Regulations on the Control of General Aviation Flights

(Promulgated by Decree No. 371 of the State Council of the People's Republic of China and the Central Military Commission of the People's Republic of China on January 10, 2003, and effective as of May 1, 2003)

为了促进通用航空事业的发展，规范通用航空飞行活动，保证飞行安全，根据《中华人民共和国民用航空法》和《中华人民共和国飞行基本规则》，制定本条例。

These Regulations are formulated in accordance with the Civil Aviation Law of the People's Republic of China and the Basic Rules for Flights of the People's Republic of China for the purpose of promoting the development of general aviation, regulating general aviation flight activities, and ensuring flight safety.

在中华人民共和国境内从事通用航空飞行活动，必须遵守本条例。

Any person engaging in general aviation flight activities within the territory of the People's Republic of China must comply with these Regulations.

在中华人民共和国境内从事升放无人驾驶自由气球和系留气球活动，适用本条例的有关规定。

The release of unmanned free balloons and tethered balloons within the territory of the People's Republic of China shall be subject to the relevant provisions of these Regulations.

本条例所称通用航空，是指除军事、警务、海关缉私飞行和公共航空运输飞行以外的航空活动，包括从事工业、农业、林业、渔业、矿业、建筑业的作业飞行和医疗卫生、抢险救灾、气象探测、海洋监测、科学实验、遥感测绘、教育训练、文化体育、旅游观光等方面的飞行活动。

For the purposes of these Regulations, "general aviation" refers to aviation activities other than military, police, customs anti-smuggling flights, and public air transport flights, including operational flights in industry, agriculture, forestry, fishery, mining, and construction, as well as flights in medical and health services, emergency rescue and disaster relief, meteorological detection, ocean monitoring, scientific experiments, remote sensing and mapping, education and training, cultural and sports activities, and tourism.

从事通用航空飞行活动的单位、个人，必须按照《中华人民共和国民用航空法》的规定取得从事通用航空活动的资格，并遵守国家有关法律、行政法规的规定。

Units and individuals engaged in general aviation flight activities must obtain qualifications for engaging in general aviation activities in accordance with the provisions of the Civil Aviation Law of the People's Republic of China and comply with relevant national laws and administrative regulations.

飞行管制部门按照职责分工，负责对通用航空飞行活动实施管理，提供空中交通管制服务。相关飞行保障单位应当积极协调配合，做好有关服务保障工作，为通用航空飞行活动创造便利条件。

Flight control departments shall, in accordance with their respective functions and duties, manage general aviation flight activities and provide air traffic control services. Relevant flight support units shall actively coordinate and cooperate, provide good service and support, and create convenient conditions for general aviation flight activities.

从事通用航空飞行活动的单位、个人使用机场飞行空域、航路、航线，应当按照国家有关规定向飞行管制部门提出申请，经批准后方可实施。

Units and individuals engaged in general aviation flight activities that use airport flight airspace, airways, or routes shall submit an application to the flight control department in accordance with relevant state regulations and may proceed only after approval.

从事通用航空飞行活动的单位、个人，根据飞行活动要求，需要划设临时飞行空域的，应当向有关飞行管制部门提出划设临时飞行空域的申请。

Units and individuals engaged in general aviation flight activities that need to establish temporary flight airspace according to flight activity requirements shall submit an application to the relevant flight control department for establishing temporary flight airspace.

划设临时飞行空域的申请应当包括下列内容：

The application for establishing temporary flight airspace shall include the following contents:

(一)临时飞行空域的水平范围、高度；

(1) The horizontal range and altitude of the temporary flight airspace;

(二)飞入和飞出临时飞行空域的方法；

(2) The method of entering and exiting the temporary flight airspace;

(三)使用临时飞行空域的时间；

(3) The time of use of the temporary flight airspace;

(四)飞行活动性质；

(4) The nature of the flight activity;

(五)其他有关事项。

(5) Other relevant matters.

