozone-depleting substances included in the list of commodities subject to mandatory inspection for import and export shall be inspected by the customs in accordance with the law.

消耗臭氧层物质在中华人民共和国境内的海关特殊监管区域、保税监管场所与境外之间进出的，进出口单位应当依照本条例的规定申请领取进出口审批单、进出口许可证；消耗臭氧层物质在中华人民共和国境内的海关特殊监管区域、保税监管场所与境内其他区域之间进出的，或者在上述海关特殊监管区域、保税监管场所之间进出的，不需要申请领取进出口审批单、进出口许可证。

For ozone-depleting substances moving between special customs supervision zones or bonded supervision sites within the territory of the People's Republic of China and places outside the territory, the importing or exporting unit shall apply for an import and export approval document and an import or export license in accordance with the provisions of these Regulations; for ozone-depleting substances moving between special customs supervision zones or bonded supervision sites within the territory of the People's Republic of China and other areas within the territory, or between the aforementioned special customs supervision zones or bonded supervision sites, no application for an import and export approval document or import or export license is required.

生态环境主管部门和其他有关部门，依照本条例的规定和各自的职责对消耗臭氧层物质的生产、销售、使用和进出口等活动进行监督检查。

The competent ecological environment department and other relevant departments shall, in accordance with the provisions of these Regulations and their respective duties, supervise and inspect the production, sale, use, import, and export of ozone-depleting substances.

生态环境主管部门和其他有关部门进行监督检查，有权采取下列措施：

When conducting supervision and inspection, the competent ecological environment department and other relevant departments have the authority to take the following measures:

(一)要求被检查单位提供有关资料；

(1) Require the unit under inspection to provide relevant materials;

(二)要求被检查单位就执行本条例规定的有关情况作出说明；

(2) Require the unit under inspection to provide explanations on the implementation of the provisions of these Regulations;

(三)进入被检查单位的生产、经营、储存场所进行调查和取证；

(3) Enter the production, operation, and storage premises of the inspected unit to conduct investigations and collect evidence;

(四)责令被检查单位停止违反本条例规定的行为，履行法定义务；

(4) Order the inspected unit to cease acts that violate the provisions of these Regulations and to fulfill statutory obligations;

(五)扣押、查封违法生产、销售、使用、进出口的消耗臭氧层物质及其生产设备、设施、原料及产品。

(5) Seize and seal up ozone-depleting substances that are illegally produced, sold, used, imported, or exported, as well as their production equipment, facilities, raw materials, and products.

被检查单位应当予以配合，如实反映情况，提供必要资料，不得拒绝和阻碍。

The inspected unit shall cooperate, truthfully reflect the situation, provide necessary materials, and shall not refuse or obstruct.

生态环境主管部门和其他有关部门进行监督检查，监督检查人员不得少于2人，并应当出示有效的行政执法证件。

When the competent department of ecological environment and other relevant departments conduct supervision and inspection, there shall be no fewer than two inspectors, and they shall present valid administrative law enforcement credentials.

生态环境主管部门和其他有关部门的工作人员，对监督检查中知悉的商业秘密负有保密义务。

Staff members of the competent department of ecological environment and other relevant departments have a duty to keep confidential any trade secrets learned during supervision and inspection.

国务院生态环境主管部门应当建立健全消耗臭氧层物质的数据信息管理系统，收集、汇总和发布消耗臭氧层物质的生产、使用、进出口等数据信息。

The competent department of ecological environment under the State Council shall establish a sound data information management system for ozone-depleting substances, collecting, summarizing, and publishing data and information on the production, use, import, and export of ozone-depleting substances.

地方人民政府生态环境主管部门应当将监督检查中发现的违反本条例规定的行为及处理情况逐级上报至国务院生态环境主管部门。

The competent department of ecological environment of the local people's government shall report step by step to the competent department of ecological environment under the State Council any acts violating these Regulations discovered during supervision and inspection, as well as the handling status.

县级以上地方人民政府其他有关部门应当将监督检查中发现的违反本条例规定的行为及处理情况逐级上报至国务院有关部门，国务院有关部门应当及时抄送国务院生态环境主管部门。

Other relevant departments of the local people's government at or above the county level shall report step by step to the relevant departments under the State Council any acts violating these Regulations discovered during supervision and inspection, as well as the handling status, and the relevant departments under the State Council shall promptly copy the information to the competent department of ecological environment under the State Council.

