总则
General Provisions
为了加强对娱乐场所的管理，保障娱乐场所的健康发展，制定本条例。
These Regulations are formulated to strengthen the administration of entertainment venues and ensure the healthy development of entertainment venues.
本条例所称娱乐场所，是指以营利为目的，并向公众开放、消费者自娱自乐的歌舞、游艺等场所。
For the purposes of these Regulations, 'entertainment venues' refer to places such as song and dance venues and amusement venues that operate for profit, are open to the public, and where consumers entertain themselves.
县级以上人民政府文化主管部门负责对娱乐场所日常经营活动的监督管理；县级以上公安部门负责对娱乐场所消防、治安状况的监督管理。
The cultural administrative departments of people's governments at or above the county level shall be responsible for the supervision and administration of the daily business activities of entertainment venues; the public security departments at or above the county level shall be responsible for the supervision and administration of fire safety and public security conditions of entertainment venues.
国家机关及其工作人员不得开办娱乐场所，不得参与或者变相参与娱乐场所的经营活动。
State organs and their staff members shall not establish entertainment venues, nor participate or covertly participate in the business activities of entertainment venues.
与文化主管部门、公安部门的工作人员有夫妻关系、直系血亲关系、三代以内旁系血亲关系以及近姻亲关系的亲属，不得开办娱乐场所，不得参与或者变相参与娱乐场所的经营活动。
Relatives who have a spousal relationship, direct blood relationship, collateral blood relationship within three generations, or close in-law relationship with staff members of the cultural administrative departments or public security departments shall not establish entertainment venues, nor participate or covertly participate in the business activities of entertainment venues.
设立
Establishment
有下列情形之一的人员，不得开办娱乐场所或者在娱乐场所内从业：
Persons with any of the following circumstances shall not establish entertainment venues or work in entertainment venues:
(一)曾犯有组织、强迫、引诱、容留、介绍卖淫罪，制作、贩卖、传播淫秽物品罪，走私、贩卖、运输、制造毒品罪，强奸罪，强制猥亵、侮辱妇女罪，赌博罪，洗钱罪，组织、领导、参加黑社会性质组织罪的；
(1) Those who have been convicted of organizing, forcing, luring, harboring, or introducing prostitution; producing, selling, or disseminating obscene materials; smuggling, selling, transporting, or manufacturing drugs; rape; forced indecency or insulting women; gambling; money laundering; organizing, leading, or participating in organizations of a gangland nature;
(二)因犯罪曾被剥夺政治权利的；
(2) Those who have been deprived of political rights due to a crime;
(三)因吸食、注射毒品曾被强制戒毒的；
(3) Those who have been subjected to compulsory drug rehabilitation due to drug use or injection;
(四)因卖淫、嫖娼曾被处以行政拘留的。
(4) Those who have been subjected to administrative detention for prostitution or patronizing prostitution.
外国投资者可以依法在中国境内设立娱乐场所。
Foreign investors may establish entertainment venues within China in accordance with the law.
娱乐场所不得设在下列地点：
Entertainment venues shall not be located in the following places:
(一)居民楼、博物馆、图书馆和被核定为文物保护单位的建筑物内；
(1) Within residential buildings, museums, libraries, and buildings designated as cultural relics protection units;
(二)居民住宅区和学校、医院、机关周围；
(2) Surrounding residential areas, schools, hospitals, and government agencies;
(三)车站、机场等人群密集的场所；
(3) Crowded places such as bus stations and airports;
(四)建筑物地下一层以下；
(4) Below the first underground floor of a building;
(五)与危险化学品仓库毗连的区域。
(5) Areas adjacent to hazardous chemical warehouses.
娱乐场所的边界噪声，应当符合国家规定的环境噪声标准。
The boundary noise of entertainment venues shall comply with the national environmental noise standards.
娱乐场所的使用面积，不得低于国务院文化主管部门规定的最低标准；设立含有电子游戏机的游艺娱乐场所，应当符合国务院文化主管部门关于总量和布局的要求。
The usable area of an entertainment venue shall not be less than the minimum standard prescribed by the competent cultural department of the State Council; the establishment of amusement entertainment venues containing electronic game machines shall meet the requirements of the competent cultural department of the State Council regarding total quantity and layout.
娱乐场所申请从事娱乐场所经营活动，应当向所在地县级人民政府文化主管部门提出申请；外商投资的娱乐场所申请从事娱乐场所经营活动，应当向所在地省、自治区、直辖市人民政府文化主管部门提出申请。
An entertainment venue applying to engage in entertainment business activities shall submit an application to the competent cultural department of the local people's government at the county level; a foreign-invested entertainment venue applying to engage in entertainment business activities shall submit an application to the competent cultural department of the people's government of the province, autonomous region, or municipality directly under the Central Government.
