为了规范企业、事业单位(以下简称单位)内部治安保卫工作，保护公民人身、财产安全和公共财产安全，维护单位的工作、生产、经营、教学和科研秩序，制定本条例。
These Regulations are formulated to standardize the internal security and protection work of enterprises and institutions (hereinafter referred to as units), to protect the personal and property safety of citizens and public property, and to maintain the order of work, production, operation, teaching, and scientific research within the units.
单位内部治安保卫工作贯彻预防为主、单位负责、突出重点、保障安全的方针。
The internal security and protection work of units shall implement the policy of prevention first, unit responsibility, highlighting key points, and ensuring safety.
单位内部治安保卫工作应当突出保护单位内人员的人身安全，单位不得以经济效益、财产安全或者其他任何借口忽视人身安全。
The internal security and protection work of units shall prioritize the protection of personal safety of personnel within the unit. Units shall not neglect personal safety on any pretext such as economic benefits or property safety.
国务院公安部门指导、监督全国的单位内部治安保卫工作，对行业、系统有监管职责的国务院有关部门指导、检查本行业、本系统的单位内部治安保卫工作；县级以上地方各级人民政府公安机关指导、监督本行政区域内的单位内部治安保卫工作，对行业、系统有监管职责的县级以上地方各级人民政府有关部门指导、检查本行政区域内的本行业、本系统的单位内部治安保卫工作，及时解决单位内部治安保卫工作中的突出问题。
The public security department of the State Council shall guide and supervise the national internal security and protection work of units. The relevant departments of the State Council with supervisory responsibilities over industries and systems shall guide and inspect the internal security and protection work of units within their respective industries and systems. The public security organs of local people's governments at or above the county level shall guide and supervise the internal security and protection work of units within their administrative regions. The relevant departments of local people's governments at or above the county level with supervisory responsibilities over industries and systems shall guide and inspect the internal security and protection work of units within their respective industries and systems in their administrative regions, and promptly resolve prominent issues in the internal security and protection work of units.
县级以上地方各级人民政府应当加强对本行政区域内的单位内部治安保卫工作的领导，督促公安机关和有关部门依法履行职责，并及时协调解决单位内部治安保卫工作中的重大问题。
Local people's governments at or above the county level shall strengthen leadership over the internal security and protection work of units within their administrative regions, supervise the public security organs and relevant departments to perform their duties according to law, and promptly coordinate and resolve major issues in the internal security and protection work of units.
单位的主要负责人对本单位的内部治安保卫工作负责。
The principal responsible person of a unit shall be responsible for the internal security and protection work of that unit.
单位应当根据内部治安保卫工作需要，设置治安保卫机构或者配备专职、兼职治安保卫人员。
Units shall, based on the needs of internal security and protection work, establish security and protection institutions or assign full-time or part-time security and protection personnel.
治安保卫重点单位应当设置与治安保卫任务相适应的治安保卫机构，配备专职治安保卫人员，并将治安保卫机构的设置和人员的配备情况报主管公安机关备案。
Key security and protection units shall establish security and protection institutions commensurate with the security and protection tasks, assign full-time security and protection personnel, and report the establishment of the security and protection institution and the assignment of personnel to the competent public security organ for record.
单位内部治安保卫工作的要求是：
The requirements for internal security and protection work of units are:
(一)有适应单位具体情况的内部治安保卫制度、措施和必要的治安防范设施；
(1) Having internal security and protection systems, measures, and necessary security prevention facilities adapted to the specific circumstances of the unit;
(二)单位范围内的治安保卫情况有人检查，重要部位得到重点保护，治安隐患及时得到排查；
(2) The security and protection situation within the unit's scope is inspected, important parts receive key protection, and security hazards are promptly investigated;
(三)单位范围内的治安隐患和问题及时得到处理，发生治安案件、涉嫌刑事犯罪的案件及时得到处置。
(3) Security hazards and problems within the unit's scope are promptly addressed, and the occurrence of public security cases or suspected criminal cases is promptly handled.
