为了控制检疫传染病通过交通工具及其乘运的人员、物资传播，防止检疫传染病流行，保障人体健康，依照《中华人民共和国传染病防治法》(以下简称传染病防治法)的规定，制定本条例。
These Regulations are formulated in accordance with the provisions of the Law of the People's Republic of China on the Prevention and Control of Infectious Diseases (hereinafter referred to as the Infectious Disease Prevention and Control Law) for the purpose of controlling the spread of quarantinable infectious diseases through vehicles and the persons and materials transported thereby, preventing the epidemic of quarantinable infectious diseases, and protecting human health.
列车、船舶、航空器和其他车辆(以下简称交通工具)出入检疫传染病疫区和在非检疫传染病疫区的交通工具上发现检疫传染病疫情时，依照本条例对交通工具及其乘运的人员、物资实施交通卫生检疫。
When trains, ships, aircraft, and other vehicles (hereinafter referred to as vehicles) enter or leave an epidemic area of quarantinable infectious diseases, or when an epidemic situation of quarantinable infectious diseases is discovered on a vehicle in a non-epidemic area, traffic health quarantine shall be implemented on the vehicle and the persons and materials transported thereby in accordance with these Regulations.
在中华人民共和国国际通航的港口、机场以及陆地边境和国界江河口岸的国境卫生检疫，依照《中华人民共和国国境卫生检疫法》的规定执行。
Frontier health quarantine at ports, airports, and land border and border river ports open to international navigation in the People's Republic of China shall be implemented in accordance with the Frontier Health and Quarantine Law of the People's Republic of China.
本条例所称检疫传染病，是指鼠疫、霍乱以及国务院确定并公布的其他传染病。
Quarantinable infectious diseases as referred to in these Regulations mean plague, cholera, and other infectious diseases determined and announced by the State Council.
检疫传染病的诊断标准，按照国家有关卫生标准和国务院卫生行政部门的规定执行。
The diagnostic criteria for quarantinable infectious diseases shall be implemented in accordance with the relevant national health standards and the provisions of the health administrative department of the State Council.
国务院卫生行政部门主管全国国内交通卫生检疫监督管理工作。
The health administrative department of the State Council shall be in charge of the supervision and administration of domestic traffic health quarantine nationwide.
县级以上地方人民政府卫生行政部门负责本行政区域内的国内交通卫生检疫监督管理工作。
The health administrative departments of local people's governments at or above the county level shall be responsible for the supervision and administration of domestic traffic health quarantine within their respective administrative regions.
铁路、交通、民用航空行政主管部门的卫生主管机构，根据有关法律、法规和国务院卫生行政部门分别会同国务院铁路、交通、民用航空行政主管部门规定的职责划分，负责各自职责范围内的国内交通卫生检疫工作。
The health competent authorities of the administrative departments of railways, communications, and civil aviation shall, in accordance with relevant laws and regulations and the division of responsibilities stipulated by the health administrative department of the State Council jointly with the administrative departments of railways, communications, and civil aviation of the State Council, be responsible for domestic traffic health quarantine work within their respective scopes of duties.
省、自治区、直辖市人民政府依照传染病防治法的规定，确定检疫传染病疫区，并决定对出入疫区的交通工具及其乘运的人员、物资实施交通卫生检疫。
The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, in accordance with the provisions of the Infectious Disease Prevention and Control Law, determine epidemic areas of quarantinable infectious diseases and decide to implement traffic health quarantine on vehicles entering or leaving the epidemic areas and the persons and materials transported thereby.
对出入检疫传染病疫区的交通工具及其乘运的人员、物资，县级以上地方人民政府卫生行政部门或者铁路、交通、民用航空行政主管部门的卫生主管机构根据各自的职责，有权采取下列相应的交通卫生检疫措施：
With respect to vehicles entering or leaving an epidemic area of quarantinable infectious diseases and the persons and materials transported thereby, the health administrative departments of local people's governments at or above the county level or the health competent authorities of the administrative departments of railways, communications, and civil aviation shall, according to their respective duties, have the authority to take the following corresponding traffic health quarantine measures:
(一)对出入检疫传染病疫区的人员、交通工具及其承运的物资进行查验；
(1) Conduct inspection on persons, vehicles, and materials carried entering or leaving the epidemic area of quarantinable infectious diseases;
(二)对检疫传染病病人、病原携带者、疑似检疫传染病病人和与其密切接触者，实施临时隔离、医学检查及其他应急医学措施；
(2) Implement temporary isolation, medical examination, and other emergency medical measures on patients with quarantinable infectious diseases, pathogen carriers, suspected patients with quarantinable infectious diseases, and persons in close contact with them;
(三)对被检疫传染病病原体污染或者可能被污染的物品，实施控制和卫生处理；
(3) Implement control and sanitary treatment on articles contaminated or likely contaminated by pathogens of quarantinable infectious diseases;
(四)对通过该疫区的交通工具及其停靠场所，实施紧急卫生处理；
(4) Implement emergency sanitary treatment on vehicles passing through the epidemic area and their stopping places;
(五)需要采取的其他卫生检疫措施。
(5) Other health quarantine measures that need to be taken.