划设临时飞行空域，按照下列规定的权限批准：

The establishment of temporary flight airspace shall be approved according to the following specified authorities:

(一)在机场区域内划设的，由负责该机场飞行管制的部门批准；

(1) If established within the airport area, it shall be approved by the flight control department responsible for that airport;

(二)超出机场区域在飞行管制分区内划设的，由负责该分区飞行管制的部门批准；

(2) If established beyond the airport area within a flight control subzone, it shall be approved by the flight control department responsible for that subzone;

(三)超出飞行管制分区在飞行管制区内划设的，由负责该管制区飞行管制的部门批准；

(3) If the temporary flight zone is to be established beyond a flight control subzone but within a flight control zone, it shall be approved by the department responsible for flight control in that zone;

(四)在飞行管制区间划设的，由中国人民解放军空军批准。

(4) If the temporary flight zone is to be established between flight control zones, it shall be approved by the Air Force of the People's Liberation Army.

批准划设临时飞行空域的部门应当将划设的临时飞行空域报上一级飞行管制部门备案，并通报有关单位。

The department that approves the establishment of a temporary flight zone shall report the established temporary flight zone to the higher-level flight control department for record and notify the relevant units.

划设临时飞行空域的申请，应当在拟使用临时飞行空域7个工作日前向有关飞行管制部门提出；负责批准该临时飞行空域的飞行管制部门应当在拟使用临时飞行空域3个工作日前作出批准或者不予批准的决定，并通知申请人。

An application for establishing a temporary flight zone shall be submitted to the relevant flight control department 7 working days before the intended use of the temporary flight zone; the flight control department responsible for approving the temporary flight zone shall make a decision to approve or disapprove within 3 working days before the intended use and notify the applicant.

临时飞行空域的使用期限应当根据通用航空飞行的性质和需要确定，通常不得超过12个月。

The period of use of a temporary flight zone shall be determined according to the nature and needs of the general aviation flight, and generally shall not exceed 12 months.

因飞行任务的要求，需要延长临时飞行空域使用期限的，应当报经批准该临时飞行空域的飞行管制部门同意。

If it is necessary to extend the period of use of a temporary flight zone due to flight mission requirements, the consent of the flight control department that approved the temporary flight zone shall be obtained.

通用航空飞行任务完成后，从事通用航空飞行活动的单位、个人应当及时报告有关飞行管制部门，其申请划设的临时飞行空域即行撤销。

After the completion of a general aviation flight mission, the unit or individual engaged in general aviation flight activities shall promptly report to the relevant flight control department, and the temporary flight zone applied for shall be revoked immediately.

已划设的临时飞行空域，从事通用航空飞行活动的其他单位、个人因飞行需要，经批准划设该临时飞行空域的飞行管制部门同意，也可以使用。

Other units or individuals engaged in general aviation flight activities may also use an established temporary flight zone if needed for flight, subject to the consent of the flight control department that approved the establishment of the temporary flight zone.

从事通用航空飞行活动的单位、个人实施飞行前，应当向当地飞行管制部门提出飞行计划申请，按照批准权限，经批准后方可实施。

Before conducting a flight, units or individuals engaged in general aviation flight activities shall submit a flight plan application to the local flight control department, and may proceed only after approval according to the approval authority.

飞行计划申请应当包括下列内容：

A flight plan application shall include the following contents:

(一)飞行单位；

(1) Flight unit;

(二)飞行任务性质；

(2) Nature of flight mission;

(三)机长(飞行员)姓名、代号(呼号)和空勤组人数；

(3) Name, code (call sign) of the captain (pilot), and number of crew members;

(四)航空器型别和架数；

(4) Aircraft type and number of aircraft;

(五)通信联络方法和二次雷达应答机代码；

(5) Communication method and secondary surveillance radar transponder code;

(六)起飞、降落机场和备降场；

(6) Departure and landing airports and alternate airports;

(七)预计飞行开始、结束时间；

(7) Estimated flight start and end time;

(八)飞行气象条件；

(8) Flight meteorological conditions;

(九)航线、飞行高度和飞行范围；

(9) Route, flight altitude, and flight range;

(十)其他特殊保障需求。

(10) Other special support needs.

