总则
General Provisions
为了加强对电影行业的管理，发展和繁荣电影事业，满足人民群众文化生活需要，促进社会主义物质文明和精神文明建设，制定本条例。
These Regulations are formulated to strengthen the administration of the film industry, develop and prosper the film industry, meet the cultural and entertainment needs of the people, and promote the construction of socialist material civilization and spiritual civilization.
本条例适用于中华人民共和国境内的故事片、纪录片、科教片、美术片、专题片等电影片的制片、进口、出口、发行和放映等活动。
These Regulations apply to activities such as the production, import, export, distribution, and screening of feature films, documentaries, science and education films, art films, and special-topic films within the territory of the People's Republic of China.
从事电影片的制片、进口、出口、发行和放映等活动，应当遵守宪法和有关法律、法规，坚持为人民服务、为社会主义服务的方向。
Engaging in the production, import, export, distribution, and screening of films shall comply with the Constitution and relevant laws and regulations, and adhere to the direction of serving the people and serving socialism.
国务院广播电影电视行政部门主管全国电影工作。
The administrative department of radio, film, and television under the State Council shall be in charge of the national film work.
县级以上地方人民政府管理电影的行政部门(以下简称电影行政部门)，依照本条例的规定负责本行政区域内的电影管理工作。
The administrative department of films of the local people's government at or above the county level (hereinafter referred to as the film administrative department) shall be responsible for the film administration within its administrative region in accordance with the provisions of these Regulations.
国家对电影摄制、进口、出口、发行、放映和电影片公映实行许可制度。未经许可，任何单位和个人不得从事电影片的摄制、进口、发行、放映活动，不得进口、出口、发行、放映未取得许可证的电影片。
The State implements a licensing system for film production, import, export, distribution, screening, and public release of films. Without a license, no unit or individual may engage in the production, import, distribution, or screening of films, nor may they import, export, distribute, or screen films that have not obtained a license.
依照本条例发放的许可证和批准文件，不得出租、出借、出售或者以其他任何形式转让。
Licenses and approval documents issued in accordance with these Regulations shall not be rented, lent, sold, or transferred in any other form.
全国性电影行业的社会团体按照其章程，在国务院广播电影电视行政部门指导下，实行自律管理。
National social organizations in the film industry shall, in accordance with their articles of association and under the guidance of the administrative department of radio, film, and television under the State Council, implement self-discipline management.
国家对为电影事业发展做出显著贡献的单位和个人，给予奖励。
The state shall give rewards to entities and individuals that have made significant contributions to the development of the film industry.
电影制片
Film Production
设立电影制片单位，应当具备下列条件：
The establishment of a film production unit shall meet the following conditions:
(一)有电影制片单位的名称、章程；
(1) Having a name and articles of association for the film production unit;
(二)有符合国务院广播电影电视行政部门认定的主办单位及其主管机关；
(2) Having a sponsoring unit recognized by the administrative department of radio, film and television under the State Council and its competent authority;
(三)有确定的业务范围；
(3) Having a defined business scope;
(四)有适应业务范围需要的组织机构和专业人员；
(4) Having an organizational structure and professional personnel suitable for the business scope;
(五)有适应业务范围需要的资金、场所和设备；
(5) Having funds, premises and equipment suitable for the business scope;
(六)法律、行政法规规定的其他条件。
(6) Other conditions as prescribed by laws and administrative regulations.
审批设立电影制片单位，除依照前款所列条件外，还应当符合国务院广播电影电视行政部门制定的电影制片单位总量、布局和结构的规划。
In addition to the conditions listed in the preceding paragraph, the approval of the establishment of a film production unit shall also comply with the planning for the total number, layout and structure of film production units formulated by the administrative department of radio, film and television under the State Council.
申请设立电影制片单位，由所在地省、自治区、直辖市人民政府电影行政部门审核同意后，报国务院广播电影电视行政部门审批。
An application to establish a film production unit shall be examined and approved by the film administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the unit is located, and then submitted to the radio, film, and television administrative department of the State Council for approval.
申请书应当载明下列内容：
The application shall specify the following:
(一)电影制片单位的名称、地址和经济性质；
(1) The name, address, and economic nature of the film production unit;
(二)电影制片单位的主办单位的名称、地址、性质及其主管机关；
(2) The name, address, nature, and competent authority of the sponsoring unit of the film production unit;
(三)电影制片单位的法定代表人的姓名、住址、资格证明文件；
(3) The name, address, and qualification documents of the legal representative of the film production unit;
(四)电影制片单位的资金来源和数额。
(4) The source and amount of funds of the film production unit.
国务院广播电影电视行政部门应当自收到设立电影制片单位的申请书之日起90日内，作出批准或者不批准的决定，并通知申请人。批准的，由国务院广播电影电视行政部门发给《摄制电影许可证》，申请人持《摄制电影许可证》到国务院工商行政管理部门办理登记手续，依法领取营业执照；不批准的，应当说明理由。
The radio, film, and television administrative department of the State Council shall, within 90 days from the date of receiving the application for establishing a film production unit, make a decision to approve or disapprove and notify the applicant. If approved, the radio, film, and television administrative department of the State Council shall issue a Film Production License, and the applicant shall, with the Film Production License, go through registration procedures with the administrative department for industry and commerce of the State Council and obtain a business license according to law; if not approved, reasons shall be stated.
电影制片单位以其全部法人财产，依法享有民事权利，承担民事责任。
A film production unit shall, with all its legal person property, enjoy civil rights and bear civil liability according to law.
电影制片单位变更、终止，应当报国务院广播电影电视行政部门批准，并依法到原登记的工商行政管理部门办理变更登记或者注销登记。
Any change or termination of a film production unit shall be reported to the radio, film, and television administrative department of the State Council for approval, and the unit shall go through change registration or cancellation registration with the original registered administrative department for industry and commerce according to law.
