总则
General Provisions
为了加强对收费公路的管理，规范公路收费行为，维护收费公路的经营管理者和使用者的合法权益，促进公路事业的发展，根据《中华人民共和国公路法》(以下简称公路法)，制定本条例。
These Regulations are formulated in accordance with the Highway Law of the People's Republic of China (hereinafter referred to as the Highway Law) for the purpose of strengthening the administration of toll roads, regulating the acts of toll collection on highways, safeguarding the legitimate rights and interests of the operators and users of toll roads, and promoting the development of highway undertakings.
本条例所称收费公路，是指符合公路法和本条例规定，经批准依法收取车辆通行费的公路(含桥梁和隧道)。
For the purposes of these Regulations, "toll roads" refer to highways (including bridges and tunnels) that meet the provisions of the Highway Law and these Regulations and are approved to collect vehicle tolls according to law.
各级人民政府应当采取积极措施，支持、促进公路事业的发展。公路发展应当坚持非收费公路为主，适当发展收费公路。
People's governments at all levels shall take active measures to support and promote the development of highway undertakings. The development of highways shall adhere to the principle of giving priority to non-toll roads and appropriately developing toll roads.
全部由政府投资或者社会组织、个人捐资建设的公路，不得收取车辆通行费。
Highways constructed entirely with government investment or donated by social organizations or individuals shall not collect vehicle tolls.
任何单位或者个人不得违反公路法和本条例的规定，在公路上设站(卡)收取车辆通行费。
No unit or individual may set up stations (checkpoints) on highways to collect vehicle tolls in violation of the provisions of the Highway Law and these Regulations.
对在公路上非法设立收费站(卡)收取车辆通行费的，任何单位和个人都有权拒绝交纳。
Any unit or individual has the right to refuse to pay vehicle tolls illegally collected at toll stations (checkpoints) illegally set up on highways.
任何单位或者个人对在公路上非法设立收费站(卡)、非法收取或者使用车辆通行费、非法转让收费公路权益或者非法延长收费期限等行为，都有权向交通、价格、财政等部门举报。收到举报的部门应当按照职责分工依法及时查处；无权查处的，应当及时移送有权查处的部门。受理的部门必须自收到举报或者移送材料之日起10日内进行查处。
Any unit or individual has the right to report to the departments of transportation, price, and finance any acts such as illegally setting up toll stations (checkpoints) on highways, illegally collecting or using vehicle tolls, illegally transferring toll road rights, or illegally extending the toll period. The department receiving the report shall investigate and handle the matter in a timely manner according to its functions and duties; if it has no authority to investigate, it shall promptly transfer the case to the department with authority. The department accepting the case must investigate and handle it within 10 days from the date of receiving the report or transferred materials.
收费公路的经营管理者，经依法批准有权向通行收费公路的车辆收取车辆通行费。
The operator of a toll road, upon approval according to law, has the right to collect vehicle tolls from vehicles passing through the toll road.
军队车辆、武警部队车辆，公安机关在辖区内收费公路上处理交通事故、执行正常巡逻任务和处置突发事件的统一标志的制式警车，以及经国务院交通主管部门或者省、自治区、直辖市人民政府批准执行抢险救灾任务的车辆，免交车辆通行费。
Vehicles of the military and armed police forces, standard-marked police vehicles of public security organs handling traffic accidents, performing routine patrols, and responding to emergencies within their jurisdiction on toll roads, as well as vehicles approved by the competent transportation department of the State Council or the people's government of a province, autonomous region, or municipality directly under the Central Government to perform emergency rescue and disaster relief tasks, are exempt from vehicle tolls.
进行跨区作业的联合收割机、运输联合收割机(包括插秧机)的车辆，免交车辆通行费。联合收割机不得在高速公路上通行。
Vehicles transporting combine harvesters (including rice transplanters) for cross-regional operations are exempt from vehicle tolls. Combine harvesters are not allowed to travel on expressways.
任何单位或者个人不得以任何形式非法干预收费公路的经营管理，挤占、挪用收费公路经营管理者依法收取的车辆通行费。
No unit or individual may illegally interfere with the operation and management of toll roads in any form, or misappropriate or divert the vehicle tolls lawfully collected by toll road operators.
收费公路建设和收费站的设置
Construction of Toll Roads and Establishment of Toll Stations
建设收费公路，应当符合国家和省、自治区、直辖市公路发展规划，符合本条例规定的收费公路的技术等级和规模。
The construction of toll roads shall comply with the national and provincial, autonomous region, or municipality directly under the Central Government highway development plans, and meet the technical grades and scales of toll roads as specified in these Regulations.
