总则
General Provisions
为了加强对规划的环境影响评价工作，提高规划的科学性，从源头预防环境污染和生态破坏，促进经济、社会和环境的全面协调可持续发展，根据《中华人民共和国环境影响评价法》，制定本条例。
These Regulations are formulated in accordance with the Environmental Impact Assessment Law of the People's Republic of China to strengthen the environmental impact assessment of plans, improve the scientific nature of plans, prevent environmental pollution and ecological damage from the source, and promote comprehensive, coordinated, and sustainable economic, social, and environmental development.
国务院有关部门、设区的市级以上地方人民政府及其有关部门，对其组织编制的土地利用的有关规划和区域、流域、海域的建设、开发利用规划(以下称综合性规划)，以及工业、农业、畜牧业、林业、能源、水利、交通、城市建设、旅游、自然资源开发的有关专项规划(以下称专项规划)，应当进行环境影响评价。
The relevant departments of the State Council, the local people's governments at or above the level of a city divided into districts and their relevant departments shall conduct environmental impact assessments on the land use plans and the construction, development, and utilization plans for regions, river basins, and sea areas (hereinafter referred to as comprehensive plans) that they organize to prepare, as well as on the relevant special plans for industry, agriculture, animal husbandry, forestry, energy, water conservancy, transportation, urban construction, tourism, and natural resources development (hereinafter referred to as special plans).
依照本条第一款规定应当进行环境影响评价的规划的具体范围，由国务院环境保护主管部门会同国务院有关部门拟订，报国务院批准后执行。
The specific scope of plans that shall undergo environmental impact assessment in accordance with the provisions of the first paragraph of this Article shall be formulated by the competent department of environmental protection under the State Council jointly with the relevant departments of the State Council, and shall be implemented after being reported to the State Council for approval.
对规划进行环境影响评价，应当遵循客观、公开、公正的原则。
Environmental impact assessment of plans shall follow the principles of objectivity, openness, and fairness.
国家建立规划环境影响评价信息共享制度。
The State shall establish a system for sharing information on planning environmental impact assessment.
县级以上人民政府及其有关部门应当对规划环境影响评价所需资料实行信息共享。
The people's governments at or above the county level and their relevant departments shall share information on the data required for planning environmental impact assessment.
规划环境影响评价所需的费用应当按照预算管理的规定纳入财政预算，严格支出管理，接受审计监督。
The expenses required for planning environmental impact assessment shall be included in the fiscal budget in accordance with budget management regulations, with strict expenditure management and subject to audit supervision.
任何单位和个人对违反本条例规定的行为或者对规划实施过程中产生的重大不良环境影响，有权向规划审批机关、规划编制机关或者环境保护主管部门举报。有关部门接到举报后，应当依法调查处理。
Any unit or individual has the right to report to the plan approval authority, the plan preparation authority, or the competent department of environmental protection any act that violates the provisions of these Regulations or any major adverse environmental impact arising during the implementation of a plan. Upon receiving such a report, the relevant department shall investigate and handle it in accordance with the law.
评价
Assessment
规划编制机关应当在规划编制过程中对规划组织进行环境影响评价。
The plan preparation authority shall organize an environmental impact assessment of the plan during the process of preparing the plan.
对规划进行环境影响评价，应当分析、预测和评估以下内容：
The environmental impact assessment of a plan shall analyze, predict, and evaluate the following contents:
(一)规划实施可能对相关区域、流域、海域生态系统产生的整体影响；
(1) The overall impact that the implementation of the plan may have on the ecosystems of the relevant regions, river basins, and sea areas;
(二)规划实施可能对环境和人群健康产生的长远影响；
(2) The long-term impact that the implementation of the plan may have on the environment and human health;
(三)规划实施的经济效益、社会效益与环境效益之间以及当前利益与长远利益之间的关系。
(3) The relationship between the economic, social, and environmental benefits of the plan implementation, as well as between current interests and long-term interests.
对规划进行环境影响评价，应当遵守有关环境保护标准以及环境影响评价技术导则和技术规范。
The environmental impact assessment of a plan shall comply with relevant environmental protection standards and the technical guidelines and technical specifications for environmental impact assessment.
规划环境影响评价技术导则由国务院环境保护主管部门会同国务院有关部门制定；规划环境影响评价技术规范由国务院有关部门根据规划环境影响评价技术导则制定，并抄送国务院环境保护主管部门备案。
The technical guidelines for planning environmental impact assessment shall be formulated by the competent department of environmental protection under the State Council jointly with the relevant departments of the State Council; the technical specifications for planning environmental impact assessment shall be formulated by the relevant departments of the State Council in accordance with the technical guidelines for planning environmental impact assessment and shall be submitted to the competent department of environmental protection under the State Council for record.
