Regulations on the Establishment and Staffing of Local People's Governments at All Levels

为了规范地方各级人民政府机构设置，加强编制管理，提高行政效能，根据宪法、地方各级人民代表大会和地方各级人民政府组织法，制定本条例。

These Regulations are formulated in accordance with the Constitution and the Organic Law of the Local People's Congresses and Local People's Governments of the People's Republic of China, for the purpose of standardizing the establishment of local people's governments at all levels, strengthening staffing management, and improving administrative efficiency.

地方各级人民政府机构的设置、职责配置、编制核定以及对机构编制工作的监督管理，适用本条例。

These Regulations apply to the establishment, allocation of functions, staffing determination, and supervision and management of the establishment and staffing of local people's governments at all levels.

地方各级人民政府机构设置和编制管理工作，应当按照经济社会全面协调可持续发展的要求，适应全面履行职能的需要，遵循精简、统一、效能的原则。

The establishment and staffing management of local people's governments at all levels shall be carried out in accordance with the requirements of comprehensive, coordinated, and sustainable economic and social development, to meet the needs of fully performing functions, and follow the principles of simplification, unification, and efficiency.

地方各级人民政府的机构编制工作，实行中央统一领导、地方分级管理的体制。

The establishment and staffing work of local people's governments at all levels shall implement a system of unified leadership by the central government and hierarchical management by local governments.

县级以上各级人民政府机构编制管理机关应当按照管理权限履行管理职责，并对下级机构编制工作进行业务指导和监督。

The establishment and staffing management authorities of people's governments at or above the county level shall perform their management duties in accordance with their management authority, and provide professional guidance and supervision over the establishment and staffing work of lower-level governments.

依照国家规定的程序设置的机构和核定的编制，是录用、聘用、调配工作人员、配备领导成员和核拨经费的依据。

The institutions established and the staffing approved in accordance with the procedures prescribed by the state shall serve as the basis for recruiting, employing, and transferring staff, appointing leading members, and allocating funds.

县级以上各级人民政府应当建立机构编制、人员工资与财政预算相互制约的机制，在设置机构、核定编制时，应当充分考虑财政的供养能力。机构实有人员不得突破规定的编制。禁止擅自设置机构和增加编制。对擅自设置机构和增加编制的，不得核拨财政资金或者挪用其他资金安排其经费。

People's governments at or above the county level shall establish a mechanism of mutual restraint among establishment, staffing, personnel salaries, and financial budgets. When establishing institutions and determining staffing, full consideration shall be given to the financial support capacity. The actual number of personnel in an institution shall not exceed the prescribed staffing. It is prohibited to establish institutions or increase staffing without authorization. For those that establish institutions or increase staffing without authorization, no financial funds shall be allocated, nor shall other funds be misappropriated to arrange their expenses.

县级以上各级人民政府行政机构不得干预下级人民政府行政机构的设置和编制管理工作，不得要求下级人民政府设立与其业务对口的行政机构。

The administrative institutions of people's governments at or above the county level shall not interfere with the establishment and staffing management of administrative institutions of lower-level people's governments, nor shall they require lower-level people's governments to establish administrative institutions corresponding to their own business.

地方各级人民政府行政机构应当以职责的科学配置为基础，综合设置，做到职责明确、分工合理、机构精简、权责一致，决策和执行相协调。

The administrative institutions of local people's governments at all levels shall be comprehensively established based on the scientific allocation of functions, so as to achieve clear functions, reasonable division of labor, streamlined institutions, consistent powers and responsibilities, and coordination between decision-making and execution.

地方各级人民政府行政机构应当根据履行职责的需要，适时调整。但是，在一届政府任期内，地方各级人民政府的工作部门应当保持相对稳定。

The administrative institutions of local people's governments at all levels shall be adjusted in a timely manner according to the needs of performing their functions. However, during the term of a government, the working departments of local people's governments at all levels shall remain relatively stable.

地方各级人民政府行政机构的设立、撤销、合并或者变更规格、名称，由本级人民政府提出方案，经上一级人民政府机构编制管理机关审核后，报上一级人民政府批准；其中，县级以上地方各级人民政府行政机构的设立、撤销或者合并，还应当依法报本级人民代表大会常务委员会备案。

The establishment, dissolution, merger, or change of specification or name of an administrative institution of a local people's government at any level shall be proposed by the people's government at that level, reviewed by the establishment and staffing management authority of the people's government at the next higher level, and submitted to the people's government at the next higher level for approval. Among these, the establishment, dissolution, or merger of an administrative institution of a local people's government at or above the county level shall also be reported to the standing committee of the people's congress at the same level for recordation in accordance with the law.

地方各级人民政府行政机构职责相同或者相近的，原则上由一个行政机构承担。

Where the functions of administrative institutions of local people's governments at all levels are identical or similar, in principle, they shall be undertaken by one administrative institution.

