总则
General Provisions
为了规范民用机场的建设与管理，积极、稳步推进民用机场发展，保障民用机场安全和有序运营，维护有关当事人的合法权益，依据《中华人民共和国民用航空法》，制定本条例。
This Regulation is formulated in accordance with the Civil Aviation Law of the People's Republic of China for the purposes of regulating the construction and management of civil airports, actively and steadily promoting the development of civil airports, ensuring the safe and orderly operation of civil airports, and protecting the legitimate rights and interests of relevant parties.
本条例适用于中华人民共和国境内民用机场的规划、建设、使用、管理及其相关活动。
This Regulation applies to the planning, construction, use, management, and related activities of civil airports within the territory of the People's Republic of China.
民用机场分为运输机场和通用机场。
Civil airports are divided into transport airports and general airports.
民用机场是公共基础设施。各级人民政府应当采取必要的措施，鼓励、支持民用机场发展，提高民用机场的管理水平。
Civil airports are public infrastructure. People's governments at all levels shall take necessary measures to encourage and support the development of civil airports and improve the management level of civil airports.
国务院民用航空主管部门依法对全国民用机场实施行业监督管理。地区民用航空管理机构依法对辖区内民用机场实施行业监督管理。
The competent civil aviation authority under the State Council shall exercise industry supervision and management over civil airports nationwide in accordance with the law. Regional civil aviation administration agencies shall exercise industry supervision and management over civil airports within their respective jurisdictions in accordance with the law.
有关地方人民政府依法对民用机场实施监督管理。
Relevant local people's governments shall exercise supervision and management over civil airports in accordance with the law.
全国民用机场布局规划应当根据国民经济和社会发展需求以及国防要求编制，并与综合交通发展规划、土地利用总体规划、城乡规划相衔接，严格控制建设用地规模，节约集约用地，保护生态环境。
The national civil airport layout plan shall be formulated based on the needs of national economic and social development as well as national defense requirements, and shall be coordinated with comprehensive transportation development plans, overall land use plans, and urban and rural plans. It shall strictly control the scale of construction land, promote economical and intensive land use, and protect the ecological environment.
民用机场的建设和使用
Construction and Use of Civil Airports
新建运输机场的场址应当符合国务院民用航空主管部门规定的条件。
The site of a new transport airport shall meet the conditions prescribed by the civil aviation authority under the State Council.
运输机场所在地有关地方人民政府应当将运输机场场址纳入土地利用总体规划和城乡规划统筹安排，并对场址实施保护。
The relevant local people's government at the location of the transport airport shall incorporate the transport airport site into the overall land use plan and urban-rural plan for coordinated arrangement, and implement protection for the site.
运输机场的新建、改建和扩建应当依照国家有关规定办理建设项目审批、核准手续。
The new construction, reconstruction, and expansion of transport airports shall undergo construction project approval and verification procedures in accordance with relevant state regulations.
运输机场总体规划由运输机场建设项目法人编制，并经国务院民用航空主管部门或者地区民用航空管理机构(以下统称民用航空管理部门)批准后方可实施。
The master plan of a transport airport shall be prepared by the construction project legal person of the transport airport and may only be implemented after approval by the civil aviation authority under the State Council or the regional civil aviation administration (hereinafter collectively referred to as the civil aviation administrative department).
飞行区指标为4E以上(含4E)的运输机场的总体规划，由国务院民用航空主管部门批准；飞行区指标为4D以下(含4D)的运输机场的总体规划，由所在地地区民用航空管理机构批准。民用航空管理部门审批运输机场总体规划，应当征求运输机场所在地有关地方人民政府意见。
The master plan of a transport airport with a flight area index of 4E or above (including 4E) shall be approved by the civil aviation authority under the State Council; the master plan of a transport airport with a flight area index of 4D or below (including 4D) shall be approved by the regional civil aviation administration at the location. When the civil aviation administrative department examines and approves the master plan of a transport airport, it shall seek opinions from the relevant local people's government at the location of the transport airport.
运输机场建设项目法人编制运输机场总体规划，应当征求有关军事机关意见。
When preparing the master plan of a transport airport, the construction project legal person of the transport airport shall seek opinions from relevant military authorities.
运输机场所在地有关地方人民政府应当将运输机场总体规划纳入城乡规划，并根据运输机场的运营和发展需要，对运输机场周边地区的土地利用和建设实行规划控制。
The relevant local people's government at the location of the transport airport shall incorporate the master plan of the transport airport into the urban-rural plan, and implement planning control over land use and construction in the surrounding areas of the transport airport based on the operation and development needs of the transport airport.
运输机场内的建设项目应当符合运输机场总体规划。任何单位和个人不得在运输机场内擅自新建、改建、扩建建筑物或者构筑物。
Construction projects within a transport airport shall comply with the master plan of the transport airport. No unit or individual may construct, reconstruct, or expand buildings or structures within the transport airport without authorization.
运输机场新建、改建和扩建项目的安全设施应当与主体工程同时设计、同时施工、同时验收、同时投入使用。安全设施投资应当纳入建设项目概算。
The safety facilities of new construction, reconstruction, and expansion projects of transport airports shall be designed, constructed, accepted, and put into use simultaneously with the main project. The investment in safety facilities shall be included in the project budget.
运输机场内的供水、供电、供气、通信、道路等基础设施由机场建设项目法人负责建设；运输机场外的供水、供电、供气、通信、道路等基础设施由运输机场所在地地方人民政府统一规划，统筹建设。
Infrastructure such as water supply, power supply, gas supply, communication, and roads within the transport airport shall be constructed by the airport construction project legal person; infrastructure such as water supply, power supply, gas supply, communication, and roads outside the transport airport shall be uniformly planned and constructed by the local people's government at the location of the transport airport.
运输机场专业工程的设计应当符合国家有关标准，并经民用航空管理部门批准。
The design of transport airport professional engineering shall comply with relevant national standards and be approved by the civil aviation authority.
飞行区指标为4E以上(含4E)的运输机场专业工程的设计，由国务院民用航空主管部门批准；飞行区指标为4D以下(含4D)的运输机场专业工程的设计，由运输机场所在地地区民用航空管理机构批准。
For transport airport professional engineering with a flight area index of 4E or above (including 4E), the design shall be approved by the civil aviation authority of the State Council; for transport airport professional engineering with a flight area index of 4D or below (including 4D), the design shall be approved by the regional civil aviation authority where the transport airport is located.