电影制片单位可以从事下列活动：
A film production unit may engage in the following activities:
(一)摄制电影片；
(1) Produce films;
(二)按照国家有关规定制作本单位摄制的电影片的复制品；
(2) Produce copies of films produced by the unit in accordance with relevant state regulations;
(三)按照国家有关规定在全国范围发行本单位摄制并被许可公映的电影片及其复制品；
(3) Distribute nationwide, in accordance with relevant state regulations, films produced by the unit that have been approved for public screening, as well as copies thereof;
(四)按照国家有关规定出口本单位摄制并被许可公映的电影片及其复制品。
(4) Export, in accordance with relevant state regulations, films produced by the unit that have been approved for public screening, as well as copies thereof.
电影制片单位应当建立、健全管理制度，保证电影片的质量。
A film production unit shall establish and improve management systems to ensure the quality of films.
电影制片单位对其摄制的电影片，依法享有著作权。
A film production unit shall enjoy copyright in the films it produces in accordance with the law.
电影制片单位以外的单位独立从事电影摄制业务，须报经国务院广播电影电视行政部门批准，并持批准文件到工商行政管理部门办理相应的登记手续。
If a unit other than a film production unit independently engages in film production business, it must report to the radio, film, and television administrative department of the State Council for approval, and shall, with the approval document, go through the corresponding registration procedures with the administrative department for industry and commerce.
电影制片单位以外的单位经批准后摄制电影片，应当事先到国务院广播电影电视行政部门领取一次性《摄制电影片许可证(单片)》，并参照电影制片单位享有权利、承担义务。具体办法由国务院广播电影电视行政部门制定。
A unit other than a film production unit that, after approval, produces a film shall, in advance, obtain a one-time "Film Production License (Single Film)" from the radio, film, and television administrative department of the State Council, and shall enjoy rights and assume obligations by reference to a film production unit. Specific measures shall be formulated by the radio, film, and television administrative department of the State Council.
国家鼓励企业、事业单位和其他社会组织以及个人以资助、投资的形式参与摄制电影片。具体办法由国务院广播电影电视行政部门制定。
The State encourages enterprises, institutions, other social organizations, and individuals to participate in film production in the form of sponsorship or investment. Specific measures shall be formulated by the radio, film, and television administrative department of the State Council.
电影制片单位经国务院广播电影电视行政部门批准，可以与境外电影制片者合作摄制电影片；其他单位和个人不得与境外电影制片者合作摄制电影片。
A film production unit may, with the approval of the radio, film, and television administrative department of the State Council, co-produce films with overseas film producers; other units and individuals shall not co-produce films with overseas film producers.
电影制片单位和持有《摄制电影片许可证(单片)》的单位经国务院广播电影电视行政部门批准，可以到境外从事电影片摄制活动。
Film production units and units holding the 'Single-Film Production Permit' may, with the approval of the State Administration of Radio, Film and Television, engage in film production activities abroad.
境外组织或者个人不得在中华人民共和国境内独立从事电影片摄制活动。
Foreign organizations or individuals shall not independently engage in film production activities within the territory of the People's Republic of China.
中外合作摄制电影片，应当由中方合作者事先向国务院广播电影电视行政部门提出立项申请。国务院广播电影电视行政部门征求有关部门的意见后，经审查符合规定的，发给申请人一次性《中外合作摄制电影片许可证》。申请人取得《中外合作摄制电影片许可证》后，应当按照国务院广播电影电视行政部门的规定签订中外合作摄制电影片合同。
For Sino-foreign cooperative film production, the Chinese partner shall first submit a project application to the State Administration of Radio, Film and Television. After consulting with relevant departments and verifying compliance with regulations, the Administration shall issue a one-time 'Sino-Foreign Cooperative Film Production Permit' to the applicant. After obtaining the permit, the applicant shall sign a Sino-foreign cooperative film production contract in accordance with the regulations of the State Administration of Radio, Film and Television.
中外合作摄制电影片需要进口设备、器材、胶片、道具的，中方合作者应当持国务院广播电影电视行政部门的批准文件到海关办理进口或者临时进口手续。
If equipment, materials, film stock, or props need to be imported for Sino-foreign cooperative film production, the Chinese partner shall hold the approval document from the State Administration of Radio, Film and Television to go through customs procedures for import or temporary import.
境外电影制片者同中方合作者合作或者以其他形式在中华人民共和国境内摄制电影片，应当遵守中华人民共和国的法律、法规，尊重中华民族的风俗、习惯。
Foreign film producers cooperating with Chinese partners or engaging in film production within the territory of the People's Republic of China in other forms shall comply with the laws and regulations of the People's Republic of China and respect the customs and habits of the Chinese nation.
电影底片、样片的冲洗及后期制作，应当在中华人民共和国境内完成。有特殊技术要求确需在境外完成的，应当单项申请，报经国务院广播电影电视行政部门批准后，按照批准文件载明的要求执行。
The processing of film negatives and positives and post-production shall be completed within the territory of the People's Republic of China. If special technical requirements necessitate completion abroad, a separate application shall be submitted, and upon approval by the State Administration of Radio, Film and Television, the work shall be carried out in accordance with the requirements specified in the approval document.
电影洗印单位不得洗印加工未取得《摄制电影许可证》或者《摄制电影片许可证(单片)》的单位摄制的电影底片、样片，不得洗印加工未取得《电影片公映许可证》的电影片拷贝。
Film processing units shall not process film negatives or positives produced by units that have not obtained the 'Film Production Permit' or the 'Single-Film Production Permit', nor shall they process film copies that have not obtained the 'Film Public Release Permit'.
