Investigation of Electric Power Safety Accidents

总则
General Provisions
为了加强电力安全事故的应急处置工作，规范电力安全事故的调查处理，控制、减轻和消除电力安全事故损害，制定本条例。
These Regulations are formulated to strengthen the emergency response work for electric power safety accidents, standardize the investigation and handling of electric power safety accidents, and control, mitigate, and eliminate the damage caused by electric power safety accidents.
本条例所称电力安全事故，是指电力生产或者电网运行过程中发生的影响电力系统安全稳定运行或者影响电力正常供应的事故(包括热电厂发生的影响热力正常供应的事故)。
For the purposes of these Regulations, "electric power safety accidents" refer to accidents that occur during electric power production or grid operation that affect the safe and stable operation of the electric power system or affect the normal supply of electric power (including accidents at thermal power plants that affect the normal supply of heat).
根据电力安全事故(以下简称事故)影响电力系统安全稳定运行或者影响电力(热力)正常供应的程度，事故分为特别重大事故、重大事故、较大事故和一般事故。事故等级划分标准由本条例附表列示。事故等级划分标准的部分项目需要调整的，由国务院电力监管机构提出方案，报国务院批准。
According to the degree to which an electric power safety accident (hereinafter referred to as an "accident") affects the safe and stable operation of the electric power system or affects the normal supply of electric power (heat), accidents are classified into particularly major accidents, major accidents, relatively major accidents, and general accidents. The classification standards for accident grades are set forth in the schedule attached to these Regulations. If some items in the accident classification standards need adjustment, the electric power regulatory authority of the State Council shall propose a plan and submit it to the State Council for approval.
由独立的或者通过单一输电线路与外省连接的省级电网供电的省级人民政府所在地城市，以及由单一输电线路或者单一变电站供电的其他设区的市、县级市，其电网减供负荷或者造成供电用户停电的事故等级划分标准，由国务院电力监管机构另行制定，报国务院批准。
For cities where the people's government of a provincial-level administrative region is located and which are supplied by a provincial-level power grid that is independent or connected to other provinces through a single transmission line, as well as other cities divided into districts and county-level cities supplied by a single transmission line or a single substation, the classification standards for accidents involving reduction of grid supply load or power outage to users shall be separately formulated by the electric power regulatory authority of the State Council and submitted to the State Council for approval.
国务院电力监管机构应当加强电力安全监督管理，依法建立健全事故应急处置和调查处理的各项制度，组织或者参与事故的调查处理。
The electric power regulatory authority of the State Council shall strengthen the supervision and management of electric power safety, establish and improve various systems for accident emergency response and investigation in accordance with the law, and organize or participate in the investigation and handling of accidents.
国务院电力监管机构、国务院能源主管部门和国务院其他有关部门、地方人民政府及有关部门按照国家规定的权限和程序，组织、协调、参与事故的应急处置工作。
The electric power regulatory authority of the State Council, the energy administration department of the State Council, other relevant departments of the State Council, local people's governments, and relevant departments shall organize, coordinate, and participate in the emergency response work for accidents in accordance with the authority and procedures prescribed by the state.
电力企业、电力用户以及其他有关单位和个人，应当遵守电力安全管理规定，落实事故预防措施，防止和避免事故发生。
Electric power enterprises, electric power users, and other relevant entities and individuals shall comply with electric power safety management regulations, implement accident prevention measures, and prevent and avoid the occurrence of accidents.
县级以上地方人民政府有关部门确定的重要电力用户，应当按照国务院电力监管机构的规定配置自备应急电源，并加强安全使用管理。
Important electric power users identified by the relevant departments of local people's governments at or above the county level shall equip themselves with self-provided emergency power sources in accordance with the regulations of the electric power regulatory authority of the State Council and strengthen the management of their safe use.