娱乐场所申请从事娱乐场所经营活动，应当提交投资人员、拟任的法定代表人和其他负责人没有本条例第五条规定情形的书面声明。申请人应当对书面声明内容的真实性负责。
An entertainment venue applying to engage in entertainment business activities shall submit a written declaration that the investors, the proposed legal representative, and other responsible persons do not have any of the circumstances specified in Article 5 of these Regulations. The applicant shall be responsible for the truthfulness of the content of the written declaration.
受理申请的文化主管部门应当就书面声明向公安部门或者其他有关单位核查，公安部门或者其他有关单位应当予以配合；经核查属实的，文化主管部门应当依据本条例第七条、第八条的规定进行实地检查，作出决定。予以批准的，颁发娱乐经营许可证，并根据国务院文化主管部门的规定核定娱乐场所容纳的消费者数量；不予批准的，应当书面通知申请人并说明理由。
The cultural department accepting the application shall verify the written declaration with the public security department or other relevant units, and the public security department or other relevant units shall cooperate; if the verification is true, the cultural department shall conduct an on-site inspection in accordance with Articles 7 and 8 of these Regulations and make a decision. If approved, it shall issue an entertainment business license and determine the number of consumers that the entertainment venue can accommodate according to the provisions of the competent cultural department of the State Council; if not approved, it shall notify the applicant in writing and state the reasons.
有关法律、行政法规规定需要办理消防、卫生、环境保护等审批手续的，从其规定。
Where relevant laws and administrative regulations require the completion of fire protection, health, environmental protection, and other approval procedures, those provisions shall prevail.
文化主管部门审批娱乐场所应当举行听证。有关听证的程序，依照《中华人民共和国行政许可法》的规定执行。
The cultural department shall hold a hearing when approving an entertainment venue. The procedures for the hearing shall be implemented in accordance with the Administrative License Law of the People's Republic of China.
娱乐场所依法取得营业执照和相关批准文件、许可证后，应当在15日内向所在地县级公安部门备案。
After lawfully obtaining a business license and relevant approval documents and permits, an entertainment venue shall file with the local public security department at the county level within 15 days.
娱乐场所改建、扩建营业场所或者变更场地、主要设施设备、投资人员，或者变更娱乐经营许可证载明的事项的，应当向原发证机关申请重新核发娱乐经营许可证，并向公安部门备案；需要办理变更登记的，应当依法向工商行政管理部门办理变更登记。
If an entertainment venue rebuilds or expands its business premises, or changes the venue, main facilities and equipment, investors, or matters recorded in the entertainment business license, it shall apply to the original issuing authority for re-issuance of the entertainment business license and file with the public security department; if change registration is required, it shall register the change with the administrative department for industry and commerce in accordance with the law.
经营
Operation
国家倡导弘扬民族优秀文化，禁止娱乐场所内的娱乐活动含有下列内容：
The State advocates promoting excellent national culture and prohibits entertainment activities in entertainment venues from containing the following content:
(一)违反宪法确定的基本原则的；
(1) Violating the basic principles established by the Constitution;
(二)危害国家统一、主权或者领土完整的；
(2) Endangering national unity, sovereignty, or territorial integrity;
(三)危害国家安全，或者损害国家荣誉、利益的；
(3) Endangering national security or damaging national honor or interests;
(四)煽动民族仇恨、民族歧视，伤害民族感情或者侵害民族风俗、习惯，破坏民族团结的；
(4) Inciting ethnic hatred or discrimination, harming ethnic feelings or infringing upon ethnic customs and habits, or undermining ethnic unity;
(五)违反国家宗教政策，宣扬邪教、迷信的；
(5) Violating national religious policies, promoting cults or superstitions;
(六)宣扬淫秽、赌博、暴力以及与毒品有关的违法犯罪活动，或者教唆犯罪的；
(6) Promoting obscenity, gambling, violence, and drug-related illegal and criminal activities, or abetting crimes;
(七)违背社会公德或者民族优秀文化传统的；
(7) Violating social morality or excellent national cultural traditions;
(八)侮辱、诽谤他人，侵害他人合法权益的；
(8) Insulting or slandering others, infringing upon the legitimate rights and interests of others;
(九)法律、行政法规禁止的其他内容。
(9) Other content prohibited by laws and administrative regulations.
