根据《中华人民共和国民用航空法》，制定本条例。
These Regulations are formulated in accordance with the Civil Aviation Law of the People's Republic of China.
在中华人民共和国办理民用航空器权利登记，应当遵守本条例。
Registration of rights in civil aircraft within the People's Republic of China shall comply with these Regulations.
国务院民用航空主管部门主管民用航空器权利登记工作，设立民用航空器权利登记簿，统一记载民用航空器权利登记事项。
The competent civil aviation authority under the State Council shall be responsible for the registration of rights in civil aircraft, establish a register of rights in civil aircraft, and uniformly record matters concerning the registration of rights in civil aircraft.
同一民用航空器的权利登记事项应当记载于同一权利登记簿中。
Matters concerning the registration of rights in the same civil aircraft shall be recorded in the same register of rights.
办理民用航空器所有权、占有权或者抵押权登记的，民用航空器权利人应当按照国务院民用航空主管部门的规定，分别填写民用航空器所有权、占有权或者抵押权登记申请书，并向国务院民用航空主管部门提交本条例第五条至第七条规定的相应文件。
To register ownership, possession, or mortgage of a civil aircraft, the right holder of the civil aircraft shall, in accordance with the provisions of the competent civil aviation authority under the State Council, fill in the application form for registration of ownership, possession, or mortgage of the civil aircraft respectively, and submit the corresponding documents specified in Articles 5 to 7 of these Regulations to the competent civil aviation authority under the State Council.
办理民用航空器优先权登记的，民用航空器优先权的债权人应当自援救或者保管维护工作终了之日起3个月内，按照国务院民用航空主管部门的规定，填写民用航空器优先权登记申请书，并向国务院民用航空主管部门提交足以证明其合法身份的文件和有关债权证明。
To register a priority right in a civil aircraft, the creditor of the priority right in the civil aircraft shall, within three months from the date of completion of the rescue or preservation and maintenance work, fill in the application form for registration of the priority right in the civil aircraft in accordance with the provisions of the competent civil aviation authority under the State Council, and submit to the competent civil aviation authority under the State Council documents sufficient to prove its legal identity and relevant creditor's rights certificates.
办理民用航空器所有权登记的，民用航空器的所有人应当提交下列文件或者经核对无误的复印件：
To register ownership of a civil aircraft, the owner of the civil aircraft shall submit the following documents or their verified copies:
(一)民用航空器国籍登记证书；
(1) The nationality registration certificate of the civil aircraft;
(二)民用航空器所有权取得的证明文件；
(2) The document evidencing the acquisition of ownership of the civil aircraft;
(三)国务院民用航空主管部门要求提交的其他必要的有关文件。
(3) Other necessary relevant documents as required by the competent civil aviation authority under the State Council.
办理民用航空器占有权登记的，民用航空器的占有人应当提交下列文件或者经核对无误的复印件：
To register possession of a civil aircraft, the possessor of the civil aircraft shall submit the following documents or their verified copies:
(一)民用航空器国籍登记证书；
(1) The nationality registration certificate of the civil aircraft;
(二)民用航空器所有权登记证书或者相应的所有权证明文件；民用航空器设定抵押的，还应当提供有关证明文件；
(2) The ownership registration certificate of the civil aircraft or the corresponding document evidencing ownership; if the civil aircraft is mortgaged, relevant certification documents shall also be provided;
(三)符合《中华人民共和国民用航空法》第十一条第(二)项或者第(三)项规定的民用航空器买卖合同或者租赁合同；
(3) The contract for the sale or lease of the civil aircraft that complies with the provisions of Article 11, paragraph (2) or (3) of the Civil Aviation Law of the People's Republic of China;
(四)国务院民用航空主管部门要求提交的其他必要的有关文件。
(4) Other necessary relevant documents as required by the competent civil aviation authority under the State Council.
办理民用航空器抵押权登记的，民用航空器的抵押权人和抵押人应当提交下列文件或者经核对无误的复印件：
To register a mortgage on a civil aircraft, the mortgagor and mortgagee of the civil aircraft shall submit the following documents or their verified copies:
(一)民用航空器国籍登记证书；
(1) The nationality registration certificate of the civil aircraft;
(二)民用航空器所有权登记证书或者相应的所有权证明文件；
(2) The ownership registration certificate of the civil aircraft or the corresponding document evidencing ownership;
(三)民用航空器抵押合同；
(3) The mortgage contract for the civil aircraft;
(四)国务院民用航空主管部门要求提交的其他必要的有关文件。
(4) Other necessary relevant documents as required by the competent civil aviation authority under the State Council.
就两架以上民用航空器设定一项抵押权或者就同一民用航空器设定两项以上抵押权时，民用航空器的抵押权人和抵押人应当就每一架民用航空器或者每一项抵押权分别办理抵押权登记。
Where a single mortgage is created on two or more civil aircraft, or two or more mortgages are created on the same civil aircraft, the mortgagor and mortgagee of the civil aircraft shall separately register the mortgage for each civil aircraft or each mortgage.