事故发生后，电力企业和其他有关单位应当按照规定及时、准确报告事故情况，开展应急处置工作，防止事故扩大，减轻事故损害。电力企业应当尽快恢复电力生产、电网运行和电力(热力)正常供应。
After an accident occurs, electric power enterprises and other relevant entities shall promptly and accurately report the accident situation in accordance with regulations, carry out emergency response work, prevent the accident from expanding, and mitigate the damage caused by the accident. Electric power enterprises shall restore electric power production, grid operation, and normal supply of electric power (heat) as soon as possible.
任何单位和个人不得阻挠和干涉对事故的报告、应急处置和依法调查处理。
No entity or individual may obstruct or interfere with the reporting, emergency response, or lawful investigation and handling of an accident.
事故报告
Accident Reporting
事故发生后，事故现场有关人员应当立即向发电厂、变电站运行值班人员、电力调度机构值班人员或者本企业现场负责人报告。有关人员接到报告后，应当立即向上一级电力调度机构和本企业负责人报告。本企业负责人接到报告后，应当立即向国务院电力监管机构设在当地的派出机构(以下称事故发生地电力监管机构)、县级以上人民政府安全生产监督管理部门报告；热电厂事故影响热力正常供应的，还应当向供热管理部门报告；事故涉及水电厂(站)大坝安全的，还应当同时向有管辖权的水行政主管部门或者流域管理机构报告。
After an accident occurs, the relevant personnel at the accident site shall immediately report to the duty personnel of the power plant or substation, the duty personnel of the power dispatch agency, or the on-site person in charge of the enterprise. Upon receiving the report, the relevant personnel shall immediately report to the higher-level power dispatch agency and the person in charge of the enterprise. Upon receiving the report, the person in charge of the enterprise shall immediately report to the local office of the electric power regulatory authority of the State Council (hereinafter referred to as the "electric power regulatory authority at the accident location") and the work safety supervision and management department of the people's government at or above the county level; if the accident at a thermal power plant affects the normal supply of heat, it shall also report to the heat supply management department; if the accident involves the safety of a hydropower plant (station) dam, it shall also report to the water administrative department or river basin management agency with jurisdiction.
电力企业及其有关人员不得迟报、漏报或者瞒报、谎报事故情况。
Electric power enterprises and their relevant personnel shall not delay, omit, conceal, or falsely report the accident situation.
事故发生地电力监管机构接到事故报告后，应当立即核实有关情况，向国务院电力监管机构报告；事故造成供电用户停电的，应当同时通报事故发生地县级以上地方人民政府。
Upon receiving an accident report, the electric power regulatory authority at the accident location shall immediately verify the relevant information and report to the electric power regulatory authority of the State Council; if the accident causes a power outage to users, it shall simultaneously notify the local people's government at or above the county level at the accident location.
对特别重大事故、重大事故，国务院电力监管机构接到事故报告后应当立即报告国务院，并通报国务院安全生产监督管理部门、国务院能源主管部门等有关部门。
For particularly major accidents and major accidents, upon receiving the accident report, the electric power regulatory authority of the State Council shall immediately report to the State Council and notify the work safety supervision and management department of the State Council, the energy administration department of the State Council, and other relevant departments.
事故报告应当包括下列内容：
An accident report shall include the following contents:
(一)事故发生的时间、地点(区域)以及事故发生单位；
(1) The time, location (area) of the accident, and the entity where the accident occurred;
(二)已知的电力设备、设施损坏情况，停运的发电(供热)机组数量、电网减供负荷或者发电厂减少出力的数值、停电(停热)范围；
(2) Known damage to electric power equipment and facilities, the number of generating (heating) units shut down, the amount of reduction in grid supply load or reduction in output of the power plant, and the scope of power (heat) outage;
(三)事故原因的初步判断；
(3) Preliminary judgment of the cause of the accident;
(四)事故发生后采取的措施、电网运行方式、发电机组运行状况以及事故控制情况；
(4) Measures taken after the accident, the grid operation mode, the operating status of generating units, and the accident control situation;
(五)其他应当报告的情况。
(5) Other circumstances that should be reported.
