Regulations on the Administration of Special Symbols

为了加强对特殊标志的管理，推动文化、体育、科学研究及其他社会公益活动的发展，保护特殊标志所有人、使用人和消费者的合法权益，制定本条例。

These Regulations are formulated to strengthen the administration of special symbols, promote the development of cultural, sports, scientific research and other social welfare activities, and protect the legitimate rights and interests of owners, users and consumers of special symbols.

本条例所称特殊标志，是指经国务院批准举办的全国性和国际性的文化、体育、科学研究及其他社会公益活动所使用的，由文字、图形组成的名称及缩写、会徽、吉祥物等标志。

For the purposes of these Regulations, 'special symbols' refer to names, abbreviations, emblems, mascots and other symbols composed of words and graphics used in national and international cultural, sports, scientific research and other social welfare activities approved by the State Council.

经国务院工商行政管理部门核准登记的特殊标志，受本条例保护。

Special symbols registered with the administrative department for industry and commerce under the State Council shall be protected under these Regulations.

含有下列内容的文字、图形组成的特殊标志，不予登记：

Special symbols composed of words and graphics containing any of the following content shall not be registered:

(一)有损于国家或者国际组织的尊严或者形象的；

(1) Those detrimental to the dignity or image of the State or international organizations;

(二)有害于社会善良习俗和公共秩序的；

(2) Those harmful to social good customs and public order;

(三)带有民族歧视性，不利于民族团结的；

(3) Those with ethnic discrimination, detrimental to national unity;

(四)缺乏显著性，不便于识别的；

(4) Those lacking distinctiveness and not easy to identify;

(五)法律、行政法规禁止的其他内容。

(5) Other content prohibited by laws and administrative regulations.

特殊标志所有人使用或者许可他人使用特殊标志所募集的资金，必须用于特殊标志所服务的社会公益事业，并接受国务院财政部门、审计部门的监督。

Funds raised by the owner of a special symbol through its own use or through licensing others to use the special symbol must be used for the social welfare activities served by the special symbol, and shall be subject to supervision by the financial department and audit department under the State Council.

举办社会公益活动的组织者或者筹备者对其使用的名称、会徽、吉祥物等特殊标志，需要保护的，应当向国务院工商行政管理部门提出登记申请。

Where the organizer or preparer of a social welfare activity needs protection for the special symbols such as names, emblems, mascots used in the activity, it shall file an application for registration with the administrative department for industry and commerce under the State Council.

登记申请可以直接办理，也可以委托他人代理。

The registration application may be filed directly or through an agent.

申请特殊标志登记，应当填写特殊标志登记申请书并提交下列文件：

To apply for registration of a special symbol, a special symbol registration application form shall be completed and the following documents shall be submitted:

(一)国务院批准举办该社会公益活动的文件；

(1) The document approving the social welfare activity by the State Council;

(二)准许他人使用特殊标志的条件及管理办法；

(2) Conditions and management measures for permitting others to use the special symbol;

(三)特殊标志图样5份，黑白墨稿1份。图样应当清晰，便于粘贴，用光洁耐用的纸张印制或者用照片代替，长和宽不大于10厘米、不小于5厘米；

(3) Five copies of the special symbol design and one black-and-white ink draft. The design shall be clear, easy to paste, printed on smooth and durable paper or replaced by photos, with length and width not exceeding 10 cm and not less than 5 cm;

(四)委托他人代理的，应当附代理人委托书，注明委托事项和权限；

(4) If filing through an agent, a power of attorney specifying the entrusted matters and scope of authority shall be attached;

(五)国务院工商行政管理部门认为应当提交的其他文件。

(5) Other documents deemed necessary by the administrative department for industry and commerce under the State Council.

国务院工商行政管理部门收到申请后，按照以下规定处理：

Upon receipt of an application, the administrative department for industry and commerce under the State Council shall handle it in accordance with the following provisions:

(一)符合本条例有关规定，申请文件齐备无误的，自收到申请之日起15日内，发给特殊标志登记申请受理通知书，并在发出通知之日起2个月内，将特殊标志有关事项、图样和核准使用的商品和服务项目，在特殊标志登记簿上登记，发给特殊标志登记证书。

(1) If the application complies with the relevant provisions of these Regulations and the application documents are complete and correct, a notice of acceptance of the special symbol registration application shall be issued within 15 days from the date of receipt, and within two months from the date of issuance of the notice, the relevant matters, design, and approved goods and services of the special symbol shall be recorded in the special symbol register, and a special symbol registration certificate shall be issued.

特殊标志经核准登记后，由国务院工商行政管理部门公告。

After a special symbol is approved for registration, it shall be announced by the administrative department for industry and commerce under the State Council.

(二)申请文件不齐备或者有误的，自收到申请之日起10日内发给特殊标志登记申请补正通知书，并限其自收到通知之日起15日内予以补正；期满不补正或者补正仍不符合规定的，发给特殊标志登记申请不予受理通知书。

(2) If the application documents are incomplete or contain errors, a notice of correction for the special symbol registration application shall be issued within 10 days from the date of receipt, and the applicant shall be required to make corrections within 15 days from the date of receipt of the notice; if no correction is made within the time limit or the correction still does not meet the requirements, a notice of non-acceptance of the special symbol registration application shall be issued.