娱乐场所及其从业人员不得实施下列行为，不得为进入娱乐场所的人员实施下列行为提供条件：
Entertainment venues and their employees shall not engage in the following acts, nor shall they provide conditions for persons entering the entertainment venues to engage in the following acts:
(一)贩卖、提供毒品，或者组织、强迫、教唆、引诱、欺骗、容留他人吸食、注射毒品；
(1) Selling, providing drugs, or organizing, forcing, instigating, enticing, deceiving, or harboring others to use or inject drugs;
(二)组织、强迫、引诱、容留、介绍他人卖淫、嫖娼；
(2) Organizing, forcing, enticing, harboring, or introducing others to engage in prostitution or patronize prostitutes;
(三)制作、贩卖、传播淫秽物品；
(3) Producing, selling, or disseminating obscene materials;
(四)提供或者从事以营利为目的的陪侍；
(4) Providing or engaging in profit-oriented companionship;
(五)赌博；
(5) Gambling;
(六)从事邪教、迷信活动；
(6) Engaging in cult or superstitious activities;
(七)其他违法犯罪行为。
(7) Other illegal or criminal acts.
娱乐场所的从业人员不得吸食、注射毒品，不得卖淫、嫖娼；娱乐场所及其从业人员不得为进入娱乐场所的人员实施上述行为提供条件。
Employees of entertainment venues shall not use or inject drugs, nor engage in prostitution or patronize prostitutes; entertainment venues and their employees shall not provide conditions for persons entering the entertainment venues to engage in the above acts.
歌舞娱乐场所应当按照国务院公安部门的规定在营业场所的出入口、主要通道安装闭路电视监控设备，并应当保证闭路电视监控设备在营业期间正常运行，不得中断。
Song and dance entertainment venues shall install closed-circuit television surveillance equipment at the entrances, exits, and main passages of the business premises in accordance with the provisions of the public security department of the State Council, and shall ensure that the closed-circuit television surveillance equipment operates normally during business hours without interruption.
歌舞娱乐场所应当将闭路电视监控录像资料留存30日备查，不得删改或者挪作他用。
Song and dance entertainment venues shall retain closed-circuit television surveillance video recordings for 30 days for inspection, and shall not delete, alter, or use them for other purposes.
歌舞娱乐场所的包厢、包间内不得设置隔断，并应当安装展现室内整体环境的透明门窗。包厢、包间的门不得有内锁装置。
In song and dance entertainment venues, no partitions shall be installed in private rooms or boxes, and transparent windows or doors that reveal the overall indoor environment shall be installed. The doors of private rooms or boxes shall not have internal locking devices.
营业期间，歌舞娱乐场所内亮度不得低于国家规定的标准。
During business hours, the brightness within song and dance entertainment venues shall not be lower than the standards prescribed by the state.
娱乐场所使用的音像制品或者电子游戏应当是依法出版、生产或者进口的产品。
The audio-visual products or electronic games used in entertainment venues shall be products that have been lawfully published, produced, or imported.
歌舞娱乐场所播放的曲目和屏幕画面以及游艺娱乐场所的电子游戏机内的游戏项目，不得含有本条例第十三条禁止的内容；歌舞娱乐场所使用的歌曲点播系统不得与境外的曲库联接。
The songs and screen images played in song and dance entertainment venues, as well as the game items in electronic game machines of amusement entertainment venues, shall not contain content prohibited by Article 13 of these Regulations; the song-on-demand systems used in song and dance entertainment venues shall not be connected to overseas song libraries.
游艺娱乐场所不得设置具有赌博功能的电子游戏机机型、机种、电路板等游戏设施设备，不得以现金或者有价证券作为奖品，不得回购奖品。
Amusement entertainment venues shall not install electronic game machine models, types, circuit boards, or other game facilities and equipment with gambling functions, shall not use cash or securities as prizes, and shall not buy back prizes.
娱乐场所的法定代表人或者主要负责人应当对娱乐场所的消防安全和其他安全负责。
The legal representative or principal responsible person of an entertainment venue shall be responsible for the fire safety and other safety of the entertainment venue.
娱乐场所应当确保其建筑、设施符合国家安全标准和消防技术规范，定期检查消防设施状况，并及时维护、更新。
Entertainment venues shall ensure that their buildings and facilities comply with national safety standards and fire technical specifications, regularly inspect the condition of fire-fighting facilities, and promptly maintain and update them.
娱乐场所应当制定安全工作方案和应急疏散预案。
Entertainment venues shall formulate safety work plans and emergency evacuation plans.