从事通用航空飞行活动的单位、个人有下列情形之一的，必须在提出飞行计划申请时，提交有效的任务批准文件：

Units or individuals engaged in general aviation flight activities must submit valid mission approval documents when applying for a flight plan in any of the following circumstances:

(一)飞出或者飞入我国领空的(公务飞行除外)；

(1) Flying out of or into China's territorial airspace (excluding official flights);

(二)进入空中禁区或者国(边)界线至我方一侧10公里之间地带上空飞行的；

(2) Flying into a prohibited air zone or the airspace within 10 kilometers from the national border (boundary) line on China's side;

(三)在我国境内进行航空物探或者航空摄影活动的；

(3) Conducting aerial geophysical surveys or aerial photography activities within China;

(四)超出领海(海岸)线飞行的；

(4) Flying beyond the territorial sea (coastline);

(五)外国航空器或者外国人使用我国航空器在我国境内进行通用航空飞行活动的。

(5) Foreign aircraft or foreigners using Chinese aircraft to conduct general aviation flight activities within China.

使用机场飞行空域、航路、航线进行通用航空飞行活动，其飞行计划申请由当地飞行管制部门批准或者由当地飞行管制部门报经上级飞行管制部门批准。

For general aviation flight activities using airport flight airspace, airways, or routes, the flight plan application shall be approved by the local flight control department or submitted by the local flight control department to the higher-level flight control department for approval.

使用临时飞行空域、临时航线进行通用航空飞行活动，其飞行计划申请按照下列规定的权限批准：

For general aviation flight activities using temporary flight airspace or temporary routes, the flight plan application shall be approved according to the following authority:

(一)在机场区域内的，由负责该机场飞行管制的部门批准；

(1) Within the airport area, it shall be approved by the flight control department responsible for that airport;

(二)超出机场区域在飞行管制分区内的，由负责该分区飞行管制的部门批准；

(2) If the flight extends beyond the airport area but within a flight control subzone, approval shall be obtained from the department responsible for flight control in that subzone;

(三)超出飞行管制分区在飞行管制区内的，由负责该区域飞行管制的部门批准；

(3) If the flight extends beyond the flight control subzone but within a flight control zone, approval shall be obtained from the department responsible for flight control in that zone;

(四)超出飞行管制区的，由中国人民解放军空军批准。

(4) If the flight extends beyond the flight control zone, approval shall be obtained from the Air Force of the People's Liberation Army.

飞行计划申请应当在拟飞行前1天15时前提出；飞行管制部门应当在拟飞行前1天21时前作出批准或者不予批准的决定，并通知申请人。

A flight plan application shall be submitted before 15:00 on the day prior to the intended flight; the flight control department shall make a decision to approve or disapprove before 21:00 on the day prior to the intended flight and notify the applicant.

执行紧急救护、抢险救灾、人工影响天气或者其他紧急任务的，可以提出临时飞行计划申请。临时飞行计划申请最迟应当在拟飞行1小时前提出；飞行管制部门应当在拟起飞时刻15分钟前作出批准或者不予批准的决定，并通知申请人。

For emergency rescue, disaster relief, weather modification, or other urgent missions, a temporary flight plan application may be submitted. The temporary flight plan application shall be submitted no later than 1 hour before the intended flight; the flight control department shall make a decision to approve or disapprove 15 minutes before the intended takeoff time and notify the applicant.

在划设的临时飞行空域内实施通用航空飞行活动的，可以在申请划设临时飞行空域时一并提出15天以内的短期飞行计划申请，不再逐日申请；但是每日飞行开始前和结束后，应当及时报告飞行管制部门。

For general aviation flight activities conducted within a designated temporary flight airspace, a short-term flight plan application for up to 15 days may be submitted together with the application for designation of the temporary flight airspace, without the need for daily applications; however, the flight control department shall be promptly notified before and after each day's flight.

使用临时航线转场飞行的，其飞行计划申请应当在拟飞行2天前向当地飞行管制部门提出；飞行管制部门应当在拟飞行前1天18时前作出批准或者不予批准的决定，并通知申请人，同时按照规定通报有关单位。

For cross-country flights using temporary routes, the flight plan application shall be submitted to the local flight control department 2 days before the intended flight; the flight control department shall make a decision to approve or disapprove before 18:00 on the day prior to the intended flight, notify the applicant, and inform relevant units as required.

