总则
General Provisions
为了加强核电厂核事故应急管理工作，控制和减少核事故危害，制定本条例。
These Regulations are formulated to strengthen emergency management for nuclear accidents at nuclear power plants and to control and reduce the hazards of nuclear accidents.
本条例适用于可能或者已经引起放射性物质释放、造成重大辐射后果的核电厂核事故(以下简称核事故)应急管理工作。
These Regulations apply to emergency management for nuclear accidents at nuclear power plants that may or have caused the release of radioactive substances and result in significant radiation consequences (hereinafter referred to as nuclear accidents).
核事故应急管理工作实行常备不懈，积极兼容，统一指挥，大力协同，保护公众，保护环境的方针。
The emergency management of nuclear accidents shall adhere to the principles of constant preparedness, active compatibility, unified command, vigorous coordination, protection of the public, and protection of the environment.
应急机构及其职责
Emergency Organizations and Their Responsibilities
全国的核事故应急管理工作由国务院指定的部门负责，其主要职责是：
The department designated by the State Council shall be responsible for the national emergency management of nuclear accidents, with the main responsibilities being:
(一)拟定国家核事故应急工作政策；
(1) Formulating national policies for nuclear accident emergency work;
(二)统一协调国务院有关部门、军队和地方人民政府的核事故应急工作；
(2) Coordinating the nuclear accident emergency work of relevant departments of the State Council, the military, and local people's governments;
(三)组织制定和实施国家核事故应急计划，审查批准场外核事故应急计划；
(3) Organizing the formulation and implementation of national nuclear accident emergency plans, and reviewing and approving off-site nuclear accident emergency plans;
(四)适时批准进入和终止场外应急状态；
(4) Approve the entry into and termination of off-site emergency status in a timely manner;
(五)提出实施核事故应急响应行动的建议；
(5) Propose the implementation of nuclear accident emergency response actions;
(六)审查批准核事故公报、国际通报，提出请求国际援助的方案。
(6) Review and approve nuclear accident bulletins and international notifications, and propose plans for requesting international assistance.
必要时，由国务院领导、组织、协调全国的核事故应急管理工作。
When necessary, the State Council shall lead, organize, and coordinate the national nuclear accident emergency management work.
核电厂所在地的省、自治区、直辖市人民政府指定的部门负责本行政区域内的核事故应急管理工作，其主要职责是：
The department designated by the people's government of the province, autonomous region, or municipality directly under the Central Government where the nuclear power plant is located shall be responsible for the nuclear accident emergency management work within its administrative region, with the main responsibilities being:
(一)执行国家核事故应急工作的法规和政策；
(1) Implement national laws, regulations, and policies on nuclear accident emergency work;
(二)组织制定场外核事故应急计划，做好核事故应急准备工作；
(2) Organize the formulation of off-site nuclear accident emergency plans and prepare for nuclear accident emergency response;
(三)统一指挥场外核事故应急响应行动；
(3) Uniformly command off-site nuclear accident emergency response actions;
(四)组织支援核事故应急响应行动；
(4) Organize support for nuclear accident emergency response actions;
(五)及时向相邻的省、自治区、直辖市通报核事故情况。
(5) Timely notify neighboring provinces, autonomous regions, and municipalities directly under the Central Government of the nuclear accident situation.
必要时，由省、自治区、直辖市人民政府领导、组织、协调本行政区域内的核事故应急管理工作。
When necessary, the people's government of the province, autonomous region, or municipality directly under the Central Government shall lead, organize, and coordinate nuclear accident emergency management within its administrative region.
核电厂的核事故应急机构的主要职责是：
The main responsibilities of the nuclear accident emergency organization of a nuclear power plant are:
(一)执行国家核事故应急工作的法规和政策；
(1) Implement national laws, regulations, and policies on nuclear accident emergency work;
(二)制定场内核事故应急计划，做好核事故应急准备工作；
(2) Formulate on-site nuclear accident emergency plans and prepare for nuclear accident emergency response;
(三)确定核事故应急状态等级，统一指挥本单位的核事故应急响应行动；
(3) Determine the level of nuclear accident emergency status and uniformly command the unit's nuclear accident emergency response actions;
(四)及时向上级主管部门、国务院核安全部门和省级人民政府指定的部门报告事故情况，提出进入场外应急状态和采取应急防护措施的建议；
(4) Promptly report the accident situation to the higher competent authority, the nuclear safety department of the State Council, and the department designated by the provincial people's government, and propose recommendations for entering off-site emergency status and adopting emergency protective measures;
(五)协助和配合省级人民政府指定的部门做好核事故应急管理工作。
(5) Assist and cooperate with the department designated by the provincial people's government in carrying out nuclear accident emergency management.