单位制定的内部治安保卫制度应当包括下列内容：
The internal security and protection systems formulated by units shall include the following contents:
(一)门卫、值班、巡查制度；
(1) Gatekeeping, duty, and patrol systems;
(二)工作、生产、经营、教学、科研等场所的安全管理制度；
(2) Safety management systems for workplaces, production, operation, teaching, scientific research, and other premises;
(三)现金、票据、印鉴、有价证券等重要物品使用、保管、储存、运输的安全管理制度；
(3) Safety management systems for the use, storage, and transportation of important items such as cash, bills, seals, and securities;
(四)单位内部的消防、交通安全管理制度；
(4) Fire safety and traffic safety management systems within the unit;
(五)治安防范教育培训制度；
(5) Security prevention education and training systems;
(六)单位内部发生治安案件、涉嫌刑事犯罪案件的报告制度；
(6) Reporting systems for public security cases and suspected criminal cases occurring within the unit;
(七)治安保卫工作检查、考核及奖惩制度；
(7) Inspection, assessment, and reward/punishment systems for security and protection work;
(八)存放有爆炸性、易燃性、放射性、毒害性、传染性、腐蚀性等危险物品和传染性菌种、毒种以及武器弹药的单位，还应当有相应的安全管理制度；
(8) For units storing dangerous items such as explosive, flammable, radioactive, toxic, infectious, corrosive substances, and infectious bacterial strains, virus strains, and weapons and ammunition, corresponding safety management systems shall also be in place;
(九)其他有关的治安保卫制度。
(9) Other relevant security and protection systems.
单位制定的内部治安保卫制度不得与法律、法规、规章的规定相抵触。
The internal security and protection systems formulated by units shall not conflict with the provisions of laws, regulations, and rules.
单位内部治安保卫人员应当接受有关法律知识和治安保卫业务、技能以及相关专业知识的培训、考核。
Internal security and protection personnel of units shall receive training and assessment in relevant legal knowledge, security and protection business, skills, and related professional knowledge.
单位内部治安保卫人员应当依法、文明履行职责，不得侵犯他人合法权益。治安保卫人员依法履行职责的行为受法律保护。
Internal security and protection personnel of units shall perform their duties lawfully and civilly, and shall not infringe upon the lawful rights and interests of others. The lawful performance of duties by security and protection personnel is protected by law.
单位内部治安保卫机构、治安保卫人员应当履行下列职责：
Internal security and protection institutions and security and protection personnel of units shall perform the following duties:
(一)开展治安防范宣传教育，并落实本单位的内部治安保卫制度和治安防范措施；
(1) Conduct publicity and education on security prevention, and implement the unit's internal security and protection systems and security prevention measures;
(二)根据需要，检查进入本单位人员的证件，登记出入的物品和车辆；
(2) As needed, check the identification of persons entering the unit, and register items and vehicles entering and leaving;
(三)在单位范围内进行治安防范巡逻和检查，建立巡逻、检查和治安隐患整改记录；
(3) Conduct security prevention patrols and inspections within the unit's scope, and maintain records of patrols, inspections, and rectification of security hazards;
(四)维护单位内部的治安秩序，制止发生在本单位的违法行为，对难以制止的违法行为以及发生的治安案件、涉嫌刑事犯罪案件应当立即报警，并采取措施保护现场，配合公安机关的侦查、处置工作；
(4) Maintain public security order within the unit, stop illegal acts occurring within the unit, immediately report illegal acts that are difficult to stop, as well as public security cases and suspected criminal cases, take measures to protect the scene, and cooperate with the public security organs in investigation and handling;
(五)督促落实单位内部治安防范设施的建设和维护。
(5) Supervise and implement the construction and maintenance of internal security prevention facilities of the unit.
在单位管理范围内的人员，应当遵守单位的内部治安保卫制度。
Persons within the management scope of a unit shall comply with the unit's internal security and protection systems.
