为了保持和提高国防科研生产能力，加强军工关键设备设施的管理，保障军工关键设备设施的安全、完整和有效使用，制定本条例。
These Regulations are formulated to maintain and enhance the capability of national defense scientific research and production, strengthen the management of military key equipment and facilities, and ensure the safety, integrity, and effective use of military key equipment and facilities.
本条例所称军工关键设备设施，是指直接用于武器装备科研生产的重要的实验设施、工艺设备、试验及测试设备等专用的军工设备设施。
For the purposes of these Regulations, 'military key equipment and facilities' refer to important experimental facilities, process equipment, testing and test equipment, and other specialized military equipment and facilities directly used for the scientific research and production of weapons and equipment.
军工关键设备设施的目录，由国务院国防科技工业主管部门会同军队武器装备主管部门、国务院国有资产监督管理机构和国务院有关部门制定。
The catalog of military key equipment and facilities shall be formulated by the competent department of defense science, technology, and industry under the State Council jointly with the competent department of weapons and equipment of the military, the state-owned assets supervision and administration institution under the State Council, and the relevant departments under the State Council.
国家对军工关键设备设施实行登记管理，对使用国家财政资金购建的用于武器装备总体、关键分系统、核心配套产品科研生产的军工关键设备设施的处置实行审批管理。
The state implements registration management for military key equipment and facilities, and implements approval management for the disposal of military key equipment and facilities that are purchased or constructed using state financial funds and used for the scientific research and production of overall weapons systems, key subsystems, and core supporting products.
国务院国防科技工业主管部门会同国务院有关部门依照本条例规定，对全国军工关键设备设施进行管理。
The competent department of defense science, technology, and industry under the State Council, together with the relevant departments under the State Council, shall manage the military key equipment and facilities nationwide in accordance with these Regulations.
省、自治区、直辖市人民政府负责国防科技工业管理的部门会同同级有关部门依照本条例规定，对有关军工关键设备设施进行管理。
The departments responsible for the administration of defense science, technology, and industry of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, together with the relevant departments at the same level, shall manage the relevant military key equipment and facilities in accordance with these Regulations.
军工关键设备设施管理，应当遵循严格责任、分工负责、方便有效的原则。
The management of military key equipment and facilities shall follow the principles of strict responsibility, division of responsibilities, and convenience and effectiveness.
占有、使用军工关键设备设施的企业、事业单位(以下简称企业、事业单位)及其工作人员，负责军工关键设备设施管理的部门、单位及其工作人员，对知悉的国家秘密和商业秘密负有保密义务。
Enterprises and institutions that possess or use military key equipment and facilities (hereinafter referred to as enterprises and institutions) and their staff, as well as departments and units responsible for the management of military key equipment and facilities and their staff, have the obligation to keep confidential any state secrets and commercial secrets they become aware of.
中央管理的企业负责办理所属单位军工关键设备设施的登记。国务院教育主管部门负责办理所属高等学校军工关键设备设施的登记。中国科学院负责办理所属科研机构军工关键设备设施的登记。
Enterprises managed by the central government shall be responsible for handling the registration of military key equipment and facilities of their subordinate units. The competent education department under the State Council shall be responsible for handling the registration of military key equipment and facilities of its subordinate institutions of higher education. The Chinese Academy of Sciences shall be responsible for handling the registration of military key equipment and facilities of its subordinate research institutions.
省、自治区、直辖市人民政府负责国防科技工业管理的部门负责办理本行政区域内前款规定以外的企业、事业单位军工关键设备设施的登记。
The departments responsible for the administration of defense science, technology, and industry of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for handling the registration of military key equipment and facilities of enterprises and institutions other than those specified in the preceding paragraph within their respective administrative regions.
企业、事业单位应当自军工关键设备设施投入使用之日起30日内向负责登记的部门、单位提交载明下列内容的文件材料，办理登记手续：
Enterprises and institutions shall, within 30 days from the date when the military key equipment and facilities are put into use, submit to the department or unit responsible for registration documents containing the following information to complete the registration procedures:
(一)企业、事业单位的名称、住所等基本情况；
(1) The name, domicile, and other basic information of the enterprise or institution;
(二)军工关键设备设施的名称、产地、价值、性能、状态、资金来源、权属等基本情况。
(2) The name, place of origin, value, performance, status, source of funds, ownership, and other basic information of the military key equipment and facilities.
企业、事业单位应当对其提交的文件材料的真实性负责。
Enterprises and institutions shall be responsible for the authenticity of the documents they submit.
负责登记的部门、单位应当自收到提交的文件材料之日起30日内办结登记，并对军工关键设备设施赋予专用代码。
The department or unit responsible for registration shall complete the registration within 30 days from the date of receiving the submitted documents, and assign a special code to the military key equipment and facilities.