运输机场专业工程经民用航空管理部门验收合格后，方可投入使用。
Transport airport professional engineering may only be put into use after passing acceptance inspection by the civil aviation authority.
运输机场专业工程目录由国务院民用航空主管部门会同国务院建设主管部门制定并公布。
The catalog of transport airport professional engineering shall be formulated and published by the civil aviation authority of the State Council jointly with the construction authority of the State Council.
通用机场的规划、建设按照国家有关规定执行。
The planning and construction of general airports shall be carried out in accordance with relevant national regulations.
运输机场的安全和运营管理由依法组建的或者受委托的具有法人资格的机构(以下简称机场管理机构)负责。
The safety and operation management of transport airports shall be the responsibility of a legally established or entrusted institution with legal personality (hereinafter referred to as the airport management authority).
运输机场投入使用应当具备下列条件：
A transport airport shall meet the following conditions before being put into use:
(一)有健全的安全运营管理体系、组织机构和管理制度；
(1) Having a sound safety operation management system, organizational structure, and management system;
(二)有与其运营业务相适应的飞行区、航站区、工作区以及空中交通服务、航行情报、通信导航监视、气象等相关设施、设备和人员；
(2) Having flight areas, terminal areas, work areas, and related facilities, equipment, and personnel for air traffic services, aeronautical information, communication navigation surveillance, meteorology, etc., corresponding to its operational business;
(三)使用空域已经批准；
(3) The airspace to be used has been approved;
(四)飞行程序和运行标准符合国务院民用航空主管部门的规定；
(4) Flight procedures and operating standards comply with the provisions of the civil aviation authority of the State Council;
(五)符合国家规定的民用航空安全保卫条件；
(5) Meet the civil aviation security conditions prescribed by the state;
(六)有处理突发事件的应急预案及相应的设施、设备。
(6) Have emergency response plans and corresponding facilities and equipment for handling emergencies.
运输机场投入使用的，机场管理机构应当向国务院民用航空主管部门提出申请，并附送符合本条例第十六条规定条件的相关材料。
For a transport airport to be put into use, the airport management authority shall submit an application to the civil aviation authority of the State Council, together with relevant materials that meet the conditions specified in Article 16 of these Regulations.
国务院民用航空主管部门应当自受理申请之日起45个工作日内审查完毕，作出准予许可或者不予许可的决定。准予许可的，颁发运输机场使用许可证；不予许可的，应当书面通知申请人并说明理由。
The civil aviation authority of the State Council shall complete the review within 45 working days from the date of accepting the application, and make a decision to grant or deny the permit. If the permit is granted, a transport airport operation permit shall be issued; if not, the applicant shall be notified in writing with reasons.
通用机场投入使用应当具备下列条件：
A general airport to be put into use shall meet the following conditions:
(一)有与运营业务相适应的飞行场地；
(1) Have flight sites suitable for the operational business;
(二)有保证飞行安全的空中交通服务、通信导航监视等设施和设备；
(2) Have air traffic services, communication navigation surveillance and other facilities and equipment to ensure flight safety;
(三)有健全的安全管理制度、符合国家规定的民用航空安全保卫条件以及处理突发事件的应急预案；
(3) Have a sound safety management system, meet the civil aviation security conditions prescribed by the state, and have emergency response plans for handling emergencies;
(四)配备必要的管理人员和专业技术人员。
(4) Be equipped with necessary management personnel and professional technical personnel.
通用机场投入使用的，通用机场的管理者应当向通用机场所在地地区民用航空管理机构提出申请，并附送符合本条例第十八条规定条件的相关材料。
When a general airport is put into use, the manager of the general airport shall submit an application to the regional civil aviation administration where the general airport is located, together with relevant materials that meet the conditions specified in Article 18 of these Regulations.
地区民用航空管理机构应当自受理申请之日起30个工作日内审查完毕，作出准予许可或者不予许可的决定。准予许可的，颁发通用机场使用许可证；不予许可的，应当书面通知申请人并说明理由。
The regional civil aviation administration shall complete the review within 30 working days from the date of accepting the application, and make a decision to grant or deny the permit. If the permit is granted, a general airport use permit shall be issued; if the permit is denied, the applicant shall be notified in writing with reasons stated.
运输机场作为国际机场使用的，应当按照国家有关规定设立口岸查验机构，配备相应的人员、场地和设施，并经国务院有关部门验收合格。
If a transport airport is to be used as an international airport, it shall establish port inspection agencies in accordance with relevant state regulations, equip them with appropriate personnel, premises, and facilities, and pass the acceptance inspection by the relevant departments of the State Council.
国际机场的开放使用，由国务院民用航空主管部门对外公告；国际机场资料由国务院民用航空主管部门统一对外提供。
The opening of an international airport for use shall be publicly announced by the competent civil aviation authority of the State Council; airport information for international airports shall be uniformly provided by the competent civil aviation authority of the State Council.
机场管理机构应当按照运输机场使用许可证规定的范围开放使用运输机场，不得擅自关闭。
The airport manager shall operate the transport airport within the scope specified in the transport airport use permit and shall not close it without authorization.
运输机场因故不能保障民用航空器运行安全，需要临时关闭的，机场管理机构应当及时通知有关空中交通管理部门并及时向社会公告。空中交通管理部门应当按照相关规定发布航行通告。
If a transport airport cannot ensure the safe operation of civil aircraft for some reason and needs to be temporarily closed, the airport manager shall promptly notify the relevant air traffic control department and make a public announcement in a timely manner. The air traffic control department shall issue a navigation notice in accordance with relevant regulations.
机场管理机构拟关闭运输机场的，应当提前45日报颁发运输机场使用许可证的机关，经批准后方可关闭，并向社会公告。
If the airport manager intends to close a transport airport, it shall report to the authority that issued the transport airport use permit 45 days in advance, and may close only after obtaining approval, and shall make a public announcement.
运输机场的命名或者更名应当符合国家有关法律、行政法规的规定。
The naming or renaming of a transport airport shall comply with relevant state laws and administrative regulations.