核电厂的上级主管部门领导核电厂的核事故应急工作。
The higher competent authority of the nuclear power plant shall lead the nuclear accident emergency work of the nuclear power plant.
国务院核安全部门、环境保护部门和卫生部门等有关部门在各自的职责范围内做好相应的核事故应急工作。
The nuclear safety department, environmental protection department, health department, and other relevant departments of the State Council shall perform corresponding nuclear accident emergency work within their respective responsibilities.
中国人民解放军作为核事故应急工作的重要力量，应当在核事故应急响应中实施有效的支援。
The People's Liberation Army of China, as an important force in nuclear accident emergency work, shall provide effective support in nuclear accident emergency response.
应急准备
Emergency Preparedness
针对核电厂可能发生的核事故，核电厂的核事故应急机构、省级人民政府指定的部门和国务院指定的部门应当预先制定核事故应急计划。
In response to possible nuclear accidents at nuclear power plants, the nuclear accident emergency organization of the nuclear power plant, the department designated by the provincial people's government, and the department designated by the State Council shall formulate nuclear accident emergency plans in advance.
核事故应急计划包括场内核事故应急计划、场外核事故应急计划和国家核事故应急计划。各级核事故应急计划应当相互衔接、协调一致。
Nuclear accident emergency plans include on-site nuclear accident emergency plans, off-site nuclear accident emergency plans, and national nuclear accident emergency plans. Nuclear accident emergency plans at all levels shall be interconnected and coordinated.
场内核事故应急计划由核电厂核事故应急机构制定，经其主管部门审查后，送国务院核安全部门审评并报国务院指定的部门备案。
The on-site nuclear accident emergency plan shall be formulated by the nuclear accident emergency organization of the nuclear power plant, reviewed by its competent authority, then submitted to the nuclear safety department of the State Council for evaluation and to the department designated by the State Council for record.
场外核事故应急计划由核电厂所在地的省级人民政府指定的部门组织制定，报国务院指定的部门审查批准。
The off-site nuclear accident emergency plan shall be formulated by the department designated by the provincial people's government where the nuclear power plant is located, and submitted to the department designated by the State Council for review and approval.
国家核事故应急计划由国务院指定的部门组织制定。
The national nuclear accident emergency plan shall be formulated by the department designated by the State Council.
国务院有关部门和中国人民解放军总部应当根据国家核事故应急计划，制定相应的核事故应急方案，报国务院指定的部门备案。
Relevant departments of the State Council and the headquarters of the People's Liberation Army shall, in accordance with the national nuclear accident emergency plan, formulate corresponding nuclear accident emergency plans and submit them to the department designated by the State Council for record.
场内核事故应急计划、场外核事故应急计划应当包括下列内容：
The on-site nuclear accident emergency plan and the off-site nuclear accident emergency plan shall include the following contents:
(一)核事故应急工作的基本任务；
(1) Basic tasks of nuclear accident emergency work;
(二)核事故应急响应组织及其职责；
(2) Nuclear accident emergency response organization and its responsibilities;
(三)烟羽应急计划区和食入应急计划区的范围；
(3) The scope of the plume emergency planning zone and the ingestion emergency planning zone;
(四)干预水平和导出干预水平；
(4) Intervention levels and derived intervention levels;
(五)核事故应急准备和应急响应的详细方案；
(5) Detailed plans for nuclear accident emergency preparedness and emergency response;
(六)应急设施、设备、器材和其他物资；
(6) Emergency facilities, equipment, apparatus, and other materials;
(七)核电厂核事故应急机构同省级人民政府指定的部门之间以及同其他有关方面相互配合、支援的事项及措施。
(7) Matters and measures for mutual cooperation and support between the nuclear power plant nuclear accident emergency organization and the department designated by the provincial people's government, as well as with other relevant parties.