电影洗印单位接受委托洗印加工境外的电影底片、样片和电影片拷贝的，应当事先经国务院广播电影电视行政部门批准，并持批准文件依法向海关办理有关进口手续。洗印加工的电影底片、样片和电影片拷贝必须全部运输出境。
If a film processing unit accepts the processing of foreign film negatives, positives, and film copies, it shall first obtain approval from the State Administration of Radio, Film and Television and, with the approval document, go through relevant import procedures with customs in accordance with the law. All processed film negatives, positives, and film copies must be shipped out of the country.
电影审查
Film Censorship
国家实行电影审查制度。
The state implements a film censorship system.
未经国务院广播电影电视行政部门的电影审查机构(以下简称电影审查机构)审查通过的电影片，不得发行、放映、进口、出口。
No film that has not been examined and approved by the film censorship authority under the State Administration of Radio, Film and Television (hereinafter referred to as the film censorship authority) may be distributed, screened, imported, or exported.
供科学研究、教学参考的专题片进口和中国电影资料馆进口电影资料片，依照本条例第三十二条的规定办理。
The import of special films for scientific research and teaching reference, and the import of film archival materials by the China Film Archive, shall be handled in accordance with the provisions of Article 32 of these Regulations.
电影片禁止载有下列内容：
Films are prohibited from containing the following content:
(一)反对宪法确定的基本原则的；
(1) Opposing the basic principles established by the Constitution;
(二)危害国家统一、主权和领土完整的；
(2) Endangering national unity, sovereignty, and territorial integrity;
(三)泄露国家秘密、危害国家安全或者损害国家荣誉和利益的；
(3) Disclosing state secrets, endangering national security, or harming national honor and interests;
(四)煽动民族仇恨、民族歧视，破坏民族团结，或者侵害民族风俗、习惯的；
(4) Inciting ethnic hatred or discrimination, undermining ethnic unity, or infringing upon ethnic customs and habits;
(五)宣扬邪教、迷信的；
(5) Promoting cults or superstitions;
(六)扰乱社会秩序，破坏社会稳定的；
(6) Disrupting social order or undermining social stability;
(七)宣扬淫秽、赌博、暴力或者教唆犯罪的；
(7) Promoting obscenity, gambling, violence, or inciting crime;
(八)侮辱或者诽谤他人，侵害他人合法权益的；
(8) Insulting or slandering others, infringing upon the lawful rights and interests of others;
(九)危害社会公德或者民族优秀文化传统的；
(9) Endangering social morality or excellent national cultural traditions;
(十)有法律、行政法规和国家规定禁止的其他内容的。
(10) Containing other content prohibited by laws, administrative regulations, and state provisions.
电影技术质量应当符合国家标准。
The technical quality of films shall comply with national standards.
电影制片单位应当依照本条例第二十五条的规定，负责电影剧本投拍和电影片出厂前的审查。
A film production unit shall, in accordance with the provisions of Article 25 of these Regulations, be responsible for the review of film scripts before investment in production and of films before they leave the factory.
电影制片单位依照前款规定对其准备投拍的电影剧本审查后，应当报电影审查机构备案；电影审查机构可以对报备案的电影剧本进行审查，发现有本条例第二十五条禁止内容的，应当及时通知电影制片单位不得投拍。具体办法由国务院广播电影电视行政部门制定。
After a film production unit has reviewed a film script it intends to invest in production in accordance with the preceding paragraph, it shall report it to the film censorship authority for record; the film censorship authority may review the reported film script, and if it finds any content prohibited by Article 25 of these Regulations, it shall promptly notify the film production unit not to proceed with production. Specific measures shall be formulated by the radio, film, and television administrative department of the State Council.
电影制片单位应当在电影片摄制完成后，报请电影审查机构审查；电影进口经营单位应当在办理电影片临时进口手续后，报请电影审查机构审查。
A film production unit shall, after completing the production of a film, submit it to the film censorship authority for review; a film import business unit shall, after completing the procedures for temporary import of a film, submit it to the film censorship authority for review.
电影审查收费标准由国务院价格主管部门会同国务院广播电影电视行政部门规定。
The fee standards for film censorship shall be stipulated by the competent price department of the State Council jointly with the radio, film, and television administrative department of the State Council.
电影审查机构应当自收到报送审查的电影片之日起30日内，将审查决定书面通知送审单位。审查合格的，由国务院广播电影电视行政部门发给《电影片公映许可证》。
The film censorship authority shall, within 30 days from the date of receiving the film submitted for review, notify the submitting unit in writing of the review decision. If the review is passed, the radio, film, and television administrative department of the State Council shall issue the "Film Public Screening Permit".
电影制片单位或者电影进口经营单位应当将《电影片公映许可证》证号印制在该电影片拷贝第一本片头处。
The film production unit or film import business unit shall print the permit number of the "Film Public Screening Permit" at the beginning of the first reel of the film copy.
审查不合格，经修改报送重审的，审查期限依照本条第一款的规定重新计算。
If a film fails censorship and is resubmitted after modification, the censorship period shall be recalculated in accordance with the first paragraph of this Article.
电影制片单位和电影进口经营单位对电影片审查决定不服的，可以自收到审查决定之日起30日内向国务院广播电影电视行政部门的电影复审机构申请复审；复审合格的，由国务院广播电影电视行政部门发给《电影片公映许可证》。
If a film production unit or film import business entity disagrees with a film censorship decision, it may apply for a review to the film review body of the State Council's administrative department of radio, film and television within 30 days from receipt of the censorship decision. If the review is passed, the State Council's administrative department of radio, film and television shall issue the Film Public Release Permit.
