总则
General Provisions
为了加强彩票管理，规范彩票市场发展，维护彩票市场秩序，保护彩票参与者的合法权益，促进社会公益事业发展，制定本条例。
These Regulations are formulated to strengthen lottery administration, regulate the development of the lottery market, maintain order in the lottery market, protect the legitimate rights and interests of lottery participants, and promote the development of social welfare undertakings.
本条例所称彩票，是指国家为筹集社会公益资金，促进社会公益事业发展而特许发行、依法销售，自然人自愿购买，并按照特定规则获得中奖机会的凭证。
For the purposes of these Regulations, 'lottery' refers to a certificate that is specially licensed for issuance by the State, lawfully sold, voluntarily purchased by natural persons, and provides an opportunity to win a prize in accordance with specific rules, for the purpose of raising funds for social welfare and promoting the development of social welfare undertakings.
彩票不返还本金、不计付利息。
Lotteries are non-refundable and do not bear interest.
国务院特许发行福利彩票、体育彩票。未经国务院特许，禁止发行其他彩票。禁止在中华人民共和国境内发行、销售境外彩票。
The State Council specially licenses the issuance of welfare lotteries and sports lotteries. Without the special license of the State Council, no other lotteries may be issued. It is prohibited to issue or sell lotteries from outside the territory within the People's Republic of China.
彩票的发行、销售和开奖，应当遵循公开、公平、公正和诚实信用的原则。
The issuance, sale, and drawing of lotteries shall follow the principles of openness, fairness, justice, and good faith.
国务院财政部门负责全国的彩票监督管理工作。国务院民政部门、体育行政部门按照各自的职责分别负责全国的福利彩票、体育彩票管理工作。
The finance department of the State Council is responsible for the supervision and administration of lotteries nationwide. The civil affairs department and the sports administration department of the State Council are respectively responsible for the administration of welfare lotteries and sports lotteries nationwide within their respective functions.
省、自治区、直辖市人民政府财政部门负责本行政区域的彩票监督管理工作。省、自治区、直辖市人民政府民政部门、体育行政部门按照各自的职责分别负责本行政区域的福利彩票、体育彩票管理工作。
The finance departments of provinces, autonomous regions, and municipalities directly under the Central Government are responsible for the supervision and administration of lotteries within their respective administrative regions. The civil affairs departments and sports administration departments of provinces, autonomous regions, and municipalities directly under the Central Government are respectively responsible for the administration of welfare lotteries and sports lotteries within their respective administrative regions within their respective functions.
县级以上各级人民政府公安机关和县级以上工商行政管理机关，在各自的职责范围内，依法查处非法彩票，维护彩票市场秩序。
The public security organs and the administrative authorities for industry and commerce at or above the county level shall, within their respective functions, investigate and deal with illegal lotteries in accordance with the law and maintain order in the lottery market.
彩票发行和销售管理
Lottery Issuance and Sales Management
国务院民政部门、体育行政部门依法设立的福利彩票发行机构、体育彩票发行机构(以下简称彩票发行机构)，分别负责全国的福利彩票、体育彩票发行和组织销售工作。
The welfare lottery issuance institution and sports lottery issuance institution (hereinafter referred to as lottery issuance institutions) established according to law by the civil affairs department and the sports administration department of the State Council shall respectively be responsible for the nationwide issuance and organized sales of welfare lotteries and sports lotteries.
省、自治区、直辖市人民政府民政部门、体育行政部门依法设立的福利彩票销售机构、体育彩票销售机构(以下简称彩票销售机构)，分别负责本行政区域的福利彩票、体育彩票销售工作。
The welfare lottery sales institutions and sports lottery sales institutions (hereinafter referred to as lottery sales institutions) established according to law by the civil affairs departments and sports administration departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall respectively be responsible for the sales of welfare lotteries and sports lotteries within their respective administrative regions.
彩票发行机构申请开设、停止福利彩票、体育彩票的具体品种(以下简称彩票品种)或者申请变更彩票品种审批事项的，应当依照本条例规定的程序报国务院财政部门批准。
If a lottery issuance institution applies to establish, discontinue a specific variety of welfare lottery or sports lottery (hereinafter referred to as lottery variety) or to change the approval matters of a lottery variety, it shall submit the application to the finance department of the State Council for approval in accordance with the procedures prescribed in these Regulations.