运输机场废弃或者改作他用的，机场管理机构应当按照国家有关规定办理报批手续，并及时向社会公告。
If a transport airport is to be abandoned or converted to other uses, the airport manager shall go through the approval procedures in accordance with relevant state regulations and make a timely public announcement.
民用机场安全和运营管理
Civil Airport Safety and Operation Management
民用航空管理部门、有关地方人民政府应当加强对运输机场安全运营工作的领导，督促机场管理机构依法履行安全管理职责，协调、解决运输机场安全运营中的问题。
The civil aviation administrative department and the relevant local people's government shall strengthen leadership over the safe operation of transport airports, urge airport management agencies to perform safety management duties according to law, and coordinate and resolve issues in the safe operation of transport airports.
民用航空管理部门、有关地方人民政府应当按照国家规定制定运输机场突发事件的应急预案。
The civil aviation administrative department and the relevant local people's government shall formulate emergency response plans for transport airport emergencies in accordance with national regulations.
机场管理机构应当根据运输机场突发事件应急预案组织运输机场应急救援的演练和人员培训。
The airport management agency shall organize emergency rescue drills and personnel training for transport airports based on the transport airport emergency response plan.
机场管理机构、航空运输企业以及其他驻场单位应当配备必要的应急救援设备和器材，并加强日常管理。
The airport management agency, air transport enterprises, and other on-site units shall be equipped with necessary emergency rescue equipment and devices, and strengthen daily management.
机场管理机构应当依照国家有关法律、法规和技术标准的规定，保证运输机场持续符合安全运营要求。运输机场不符合安全运营要求的，机场管理机构应当按照国家有关规定及时改正。
The airport management agency shall, in accordance with the provisions of relevant national laws, regulations, and technical standards, ensure that the transport airport continuously meets the requirements for safe operation. If the transport airport does not meet the safe operation requirements, the airport management agency shall promptly make corrections in accordance with relevant national regulations.
机场管理机构对运输机场的安全运营实施统一协调管理，负责建立健全机场安全运营责任制，组织制定机场安全运营规章制度，保障机场安全投入的有效实施，督促检查安全运营工作，及时消除安全事故隐患，依法报告生产安全事故。
The airport management agency shall implement unified coordination and management of the safe operation of the transport airport, be responsible for establishing and improving the safety operation responsibility system of the airport, organizing the formulation of airport safety operation rules and regulations, ensuring the effective implementation of airport safety investment, supervising and inspecting safety operation work, promptly eliminating potential safety accident hazards, and reporting production safety accidents according to law.
航空运输企业及其他驻场单位应当按照各自的职责，共同保障运输机场的安全运营并承担相应的责任；发生影响运输机场安全运营情况的，应当立即报告机场管理机构。
Air transport enterprises and other on-site units shall, in accordance with their respective responsibilities, jointly ensure the safe operation of the transport airport and bear corresponding responsibilities; if any situation affecting the safe operation of the transport airport occurs, they shall immediately report to the airport management agency.
机场管理机构、航空运输企业以及其他驻场单位应当定期对从业人员进行必要的安全运营培训，保证从业人员具备相关的知识和技能。
The airport management agency, air transport enterprises, and other on-site units shall regularly conduct necessary safety operation training for employees to ensure that employees possess relevant knowledge and skills.
民用机场专用设备应当符合国家规定的标准和相关技术规范，并经国务院民用航空主管部门认定的机构检验合格后，方可用于民用机场。
Special equipment for civil airports shall meet the standards and relevant technical specifications stipulated by the state, and may only be used in civil airports after passing inspection by an institution recognized by the civil aviation authority of the State Council.
民用航空管理部门应当加强对民用机场专用设备的监督检查。
The civil aviation administrative department shall strengthen supervision and inspection of special equipment for civil airports.
民用机场专用设备目录由国务院民用航空主管部门制定并公布。
The catalogue of special equipment for civil airports shall be formulated and published by the competent civil aviation authority under the State Council.
在运输机场开放使用的情况下，不得在飞行区及与飞行区临近的航站区内进行施工。确需施工的，应当取得运输机场所在地地区民用航空管理机构的批准。
During the period when a transport airport is open for use, construction shall not be carried out in the flight area or the terminal area adjacent to the flight area. If construction is indeed necessary, approval from the regional civil aviation administration where the transport airport is located shall be obtained.
发生突发事件，运输机场所在地有关地方人民政府、民用航空管理部门、空中交通管理部门、机场管理机构等单位应当按照应急预案的要求及时、有效地开展应急救援。
In the event of an emergency, the relevant local people's government at the location of the transport airport, the civil aviation administration, the air traffic control authority, the airport operator, and other entities shall carry out emergency rescue promptly and effectively in accordance with the requirements of the emergency plan.
机场管理机构统一协调、管理运输机场的生产运营，维护运输机场的正常秩序，为航空运输企业及其他驻场单位、旅客和货主提供公平、公正、便捷的服务。
The airport operator shall uniformly coordinate and manage the production and operation of the transport airport, maintain normal order at the transport airport, and provide fair, just, and convenient services to air transport enterprises, other on-site entities, passengers, and cargo owners.
机场管理机构与航空运输企业及其他驻场单位应当签订书面协议，明确各方在生产运营、机场管理过程中以及发生航班延误等情况时的权利和义务。
The airport operator and air transport enterprises and other on-site entities shall enter into written agreements specifying their respective rights and obligations during production and operation, airport management, and in the event of flight delays.
机场管理机构应当组织航空运输企业及其他驻场单位制定服务规范并向社会公布。
The airport operator shall organize air transport enterprises and other on-site entities to formulate service standards and make them public.
机场管理机构应当按照国家规定的标准配备候机、餐饮、停车、医疗急救等设施、设备，并提供相应的服务。
The airport operator shall equip facilities and equipment such as waiting lounges, catering, parking, and medical first aid in accordance with the standards prescribed by the state, and provide corresponding services.
机场管理机构应当与航空运输企业、空中交通管理部门等单位建立信息共享机制，相互提供必要的生产运营信息，及时为旅客和货主提供准确的信息。
The airport operator shall establish an information sharing mechanism with air transport enterprises, air traffic control authorities, and other entities, provide necessary production and operation information to each other, and promptly provide accurate information to passengers and cargo owners.