飞行管制部门对违反飞行管制规定的航空器，可以根据情况责令改正或者停止其飞行。

The flight control department may, depending on the circumstances, order an aircraft that violates flight control regulations to rectify the violation or cease its flight.

通信、导航、雷达、气象、航行情报和其他飞行保障部门应当认真履行职责，密切协同，统筹兼顾，合理安排，提高飞行空域和时间的利用率，保障通用航空飞行顺利实施。

Communication, navigation, radar, meteorology, flight information, and other flight support departments shall conscientiously perform their duties, closely coordinate, make overall plans, arrange reasonably, improve the utilization rate of flight airspace and time, and ensure the smooth implementation of general aviation flights.

通信、导航、雷达、气象、航行情报和其他飞行保障部门对于紧急救护、抢险救灾、人工影响天气等突发性任务的飞行，应当优先安排。

Communication, navigation, radar, meteorology, flight information and other flight support departments shall give priority to flights for emergency rescue, disaster relief, weather modification and other sudden missions.

从事通用航空飞行活动的单位、个人组织各类飞行活动，应当制定安全保障措施，严格按照批准的飞行计划组织实施，并按照要求报告飞行动态。

Units and individuals engaged in general aviation flight activities organizing various flight activities shall formulate safety measures, strictly implement them in accordance with the approved flight plan, and report flight dynamics as required.

从事通用航空飞行活动的单位、个人，应当与有关飞行管制部门建立可靠的通信联络。

Units and individuals engaged in general aviation flight activities shall establish reliable communication links with the relevant flight control departments.

在划设的临时飞行空域内从事通用航空飞行活动时，应当保持空地联络畅通。

When conducting general aviation flight activities within a designated temporary flight airspace, air-ground communication shall be kept smooth.

在临时飞行空域内进行通用航空飞行活动，通常由从事通用航空飞行活动的单位、个人负责组织实施，并对其安全负责。

General aviation flight activities within a temporary flight airspace shall generally be organized and implemented by the units and individuals engaged in such activities, who shall be responsible for their safety.

飞行管制部门应当按照职责分工或者协议，为通用航空飞行活动提供空中交通管制服务。

Flight control departments shall provide air traffic control services for general aviation flight activities in accordance with their division of responsibilities or agreements.

从事通用航空飞行活动需要使用军用机场的，应当将使用军用机场的申请和飞行计划申请一并向有关部队司令机关提出，由有关部队司令机关作出批准或者不予批准的决定，并通知申请人。

If a military airport is needed for general aviation flight activities, the application for using the military airport and the flight plan application shall be submitted together to the relevant military command organ, which shall make a decision to approve or disapprove and notify the applicant.

从事通用航空飞行活动的航空器转场飞行，需要使用军用或者民用机场的，由该机场管理机构按照规定或者协议提供保障；使用军民合用机场的，由从事通用航空飞行活动的单位、个人与机场有关部门协商确定保障事宜。

If a diversion flight of an aircraft engaged in general aviation flight activities requires the use of a military or civil airport, the airport management agency shall provide support in accordance with regulations or agreements; if a military-civilian joint-use airport is used, the units and individuals engaged in general aviation flight activities shall negotiate with the relevant airport departments to determine support matters.

在临时机场或者起降点飞行的组织指挥，通常由从事通用航空飞行活动的单位、个人负责。

The organization and command of flights at temporary airports or landing sites shall generally be the responsibility of the units and individuals engaged in general aviation flight activities.

从事通用航空飞行活动的民用航空器能否起飞、着陆和飞行，由机长(飞行员)根据适航标准和气象条件等最终确定，并对此决定负责。

Whether a civil aircraft engaged in general aviation flight activities can take off, land and fly shall be finally determined by the captain (pilot) based on airworthiness standards and meteorological conditions, and the captain shall be responsible for this decision.

通用航空飞行保障收费标准，按照国家有关国内机场收费标准执行。

The charging standards for general aviation flight support services shall be implemented in accordance with the relevant national standards for domestic airport charges.

升放无人驾驶自由气球或者系留气球，不得影响飞行安全。

The release of unmanned free balloons or tethered balloons shall not affect flight safety.

