为了保障无线电管制的有效实施，维护国家安全和社会公共利益，制定本规定。
These regulations are formulated to ensure the effective implementation of radio control and to safeguard national security and social public interests.
本规定所称无线电管制，是指在特定时间和特定区域内，依法采取限制或者禁止无线电台(站)、无线电发射设备和辐射无线电波的非无线电设备的使用，以及对特定的无线电频率实施技术阻断等措施，对无线电波的发射、辐射和传播实施的强制性管理。
For the purposes of these regulations, 'radio control' refers to the compulsory management of the emission, radiation, and propagation of radio waves by taking measures such as restricting or prohibiting the use of radio stations (including fixed and mobile stations), radio transmitting equipment, and non-radio equipment that radiates radio waves, as well as implementing technical blocking measures on specific radio frequencies, within a specific time and specific area in accordance with the law.
根据维护国家安全、保障国家重大任务、处置重大突发事件等需要，国家可以实施无线电管制。
The state may implement radio control when necessary for safeguarding national security, ensuring major national tasks, or handling major emergencies.
在全国范围内或者跨省、自治区、直辖市实施无线电管制，由国务院和中央军事委员会决定。
Radio control implemented nationwide or across provinces, autonomous regions, or municipalities directly under the Central Government shall be decided by the State Council and the Central Military Commission.
在省、自治区、直辖市范围内实施无线电管制，由省、自治区、直辖市人民政府和相关军区决定，并报国务院和中央军事委员会备案。
Radio control implemented within a province, autonomous region, or municipality directly under the Central Government shall be decided by the people's government of that province, autonomous region, or municipality and the relevant military command, and shall be reported to the State Council and the Central Military Commission for record.
实施无线电管制，应当遵循科学筹划、合理实施的原则，最大限度地减轻无线电管制对国民经济和人民群众生产生活造成的影响。
The implementation of radio control shall follow the principles of scientific planning and reasonable implementation, minimizing the impact on the national economy and the production and daily life of the people.
国家无线电管理机构和军队电磁频谱管理机构，应当根据无线电管制需要，会同国务院有关部门，制定全国范围的无线电管制预案，报国务院和中央军事委员会批准。
The national radio regulatory authority and the military electromagnetic spectrum management authority shall, based on the needs of radio control and in conjunction with relevant departments of the State Council, formulate nationwide radio control plans, which shall be submitted to the State Council and the Central Military Commission for approval.
省、自治区、直辖市无线电管理机构和军区电磁频谱管理机构，应当根据全国范围的无线电管制预案，会同省、自治区、直辖市人民政府有关部门，制定本区域的无线电管制预案，报省、自治区、直辖市人民政府和军区批准。
The radio regulatory authorities of provinces, autonomous regions, and municipalities directly under the Central Government and the electromagnetic spectrum management authorities of military commands shall, based on the nationwide radio control plans and in conjunction with relevant departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government, formulate radio control plans for their respective regions, which shall be submitted to the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government and the military commands for approval.
决定实施无线电管制的机关应当在开始实施无线电管制10日前发布无线电管制命令，明确无线电管制的区域、对象、起止时间、频率范围以及其他有关要求。但是，紧急情况下需要立即实施无线电管制的除外。
The authority that decides to implement radio control shall issue a radio control order at least 10 days before the start of radio control, specifying the area, objects, start and end times, frequency range, and other relevant requirements of the radio control. However, this does not apply in emergency situations where radio control needs to be implemented immediately.
国务院和中央军事委员会决定在全国范围内或者跨省、自治区、直辖市实施无线电管制的，由国家无线电管理机构和军队电磁频谱管理机构会同国务院公安等有关部门组成无线电管制协调机构，负责无线电管制的组织、协调工作。
When the State Council and the Central Military Commission decide to implement radio control nationwide or across provinces, autonomous regions, or municipalities directly under the Central Government, the national radio regulatory authority and the military electromagnetic spectrum management authority shall, together with the public security and other relevant departments of the State Council, form a radio control coordination body responsible for the organization and coordination of radio control.
在省、自治区、直辖市范围内实施无线电管制的，由省、自治区、直辖市无线电管理机构和军区电磁频谱管理机构会同公安等有关部门组成无线电管制协调机构，负责无线电管制的组织、协调工作。
When radio control is implemented within a province, autonomous region, or municipality directly under the Central Government, the radio regulatory authority of that province, autonomous region, or municipality and the electromagnetic spectrum management authority of the military command shall, together with the public security and other relevant departments, form a radio control coordination body responsible for the organization and coordination of radio control.
无线电管制协调机构应当根据无线电管制命令发布无线电管制指令。
The radio control coordination body shall issue radio control instructions based on the radio control order.