机场管理机构、航空运输企业以及其他驻场单位应当采取有效措施加强协调和配合，共同保证航班正常运行。
The airport operator, air transport enterprises, and other on-site entities shall take effective measures to strengthen coordination and cooperation, and jointly ensure the normal operation of flights.
航班发生延误，机场管理机构应当及时协调航空运输企业及其他有关驻场单位共同做好旅客和货主服务，及时通告相关信息。航空运输企业及其代理人应当按照有关规定和服务承诺为旅客和货主提供相应的服务。
In the event of a flight delay, the airport operator shall promptly coordinate with air transport enterprises and other relevant on-site entities to jointly provide services to passengers and cargo owners, and promptly notify relevant information. Air transport enterprises and their agents shall provide corresponding services to passengers and cargo owners in accordance with relevant regulations and service commitments.
机场范围内的零售、餐饮、航空地面服务等经营性业务采取有偿转让经营权的方式经营的，机场管理机构应当按照国务院民用航空主管部门的规定与取得经营权的企业签订协议，明确服务标准、收费水平、安全规范和责任等事项。
Where retail, catering, aviation ground services and other operational businesses within the airport are operated by means of paid transfer of concession rights, the airport management authority shall, in accordance with the provisions of the competent civil aviation authority under the State Council, enter into an agreement with the enterprise that has obtained the concession rights, specifying matters such as service standards, fee levels, safety norms and responsibilities.
对于采取有偿转让经营权的方式经营的业务，机场管理机构及其关联企业不得参与经营。
For businesses operated by means of paid transfer of concession rights, the airport management authority and its affiliated enterprises shall not participate in the operation.
机场管理机构应当向民用航空管理部门报送运输机场规划、建设和生产运营的有关资料，接受民用航空管理部门的监督检查。
The airport management authority shall submit relevant materials on the planning, construction and production operation of transport airports to the civil aviation administrative department, and accept supervision and inspection by the civil aviation administrative department.
民用航空管理部门和机场管理机构应当建立投诉受理制度，公布投诉受理单位和投诉方式。对于旅客和货主的投诉，民用航空管理部门或者机场管理机构应当自受理之日起10个工作日内作出书面答复。
The civil aviation administrative department and the airport management authority shall establish a complaint acceptance system and publish the complaint acceptance unit and complaint methods. For complaints from passengers and cargo owners, the civil aviation administrative department or the airport management authority shall make a written reply within 10 working days from the date of acceptance.
在民用机场内从事航空燃油供应业务的企业，应当具备下列条件：
An enterprise engaged in aviation fuel supply business within a civil airport shall meet the following conditions:
(一)取得成品油经营许可和危险化学品经营许可；
(1) Obtain a refined oil operation license and a hazardous chemicals operation license;
(二)有符合国家有关标准、与经营业务规模相适应的航空燃油供应设施、设备；
(2) Have aviation fuel supply facilities and equipment that comply with relevant national standards and are commensurate with the scale of the business;
(三)有健全的航空燃油供应安全管理制度、油品检测和监控体系；
(3) Have a sound aviation fuel supply safety management system, oil product testing and monitoring system;
(四)有满足业务经营需要的专业技术和管理人员。
(4) Have professional technical and management personnel meeting the needs of business operations.
申请在民用机场内从事航空燃油供应业务的企业，应当向民用机场所在地地区民用航空管理机构提出申请，并附送符合本条例第四十一条规定条件的相关材料。
An enterprise applying to engage in aviation fuel supply business within a civil airport shall submit an application to the regional civil aviation management authority at the location of the civil airport, together with relevant materials proving compliance with the conditions set forth in Article 41 of these Regulations.
地区民用航空管理机构应当自受理申请之日起30个工作日内，作出准予许可或者不予许可的决定。准予许可的，颁发民用机场航空燃油供应安全运营许可证；不予许可的，应当书面通知申请人并说明理由。
The regional civil aviation administration shall, within 30 working days from the date of accepting the application, make a decision to grant or deny the permit. If the permit is granted, it shall issue the Civil Airport Aviation Fuel Supply Safety Operation Permit; if denied, it shall notify the applicant in writing and state the reasons.
航空燃油供应企业供应的航空燃油应当符合航空燃油适航标准。
Aviation fuel supplied by aviation fuel supply enterprises shall comply with aviation fuel airworthiness standards.
民用机场航空燃油供应设施应当公平地提供给航空燃油供应企业使用。
Civil airport aviation fuel supply facilities shall be made available to aviation fuel supply enterprises on a fair basis.
运输机场航空燃油供应企业停止运输机场航空燃油供应业务的，应当提前90日告知运输机场所在地地区民用航空管理机构、机场管理机构和相关航空运输企业。
If an aviation fuel supply enterprise at a transport airport ceases its aviation fuel supply business, it shall notify the regional civil aviation administration at the transport airport's location, the airport management authority, and the relevant air transport enterprises at least 90 days in advance.
民用机场安全环境保护
Safety and Environmental Protection of Civil Airports
民用机场所在地地区民用航空管理机构和有关地方人民政府，应当按照国家有关规定划定民用机场净空保护区域，并向社会公布。
The regional civil aviation administration at the civil airport's location and the relevant local people's government shall, in accordance with relevant state regulations, delineate the obstacle-free zone of the civil airport and make it known to the public.
县级以上地方人民政府审批民用机场净空保护区域内的建设项目，应当书面征求民用机场所在地地区民用航空管理机构的意见。
When approving construction projects within the obstacle-free zone of a civil airport, the local people's government at or above the county level shall seek written opinions from the regional civil aviation administration at the civil airport's location.
在民用机场净空保护区域内设置22万伏以上(含22万伏)的高压输电塔的，应当按照国务院民用航空主管部门的有关规定设置障碍灯或者标志，保持其正常状态，并向民用机场所在地地区民用航空管理机构、空中交通管理部门和机场管理机构提供有关资料。
If a high-voltage transmission tower of 220 kV or above (including 220 kV) is erected within the obstacle-free zone of a civil airport, obstacle lights or markers shall be installed in accordance with the relevant provisions of the civil aviation authority under the State Council, maintained in normal working condition, and relevant data shall be provided to the regional civil aviation administration at the civil airport's location, the air traffic control authority, and the airport management authority.