国务院财政部门应当根据彩票市场健康发展的需要，按照合理规划彩票市场和彩票品种结构、严格控制彩票风险的原则，对彩票发行机构的申请进行审查。
The finance department of the State Council shall, based on the needs for the healthy development of the lottery market and in accordance with the principles of rationally planning the lottery market and lottery variety structure and strictly controlling lottery risks, review the application of the lottery issuance institution.
彩票发行机构申请开设彩票品种，应当经国务院民政部门或者国务院体育行政部门审核同意，向国务院财政部门提交下列申请材料：
A lottery issuance institution applying to establish a lottery variety shall, after obtaining the review and consent of the civil affairs department or the sports administration department of the State Council, submit the following application materials to the finance department of the State Council:
(一)申请书；
(1) A written application;
(二)彩票品种的规则；
(2) The rules of the lottery variety;
(三)发行方式、发行范围；
(3) The issuance method and issuance scope;
(四)市场分析报告及技术可行性分析报告；
(4) A market analysis report and a technical feasibility analysis report;
(五)开奖、兑奖操作规程；
(5) Draw and prize claim operating procedures;
(六)风险控制方案。
(6) Risk control plan.
国务院财政部门应当自受理申请之日起90个工作日内，通过专家评审、听证会等方式对开设彩票品种听取社会意见，对申请进行审查并作出书面决定。
The finance department of the State Council shall, within 90 working days from the date of accepting the application, solicit public opinions on the establishment of lottery types through expert review, hearings, etc., review the application, and make a written decision.
彩票发行机构申请变更彩票品种的规则、发行方式、发行范围等审批事项的，应当经国务院民政部门或者国务院体育行政部门审核同意，向国务院财政部门提出申请并提交与变更事项有关的材料。国务院财政部门应当自受理申请之日起45个工作日内，对申请进行审查并作出书面决定。
A lottery issuance institution applying to change the rules, issuance method, issuance scope, or other approval items of a lottery type shall, after obtaining the review and consent of the civil affairs department of the State Council or the sports administrative department of the State Council, submit an application to the finance department of the State Council along with materials related to the change. The finance department of the State Council shall, within 45 working days from the date of accepting the application, review the application and make a written decision.
彩票发行机构申请停止彩票品种的，应当经国务院民政部门或者国务院体育行政部门审核同意，向国务院财政部门提出书面申请并提交与停止彩票品种有关的材料。国务院财政部门应当自受理申请之日起10个工作日内，对申请进行审查并作出书面决定。
A lottery issuance institution applying to cease a lottery type shall, after obtaining the review and consent of the civil affairs department of the State Council or the sports administrative department of the State Council, submit a written application to the finance department of the State Council along with materials related to the cessation. The finance department of the State Council shall, within 10 working days from the date of accepting the application, review the application and make a written decision.
经批准开设、停止彩票品种或者变更彩票品种审批事项的，彩票发行机构应当在开设、变更、停止的10个自然日前，将有关信息向社会公告。
Upon approval to establish, cease, or change approval items of a lottery type, the lottery issuance institution shall publicly announce the relevant information to society at least 10 calendar days before the establishment, change, or cessation.
因维护社会公共利益的需要，在紧急情况下，国务院财政部门可以采取必要措施，决定变更彩票品种审批事项或者停止彩票品种。
For the need to safeguard public interests, in emergency situations, the finance department of the State Council may take necessary measures to decide to change approval items of a lottery type or cease a lottery type.
彩票发行机构、彩票销售机构应当依照政府采购法律、行政法规的规定，采购符合标准的彩票设备和技术服务。
Lottery issuance institutions and lottery sales institutions shall, in accordance with government procurement laws and administrative regulations, procure lottery equipment and technical services that meet the standards.
彩票设备和技术服务的标准，由国务院财政部门会同国务院民政部门、体育行政部门依照国家有关标准化法律、行政法规的规定制定。
The standards for lottery equipment and technical services shall be formulated by the finance department of the State Council together with the civil affairs department and the sports administrative department of the State Council in accordance with relevant national standardization laws and administrative regulations.
彩票发行机构、彩票销售机构应当建立风险管理体系和可疑资金报告制度，保障彩票发行、销售的安全。
Lottery issuance institutions and lottery sales institutions shall establish a risk management system and a suspicious fund reporting system to ensure the safety of lottery issuance and sales.