地方人民政府生态环境主管部门或者其他有关部门对违反本条例规定的行为不查处的，其上级主管部门有权责令其依法查处或者直接进行查处。

If the competent department of ecological environment of the local people's government or other relevant departments fail to investigate acts violating these Regulations, their superior competent department has the authority to order them to investigate and handle according to law, or to directly conduct the investigation and handling.

负有消耗臭氧层物质监督管理职责的部门及其工作人员有下列行为之一的，对直接负责的主管人员和其他直接责任人员，依法给予处分；直接负责的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任：

Where departments and their staff responsible for the supervision and management of ozone-depleting substances commit any of the following acts, the directly responsible supervisors and other directly responsible personnel shall be given sanctions according to law; if the directly responsible supervisors and other directly responsible personnel constitute a crime, criminal liability shall be pursued according to law:

(一)违反本条例规定核发消耗臭氧层物质生产、使用配额许可证的；

(1) Issuing production or use quota licenses for ozone-depleting substances in violation of these Regulations;

(二)违反本条例规定核发消耗臭氧层物质进出口审批单或者进出口许可证的；

(2) Issuing import/export approval forms or import/export licenses for ozone-depleting substances in violation of these Regulations;

(三)对发现的违反本条例的行为不依法查处的；

(3) Failing to investigate and punish violations of these Regulations that are discovered;

(四)在办理消耗臭氧层物质生产、使用、进出口等行政许可以及实施监督检查的过程中，索取、收受他人财物或者谋取其他利益的；

(4) Soliciting, accepting property or seeking other benefits in the process of handling administrative permits for production, use, import/export of ozone-depleting substances or during supervision and inspection;

(五)有其他徇私舞弊、滥用职权、玩忽职守行为的。

(5) Other acts of engaging in malpractices for personal gain, abusing power, or neglecting duties.

无生产配额许可证生产消耗臭氧层物质的，由所在地生态环境主管部门责令停止违法行为，没收用于违法生产消耗臭氧层物质的原料、违法生产的消耗臭氧层物质和违法所得，拆除、销毁用于违法生产消耗臭氧层物质的设备、设施，并处100万元以上500万元以下的罚款。

Where a unit produces ozone-depleting substances without a production quota license, the local competent department of ecological environment shall order cessation of the illegal act, confiscate the raw materials used for illegal production, the illegally produced ozone-depleting substances, and illegal gains, dismantle and destroy the equipment and facilities used for illegal production, and impose a fine of not less than 1 million yuan but not more than 5 million yuan.

依照本条例规定应当申请领取使用配额许可证的单位无使用配额许可证使用消耗臭氧层物质，或者违反本条例规定将已淘汰的消耗臭氧层物质用于制冷剂、发泡剂、灭火剂、溶剂、清洗剂、加工助剂、杀虫剂、气雾剂、膨胀剂等用途的，由所在地生态环境主管部门责令停止违法行为，没收违法使用的消耗臭氧层物质、违法使用消耗臭氧层物质生产的产品和违法所得，并处20万元以上50万元以下的罚款；情节严重的，并处50万元以上100万元以下的罚款，拆除、销毁用于违法使用消耗臭氧层物质的设备、设施。

Where a unit that should apply for a use quota license uses ozone-depleting substances without a use quota license, or uses phased-out ozone-depleting substances as refrigerants, foaming agents, fire extinguishing agents, solvents, cleaning agents, processing aids, pesticides, aerosol propellants, expansion agents, etc., in violation of these Regulations, the local competent department of ecological environment shall order cessation of the illegal act, confiscate the illegally used ozone-depleting substances, products produced using illegally used ozone-depleting substances, and illegal gains, and impose a fine of not less than 200,000 yuan but not more than 500,000 yuan; if the circumstances are serious, a fine of not less than 500,000 yuan but not more than 1 million yuan shall be imposed, and the equipment and facilities used for illegal use of ozone-depleting substances shall be dismantled and destroyed.