禁止在民用机场净空保护区域内从事下列活动：
The following activities are prohibited within the obstacle-free zone of a civil airport:
(一)排放大量烟雾、粉尘、火焰、废气等影响飞行安全的物质；
(1) Discharging large amounts of smoke, dust, flames, exhaust gases, or other substances that affect flight safety;
(二)修建靶场、强烈爆炸物仓库等影响飞行安全的建筑物或者其他设施；
(2) Constructing buildings or other facilities such as shooting ranges and strong explosive warehouses that affect flight safety;
(三)设置影响民用机场目视助航设施使用或者飞行员视线的灯光、标志或者物体；
(3) Setting up lights, signs, or objects that affect the use of civil airport visual aids or the pilot's line of sight;
(四)种植影响飞行安全或者影响民用机场助航设施使用的植物；
(4) Planting vegetation that affects flight safety or the use of civil airport navigation aids;
(五)放飞影响飞行安全的鸟类，升放无人驾驶的自由气球、系留气球和其他升空物体；
(5) Releasing birds that affect flight safety, or flying unmanned free balloons, tethered balloons, and other airborne objects;
(六)焚烧产生大量烟雾的农作物秸秆、垃圾等物质，或者燃放烟花、焰火；
(6) Burning crop straw, garbage, or other substances that produce large amounts of smoke, or setting off fireworks and firecrackers;
(七)在民用机场围界外5米范围内，搭建建筑物、种植树木，或者从事挖掘、堆积物体等影响民用机场运营安全的活动；
(7) Within 5 meters outside the civil airport fence, constructing buildings, planting trees, or engaging in activities such as excavation or piling of objects that affect the safe operation of the civil airport;
(八)国务院民用航空主管部门规定的其他影响民用机场净空保护的行为。
(8) Other acts that affect the clearance protection of civil airports as prescribed by the civil aviation authority of the State Council.
在民用机场净空保护区域外从事本条例第四十九条所列活动的，不得影响民用机场净空保护。
Activities listed in Article 49 of these Regulations conducted outside the civil airport clearance protection area shall not affect the clearance protection of the civil airport.
禁止在距离航路两侧边界各30公里以内的地带修建对空射击的靶场和其他可能影响飞行安全的设施。
It is prohibited to construct shooting ranges targeting aircraft and other facilities that may affect flight safety within a zone of 30 kilometers from each side of the airway boundary.
民用航空管理部门和机场管理机构应当加强对民用机场净空状况的核查。发现影响民用机场净空保护的情况，应当立即制止，并书面报告民用机场所在地县级以上地方人民政府。接到报告的县级以上地方人民政府应当及时采取有效措施，消除对飞行安全的影响。
The civil aviation administration department and the airport management agency shall strengthen the inspection of the clearance status of civil airports. Upon discovering any situation affecting the clearance protection of a civil airport, they shall immediately stop it and report in writing to the local people's government at or above the county level where the civil airport is located. The local people's government at or above the county level that receives the report shall promptly take effective measures to eliminate the impact on flight safety.
民用机场所在地地方无线电管理机构应当会同地区民用航空管理机构按照国家无线电管理的有关规定和标准确定民用机场电磁环境保护区域，并向社会公布。
The local radio regulatory authority at the location of a civil airport shall, together with the regional civil aviation regulatory authority, determine the electromagnetic environment protection zone of the civil airport in accordance with the relevant provisions and standards of the state on radio regulation, and make it known to the public.
民用机场电磁环境保护区域包括设置在民用机场总体规划区域内的民用航空无线电台(站)电磁环境保护区域和民用机场飞行区电磁环境保护区域。
The electromagnetic environment protection zone of a civil airport includes the electromagnetic environment protection zone of civil aviation radio stations (sites) located within the master plan area of the civil airport and the electromagnetic environment protection zone of the civil airport flight area.
设置、使用地面民用航空无线电台(站)，应当经民用航空管理部门审核后，按照国家无线电管理有关规定办理审批手续，领取无线电台执照。
The installation and use of ground civil aviation radio stations (sites) shall be subject to review by the civil aviation regulatory authority, and then the approval procedures shall be handled in accordance with the state regulations on radio regulation, and a radio station license shall be obtained.
在民用机场电磁环境保护区域内设置、使用非民用航空无线电台(站)的，无线电管理机构应当在征求民用机场所在地地区民用航空管理机构意见后，按照国家无线电管理的有关规定审批。

禁止在民用航空无线电台(站)电磁环境保护区域内，从事下列影响民用机场电磁环境的活动：
It is prohibited to engage in the following activities affecting the electromagnetic environment of a civil airport within the electromagnetic environment protection zone of civil aviation radio stations (sites):
(一)修建架空高压输电线、架空金属线、铁路、公路、电力排灌站；
(1) Constructing overhead high-voltage transmission lines, overhead metal lines, railways, highways, or electric power drainage and irrigation stations;
(二)存放金属堆积物；
(2) Storing metal piles;
(三)种植高大植物；
(3) Planting tall plants;
(四)从事掘土、采砂、采石等改变地形地貌的活动；
(4) Engaging in activities that change the topography or landform, such as digging, sand mining, or stone quarrying;
(五)国务院民用航空主管部门规定的其他影响民用机场电磁环境的行为。
(5) Other activities affecting the electromagnetic environment of a civil airport as prescribed by the competent civil aviation authority of the State Council.
任何单位或者个人使用的无线电台(站)和其他仪器、装置，不得对民用航空无线电专用频率的正常使用产生干扰。
No unit or individual shall use any radio station (including stations) or other instruments or devices that interfere with the normal use of civil aviation radio dedicated frequencies.
民用航空无线电专用频率受到干扰时，机场管理机构和民用航空管理部门应当立即采取排查措施，及时消除；无法消除的，应当通报民用机场所在地地方无线电管理机构。接到通报的无线电管理机构应当采取措施，依法查处。
When civil aviation radio dedicated frequencies are interfered with, the airport management authority and the civil aviation administrative department shall immediately take investigative measures to eliminate the interference in a timely manner; if it cannot be eliminated, they shall notify the local radio regulatory authority at the location of the civil airport. The notified radio regulatory authority shall take measures and investigate and deal with the matter in accordance with the law.