事故报告后出现新情况的，应当及时补报。
If new circumstances arise after the accident report, a supplementary report shall be made in a timely manner.
事故发生后，有关单位和人员应当妥善保护事故现场以及工作日志、工作票、操作票等相关材料，及时保存故障录波图、电力调度数据、发电机组运行数据和输变电设备运行数据等相关资料，并在事故调查组成立后将相关材料、资料移交事故调查组。
After an accident occurs, the relevant entities and personnel shall properly protect the accident scene, as well as relevant materials such as work logs, work tickets, operation tickets, and promptly preserve relevant data such as fault recorder diagrams, power dispatch data, generating unit operation data, and transmission and transformation equipment operation data, and shall transfer the relevant materials and data to the accident investigation team after its establishment.
因抢救人员或者采取恢复电力生产、电网运行和电力供应等紧急措施，需要改变事故现场、移动电力设备的，应当作出标记、绘制现场简图，妥善保存重要痕迹、物证，并作出书面记录。
If it is necessary to change the accident scene or move electric power equipment due to emergency measures such as rescuing personnel or restoring electric power production, grid operation, and electric power supply, markings shall be made, a simple sketch of the scene shall be drawn, important traces and physical evidence shall be properly preserved, and a written record shall be made.
任何单位和个人不得故意破坏事故现场，不得伪造、隐匿或者毁灭相关证据。
No entity or individual may intentionally damage the accident scene, or forge, conceal, or destroy relevant evidence.
事故应急处置
Emergency Response to Accidents
国务院电力监管机构依照《中华人民共和国突发事件应对法》和《国家突发公共事件总体应急预案》，组织编制国家处置电网大面积停电事件应急预案，报国务院批准。
The electric power regulatory authority of the State Council shall, in accordance with the Emergency Response Law of the People's Republic of China and the National Overall Emergency Plan for Public Emergencies, organize the formulation of the national emergency plan for handling large-scale grid blackouts and submit it to the State Council for approval.
有关地方人民政府应当依照法律、行政法规和国家处置电网大面积停电事件应急预案，组织制定本行政区域处置电网大面积停电事件应急预案。
Relevant local people's governments shall, in accordance with laws, administrative regulations, and the national emergency plan for handling large-scale grid blackouts, organize the formulation of emergency plans for handling large-scale grid blackouts within their respective administrative regions.
处置电网大面积停电事件应急预案应当对应急组织指挥体系及职责，应急处置的各项措施，以及人员、资金、物资、技术等应急保障作出具体规定。
The emergency plan for handling large-scale grid blackouts shall specify the emergency command organization system and its responsibilities, various emergency response measures, and emergency support such as personnel, funds, materials, and technology.
电力企业应当按照国家有关规定，制定本企业事故应急预案。
Electric power enterprises shall, in accordance with relevant state regulations, formulate their own accident emergency plans.
电力监管机构应当指导电力企业加强电力应急救援队伍建设，完善应急物资储备制度。
The electric power regulatory authority shall guide electric power enterprises in strengthening the construction of electric power emergency rescue teams and improving the emergency material reserve system.
事故发生后，有关电力企业应当立即采取相应的紧急处置措施，控制事故范围，防止发生电网系统性崩溃和瓦解；事故危及人身和设备安全的，发电厂、变电站运行值班人员可以按照有关规定，立即采取停运发电机组和输变电设备等紧急处置措施。
After an accident occurs, the relevant electric power enterprise shall immediately take corresponding emergency measures to control the scope of the accident and prevent systemic collapse and disintegration of the power grid; if the accident endangers personal and equipment safety, the duty personnel of the power plant or substation may, in accordance with relevant regulations, immediately take emergency measures such as shutting down generating units and transmission and transformation equipment.