有关部门在进行核电厂选址和设计工作时，应当考虑核事故应急工作的要求。
Relevant departments shall consider the requirements of nuclear accident emergency work when conducting site selection and design of nuclear power plants.
新建的核电厂必须在其场内和场外核事故应急计划审查批准后，方可装料。
New nuclear power plants must have their on-site and off-site nuclear accident emergency plans reviewed and approved before fuel loading.
国务院指定的部门、省级人民政府指定的部门和核电厂的核事故应急机构应当具有必要的应急设施、设备和相互之间快速可靠的通讯联络系统。
The department designated by the State Council, the department designated by the provincial people's government, and the nuclear accident emergency organization of the nuclear power plant shall have necessary emergency facilities, equipment, and a fast and reliable communication system among them.
核电厂的核事故应急机构和省级人民政府指定的部门应当具有辐射监测系统、防护器材、药械和其他物资。
The nuclear accident emergency organization of the nuclear power plant and the department designated by the provincial people's government shall have radiation monitoring systems, protective equipment, medicines, and other materials.
用于核事故应急工作的设施、设备和通讯联络系统、辐射监测系统以及防护器材、药械等，应当处于良好状态。
Facilities, equipment, communication systems, radiation monitoring systems, protective equipment, medicines, etc., used for nuclear accident emergency work shall be maintained in good condition.
核电厂应当对职工进行核安全、辐射防护和核事故应急知识的专门教育。
Nuclear power plants shall provide specialized education to their employees on nuclear safety, radiation protection, and nuclear accident emergency knowledge.
省级人民政府指定的部门应当在核电厂的协助下对附近的公众进行核安全、辐射防护和核事故应急知识的普及教育。
The department designated by the provincial people's government shall, with the assistance of the nuclear power plant, conduct popular education on nuclear safety, radiation protection, and nuclear accident emergency knowledge for the nearby public.
核电厂的核事故应急机构和省级人民政府指定的部门应当对核事故应急工作人员进行培训。
The nuclear accident emergency organization of the nuclear power plant and the department designated by the provincial people's government shall provide training to nuclear accident emergency personnel.
核电厂的核事故应急机构和省级人民政府指定的部门应当适时组织不同专业和不同规模的核事故应急演习。
The nuclear accident emergency organization of the nuclear power plant and the department designated by the provincial people's government shall organize nuclear accident emergency drills of different specialties and scales at appropriate times.
在核电厂首次装料前，核电厂的核事故应急机构和省级人民政府指定的部门应当组织场内、场外核事故应急演习。
Before the initial fuel loading of a nuclear power plant, the nuclear accident emergency organization of the nuclear power plant and the department designated by the provincial people's government shall organize on-site and off-site nuclear accident emergency drills.
应急对策和应急防护措施
Emergency Countermeasures and Emergency Protective Measures
核事故应急状态分为下列四级：
The nuclear accident emergency states are divided into the following four levels:
(一)应急待命。出现可能导致危及核电厂核安全的某些特定情况或者外部事件，核电厂有关人员进入戒备状态。
(1) Emergency standby. When certain specific situations or external events that may endanger the nuclear safety of the nuclear power plant occur, relevant personnel of the nuclear power plant enter a state of alert.
(二)厂房应急。事故后果仅限于核电厂的局部区域，核电厂人员按照场内核事故应急计划的要求采取核事故应急响应行动，通知厂外有关核事故应急响应组织。
(2) Plant emergency. The consequences of the accident are limited to a local area of the nuclear power plant. Personnel of the nuclear power plant take nuclear accident emergency response actions in accordance with the requirements of the on-site nuclear accident emergency plan, and notify off-site nuclear accident emergency response organizations.
(三)场区应急。事故后果蔓延至整个场区，场区内的人员采取核事故应急响应行动，通知省级人民政府指定的部门，某些厂外核事故应急响应组织可能采取核事故应急响应行动。
(3) Site area emergency. The consequences of the accident spread to the entire site area. Personnel within the site area take nuclear accident emergency response actions, notify the department designated by the provincial people's government, and certain off-site nuclear accident emergency response organizations may take nuclear accident emergency response actions.