采取前款所列交通卫生检疫措施的期间自决定实施时起至决定解除时止。
The period for taking the traffic health quarantine measures listed in the preceding paragraph shall commence from the time the decision is implemented until the time the decision is lifted.
非检疫传染病疫区的交通工具上发现下列情形之一时，县级以上地方人民政府卫生行政部门或者铁路、交通、民用航空行政主管部门的卫生主管机构根据各自的职责，有权对交通工具及其乘运的人员、物资实施交通卫生检疫：
When any of the following circumstances is discovered on a vehicle in a non-epidemic area of quarantinable infectious diseases, the health administrative departments of local people's governments at or above the county level or the health competent authorities of the administrative departments of railways, communications, and civil aviation shall, according to their respective duties, have the authority to implement traffic health quarantine on the vehicle and the persons and materials transported thereby:
(一)发现有感染鼠疫的啮齿类动物或者啮齿类动物反常死亡，并且死因不明；
(1) Rodents infected with plague or abnormal death of rodents with unknown cause are found;
(二)发现鼠疫、霍乱病人、病原携带者和疑似鼠疫、霍乱病人；
(2) Patients with plague or cholera, pathogen carriers, and suspected patients with plague or cholera are found;
(三)发现国务院确定并公布的需要实施国内交通卫生检疫的其他传染病。
(3) Other infectious diseases determined and announced by the State Council that require domestic traffic health quarantine are found.
跨省、自治区、直辖市在非检疫传染病疫区运行的列车、船舶、航空器上发现前款所列情形之一时，国务院卫生行政部门分别会同国务院铁路、交通、民用航空行政主管部门，可以决定对该列车、船舶、航空器实施交通卫生检疫和指令列车、船舶、航空器不得停靠或者通过港口、机场、车站；但是，因实施交通卫生检疫导致中断干线交通或者封锁国境的，须由国务院决定。
When any of the circumstances listed in the preceding paragraph is discovered on a train, ship, or aircraft operating across provinces, autonomous regions, or municipalities directly under the Central Government in a non-epidemic area, the health administrative department of the State Council jointly with the administrative departments of railways, communications, and civil aviation of the State Council may decide to implement traffic health quarantine on the train, ship, or aircraft and instruct the train, ship, or aircraft not to stop at or pass through ports, airports, or stations; however, if the implementation of traffic health quarantine results in the interruption of trunk transportation or the closure of national borders, the decision shall be made by the State Council.
在非检疫传染病疫区的交通工具上，发现检疫传染病病人、病原携带者、疑似检疫传染病病人时，交通工具负责人应当组织有关人员采取下列临时措施：
When a patient with a quarantinable infectious disease, a pathogen carrier, or a suspected patient with a quarantinable infectious disease is discovered on a vehicle in a non-epidemic area, the person in charge of the vehicle shall organize relevant personnel to take the following temporary measures:
(一)以最快的方式通知前方停靠点，并向交通工具营运单位的主管部门报告；
(1) Notify the next stopping point by the fastest means and report to the competent department of the vehicle operating unit;
(二)对检疫传染病病人、病原携带者、疑似检疫传染病病人和与其密切接触者实施隔离；
(2) Implement isolation on the patient with quarantinable infectious disease, pathogen carrier, suspected patient with quarantinable infectious disease, and persons in close contact with them;
(三)封锁已经污染或者可能污染的区域，采取禁止向外排放污物等卫生处理措施；
(3) Seal off areas that are already contaminated or may be contaminated, and take sanitary measures such as prohibiting the discharge of pollutants;
(四)在指定的停靠点将检疫传染病病人、病原携带者、疑似检疫传染病病人和与其密切接触者以及其他需要跟踪观察的旅客名单，移交当地县级以上地方人民政府卫生行政部门；
(4) At designated stops, transfer the list of quarantine infectious disease patients, pathogen carriers, suspected quarantine infectious disease patients, and their close contacts, as well as other passengers requiring follow-up observation, to the local health administrative department of the people's government at or above the county level;
(五)对承运过检疫传染病病人、病原携带者、疑似检疫传染病病人的交通工具和可能被污染的环境实施卫生处理。
(5) Carry out sanitary treatment on transport vehicles that have carried quarantine infectious disease patients, pathogen carriers, or suspected quarantine infectious disease patients, and on environments that may have been contaminated.