编制综合性规划，应当根据规划实施后可能对环境造成的影响，编写环境影响篇章或者说明。
When preparing a comprehensive plan, an environmental impact chapter or description shall be prepared based on the possible environmental impact after the plan is implemented.
编制专项规划，应当在规划草案报送审批前编制环境影响报告书。编制专项规划中的指导性规划，应当依照本条第一款规定编写环境影响篇章或者说明。
When preparing a special plan, an environmental impact report shall be prepared before submitting the draft plan for approval. When preparing a guiding plan within a special plan, an environmental impact chapter or description shall be prepared in accordance with the provisions of the first paragraph of this Article.
本条第二款所称指导性规划是指以发展战略为主要内容的专项规划。
The guiding plan referred to in the second paragraph of this Article means a special plan whose main content is a development strategy.
环境影响篇章或者说明应当包括下列内容：
The environmental impact chapter or description shall include the following contents:
(一)规划实施对环境可能造成影响的分析、预测和评估。主要包括资源环境承载能力分析、不良环境影响的分析和预测以及与相关规划的环境协调性分析。
(1) Analysis, prediction, and assessment of the possible environmental impact of the plan implementation, mainly including analysis of resource and environmental carrying capacity, analysis and prediction of adverse environmental impacts, and analysis of environmental compatibility with relevant plans.
(二)预防或者减轻不良环境影响的对策和措施。主要包括预防或者减轻不良环境影响的政策、管理或者技术等措施。
(2) Measures and measures to prevent or mitigate adverse environmental impacts, mainly including policy, management, or technical measures to prevent or mitigate adverse environmental impacts.
环境影响报告书除包括上述内容外，还应当包括环境影响评价结论。主要包括规划草案的环境合理性和可行性，预防或者减轻不良环境影响的对策和措施的合理性和有效性，以及规划草案的调整建议。
In addition to the above contents, the environmental impact report shall also include the environmental impact assessment conclusion, mainly including the environmental rationality and feasibility of the draft plan, the rationality and effectiveness of measures to prevent or mitigate adverse environmental impacts, and recommendations for adjustments to the draft plan.
环境影响篇章或者说明、环境影响报告书(以下称环境影响评价文件)，由规划编制机关编制或者组织规划环境影响评价技术机构编制。规划编制机关应当对环境影响评价文件的质量负责。
The environmental impact chapter or description and the environmental impact report (hereinafter referred to as environmental impact assessment documents) shall be prepared by the plan preparation authority or by a planning environmental impact assessment technical institution organized by the plan preparation authority. The plan preparation authority shall be responsible for the quality of the environmental impact assessment documents.
规划编制机关对可能造成不良环境影响并直接涉及公众环境权益的专项规划，应当在规划草案报送审批前，采取调查问卷、座谈会、论证会、听证会等形式，公开征求有关单位、专家和公众对环境影响报告书的意见。但是，依法需要保密的除外。
For special plans that may cause adverse environmental impacts and directly involve the environmental rights and interests of the public, the plan preparation authority shall, before submitting the draft plan for approval, publicly solicit opinions from relevant units, experts, and the public on the environmental impact report through methods such as questionnaires, seminars, demonstration meetings, and hearings, except where confidentiality is required by law.
有关单位、专家和公众的意见与环境影响评价结论有重大分歧的，规划编制机关应当采取论证会、听证会等形式进一步论证。
If there is a significant divergence between the opinions of relevant units, experts, and the public and the environmental impact assessment conclusion, the plan preparation authority shall conduct further demonstration through methods such as demonstration meetings and hearings.
规划编制机关应当在报送审查的环境影响报告书中附具对公众意见采纳与不采纳情况及其理由的说明。
The plan preparation authority shall attach to the environmental impact report submitted for review an explanation of the adoption and non-adoption of public opinions and the reasons therefor.
对已经批准的规划在实施范围、适用期限、规模、结构和布局等方面进行重大调整或者修订的，规划编制机关应当依照本条例的规定重新或者补充进行环境影响评价。
If an approved plan undergoes major adjustments or revisions in terms of implementation scope, applicable period, scale, structure, layout, etc., the plan preparation authority shall conduct a new or supplementary environmental impact assessment in accordance with the provisions of these Regulations.