电影进口出口
Film Import and Export
电影进口业务由国务院广播电影电视行政部门指定电影进口经营单位经营；未经指定，任何单位或者个人不得经营电影进口业务。
Film import business shall be operated by film import business entities designated by the State Council's administrative department of radio, film and television; without designation, no unit or individual may operate film import business.
进口供公映的电影片，进口前应当报送电影审查机构审查。
Films imported for public release shall be submitted to the film censorship authority for censorship before import.
报送电影审查机构审查的电影片，由指定的电影进口经营单位持国务院广播电影电视行政部门的临时进口批准文件到海关办理电影片临时进口手续；临时进口的电影片经电影审查机构审查合格并发给《电影片公映许可证》和进口批准文件后，由电影进口经营单位持进口批准文件到海关办理进口手续。
For films submitted to the film censorship authority for censorship, the designated film import business entity shall, holding the temporary import approval document issued by the State Council's administrative department of radio, film and television, go through the temporary import procedures for the film with the customs; after the temporarily imported film passes the censorship by the film censorship authority and the Film Public Release Permit and import approval document are issued, the film import business entity shall, holding the import approval document, go through the import procedures with the customs.
进口供科学研究、教学参考的专题片，进口单位应当报经国务院有关行政主管部门审查批准，持批准文件到海关办理进口手续，并于进口之日起30日内向国务院广播电影电视行政部门备案。但是，不得以科学研究、教学的名义进口故事片。
For special films imported for scientific research or teaching reference, the importing entity shall report to the relevant administrative department of the State Council for examination and approval, and go through the import procedures with the customs holding the approval document, and file a record with the State Council's administrative department of radio, film and television within 30 days from the date of import. However, feature films shall not be imported under the pretext of scientific research or teaching.
中国电影资料馆进口电影资料片，可以直接到海关办理进口手续。中国电影资料馆应当将其进口的电影资料片按季度向国务院广播电影电视行政部门备案。
The China Film Archive may directly go through the import procedures with the customs for importing film archival materials. The China Film Archive shall file a record with the State Council's administrative department of radio, film and television on a quarterly basis for the imported film archival materials.
除本条规定外，任何单位或者个人不得进口未经国务院广播电影电视行政部门审查合格的电影片。
Except as provided in this Article, no unit or individual may import films that have not passed the censorship of the State Council's administrative department of radio, film and television.
电影进口经营单位应当在取得电影作品著作权人使用许可后，在许可的范围内使用电影作品；未取得使用许可的，任何单位和个人不得使用进口电影作品。
A film import business entity shall, after obtaining a license to use the copyright of the film work, use the film work within the scope of the license; without obtaining a license to use, no unit or individual may use imported film works.
电影制片单位出口本单位制作的电影片的，应当持《电影片公映许可证》到海关办理电影片出口手续。
A film production unit that exports a film produced by itself shall hold the Film Public Screening License to go through the film export procedures at the customs.
中外合作摄制电影片出口的，中方合作者应当持《电影片公映许可证》到海关办理出口手续。中外合作摄制电影片素材出口的，中方合作者应当持国务院广播电影电视行政部门的批准文件到海关办理出口手续。
For the export of a Chinese-foreign co-produced film, the Chinese co-producer shall hold the Film Public Screening License to go through the export procedures at the customs. For the export of materials of a Chinese-foreign co-produced film, the Chinese co-producer shall hold the approval document of the State Administration of Radio, Film and Television to go through the export procedures at the customs.
中方协助摄制电影片或者电影片素材出境的，中方协助者应当持国务院广播电影电视行政部门的批准文件到海关办理出境手续。
For the exit of a film or film materials assisted by a Chinese party, the Chinese assistant shall hold the approval document of the State Administration of Radio, Film and Television to go through the exit procedures at the customs.
举办中外电影展、国际电影节，提供电影片参加境外电影展、电影节等，应当报国务院广播电影电视行政部门批准。
The holding of Chinese-foreign film exhibitions or international film festivals, or the provision of films to participate in overseas film exhibitions or film festivals, shall be reported to the State Administration of Radio, Film and Television for approval.
参加前款规定的电影展、电影节的电影片，须报国务院广播电影电视行政部门审查批准。参加境外电影展、电影节的电影片经批准后，参展者应当持国务院广播电影电视行政部门的批准文件到海关办理电影片临时出口手续。参加在中国境内举办的中外电影展、国际电影节的境外电影片经批准后，举办者应当持国务院广播电影电视行政部门的批准文件到海关办理临时进口手续。
Films participating in the film exhibitions or film festivals specified in the preceding paragraph must be submitted to the State Administration of Radio, Film and Television for examination and approval. After a film participating in an overseas film exhibition or film festival is approved, the participant shall hold the approval document of the State Administration of Radio, Film and Television to go through the temporary export procedures at the customs. After an overseas film participating in a Chinese-foreign film exhibition or international film festival held within China is approved, the organizer shall hold the approval document of the State Administration of Radio, Film and Television to go through the temporary import procedures at the customs.
电影发行和放映
Film Distribution and Screening
设立电影发行单位、电影放映单位，应当具备下列条件：
The establishment of a film distribution unit or a film screening unit shall meet the following conditions:
(一)有电影发行单位、电影放映单位的名称、章程；
(1) Having the name and articles of association of the film distribution unit or film screening unit;
(二)有确定的业务范围；
(2) Having a definite business scope;
(三)有适应业务范围需要的组织机构和专业人员；
(3) Having an organizational structure and professional personnel suitable for the business scope;
(四)有适应业务范围需要的资金、场所和设备；
(4) Have funds, premises, and equipment suitable for the scope of business;
(五)法律、行政法规规定的其他条件。
(5) Other conditions stipulated by laws and administrative regulations.