事故造成电力设备、设施损坏的，有关电力企业应当立即组织抢修。
If the accident causes damage to electric power equipment and facilities, the relevant electric power enterprise shall immediately organize repairs.
根据事故的具体情况，电力调度机构可以发布开启或者关停发电机组、调整发电机组有功和无功负荷、调整电网运行方式、调整供电调度计划等电力调度命令，发电企业、电力用户应当执行。
Depending on the specific circumstances of the accident, the power dispatch agency may issue power dispatch commands such as starting or shutting down generating units, adjusting the active and reactive load of generating units, adjusting the grid operation mode, and adjusting the power supply dispatch plan, and power generation enterprises and power users shall comply.
事故可能导致破坏电力系统稳定和电网大面积停电的，电力调度机构有权决定采取拉限负荷、解列电网、解列发电机组等必要措施。
If the accident may lead to the destruction of the stability of the electric power system and large-scale grid blackout, the power dispatch agency has the right to decide to take necessary measures such as load shedding, grid splitting, and generator splitting.
事故造成电网大面积停电的，国务院电力监管机构和国务院其他有关部门、有关地方人民政府、电力企业应当按照国家有关规定，启动相应的应急预案，成立应急指挥机构，尽快恢复电网运行和电力供应，防止各种次生灾害的发生。
If an accident causes a large-scale grid blackout, the electric power regulatory authority of the State Council, other relevant departments of the State Council, relevant local people's governments, and electric power enterprises shall, in accordance with relevant state regulations, activate the corresponding emergency plans, establish an emergency command organization, restore grid operation and electric power supply as soon as possible, and prevent the occurrence of various secondary disasters.
事故造成电网大面积停电的，有关地方人民政府及有关部门应当立即组织开展下列应急处置工作：
If an accident causes a large-scale grid blackout, the relevant local people's government and relevant departments shall immediately organize and carry out the following emergency response work:
(一)加强对停电地区关系国计民生、国家安全和公共安全的重点单位的安全保卫，防范破坏社会秩序的行为，维护社会稳定；
(1) Strengthen security for key units in the blackout area that are related to the national economy and people's livelihood, national security, and public safety, prevent acts that disrupt social order, and maintain social stability;
(二)及时排除因停电发生的各种险情；
(2) Promptly eliminate various dangers caused by the blackout;
(三)事故造成重大人员伤亡或者需要紧急转移、安置受困人员的，及时组织实施救治、转移、安置工作；
(3) If the accident causes significant casualties or requires emergency evacuation or resettlement of trapped persons, promptly organize and implement medical treatment, evacuation, and resettlement work;
(四)加强停电地区道路交通指挥和疏导，做好铁路、民航运输以及通信保障工作；
(4) Strengthen road traffic command and guidance in the blackout area, and ensure railway and civil aviation transportation as well as communication support;
(五)组织应急物资的紧急生产和调用，保证电网恢复运行所需物资和居民基本生活资料的供给。
(5) Organize the emergency production and allocation of emergency materials, and ensure the supply of materials needed for grid restoration and basic living necessities for residents.
事故造成重要电力用户供电中断的，重要电力用户应当按照有关技术要求迅速启动自备应急电源；启动自备应急电源无效的，电网企业应当提供必要的支援。
If an accident causes power supply interruption to important electric power users, the important electric power user shall promptly start its self-provided emergency power source in accordance with relevant technical requirements; if starting the self-provided emergency power source is ineffective, the grid enterprise shall provide necessary support.
事故造成地铁、机场、高层建筑、商场、影剧院、体育场馆等人员聚集场所停电的，应当迅速启用应急照明，组织人员有序疏散。
If an accident causes a power outage in crowded places such as subways, airports, high-rise buildings, shopping malls, cinemas, theaters, and stadiums, emergency lighting shall be promptly activated, and personnel shall be organized to evacuate in an orderly manner.