审查
Review
规划编制机关在报送审批综合性规划草案和专项规划中的指导性规划草案时，应当将环境影响篇章或者说明作为规划草案的组成部分一并报送规划审批机关。未编写环境影响篇章或者说明的，规划审批机关应当要求其补充；未补充的，规划审批机关不予审批。
When submitting a draft comprehensive plan or a draft guiding plan within a special plan for approval, the plan preparation authority shall submit the environmental impact chapter or description as an integral part of the draft plan to the plan approval authority. If the environmental impact chapter or description has not been prepared, the plan approval authority shall require its supplementation; if not supplemented, the plan approval authority shall not approve the plan.
规划编制机关在报送审批专项规划草案时，应当将环境影响报告书一并附送规划审批机关审查；未附送环境影响报告书的，规划审批机关应当要求其补充；未补充的，规划审批机关不予审批。
When submitting a draft special plan for approval, the plan preparation authority shall attach the environmental impact report to the plan approval authority for review; if the environmental impact report is not attached, the plan approval authority shall require its supplementation; if not supplemented, the plan approval authority shall not approve the plan.
设区的市级以上人民政府审批的专项规划，在审批前由其环境保护主管部门召集有关部门代表和专家组成审查小组，对环境影响报告书进行审查。审查小组应当提交书面审查意见。
For special plans approved by the people's governments at or above the level of a city divided into districts, before approval, the competent department of environmental protection of that government shall convene a review panel composed of representatives from relevant departments and experts to review the environmental impact report. The review panel shall submit a written review opinion.
省级以上人民政府有关部门审批的专项规划，其环境影响报告书的审查办法，由国务院环境保护主管部门会同国务院有关部门制定。
The review method for environmental impact reports of special plans approved by the relevant departments of the people's governments at or above the provincial level shall be formulated by the competent department of environmental protection under the State Council jointly with the relevant departments of the State Council.
审查小组的专家应当从依法设立的专家库内相关专业的专家名单中随机抽取。但是，参与环境影响报告书编制的专家，不得作为该环境影响报告书审查小组的成员。
The experts on the review panel shall be randomly selected from the list of experts in relevant specialties from the expert database established in accordance with the law. However, experts who participated in the preparation of the environmental impact report shall not be members of the review panel for that environmental impact report.
审查小组中专家人数不得少于审查小组总人数的二分之一；少于二分之一的，审查小组的审查意见无效。
The number of experts on the review panel shall not be less than one-half of the total number of members of the review panel; if it is less than one-half, the review opinion of the review panel shall be invalid.
审查小组的成员应当客观、公正、独立地对环境影响报告书提出书面审查意见，规划审批机关、规划编制机关、审查小组的召集部门不得干预。
Members of the review panel shall objectively, fairly, and independently provide written review opinions on the environmental impact report, and the plan approval authority, the plan preparation authority, and the department convening the review panel shall not interfere.
审查意见应当包括下列内容：
The review opinion shall include the following contents:
(一)基础资料、数据的真实性；
(1) The authenticity of the basic data and information;
(二)评价方法的适当性；
(2) The appropriateness of the assessment method;
(三)环境影响分析、预测和评估的可靠性；
(3) The reliability of the environmental impact analysis, prediction, and assessment;
(四)预防或者减轻不良环境影响的对策和措施的合理性和有效性；
(4) The rationality and effectiveness of measures to prevent or mitigate adverse environmental impacts;
(五)公众意见采纳与不采纳情况及其理由的说明的合理性；
(5) The reasonableness of the explanation of the adoption and non-adoption of public opinions and the reasons therefor;
(六)环境影响评价结论的科学性。
(6) The scientific nature of the environmental impact assessment conclusion.
审查意见应当经审查小组四分之三以上成员签字同意。审查小组成员有不同意见的，应当如实记录和反映。
The review opinion shall be signed by more than three-quarters of the members of the review panel. If a member of the review panel has a different opinion, it shall be truthfully recorded and reflected.
有下列情形之一的，审查小组应当提出对环境影响报告书进行修改并重新审查的意见：
Under any of the following circumstances, the review panel shall propose an opinion that the environmental impact report be modified and re-reviewed:
(一)基础资料、数据失实的；
(1) The basic data or information is inaccurate;
(二)评价方法选择不当的；
(2) The assessment method is improperly selected;
(三)对不良环境影响的分析、预测和评估不准确、不深入，需要进一步论证的；
(3) The analysis, prediction, and assessment of adverse environmental impacts are inaccurate or insufficient, requiring further demonstration;
(四)预防或者减轻不良环境影响的对策和措施存在严重缺陷的；
(4) There are serious defects in the measures to prevent or mitigate adverse environmental impacts;
(五)环境影响评价结论不明确、不合理或者错误的；
(5) The environmental impact assessment conclusion is unclear, unreasonable, or erroneous;
(六)未附具对公众意见采纳与不采纳情况及其理由的说明，或者不采纳公众意见的理由明显不合理的；
(6) The explanation of the adoption and non-adoption of public opinions and the reasons therefor is not attached, or the reasons for not adopting public opinions are obviously unreasonable;
(七)内容存在其他重大缺陷或者遗漏的。
(7) There are other major defects or omissions in the content.