关系全国或者所在地区国计民生、国家安全和公共安全的单位是治安保卫重点单位。治安保卫重点单位由县级以上地方各级人民政府公安机关按照下列范围提出，报本级人民政府确定：
Units that are related to the national economy and people's livelihood, national security, and public security of the whole country or the local region are key security and protection units. Key security and protection units shall be proposed by the public security organs of local people's governments at or above the county level within the following scope and submitted to the people's government at the same level for determination:
(一)广播电台、电视台、通讯社等重要新闻单位；
(1) Important news units such as radio stations, television stations, and news agencies;
(二)机场、港口、大型车站等重要交通枢纽；
(2) Important transportation hubs such as airports, ports, and large railway stations;
(三)国防科技工业重要产品的研制、生产单位；
(3) Research and production units of important products for national defense science, technology, and industry;
(四)电信、邮政、金融单位；
(4) Telecommunications, postal, and financial units;
(五)大型能源动力设施、水利设施和城市水、电、燃气、热力供应设施；
(5) Large energy and power facilities, water conservancy facilities, and urban water, electricity, gas, and heat supply facilities;
(六)大型物资储备单位和大型商贸中心；
(6) Large material storage units and large commercial centers;
(七)教育、科研、医疗单位和大型文化、体育场所；
(7) Educational, scientific research, medical units, and large cultural and sports venues;
(八)博物馆、档案馆和重点文物保护单位；
(8) Museums, archives, and key cultural relic protection units;
(九)研制、生产、销售、储存危险物品或者实验、保藏传染性菌种、毒种的单位；
(9) Units that research, produce, sell, store dangerous items, or experiment with and preserve infectious bacterial strains and virus strains;
(十)国家重点建设工程单位；
(10) National key construction project units;
(十一)其他需要列为治安保卫重点的单位。
(11) Other units that need to be listed as key security and protection units.
治安保卫重点单位应当遵守本条例对单位治安保卫工作的一般规定和对治安保卫重点单位的特别规定。
Key security and protection units shall comply with the general provisions of these Regulations on unit security and protection work and the special provisions for key security and protection units.
治安保卫重点单位应当确定本单位的治安保卫重要部位，按照有关国家标准对重要部位设置必要的技术防范设施，并实施重点保护。
Key security and protection units shall determine the important security and protection parts of their units, install necessary technical prevention facilities for important parts in accordance with relevant national standards, and implement key protection.
治安保卫重点单位应当在公安机关指导下制定单位内部治安突发事件处置预案，并定期演练。
Key security and protection units shall, under the guidance of public security organs, formulate contingency plans for handling internal security emergencies and conduct regular drills.
公安机关对本行政区域内的单位内部治安保卫工作履行下列职责：
Public security organs shall perform the following duties regarding the internal security and protection work of units within their administrative regions:
(一)指导单位制定、完善内部治安保卫制度，落实治安防范措施，指导治安保卫人员队伍建设和治安保卫重点单位的治安保卫机构建设；
(1) Guide units in formulating and improving internal security and protection systems, implementing security prevention measures, and guide the construction of security and protection personnel teams and the establishment of security and protection institutions in key security and protection units;
(二)检查、指导单位的内部治安保卫工作，发现单位有违反本条例规定的行为或者治安隐患，及时下达整改通知书，责令限期整改；
(2) Inspect and guide the internal security and protection work of units, and if any act violating these Regulations or security hazards are found, promptly issue a rectification notice and order rectification within a time limit;
(三)接到单位内部发生治安案件、涉嫌刑事犯罪案件的报警，及时出警，依法处置。
(3) Upon receiving reports of public security cases or suspected criminal cases occurring within a unit, promptly dispatch police and handle them according to law.
对认真落实治安防范措施，严格执行治安保卫工作制度，在单位内部治安保卫工作中取得显著成绩的单位和个人，有关人民政府、公安机关和有关部门应当给予表彰、奖励。
Units and individuals that earnestly implement security prevention measures, strictly implement security and protection work systems, and achieve remarkable results in internal security and protection work shall be commended and rewarded by the relevant people's governments, public security organs, and relevant departments.