县级以上地方人民政府交通主管部门利用贷款或者向企业、个人有偿集资建设的公路(以下简称政府还贷公路)，国内外经济组织投资建设或者依照公路法的规定受让政府还贷公路收费权的公路(以下简称经营性公路)，经依法批准后，方可收取车辆通行费。
Highways constructed by the competent transportation department of a local people's government at or above the county level using loans or funds raised from enterprises or individuals with compensation (hereinafter referred to as government loan repayment roads), and highways invested and constructed by domestic and foreign economic organizations or whose toll collection rights for government loan repayment roads are transferred in accordance with the Highway Law (hereinafter referred to as commercial roads), may collect vehicle tolls after being approved according to law.
建设和管理政府还贷公路，应当按照政事分开的原则，依法设立专门的不以营利为目的的法人组织。
The construction and management of government loan repayment roads shall, in accordance with the principle of separating government functions from enterprise management, establish a specialized non-profit legal entity according to law.
省、自治区、直辖市人民政府交通主管部门对本行政区域内的政府还贷公路，可以实行统一管理、统一贷款、统一还款。
The competent transportation department of the people's government of a province, autonomous region, or municipality directly under the Central Government may implement unified management, unified loans, and unified repayment for government loan repayment roads within its administrative region.
经营性公路建设项目应当向社会公布，采用招标投标方式选择投资者。
Commercial road construction projects shall be announced to the public and investors shall be selected through tender and bidding.
经营性公路由依法成立的公路企业法人建设、经营和管理。
Commercial roads shall be constructed, operated, and managed by highway enterprise legal persons established according to law.
收费公路收费站的设置，由省、自治区、直辖市人民政府按照下列规定审查批准：
The establishment of toll stations on toll roads shall be examined and approved by the people's government of the province, autonomous region, or municipality directly under the Central Government in accordance with the following provisions:
(一)高速公路以及其他封闭式的收费公路，除两端出入口外，不得在主线上设置收费站。但是，省、自治区、直辖市之间确需设置收费站的除外。
(1) For expressways and other closed toll roads, except at the entrances and exits at both ends, no toll station shall be set up on the main line. However, this does not apply where a toll station is truly necessary between provinces, autonomous regions, or municipalities directly under the Central Government.
(二)非封闭式的收费公路的同一主线上，相邻收费站的间距不得少于50公里。
(2) On the same main line of a non-closed toll road, the distance between adjacent toll stations shall not be less than 50 kilometers.
高速公路以及其他封闭式的收费公路，应当实行计算机联网收费，减少收费站点，提高通行效率。联网收费的具体办法由国务院交通主管部门会同国务院有关部门制定。
Expressways and other closed toll roads shall implement a computerized network toll collection system to reduce toll stations and improve traffic efficiency. The specific measures for network toll collection shall be formulated by the competent transportation department of the State Council jointly with relevant departments of the State Council.
收费公路的收费期限，由省、自治区、直辖市人民政府按照下列标准审查批准：
The toll collection period for a toll road shall be examined and approved by the people's government of the province, autonomous region, or municipality directly under the Central Government in accordance with the following standards:
(一)政府还贷公路的收费期限，按照用收费偿还贷款、偿还有偿集资款的原则确定，最长不得超过15年。国家确定的中西部省、自治区、直辖市的政府还贷公路收费期限，最长不得超过20年。
(1) For government loan roads, the toll collection period shall be determined based on the principle of repaying loans and compensated fundraising with toll revenue, and shall not exceed 15 years. For government loan roads in provinces, autonomous regions, and municipalities directly under the Central Government designated by the state as central or western regions, the toll collection period shall not exceed 20 years.
(二)经营性公路的收费期限，按照收回投资并有合理回报的原则确定，最长不得超过25年。国家确定的中西部省、自治区、直辖市的经营性公路收费期限，最长不得超过30年。
(2) For commercial roads, the toll collection period shall be determined based on the principle of recovering investment and obtaining reasonable returns, and shall not exceed 25 years. For commercial roads in provinces, autonomous regions, and municipalities directly under the Central Government designated by the state as central or western regions, the toll collection period shall not exceed 30 years.
车辆通行费的收费标准，应当依照价格法律、行政法规的规定进行听证，并按照下列程序审查批准：
The toll rate for vehicle passage shall be subject to a hearing in accordance with price laws and administrative regulations, and shall be examined and approved in accordance with the following procedures:
(一)政府还贷公路的收费标准，由省、自治区、直辖市人民政府交通主管部门会同同级价格主管部门、财政部门审核后，报本级人民政府审查批准。
(1) For government loan roads, the toll rate shall be reviewed by the competent transportation department of the province, autonomous region, or municipality directly under the Central Government jointly with thesame level price authority and thesame level financial department, and then submitted to the people's government at the same level for examination and approval.