有下列情形之一的，审查小组应当提出不予通过环境影响报告书的意见：
Under any of the following circumstances, the review panel shall propose an opinion that the environmental impact report not be approved:
(一)依据现有知识水平和技术条件，对规划实施可能产生的不良环境影响的程度或者范围不能作出科学判断的；
(1) Based on the current level of knowledge and technical conditions, a scientific judgment cannot be made on the extent or scope of adverse environmental impacts that may result from the implementation of the plan;
(二)规划实施可能造成重大不良环境影响，并且无法提出切实可行的预防或者减轻对策和措施的。
(2) The implementation of the plan may cause major adverse environmental impacts, and no practical measures to prevent or mitigate them can be proposed.
规划审批机关在审批专项规划草案时，应当将环境影响报告书结论以及审查意见作为决策的重要依据。
When approving a draft special plan, the plan approval authority shall take the conclusion of the environmental impact report and the review opinion as important bases for decision-making.
规划审批机关对环境影响报告书结论以及审查意见不予采纳的，应当逐项就不予采纳的理由作出书面说明，并存档备查。有关单位、专家和公众可以申请查阅；但是，依法需要保密的除外。
If the plan approval authority does not adopt the conclusion of the environmental impact report or the review opinion, it shall provide a written explanation item by item of the reasons for non-adoption, and keep it on file for future reference. Relevant units, experts, and the public may apply to inspect it; however, except where confidentiality is required by law.
已经进行环境影响评价的规划包含具体建设项目的，规划的环境影响评价结论应当作为建设项目环境影响评价的重要依据，建设项目环境影响评价的内容可以根据规划环境影响评价的分析论证情况予以简化。
If a plan that has undergone environmental impact assessment includes specific construction projects, the environmental impact assessment conclusion of the plan shall serve as an important basis for the environmental impact assessment of the construction project, and the content of the environmental impact assessment of the construction project may be simplified based on the analysis and demonstration of the planning environmental impact assessment.
跟踪评价
Tracking Evaluation
对环境有重大影响的规划实施后，规划编制机关应当及时组织规划环境影响的跟踪评价，将评价结果报告规划审批机关，并通报环境保护等有关部门。
After the implementation of a plan that has a significant impact on the environment, the plan preparation authority shall promptly organize a tracking evaluation of the plan's environmental impact, report the evaluation results to the plan approval authority, and notify the competent department of environmental protection and other relevant departments.
规划环境影响的跟踪评价应当包括下列内容：
The tracking evaluation of the plan's environmental impact shall include the following contents:
(一)规划实施后实际产生的环境影响与环境影响评价文件预测可能产生的环境影响之间的比较分析和评估；
(1) Comparative analysis and assessment between the actual environmental impact after plan implementation and the environmental impact predicted in the environmental impact assessment documents;
(二)规划实施中所采取的预防或者减轻不良环境影响的对策和措施有效性的分析和评估；
(2) Analysis and assessment of the effectiveness of measures taken during plan implementation to prevent or mitigate adverse environmental impacts;
(三)公众对规划实施所产生的环境影响的意见；
(3) Public opinions on the environmental impact of plan implementation;
(四)跟踪评价的结论。
(4) Conclusions of the tracking evaluation.
规划编制机关对规划环境影响进行跟踪评价，应当采取调查问卷、现场走访、座谈会等形式征求有关单位、专家和公众的意见。
When conducting a tracking evaluation of a plan's environmental impact, the plan preparation authority shall solicit opinions from relevant units, experts, and the public through methods such as questionnaires, on-site visits, and seminars.
规划实施过程中产生重大不良环境影响的，规划编制机关应当及时提出改进措施，向规划审批机关报告，并通报环境保护等有关部门。
If major adverse environmental impacts occur during the implementation of a plan, the plan preparation authority shall promptly propose improvement measures, report to the plan approval authority, and notify the competent department of environmental protection and other relevant departments.