交通工具停靠地的县级以上地方人民政府卫生行政部门或者铁路、交通、民用航空行政主管部门的卫生主管机构，应当根据各自的职责，依照传染病防治法的规定，采取控制措施。
The health administrative department of the local people's government at or above the county level at the stopover location of the transport vehicle, or the health authority of the railway, transportation, or civil aviation administrative department, shall, according to their respective responsibilities, take control measures in accordance with the provisions of the Law on the Prevention and Treatment of Infectious Diseases.
县级以上地方人民政府卫生行政部门或者铁路、交通、民用航空行政主管部门的卫生主管机构，根据各自的职责，对出入检疫传染病疫区的或者在非检疫传染病疫区发现检疫传染病疫情的交通工具及其乘运的人员、物资，实施交通卫生检疫；经检疫合格的，签发检疫合格证明。交通工具及其乘运的人员、物资凭检疫合格证明，方可通行。
The health administrative department of the local people's government at or above the county level, or the health authority of the railway, transportation, or civil aviation administrative department, shall, according to their respective responsibilities, implement traffic health quarantine for transport vehicles entering or leaving an epidemic area of a quarantinable infectious disease, or for transport vehicles and their personnel and materials found in a non-epidemic area where a quarantinable infectious disease outbreak occurs; if the quarantine is passed, a quarantine certificate shall be issued. Transport vehicles and their personnel and materials may only pass upon presentation of the quarantine certificate.
检疫合格证明的格式，由国务院卫生行政部门商国务院铁路、交通、民用航空行政主管部门制定。
The format of the quarantine certificate shall be formulated by the health administrative department of the State Council in consultation with the railway, transportation, and civil aviation administrative departments of the State Council.
对拒绝隔离、治疗、留验的检疫传染病病人、病原携带者、疑似检疫传染病病人和与其密切接触者，以及拒绝检查和卫生处理的可能传播检疫传染病的交通工具、停靠场所及物资，县级以上地方人民政府卫生行政部门或者铁路、交通、民用航空行政主管部门的卫生主管机构根据各自的职责，应当依照传染病防治法的规定，采取强制检疫措施；必要时，由当地县级以上人民政府组织公安部门予以协助。
For quarantine infectious disease patients, pathogen carriers, suspected quarantine infectious disease patients, and their close contacts who refuse isolation, treatment, or observation, as well as transport vehicles, stopover locations, and materials that may spread quarantinable infectious diseases and refuse inspection and sanitary treatment, the health administrative department of the local people's government at or above the county level, or the health authority of the railway, transportation, or civil aviation administrative department, shall, according to their respective responsibilities, take compulsory quarantine measures in accordance with the provisions of the Law on the Prevention and Treatment of Infectious Diseases; if necessary, the local people's government at or above the county level shall organize public security departments to provide assistance.
检疫传染病疫情发生后，疫区所在地的省、自治区、直辖市人民政府卫生行政部门应当向有关铁路、交通、民用航空行政主管部门的卫生主管机构通报疫情。铁路、交通、民用航空行政主管部门的卫生主管机构接到疫情通报后，应当及时通知有关交通工具的营运单位。
After the outbreak of a quarantinable infectious disease epidemic, the health administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the epidemic area is located shall notify the health authorities of the relevant railway, transportation, and civil aviation administrative departments of the epidemic. Upon receiving the epidemic notification, the health authorities of the railway, transportation, and civil aviation administrative departments shall promptly notify the operating units of the relevant transport vehicles.
检疫传染病疫情的报告、通报和公布，依照传染病防治法及其实施办法的规定执行。
The reporting, notification, and publication of quarantinable infectious disease epidemics shall be carried out in accordance with the provisions of the Law on the Prevention and Treatment of Infectious Diseases and its implementing measures.