行政机构之间对职责划分有异议的，应当主动协商解决。协商一致的，报本级人民政府机构编制管理机关备案；协商不一致的，应当提请本级人民政府机构编制管理机关提出协调意见，由机构编制管理机关报本级人民政府决定。

If there is a dispute over the division of functions between administrative institutions, they shall actively negotiate to resolve it. If an agreement is reached through negotiation, it shall be reported to the establishment and staffing management authority of the people's government at the same level for recordation. If no agreement is reached through negotiation, the matter shall be submitted to the establishment and staffing management authority of the people's government at the same level for coordination opinions, and the establishment and staffing management authority shall report to the people's government at the same level for a decision.

地方各级人民政府设立议事协调机构，应当严格控制；可以交由现有机构承担职能的或者由现有机构进行协调可以解决问题的，不另设立议事协调机构。

The establishment of deliberative and coordinating bodies by local people's governments at all levels shall be strictly controlled. If the functions can be undertaken by existing institutions or problems can be solved through coordination by existing institutions, no separate deliberative and coordinating body shall be established.

为办理一定时期内某项特定工作设立的议事协调机构，应当明确规定其撤销的条件和期限。

For a deliberative and coordinating body established to handle a specific task within a certain period, the conditions and time limit for its dissolution shall be clearly stipulated.

县级以上地方各级人民政府的议事协调机构不单独设立办事机构，具体工作由有关的行政机构承担。

The deliberative and coordinating bodies of local people's governments at or above the county level shall not establish separate offices; the specific work shall be undertaken by the relevant administrative institutions.

地方各级人民政府行政机构根据工作需要和精干的原则，设立必要的内设机构。县级以上地方各级人民政府行政机构的内设机构的设立、撤销、合并或者变更规格、名称，由该行政机构报本级人民政府机构编制管理机关审批。

The administrative institutions of local people's governments at all levels shall, based on work needs and the principle of leanness, establish necessary internal bodies. The establishment, dissolution, merger, or change of specification or name of an internal body of an administrative institution of a local people's government at or above the county level shall be submitted by that administrative institution to the establishment and staffing management authority of the people's government at the same level for approval.

地方各级人民政府行政机构的编制，应当根据其所承担的职责，按照精简的原则核定。

The staffing of administrative institutions of local people's governments at all levels shall be determined in accordance with the functions they undertake and the principle of leanness.

机构编制管理机关应当按照编制的不同类别和使用范围审批编制。地方各级人民政府行政机构应当使用行政编制，事业单位应当使用事业编制，不得混用、挤占、挪用或者自行设定其他类别的编制。

The establishment and staffing management authority shall approve staffing according to different categories and scopes of use. Administrative institutions of local people's governments at all levels shall use administrative staffing, and public institutions shall use public institution staffing. Mixing, occupying, misappropriating, or self-setting other categories of staffing is prohibited.

地方各级人民政府的行政编制总额，由省、自治区、直辖市人民政府提出，经国务院机构编制管理机关审核后，报国务院批准。

The total administrative staffing of local people's governments at all levels shall be proposed by the people's government of the province, autonomous region, or municipality directly under the central government, reviewed by the establishment and staffing management authority of the State Council, and submitted to the State Council for approval.

根据工作需要，国务院机构编制管理机关报经国务院批准，可以在地方行政编制总额内对特定的行政机构的行政编制实行专项管理。

When necessary, the establishment and staffing management authority of the State Council may, with the approval of the State Council, implement special management of the administrative staffing of specific administrative institutions within the total local administrative staffing.

地方各级人民政府根据调整职责的需要，可以在行政编制总额内调整本级人民政府有关部门的行政编制。但是，在同一个行政区域不同层级之间调配使用行政编制的，应当由省、自治区、直辖市人民政府机构编制管理机关报国务院机构编制管理机关审批。

Local people's governments at all levels may, based on the need to adjust functions, adjust the administrative staffing of relevant departments of the people's government at the same level within the total administrative staffing quota. However, the allocation and use of administrative staffing between different levels within the same administrative region shall be submitted by the institutional staffing management organ of the people's government of the province, autonomous region, or municipality directly under the Central Government to the institutional staffing management organ of the State Council for approval.

地方各级人民政府议事协调机构不单独确定编制，所需要的编制由承担具体工作的行政机构解决。

The coordination bodies of local people's governments at all levels shall not have separate staffing; the staffing required shall be resolved by the administrative organs undertaking the specific work.

地方各级人民政府行政机构的领导职数，按照地方各级人民代表大会和地方各级人民政府组织法的有关规定确定。

The number of leadership positions in administrative organs of local people's governments at all levels shall be determined in accordance with the relevant provisions of the Organic Law of the Local People's Congresses and Local People's Governments at All Levels.

县级以上各级人民政府机构编制管理机关应当按照管理权限，对机构编制管理的执行情况进行监督检查；必要时，可以会同监察机关和其他有关部门对机构编制管理的执行情况进行监督检查。有关组织和个人应当予以配合。

The institutional staffing management organs of people's governments at or above the county level shall, in accordance with their management authority, supervise and inspect the implementation of institutional staffing management; when necessary, they may, together with supervisory organs and other relevant departments, supervise and inspect the implementation of institutional staffing management. Relevant organizations and individuals shall cooperate.