在民用机场起降的民用航空器应当符合国家有关航空器噪声和涡轮发动机排出物的适航标准。
Civil aircraft taking off and landing at civil airports shall comply with the national airworthiness standards concerning aircraft noise and turbine engine emissions.
机场管理机构应当会同航空运输企业、空中交通管理部门等有关单位，采取技术手段和管理措施控制民用航空器噪声对运输机场周边地区的影响。
The airport management authority shall, together with air transport enterprises, air traffic control departments, and other relevant units, adopt technical means and management measures to control the impact of civil aircraft noise on the areas surrounding the transport airport.
民用机场所在地有关地方人民政府制定民用机场周边地区的土地利用总体规划和城乡规划，应当充分考虑民用航空器噪声对民用机场周边地区的影响，符合国家有关声环境质量标准。
When formulating the overall land use plan and urban-rural plan for the areas surrounding a civil airport, the relevant local people's government at the location of the civil airport shall fully consider the impact of civil aircraft noise on the areas surrounding the civil airport and comply with the national acoustic environment quality standards.
机场管理机构应当将民用航空器噪声对运输机场周边地区产生影响的情况，报告有关地方人民政府国土资源、规划建设、环境保护等主管部门。
The airport management authority shall report the situation of the impact of civil aircraft noise on the areas surrounding the transport airport to the relevant competent departments of land and resources, planning and construction, and environmental protection of the local people's government.
民用机场所在地有关地方人民政府应当在民用机场周边地区划定限制建设噪声敏感建筑物的区域并实施控制。确需在该区域内建设噪声敏感建筑物的，建设单位应当采取措施减轻或者避免民用航空器运行时对其产生的噪声影响。
The relevant local people's government at the location of a civil airport shall designate areas surrounding the civil airport where construction of noise-sensitive buildings is restricted and implement controls. If it is truly necessary to construct noise-sensitive buildings in such areas, the construction unit shall take measures to reduce or avoid the noise impact caused by the operation of civil aircraft on such buildings.
民用机场所在地有关地方人民政府应当会同地区民用航空管理机构协调解决在民用机场起降的民用航空器噪声影响引发的相关问题。
The relevant local people's government at the location of a civil airport shall, together with the regional civil aviation management authority, coordinate and resolve issues arising from the noise impact of civil aircraft taking off and landing at the civil airport.
法律责任
Legal Liability
违反本条例的规定，有下列情形之一的，由民用航空管理部门责令改正，处10万元以上50万元以下的罚款：
In violation of the provisions of these Regulations, under any of the following circumstances, the civil aviation administrative department shall order correction and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan:
(一)在运输机场内进行不符合运输机场总体规划的建设活动；
(1) Carrying out construction activities within a transport airport that do not conform to the overall plan of the transport airport;
(二)擅自实施未经批准的运输机场专业工程的设计，或者将未经验收合格的运输机场专业工程投入使用；
(2) Unauthorized implementation of the design of transport airport professional engineering that has not been approved, or putting into use transport airport professional engineering that has not been inspected and accepted as qualified;
(三)在运输机场开放使用的情况下，未经批准在飞行区及与飞行区临近的航站区内进行施工。
(3) Carrying out construction in the flight area and the terminal area adjacent to the flight area without approval when the transport airport is open for use.
违反本条例的规定，机场管理机构未按照运输机场使用许可证规定的范围使用运输机场的，由运输机场所在地地区民用航空管理机构责令改正，处20万元以上100万元以下的罚款。
Where, in violation of these Regulations, an airport management agency uses a transport airport beyond the scope specified in the transport airport use permit, the regional civil aviation management agency at the location of the transport airport shall order correction and impose a fine of not less than 200,000 yuan but not more than 1,000,000 yuan.
违反本条例的规定，机场管理机构未经批准擅自关闭运输机场的，由运输机场所在地地区民用航空管理机构责令改正，处10万元以上50万元以下的罚款。
Where, in violation of these Regulations, an airport management agency closes a transport airport without approval, the regional civil aviation management agency at the location of the transport airport shall order correction and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan.
违反本条例的规定，机场管理机构因故不能保障民用航空器飞行安全，临时关闭运输机场，未及时通知有关空中交通管理部门并及时向社会公告，或者经批准关闭运输机场后未及时向社会公告的，由运输机场所在地地区民用航空管理机构责令改正，处2万元以上10万元以下的罚款。
Where, in violation of these Regulations, an airport management agency, due to inability to ensure the flight safety of civil aircraft, temporarily closes a transport airport but fails to timely notify the relevant air traffic control authority and make a public announcement in a timely manner, or after approved closure of the transport airport fails to make a public announcement in a timely manner, the regional civil aviation management agency at the location of the transport airport shall order correction and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan.
违反本条例的规定，机场管理机构未按照应急预案的要求进行应急救援演练或者未配备必要的应急救援设备和器材的，由地区民用航空管理机构责令改正，处1万元以上5万元以下的罚款。
Where, in violation of these Regulations, an airport management agency fails to conduct emergency rescue drills in accordance with the requirements of the emergency plan or fails to equip necessary emergency rescue equipment and devices, the regional civil aviation management agency shall order correction and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan.
违反本条例的规定，运输机场投入使用后不符合安全运营要求，机场管理机构拒不改正，或者经改正仍不符合安全运营要求的，由民用航空管理部门作出限制使用的决定；情节严重的，吊销运输机场使用许可证。
Where, in violation of these Regulations, after a transport airport is put into use, it does not meet the safety operation requirements, and the airport management agency refuses to correct, or after correction still does not meet the safety operation requirements, the civil aviation management department shall make a decision to restrict its use; if the circumstances are serious, the transport airport use permit shall be revoked.
机场管理机构未依照本条例的规定履行管理职责，造成运输机场地面事故、民用航空器飞行事故或者严重事故征候的，民用航空管理部门应当责令改正，处20万元以上100万元以下的罚款。
Where an airport management agency fails to perform its management duties in accordance with these Regulations, causing a ground accident at a transport airport, a flight accident of a civil aircraft, or a serious incident, the civil aviation management department shall order correction and impose a fine of not less than 200,000 yuan but not more than 1,000,000 yuan.