彩票发行机构、彩票销售机构负责彩票销售系统的数据管理、开奖兑奖管理以及彩票资金的归集管理，不得委托他人管理。
Lottery issuing institutions and lottery sales institutions are responsible for data management of the lottery sales system, management of lottery drawing and prize payment, and management of lottery fund collection, and shall not entrust such management to others.
彩票发行机构、彩票销售机构可以委托单位、个人代理销售彩票。彩票发行机构、彩票销售机构应当与接受委托的彩票代销者签订彩票代销合同。福利彩票、体育彩票的代销合同示范文本分别由国务院民政部门、体育行政部门制定。
Lottery issuing institutions and lottery sales institutions may entrust entities or individuals to act as agents for lottery sales. Lottery issuing institutions and lottery sales institutions shall enter into lottery agency contracts with the entrusted lottery agents. Model contracts for welfare lottery and sports lottery agency shall be formulated by the civil affairs department and the sports administration department of the State Council respectively.
彩票代销者不得委托他人代销彩票。
Lottery agents shall not entrust others to sell lottery tickets on their behalf.
彩票销售机构应当为彩票代销者配置彩票投注专用设备。彩票投注专用设备属于彩票销售机构所有，彩票代销者不得转借、出租、出售。
Lottery sales institutions shall equip lottery agents with dedicated lottery betting equipment. Such dedicated lottery betting equipment is owned by the lottery sales institution, and lottery agents shall not lend, lease, or sell it.
彩票销售机构应当在彩票发行机构的指导下，统筹规划彩票销售场所的布局。彩票销售场所应当按照彩票发行机构的统一要求，设置彩票销售标识，张贴警示标语。
Lottery sales institutions shall, under the guidance of lottery issuing institutions, plan the layout of lottery sales outlets in a coordinated manner. Lottery sales outlets shall display lottery sales signs and post warning slogans in accordance with the unified requirements of lottery issuing institutions.
彩票发行机构、彩票销售机构、彩票代销者不得有下列行为：
Lottery issuing institutions, lottery sales institutions, and lottery agents shall not engage in the following acts:
(一)进行虚假性、误导性宣传；
(1) Making false or misleading publicity;
(二)以诋毁同业者等手段进行不正当竞争；
(2) Engaging in unfair competition by means such as defaming competitors;
(三)向未成年人销售彩票；
(3) Selling lottery tickets to minors;
(四)以赊销或者信用方式销售彩票。
(4) Selling lottery tickets on credit or by way of credit.
需要销毁彩票的，由彩票发行机构报国务院财政部门批准后，在国务院民政部门或者国务院体育行政部门的监督下销毁。
If lottery tickets need to be destroyed, the lottery issuing institution shall report to the finance department of the State Council for approval, and then destroy them under the supervision of the civil affairs department of the State Council or the sports administration department of the State Council.
彩票发行机构、彩票销售机构应当及时将彩票发行、销售情况向社会全面公布，接受社会公众的监督。
Lottery issuing institutions and lottery sales institutions shall promptly and comprehensively disclose the lottery issuance and sales situation to the public, and accept public supervision.
彩票开奖和兑奖管理
Lottery Drawing and Prize Redemption Management
彩票发行机构、彩票销售机构应当按照批准的彩票品种的规则和开奖操作规程开奖。
Lottery issuing institutions and lottery sales institutions shall conduct draws in accordance with the approved lottery variety rules and draw operating procedures.
国务院民政部门、体育行政部门和省、自治区、直辖市人民政府民政部门、体育行政部门应当加强对彩票开奖活动的监督，确保彩票开奖的公开、公正。
The civil affairs department and sports administration department of the State Council, as well as the civil affairs departments and sports administration departments of provinces, autonomous regions, and municipalities directly under the Central Government, shall strengthen supervision over lottery drawing activities to ensure openness and fairness in lottery draws.
彩票发行机构、彩票销售机构应当确保彩票销售数据的完整、准确和安全。当期彩票销售数据封存后至开奖活动结束前，不得查阅、变更或者删除销售数据。
Lottery issuing institutions and lottery sales institutions shall ensure the completeness, accuracy, and security of lottery sales data. From the time current lottery sales data is sealed until the end of the drawing activity, no one may access, modify, or delete the sales data.