设立电影发行单位，应当向所在地省、自治区、直辖市人民政府电影行政部门提出申请；设立跨省、自治区、直辖市的电影发行单位，应当向国务院广播电影电视行政部门提出申请。所在地省、自治区、直辖市人民政府电影行政部门或者国务院广播电影电视行政部门应当自收到申请书之日起60日内作出批准或者不批准的决定，并通知申请人。批准的，发给《电影发行经营许可证》，申请人应当持《电影发行经营许可证》到工商行政管理部门登记，依法领取营业执照；不批准的，应当说明理由。
To establish a film distribution unit, an application shall be submitted to the film administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the unit is located; to establish a film distribution unit that operates across provinces, autonomous regions, or municipalities directly under the Central Government, an application shall be submitted to the radio, film, and television administrative department of the State Council. The film administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government or the radio, film, and television administrative department of the State Council shall make a decision to approve or disapprove within 60 days from the date of receiving the application, and notify the applicant. If approved, a Film Distribution Operation License shall be issued, and the applicant shall register with the administrative department for industry and commerce holding the Film Distribution Operation License and obtain a business license according to law; if not approved, reasons shall be stated.
设立电影放映单位，应当向所在地县或者设区的市人民政府电影行政部门提出申请。所在地县或者设区的市人民政府电影行政部门应当自收到申请书之日起60日内作出批准或者不批准的决定，并通知申请人。批准的，发给《电影放映经营许可证》，申请人持《电影放映经营许可证》到所在地工商行政管理部门登记，依法领取营业执照；不批准的，应当说明理由。
To establish a film screening unit, an application shall be submitted to the film administrative department of the people's government of the county or city divided into districts where the unit is located. The film administrative department of the people's government of the county or city divided into districts shall make a decision to approve or disapprove within 60 days from the date of receiving the application, and notify the applicant. If approved, a Film Screening Operation License shall be issued, and the applicant shall register with the administrative department for industry and commerce at the location holding the Film Screening Operation License and obtain a business license according to law; if not approved, reasons shall be stated.
电影发行单位、电影放映单位变更业务范围，或者兼并其他电影发行单位、电影放映单位，或者因合并、分立而设立新的电影发行单位、电影放映单位的，应当依照本条例第三十七条或者第三十八条的规定办理审批手续，并到工商行政管理部门办理相应的登记手续。
If a film distribution unit or film screening unit changes its business scope, or merges with other film distribution units or film screening units, or establishes a new film distribution unit or film screening unit through merger or division, it shall go through the approval procedures in accordance with Article 37 or Article 38 of these Regulations, and go through the corresponding registration procedures with the administrative department for industry and commerce.
电影发行单位、电影放映单位变更名称、地址、法定代表人或者主要负责人，或者终止电影发行、放映经营活动的，应当到原登记的工商行政管理部门办理变更登记或者注销登记，并向原审批的电影行政部门备案。
If a film distribution unit or film screening unit changes its name, address, legal representative or principal responsible person, or terminates its film distribution or screening business activities, it shall go through change registration or cancellation registration with the original registered administrative department for industry and commerce, and file with the original approving film administrative department.
申请从事农村16毫米电影片发行、放映业务的单位或者个人，可以直接到所在地工商行政管理部门办理登记手续，并向所在地县级人民政府电影行政部门备案；备案后，可以在全国农村从事16毫米电影片发行、放映业务。
Units or individuals applying to engage in the distribution or screening of 16mm films in rural areas may directly go through registration procedures with the local administrative department for industry and commerce, and file with the film administrative department of the people's government at the county level where they are located; after filing, they may engage in the distribution or screening of 16mm films in rural areas nationwide.
国家允许企业、事业单位和其他社会组织以及个人投资建设、改造电影院。
The State allows enterprises, institutions, other social organizations, and individuals to invest in the construction and renovation of film theaters.
国家允许以中外合资或者中外合作的方式建设、改造电影院。具体办法由国务院广播电影电视行政部门会同国务院文化行政部门、国务院对外经济贸易主管部门按照有关规定制定。
The State allows the construction and renovation of film theaters through Sino-foreign equity joint ventures or Sino-foreign contractual joint ventures. Specific measures shall be formulated by the radio, film, and television administrative department of the State Council jointly with the cultural administrative department of the State Council and the competent department of foreign trade and economic cooperation of the State Council in accordance with relevant regulations.
电影片依法取得国务院广播电影电视行政部门发给的《电影片公映许可证》后，方可发行、放映。
Only after a film has lawfully obtained a Film Public Release Permit issued by the radio, film, and television administrative department of the State Council may it be distributed and screened.
已经取得《电影片公映许可证》的电影片，国务院广播电影电视行政部门在特殊情况下可以作出停止发行、放映或者经修改后方可发行、放映的决定；对决定经修改后方可发行、放映的电影片，著作权人拒绝修改的，由国务院广播电影电视行政部门决定停止发行、放映。
For a film that has obtained the Film Public Screening Permit, the administrative department of radio, film and television under the State Council may, under special circumstances, make a decision to stop its distribution and screening, or to allow distribution and screening only after modification; if the copyright owner refuses to modify a film that is subject to the decision that it may be distributed and screened only after modification, the administrative department of radio, film and television under the State Council shall decide to stop its distribution and screening.
国务院广播电影电视行政部门作出的停止发行、放映的决定，电影发行单位、电影放映单位应当执行。
Film distribution units and film screening units shall implement the decision made by the administrative department of radio, film and television under the State Council to stop distribution and screening.
利用电影片制作音像制品的，应当遵守国家有关音像制品管理的规定。
The production of audio-visual products using films shall comply with the state regulations on the administration of audio-visual products.