违反本条例的规定，机场管理机构在运输机场内使用不符合国家规定标准和相关技术规范的民用机场专用设备的，由运输机场所在地地区民用航空管理机构责令停止使用，处10万元以上50万元以下的罚款。
Where, in violation of these Regulations, an airport management agency uses civil airport special equipment within a transport airport that does not meet the national standards and relevant technical specifications, the regional civil aviation management agency at the location of the transport airport shall order cessation of use and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan.
违反本条例的规定，发生突发事件，机场管理机构、空中交通管理部门等单位未按照应急预案的要求及时、有效开展应急救援的，由地区民用航空管理机构责令改正，处10万元以上50万元以下的罚款。
In violation of the provisions of these Regulations, if an emergency occurs and the airport management agency, air traffic control department or other units fail to carry out emergency rescue timely and effectively in accordance with the requirements of the emergency plan, the regional civil aviation administration shall order correction and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan.
违反本条例的规定，未取得民用机场航空燃油供应安全运营许可证，在民用机场内从事航空燃油供应业务的，由民用机场所在地地区民用航空管理机构责令改正，处20万元以上100万元以下的罚款；有违法所得的，没收违法所得。
In violation of the provisions of these Regulations, if a party engages in aviation fuel supply business within a civil airport without obtaining the Civil Airport Aviation Fuel Supply Safety Operation Permit, the regional civil aviation administration at the location of the civil airport shall order correction and impose a fine of not less than 200,000 yuan but not more than 1,000,000 yuan; any illegal income shall be confiscated.
违反本条例的规定，航空燃油供应企业供应的航空燃油不符合航空燃油适航标准的，由民用机场所在地地区民用航空管理机构责令改正，处20万元以上100万元以下的罚款；情节严重的，吊销民用机场航空燃油供应安全运营许可证。
In violation of the provisions of these Regulations, if an aviation fuel supply enterprise supplies aviation fuel that does not meet the aviation fuel airworthiness standards, the regional civil aviation administration at the location of the civil airport shall order correction and impose a fine of not less than 200,000 yuan but not more than 1,000,000 yuan; if the circumstances are serious, the Civil Airport Aviation Fuel Supply Safety Operation Permit shall be revoked.
违反本条例的规定，运输机场航空燃油供应企业停止运输机场航空燃油供应业务，未提前90日告知地区民用航空管理机构、机场管理机构和相关航空运输企业的，由运输机场所在地地区民用航空管理机构处5万元以上25万元以下的罚款。
In violation of the provisions of these Regulations, if an aviation fuel supply enterprise at a transport airport ceases its aviation fuel supply business without notifying the regional civil aviation administration, the airport management agency and the relevant air transport enterprises at least 90 days in advance, the regional civil aviation administration at the location of the transport airport shall impose a fine of not less than 50,000 yuan but not more than 250,000 yuan.
违反本条例的规定，有下列情形之一的，由地区民用航空管理机构责令改正，处2万元以上10万元以下的罚款：
In violation of the provisions of these Regulations, under any of the following circumstances, the regional civil aviation administration shall order correction and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan:
(一)机场管理机构不按照国家规定的标准配备候机、餐饮、停车、医疗急救等设施、设备，并提供相应的服务；
(1) The airport management agency fails to equip facilities and equipment such as waiting lounges, catering, parking, and medical first aid in accordance with the standards prescribed by the state, and fails to provide corresponding services;
(二)航班发生延误时，机场管理机构、航空运输企业以及其他驻场单位不按照有关规定和服务承诺为旅客和货主提供相应的服务。
(2) When flight delays occur, the airport management agency, air transport enterprises and other on-site units fail to provide corresponding services to passengers and cargo owners in accordance with relevant regulations and service commitments.
违反本条例的规定，机场管理机构及其关联企业参与经营采取有偿转让经营权的方式经营的业务的，由地区民用航空管理机构责令改正，处10万元以上50万元以下的罚款；有违法所得的，没收违法所得。
In violation of the provisions of these Regulations, if an airport management agency or its affiliated enterprises participate in the operation of businesses that are operated by means of paid transfer of operating rights, the regional civil aviation administration shall order correction and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan; any illegal income shall be confiscated.
违反本条例的规定，机场管理机构未向民用航空管理部门报送运输机场规划、建设和生产运营的有关资料的，由民用航空管理部门责令改正；拒不改正的，处1万元以上5万元以下的罚款。
In violation of the provisions of these Regulations, if an airport management agency fails to submit relevant materials on the planning, construction and production operation of transport airports to the civil aviation administration department, the civil aviation administration department shall order correction; if it refuses to correct, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed.
违反本条例的规定，在民用机场净空保护区域内设置22万伏以上(含22万伏)的高压输电塔，未依照国务院民用航空主管部门的有关规定设置障碍灯或者标志的，由民用机场所在地地区民用航空管理机构责令改正，处10万元以上50万元以下的罚款。
In violation of the provisions of these Regulations, if a high-voltage transmission tower of 220 kV or above is erected within the obstacle limitation surface of a civil airport without installing obstacle lights or markings in accordance with the relevant provisions of the civil aviation authority under the State Council, the regional civil aviation administration at the location of the civil airport shall order correction and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan.
违反本条例的规定，有下列情形之一的，由民用机场所在地县级以上地方人民政府责令改正；情节严重的，处2万元以上10万元以下的罚款：
In violation of the provisions of these Regulations, under any of the following circumstances, the local people's government at or above the county level where the civil airport is located shall order correction; if the circumstances are serious, a fine of not less than 20,000 yuan but not more than 100,000 yuan shall be imposed:
(一)排放大量烟雾、粉尘、火焰、废气等影响飞行安全的物质；
(1) Discharging large amounts of smoke, dust, flames, exhaust gases, or other substances that affect flight safety;
(二)修建靶场、强烈爆炸物仓库等影响飞行安全的建筑物或者其他设施；
(2) Constructing shooting ranges, warehouses for highly explosive materials, or other buildings or facilities that affect flight safety;
(三)设置影响民用机场目视助航设施使用或者飞行员视线的灯光、标志或者物体；
(3) Installing lights, signs, or objects that affect the use of civil airport visual aids or the pilot's line of sight;
(四)种植影响飞行安全或者影响民用机场助航设施使用的植物；
(4) Planting vegetation that affects flight safety or the use of civil airport navigation aids;
(五)放飞影响飞行安全的鸟类、升放无人驾驶的自由气球、系留气球和其他升空物体；
(5) Releasing birds that affect flight safety, or releasing unmanned free balloons, tethered balloons, or other airborne objects;
(六)焚烧产生大量烟雾的农作物秸秆、垃圾等物质，或者燃放烟花、焰火；

(七)在民用机场围界外5米范围内，搭建建筑物、种植树木，或者从事挖掘、堆积物体等影响民用机场运营安全的活动；
(7) Within 5 meters outside the civil airport fence, constructing buildings, planting trees, or engaging in activities such as excavation or piling objects that affect the safe operation of the civil airport;
(八)国务院民用航空主管部门规定的其他影响民用机场净空保护的行为。
(8) Other acts that affect the protection of civil airport clearances as stipulated by the civil aviation authority of the State Council.