军工关键设备设施登记的具体内容和专用代码，由国务院国防科技工业主管部门统一规定和分配。
The specific content of the registration of military key equipment and facilities and the special codes shall be uniformly prescribed and allocated by the competent department of defense science, technology, and industry under the State Council.
企业、事业单位占有、使用的军工关键设备设施损毁、报废、灭失或者权属发生变更的，应当自上述事实发生之日起30日内向负责登记的部门、单位报告。负责登记的部门、单位应当及时变更登记信息。
If military key equipment and facilities possessed or used by enterprises and institutions are damaged, scrapped, lost, or their ownership changes, the enterprises and institutions shall report to the department or unit responsible for registration within 30 days from the date of occurrence of such facts. The department or unit responsible for registration shall promptly update the registration information.
负责登记的部门、单位应当按照国务院国防科技工业主管部门的规定将登记信息报送国务院国防科技工业主管部门。
The department or unit responsible for registration shall submit the registration information to the competent department of defense science, technology, and industry under the State Council in accordance with the provisions of the competent department of defense science, technology, and industry under the State Council.
国务院国防科技工业主管部门和负责登记的部门、单位可以根据需要，对登记信息进行核查。
The competent department of defense science, technology, and industry under the State Council and the department or unit responsible for registration may, as needed, verify the registration information.
企业、事业单位应当建立健全军工关键设备设施使用管理制度，保证军工关键设备设施的安全、完整和有效使用，并对其占有、使用的军工关键设备设施的名称、规格、性能、状态、数量、权属等基本情况作完整记录。
Enterprises and institutions shall establish and improve the management system for the use of military key equipment and facilities, ensure the safety, integrity, and effective use of military key equipment and facilities, and maintain complete records of the name, specifications, performance, status, quantity, ownership, and other basic information of the military key equipment and facilities they possess or use.
企业、事业单位应当按照国务院国防科技工业主管部门的规定，在需要特殊管控的军工关键设施外围划定安全控制范围，并在其外沿设置安全警戒标志。
Enterprises and institutions shall, in accordance with the provisions of the competent department of defense science, technology, and industry under the State Council, delineate a safety control perimeter around military key facilities requiring special control, and set up safety warning signs along its outer edge.
企业、事业单位改变其占有、使用的军工关键设备设施的用途的，应当向负责登记的部门、单位提交有关文件材料，办理补充登记。负责登记的部门、单位应当按照国务院国防科技工业主管部门的规定向国务院国防科技工业主管部门报送补充登记信息。
If enterprises and institutions change the use of the military key equipment and facilities they possess or use, they shall submit relevant documents to the department or unit responsible for registration and complete supplementary registration. The department or unit responsible for registration shall submit the supplementary registration information to the competent department of defense science, technology, and industry under the State Council in accordance with the provisions of the competent department of defense science, technology, and industry under the State Council.
企业、事业单位改变使用国家财政资金购建的军工关键设备设施的用途，影响武器装备科研生产任务完成的，国务院国防科技工业主管部门应当及时予以纠正。
If enterprises and institutions change the use of military key equipment and facilities purchased or constructed using state financial funds, thereby affecting the completion of weapons and equipment scientific research and production tasks, the competent department of defense science, technology, and industry under the State Council shall promptly correct it.
企业、事业单位拟通过转让、租赁等方式处置使用国家财政资金购建的用于武器装备总体、关键分系统、核心配套产品科研生产的军工关键设备设施，应当经国务院国防科技工业主管部门批准。申请批准应当提交载明下列内容的文件材料：
If enterprises and institutions intend to dispose of military key equipment and facilities that are purchased or constructed using state financial funds and used for the scientific research and production of overall weapons systems, key subsystems, and core supporting products through transfer, lease, or other means, they shall obtain approval from the competent department of defense science, technology, and industry under the State Council. To apply for approval, they shall submit documents containing the following information:
(一)军工关键设备设施的名称、数量、价值、性能、使用等情况；
(1) Name, quantity, value, performance, and usage of military key equipment and facilities;
(二)不影响承担武器装备科研生产任务的情况说明；
(2) Explanation that the disposal does not affect the ability to undertake weapons equipment research and production tasks;
(三)处置的原因及方式；
(3) Reasons and methods of disposal;
(四)受让人或者承租人的基本情况。
(4) Basic information of the transferee or lessee.
国务院国防科技工业主管部门应当自收到处置申请之日起30日内，作出批准或者不予批准的决定。作出批准决定的，国务院国防科技工业主管部门应当向申请人颁发批准文件；作出不予批准决定的，国务院国防科技工业主管部门应当书面通知申请人，并说明理由。
The State Administration of Science, Technology and Industry for National Defense shall, within 30 days from receipt of the disposal application, make a decision to approve or disapprove. If approval is granted, the Administration shall issue an approval document to the applicant; if disapproval is granted, the Administration shall notify the applicant in writing and state the reasons.