国务院卫生行政部门应当依照传染病防治法的规定，加强对检疫传染病防治的监督管理，会同国务院铁路、交通、民用航空行政主管部门，依照本条例的规定，拟订国内交通卫生检疫实施方案。
The health administrative department of the State Council shall, in accordance with the provisions of the Law on the Prevention and Treatment of Infectious Diseases, strengthen supervision and management of the prevention and treatment of quarantinable infectious diseases, and, in conjunction with the railway, transportation, and civil aviation administrative departments of the State Council, formulate a domestic traffic health quarantine implementation plan in accordance with these Regulations.
检疫传染病病人、病原携带者、疑似检疫传染病病人和与其密切接触者隐瞒真实情况、逃避交通卫生检疫的，由县级以上地方人民政府卫生行政部门或者铁路、交通、民用航空行政主管部门的卫生主管机构，根据各自的职责分工，责令限期改正，给予警告，可以并处1000元以下的罚款；拒绝接受查验和卫生处理的，给予警告，并处1000元以上5000元以下的罚款；情节严重，引起检疫传染病传播或者有传播严重危险，构成犯罪的，依法追究刑事责任。
If quarantine infectious disease patients, pathogen carriers, suspected quarantine infectious disease patients, or their close contacts conceal their true situation or evade traffic health quarantine, the health administrative department of the local people's government at or above the county level, or the health authority of the railway, transportation, or civil aviation administrative department, shall, according to their respective responsibilities, order correction within a time limit, issue a warning, and may impose a fine of not more than 1,000 yuan; if they refuse to accept inspection and sanitary treatment, a warning shall be issued and a fine of not less than 1,000 yuan but not more than 5,000 yuan shall be imposed; if the circumstances are serious, causing the spread of a quarantinable infectious disease or creating a serious risk of spread, constituting a crime, criminal liability shall be pursued according to law.
在非检疫传染病疫区的交通工具上发现检疫传染病病人、病原携带者、疑似检疫传染病病人时，交通工具负责人未依照本条例规定采取措施的，由县级以上地方人民政府卫生行政部门或者铁路、交通、民用航空行政主管部门的卫生主管机构，根据各自的职责，责令改正，给予警告，并处1000元以上5000元以下的罚款；情节严重，引起检疫传染病传播或者有传播严重危险，构成犯罪的，依法追究刑事责任。
If, when a quarantine infectious disease patient, pathogen carrier, or suspected quarantine infectious disease patient is found on a transport vehicle in a non-epidemic area, the person in charge of the transport vehicle fails to take measures in accordance with these Regulations, the health administrative department of the local people's government at or above the county level, or the health authority of the railway, transportation, or civil aviation administrative department, shall, according to their respective responsibilities, order correction, issue a warning, and impose a fine of not less than 1,000 yuan but not more than 5,000 yuan; if the circumstances are serious, causing the spread of a quarantinable infectious disease or creating a serious risk of spread, constituting a crime, criminal liability shall be pursued according to law.
县级以上地方人民政府卫生行政部门或者铁路、交通、民用航空行政主管部门的卫生主管机构，对发现的检疫传染病病人、病原携带者、疑似检疫传染病病人和与其密切接触者，未依法实施临时隔离、医学检查和其他应急医学措施的，以及对被检疫传染病病原体污染或者可能被污染的物品、交通工具及其停靠场所未依法进行必要的控制和卫生处理的，由其上级行政主管部门责令限期改正，对直接负责的主管人员和其他直接责任人员依法给予行政处分；情节严重，引起检疫传染病传播或者有传播严重危险，构成犯罪的，依法追究刑事责任。
If the health administrative department of the local people's government at or above the county level, or the health authority of the railway, transportation, or civil aviation administrative department, fails to implement temporary isolation, medical examination, or other emergency medical measures for discovered quarantine infectious disease patients, pathogen carriers, suspected quarantine infectious disease patients, and their close contacts, or fails to carry out necessary control and sanitary treatment on items, transport vehicles, and their stopover locations contaminated or possibly contaminated by quarantinable infectious disease pathogens, the superior administrative department shall order correction within a time limit, and impose administrative sanctions on the directly responsible persons in charge and other directly responsible persons according to law; if the circumstances are serious, causing the spread of a quarantinable infectious disease or creating a serious risk of spread, constituting a crime, criminal liability shall be pursued according to law.
本条例自1999年3月1日起施行。1985年9月19日国务院批准、1985年10月12日铁道部、卫生部公布的《铁路交通检疫管理办法》同时废止。
These Regulations shall come into force as of March 1, 1999. The Measures for the Administration of Railway Traffic Quarantine, approved by the State Council on September 19, 1985, and promulgated by the Ministry of Railways and the Ministry of Health on October 12, 1985, shall be abolished simultaneously.