营业期间，娱乐场所应当保证疏散通道和安全出口畅通，不得封堵、锁闭疏散通道和安全出口，不得在疏散通道和安全出口设置栅栏等影响疏散的障碍物。
During business hours, entertainment venues shall ensure that evacuation passages and safety exits are unobstructed, shall not block or lock evacuation passages and safety exits, and shall not install barriers or other obstacles affecting evacuation in evacuation passages and safety exits.
娱乐场所应当在疏散通道和安全出口设置明显指示标志，不得遮挡、覆盖指示标志。
Entertainment venues shall set up clear indication signs at evacuation passages and safety exits, and shall not obstruct or cover the indication signs.
任何人不得非法携带枪支、弹药、管制器具或者携带爆炸性、易燃性、毒害性、放射性、腐蚀性等危险物品和传染病病原体进入娱乐场所。
No person may illegally carry firearms, ammunition, controlled instruments, or bring explosive, flammable, toxic, radioactive, corrosive and other dangerous items and infectious disease pathogens into entertainment venues.
迪斯科舞厅应当配备安全检查设备，对进入营业场所的人员进行安全检查。
Disco dance halls shall be equipped with security inspection equipment and conduct security checks on persons entering the business premises.
歌舞娱乐场所不得接纳未成年人。除国家法定节假日外，游艺娱乐场所设置的电子游戏机不得向未成年人提供。
Song and dance entertainment venues shall not admit minors. Except for national statutory holidays, electronic game machines set up in amusement entertainment venues shall not be provided to minors.
娱乐场所不得招用未成年人；招用外国人的，应当按照国家有关规定为其办理外国人就业许可证。
Entertainment venues shall not employ minors; if employing foreigners, they shall handle the foreigner's employment permit in accordance with relevant state regulations.
娱乐场所应当与从业人员签订文明服务责任书，并建立从业人员名簿；从业人员名簿应当包括从业人员的真实姓名、居民身份证复印件、外国人就业许可证复印件等内容。
Entertainment venues shall sign civilized service responsibility letters with employees and establish employee name registers; employee name registers shall include the employee's real name, copy of resident identity card, copy of foreigner's employment permit, and other contents.
娱乐场所应当建立营业日志，记载营业期间从业人员的工作职责、工作时间、工作地点；营业日志不得删改，并应当留存60日备查。
Entertainment venues shall establish business logs recording the work responsibilities, working hours, and work locations of employees during business hours; business logs shall not be altered and shall be retained for 60 days for inspection.
娱乐场所应当与保安服务企业签订保安服务合同，配备专业保安人员；不得聘用其他人员从事保安工作。
Entertainment venues shall sign security service contracts with security service companies and equip professional security personnel; they shall not employ other persons to engage in security work.
营业期间，娱乐场所的从业人员应当统一着工作服，佩带工作标志并携带居民身份证或者外国人就业许可证。
During business hours, employees of entertainment venues shall wear uniforms, carry work badges, and carry resident identity cards or foreigner's employment permits.
从业人员应当遵守职业道德和卫生规范，诚实守信，礼貌待人，不得侵害消费者的人身和财产权利。
Employees shall abide by professional ethics and hygiene standards, be honest and trustworthy, treat people politely, and shall not infringe upon the personal and property rights of consumers.
每日凌晨2时至上午8时，娱乐场所不得营业。
Entertainment venues shall not operate between 2:00 a.m. and 8:00 a.m. daily.
娱乐场所提供娱乐服务项目和出售商品，应当明码标价，并向消费者出示价目表；不得强迫、欺骗消费者接受服务、购买商品。
Entertainment venues providing entertainment services and selling goods shall clearly mark prices and present a price list to consumers; they shall not force or deceive consumers into accepting services or purchasing goods.
娱乐场所应当在营业场所的大厅、包厢、包间内的显著位置悬挂含有禁毒、禁赌、禁止卖淫嫖娼等内容的警示标志、未成年人禁入或者限入标志。标志应当注明公安部门、文化主管部门的举报电话。
Entertainment venues shall prominently display warning signs containing content such as anti-drug, anti-gambling, and anti-prostitution, as well as signs prohibiting or restricting minors, in the lobby, private rooms, andprivate room of the business premises. The signs shall indicate the reporting telephone numbers of the public security department and the cultural department.
娱乐场所应当建立巡查制度，发现娱乐场所内有违法犯罪活动的，应当立即向所在地县级公安部门、县级人民政府文化主管部门报告。
Entertainment venues shall establish a patrol system. If illegal or criminal activities are found within the venue, they shall immediately report to the local county-level public security department and the county-level people's government cultural department.