恢复电网运行和电力供应，应当优先保证重要电厂厂用电源、重要输变电设备、电力主干网架的恢复，优先恢复重要电力用户、重要城市、重点地区的电力供应。
In restoring grid operation and electric power supply, priority shall be given to restoring the auxiliary power supply of important power plants, important transmission and transformation equipment, and the main grid framework, and priority shall be given to restoring power supply to important electric power users, important cities, and key areas.
事故应急指挥机构或者电力监管机构应当按照有关规定，统一、准确、及时发布有关事故影响范围、处置工作进度、预计恢复供电时间等信息。
The accident emergency command organization or the electric power regulatory authority shall, in accordance with relevant regulations, uniformly, accurately, and promptly release information on the scope of the accident's impact, the progress of response work, and the estimated time for power restoration.
事故调查处理
Accident Investigation and Handling
特别重大事故由国务院或者国务院授权的部门组织事故调查组进行调查。
Particularly major accidents shall be investigated by an accident investigation team organized by the State Council or a department authorized by the State Council.
重大事故由国务院电力监管机构组织事故调查组进行调查。
Major accidents shall be investigated by an accident investigation team organized by the electric power regulatory authority of the State Council.
较大事故、一般事故由事故发生地电力监管机构组织事故调查组进行调查。国务院电力监管机构认为必要的，可以组织事故调查组对较大事故进行调查。
Relatively major accidents and general accidents shall be investigated by an accident investigation team organized by the electric power regulatory authority at the accident location. If the electric power regulatory authority of the State Council deems it necessary, it may organize an accident investigation team to investigate relatively major accidents.
未造成供电用户停电的一般事故，事故发生地电力监管机构也可以委托事故发生单位调查处理。
For general accidents that do not cause power outages to users, the electric power regulatory authority at the accident location may also entrust the entity where the accident occurred to investigate and handle the matter.
根据事故的具体情况，事故调查组由电力监管机构、有关地方人民政府、安全生产监督管理部门、负有安全生产监督管理职责的有关部门派人组成；有关人员涉嫌失职、渎职或者涉嫌犯罪的，应当邀请监察机关、公安机关、人民检察院派人参加。
Depending on the specific circumstances of the accident, the accident investigation team shall be composed of personnel from the electric power regulatory authority, the relevant local people's government, the work safety supervision and management department, and relevant departments responsible for work safety supervision and management; if relevant personnel are suspected of dereliction of duty, malfeasance, or criminal offenses, personnel from the supervisory authority, public security authority, and people's procuratorate shall be invited to participate.
根据事故调查工作的需要，事故调查组可以聘请有关专家协助调查。
According to the needs of the accident investigation work, the accident investigation team may engage relevant experts to assist in the investigation.
事故调查组组长由组织事故调查组的机关指定。
The head of the accident investigation team shall be designated by the authority that organized the accident investigation team.
事故调查组应当按照国家有关规定开展事故调查，并在下列期限内向组织事故调查组的机关提交事故调查报告：
The accident investigation team shall conduct the accident investigation in accordance with relevant state regulations and submit an accident investigation report to the authority that organized the accident investigation team within the following time limits:
(一)特别重大事故和重大事故的调查期限为60日；特殊情况下，经组织事故调查组的机关批准，可以适当延长，但延长的期限不得超过60日。
(1) The investigation period for particularly major accidents and major accidents is 60 days; under special circumstances, with the approval of the authority that organized the accident investigation team, it may be appropriately extended, but the extension shall not exceed 60 days.
(二)较大事故和一般事故的调查期限为45日；特殊情况下，经组织事故调查组的机关批准，可以适当延长，但延长的期限不得超过45日。
(2) The investigation period for relatively major accidents and general accidents is 45 days; under special circumstances, with the approval of the authority that organized the accident investigation team, it may be appropriately extended, but the extension shall not exceed 45 days.