(二)经营性公路的收费标准，由省、自治区、直辖市人民政府交通主管部门会同同级价格主管部门审核后，报本级人民政府审查批准。
(2) For commercial roads, the toll rate shall be reviewed by the competent transportation department of the province, autonomous region, or municipality directly under the Central Government jointly with thesame level price authority, and then submitted to the people's government at the same level for examination and approval.
车辆通行费的收费标准，应当根据公路的技术等级、投资总额、当地物价指数、偿还贷款或者有偿集资款的期限和收回投资的期限以及交通量等因素计算确定。对在国家规定的绿色通道上运输鲜活农产品的车辆，可以适当降低车辆通行费的收费标准或者免交车辆通行费。
The toll standard for vehicle passage shall be calculated and determined based on factors such as the technical grade of the road, total investment amount, local price index, the period for repaying loans or paidfundraising funds, the period for recovering investment, and traffic volume. For vehicles transporting fresh agricultural products on the green channel designated by the state, the toll standard may be appropriately reduced or the toll may be exempted.
修建与收费公路经营管理无关的设施、超标准修建的收费公路经营管理设施和服务设施，其费用不得作为确定收费标准的因素。
The costs of constructing facilities unrelated to the operation and management of the toll road, or of constructing toll road operation and management facilities and service facilities exceeding the standard, shall not be considered as factors in determining the toll standard.
车辆通行费的收费标准需要调整的，应当依照本条例第十五条规定的程序办理。
If the toll standard for vehicle passage needs to be adjusted, it shall be handled in accordance with the procedures stipulated in Article 15 of these Regulations.
依照本条例规定的程序审查批准的收费公路收费站、收费期限、车辆通行费收费标准或者收费标准的调整方案，审批机关应当自审查批准之日起10日内将有关文件向国务院交通主管部门和国务院价格主管部门备案；其中属于政府还贷公路的，还应当自审查批准之日起10日内向国务院财政部门备案。
For toll road toll stations, toll periods, vehicle passage toll standards, or adjustment plans approved in accordance with the procedures stipulated in these Regulations, the approving authority shall, within 10 days from the date of approval, file the relevant documents with the competent transportation department of the State Council and the competent price department of the State Council; if it is a government loan repayment road, it shall also file with the financial department of the State Council within 10 days from the date of approval.
建设收费公路，应当符合下列技术等级和规模：
The construction of toll roads shall meet the following technical grades and scales:
(一)高速公路连续里程30公里以上。但是，城市市区至本地机场的高速公路除外。
(1) Expressway with a continuous mileage of 30 kilometers or more. However, expressways from urban areas to local airports are excluded.
(二)一级公路连续里程50公里以上。
(2) First-class highway with a continuous mileage of 50 kilometers or more.
(三)二车道的独立桥梁、隧道，长度800米以上；四车道的独立桥梁、隧道，长度500米以上。
(3) Two-lane independent bridges and tunnels with a length of 800 meters or more; four-lane independent bridges and tunnels with a length of 500 meters or more.
技术等级为二级以下(含二级)的公路不得收费。但是，在国家确定的中西部省、自治区、直辖市建设的二级公路，其连续里程60公里以上的，经依法批准，可以收取车辆通行费。
Roads with a technical grade of secondary or below (including secondary) shall not be tolled. However, for secondary roads constructed in the central and western provinces, autonomous regions, and municipalities directly under the Central Government as determined by the state, with a continuous mileage of 60 kilometers or more, tolls may be collected upon approval in accordance with the law.
收费公路权益的转让
Transfer of Toll Road Rights and Interests
依照本条例的规定转让收费公路权益的，应当向社会公布，采用招标投标的方式，公平、公正、公开地选择经营管理者，并依法订立转让协议。
Where the rights to toll roads are transferred in accordance with these Regulations, the transfer shall be announced to the public, and the operator shall be selected through bidding in a fair, just, and open manner, and a transfer agreement shall be concluded in accordance with the law.
收费公路的权益，包括收费权、广告经营权、服务设施经营权。
The rights to toll roads include the right to collect tolls, the right to operate advertising, and the right to operate service facilities.
转让收费公路权益的，应当依法保护投资者的合法利益。
Where the rights to toll roads are transferred, the legitimate interests of investors shall be protected in accordance with the law.
转让政府还贷公路权益中的收费权，可以申请延长收费期限，但延长的期限不得超过5年。
Where the toll collection right in the rights to government loan repayment roads is transferred, an extension of the toll period may be applied for, but the extended period shall not exceed 5 years.
转让经营性公路权益中的收费权，不得延长收费期限。
Where the toll collection right in the rights to commercial toll roads is transferred, the toll period shall not be extended.