违反本条例的规定，使用的无线电台(站)或者其他仪器、装置，对民用航空无线电专用频率的正常使用产生干扰的，由民用机场所在地无线电管理机构责令改正；情节严重的，处2万元以上10万元以下的罚款。
In violation of the provisions of these Regulations, if the use of radio stations (or stations) or other instruments or devices causes interference with the normal use of civil aviation radio dedicated frequencies, the radio regulatory authority at the location of the civil airport shall order correction; if the circumstances are serious, a fine of not less than 20,000 yuan but not more than 100,000 yuan shall be imposed.
违反本条例的规定，在民用航空无线电台(站)电磁环境保护区域内从事下列活动的，由民用机场所在地县级以上地方人民政府责令改正；情节严重的，处2万元以上10万元以下的罚款：
Whoever, in violation of these Regulations, engages in any of the following activities within the electromagnetic environment protection area of a civil aviation radio station (site) shall be ordered by the local people's government at or above the county level where the civil airport is located to make corrections; if the circumstances are serious, a fine of not less than 20,000 yuan but not more than 100,000 yuan shall be imposed:
(一)修建架空高压输电线、架空金属线、铁路、公路、电力排灌站；
(1) Constructing overhead high-voltage transmission lines, overhead metal lines, railways, highways, or electric power drainage and irrigation stations;
(二)存放金属堆积物；
(2) Storing metal piles;
(三)从事掘土、采砂、采石等改变地形地貌的活动；
(3) Engaging in activities that alter the terrain or landform, such as digging earth, mining sand, or quarrying;
(四)国务院民用航空主管部门规定的其他影响民用机场电磁环境保护的行为。
(4) Other acts that affect the electromagnetic environment protection of civil airports as prescribed by the competent civil aviation authority of the State Council.
违反本条例的规定，在民用机场起降的民用航空器不符合国家有关航空器噪声和涡轮发动机排出物的适航标准的，由民用航空管理部门责令相关航空运输企业改正，可以处10万元以下的罚款；拒不改正的，处10万元以上50万元以下的罚款。
Whoever, in violation of these Regulations, operates a civil aircraft taking off or landing at a civil airport that does not meet the national airworthiness standards for aircraft noise and turbine engine emissions shall be ordered by the civil aviation administrative department to make corrections, and may be fined not more than 100,000 yuan; if the party refuses to make corrections, a fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed.
国家工作人员违反本条例的规定，有下列情形之一的，由有关部门依法给予处分：
Where a state functionary, in violation of these Regulations, commits any of the following acts, the relevant department shall impose sanctions according to law:
(一)不依照规定实施行政许可；
(1) Failing to grant administrative licenses in accordance with the provisions;
(二)不依法履行监督检查职责；
(2) Failing to perform supervision and inspection duties according to law;
(三)不依法实施行政强制措施或者行政处罚；
(3) Failing to implement administrative coercive measures or administrative penalties according to law.
(四)滥用职权、玩忽职守的其他行为。
(4) Other acts of abuse of power or dereliction of duty.
附则
Supplementary Provisions
本条例所称运输机场是指为从事旅客、货物运输等公共航空运输活动的民用航空器提供起飞、降落等服务的机场。
For the purposes of these Regulations, a transport airport refers to an airport that provides takeoff and landing services for civil aircraft engaged in public air transport activities such as passenger and cargo transportation.
本条例所称通用机场是指为从事工业、农业、林业、渔业和建筑业的作业飞行，以及医疗卫生、抢险救灾、气象探测、海洋监测、科学实验、教育训练、文化体育等飞行活动的民用航空器提供起飞、降落等服务的机场。
For the purposes of these Regulations, a general airport refers to an airport that provides takeoff and landing services for civil aircraft engaged in operational flights in industries such as industry, agriculture, forestry, fishery, and construction, as well as flight activities for medical rescue, disaster relief, meteorological detection, marine monitoring, scientific experiments, education and training, cultural and sports events, etc.
本条例所称飞行区指标为4D的运输机场是指可供基准飞行场地长度大于1800米、翼展在36米至52米之间、主起落架外轮外侧边间距在9米至14米之间的民用航空器起飞、降落的机场。
For the purposes of these Regulations, a transport airport with a flight area index of 4D refers to an airport that can accommodate the takeoff and landing of civil aircraft with a reference field length greater than 1,800 meters, a wingspan between 36 meters and 52 meters, and a main landing gear outer wheel spacing between 9 meters and 14 meters.
本条例所称飞行区指标为4E的运输机场是指可供基准飞行场地长度大于1800米、翼展在52米至65米之间、主起落架外轮外侧边间距在9米至14米之间的民用航空器起飞、降落的机场。
For the purposes of these Regulations, a transport airport with a flight area index of 4E refers to an airport that can accommodate the takeoff and landing of civil aircraft with a reference field length greater than 1,800 meters, a wingspan between 52 meters and 65 meters, and a main landing gear outer wheel spacing between 9 meters and 14 meters.
军民合用机场民用部分的管理除遵守本条例的有关规定外，还应当遵守国务院、中央军事委员会的有关规定。
The civil part of a civil-military airport shall, in addition to complying with the relevant provisions of these Regulations, also comply with the relevant provisions of the State Council and the Central Military Commission.
本条例自2009年7月1日起施行。
These Regulations shall come into force as of July 1, 2009.