事故调查期限自事故发生之日起计算。
The accident investigation period shall be calculated from the date the accident occurs.
事故调查报告应当包括下列内容：
The accident investigation report shall include the following contents:
(一)事故发生单位概况和事故发生经过；
(1) Overview of the entity where the accident occurred and the process of the accident;
(二)事故造成的直接经济损失和事故对电网运行、电力(热力)正常供应的影响情况；
(2) Direct economic losses caused by the accident and the impact of the accident on grid operation and normal supply of electric power (heat);
(三)事故发生的原因和事故性质；
(3) Causes and nature of the accident;
(四)事故应急处置和恢复电力生产、电网运行的情况；
(4) Emergency response to the accident and restoration of electric power production and grid operation;
(五)事故责任认定和对事故责任单位、责任人的处理建议；
(5) Determination of accident responsibility and recommendations for handling the responsible entity and responsible persons;
(六)事故防范和整改措施。
(6) Accident prevention and rectification measures.
事故调查报告应当附具有关证据材料和技术分析报告。事故调查组成员应当在事故调查报告上签字。
The accident investigation report shall be accompanied by relevant evidence materials and technical analysis reports. Members of the accident investigation team shall sign the accident investigation report.
事故调查报告报经组织事故调查组的机关同意，事故调查工作即告结束；委托事故发生单位调查的一般事故，事故调查报告应当报经事故发生地电力监管机构同意。
Once the accident investigation report is approved by the authority that organized the accident investigation team, the accident investigation work shall be concluded; for general accidents investigated by the entity where the accident occurred, the accident investigation report shall be approved by the electric power regulatory authority at the accident location.
有关机关应当依法对事故发生单位和有关人员进行处罚，对负有事故责任的国家工作人员给予处分。
The relevant authorities shall impose penalties on the entity where the accident occurred and relevant personnel in accordance with the law, and shall impose sanctions on state functionaries responsible for the accident.
事故发生单位应当对本单位负有事故责任的人员进行处理。
The entity where the accident occurred shall handle the personnel responsible for the accident within the entity.
事故发生单位和有关人员应当认真吸取事故教训，落实事故防范和整改措施，防止事故再次发生。
The entity where the accident occurred and relevant personnel shall earnestly learn lessons from the accident, implement accident prevention and rectification measures, and prevent the recurrence of similar accidents.
电力监管机构、安全生产监督管理部门和负有安全生产监督管理职责的有关部门应当对事故发生单位和有关人员落实事故防范和整改措施的情况进行监督检查。
The electric power regulatory authority, the work safety supervision and management department, and relevant departments responsible for work safety supervision and management shall supervise and inspect the implementation of accident prevention and rectification measures by the entity where the accident occurred and relevant personnel.
法律责任
Legal Liability
发生事故的电力企业主要负责人有下列行为之一的，由电力监管机构处其上一年年收入40%至80%的罚款；属于国家工作人员的，并依法给予处分；构成犯罪的，依法追究刑事责任：
If the principal person in charge of an electric power enterprise where an accident occurs commits any of the following acts, the electric power regulatory authority shall impose a fine of 40% to 80% of his/her annual income from the previous year; if he/she is a state functionary, he/she shall also be given a sanction in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law:
(一)不立即组织事故抢救的；
(1) Failing to immediately organize accident rescue;
(二)迟报或者漏报事故的；
(2) Delaying or omitting the reporting of the accident;
(三)在事故调查处理期间擅离职守的。
(3) Leaving his/her post without authorization during the accident investigation and handling.