有下列情形之一的，收费公路权益中的收费权不得转让：
The toll collection right in the rights to toll roads shall not be transferred under any of the following circumstances:
(一)长度小于1000米的二车道独立桥梁和隧道；
(1) Two-lane independent bridges and tunnels with a length of less than 1,000 meters;
(二)二级公路；
(2) Secondary roads;
(三)收费时间已超过批准收费期限2/3。
(3) The toll collection period has exceeded two-thirds of the approved toll period.
转让政府还贷公路权益的收入，必须缴入国库，除用于偿还贷款和有偿集资款外，必须用于公路建设。
The income from the transfer of rights to government loan repayment roads must be turned over to the state treasury and, except for the repayment of loans and lawfully raised funds, must be used for road construction.
收费公路权益转让的具体办法，由国务院交通主管部门会同国务院发展改革部门和财政部门制定。
The specific measures for the transfer of toll road rights shall be formulated by the competent transportation department of the State Council jointly with the development and reform department and the financial department of the State Council.
收费公路的经营管理
Operation and Management of Toll Roads
收费公路建成后，应当按照国家有关规定进行验收；验收合格的，方可收取车辆通行费。
After a toll road is completed, it shall be accepted in accordance with the relevant provisions of the state; only those that pass the acceptance inspection may collect vehicle tolls.
收费公路不得边建设边收费。
No toll road may collect tolls while under construction.
收费公路经营管理者应当按照国家规定的标准和规范，对收费公路及沿线设施进行日常检查、维护，保证收费公路处于良好的技术状态，为通行车辆及人员提供优质服务。
The toll road operator shall, in accordance with the standards and specifications prescribed by the state, conduct daily inspections and maintenance of the toll road and its ancillary facilities to ensure that the toll road is in good technical condition and provide quality services to passing vehicles and personnel.
收费公路的养护应当严格按照工期施工、竣工，不得拖延工期，不得影响车辆安全通行。
The maintenance of toll roads shall be carried out and completed strictly according to the construction period, without delaying the construction period or affecting the safe passage of vehicles.
收费公路经营管理者应当在收费站的显著位置，设置载有收费站名称、审批机关、收费单位、收费标准、收费起止年限和监督电话等内容的公告牌，接受社会监督。
The toll road operator shall set up a bulletin board at a conspicuous location at the toll station, displaying information such as the name of the toll station, the approving authority, the toll collection unit, the toll rate, the start and end years of toll collection, and the supervision telephone number, to accept public supervision.
收费公路经营管理者应当按照国家规定的标准，结合公路交通状况、沿线设施等情况，设置交通标志、标线。
The toll road operator shall, in accordance with the standards prescribed by the state and taking into account the road traffic conditions and ancillary facilities, set up traffic signs and markings.
交通标志、标线必须清晰、准确、易于识别。重要的通行信息应当重复提示。
Traffic signs and markings must be clear, accurate, and easy to identify. Important traffic information shall be repeatedly indicated.
收费道口的设置，应当符合车辆行驶安全的要求；收费道口的数量，应当符合车辆快速通过的需要，不得造成车辆堵塞。
The setting of toll lanes shall meet the requirements for safe vehicle passage; the number of toll lanes shall meet the need for rapid vehicle passage and shall not cause vehicle congestion.
收费站工作人员的配备，应当与收费道口的数量、车流量相适应，不得随意增加人员。
The staffing of toll station personnel shall be commensurate with the number of toll lanes and traffic volume, and personnel shall not be added arbitrarily.
收费公路经营管理者应当加强对收费站工作人员的业务培训和职业道德教育，收费人员应当做到文明礼貌，规范服务。
Toll road operators shall strengthen professional training and ethical education for toll station personnel, and toll collectors shall be courteous and provide standardized service.
遇有公路损坏、施工或者发生交通事故等影响车辆正常安全行驶的情形时，收费公路经营管理者应当在现场设置安全防护设施，并在收费公路出入口进行限速、警示提示，或者利用收费公路沿线可变信息板等设施予以公告；造成交通堵塞时，应当及时报告有关部门并协助疏导交通。
When road damage, construction, or traffic accidents occur that affect normal and safe vehicle operation, toll road operators shall set up safety protection facilities on site, post speed limits and warnings at toll road entrances and exits, or use variable message signs along the toll road to announce the situation; if traffic congestion occurs, they shall promptly report to relevant authorities and assist in traffic diversion.
遇有公路严重损毁、恶劣气象条件或者重大交通事故等严重影响车辆安全通行的情形时，公安机关应当根据情况，依法采取限速通行、关闭公路等交通管制措施。收费公路经营管理者应当积极配合公安机关，及时将有关交通管制的信息向通行车辆进行提示。
When severe road damage, adverse weather conditions, or major traffic accidents seriously affect safe vehicle passage, public security authorities shall, based on the circumstances, take traffic control measures such as speed restrictions or road closures in accordance with the law. Toll road operators shall actively cooperate with public security authorities and promptly inform passing vehicles of relevant traffic control information.