(四)场外应急。事故后果超越场区边界，实施场内和场外核事故应急计划。
(4) Off-site emergency. The consequences of the accident exceed the site boundary, and both on-site and off-site nuclear accident emergency plans are implemented.
当核电厂进入应急待命状态时，核电厂核事故应急机构应当及时向核电厂的上级主管部门和国务院核安全部门报告情况，并视情况决定是否向省级人民政府指定的部门报告。当出现可能或者已经有放射性物质释放的情况时，应当根据情况，及时决定进入厂房应急或者场区应急状态，并迅速向核电厂的上级主管部门、国务院核安全部门和省级人民政府指定的部门报告情况；在放射性物质可能或者已经扩散到核电厂场区以外时，应当迅速向省级人民政府指定的部门提出进入场外应急状态并采取应急防护措施的建议。
When a nuclear power plant enters a state of emergency standby, the nuclear accident emergency organization of the nuclear power plant shall promptly report the situation to the competent higher authority of the nuclear power plant and the nuclear safety department of the State Council, and decide whether to report to the department designated by the provincial people's government based on the situation. When there is a situation where radioactive material may be or has been released, it shall promptly decide to enter the plant emergency or site emergency state based on the situation, and quickly report the situation to the competent higher authority of the nuclear power plant, the nuclear safety department of the State Council, and the department designated by the provincial people's government; when radioactive material may or has spread beyond the nuclear power plant site, it shall promptly propose to the department designated by the provincial people's government to enter the off-site emergency state and take emergency protective measures.
省级人民政府指定的部门接到核电厂核事故应急机构的事故情况报告后，应当迅速采取相应的核事故应急对策和应急防护措施，并及时向国务院指定的部门报告情况。需要决定进入场外应急状态时，应当经国务院指定的部门批准；在特殊情况下，省级人民政府指定的部门可以先行决定进入场外应急状态，但是应当立即向国务院指定的部门报告。
After receiving the accident situation report from the nuclear accident emergency organization of the nuclear power plant, the department designated by the provincial people's government shall promptly take corresponding nuclear accident emergency countermeasures and emergency protective measures, and promptly report the situation to the department designated by the State Council. When it is necessary to decide to enter the off-site emergency state, approval from the department designated by the State Council shall be obtained; under special circumstances, the department designated by the provincial people's government may decide to enter the off-site emergency state first, but shall immediately report to the department designated by the State Council.
核电厂的核事故应急机构和省级人民政府指定的部门应当做好核事故后果预测与评价以及环境放射性监测等工作，为采取核事故应急对策和应急防护措施提供依据。
The nuclear accident emergency organization of the nuclear power plant and the department designated by the provincial people's government shall conduct nuclear accident consequence prediction and assessment as well as environmental radiation monitoring, to provide a basis for taking nuclear accident emergency countermeasures and emergency protective measures.
省级人民政府指定的部门应当适时选用隐蔽、服用稳定性碘制剂、控制通道、控制食物和水源、撤离、迁移、对受影响的区域去污等应急防护措施。
The department designated by the provincial people's government shall timely select and adopt emergency protective measures such as sheltering, administration of stable iodine preparations, controlling access, controlling food and water sources, evacuation, relocation, and decontamination of affected areas.
省级人民政府指定的部门在核事故应急响应过程中应当将必要的信息及时地告知当地公众。
During the nuclear accident emergency response process, the department designated by the provincial people's government shall promptly inform the local public of necessary information.
在核事故现场，各核事故应急响应组织应当实行有效的剂量监督。现场核事故应急响应人员和其他人员都应当在辐射防护人员的监督和指导下活动，尽量防止接受过大剂量的照射。
At the nuclear accident site, all nuclear accident emergency response organizations shall implement effective dose monitoring. On-site nuclear accident emergency response personnel and other personnel shall operate under the supervision and guidance of radiation protection personnel, and try to avoid receiving excessive doses of radiation.