国务院国防科技工业主管部门作出批准或者不予批准的决定，应当征求军队武器装备主管部门、国务院国有资产监督管理机构和国务院有关部门的意见。涉及国防科研生产能力、结构和布局调整的，应当按照国家有关规定会同军队武器装备主管部门、国务院国有资产监督管理机构和国务院有关部门，作出批准或者不予批准的决定。
When making a decision to approve or disapprove, the State Administration of Science, Technology and Industry for National Defense shall seek opinions from the weapons equipment department of the military, the State-owned Assets Supervision and Administration Commission, and relevant departments of the State Council. If the decision involves adjustments to national defense research and production capacity, structure, or layout, the decision shall be made jointly with the aforementioned departments in accordance with relevant state regulations.
企业、事业单位取得批准文件后，应当依照本条例第十一条的规定及时向负责登记的部门、单位报告。
After obtaining the approval document, enterprises and institutions shall promptly report to the registration department or unit in accordance with Article 11 of this Regulation.
国有资产监督管理机构等有关部门依照法定职责和程序决定企业、事业单位合并、分立、改制、解散、申请破产等重大事项，涉及使用国家财政资金购建的用于武器装备总体、关键分系统、核心配套产品科研生产的军工关键设备设施权属变更的，应当征求国防科技工业主管部门的意见。
When state-owned assets supervision and administration authorities and other relevant departments decide on major matters such as merger, division, restructuring, dissolution, or bankruptcy of enterprises or institutions in accordance with legal duties and procedures, and such matters involve changes in ownership of military key equipment and facilities purchased with state fiscal funds and used for scientific research and production of weapons systems, key subsystems, or core supporting products, they shall seek opinions from the State Administration of Science, Technology and Industry for National Defense.
企业、事业单位未依照本条例规定办理军工关键设备设施登记，或者其占有、使用的军工关键设备设施损毁、报废、灭失或者权属发生变更未及时向负责登记的部门、单位报告的，责令限期改正；逾期未改正的，处以1万元以上2万元以下罚款。
If an enterprise or institution fails to register military key equipment and facilities as required by this Regulation, or fails to promptly report to the registration department or unit when its possessed or used military key equipment and facilities are damaged, scrapped, lost, or undergo ownership changes, it shall be ordered to rectify within a specified period; if it fails to rectify within the period, a fine of not less than 10,000 yuan but not more than 20,000 yuan shall be imposed.
企业、事业单位提交虚假文件材料办理登记的，责令改正，处以1万元以上2万元以下罚款。
If an enterprise or institution submits false documents or materials for registration, it shall be ordered to rectify and fined not less than 10,000 yuan but not more than 20,000 yuan.
企业、事业单位违反本条例规定，未经批准处置使用国家财政资金购建的用于武器装备总体、关键分系统、核心配套产品科研生产的军工关键设备设施的，责令限期改正，处以50万元以上100万元以下罚款，对直接负责的主管人员和其他直接责任人员处以5000元以上2万元以下罚款；有违法所得的，没收违法所得。
If an enterprise or institution, in violation of this Regulation, disposes of military key equipment and facilities purchased with state fiscal funds and used for scientific research and production of weapons systems, key subsystems, or core supporting products without approval, it shall be ordered to rectify within a specified period and fined not less than 500,000 yuan but not more than 1,000,000 yuan; the directly responsible managers and other directly responsible personnel shall be fined not less than 5,000 yuan but not more than 20,000 yuan; any illegal gains shall be confiscated.
企业、事业单位以欺骗、贿赂等不正当手段取得有关军工关键设备设施处置的批准文件的，处以5万元以上20万元以下罚款；对违法取得的批准文件依法予以撤销。
If an enterprise or institution obtains an approval document for disposal of military key equipment and facilities through fraud, bribery, or other improper means, it shall be fined not less than 50,000 yuan but not more than 200,000 yuan; the illegally obtained approval document shall be revoked according to law.
本条例规定的行政处罚，由国务院国防科技工业主管部门决定。但是，对本条例第七条第二款规定的企业、事业单位有本条例第十九条规定的违法行为的行政处罚，由省、自治区、直辖市人民政府负责国防科技工业管理的部门决定。
The administrative penalties provided for in this Regulation shall be decided by the State Administration of Science, Technology and Industry for National Defense. However, for enterprises and institutions specified in Article 7, paragraph 2 of this Regulation that commit illegal acts under Article 19, the administrative penalties shall be decided by the provincial, autonomous region, or municipality directly under the Central Government's department responsible for defense science, technology and industry administration.
负责军工关键设备设施登记管理、处置审批管理的部门、单位的工作人员滥用职权、玩忽职守、徇私舞弊的，依法给予处分；构成犯罪的，依法追究刑事责任。
If staff members of departments or units responsible for registration management and disposal approval management of military key equipment and facilities abuse their power, neglect their duties, or engage in malpractice for personal gain, they shall be given disciplinary sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law.
本条例自2011年10月1日起施行。
This Regulation shall come into effect on October 1, 2011.