收费公路经营管理者收取车辆通行费，必须向收费公路使用者开具收费票据。政府还贷公路的收费票据，由省、自治区、直辖市人民政府财政部门统一印(监)制。经营性公路的收费票据，由省、自治区、直辖市人民政府税务部门统一印(监)制。
When toll road operators collect vehicle tolls, they must issue toll receipts to toll road users. Toll receipts for government-financed roads shall be uniformly printed (supervised) by the finance department of the provincial, autonomous region, or municipality people's government. Toll receipts for commercial roads shall be uniformly printed (supervised) by the tax department of the provincial, autonomous region, or municipality people's government.
收费公路经营管理者对依法应当交纳而拒交、逃交、少交车辆通行费的车辆，有权拒绝其通行，并要求其补交应交纳的车辆通行费。
Toll road operators have the right to refuse passage to vehicles that refuse to pay, evade, or underpay tolls that are legally due, and may demand that they pay the overdue tolls.
任何人不得为拒交、逃交、少交车辆通行费而故意堵塞收费道口、强行冲卡、殴打收费公路管理人员、破坏收费设施或者从事其他扰乱收费公路经营管理秩序的活动。
No person shall intentionally block toll lanes, forcibly rush through toll gates, assault toll road management personnel, damage toll facilities, or engage in other activities that disrupt the order of toll road operation and management in order to refuse, evade, or underpay tolls.
发生前款规定的扰乱收费公路经营管理秩序行为时，收费公路经营管理者应当及时报告公安机关，由公安机关依法予以处理。
When conduct disrupting the order of toll road operation and management as described in the preceding paragraph occurs, toll road operators shall promptly report to public security authorities, which shall handle the matter in accordance with the law.
在收费公路上行驶的车辆不得超载。
Vehicles traveling on toll roads shall not be overloaded.
发现车辆超载时，收费公路经营管理者应当及时报告公安机关，由公安机关依法予以处理。
When a vehicle is found to be overloaded, toll road operators shall promptly report to public security authorities, which shall handle the matter in accordance with the law.
收费公路经营管理者不得有下列行为：
Toll road operators shall not engage in the following acts:
(一)擅自提高车辆通行费收费标准；
(1) Unauthorized increase of vehicle toll fee standards;
(二)在车辆通行费收费标准之外加收或者代收任何其他费用；
(2) Adding or collecting any other fees in addition to the vehicle toll fee standards;
(三)强行收取或者以其他不正当手段按车辆收取某一期间的车辆通行费；
(3) Forcibly collecting or using other improper means to collect vehicle toll fees for a certain period on a per-vehicle basis;
(四)不开具收费票据，开具未经省、自治区、直辖市人民政府财政、税务部门统一印(监)制的收费票据或者开具已经过期失效的收费票据。
(4) Failing to issue toll receipts, issuing toll receipts that are not uniformly printed (supervised) by the finance or tax departments of the provincial, autonomous region, or municipality people's government, or issuing expired or invalid toll receipts.
有前款所列行为之一的，通行车辆有权拒绝交纳车辆通行费。
If any of the acts listed in the preceding paragraph occurs, the passing vehicle has the right to refuse to pay the vehicle toll fee.
政府还贷公路的管理者收取的车辆通行费收入，应当全部存入财政专户，严格实行收支两条线管理。
The vehicle toll fee income collected by the manager of government loan repayment roads shall be fully deposited into a special fiscal account, strictly implementing separate management of revenue and expenditure.
政府还贷公路的车辆通行费，除必要的管理、养护费用从财政部门批准的车辆通行费预算中列支外，必须全部用于偿还贷款和有偿集资款，不得挪作他用。
The vehicle toll fees of government loan repayment roads, except for necessary management and maintenance expenses allocated from the vehicle toll fee budget approved by the finance department, must be fully used to repay loans and paid-infundraising funds, and shall not be misappropriated for other purposes.
收费公路的收费期限届满，必须终止收费。
Upon expiration of the toll collection period of a toll road, toll collection must be terminated.
政府还贷公路在批准的收费期限届满前已经还清贷款、还清有偿集资款的，必须终止收费。
If a government loan repayment road has fully repaid the loans and paid-infundraising funds before the expiration of the approved toll collection period, toll collection must be terminated.
依照本条前两款的规定，收费公路终止收费的，有关省、自治区、直辖市人民政府应当向社会公告，明确规定终止收费的日期，接受社会监督。
In accordance with the preceding two paragraphs, when a toll road ceases to charge tolls, the relevant provincial, autonomous region, or municipality people's government shall make a public announcement, clearly specifying the date of toll cessation, and accept public supervision.