监督管理
Supervision and Administration
文化主管部门、公安部门和其他有关部门的工作人员依法履行监督检查职责时，有权进入娱乐场所。娱乐场所应当予以配合，不得拒绝、阻挠。
Staff of the cultural department, public security department, and other relevant departments have the right to enter entertainment venues when performing their supervision and inspection duties according to law. Entertainment venues shall cooperate and shall not refuse or obstruct.
文化主管部门、公安部门和其他有关部门的工作人员依法履行监督检查职责时，需要查阅闭路电视监控录像资料、从业人员名簿、营业日志等资料的，娱乐场所应当及时提供。
When staff of the cultural department, public security department, and other relevant departments perform their supervision and inspection duties according to law and need to review materials such as closed-circuit television surveillance recordings, employee rosters, and business logs, entertainment venues shall provide them promptly.
文化主管部门、公安部门和其他有关部门应当记录监督检查的情况和处理结果。监督检查记录由监督检查人员签字归档。公众有权查阅监督检查记录。
The cultural department, public security department, and other relevant departments shall record the circumstances and results of supervision and inspections. Supervision and inspection records shall be signed and filed by the inspectors. The public has the right to access supervision and inspection records.
文化主管部门、公安部门和其他有关部门应当建立娱乐场所违法行为警示记录系统；对列入警示记录的娱乐场所，应当及时向社会公布，并加大监督检查力度。
The cultural department, public security department, and other relevant departments shall establish a warning record system for illegal acts of entertainment venues; for entertainment venues included in the warning records, they shall promptly make them public and increase the intensity of supervision and inspection.
文化主管部门应当建立娱乐场所的经营活动信用监管制度，建立健全信用约束机制，并及时公布行政处罚信息。
The cultural department shall establish a credit supervision system for the business activities of entertainment venues, establish and improve credit restraint mechanisms, and promptly publish administrative penalty information.
文化主管部门、公安部门和其他有关部门应当建立相互间的信息通报制度，及时通报监督检查情况和处理结果。
The culturalcompetent authority, public security departments, and other relevant departments shall establish an information notification system among themselves, and promptly notify each other of supervision and inspection situations and handling results.
任何单位或者个人发现娱乐场所内有违反本条例行为的，有权向文化主管部门、公安部门等有关部门举报。
Any unit or individual that discovers any violation of these Regulations within an entertainment venue has the right to report it to the culturalcompetent authority, public security department, or other relevant departments.
文化主管部门、公安部门等有关部门接到举报，应当记录，并及时依法调查、处理；对不属于本部门职责范围的，应当及时移送有关部门。
Upon receiving a report, the culturalcompetent authority, public security department, or other relevant departments shall record it and promptly investigate and handle it according to law; if it is not within their scope of duties, they shall promptly transfer it to the relevant department.
上级人民政府文化主管部门、公安部门在必要时，可以依照本条例的规定调查、处理由下级人民政府文化主管部门、公安部门调查、处理的案件。
When necessary, the culturalcompetent authority and public security department of a higher-level people's government may, in accordance with these Regulations, investigate and handle cases that are under the investigation and handling of the culturalcompetent authority and public security department of a lower-level people's government.
下级人民政府文化主管部门、公安部门认为案件重大、复杂的，可以请求移送上级人民政府文化主管部门、公安部门调查、处理。
If the culturalcompetent authority or public security department of a lower-level people's government considers a case to be major or complex, it may request to transfer the case to the culturalcompetent authority or public security department of a higher-level people's government for investigation and handling.
文化主管部门、公安部门和其他有关部门及其工作人员违反本条例规定的，任何单位或者个人可以向依法有权处理的本级或者上一级机关举报。接到举报的机关应当依法及时调查、处理。
If the culturalcompetent authority, public security department, other relevant departments, or their staff violate the provisions of these Regulations, any unit or individual may report it to the competent authority at the same level or the next higher level. The authority receiving the report shall promptly investigate and handle it according to law.
娱乐场所行业协会应当依照章程的规定，制定行业自律规范，加强对会员经营活动的指导、监督。
Industry associations of entertainment venues shall, in accordance with their articles of association, formulate industry self-discipline norms and strengthen guidance and supervision over the business activities of their members.
法律责任
Legal Liability
违反本条例规定，擅自从事娱乐场所经营活动的，由文化主管部门依法予以取缔；公安部门在查处治安、刑事案件时，发现擅自从事娱乐场所经营活动的，应当依法予以取缔。
Whoever, in violation of these Regulations, engages in entertainment venue business activities without authorization shall be banned by the culturalcompetent authority according to law; if the public security department discovers unauthorized entertainment venue business activities while investigating public security or criminal cases, it shall ban them according to law.