任何单位和个人不得利用电影资料片从事或者变相从事经营性的发行、放映活动。
No unit or individual may use film archival materials to engage in or covertly engage in for-profit distribution or screening activities.
放映电影片，应当符合国家规定的国产电影片与进口电影片放映的时间比例。
The screening of films shall comply with the time ratio stipulated by the state for the screening of domestic films and imported films.
放映单位年放映国产电影片的时间不得低于年放映电影片时间总和的三分之二。
The annual screening time of domestic films by a screening unit shall not be less than two-thirds of the total annual film screening time.
电影放映单位应当维护电影院的公共秩序和环境卫生，保证观众的安全与健康。
Film screening units shall maintain public order and environmental hygiene in cinemas and ensure the safety and health of the audience.
电影事业的保障
Guarantee of the Film Industry
国家建立和完善适应社会主义市场经济体制的电影管理体制，发展电影事业。
The state shall establish and improve a film management system that adapts to the socialist market economy system and develop the film industry.
国家保障电影创作自由，重视和培养电影专业人才，重视和加强电影理论研究，繁荣电影创作，提高电影质量。
The state shall guarantee freedom of film creation, value and cultivate film professionals, value and strengthen film theoretical research, prosper film creation, and improve film quality.
国家建立电影事业发展专项资金，并采取其他优惠措施，支持电影事业的发展。
The state establishes a special fund for the development of the film industry and adopts other preferential measures to support the development of the film industry.
电影事业发展专项资金缴纳单位应当按照国家有关规定履行缴纳义务。
Entities that contribute to the special fund for the development of the film industry shall fulfill their contribution obligations in accordance with relevant state regulations.
电影事业发展专项资金扶持、资助下列项目：
The special fund for the development of the film industry supports and subsidizes the following projects:
(一)国家倡导并确认的重点电影片的摄制和优秀电影剧本的征集；
(1) Production of key films advocated and confirmed by the state, and solicitation of outstanding film scripts;
(二)重点制片基地的技术改造；
(2) Technical renovation of key production bases;
(三)电影院的改造和放映设施的技术改造；
(3) Renovation of cinemas and technical renovation of projection facilities;
(四)少数民族地区、边远贫困地区和农村地区的电影事业的发展；
(4) Development of the film industry in ethnic minority areas, remote and impoverished areas, and rural areas;
(五)需要资助的其他项目。
(5) Other projects requiring subsidies.
国家鼓励、扶持科学教育片、纪录片、美术片及儿童电影片的制片、发行和放映。
The state encourages and supports the production, distribution, and screening of scientific and educational films, documentaries, art films, and children's films.
国家对少数民族地区、边远贫困地区和农村地区发行、放映电影实行优惠政策。
The state implements preferential policies for the distribution and screening of films in ethnic minority areas, remote and impoverished areas, and rural areas.
国家对从事农村16毫米电影片发行、放映业务的单位和个人予以扶持。具体办法由国务院广播电影电视行政部门、国务院文化行政部门会同国务院财政部门规定。
The State supports entities and individuals engaged in the distribution and exhibition of rural 16mm films. Specific measures shall be prescribed by the radio, film and television administrative department of the State Council, the cultural administrative department of the State Council, together with the financial department of the State Council.
县级以上地方人民政府制定的本行政区域建设规划，应当包括电影院和放映设施的建设规划。
The construction plans formulated by local people's governments at or above the county level for their respective administrative regions shall include construction plans for cinemas and exhibition facilities.
改建、拆除电影院和放映设施，应当报经所在地县级以上地方人民政府电影行政部门审查批准，县级以上地方人民政府电影行政部门应当依据国家有关规定作出批准或者不批准的决定。
Renovation or demolition of cinemas and exhibition facilities shall be submitted for examination and approval to the local film administrative department of the people's government at or above the county level. The film administrative department of the people's government at or above the county level shall make a decision to approve or disapprove in accordance with relevant state regulations.
县级以上地方人民政府电影行政部门和其他有关行政部门，对干扰、阻止和破坏电影片的制片、发行、放映的行为，应当及时采取措施予以制止，并依法查处。
The film administrative department of the local people's government at or above the county level and other relevant administrative departments shall take timely measures to stop and investigate acts that interfere with, obstruct, or destroy the production, distribution, and exhibition of films in accordance with the law.
大众传播媒体不得宣扬非法电影。
Mass media shall not promote illegal films.
罚则
Penalties
国务院广播电影电视行政部门和县级以上地方人民政府电影行政部门或者其他有关部门及其工作人员，利用职务上的便利收受他人财物或者其他好处，批准不符合法定设立条件的电影片的制片、发行和放映单位，或者不履行监督职责，或者发现违法行为不予查处，造成严重后果的，对负有责任的主管人员和其他直接责任人员依照刑法关于受贿罪、滥用职权罪、玩忽职守罪或者其他罪的规定，依法追究刑事责任；尚不够刑事处罚的，给予降级或者撤职的行政处分。
If the radio, film and television administrative department of the State Council, the film administrative department of the local people's government at or above the county level, or other relevant departments and their staff, take advantage of their positions to accept property or other benefits from others, approve film production, distribution, and exhibition units that do not meet the statutory establishment conditions, fail to perform supervision duties, or fail to investigate illegal acts found, causing serious consequences, the responsible persons in charge and other directly responsible persons shall be investigated for criminal liability in accordance with the provisions of the Criminal Law on the crimes of bribery, abuse of power, dereliction of duty, or other crimes; if the act is not serious enough for criminal punishment, administrative sanctions of demotion or removal from office shall be imposed.