环境保护主管部门发现规划实施过程中产生重大不良环境影响的，应当及时进行核查。经核查属实的，向规划审批机关提出采取改进措施或者修订规划的建议。
If the competent department of environmental protection discovers that major adverse environmental impacts occur during the implementation of a plan, it shall promptly conduct verification. If verified, it shall propose to the plan approval authority to take improvement measures or revise the plan.
规划审批机关在接到规划编制机关的报告或者环境保护主管部门的建议后，应当及时组织论证，并根据论证结果采取改进措施或者对规划进行修订。
Upon receiving the report from the plan preparation authority or the proposal from the competent department of environmental protection, the plan approval authority shall promptly organize a demonstration and, based on the demonstration results, take improvement measures or revise the plan.
规划实施区域的重点污染物排放总量超过国家或者地方规定的总量控制指标的，应当暂停审批该规划实施区域内新增该重点污染物排放总量的建设项目的环境影响评价文件。
If the total discharge of key pollutants in the area where a plan is implemented exceeds the total discharge control indicators set by the State or local authorities, the approval of environmental impact assessment documents for construction projects that would increase the discharge of such key pollutants in that area shall be suspended.
法律责任
Legal Liability
规划编制机关在组织环境影响评价时弄虚作假或者有失职行为，造成环境影响评价严重失实的，对直接负责的主管人员和其他直接责任人员，依法给予处分。
If the plan preparation authority engages in fraud or dereliction of duty when organizing an environmental impact assessment, resulting in serious inaccuracy of the environmental impact assessment, the directly responsible person in charge and other directly responsible persons shall be given sanctions in accordance with the law.
规划审批机关有下列行为之一的，对直接负责的主管人员和其他直接责任人员，依法给予处分：
If the plan approval authority commits any of the following acts, the directly responsible person in charge and other directly responsible persons shall be given sanctions in accordance with the law:
(一)对依法应当编写而未编写环境影响篇章或者说明的综合性规划草案和专项规划中的指导性规划草案，予以批准的；
(1) Approving a draft comprehensive plan or a draft guiding plan within a special plan that should have but has not prepared an environmental impact chapter or description;
(二)对依法应当附送而未附送环境影响报告书的专项规划草案，或者对环境影响报告书未经审查小组审查的专项规划草案，予以批准的。
(2) Approving a draft special plan that should have but has not attached an environmental impact report, or approving a draft special plan whose environmental impact report has not been reviewed by a review panel.
审查小组的召集部门在组织环境影响报告书审查时弄虚作假或者滥用职权，造成环境影响评价严重失实的，对直接负责的主管人员和其他直接责任人员，依法给予处分。
If the department convening the review panel engages in fraud or abuses its power when organizing the review of an environmental impact report, resulting in serious inaccuracy of the environmental impact assessment, the directly responsible person in charge and other directly responsible persons shall be given sanctions in accordance with the law.
审查小组的专家在环境影响报告书审查中弄虚作假或者有失职行为，造成环境影响评价严重失实的，由设立专家库的环境保护主管部门取消其入选专家库的资格并予以公告；审查小组的部门代表有上述行为的，依法给予处分。
If an expert on the review panel engages in fraud or dereliction of duty during the review of an environmental impact report, resulting in serious inaccuracy of the environmental impact assessment, the competent department of environmental protection that established the expert database shall cancel the expert's qualification to be included in the expert database and make a public announcement; if a department representative on the review panel commits the above act, sanctions shall be given in accordance with the law.
规划环境影响评价技术机构弄虚作假或者有失职行为，造成环境影响评价文件严重失实的，由国务院环境保护主管部门予以通报，处所收费用1倍以上3倍以下的罚款；构成犯罪的，依法追究刑事责任。
If a planning environmental impact assessment technical institution engages in fraud or dereliction of duty, resulting in serious inaccuracy of the environmental impact assessment documents, the competent department of environmental protection under the State Council shall issue a notice of criticism, impose a fine of not less than one time but not more than three times the fees charged; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
附则
Supplementary Provisions
省、自治区、直辖市人民政府可以根据本地的实际情况，要求本行政区域内的县级人民政府对其组织编制的规划进行环境影响评价。具体办法由省、自治区、直辖市参照《中华人民共和国环境影响评价法》和本条例的规定制定。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government may, based on local actual conditions, require the people's governments at the county level within their administrative regions to conduct environmental impact assessments on the plans they organize to prepare. Specific measures shall be formulated by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government with reference to the Environmental Impact Assessment Law of the People's Republic of China and these Regulations.
本条例自2009年10月1日起施行。
These Regulations shall come into effect as of October 1, 2009.