收费公路终止收费前6个月，省、自治区、直辖市人民政府交通主管部门应当对收费公路进行鉴定和验收。经鉴定和验收，公路符合取得收费公路权益时核定的技术等级和标准的，收费公路经营管理者方可按照国家有关规定向交通主管部门办理公路移交手续；不符合取得收费公路权益时核定的技术等级和标准的，收费公路经营管理者应当在交通主管部门确定的期限内进行养护，达到要求后，方可按照规定办理公路移交手续。
Six months before the termination of toll collection on a toll road, the transportation authority of the provincial, autonomous region, or municipality people's government shall conduct an appraisal and acceptance inspection of the toll road. If the appraisal and acceptance confirm that the road meets the technical grade and standards verified at the time the toll road rights were obtained, the toll road operator may handle the road transfer procedures with the transportation authority in accordance with state regulations. If the road does not meet the verified technical grade and standards, the toll road operator shall carry out maintenance within a period determined by the transportation authority, and only after meeting the requirements may the road transfer procedures be handled as stipulated.
收费公路终止收费后，收费公路经营管理者应当自终止收费之日起15日内拆除收费设施。
After the termination of toll collection on a toll road, the toll road operator shall dismantle the toll collection facilities within 15 days from the date of toll cessation.
任何单位或者个人不得通过封堵非收费公路或者在非收费公路上设卡收费等方式，强迫车辆通行收费公路。
No unit or individual may force vehicles to use a toll road by blocking non-toll roads or setting up toll stations on non-toll roads, or by other means.
收费公路经营管理者应当按照国务院交通主管部门和省、自治区、直辖市人民政府交通主管部门的要求，及时提供统计资料和有关情况。

收费公路的养护、绿化和公路用地范围内的水土保持及路政管理，依照公路法的有关规定执行。

国务院交通主管部门和省、自治区、直辖市人民政府交通主管部门应当对收费公路实施监督检查，督促收费公路经营管理者依法履行公路养护、绿化和公路用地范围内的水土保持义务。
The transportation authority of the State Council and the transportation authority of the provincial, autonomous region, or municipality people's government shall supervise and inspect toll roads, urging toll road operators to lawfully fulfill their obligations for road maintenance, greening, and soil and water conservation within the roadland use.
审计机关应当依法加强收费公路的审计监督，对违法行为依法进行查处。

行政执法机关依法对收费公路实施监督检查时，不得向收费公路经营管理者收取任何费用。
When administrative law enforcement authorities conduct supervision and inspection of toll roads in accordance with the law, they shall not charge any fees to the toll road operator.
省、自治区、直辖市人民政府应当将本行政区域内收费公路及收费站名称、收费单位、收费标准、收费期限等信息向社会公布，接受社会监督。
The provincial, autonomous region, or municipality people's government shall publicly disclose information on toll roads and toll station names, toll units, toll rates, and toll periods within its administrative region, and accept public supervision.

Where, in violation of these Regulations, a toll road construction, toll station, toll period, vehicle toll rate, or transfer of toll road rights is approved without authorization, the people's government of the province, autonomous region, or municipality directly under the Central Government shall order correction; the responsible persons in charge and other directly responsible personnel shall be given administrative sanctions ranging from a major demerit to dismissal according to law; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例的规定，地方人民政府或者有关部门及其工作人员非法干预收费公路经营管理，或者挤占、挪用收费公路经营管理者收取的车辆通行费的，由上级人民政府或者有关部门责令停止非法干预，退回挤占、挪用的车辆通行费；对负有责任的主管人员和其他直接责任人员依法给予记大过直至开除的行政处分；构成犯罪的，依法追究刑事责任。
Where, in violation of these Regulations, a local people's government or relevant department or its staff illegally interferes with the operation and management of a toll road, or misappropriates or diverts the vehicle tolls collected by the toll road operator, the superior people's government or relevant department shall order the cessation of the illegal interference and the return of the misappropriated or diverted vehicle tolls; the responsible persons in charge and other directly responsible personnel shall be given administrative sanctions ranging from a major demerit to dismissal according to law; if a crime is constituted, criminal liability shall be pursued according to law.
违反本条例的规定，擅自在公路上设立收费站(卡)收取车辆通行费或者应当终止收费而不终止的，由国务院交通主管部门或者省、自治区、直辖市人民政府交通主管部门依据职权，责令改正，强制拆除收费设施；有违法所得的，没收违法所得，并处违法所得2倍以上5倍以下的罚款；没有违法所得的，处l万元以上5万元以下的罚款；负有责任的主管人员和其他直接责任人员属于国家工作人员的，依法给予记大过直至开除的行政处分。
Where, in violation of these Regulations, a toll station (checkpoint) is set up on a road without authorization to collect vehicle tolls, or toll collection is not terminated when it should be, the competent transport department of the State Council or the competent transport department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall, within its authority, order correction and forcibly dismantle the toll collection facilities; if there is illegal income, the illegal income shall be confiscated and a fine of not less than 2 times but not more than 5 times the illegal income shall be imposed; if there is no illegal income, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed; if the responsible persons in charge and other directly responsible personnel are state functionaries, they shall be given administrative sanctions ranging from a major demerit to dismissal according to law.