消耗臭氧层物质的生产、使用单位有下列行为之一的，由所在地省、自治区、直辖市人民政府生态环境主管部门责令停止违法行为，没收违法生产、使用的消耗臭氧层物质、违法使用消耗臭氧层物质生产的产品和违法所得，并处10万元以上50万元以下的罚款，报国务院生态环境主管部门核减其生产、使用配额数量；情节严重的，并处50万元以上100万元以下的罚款，报国务院生态环境主管部门吊销其生产、使用配额许可证：

Where a production or use unit of ozone-depleting substances commits any of the following acts, the competent department of ecological environment of the province, autonomous region, or municipality directly under the Central Government shall order cessation of the illegal act, confiscate the illegally produced or used ozone-depleting substances, products produced using illegally used ozone-depleting substances, and illegal gains, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan, and report to the competent department of ecological environment of the State Council to reduce its production or use quota; if the circumstances are serious, a fine of not less than 500,000 yuan but not more than 1 million yuan shall be imposed, and report to the competent department of ecological environment of the State Council to revoke its production or use quota license:

(一)超出生产配额许可证规定的品种、数量、期限生产消耗臭氧层物质的；

(1) Producing ozone-depleting substances beyond the variety, quantity, or period specified in the production quota permit;

(二)超出生产配额许可证规定的用途生产或者销售消耗臭氧层物质的；

(2) Producing or selling ozone-depleting substances for uses other than those specified in the production quota permit;

(三)超出使用配额许可证规定的品种、数量、用途、期限使用消耗臭氧层物质的。

(3) Using ozone-depleting substances beyond the variety, quantity, use, or period specified in the use quota permit.

消耗臭氧层物质的生产、销售、使用单位向不符合本条例规定的单位销售或者购买消耗臭氧层物质的，由所在地生态环境主管部门责令改正，没收违法销售或者购买的消耗臭氧层物质和违法所得，处以所销售或者购买的消耗臭氧层物质市场总价3倍的罚款；对取得生产、使用配额许可证的单位，报国务院生态环境主管部门核减其生产、使用配额数量。

Where a unit that produces, sells, or uses ozone-depleting substances sells or purchases ozone-depleting substances to or from a unit that does not comply with these Regulations, the local ecological environment authority shall order correction, confiscate the illegally sold or purchased ozone-depleting substances and illegal gains, and impose a fine of three times the total market price of the ozone-depleting substances sold or purchased; for units that have obtained production or use quota permits, the matter shall be reported to the ecological environment authority under the State Council to reduce their production or use quotas.

消耗臭氧层物质的生产、使用单位未按照规定采取必要的措施防止或者减少消耗臭氧层物质的泄漏和排放的，由所在地生态环境主管部门责令改正，处5万元以上10万元以下的罚款；拒不改正的，处10万元以上50万元以下的罚款，报国务院生态环境主管部门核减其生产、使用配额数量。

Where a unit that produces or uses ozone-depleting substances fails to take necessary measures to prevent or reduce leakage and emission of ozone-depleting substances as required, the local ecological environment authority shall order correction and impose a fine of not less than 50,000 yuan but not more than 100,000 yuan; if it refuses to correct, a fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed, and the matter shall be reported to the ecological environment authority under the State Council to reduce its production or use quotas.

从事含消耗臭氧层物质的制冷设备、制冷系统或者灭火系统的维修、报废处理等经营活动的单位，未按照规定对消耗臭氧层物质进行回收、循环利用或者交由从事消耗臭氧层物质回收、再生利用、销毁等经营活动的单位进行无害化处置的，由所在地生态环境主管部门责令改正，处5万元以上20万元以下的罚款；拒不改正的，责令停产整治或者停业整治。

Where a unit engaged in business activities such as maintenance or disposal of refrigeration equipment, refrigeration systems, or fire extinguishing systems containing ozone-depleting substances fails to recover, recycle, or hand over ozone-depleting substances to units engaged in recovery, recycling, or destruction of ozone-depleting substances for harmless disposal as required, the local ecological environment authority shall order correction and impose a fine of not less than 50,000 yuan but not more than 200,000 yuan; if it refuses to correct, it shall be ordered to suspend production for remediation or suspend business for remediation.

从事消耗臭氧层物质回收、再生利用、销毁等经营活动的单位，以及生产过程中附带产生消耗臭氧层物质的单位，未按照规定对消耗臭氧层物质进行无害化处置而直接排放的，由所在地生态环境主管部门责令改正，处10万元以上50万元以下的罚款；拒不改正的，责令停产整治或者停业整治。

Where a unit engaged in business activities such as recovery, recycling, or destruction of ozone-depleting substances, or a unit that generates ozone-depleting substances as a by-product during production, fails to carry out harmless disposal of ozone-depleting substances as required and directly discharges them, the local ecological environment authority shall order correction and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if it refuses to correct, it shall be ordered to suspend production for remediation or suspend business for remediation.