违反本条例规定，以欺骗等不正当手段取得娱乐经营许可证的，由原发证机关撤销娱乐经营许可证。
Whoever, in violation of these Regulations, obtains an entertainment business license by fraudulent or other improper means shall have the entertainment business license revoked by the original issuing authority.
娱乐场所实施本条例第十四条禁止行为的，由县级公安部门没收违法所得和非法财物，责令停业整顿3个月至6个月；情节严重的，由原发证机关吊销娱乐经营许可证，对直接负责的主管人员和其他直接责任人员处1万元以上2万元以下的罚款。
If an entertainment venue engages in any act prohibited by Article 14 of these Regulations, the public security department at the county level shall confiscate the illegal gains and illegal property, and order a suspension of business for rectification for a period of 3 to 6 months; if the circumstances are serious, the original issuing authority shall revoke the entertainment business license, and impose a fine of not less than 10,000 yuan but not more than 20,000 yuan on the directly responsible person in charge and other directly responsible persons.
娱乐场所违反本条例规定，有下列情形之一的，由县级公安部门责令改正，给予警告；情节严重的，责令停业整顿1个月至3个月：
If an entertainment venue violates these Regulations under any of the following circumstances, the public security department at the county level shall order correction and give a warning; if the circumstances are serious, it shall order a suspension of business for rectification for a period of 1 to 3 months:
(一)照明设施、包厢、包间的设置以及门窗的使用不符合本条例规定的；
(1) The lighting facilities, private rooms, and the use of doors and windows do not comply with the provisions of these Regulations;
(二)未按照本条例规定安装闭路电视监控设备或者中断使用的；
(2) Failure to install closed-circuit television monitoring equipment as required by these Regulations, or interrupting its use;
(三)未按照本条例规定留存监控录像资料或者删改监控录像资料的；
(3) Failure to retain monitoring video materials as required by these Regulations, or deleting or altering monitoring video materials;
(四)未按照本条例规定配备安全检查设备或者未对进入营业场所的人员进行安全检查的；
(4) Failure to equip security inspection equipment as required by these Regulations, or failure to conduct security inspections on persons entering the business premises;
(五)未按照本条例规定配备保安人员的。
(5) Failure to employ security personnel as required by these Regulations.
娱乐场所违反本条例规定，有下列情形之一的，由县级公安部门没收违法所得和非法财物，并处违法所得2倍以上5倍以下的罚款；没有违法所得或者违法所得不足1万元的，并处2万元以上5万元以下的罚款；情节严重的，责令停业整顿1个月至3个月：
If an entertainment venue violates these Regulations under any of the following circumstances, the public security department at the county level shall confiscate the illegal gains and illegal property, and impose a fine of not less than 2 times but not more than 5 times the illegal gains; if there are no illegal gains or the illegal gains are less than 10,000 yuan, a fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed; if the circumstances are serious, it shall order a suspension of business for rectification for a period of 1 to 3 months:
(一)设置具有赌博功能的电子游戏机机型、机种、电路板等游戏设施设备的；
(1) Installing electronic game machine models, types, circuit boards, or other game facility equipment with gambling functions;
(二)以现金、有价证券作为奖品，或者回购奖品的。
(2) Using cash or securities as prizes, or repurchasing prizes.
娱乐场所指使、纵容从业人员侵害消费者人身权利的，应当依法承担民事责任，并由县级公安部门责令停业整顿1个月至3个月；造成严重后果的，由原发证机关吊销娱乐经营许可证。
If an entertainment venue directs or tolerates its employees to infringe upon the personal rights of consumers, it shall bear civil liability according to law, and the public security department at the county level shall order a suspension of operations for rectification for a period of 1 to 3 months; if serious consequences are caused, the original licensing authority shall revoke the entertainment business license.
娱乐场所取得营业执照后，未按照本条例规定向公安部门备案的，由县级公安部门责令改正，给予警告。
If an entertainment venue, after obtaining a business license, fails to file with the public security department in accordance with these Regulations, the public security department at the county level shall order correction and give a warning.