本条例所称无人驾驶自由气球，是指无动力驱动、无人操纵、轻于空气、总质量大于4千克自由飘移的充气物体。

For the purposes of these Regulations, 'unmanned free balloon' means an inflatable object that is not power-driven, unmanned, lighter than air, with a total mass greater than 4 kilograms, and free-floating.

本条例所称系留气球，是指系留于地面物体上、直径大于1.8米或者体积容量大于3.2立方米、轻于空气的充气物体。

For the purposes of these Regulations, 'tethered balloon' means an inflatable object that is tethered to a ground object, with a diameter greater than 1.8 meters or a volume capacity greater than 3.2 cubic meters, and lighter than air.

无人驾驶自由气球和系留气球的分类、识别标志和升放条件等，应当符合国家有关规定。

The classification, identification marks, and release conditions of unmanned free balloons and tethered balloons shall comply with the relevant national provisions.

进行升放无人驾驶自由气球或者系留气球活动，必须经设区的市级以上气象主管机构会同有关部门批准。具体办法由国务院气象主管机构制定。

Activities involving the release of unmanned free balloons or tethered balloons must be approved by the meteorological authority at or above the city level with districts, in conjunction with relevant departments. Specific measures shall be formulated by the meteorological authority of the State Council.

升放无人驾驶自由气球，应当在拟升放2天前持本条例第三十三条规定的批准文件向当地飞行管制部门提出升放申请；飞行管制部门应当在拟升放1天前作出批准或者不予批准的决定，并通知申请人。

To release an unmanned free balloon, the release unit shall submit an application to the local flight control department with the approval document specified in Article 33 of these Regulations two days before the intended release; the flight control department shall make a decision to approve or disapprove one day before the intended release and notify the applicant.

升放无人驾驶自由气球的申请，通常应当包括下列内容：

An application for releasing an unmanned free balloon shall generally include the following contents:

(一)升放的单位、个人和联系方法；

(1) The unit, individual, and contact information for the release;

(二)气球的类型、数量、用途和识别标志；

(2) Type, quantity, purpose and identification marks of the balloons;

(三)升放地点和计划回收区；

(3) Release location and planned recovery area;

(四)预计升放和回收(结束)的时间；

(4) Estimated time of release and recovery (end);

(五)预计飘移方向、上升的速度和最大高度。

(5) Estimated drift direction, ascent speed and maximum altitude.

升放无人驾驶自由气球，应当按照批准的申请升放，并及时向有关飞行管制部门报告升放动态；取消升放时，应当及时报告有关飞行管制部门。

When releasing an unmanned free balloon, it shall be released in accordance with the approved application, and the release dynamics shall be promptly reported to the relevant flight control department; if the release is cancelled, the relevant flight control department shall be promptly informed.

升放系留气球，应当确保系留牢固，不得擅自释放。

When releasing a tethered balloon, it shall be securely tethered and shall not be released without authorization.

系留气球升放的高度不得高于地面150米，但是低于距其水平距离50米范围内建筑物顶部的除外。

The altitude of a tethered balloon shall not exceed 150 meters above ground, except when it is lower than the top of buildings within a horizontal distance of 50 meters.

系留气球升放的高度超过地面50米的，必须加装快速放气装置，并设置识别标志。

If the altitude of a tethered balloon exceeds 50 meters above ground, a quick-release device must be installed and identification marks must be set.

升放的无人驾驶自由气球或者系留气球中发生下列可能危及飞行安全的情况时，升放单位、个人应当及时报告有关飞行管制部门和当地气象主管机构：

When any of the following situations that may endanger flight safety occur in the released unmanned free balloon or tethered balloon, the releasing unit or individual shall promptly report to the relevant flight control department and the local meteorological authority:

(一)无人驾驶自由气球非正常运行的；

(1) Abnormal operation of the unmanned free balloon;

(二)系留气球意外脱离系留的；

(2) Accidental release of a tethered balloon from its tether;

(三)其他可能影响飞行安全的异常情况。

(3) Other abnormal situations that may affect flight safety.