核电厂的核事故应急机构和省级人民政府指定的部门应当做好核事故现场接受照射人员的救护、洗消、转运和医学处置工作。
The nuclear accident emergency organization of the nuclear power plant and the department designated by the provincial people's government shall properly carry out rescue, decontamination, transfer, and medical treatment of persons exposed to radiation at the nuclear accident site.
在核事故应急进入场外应急状态时，国务院指定的部门应当及时派出人员赶赴现场，指导核事故应急响应行动，必要时提出派出救援力量的建议。
When the nuclear accident emergency enters the off-site emergency state, the department designated by the State Council shall promptly dispatch personnel to the site to guide the nuclear accident emergency response actions, and if necessary, propose the dispatch of rescue forces.
因核事故应急响应需要，可以实行地区封锁。省、自治区、直辖市行政区域内的地区封锁，由省、自治区、直辖市人民政府决定；跨省、自治区、直辖市的地区封锁，以及导致中断干线交通或者封锁国境的地区封锁，由国务院决定。
If necessary for nuclear accident emergency response, area lockdown may be implemented. Area lockdown within the administrative region of a province, autonomous region, or municipality directly under the Central Government shall be decided by the people's government of that province, autonomous region, or municipality; area lockdown across provinces, autonomous regions, or municipalities directly under the Central Government, as well as area lockdown that causes interruption of trunk transportation or blockade of national borders, shall be decided by the State Council.
地区封锁的解除，由原决定机关宣布。
Lifting of Regional Blockade，Announced by the original decision-making authority。
有关核事故的新闻由国务院授权的单位统一发布。
News concerning nuclear accidents shall be uniformly released by the unit authorized by the State Council。
应急状态的终止和恢复措施
Termination of Emergency State and Recovery Measures
场外应急状态的终止由省级人民政府指定的部门会同核电厂核事故应急机构提出建议，报国务院指定的部门批准，由省级人民政府指定的部门发布。
The termination of the off-site emergency state shall be proposed by the department designated by the provincial people's government in conjunction with the nuclear accident emergency organization of the nuclear power plant，Reported to the department designated by the State Council for approval，Released by the department designated by the provincial people's government。
省级人民政府指定的部门应当根据受影响地区的放射性水平，采取有效的恢复措施。
The department designated by the provincial people's government shall, based on the radiation levels in the affected areas,，Take effective recovery measures。
核事故应急状态终止后，核电厂核事故应急机构应当向国务院指定的部门、核电厂的上级主管部门、国务院核安全部门和省级人民政府指定的部门提交详细的事故报告；省级人民政府指定的部门应当向国务院指定的部门提交场外核事故应急工作的总结报告。
After the termination of the nuclear accident emergency state,，The nuclear accident emergency organization of the nuclear power plant shall submit a detailed accident report to the department designated by the State Council,、The superior competent authority of the nuclear power plant,、The nuclear safety department of the State Council and the department designated by the provincial people's government；The department designated by the provincial people's government shall submit a summary report on the off-site nuclear accident emergency work to the department designated by the State Council。
核事故使核安全重要物项的安全性能达不到国家标准时，核电厂的重新起动计划应当按照国家有关规定审查批准。
When the safety performance of important nuclear safety items fails to meet national standards due to a nuclear accident,，The restart plan of the nuclear power plant shall be reviewed and approved in accordance with national regulations。
资金和物资保障
Funding and Material Support
国务院有关部门、军队、地方各级人民政府和核电厂在核事故应急准备工作中应当充分利用现有组织机构、人员、设施和设备等，努力提高核事故应急准备资金和物资的使用效益，并使核事故应急准备工作与地方和核电厂的发展规划相结合。各有关单位应当提供支援。
Relevant departments of the State Council,、The military,、Local people's governments at all levels and nuclear power plants shall make full use of existing organizational structures in nuclear accident emergency preparedness work,、Personnel,、Facilities and equipment, etc.，Strive to improve the utilization efficiency of nuclear accident emergency preparedness funds and materials,，And integrate nuclear accident emergency preparedness work with local and nuclear power plant development plans。All relevant units shall provide support。
场内核事故应急准备资金由核电厂承担，列入核电厂工程项目投资概算和运行成本。
On-site nuclear accident emergency preparedness funds shall be borne by the nuclear power plant,，Included in the investment estimate and operating cost of the nuclear power plant project。
场外核事故应急准备资金由核电厂和地方人民政府共同承担，资金数额由国务院指定的部门会同有关部门审定。核电厂承担的资金，在投产前根据核电厂容量、在投产后根据实际发电量确定一定的比例交纳，由国务院计划部门综合平衡后用于地方场外核事故应急准备工作；其余部分由地方人民政府解决。具体办法由国务院指定的部门会同国务院计划部门和国务院财政部门规定。
Off-site nuclear accident emergency preparedness funds shall be borne jointly by the nuclear power plant and the local people's government. The amount of funds shall be determined by the department designated by the State Council in conjunction with relevant departments. The funds borne by the nuclear power plant shall be paid at a certain proportion determined before commissioning based on the capacity of the nuclear power plant and after commissioning based on actual power generation, and shall be used for local off-site nuclear accident emergency preparedness work after comprehensive balancing by the planning department of the State Council; the remaining portion shall be resolved by the local people's government. Specific measures shall be prescribed by the department designated by the State Council in conjunction with the planning department and the finance department of the State Council.
