导游人员管理条例

This regulation governs the qualification, conduct, and management of tour guides in China to protect the rights of tourists and guides and promote healthy tourism development.

本条例所称导游人员,是指依照本条例的规定取得导游证,接受旅行社委派,为旅游者提供向导、讲解及相关旅游服务的人员。

For the purposes of these Regulations, 'tour guide' refers to a person who, in accordance with these Regulations, obtains a tour guide certificate, accepts assignment from a travel agency, and provides tourists with guiding, interpretation, and related tourism services.

具有高级中学、中等专业学校或者以上学历,身体健康,具有适应导游需要的基本知识和语言表达能力的中华人民共和国公民,可以参加导游人员资格考试;经考试合格的,由国务院旅游行政部门或者国务院旅游行政部门委托省、自治区、直辖市人民政府旅游行政部门颁发导游人员资格证书。

Translation

A citizen of the People's Republic of China who has a senior high school, secondary specialized school, or higher education level, is in good health, and possesses the basic knowledge and language expression ability necessary for tour guiding may take the tour guide qualification examination. Those who pass the examination shall be issued a tour guide qualification certificate by the tourism administrative department of the State Council or by the tourism administrative department of a province, autonomous region, or municipality directly under the Central Government as authorized by the State Council.

在中华人民共和国境内从事导游活动,必须取得导游证。

TranslationArticle 4

To engage in tour guide activities within the territory of the People's Republic of China, one must obtain a tour guide certificate.

取得导游人员资格证书的,经与旅行社订立劳动合同或者在相关旅游行业组织注册,方可持所订立的劳动合同或者登记证明材料,向省、自治区、直辖市人民政府旅游行政部门申请领取导游证。

Translation

A person who has obtained a tour guide qualification certificate may, after concluding a labor contract with a travel agency or registering with a relevant tourism industry organization, apply to the tourism administrative department of the province, autonomous region, or municipality directly under the Central Government for a tour guide certificate by presenting the signed labor contract or registration certification materials.

有下列情形之一的,不得颁发导游证:

省、自治区、直辖市人民政府旅游行政部门应当自收到申请领取导游证之日起15日内,颁发导游证;发现有本条例第五条规定情形,不予颁发导游证的,应当书面通知申请人。

导游人员进行导游活动时,应当佩戴导游证。

导游证的有效期限为3年。导游证持有人需要在有效期满后继续从事导游活动的,应当在有效期限届满3个月前,向省、自治区、直辖市人民政府旅游行政部门申请办理换发导游证手续。

Translation

The validity period of a tour guide certificate is three years. If the holder of a tour guide certificate needs to continue engaging in tour guide activities after the expiration of the validity period, they shall apply to the tourism administrative department of the province, autonomous region, or municipality directly under the Central Government for renewal of the tour guide certificate three months before the expiration of the validity period.

When conducting tour guide activities, a tour guide shall explain to tourists the cultural and natural conditions of the tour site, and introduce local customs and practices; however, they shall not cater to the vulgar tastes of individual tourists by incorporating obscene or vulgar content into the explanations and introductions.

导游人员应当严格按照旅行社确定的接待计划,安排旅游者的旅行、游览活动,不得擅自增加、减少旅游项目或者中止导游活动。

Tour guides shall strictly follow the reception plan determined by the travel agency to arrange tourists' travel and sightseeing activities, and shall not add or reduce tour items or suspend tour guide activities without authorization.

导游人员在引导旅游者旅行、游览过程中,遇有可能危及旅游者人身安全的紧急情形时,经征得多数旅游者的同意,可以调整或者变更接待计划,但是应当立即报告旅行社。

When guiding tourists during travel and sightseeing, if an emergency situation that may endanger the personal safety of tourists arises, the tour guide may adjust or change the reception plan after obtaining the consent of the majority of tourists, but shall immediately report to the travel agency.

导游人员在引导旅游者旅行、游览过程中,应当就可能发生危及旅游者人身、财物安全的情况,向旅游者作出真实说明和明确警示,并按照旅行社的要求采取防止危害发生的措施。

When guiding tourists during travel and sightseeing, tour guides shall provide truthful explanations and clear warnings to tourists regarding situations that may endanger their personal or property safety, and shall take measures to prevent harm as required by the travel agency.

If a tour guide, when conducting tour guide activities, makes remarks that harm national interests or national dignity, the tourism administrative department shall order correction; if the circumstances are serious, the tourism administrative department of the provincial, autonomous region, or municipality directly under the Central Government shall revoke the tour guide certificate and make a public announcement; the travel agency that assigned the tour guide shall be given a warning or ordered to suspend operations for rectification.

导游人员进行导游活动时未佩戴导游证的,由旅游行政部门责令改正;拒不改正的,处500元以下的罚款。

If a tour guide fails to wear a tour guide certificate when conducting tour guide activities, the tourism administrative department shall order correction; if the tour guide refuses to correct, a fine of not more than 500 yuan shall be imposed.

旅游行政部门工作人员玩忽职守、滥用职权、徇私舞弊,构成犯罪的,依法追究刑事责任;尚不构成犯罪的,依法给予行政处分。

If a staff member of the tourism administrative department neglects duty, abuses power, or engages in malpractice for personal gain, and if a crime is constituted, criminal liability shall be pursued according to law; if no crime is constituted, administrative sanctions shall be imposed according to law.

本条例自1999年10月1日起施行。1987年11月14日国务院批准、1987年12月1日国家旅游局发布的《导游人员管理暂行规定》同时废止。

These Regulations shall come into effect on October 1, 1999. The Interim Provisions on the Administration of Tour Guides approved by the State Council on November 14, 1987 and promulgated by the National Tourism Administration on December 1, 1987 shall be abolished simultaneously.