国家无线电管理机构和军队电磁频谱管理机构，省、自治区、直辖市无线电管理机构和军区电磁频谱管理机构，依照无线电管制指令，根据各自的管理职责，可以采取下列无线电管制措施：
The national radio regulatory authority and the military electromagnetic spectrum management authority, as well as the radio regulatory authorities of provinces, autonomous regions, and municipalities directly under the Central Government and the electromagnetic spectrum management authorities of military commands, may, in accordance with the radio control instructions and within their respective management responsibilities, take the following radio control measures:
(一)对无线电台(站)、无线电发射设备和辐射无线电波的非无线电设备进行清查、检测；
(1) Conduct inventory and inspection of radio stations (including fixed and mobile stations), radio transmitting equipment, and non-radio equipment that radiates radio waves;
(二)对电磁环境进行监测，对无线电台(站)、无线电发射设备和辐射无线电波的非无线电设备的使用情况进行监督；
(2) Monitor the electromagnetic environment and supervise the use of radio stations (including fixed and mobile stations), radio transmitting equipment, and non-radio equipment that radiates radio waves;
(三)采取电磁干扰等技术阻断措施；
(3) Take technical blocking measures such as electromagnetic interference;
(四)限制或者禁止无线电台(站)、无线电发射设备和辐射无线电波的非无线电设备的使用。
(4) Restrict or prohibit the use of radio stations (including fixed and mobile stations), radio transmitting equipment, and non-radio equipment that radiates radio waves.
实施无线电管制期间，无线电管制区域内拥有、使用或者管理无线电台(站)、无线电发射设备和辐射无线电波的非无线电设备的单位或者个人，应当服从无线电管制命令和无线电管制指令。
During the implementation of radio control, units or individuals that own, use, or manage radio stations (including fixed and mobile stations), radio transmitting equipment, and non-radio equipment that radiates radio waves within the radio control area shall comply with the radio control order and radio control instructions.
实施无线电管制期间，有关地方人民政府，交通运输、铁路、广播电视、气象、渔业、通信、电力等部门和单位，军队、武装警察部队的有关单位，应当协助国家无线电管理机构和军队电磁频谱管理机构或者省、自治区、直辖市无线电管理机构和军区电磁频谱管理机构实施无线电管制。
During the implementation of radio control, relevant local people's governments, departments and units of transportation, railways, radio and television, meteorology, fisheries, communications, electric power, and relevant units of the armed forces and the armed police forces shall assist the national radio regulatory authority and the military electromagnetic spectrum management authority, or the radio regulatory authorities of provinces, autonomous regions, and municipalities directly under the Central Government and the electromagnetic spectrum management authorities of military commands, in implementing radio control.
无线电管制结束，决定实施无线电管制的机关应当及时发布无线电管制结束通告；无线电管制命令已经明确无线电管制终止时间的，可以不再发布无线电管制结束通告。
Upon the conclusion of radio control, the authority that decided to implement radio control shall promptly issue a notice of termination of radio control; if the radio control order has already specified the termination time of radio control, a notice of termination of radio control may not be issued.
违反无线电管制命令和无线电管制指令的，由国家无线电管理机构或者省、自治区、直辖市无线电管理机构责令改正；拒不改正的，可以关闭、查封、暂扣或者拆除相关设备；情节严重的，吊销无线电台(站)执照和无线电频率使用许可证；违反治安管理规定的，由公安机关依法给予处罚。
Anyone who violates the radio control order or radio control instructions shall be ordered to correct by the national radio regulatory authority or the radio regulatory authority of the province, autonomous region, or municipality directly under the Central Government; if they refuse to correct, the relevant equipment may be shut down, sealed up, seized, or dismantled; if the circumstances are serious, the radio station (including fixed and mobile stations) license and the radio frequency use permit shall be revoked; if the violation constitutes a violation of public security administration, the public security authority shall impose a penalty in accordance with the law.
军队、武装警察部队的有关单位违反无线电管制命令和无线电管制指令的，由军队电磁频谱管理机构或者军区电磁频谱管理机构责令改正；情节严重的，依照中央军事委员会的有关规定，对直接负责的主管人员和其他直接责任人员给予处分。
If relevant units of the armed forces or the armed police forces violate the radio control order or radio control instructions, the military electromagnetic spectrum management authority or the electromagnetic spectrum management authority of the military command shall order them to correct; if the circumstances are serious, the directly responsible supervisors and other directly responsible personnel shall be disciplined in accordance with the relevant regulations of the Central Military Commission.
本规定自2010年11月1日起施行。
These regulations shall come into force as of November 1, 2010.