违反本条例规定，有下列情形之一的，由县级人民政府文化主管部门没收违法所得和非法财物，并处违法所得1倍以上3倍以下的罚款；没有违法所得或者违法所得不足1万元的，并处1万元以上3万元以下的罚款；情节严重的，责令停业整顿1个月至6个月：
In violation of these Regulations, under any of the following circumstances, the culturalcompetent authority at the county level shall confiscate illegal gains and illegal property, and impose a fine of not less than one time but not more than three times the illegal gains; if there are no illegal gains or the illegal gains are less than 10,000 yuan, a fine of not less than 10,000 yuan but not more than 30,000 yuan shall be imposed; if the circumstances are serious, a suspension of operations for rectification for a period of 1 to 6 months shall be ordered:
(一)歌舞娱乐场所的歌曲点播系统与境外的曲库联接的；
(1) The song-on-demand system of a song and dance entertainment venue is connected to a foreign song library;
(二)歌舞娱乐场所播放的曲目、屏幕画面或者游艺娱乐场所电子游戏机内的游戏项目含有本条例第十三条禁止内容的；
(2) The songs, screen images played in a song and dance entertainment venue, or the game items in electronic game machines of a game entertainment venue contain content prohibited by Article 13 of these Regulations;
(三)歌舞娱乐场所接纳未成年人的；
(3) A song and dance entertainment venue admits minors;
(四)游艺娱乐场所设置的电子游戏机在国家法定节假日外向未成年人提供的；
(4) Electronic game machines set up in a game entertainment venue are provided to minors outside of legal holidays;
(五)娱乐场所容纳的消费者超过核定人数的。
(5) The number of consumers accommodated in an entertainment venue exceeds the approved capacity.
娱乐场所违反本条例规定，有下列情形之一的，由县级人民政府文化主管部门责令改正，给予警告；情节严重的，责令停业整顿1个月至3个月：
If an entertainment venue violates these Regulations under any of the following circumstances, the cultural department at the county level shall order correction and give a warning; if the circumstances are serious, a suspension of operations for rectification for a period of 1 to 3 months shall be ordered:
(一)变更有关事项，未按照本条例规定申请重新核发娱乐经营许可证的；
(1) Changes to relevant matters are made without applying for reissuance of the entertainment business license in accordance with these Regulations;
(二)在本条例规定的禁止营业时间内营业的；
(2) Operating during prohibited business hours as stipulated in these Regulations;
(三)从业人员在营业期间未统一着装并佩带工作标志的。
(3) Employees not wearing uniform and work badges during business hours.
娱乐场所未按照本条例规定建立从业人员名簿、营业日志，或者发现违法犯罪行为未按照本条例规定报告的，由县级人民政府文化主管部门、县级公安部门依据法定职权责令改正，给予警告；情节严重的，责令停业整顿1个月至3个月。
If an entertainment venue fails to establish an employee roster or business log as required by these Regulations, or fails to report illegal or criminal activities as required by these Regulations, the culturalcompetent authority of the county-level people's government or the county-level public security department shall, within their statutory authority, order correction and give a warning; if the circumstances are serious, order a suspension of business for rectification for a period of 1 to 3 months.
娱乐场所未按照本条例规定悬挂警示标志、未成年人禁入或者限入标志的，由县级人民政府文化主管部门、县级公安部门依据法定职权责令改正，给予警告。
If an entertainment venue fails to display warning signs, minor prohibition or restriction signs as required by these Regulations, the culturalcompetent authority of the county-level people's government or the county-level public security department shall, within their statutory authority, order correction and give a warning.
娱乐场所招用未成年人的，由劳动保障行政部门责令改正，并按照每招用一名未成年人每月处5000元罚款的标准给予处罚。
If an entertainment venue employs minors, the labor and social security administrative department shall order correction and impose a fine of 5,000 yuan per month for each minor employed.
因擅自从事娱乐场所经营活动被依法取缔的，其投资人员和负责人终身不得投资开办娱乐场所或者担任娱乐场所的法定代表人、负责人。
If an entertainment venue is lawfully banned for engaging in entertainment business activities without authorization, its investors and responsible persons shall be prohibited for life from investing in or establishing entertainment venues, or serving as legal representatives or responsible persons of entertainment venues.
娱乐场所因违反本条例规定，被吊销或者撤销娱乐经营许可证的，自被吊销或者撤销之日起，其法定代表人、负责人5年内不得担任娱乐场所的法定代表人、负责人。
If an entertainment venue has its entertainment business license revoked or cancelled due to violation of these Regulations, its legal representative or responsible person shall not serve as the legal representative or responsible person of any entertainment venue within 5 years from the date of revocation or cancellation.
娱乐场所因违反本条例规定，2年内被处以3次警告或者罚款又有违反本条例的行为应受行政处罚的，由县级人民政府文化主管部门、县级公安部门依据法定职权责令停业整顿3个月至6个月；2年内被2次责令停业整顿又有违反本条例的行为应受行政处罚的，由原发证机关吊销娱乐经营许可证。
If an entertainment venue, within 2 years, has been subjected to 3 warnings or fines for violating these Regulations and again commits a violation subject to administrative penalty, the culturalcompetent authority of the county-level people's government or the county-level public security department shall, within their statutory authority, order a suspension of business for rectification for 3 to 6 months; if within 2 years it has been ordered to suspend business for rectification twice and again commits a violation subject to administrative penalty, the original licensing authority shall revoke the entertainment business license.