从事消耗臭氧层物质生产、销售、使用、进出口、回收、再生利用、销毁等经营活动的单位，以及从事含消耗臭氧层物质的制冷设备、制冷系统或者灭火系统的维修、报废处理等经营活动的单位有下列行为之一的，由所在地生态环境主管部门责令改正，处5000元以上2万元以下的罚款：

Where a unit engaged in business activities such as production, sale, use, import, export, recovery, recycling, or destruction of ozone-depleting substances, or a unit engaged in business activities such as maintenance or disposal of refrigeration equipment, refrigeration systems, or fire extinguishing systems containing ozone-depleting substances, commits any of the following acts, the local ecological environment authority shall order correction and impose a fine of not less than 5,000 yuan but not more than 20,000 yuan:

(一)依照本条例规定应当向生态环境主管部门备案而未备案的；

(1) Failing to file a record with the ecological environment authority as required by these Regulations;

(二)未按照规定完整保存有关生产经营活动的原始资料的；

(2) Failing to completely preserve original materials related to production and business activities as required.

(三)未按时申报或者谎报、瞒报有关经营活动的数据资料的；

(3) Failing to declare on time or falsely reporting, concealing, or misrepresenting data on relevant business activities;

(四)未按照监督检查人员的要求提供必要的资料的。

(4) Failing to provide necessary materials as required by the inspection personnel.

生产、使用消耗臭氧层物质数量较大，以及生产过程中附带产生消耗臭氧层物质数量较大的单位，未按照规定安装自动监测设备并与生态环境主管部门的监控设备联网，或者未保证监测设备正常运行导致监测数据不真实、不准确的，由所在地生态环境主管部门责令改正，处2万元以上20万元以下的罚款；拒不改正的，责令停产整治或者停业整治。

If a unit that produces or uses ozone-depleting substances in large quantities, or that produces ozone-depleting substances as a by-product in large quantities during production, fails to install automatic monitoring equipment as required and connect it to the monitoring equipment of the ecological environmentcompetent authority, or fails to ensure the normal operation of the monitoring equipment resulting in untrue or inaccurate monitoring data, the local ecological environmentcompetent authority shall order correction and impose a fine of not less than 20,000 yuan but not more than 200,000 yuan; if correction is refused, it shall order suspension of production for remediation or suspension of business for remediation.

进出口单位无进出口许可证或者超出进出口许可证的规定进出口消耗臭氧层物质的，由海关依照有关法律、行政法规的规定予以处罚；构成犯罪的，依法追究刑事责任。

If an import or export unit imports or exports ozone-depleting substances without an import or export license or in violation of the provisions of the import or export license, the customs shall impose penalties in accordance with relevant laws and administrative regulations; if a crime is constituted, criminal liability shall be pursued according to law.

以欺骗、贿赂等不正当手段取得消耗臭氧层物质进出口配额、进出口审批单、进出口许可证的，由国家消耗臭氧层物质进出口管理机构、国务院商务主管部门依据职责撤销其进出口配额、进出口审批单、进出口许可证，3年内不得再次申请，并由所在地生态环境主管部门处10万元以上50万元以下的罚款。

If a person obtains an import or export quota, import or export approval form, or import or export license for ozone-depleting substances by improper means such as fraud or bribery, the national ozone-depleting substance import and export management authority or the competent commerce department of the State Council shall revoke the import or export quota, import or export approval form, or import or export license according to their respective functions, and the person shall not apply again within three years, and the local ecological environmentcompetent authority shall impose a fine of not less than 100,000 yuan but not more than 500,000 yuan.

拒绝、阻碍生态环境主管部门或者其他有关部门的监督检查，或者在接受监督检查时弄虚作假的，由监督检查部门责令改正，处2万元以上20万元以下的罚款；构成违反治安管理行为的，由公安机关依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。

If a person refuses or obstructs the supervision and inspection by the ecological environmentcompetent authority or other relevant departments, or practices fraud during the supervision and inspection, the inspection department shall order correction and impose a fine of not less than 20,000 yuan but not more than 200,000 yuan; if the act constitutes a violation of public security administration, the public security organ shall impose public security administration penalties according to law; if a crime is constituted, criminal liability shall be pursued according to law.

因违反本条例规定受到行政处罚的，按照国家有关规定记入信用记录，并向社会公布。

If a person is subject to administrative penalties for violating the provisions of these Regulations, it shall be recorded in the credit record in accordance with relevant state regulations and published to the public.

本条例自2010年6月1日起施行。

These Regulations shall come into force on June 1, 2010.