彩票发行机构、彩票销售机构应当加强对开奖设备的管理，确保开奖设备正常运行，并配置备用开奖设备。
Lottery issuing institutions and lottery sales institutions shall strengthen the management of drawing equipment, ensure the normal operation of drawing equipment, and configure backup drawing equipment.
彩票发行机构、彩票销售机构应当在每期彩票销售结束后，及时向社会公布当期彩票的销售情况和开奖结果。
Lottery issuing institutions and lottery sales institutions shall promptly disclose the sales situation and drawing results of the current lottery to the public after the end of each lottery sales period.
彩票中奖者应当自开奖之日起60个自然日内，持中奖彩票到指定的地点兑奖，彩票品种的规则规定需要出示身份证件的，还应当出示本人身份证件。逾期不兑奖的视为弃奖。
A lottery winner shall, within 60 natural days from the date of the draw, present the winning lottery ticket at the designated location for prize redemption. If the lottery variety rules require the presentation of an identity document, the winner shall also present his/her identity document. Failure to redeem the prize within the time limit shall be deemed as forfeiting the prize.
禁止使用伪造、变造的彩票兑奖。
It is prohibited to use forged or altered lottery tickets for prize redemption.
彩票发行机构、彩票销售机构、彩票代销者应当按照彩票品种的规则和兑奖操作规程兑奖。
Lottery issuing institutions, lottery sales institutions, and lottery agents shall redeem prizes in accordance with the rules of the lottery type and the prize redemption operating procedures.
彩票中奖奖金应当以人民币现金或者现金支票形式一次性兑付。
Lottery winning prizes shall be paid in a lump sum in the form of RMB cash or cashier's check.
不得向未成年人兑奖。
Prizes shall not be redeemed to minors.
彩票发行机构、彩票销售机构、彩票代销者以及其他因职务或者业务便利知悉彩票中奖者个人信息的人员，应当对彩票中奖者个人信息予以保密。
Lottery issuing institutions, lottery sales institutions, lottery agents, and other personnel who have access to the personal information of lottery winners due to their duties or business convenience shall keep such information confidential.
彩票资金管理
Lottery Fund Management
彩票资金包括彩票奖金、彩票发行费和彩票公益金。彩票资金构成比例由国务院决定。
Lottery funds include lottery prizes, lottery issuance fees, and lottery public welfare funds. The proportion of lottery fund components shall be determined by the State Council.
彩票品种中彩票资金的具体构成比例，由国务院财政部门按照国务院的决定确定。
The specific proportion of lottery fund components for each lottery type shall be determined by the finance department of the State Council in accordance with the decision of the State Council.
随着彩票发行规模的扩大和彩票品种的增加，可以降低彩票发行费比例。
As the scale of lottery issuance expands and the variety of lottery types increases, the proportion of lottery issuance fees may be reduced.
彩票发行机构、彩票销售机构应当按照国务院财政部门的规定开设彩票资金账户，用于核算彩票资金。
Lottery issuing institutions and lottery sales institutions shall open lottery fund accounts in accordance with the regulations of the finance department of the State Council for accounting of lottery funds.
国务院财政部门和省、自治区、直辖市人民政府财政部门应当建立彩票发行、销售和资金管理信息系统，及时掌握彩票销售和资金流动情况。
The finance department of the State Council and the finance departments of provinces, autonomous regions, and municipalities directly under the Central Government shall establish information systems for lottery issuance, sales, and fund management to timely monitor lottery sales and fund flows.
彩票奖金用于支付彩票中奖者。彩票单注奖金的最高限额，由国务院财政部门根据彩票市场发展情况决定。
Lottery prize funds are used to pay lottery winners. The maximum single-bet prize limit for lottery shall be determined by the finance department of the State Council based on the development of the lottery market.
逾期未兑奖的奖金，纳入彩票公益金。
Unclaimed prize funds shall be included in the lottery public welfare fund.
彩票发行费专项用于彩票发行机构、彩票销售机构的业务费用支出以及彩票代销者的销售费用支出。
Lottery issuance fees are specifically used for the business expenses of lottery issuing institutions and lottery sales institutions, as well as the sales expenses of lottery sales agents.
彩票发行机构、彩票销售机构的业务费实行收支两条线管理，其支出应当符合彩票发行机构、彩票销售机构财务管理制度。
The business fees of lottery issuing institutions and lottery sales institutions shall be managed under separate revenue and expenditure accounts, and their expenditures shall comply with the financial management systems of lottery issuing institutions and lottery sales institutions.