国务院有关部门和军队所需的核事故应急准备资金，根据各自在核事故应急工作中的职责和任务，充分利用现有条件进行安排，不足部分按照各自的计划和资金渠道上报。
The nuclear accident emergency preparedness funds required by the relevant departments of the State Council and the military shall be arranged by making full use of existing conditions according to their respective responsibilities and tasks in nuclear accident emergency work, and any shortfall shall be reported upward in accordance with their respective plans and funding channels.
国家的和地方的物资供应部门及其他有关部门应当保证供给核事故应急所需的设备、器材和其他物资。
State and local material supply departments and other relevant departments shall ensure the supply of equipment, materials, and other goods required for nuclear accident emergencies.
因核电厂核事故应急响应需要，执行核事故应急响应行动的行政机关有权征用非用于核事故应急响应的设备、器材和其他物资。
When necessary for nuclear power plant nuclear accident emergency response, administrative organs performing nuclear accident emergency response actions have the authority to requisition equipment, materials, and other goods not used for nuclear accident emergency response.
对征用的设备、器材和其他物资，应当予以登记并在使用后及时归还；造成损坏的，由征用单位补偿。
Requisitioned equipment, materials, and other goods shall be registered and returned promptly after use; if damage is caused, the requisitioning unit shall provide compensation.
奖励与处罚
Rewards and Penalties
在核事故应急工作中有下列事迹之一的单位和个人，由主管部门或者所在单位给予表彰或者奖励：
Units or individuals that have performed one of the following deeds in nuclear accident emergency work shall be commended or rewarded by the competent authority or their unit:
(一)完成核事故应急响应任务的；
(1) Completing nuclear accident emergency response tasks;
(二)保护公众安全和国家的、集体的和公民的财产，成绩显著的；
(2) Protecting public safety and state, collective, and citizen property with outstanding results;
(三)对核事故应急准备与响应提出重大建议，实施效果显著的；
(3) Making significant suggestions for nuclear accident emergency preparedness and response with outstanding implementation results.
(四)辐射、气象预报和测报准确及时，从而减轻损失的；
(4) Providing accurate and timely radiation, weather forecasts and measurements, thereby reducing losses;
(五)有其他特殊贡献的。
(5) Having other special contributions.