违反本条例规定，擅自设立电影片的制片、发行、放映单位，或者擅自从事电影制片、进口、发行、放映活动的，由工商行政管理部门予以取缔；依照刑法关于非法经营罪的规定，依法追究刑事责任；尚不够刑事处罚的，没收违法经营的电影片和违法所得以及进行违法经营活动的专用工具、设备；违法所得5万元以上的，并处违法所得5倍以上10倍以下的罚款；没有违法所得或者违法所得不足5万元的，并处20万元以上50万元以下的罚款。
Anyone who, in violation of these Regulations, establishes a film production, distribution, or exhibition unit without authorization, or engages in film production, import, distribution, or exhibition activities without authorization, shall be banned by the administrative department for industry and commerce; criminal liability shall be investigated in accordance with the provisions of the Criminal Law on the crime of illegal business operation; if the act is not serious enough for criminal punishment, the illegally operated films and illegal gains, as well as the special tools and equipment used for the illegal activities, shall be confiscated; if the illegal gains are 50,000 yuan or more, a fine of not less than 5 times but not more than 10 times the illegal gains shall also be imposed; if there are no illegal gains or the illegal gains are less than 50,000 yuan, a fine of not less than 200,000 yuan but not more than 500,000 yuan shall be imposed.
摄制含有本条例第二十五条禁止内容的电影片，或者洗印加工、进口、发行、放映明知或者应知含有本条例第二十五条禁止内容的电影片的，依照刑法有关规定，依法追究刑事责任；尚不够刑事处罚的，由电影行政部门责令停业整顿，没收违法经营的电影片和违法所得；违法所得5万元以上的，并处违法所得5倍以上10倍以下的罚款；没有违法所得或者违法所得不足5万元的，并处20万元以上50万元以下的罚款；情节严重的，并由原发证机关吊销许可证。
Anyone who produces a film containing content prohibited by Article 25 of these Regulations, or develops, prints, imports, distributes, or exhibits a film that they know or should know contains content prohibited by Article 25 of these Regulations, shall be investigated for criminal liability in accordance with the relevant provisions of the Criminal Law; if the act is not serious enough for criminal punishment, the film administrative department shall order a suspension of business for rectification, confiscate the illegally operated films and illegal gains; if the illegal gains are 50,000 yuan or more, a fine of not less than 5 times but not more than 10 times the illegal gains shall also be imposed; if there are no illegal gains or the illegal gains are less than 50,000 yuan, a fine of not less than 200,000 yuan but not more than 500,000 yuan shall be imposed; if the circumstances are serious, the original license-issuing authority shall revoke the license.
走私电影片，依照刑法关于走私罪的规定，依法追究刑事责任；尚不够刑事处罚的，由海关依法给予行政处罚。
Anyone who smuggles films shall be investigated for criminal liability in accordance with the provisions of the Criminal Law on the crime of smuggling; if the act is not serious enough for criminal punishment, the customs shall impose administrative penalties in accordance with the law.
出口、发行、放映未取得《电影片公映许可证》的电影片的，由电影行政部门责令停止违法行为，没收违法经营的电影片和违法所得；违法所得5万元以上的，并处违法所得10倍以上15倍以下的罚款；没有违法所得或者违法所得不足5万元的，并处20万元以上50万元以下的罚款；情节严重的，并责令停业整顿或者由原发证机关吊销许可证。
Whoever exports, distributes, or screens a film without obtaining the Film Public Screening Permit shall be ordered by the film administrative department to cease the illegal act, and the illegally operated films and illegal gains shall be confiscated; if the illegal gains are 50,000 yuan or more, a fine of not less than 10 times but not more than 15 times the illegal gains shall also be imposed; if there are no illegal gains or the illegal gains are less than 50,000 yuan, a fine of not less than 200,000 yuan but not more than 500,000 yuan shall also be imposed; if the circumstances are serious, the violator shall also be ordered to suspend business for rectification or the license shall be revoked by the original issuing authority.
有下列行为之一的，由电影行政部门责令停止违法行为，没收违法经营的电影片和违法所得；违法所得5万元以上的，并处违法所得5倍以上10倍以下的罚款；没有违法所得或者违法所得不足5万元的，并处10万元以上30万元以下的罚款；情节严重的，并责令停业整顿或者由原发证机关吊销许可证：
Whoever commits any of the following acts shall be ordered by the film administrative department to cease the illegal act, and the illegally operated films and illegal gains shall be confiscated; if the illegal gains are 50,000 yuan or more, a fine of not less than 5 times but not more than 10 times the illegal gains shall also be imposed; if there are no illegal gains or the illegal gains are less than 50,000 yuan, a fine of not less than 100,000 yuan but not more than 300,000 yuan shall also be imposed; if the circumstances are serious, the violator shall also be ordered to suspend business for rectification or the license shall be revoked by the original issuing authority:
(一)未经批准，擅自与境外组织或者个人合作摄制电影，或者擅自到境外从事电影摄制活动的；
(1) Without approval, collaborating with foreign organizations or individuals to produce a film, or engaging in film production activities abroad without authorization;
(二)擅自到境外进行电影底片、样片的冲洗或者后期制作，或者未按照批准文件载明的要求执行的；
(2) Without authorization, conducting film negative or positive processing or post-production abroad, or failing to comply with the requirements specified in the approval document;
(三)洗印加工未取得《摄制电影许可证》、《摄制电影片许可证(单片)》的单位摄制的电影底片、样片，或者洗印加工未取得《电影片公映许可证》的电影片拷贝的；
(3) Developing or printing film negatives or positives produced by units that have not obtained the Film Production License or the Single Film Production License, or developing or printing copies of films that have not obtained the Film Public Screening Permit;
(四)未经批准，接受委托洗印加工境外电影底片、样片或者电影片拷贝，或者未将洗印加工的境外电影底片、样片或者电影片拷贝全部运输出境的；
(4) Without approval, accepting commissions to develop or print foreign film negatives, positives, or copies, or failing to transport all developed or printed foreign film negatives, positives, or copies out of the country;
(五)利用电影资料片从事或者变相从事经营性的发行、放映活动的；
(5) Using film reference materials to engage in or covertly engage in commercial distribution or screening activities;
(六)未按照规定的时间比例放映电影片，或者不执行国务院广播电影电视行政部门停止发行、放映决定的。
(6) Failing to screen films in accordance with the prescribed time ratio, or failing to comply with the decision of the State Administration of Radio, Film and Television to stop distribution or screening.