彩票公益金专项用于社会福利、体育等社会公益事业，不用于平衡财政一般预算。
Lottery public welfare funds are specifically used for social welfare, sports, and other public welfare undertakings, and shall not be used to balance general fiscal budgets.
彩票公益金按照政府性基金管理办法纳入预算，实行收支两条线管理。
Lottery public welfare funds shall be included in the budget in accordance with the management measures for government-managed funds, and shall be managed under separate revenue and expenditure accounts.
彩票发行机构、彩票销售机构应当按照国务院财政部门的规定，及时上缴彩票公益金和彩票发行费中的业务费，不得截留或者挪作他用。财政部门应当及时核拨彩票发行机构、彩票销售机构的业务费。
Lottery issuing institutions and lottery sales institutions shall, in accordance with the provisions of the finance department of the State Council, promptly remit the lottery public welfare funds and the business fees from lottery issuance fees, and shall not withhold or misappropriate them. The finance department shall promptly allocate the business fees to lottery issuing institutions and lottery sales institutions.
彩票公益金的分配政策，由国务院财政部门会同国务院民政、体育行政等有关部门提出方案，报国务院批准后执行。
The distribution policy for lottery public welfare funds shall be proposed by the finance department of the State Council jointly with the civil affairs, sports administration, and other relevant departments of the State Council, and shall be implemented after approval by the State Council.
彩票发行费、彩票公益金的管理、使用单位，应当依法接受财政部门、审计机关和社会公众的监督。
The units that manage and use lottery issuance fees and lottery public welfare funds shall legally accept supervision from the finance department, audit authorities, and the public.
彩票公益金的管理、使用单位，应当每年向社会公告公益金的使用情况。
The units that manage and use lottery public welfare funds shall annually announce to the public the usage of the public welfare funds.
国务院财政部门和省、自治区、直辖市人民政府财政部门应当每年向本级人民政府报告上年度彩票公益金的筹集、分配和使用情况，并向社会公告。
The finance department of the State Council and the finance departments of provinces, autonomous regions, and municipalities directly under the Central Government shall report to the people's government at the same level each year on the collection, allocation, and use of lottery public welfare funds from the previous year, and shall make a public announcement.
法律责任
Legal Liability
违反本条例规定，擅自发行、销售彩票，或者在中华人民共和国境内发行、销售境外彩票构成犯罪的，依法追究刑事责任；尚不构成犯罪的，由公安机关依法给予治安管理处罚；有违法所得的，没收违法所得。
Whoever, in violation of these Regulations, issues or sells lotteries without authorization, or issues or sells overseas lotteries within the territory of the People's Republic of China, if the act constitutes a crime, shall be investigated for criminal liability according to law; if the act does not constitute a crime, the public security organ shall impose a public security penalty according to law; if there is illegal income, the illegal income shall be confiscated.
彩票发行机构、彩票销售机构有下列行为之一的，由财政部门责令停业整顿；有违法所得的，没收违法所得，并处违法所得3倍的罚款；对直接负责的主管人员和其他直接责任人员，依法给予处分；构成犯罪的，依法追究刑事责任：
If a lottery issuing institution or lottery sales institution commits any of the following acts, the finance department shall order it to suspend operations for rectification; if there is illegal income, the illegal income shall be confiscated, and a fine of three times the illegal income shall be imposed; the directly responsible person in charge and other directly responsible persons shall be given sanctions according to law; if the act constitutes a crime, criminal liability shall be investigated according to law:
(一)未经批准开设、停止彩票品种或者未经批准变更彩票品种审批事项的；
(1) Opening or discontinuing a lottery type without approval, or changing the approved matters of a lottery type without approval;
(二)未按批准的彩票品种的规则、发行方式、发行范围、开奖兑奖操作规程发行、销售彩票或者开奖兑奖的；
(2) Issuing or selling lotteries or conducting draws and prize claims not in accordance with the approved rules, issuance methods, issuance scope, or draw and prize claim operating procedures of the lottery type;
(三)将彩票销售系统的数据管理、开奖兑奖管理或者彩票资金的归集管理委托他人管理的；
(3) Entrusting the management of lottery sales system data management, draw and prize claim management, or lottery fund collection management to another person;
(四)违反规定查阅、变更、删除彩票销售数据的；
(4) Accessing, altering, or deleting lottery sales data in violation of regulations;
(五)以赊销或者信用方式销售彩票的；
(5) Selling lotteries on credit or by credit;
(六)未经批准销毁彩票的；
(6) Destroying lotteries without approval;
(七)截留、挪用彩票资金的。
(7) Misappropriating or diverting lottery funds.