(三)违反本条例第四条规定的，自收到申请之日起15日内发给特殊标志登记申请驳回通知书。申请人对驳回通知不服的，可以自收到驳回通知之日起15日内，向国务院工商行政管理部门申请复议。

(3) If the provisions of Article 4 of these Regulations are violated, a notice of rejection of the special sign registration application shall be issued within 15 days from the date of receipt of the application. If the applicant disagrees with the rejection notice, they may apply for reconsideration to the administrative department for industry and commerce under the State Council within 15 days from the date of receipt of the rejection notice.

前款所列各类通知书，由国务院工商行政管理部门送达申请人或者其代理人。因故不能直接送交的，以国务院工商行政管理部门公告或者邮寄之日起的20日为送达日期。

The various types of notices mentioned in the preceding paragraph shall be served by the administrative department for industry and commerce under the State Council to the applicant or their agent. If direct service is not possible, the date of service shall be 20 days from the date of announcement by the administrative department for industry and commerce under the State Council or from the date of mailing.

特殊标志有效期为4年，自核准登记之日起计算。

The term of validity of a special sign is 4 years, calculated from the date of approval and registration.

特殊标志所有人可以在有效期满前3个月内提出延期申请，延长的期限由国务院工商行政管理部门根据实际情况和需要决定。

The owner of a special sign may file an application for renewal within 3 months before the expiration of the term of validity, and the extended term shall be determined by the administrative department for industry and commerce under the State Council based on actual circumstances and needs.

特殊标志所有人变更地址，应当自变更之日起1个月内报国务院工商行政管理部门备案。

If the owner of a special sign changes their address, they shall report to the administrative department for industry and commerce under the State Council for record within 1 month from the date of change.

已获准登记的特殊标志有下列情形之一的，任何单位和个人可以在特殊标志公告刊登之日至其有效期满的期间，向国务院工商行政管理部门申明理由并提供相应证据，请求宣告特殊标志登记无效：

If a registered special sign falls under any of the following circumstances, any entity or individual may, during the period from the date of publication of the special sign announcement to the expiration of its term of validity, state reasons and provide corresponding evidence to the administrative department for industry and commerce under the State Council, requesting a declaration of invalidity of the special sign registration:

(一)同已在先申请的特殊标志相同或者近似的；

(1) It is identical or similar to a special sign that has been previously applied for;

(二)同已在先申请注册的商标或者已获得注册的商标相同或者近似的；

(2) It is identical or similar to a trademark that has been previously applied for registration or has been registered;

(三)同已在先申请外观设计专利或者已依法取得专利权的外观设计专利相同或者近似的；

(3) It is identical or similar to a design patent that has been previously applied for or has been legally granted;

(四)侵犯他人著作权的。

(4) It infringes upon the copyright of others.

国务院工商行政管理部门自收到特殊标志登记无效申请之日起10日内，通知被申请人并限其自收到通知之日起15日内作出答辩。

The administrative department for industry and commerce under the State Council shall, within 10 days from the date of receipt of the application for invalidation of a special sign registration, notify the respondent and require them to submit a defense within 15 days from the date of receipt of the notice.

被申请人拒绝答辩或者无正当理由超过答辩期限的，视为放弃答辩的权利。

If the respondent refuses to submit a defense or fails to submit a defense within the time limit without justifiable reasons, they shall be deemed to have waived the right to defense.

国务院工商行政管理部门自收到特殊标志登记无效申请之日起3个月内作出裁定，并通知当事人；当事人对裁定不服的，可以自收到通知之日起15日内，向国务院工商行政管理部门申请复议。

The administrative department for industry and commerce under the State Council shall make a ruling within 3 months from the date of receipt of the application for invalidation of a special sign registration and notify the parties; if a party disagrees with the ruling, they may apply for reconsideration to the administrative department for industry and commerce under the State Council within 15 days from the date of receipt of the ruling.

特殊标志所有人可以在与其公益活动相关的广告、纪念品及其他物品上使用该标志，并许可他人在国务院工商行政管理部门核准使用该标志的商品或者服务项目上使用。

The owner of a special sign may use the sign on advertisements, souvenirs, and other items related to their public welfare activities, and may license others to use the sign on goods or service items approved by the administrative department for industry and commerce under the State Council.

特殊标志的使用人应当是依法成立的企业、事业单位、社会团体、个体工商户。

Users of a special sign shall be enterprises, institutions, social organizations, or individual industrial and commercial households established in accordance with the law.

特殊标志使用人应当同所有人签订书面使用合同。

Users of a special sign shall sign a written use contract with the owner.

特殊标志使用人应当自合同签订之日起1个月内，将合同副本报国务院工商行政管理部门备案，并报使用人所在地县级以上人民政府工商行政管理部门存查。

Users of a special sign shall, within 1 month from the date of signing the contract, submit a copy of the contract to the administrative department for industry and commerce under the State Council for record, and also report to the administrative department for industry and commerce of the people's government at or above the county level where the user is located for reference.