违反本条例的规定，有下列情形之一的，由国务院交通主管部门或者省、自治区、直辖市人民政府交通主管部门依据职权，责令改正，并根据情节轻重，处5万元以上20万元以下的罚款：
Where, in violation of these Regulations, any of the following circumstances occurs, the competent transport department of the State Council or the competent transport department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall, within its authority, order correction and, depending on the severity of the circumstances, impose a fine of not less than 50,000 yuan but not more than 200,000 yuan:
(一)收费站的设置不符合标准或者擅自变更收费站位置的；
(1) The setting of a toll station does not meet the standards or the location of the toll station is changed without authorization;
(二)未按照国家规定的标准和规范对收费公路及沿线设施进行日常检查、维护的；
(2) Failure to conduct daily inspections and maintenance of the toll road and its ancillary facilities in accordance with the standards and specifications prescribed by the state;
(三)未按照国家有关规定合理设置交通标志、标线的；
(3) Failure to set up traffic signs and markings reasonably in accordance with the relevant provisions of the state;
(四)道口设置不符合车辆行驶安全要求或者道口数量不符合车辆快速通过需要的；
(4) The setting of crossings does not meet the safety requirements for vehicle passage or the number of crossings does not meet the need for rapid vehicle passage;
(五)遇有公路损坏、施工或者发生交通事故等影响车辆正常安全行驶的情形，未按照规定设置安全防护设施或者未进行提示、公告，或者遇有交通堵塞不及时疏导交通的；
(5) When encountering situations such as road damage, construction, or traffic accidents that affect normal and safe vehicle operation, failure to set up safety protection facilities as required, or failure to provide warnings or announcements, or failure to promptly divert traffic when there is congestion;
(六)应当公布有关限速通行或者关闭收费公路的信息而未及时公布的。
(6) Failure to timely publish information on speed limits or closure of toll roads.
违反本条例的规定，收费公路经营管理者收费时不开具票据，开具未经省、自治区、直辖市人民政府财政、税务部门统一印(监)制的票据，或者开具已经过期失效的票据的，由财政部门或者税务部门责令改正，并根据情节轻重，处10万元以上50万元以下的罚款；负有责任的主管人员和其他直接责任人员属于国家工作人员的，依法给予记大过直至开除的行政处分；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if a toll road operator fails to issue a receipt when collecting tolls, issues a receipt not uniformly printed (supervised) by the finance or tax department of the province, autonomous region, or municipality directly under the Central Government, or issues an expired or invalid receipt, the finance or tax department shall order correction and, depending on the severity, impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; if the responsible supervisor or other directly responsible personnel are state employees, they shall be given administrative sanctions ranging from a major demerit to dismissal; if the act constitutes a crime, criminal liability shall be pursued according to law.
违反本条例的规定，政府还贷公路的管理者未将车辆通行费足额存入财政专户或者未将转让政府还贷公路权益的收入全额缴入国库的，由财政部门予以追缴、补齐；对负有责任的主管人员和其他直接责任人员，依法给予记过直至开除的行政处分。
In violation of these regulations, if the manager of a government loan repayment road fails to deposit the full amount of vehicle tolls into the fiscal special account or fails to remit all income from the transfer of government loan repayment road rights into the state treasury, the finance department shall recover and make up the amount; the responsible supervisor and other directly responsible personnel shall be given administrative sanctions ranging from a demerit to dismissal according to law.
违反本条例的规定，财政部门未将政府还贷公路的车辆通行费或者转让政府还贷公路权益的收入用于偿还贷款、偿还有偿集资款，或者将车辆通行费、转让政府还贷公路权益的收入挪作他用的，由本级人民政府责令偿还贷款、偿还有偿集资款，或者责令退还挪用的车辆通行费和转让政府还贷公路权益的收入；对负有责任的主管人员和其他直接责任人员，依法给予记过直至开除的行政处分；构成犯罪的，依法追究刑事责任。
In violation of these regulations, if the finance department fails to use the vehicle tolls of government loan repayment roads or the income from the transfer of government loan repayment road rights for repaying loans or repaying paidfundraising funds, or misappropriates the vehicle tolls or income from the transfer of government loan repayment road rights for other purposes, the people's government at the same level shall order the repayment of loans or paidfundraising funds, or order the return of the misappropriated vehicle tolls and income from the transfer of government loan repayment road rights; the responsible supervisor and other directly responsible personnel shall be given administrative sanctions ranging from a demerit to dismissal according to law; if the act constitutes a crime, criminal liability shall be pursued according to law.