彩票发行机构、彩票销售机构有下列行为之一的，由财政部门责令改正；有违法所得的，没收违法所得；对直接负责的主管人员和其他直接责任人员，依法给予处分：
If a lottery issuing institution or lottery sales institution commits any of the following acts, the financial department shall order correction; if there is illegal income, the illegal income shall be confiscated; the directly responsible person in charge and other directly responsible personnel shall be given sanctions according to law:
(一)采购不符合标准的彩票设备或者技术服务的；
(1) Purchasing lottery equipment or technical services that do not meet the standards;
(二)进行虚假性、误导性宣传的；
(2) Conducting false or misleading publicity;
(三)以诋毁同业者等手段进行不正当竞争的；
(3) Engaging in unfair competition by means such as denigrating competitors;
(四)向未成年人销售彩票的；
(4) Selling lottery tickets to minors;
(五)泄露彩票中奖者个人信息的；
(5) Disclosing personal information of lottery winners;
(六)未将逾期未兑奖的奖金纳入彩票公益金的；
(6) Failing to include unclaimed expired prizes into the lottery public welfare fund;
(七)未按规定上缴彩票公益金、彩票发行费中的业务费的。
(7) Failing to remit the lottery public welfare fund and the business fees in the lottery issuance fees as required.
彩票代销者有下列行为之一的，由民政部门、体育行政部门责令改正，处2000元以上1万元以下罚款；有违法所得的，没收违法所得：
If a lottery agent commits any of the following acts, the civil affairs department or the sports administrative department shall order correction, impose a fine of not less than 2,000 yuan but not more than 10,000 yuan; if there is illegal income, the illegal income shall be confiscated:
(一)委托他人代销彩票或者转借、出租、出售彩票投注专用设备的；
(1) Entrusting others to sell lottery tickets on commission, or transferring, lending, renting, or selling lottery betting dedicated equipment;
(二)进行虚假性、误导性宣传的；
(2) Conducting false or misleading publicity;
(三)以诋毁同业者等手段进行不正当竞争的；
(3) Engaging in unfair competition by means such as denigrating competitors;
(四)向未成年人销售彩票的；
(4) Selling lottery tickets to minors;
(五)以赊销或者信用方式销售彩票的。
(5) Selling lottery tickets on credit or by means of credit.
彩票代销者有前款行为受到处罚的，彩票发行机构、彩票销售机构有权解除彩票代销合同。
If a lottery sales agent is penalized for the acts in the preceding paragraph, the lottery issuing institution or lottery sales institution has the right to terminate the lottery sales agency contract.
伪造、变造彩票或使用伪造、变造的彩票兑奖的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
Whoever forges or alters lottery tickets, or uses forged or altered lottery tickets to claim prizes, shall be given a public security penalty according to law; if a crime is constituted, criminal liability shall be pursued according to law.
彩票公益金管理、使用单位违反彩票公益金管理、使用规定的，由财政部门责令限期改正；有违法所得的，没收违法所得；在规定期限内不改正的，没收已使用彩票公益金形成的资产，取消其彩票公益金使用资格。
If a unit managing or using lottery public welfare funds violates the provisions on the management and use of lottery public welfare funds, the financial department shall order correction within a time limit; if there is illegal income, the illegal income shall be confiscated; if correction is not made within the time limit, the assets formed by the used lottery public welfare funds shall be confiscated, and its qualification to use lottery public welfare funds shall be revoked.
依照本条例的规定履行彩票管理职责的财政部门、民政部门、体育行政部门的工作人员，在彩票监督管理活动中滥用职权、玩忽职守、徇私舞弊，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予处分。
If staff members of the financial department, civil affairs department, or sports administration department who perform lottery management duties according to these Regulations abuse their power, neglect their duties, or engage in malpractice for personal gain in lottery supervision and management activities, and if a crime is constituted, criminal liability shall be pursued according to law; if a crime is not constituted, disciplinary action shall be given according to law.

Supplementary Provisions
本条例自2009年7月1日起施行。
These regulations from2009year7month1day shall come into effect。