娱乐场所违反有关治安管理或者消防管理法律、行政法规规定的，由公安部门依法予以处罚；构成犯罪的，依法追究刑事责任。
If an entertainment venue violates laws or administrative regulations on public security or fire control, the public security department shall impose penalties according to law; if a crime is constituted, criminal liability shall be pursued according to law.
娱乐场所违反有关卫生、环境保护、价格、劳动等法律、行政法规规定的，由有关部门依法予以处罚；构成犯罪的，依法追究刑事责任。
If an entertainment venue violates laws or administrative regulations on health, environmental protection, pricing, labor, etc., the relevant departments shall impose penalties according to law; if a crime is constituted, criminal liability shall be pursued according to law.
娱乐场所及其从业人员与消费者发生争议的，应当依照消费者权益保护的法律规定解决；造成消费者人身、财产损害的，由娱乐场所依法予以赔偿。
Disputes between entertainment venues and their employees and consumers shall be resolved in accordance with the laws on consumer rights protection; if personal injury or property damage is caused to consumers, the entertainment venue shall compensate according to law.
国家机关及其工作人员开办娱乐场所，参与或者变相参与娱乐场所经营活动的，对直接负责的主管人员和其他直接责任人员依法给予撤职或者开除的行政处分。
If state organs and their staff establish entertainment venues, or participate or covertly participate in the operation of entertainment venues, the directly responsible supervisors and other directly responsible personnel shall be given administrative sanctions of demotion or dismissal according to law.
文化主管部门、公安部门的工作人员明知其亲属开办娱乐场所或者发现其亲属参与、变相参与娱乐场所的经营活动，不予制止或者制止不力的，依法给予行政处分；情节严重的，依法给予撤职或者开除的行政处分。
If staff of the cultural administrative department or the public security department know that their relatives have established entertainment venues or discover that their relatives participate or covertly participate in the operation of entertainment venues, and fail to stop it or stop it ineffectively, they shall be given administrative sanctions according to law; if the circumstances are serious, they shall be given administrative sanctions of demotion or dismissal according to law.
文化主管部门、公安部门、工商行政管理部门和其他有关部门的工作人员有下列行为之一的，对直接负责的主管人员和其他直接责任人员依法给予行政处分；构成犯罪的，依法追究刑事责任：
If staff of the cultural administrative department, public security department, administrative department for industry and commerce, and other relevant departments commit any of the following acts, the directly responsible supervisors and other directly responsible personnel shall be given administrative sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law:
(一)向不符合法定设立条件的单位颁发许可证、批准文件、营业执照的；
(1) Issuing permits, approval documents, or business licenses to entities that do not meet the statutory establishment conditions;
(二)不履行监督管理职责，或者发现擅自从事娱乐场所经营活动不依法取缔，或者发现违法行为不依法查处的；
(2) Failing to perform supervision and management duties, or failing to ban entertainment venues operating without authorization upon discovery, or failing to investigate and punish illegal acts upon discovery;
(三)接到对违法行为的举报、通报后不依法查处的；
(3) Failing to investigate and punish reports or notifications of illegal acts upon receipt;
(四)利用职务之便，索取、收受他人财物或者谋取其他利益的；
(4) Taking advantage of their positions to demand or accept property from others, or seek other benefits;
(五)利用职务之便，参与、包庇违法行为，或者向有关单位、个人通风报信的；
(5) Taking advantage of their positions to participate in or cover up illegal acts, or tipping off relevant units or individuals;
(六)有其他滥用职权、玩忽职守、徇私舞弊行为的。
(6) Other acts of abusing power, neglecting duties, or engaging in malpractice for personal gain.
附则
Supplementary Provisions
本条例所称从业人员，包括娱乐场所的管理人员、服务人员、保安人员和在娱乐场所工作的其他人员。
The term 'practitioners' as used in these Regulations includes management personnel, service personnel, security personnel, and other persons working in entertainment venues.
本条例自2006年3月1日起施行。1999年3月26日国务院发布的《娱乐场所管理条例》同时废止。
These Regulations shall come into force as of March 1, 2006. The Regulations on the Administration of Entertainment Venues promulgated by the State Council on March 26, 1999 shall be repealed simultaneously.