县级以上各级人民政府机构编制管理机关实施监督检查时，应当严格执行规定的程序，发现违反本条例规定的行为，应当向本级人民政府提出处理意见和建议。

When conducting supervision and inspection, the institutional staffing management organs of people's governments at or above the county level shall strictly follow the prescribed procedures. If any act violating these regulations is found, they shall submit opinions and suggestions for handling to the people's government at the same level.

地方各级人民政府机构编制管理机关，应当如实向上级机构编制管理机关提交机构编制年度统计资料，不得虚报、瞒报、伪造。

The institutional staffing management organs of local people's governments at all levels shall truthfully submit annual statistical data on institutional staffing to the superior institutional staffing management organ, and shall not make false reports, conceal reports, or forge data.

县级以上各级人民政府机构编制管理机关应当定期评估机构和编制的执行情况，并将评估结果作为调整机构编制的参考依据。评估的具体办法，由国务院机构编制管理机关制定。

The institutional staffing management organs of people's governments at or above the county level shall regularly evaluate the implementation of institutions and staffing, and use the evaluation results as a reference basis for adjusting institutions and staffing. The specific evaluation measures shall be formulated by the institutional staffing management organ of the State Council.

任何组织和个人对违反机构编制管理规定的行为，都有权向机构编制管理机关、监察机关等有关部门举报。

Any organization or individual has the right to report to the institutional staffing management organ, supervisory organ, or other relevant departments any act that violates the provisions on institutional staffing management.

县级以上各级人民政府机构编制管理机关应当接受社会监督。

The institutional staffing management organs of people's governments at or above the county level shall accept social supervision.

有下列行为之一的，由机构编制管理机关给予通报批评，并责令限期改正；情节严重的，对直接负责的主管人员和其他直接责任人员，依法给予处分：

Any of the following acts shall be given a notice of criticism by the institutional staffing management organ and ordered to make corrections within a time limit; if the circumstances are serious, the directly responsible person in charge and other directly responsible persons shall be given sanctions according to law:

(一)擅自设立、撤销、合并行政机构或者变更规格、名称的；

(1) Unauthorized establishment, dissolution, or merger of administrative organs, or change of their specifications or names;

(二)擅自改变行政机构职责的；

(2) Unauthorized change of the functions of administrative organs;

(三)擅自增加编制或者改变编制使用范围的；

(3) Unauthorized increase of staffing or change of the scope of staffing use;

(四)超出编制限额调配财政供养人员、为超编人员核拨财政资金或者挪用其他资金安排其经费、以虚报人员等方式占用编制并冒用财政资金的；

(4) Allocating financial support personnel beyond the staffing quota, allocating financial funds for overstaffed personnel, or misappropriating other funds to arrange their expenses, or occupying staffing and misappropriating financial funds by falsely reporting personnel;

(五)擅自超职数、超规格配备领导成员的；

(5) Unauthorized appointment of leading members beyond the number of positions or specifications;

(六)违反规定干预下级人民政府行政机构的设置和编制管理工作的；

(6) Violating regulations to interfere with the establishment and staffing management of administrative organs of lower-level people's governments;

(七)违反规定审批机构、编制的；

(7) Violating regulations to approve institutions or staffing;

(八)违反机构编制管理规定的其他行为。

(8) Other acts violating the provisions on institutional staffing management.

机构编制管理机关工作人员在机构编制管理工作中滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予处分。

If staff members of the institutional staffing management organ abuse their power, neglect their duties, or engage in malpractice for personal gain in institutional staffing management work, which constitutes a crime, they shall be investigated for criminal liability according to law; if it does not constitute a crime, they shall be given sanctions according to law.

本条例所称编制，是指机构编制管理机关核定的行政机构和事业单位的人员数额和领导职数。

For the purposes of these regulations, 'staffing' refers to the number of personnel and leadership positions of administrative organs and public institutions approved by the institutional staffing management organ.

地方的事业单位机构和编制管理办法，由省、自治区、直辖市人民政府机构编制管理机关拟定，报国务院机构编制管理机关审核后，由省、自治区、直辖市人民政府发布。事业编制的全国性标准由国务院机构编制管理机关会同国务院财政部门和其他有关部门制定。

The measures for the management of public institution institutions and staffing at the local level shall be drafted by the institutional staffing management organ of the people's government of the province, autonomous region, or municipality directly under the Central Government, submitted to the institutional staffing management organ of the State Council for review, and then promulgated by the people's government of the province, autonomous region, or municipality directly under the Central Government. The national standards for public institution staffing shall be formulated by the institutional staffing management organ of the State Council together with the finance department of the State Council and other relevant departments.

本条例自2007年5月1日起施行。

These regulations shall come into force as of May 1, 2007.