单位治安保卫人员因履行治安保卫职责伤残或者死亡的，依照国家有关工伤保险、评定伤残、批准烈士的规定给予相应的待遇。
If a unit's security and protection personnel are injured or die due to performing security and protection duties, they shall be given corresponding treatment in accordance with the state's provisions on work-related injury insurance, disability assessment, and approval of martyr status.
单位违反本条例的规定，存在治安隐患的，公安机关应当责令限期整改，并处警告；单位逾期不整改，造成公民人身伤害、公私财产损失，或者严重威胁公民人身安全、公私财产安全或者公共安全的，对单位处1万元以上10万元以下的罚款，对单位主要负责人和其他直接责任人员处500元以上5000元以下的罚款，并可以建议有关组织对单位主要负责人和其他直接责任人员依法给予处分；情节严重，构成犯罪的，依法追究刑事责任。
If a unit violates the provisions of these Regulations and has security hazards, the public security organ shall order rectification within a time limit and give a warning; if the unit fails to rectify within the time limit, causing personal injury or property loss to citizens, or seriously threatening the personal safety, property safety, or public safety of citizens, the unit shall be fined not less than 10,000 yuan but not more than 100,000 yuan, and the principal responsible person and other directly responsible persons of the unit shall be fined not less than 500 yuan but not more than 5,000 yuan, and it may be recommended that the relevant organization impose sanctions on the principal responsible person and other directly responsible persons according to law; if the circumstances are serious enough to constitute a crime, criminal liability shall be pursued according to law.
单位治安保卫人员在履行职责时侵害他人合法权益的，应当赔礼道歉，给他人造成损害的，单位应当承担赔偿责任。单位赔偿后，有权责令因故意或者重大过失造成侵权的治安保卫人员承担部分或者全部赔偿的费用；对故意或者重大过失造成侵权的治安保卫人员，单位应当依法给予处分。治安保卫人员侵害他人合法权益的行为属于受单位负责人指使、胁迫的，对单位负责人依法给予处分，并由其承担赔偿责任；情节严重，构成犯罪的，依法追究刑事责任。
If a unit's security and protection personnel infringe upon the lawful rights and interests of others while performing their duties, they shall apologize; if damage is caused to others, the unit shall bear compensation liability. After compensation, the unit has the right to order the security and protection personnel who caused the infringement intentionally or through gross negligence to bear part or all of the compensation costs; for security and protection personnel who caused infringement intentionally or through gross negligence, the unit shall impose sanctions according to law. If the act of infringement by security and protection personnel is instigated or coerced by the unit's responsible person, the unit's responsible person shall be sanctioned according to law and bear compensation liability; if the circumstances are serious enough to constitute a crime, criminal liability shall be pursued according to law.
公安机关接到单位报警后不依法履行职责，致使公民人身、财产和公共财产遭受损失，或者有其他玩忽职守、滥用职权行为的，对直接负责的主管人员和其他直接责任人员依法给予行政处分；情节严重，构成犯罪的，依法追究刑事责任。
If a public security organ fails to perform its duties according to law after receiving a report from a unit, resulting in loss of personal, property, or public property, or commits other acts of dereliction of duty or abuse of power, the directly responsible supervisors and other directly responsible personnel shall be given administrative sanctions according to law; if the circumstances are serious enough to constitute a crime, criminal liability shall be pursued according to law.
对行业、系统有监管职责的人民政府有关部门在指导、检查本行业、本系统的单位内部治安保卫工作过程中有玩忽职守、滥用职权行为的，参照前款规定处罚。
If the relevant departments of the people's government with supervisory responsibilities over industries and systems commit acts of dereliction of duty or abuse of power in the process of guiding and inspecting the internal security and protection work of units within their respective industries and systems, they shall be punished by reference to the preceding paragraph.
机关、团体的内部治安保卫工作参照本条例的有关规定执行。
The internal security and protection work of state organs and organizations shall be implemented by reference to the relevant provisions of these Regulations.
高等学校治安保卫工作的具体规定由国务院另行制定。
Specific provisions on the security and protection work of institutions of higher education shall be formulated separately by the State Council.
本条例自2004年12月1日起施行。
These Regulations shall come into force as of December 1, 2004.