境外组织、个人在中华人民共和国境内独立从事电影片摄制活动的，由国务院广播电影电视行政部门责令停止违法活动，没收违法摄制的电影片和进行违法活动的专用工具、设备，并处30万元以上50万元以下的罚款。
If a foreign organization or individual independently engages in film production activities within the territory of the People's Republic of China, the State Administration of Radio, Film and Television shall order the cessation of the illegal activities, confiscate the illegally produced films and the special tools and equipment used for the illegal activities, and impose a fine of not less than 300,000 yuan but not more than 500,000 yuan.
未经批准，擅自举办中外电影展、国际电影节，或者擅自提供电影片参加境外电影展、电影节的，由国务院广播电影电视行政部门责令停止违法活动，没收违法参展的电影片和违法所得；违法所得2万元以上的，并处违法所得5倍以上10倍以下的罚款；没有违法所得或者违法所得不足2万元的，并处2万元以上10万元以下的罚款。
If, without approval, a Chinese-foreign film exhibition or international film festival is held, or films are provided for participation in foreign film exhibitions or festivals without authorization, the State Administration of Radio, Film and Television shall order the cessation of the illegal activities, confiscate the illegally exhibited films and illegal gains; if the illegal gains are 20,000 yuan or more, a fine of not less than 5 times but not more than 10 times the illegal gains shall also be imposed; if there are no illegal gains or the illegal gains are less than 20,000 yuan, a fine of not less than 20,000 yuan but not more than 100,000 yuan shall also be imposed.
未经批准，擅自改建、拆除电影院或者放映设施的，由县级以上地方人民政府电影行政部门责令限期恢复电影院或者放映设施的原状，给予警告，对负有责任的主管人员和其他直接责任人员依法给予纪律处分。
Where a person, without approval, rebuilds or demolishes a cinema or projection facility, the film administrative department of the local people's government at or above the county level shall order restoration of the cinema or projection facility to its original condition within a specified period, give a warning, and impose disciplinary sanctions according to law on the directly responsible person in charge and other directly responsible persons.
单位违反本条例，被处以吊销许可证行政处罚的，应当按照国家有关规定到工商行政管理部门办理变更登记或者注销登记；逾期未办理的，由工商行政管理部门吊销营业执照。
Where a unit violates these Regulations and is subject to the administrative penalty of revocation of a permit, it shall, in accordance with the relevant provisions of the state, undergo change registration or cancellation registration with the administrative department for industry and commerce; if it fails to do so within the prescribed time limit, the administrative department for industry and commerce shall revoke its business license.
单位违反本条例，被处以吊销许可证行政处罚的，其法定代表人或者主要负责人自吊销许可证之日起5年内不得担任电影片的制片、进口、出口、发行和放映单位的法定代表人或者主要负责人。
Where a unit violates these Regulations and is subject to the administrative penalty of revocation of a permit, its legal representative or principal responsible person shall not serve as the legal representative or principal responsible person of a unit engaged in film production, import, export, distribution, or exhibition within five years from the date of revocation of the permit.
个人违反本条例，未经批准擅自从事电影片的制片、进口、发行业务，或者擅自举办中外电影展、国际电影节或者擅自提供电影片参加境外电影展、电影节的，5年内不得从事相关电影业务。
Where an individual violates these Regulations and, without approval, engages in film production, import, or distribution, or without approval holds a Chinese-foreign film exhibition, international film festival, or provides a film for participation in an overseas film exhibition or film festival, the individual shall not engage in related film business within five years.
未按照国家有关规定履行电影事业发展专项资金缴纳义务的，由省级以上人民政府电影行政部门责令限期补交，并自欠缴之日起按日加收所欠缴金额万分之五的滞纳金。
Where a person fails to fulfill the obligation to pay the film development fund in accordance with the relevant provisions of the state, the film administrative department of the people's government at or above the provincial level shall order payment of the arrears within a specified period, and a late fee of 0.05% of the amount in arrears per day shall be imposed from the date the payment became due.
依照本条例的规定实施罚款的行政处罚，应当依照有关法律、行政法规的规定，实行罚款决定与罚款收缴分离；收缴的罚款应当全部上缴国库。
Where an administrative penalty of a fine is imposed in accordance with these Regulations, the decision on the fine and the collection of the fine shall be separated in accordance with the relevant laws and administrative regulations; all fines collected shall be turned over to the state treasury.
附则
Supplementary Provisions
国家实行《摄制电影许可证》和《电影发行经营许可证》、《电影放映经营许可证》年检制度。年检办法由国务院广播电影电视行政部门制定。
The state implements an annual inspection system for the Film Production Permit, the Film Distribution Operation Permit, and the Film Projection Operation Permit. The measures for annual inspection shall be formulated by the radio, film, and television administrative department of the State Council.
本条例自2002年2月1日起施行。1996年6月19日国务院发布的《电影管理条例》同时废止。
These Regulations shall come into force as of February 1, 2002. The Regulations on the Administration of Films promulgated by the State Council on June 19, 1996 shall be repealed simultaneously.