加装快速放气装置的系留气球意外脱离系留时，升放系留气球的单位、个人应当在保证地面人员、财产安全的条件下，快速启动放气装置。

When a tethered balloon equipped with a rapid deflation device accidentally breaks free from its tether, the unit or individual releasing the tethered balloon shall quickly activate the deflation device under conditions ensuring the safety of ground personnel and property.

禁止在依法划设的机场范围内和机场净空保护区域内升放无人驾驶自由气球或者系留气球，但是国家另有规定的除外。

It is prohibited to release unmanned free balloons or tethered balloons within the legally designated airport area and airport clearance protection zone, unless otherwise provided by the state.

违反本条例规定，《中华人民共和国民用航空法》、《中华人民共和国飞行基本规则》及有关行政法规对其处罚有规定的，从其规定；没有规定的，适用本章规定。

If a violation of these regulations is subject to penalties under the Civil Aviation Law of the People's Republic of China, the Basic Rules of Flight of the People's Republic of China, or relevant administrative regulations, those provisions shall prevail; if there are no such provisions, this chapter shall apply.

从事通用航空飞行活动的单位、个人违反本条例规定，有下列情形之一的，由有关部门按照职责分工责令改正，给予警告；情节严重的，处2万元以上10万元以下罚款，并可给予责令停飞1个月至3个月、暂扣直至吊销经营许可证、飞行执照的处罚；造成重大事故或者严重后果的，依照刑法关于重大飞行事故罪或者其他罪的规定，依法追究刑事责任：

If a unit or individual engaged in general aviation flight activities violates these regulations under any of the following circumstances, the relevant department shall, within its scope of duties, order correction and give a warning; if the circumstances are serious, a fine of not less than 20,000 yuan but not more than 100,000 yuan shall be imposed, and a penalty of grounding for 1 to 3 months, suspension or even revocation of the operating license or flight license may be imposed; if a major accident or serious consequence is caused, criminal liability shall be pursued in accordance with the Criminal Law regarding the crime of major flight accident or other crimes:

(一)未经批准擅自飞行的；

(1) Flying without approval;

(二)未按批准的飞行计划飞行的；

(2) Flying not in accordance with the approved flight plan;

(三)不及时报告或者漏报飞行动态的；

(3) Failing to report or omitting to report flight dynamics in a timely manner;

(四)未经批准飞入空中限制区、空中危险区的。

(4) Entering an airspace restricted area or airspace danger area without approval.

违反本条例规定，未经批准飞入空中禁区的，由有关部门按照国家有关规定处置。

Whoever, in violation of these Regulations, enters an airspace prohibited area without approval shall be dealt with by the relevant department in accordance with the relevant provisions of the state.

违反本条例规定，升放无人驾驶自由气球或者系留气球，有下列情形之一的，由气象主管机构或者有关部门按照职责分工责令改正，给予警告；情节严重的，处1万元以上5万元以下罚款；造成重大事故或者严重后果的，依照刑法关于重大责任事故罪或者其他罪的规定，依法追究刑事责任：

Whoever, in violation of these Regulations, releases an unmanned free balloon or a tethered balloon under any of the following circumstances shall be ordered to make corrections and given a warning by the meteorological competent authority or the relevant department according to their respective functions and duties; if the circumstances are serious, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed; if a major accident or serious consequence is caused, criminal liability shall be investigated in accordance with the provisions of the Criminal Law on the crime of major liability accident or other crimes:

(一)未经批准擅自升放的；

(1) Releasing without approval;

(二)未按照批准的申请升放的；

(2) Releasing not in accordance with the approved application;

(三)未按照规定设置识别标志的；

(3) Failing to set identification marks as required;

(四)未及时报告升放动态或者系留气球意外脱离时未按照规定及时报告的；

(4) Failing to report the release dynamics in a timely manner or failing to report in a timely manner as required when a tethered balloon accidentally detaches;

(五)在规定的禁止区域内升放的。

(5) Releasing in a prohibited area as specified.

按照本条例实施的罚款，应当全额上缴财政。

Fines imposed in accordance with these Regulations shall be turned over to the state treasury in full.

本条例自2003年5月1日起施行。

These Regulations shall come into force as of May 1, 2003.