发生事故的电力企业及其有关人员有下列行为之一的，由电力监管机构对电力企业处100万元以上500万元以下的罚款；对主要负责人、直接负责的主管人员和其他直接责任人员处其上一年年收入60%至100%的罚款，属于国家工作人员的，并依法给予处分；构成违反治安管理行为的，由公安机关依法给予治安管理处罚；构成犯罪的，依法追究刑事责任：
If an electric power enterprise where an accident occurs and its relevant personnel commit any of the following acts, the electric power regulatory authority shall impose a fine of not less than RMB 1 million but not more than RMB 5 million on the electric power enterprise; and impose a fine of 60% to 100% of his/her annual income from the previous year on the principal person in charge, the directly responsible supervisor, and other directly responsible personnel; if they are state functionaries, they shall also be given a sanction in accordance with the law; if the act constitutes a violation of public security administration, the public security authority shall impose a public security administration penalty in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law:
(一)谎报或者瞒报事故的；
(1) Falsely reporting or concealing the accident;
(二)伪造或者故意破坏事故现场的；
(2) Forging or intentionally damaging the accident scene;
(三)转移、隐匿资金、财产，或者销毁有关证据、资料的；
(3) Transferring or concealing funds or property, or destroying relevant evidence or materials;
(四)拒绝接受调查或者拒绝提供有关情况和资料的；
(4) Refusing to accept the investigation or refusing to provide relevant information and materials;
(五)在事故调查中作伪证或者指使他人作伪证的；
(5) Giving false testimony during the accident investigation or instructing others to give false testimony;
(六)事故发生后逃匿的。
(6) Fleeing after the accident.
电力企业对事故发生负有责任的，由电力监管机构依照下列规定处以罚款：
If an electric power enterprise is responsible for the occurrence of an accident, the electric power regulatory authority shall impose a fine in accordance with the following provisions:
(一)发生一般事故的，处10万元以上20万元以下的罚款；
(1) For a general accident, a fine of not less than RMB 100,000 but not more than RMB 200,000;
(二)发生较大事故的，处20万元以上50万元以下的罚款；
(2) For a relatively major accident, a fine of not less than RMB 200,000 but not more than RMB 500,000;
(三)发生重大事故的，处50万元以上200万元以下的罚款；
(3) For a major accident, a fine of not less than RMB 500,000 but not more than RMB 2 million;
(四)发生特别重大事故的，处200万元以上500万元以下的罚款。
(4) For a particularly major accident, a fine of not less than RMB 2 million but not more than RMB 5 million.
电力企业主要负责人未依法履行安全生产管理职责，导致事故发生的，由电力监管机构依照下列规定处以罚款；属于国家工作人员的，并依法给予处分；构成犯罪的，依法追究刑事责任：
If the principal person in charge of an electric power enterprise fails to perform work safety management duties in accordance with the law, resulting in an accident, the electric power regulatory authority shall impose a fine in accordance with the following provisions; if he/she is a state functionary, he/she shall also be given a sanction in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law:
(一)发生一般事故的，处其上一年年收入30%的罚款；
(1) For a general accident, a fine of 30% of his/her annual income from the previous year;
(二)发生较大事故的，处其上一年年收入40%的罚款；
(2) For a relatively major accident, a fine of 40% of his/her annual income from the previous year;
(三)发生重大事故的，处其上一年年收入60%的罚款；
(3) For a major accident, a fine of 60% of his/her annual income from the previous year;
(四)发生特别重大事故的，处其上一年年收入80%的罚款。
(4) For a particularly major accident, a fine of 80% of his/her annual income from the previous year.
电力企业主要负责人依照本条例第二十七条、第二十八条、第三十条规定受到撤职处分或者刑事处罚的，自受处分之日或者刑罚执行完毕之日起5年内，不得担任任何生产经营单位主要负责人。
If the principal person in charge of an electric power enterprise is subjected to a sanction of removal from office or criminal punishment in accordance with Articles 27, 28, and 30 of these Regulations, he/she shall not serve as the principal person in charge of any production or business operation entity within five years from the date of the sanction or the date of completion of the criminal punishment.