国务院民用航空主管部门应当自收到民用航空器权利登记申请之日起7个工作日内，对申请的权利登记事项进行审查。经审查符合本条例规定的，应当向民用航空器权利人颁发相应的民用航空器权利登记证书，并区别情况在民用航空器权利登记簿上载明本条例第十条至第十三条规定的相应事项；经审查不符合本条例规定的，应当书面通知民用航空器权利人。
The competent civil aviation authority under the State Council shall, within seven working days from the date of receipt of the application for registration of rights in a civil aircraft, examine the matters applied for registration. If upon examination it is found to comply with these Regulations, it shall issue the corresponding certificate of registration of rights in the civil aircraft to the right holder of the civil aircraft, and, as the case may be, record in the register of rights in the civil aircraft the corresponding matters specified in Articles 10 to 13 of these Regulations; if upon examination it is found not to comply with these Regulations, it shall notify the right holder of the civil aircraft in writing.
国务院民用航空主管部门向民用航空器所有人颁发民用航空器所有权登记证书时，应当在民用航空器权利登记簿上载明下列事项：
When the competent civil aviation authority under the State Council issues a certificate of ownership registration of a civil aircraft to the owner of the civil aircraft, it shall record the following matters in the register of rights in the civil aircraft:
(一)民用航空器国籍、国籍标志和登记标志；
(1) The nationality, nationality mark, and registration mark of the civil aircraft;
(二)民用航空器所有人的姓名或者名称、地址及其法定代表人的姓名；
(2) The name or title, address, and the name of the legal representative of the owner of the civil aircraft;
(三)民用航空器为数人共有的，载明民用航空器共有人的共有情况；
(3) If the civil aircraft is owned by several persons, the co-ownership status of the co-owners of the civil aircraft;
(四)民用航空器所有权的取得方式和取得日期；
(4) The method and date of acquisition of ownership of the civil aircraft;
(五)民用航空器制造人名称、制造日期和制造地点；
(5) The name of the manufacturer, date of manufacture, and place of manufacture of the civil aircraft;
(六)民用航空器价值、机体材料和主要技术数据；
(6) The value, airframe material, and main technical data of the civil aircraft;
(七)民用航空器已设定抵押的，载明其抵押权的设定情况；
(7) If a mortgage has been established on the civil aircraft, the status of the mortgage;
(八)民用航空器所有权登记日期；
(8) The date of registration of ownership of the civil aircraft;
(九)国务院民用航空主管部门规定的其他事项。
(9) Other matters prescribed by the competent civil aviation authority under the State Council.
国务院民用航空主管部门向民用航空器占有人颁发民用航空器占有权登记证书时，应当在民用航空器权利登记簿上载明下列事项：
When the competent civil aviation authority under the State Council issues a certificate of registration of possession of a civil aircraft to the possessor of the civil aircraft, it shall record the following items in the civil aircraft rights register:
(一)民用航空器的国籍、国籍标志和登记标志；
(1) The nationality, nationality mark, and registration mark of the civil aircraft;
(二)民用航空器占有人、所有人或者出租人的姓名或者名称、地址及其法定代表人的姓名；
(2) The name or title, address, and the name of the legal representative of the possessor, owner, or lessor of the civil aircraft;
(三)民用航空器占有权的取得方式、取得日期和约定的占有条件；
(3) The method and date of acquisition of possession of the civil aircraft and the agreed conditions of possession;
(四)民用航空器占有权登记日期；
(4) The date of registration of possession of the civil aircraft;
(五)国务院民用航空主管部门规定的其他事项。
(5) Other matters prescribed by the competent civil aviation authority under the State Council.
国务院民用航空主管部门向民用航空器抵押权人颁发民用航空器抵押权登记证书时，应当在民用航空器权利登记簿上载明下列事项：
When the competent civil aviation authority under the State Council issues a certificate of registration of mortgage of a civil aircraft to the mortgagee of the civil aircraft, it shall record the following items in the civil aircraft rights register:
(一)被抵押的民用航空器的国籍、国籍标志和登记标志；
(1) The nationality, nationality mark, and registration mark of the mortgaged civil aircraft;
(二)抵押权人和抵押人的姓名或者名称、地址及其法定代表人的姓名；
(2) The name or title, address, and the name of the legal representative of the mortgagee and the mortgagor;
(三)民用航空器抵押所担保的债权数额、利息率、受偿期限；
(3) The amount of the debt secured by the mortgage of the civil aircraft, the interest rate, and the term for repayment;
(四)民用航空器抵押权登记日期；
(4) The date of registration of the mortgage of the civil aircraft;
(五)国务院民用航空主管部门规定的其他事项。
(5) Other matters prescribed by the competent civil aviation authority under the State Council.