有下列行为之一的，对有关责任人员视情节和危害后果，由其所在单位或者上级机关给予行政处分；属于违反治安管理行为的，由公安机关依照治安管理处罚法的规定予以处罚；构成犯罪的，由司法机关依法追究刑事责任：
Whoever commits any of the following acts shall, depending on the circumstances and harmful consequences, be given administrative sanctions by the unit to which he belongs or by the competent authority; if the act constitutes a violation of public security administration, punishment shall be imposed by the public security organ in accordance with the Public Security Administration Punishments Law; if the act constitutes a crime, criminal liability shall be investigated by the judicial authority in accordance with the law:
(一)不按照规定制定核事故应急计划，拒绝承担核事故应急准备义务的；
(1) Failing to formulate a nuclear accident emergency plan as required, or refusing to undertake the obligation of nuclear accident emergency preparedness;
(二)玩忽职守，引起核事故发生的；
(2) Dereliction of duty, causing a nuclear accident;
(三)不按照规定报告、通报核事故真实情况的；
(3) Failing to report or notify the true situation of a nuclear accident as required;
(四)拒不执行核事故应急计划，不服从命令和指挥，或者在核事故应急响应时临阵脱逃的；
(4) Refusing to implement the nuclear accident emergency plan, disobeying orders and commands, or deserting during nuclear accident emergency response;
(五)盗窃、挪用、贪污核事故应急工作所用资金或者物资的；
(5) Stealing, misappropriating, or embezzling funds or materials used for nuclear accident emergency work;
(六)阻碍核事故应急工作人员依法执行职务或者进行破坏活动的；
(6) Obstructing nuclear accident emergency workers from performing their duties according to law or engaging in sabotage activities;
(七)散布谣言，扰乱社会秩序的；
(7) Spreading rumors, disrupting social order;
(八)有其他对核事故应急工作造成危害的行为的。
(8) Other acts that cause harm to nuclear accident emergency response work.
附则
Supplementary Provisions
本条例中下列用语的含义：
The meanings of the following terms in these Regulations:
(一)核事故应急，是指为了控制或者缓解核事故、减轻核事故后果而采取的不同于正常秩序和正常工作程序的紧急行动。
(1) Nuclear accident emergency refers to urgent actions taken to control or mitigate a nuclear accident and reduce its consequences, which differ from normal order and normal working procedures.
(二)场区，是指由核电厂管理的区域。
(2) Site area refers to the area managed by the nuclear power plant.
(三)应急计划区，是指在核电厂周围建立的，制定有核事故应急计划、并预计采取核事故应急对策和应急防护措施的区域。
(3) Emergency planning zone refers to the area established around a nuclear power plant, for which a nuclear accident emergency plan is developed and where nuclear accident emergency countermeasures and protective actions are expected to be taken.
(四)烟羽应急计划区，是指针对放射性烟云引起的照射而建立的应急计划区。
(4) Plume emergency planning zone refers to the emergency planning zone established for exposure caused by radioactive plumes.
(五)食入应急计划区，是指针对食入放射性污染的水或者食物引起照射而建立的应急计划区。
(5) Ingestion emergency planning zone refers to the emergency planning zone established for exposure caused by ingestion of contaminated water or food.
(六)干预水平，是指预先规定的用于在异常状态下确定需要对公众采取应急防护措施的剂量水平。
(6) Intervention level refers to the dose level pre-established to determine the need for taking protective actions for the public under abnormal conditions.
(七)导出干预水平，是指由干预水平推导得出的放射性物质在环境介质中的浓度或者水平。
(7) Derived intervention level refers to the concentration or level of radioactive substances in environmental media derived from the intervention level.
(八)应急防护措施，是指在核事故情况下用于控制工作人员和公众所接受的剂量而采取的保护措施。
(8) Emergency protective measures refer to protective actions taken to control the dose received by workers and the public in the event of a nuclear accident.
(九)核安全重要物项，是指对核电厂安全有重要意义的建筑物、构筑物、系统、部件和设施等。
(9) Nuclear safety important items refer to buildings, structures, systems, components, and facilities that are of significance to the safety of a nuclear power plant.
除核电厂外，其他核设施的核事故应急管理，可以根据具体情况，参照本条例的有关规定执行。
For nuclear facilities other than nuclear power plants, the emergency management of nuclear accidents may, depending on the specific circumstances, be implemented with reference to the relevant provisions of these Regulations.
对可能或者已经造成放射性物质释放超越国界的核事故应急，除执行本条例的规定外，并应当执行中华人民共和国缔结或者参加的国际条约的规定，但是中华人民共和国声明保留的条款除外。
For nuclear accident emergencies that may or have already caused the release of radioactive materials beyond national borders, in addition to implementing the provisions of these Regulations, the provisions of international treaties concluded or acceded to by the People's Republic of China shall also be implemented, except for clauses on which the People's Republic of China has declared reservations.
本条例自发布之日起施行。
These Regulations shall come into force on the date of promulgation.