特殊标志所有人或者使用人有下列行为之一的，由其所在地或者行为发生地县级以上人民政府工商行政管理部门责令改正，可以处5万元以下的罚款；情节严重的，由县级以上人民政府工商行政管理部门责令使用人停止使用该特殊标志，由国务院工商行政管理部门撤销所有人的特殊标志登记：

If the owner or user of a special sign commits any of the following acts, the administrative department for industry and commerce of the people's government at or above the county level where the owner or user is located or where the act occurred shall order correction and may impose a fine of not more than 50,000 yuan; if the circumstances are serious, the administrative department for industry and commerce of the people's government at or above the county level shall order the user to stop using the special sign, and the administrative department for industry and commerce under the State Council shall revoke the registration of the special sign of the owner:

(一)擅自改变特殊标志文字、图形的；

(1) Unauthorized alteration of the text or graphics of the special sign;

(二)许可他人使用特殊标志，未签订使用合同，或者使用人在规定期限内未报国务院工商行政管理部门备案或者未报所在地县级以上人民政府工商行政管理机关存查的；

(2) Licensing others to use the special sign without signing a use contract, or the user fails to report to the administrative department for industry and commerce under the State Council for record or to the administrative department for industry and commerce of the people's government at or above the county level where the user is located for reference within the prescribed time limit;

(三)超出核准登记的商品或者服务范围使用的。

(3) Use beyond the approved scope of goods or services.

有下列行为之一的，由县级以上人民政府工商行政管理部门责令侵权人立即停止侵权行为，没收侵权商品，没收违法所得，并处违法所得5倍以下的罚款，没有违法所得的，处1万元以下的罚款：

If any of the following acts is committed, the administrative department for industry and commerce of the people's government at or above the county level shall order the infringer to immediately stop the infringement, confiscate the infringing goods, confiscate the illegal gains, and impose a fine of not less than 5 times the illegal gains; if there are no illegal gains, a fine of not more than 10,000 yuan shall be imposed:

(一)擅自使用与所有人的特殊标志相同或者近似的文字、图形或者其组合的；

(1) Unauthorized use of text, graphics, or combinations thereof that are identical or similar to the special sign of the owner;

(二)未经特殊标志所有人许可，擅自制造、销售其特殊标志或者将其特殊标志用于商业活动的；

(2) Without the permission of the owner of the special sign, unauthorized manufacture or sale of the special sign, or use of the special sign for commercial activities.

(三)有给特殊标志所有人造成经济损失的其他行为的。

(3) Other acts that cause economic losses to the owner of the special symbol.

特殊标志所有人或者使用人发现特殊标志所有权或者使用权被侵害时，可以向侵权人所在地或者侵权行为发生地县级以上人民政府工商行政管理部门投诉；也可以直接向人民法院起诉。

If the owner or user of a special symbol discovers that the ownership or right to use the special symbol is infringed, they may file a complaint with the administrative department for industry and commerce of the people's government at or above the county level in the place where the infringer is located or where the infringement occurred; they may also directly file a lawsuit with the people's court.

工商行政管理部门受理特殊标志侵权案件投诉的，应当依特殊标志所有人的请求，就侵权的民事赔偿主持调解；调解不成的，特殊标志所有人可以向人民法院起诉。

When the administrative department for industry and commerce accepts a complaint about a special symbol infringement case, it shall, at the request of the owner of the special symbol, preside over mediation regarding civil compensation for the infringement; if mediation fails, the owner of the special symbol may file a lawsuit with the people's court.

工商行政管理部门受理特殊标志侵权案件，在调查取证时，可以行使下列职权，有关当事人应当予以协助，不得拒绝：

When the administrative department for industry and commerce accepts a special symbol infringement case, it may exercise the following powers during investigation and evidence collection, and the relevant parties shall assist and shall not refuse:

(一)询问有关当事人；

(1) Question the relevant parties;

(二)检查与侵权活动有关的物品；

(2) Inspect items related to the infringing activity;

(三)调查与侵权活动有关的行为；

(3) Investigate acts related to the infringing activity;

(四)查阅、复制与侵权活动有关的合同、帐册等业务资料。

(4) Review and copy contracts, account books, and other business materials related to the infringing activity.

特殊标志申请费、公告费、登记费的收费标准，由国务院财政部门、物价部门会同国务院工商行政管理部门制定。

The fee standards for special symbol application fees, announcement fees, and registration fees shall be formulated by the financial department and the pricing department of the State Council together with the administrative department for industry and commerce of the State Council.

申请特殊标志登记有关文书格式由国务院工商行政管理部门制定。

The format of documents related to the application for special symbol registration shall be formulated by the administrative department for industry and commerce of the State Council.

经国务院批准代表中国参加国际性文化、体育、科学研究等活动的组织所使用的名称、徽记、吉祥物等标志的保护，参照本条例的规定施行。

The protection of names, emblems, mascots, and other symbols used by organizations approved by the State Council to represent China in international cultural, sports, scientific research, and other activities shall be implemented with reference to these Regulations.

本条例自发布之日起施行。

These Regulations shall come into force as of the date of promulgation.