国务院民用航空主管部门向民用航空器优先权的债权人颁发民用航空器优先权登记证书时，应当在民用航空器权利登记簿上载明下列事项：
When the competent civil aviation authority under the State Council issues a certificate of registration of priority right of a civil aircraft to the creditor of the priority right of the civil aircraft, it shall record the following items in the civil aircraft rights register:
(一)发生债权的民用航空器的国籍、国籍标志和登记标志；
(1) The nationality, nationality mark, and registration mark of the civil aircraft on which the claim arises;
(二)民用航空器优先权的债权人的姓名或者名称、地址及其法定代表人的姓名；
(2) The name or title, address, and the name of the legal representative of the creditor of the priority right of the civil aircraft;
(三)发生债权的民用航空器的所有人、经营人或者承租人的姓名或者名称、地址及其法定代表人的姓名；
(3) The name or title, address, and the name of the legal representative of the owner, operator, or lessee of the civil aircraft on which the claim arises;
(四)民用航空器优先权的债权人主张的债权数额和债权发生的时间、原因；
(4) The amount of the claim asserted by the creditor of the priority right of the civil aircraft and the time and cause of the claim.
(五)民用航空器优先权登记日期；
(5) the date of registration of priority rights in civil aircraft;
(六)国务院民用航空主管部门规定的其他事项。
(6) other matters prescribed by the competent civil aviation authority under the State Council.
同一民用航空器设定两项以上抵押权的，国务院民用航空主管部门应当按照抵押权登记申请日期的先后顺序进行登记。
Where two or more mortgages are created on the same civil aircraft, the competent civil aviation authority under the State Council shall register them in the order of the dates of application for mortgage registration.
民用航空器权利登记事项发生变更时，民用航空器权利人应当持有关的民用航空器权利登记证书和变更证明文件，向国务院民用航空主管部门办理变更登记。
When the registered matters of rights in civil aircraft change, the holder of the rights in civil aircraft shall, by presenting the relevant certificate of registration of rights in civil aircraft and the certifying documents, apply to the competent civil aviation authority under the State Council for registration of the change.
民用航空器抵押合同变更时，由抵押权人和抵押人共同向国务院民用航空主管部门办理变更登记。
When a mortgage contract for civil aircraft is amended, the mortgagee and the mortgagor shall jointly apply to the competent civil aviation authority under the State Council for registration of the change.
国务院民用航空主管部门应当自收到民用航空器权利变更登记申请之日起7个工作日内，对申请的权利变更登记事项进行审查。经审查符合本条例规定的，在有关权利登记证书和民用航空器权利登记簿上注明变更事项；经审查不符合本条例规定的，应当书面通知民用航空器权利人。
The competent civil aviation authority under the State Council shall, within 7 working days from the date of receipt of the application for registration of change of rights in civil aircraft, examine the matters applied for registration of change. If, upon examination, the application complies with these Regulations, it shall record the changed matters on the relevant certificate of registration of rights and in the register of rights in civil aircraft; if, upon examination, the application does not comply with these Regulations, it shall notify the holder of the rights in civil aircraft in writing.
遇有下列情形之一时，民用航空器权利人应当持有关的民用航空器权利登记证书和证明文件，向国务院民用航空主管部门办理注销登记：
In any of the following circumstances, the holder of the rights in civil aircraft shall, by presenting the relevant certificate of registration of rights in civil aircraft and the certifying documents, apply to the competent civil aviation authority under the State Council for cancellation of registration:
(一)民用航空器所有权转移；
(1) transfer of ownership of the civil aircraft;
(二)民用航空器灭失或者失踪；
(2) loss or disappearance of the civil aircraft;
(三)民用航空器租赁关系终止或者民用航空器占有人停止占有；
(3) termination of the lease of the civil aircraft or cessation of possession by the possessor of the civil aircraft;
(四)民用航空器抵押权所担保的债权消灭；
(4) extinction of the claim secured by the mortgage on the civil aircraft;
(五)民用航空器优先权消灭；
(5) extinction of the priority right in the civil aircraft;
(六)国务院民用航空主管部门规定的其他情形。
(6) other circumstances prescribed by the competent civil aviation authority under the State Council.
国务院民用航空主管部门应当自收到民用航空器注销登记申请之日起7个工作日内，对申请的注销登记事项进行审查。经审查符合本条例规定的，收回有关的民用航空器权利登记证书，相应地注销民用航空器权利登记簿上的权利登记，并根据具体情况向民用航空器权利人出具民用航空器权利登记注销证明书；经审查不符合本条例规定的，应当书面通知民用航空器权利人。
The competent civil aviation authority under the State Council shall, within 7 working days from the date of receipt of the application for cancellation of registration of rights in civil aircraft, examine the matters applied for cancellation of registration. If, upon examination, the application complies with these Regulations, it shall retrieve the relevant certificate of registration of rights in civil aircraft, cancel the registration of rights in the register of rights in civil aircraft accordingly, and issue a certificate of cancellation of registration of rights in civil aircraft to the holder of the rights in civil aircraft as the case may be; if, upon examination, the application does not comply with these Regulations, it shall notify the holder of the rights in civil aircraft in writing.
申请人办理民用航空器权利登记，应当缴纳登记费。登记费的收费标准由国务院民用航空主管部门会同国务院价格主管部门制定。
An applicant for registration of rights in civil aircraft shall pay a registration fee. The fee standard for registration shall be formulated by the competent civil aviation authority under the State Council jointly with the competent pricing authority under the State Council.
本条例自发布之日起施行。
These Regulations shall come into force as of the date of promulgation.