违反本条例的规定，收费公路终止收费后，收费公路经营管理者不及时拆除收费设施的，由省、自治区、直辖市人民政府交通主管部门责令限期拆除；逾期不拆除的，强制拆除，拆除费用由原收费公路经营管理者承担。
In violation of these regulations, if after the termination of toll collection on a toll road, the toll road operator fails to promptly remove the toll collection facilities, the transportation department of the province, autonomous region, or municipality directly under the Central Government shall order removal within a specified period; if removal is not made within the period, compulsory removal shall be carried out, and the removal costs shall be borne by the original toll road operator.
违反本条例的规定，收费公路经营管理者未按照国务院交通主管部门规定的技术规范和操作规程进行收费公路养护的，由省、自治区、直辖市人民政府交通主管部门责令改正；拒不改正的，责令停止收费。责令停止收费后30日内仍未履行公路养护义务的，由省、自治区、直辖市人民政府交通主管部门指定其他单位进行养护，养护费用由原收费公路经营管理者承担。拒不承担的，由省、自治区、直辖市人民政府交通主管部门申请人民法院强制执行。
In violation of these regulations, if a toll road operator fails to carry out toll road maintenance in accordance with the technical specifications and operating procedures prescribed by the transportation department of the State Council, the transportation department of the province, autonomous region, or municipality directly under the Central Government shall order correction; if correction is refused, toll collection shall be ordered to stop. If the maintenance obligation is not fulfilled within 30 days after the order to stop toll collection, the transportation department of the province, autonomous region, or municipality directly under the Central Government shall designate another unit to carry out maintenance, and the maintenance costs shall be borne by the original toll road operator. If the operator refuses to bear the costs, the transportation department of the province, autonomous region, or municipality directly under the Central Government shall apply to the people's court for compulsory enforcement.
违反本条例的规定，收费公路经营管理者未履行公路绿化和水土保持义务的，由省、自治区、直辖市人民政府交通主管部门责令改正，并可以对原收费公路经营管理者处履行绿化、水土保持义务所需费用1倍至2倍的罚款。
In violation of these regulations, if a toll road operator fails to fulfill the obligations of road greening and soil conservation, the transportation department of the province, autonomous region, or municipality directly under the Central Government shall order correction and may impose a fine of 1 to 2 times the cost required for fulfilling the greening and soil conservation obligations on the original toll road operator.
国务院价格主管部门或者县级以上地方人民政府价格主管部门对违反本条例的价格违法行为，应当依据价格管理的法律、法规和规章的规定予以处罚。
The price department of the State Council or the price department of the people's government at or above the county level shall, in accordance with the laws, regulations, and rules on price management, impose penalties for price violations in violation of these regulations.
违反本条例的规定，为拒交、逃交、少交车辆通行费而故意堵塞收费道口、强行冲卡、殴打收费公路管理人员、破坏收费设施或者从事其他扰乱收费公路经营管理秩序活动，构成违反治安管理行为的，由公安机关依法予以处罚；构成犯罪的，依法追究刑事责任；给收费公路经营管理者造成损失或者造成人身损害的，依法承担民事赔偿责任。
In violation of these regulations, if a person intentionally blocks a toll lane, forcibly charges through, assaults toll road management personnel, damages toll facilities, or engages in other activities disrupting the order of toll road operation and management in order to refuse, evade, or underpay vehicle tolls, and such act constitutes a violation of public security administration, the public security organ shall impose penalties according to law; if the act constitutes a crime, criminal liability shall be pursued according to law; if losses are caused to the toll road operator or personal injury is caused, civil compensation liability shall be borne according to law.
违反本条例的规定，假冒军队车辆、武警部队车辆、公安机关统一标志的制式警车和抢险救灾车辆逃交车辆通行费的，由有关机关依法予以处理。
In violation of these regulations, if a person uses counterfeit military vehicles, armed police vehicles, standard police vehicles with unified markings of public security organs, or emergency rescue and disaster relief vehicles to evade vehicle tolls, the relevant authorities shall handle the matter according to law.
附则
Supplementary Provisions
本条例施行前在建的和已投入运行的收费公路，由国务院交通主管部门会同国务院发展改革部门和财政部门依照本条例规定的原则进行规范。具体办法由国务院交通主管部门制定。
For toll roads that were under construction or already in operation before the implementation of these Regulations, the competent transportation department of the State Council shall, together with the development and reform department and the financial department of the State Council, regulate them in accordance with the principles set forth in these Regulations. Specific measures shall be formulated by the competent transportation department of the State Council.
本条例自2004年11月1日起施行。
These Regulations shall take effect as of November 1, 2004.