电力监管机构、有关地方人民政府以及其他负有安全生产监督管理职责的有关部门有下列行为之一的，对直接负责的主管人员和其他直接责任人员依法给予处分；直接负责的主管人员和其他直接责任人员构成犯罪的，依法追究刑事责任：
If the electric power regulatory authority, the relevant local people's government, or other relevant departments responsible for work safety supervision and management commit any of the following acts, the directly responsible supervisor and other directly responsible personnel shall be given a sanction in accordance with the law; if the directly responsible supervisor and other directly responsible personnel constitute a crime, criminal liability shall be pursued in accordance with the law:
(一)不立即组织事故抢救的；
(1) Failing to immediately organize accident rescue;
(二)迟报、漏报或者瞒报、谎报事故的；
(2) Delaying, omitting, concealing, or falsely reporting the accident;
(三)阻碍、干涉事故调查工作的；
(3) Obstructing or interfering with the accident investigation work;
(四)在事故调查中作伪证或者指使他人作伪证的。
(4) Giving false testimony during the accident investigation or instructing others to give false testimony.
参与事故调查的人员在事故调查中有下列行为之一的，依法给予处分；构成犯罪的，依法追究刑事责任：
If personnel participating in the accident investigation commit any of the following acts during the accident investigation, they shall be given a sanction in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law:
(一)对事故调查工作不负责任，致使事故调查工作有重大疏漏的；
(1) Being irresponsible in the accident investigation work, resulting in significant omissions in the accident investigation work;
(二)包庇、袒护负有事故责任的人员或者借机打击报复的。
(2) Covering up or shielding personnel responsible for the accident, or taking the opportunity to retaliate.
附则
Supplementary Provisions
发生本条例规定的事故，同时造成人员伤亡或者直接经济损失，依照本条例确定的事故等级与依照《生产安全事故报告和调查处理条例》确定的事故等级不相同的，按事故等级较高者确定事故等级，依照本条例的规定调查处理；事故造成人员伤亡，构成《生产安全事故报告和调查处理条例》规定的重大事故或者特别重大事故的，依照《生产安全事故报告和调查处理条例》的规定调查处理。
If an accident specified in these Regulations also causes casualties or direct economic losses, and the accident grade determined in accordance with these Regulations differs from the accident grade determined in accordance with the Regulations on Reporting and Investigation of Production Safety Accidents, the higher accident grade shall prevail, and the accident shall be investigated and handled in accordance with these Regulations; if the accident causes casualties and constitutes a major accident or particularly major accident as specified in the Regulations on Reporting and Investigation of Production Safety Accidents, the accident shall be investigated and handled in accordance with the Regulations on Reporting and Investigation of Production Safety Accidents.
电力生产或者电网运行过程中发生发电设备或者输变电设备损坏，造成直接经济损失的事故，未影响电力系统安全稳定运行以及电力正常供应的，由电力监管机构依照《生产安全事故报告和调查处理条例》的规定组成事故调查组对重大事故、较大事故、一般事故进行调查处理。
If an accident occurs during electric power production or grid operation that causes damage to power generation equipment or transmission and transformation equipment, resulting in direct economic losses, but does not affect the safe and stable operation of the electric power system or the normal supply of electric power, the electric power regulatory authority shall, in accordance with the Regulations on Reporting and Investigation of Production Safety Accidents, form an accident investigation team to investigate and handle major accidents, relatively major accidents, and general accidents.
本条例对事故报告和调查处理未作规定的，适用《生产安全事故报告和调查处理条例》的规定。
Matters not covered by these Regulations regarding accident reporting and investigation shall be governed by the Regulations on Reporting and Investigation of Production Safety Accidents.
核电厂核事故的应急处置和调查处理，依照《核电厂核事故应急管理条例》的规定执行。
The emergency response and investigation of nuclear accidents at nuclear power plants shall be carried out in accordance with the Regulations on Emergency Management of Nuclear Accidents at Nuclear Power Plants.
本条例自2011年9月1日起施行。
These Regulations shall come into effect on September 1, 2011.
