为加强对陆地污染源的监督管理,防治陆源污染物污染损害海洋环境,根据《中华人民共和国海洋环境保护法》,制定本条例。
These Regulations are formulated in accordance with the Marine Environment Protection Law of the People's Republic of China to strengthen the supervision and management of land-based pollution sources and to prevent and control pollution damage to the marine environment by land-sourced pollutants.
本条例所称陆地污染源(简称陆源),是指从陆地向海域排放污染物,造成或者可能造成海洋环境污染损害的场所、设施等。
For the purposes of these Regulations, 'land-based pollution sources' (hereinafter referred to as 'land sources') means places, facilities, etc., that discharge pollutants from land to the sea, causing or potentially causing pollution damage to the marine environment.
本条例所称陆源污染物是指由前款陆源排放的污染物。
For the purposes of these Regulations, 'land-sourced pollutants' means pollutants discharged from the land sources mentioned in the preceding paragraph.
本条例适用于在中华人民共和国境内向海域排放陆源污染物的一切单位和个人。
These Regulations apply to all units and individuals that discharge land-sourced pollutants into the sea within the territory of the People's Republic of China.
防止拆船污染损害海洋环境,依照《防止拆船污染环境管理条例》执行。
The prevention of pollution damage to the marine environment by ship dismantling shall be governed by the Regulations on the Prevention and Control of Environmental Pollution by Ship Dismantling.
国务院环境保护行政主管部门,主管全国防治陆源污染物污染损害海洋环境工作。
The competent administrative department of environmental protection under the State Council shall be responsible for the nationwide work of preventing and controlling pollution damage to the marine environment by land-sourced pollutants.
沿海县级以上地方人民政府环境保护行政主管部门,主管本行政区域内防治陆源污染物污染损害海洋环境工作。
The competent administrative departments of environmental protection of the coastal people's governments at or above the county level shall be responsible for the work of preventing and controlling pollution damage to the marine environment by land-sourced pollutants within their respective administrative regions.
任何单位和个人向海域排放陆源污染物,必须执行国家和地方发布的污染物排放标准和有关规定。
Any unit or individual that discharges land-sourced pollutants into the sea must comply with the pollutant discharge standards and relevant provisions issued by the state and local authorities.
任何单位和个人向海域排放陆源污染物,必须向其所在地环境保护行政主管部门申报登记拥有的污染物排放设施、处理设施和在正常作业条件下排放污染物的种类、数量和浓度,提供防治陆源污染物污染损害海洋环境的资料,并将上述事项和资料抄送海洋行政主管部门。
Any unit or individual that discharges land-sourced pollutants into the sea must register with the competent administrative department of environmental protection at the location, declaring the pollutant discharge facilities, treatment facilities, and the types, quantities, and concentrations of pollutants discharged under normal operating conditions, provide information on the prevention and control of pollution damage to the marine environment by land-sourced pollutants, and submit a copy of the above information to the competent administrative department of marine affairs.
排放污染物的种类、数量和浓度有重大改变或者拆除、闲置污染物处理设施的,应当征得所在地环境保护行政主管部门同意并经原审批部门批准。
If there is a significant change in the types, quantities, or concentrations of pollutants discharged, or if pollutant treatment facilities are removed or left idle, the consent of the competent administrative department of environmental protection at the location must be obtained and approval from the original approving authority must be secured.
任何单位和个人向海域排放陆源污染物,超过国家和地方污染物排放标准的,必须缴纳超标准排污费,并负责治理。
Any unit or individual that discharges land-sourced pollutants into the sea exceeding the national or local pollutant discharge standards must pay a fee for exceeding the standard discharge and shall be responsible for treatment.
任何单位和个人,不得在海洋特别保护区、海上自然保护区、海滨风景游览区、盐场保护区、海水浴场、重要渔业水域和其他需要特殊保护的区域内兴建排污口。
No unit or individual may construct sewage outfalls in marine special protection areas, marine nature reserves, coastal scenic and tourist areas, salt field protection areas, seawater bathing beaches, important fishing waters, or other areas requiring special protection.
对在前款区域内已建的排污口,排放污染物超过国家和地方排放标准的,限期治理。
For existing sewage outfalls in the areas mentioned in the preceding paragraph that discharge pollutants exceeding national or local discharge standards, a deadline for treatment shall be set.
对向海域排放陆源污染物造成海洋环境严重污染损害的企业事业单位,限期治理。
For enterprises and institutions that discharge land-sourced pollutants into the sea causing serious pollution damage to the marine environment, a deadline for treatment shall be set.
国务院各部门或者省、自治区、直辖市人民政府直接管辖的企业事业单位的限期治理,由省、自治区、直辖市人民政府的环境保护行政主管部门提出意见,报同级人民政府决定。市、县或者市、县以下人民政府管辖的企业事业单位的限期治理,由市、县人民政府环境保护行政主管部门提出意见,报同级人民政府决定。被限期治理的企业事业单位必须如期完成治理任务。
For enterprises and institutions directly under the administration of departments of the State Council or the people's governments of provinces, autonomous regions, or municipalities directly under the Central Government, the deadline for treatment shall be proposed by the competent administrative department of environmental protection of the people's government of the province, autonomous region, or municipality directly under the Central Government and submitted to the people's government at the same level for decision. For enterprises and institutions under the administration of the people's government of a city, county, or below, the deadline for treatment shall be proposed by the competent administrative department of environmental protection of the people's government of the city or county and submitted to the people's government at the same level for decision. The enterprises and institutions subject to the deadline for treatment must complete the treatment task within the prescribed time limit.
禁止在岸滩擅自堆放、弃置和处理固体废弃物。确需临时堆放、处理固体废弃物的,必须按照沿海省、自治区、直辖市人民政府环境保护行政主管部门规定的审批程序,提出书面申请。其主要内容包括:
It is prohibited to arbitrarily pile up, discard, or dispose of solid waste on the shore or beach. If temporary piling up or disposal of solid waste is truly necessary, a written application must be submitted in accordance with the approval procedures prescribed by the competent administrative department of environmental protection of the coastal province, autonomous region, or municipality directly under the Central Government. The main contents of the application include:
(一)申请单位的名称、地址;
(1) Name and address of the applicant;
(二)堆放、处理的地点和占地面积;
(2) Location and area occupied for piling up or disposal;
(三)固体废弃物的种类、成分,年堆放量、处理量,积存堆放、处理的总量和堆放高度;
(3) Types and composition of solid waste, annual piling up and disposal volume, total accumulated piling up and disposal volume, and piling height;
(四)固体废弃物堆放、处理的期限,最终处置方式;
(4) Duration of piling up or disposal of solid waste and final disposal method;
(五)堆放、处理固体废弃物可能对海洋环境造成的污染损害;
(5) Possible pollution damage to the marine environment caused by piling up or disposal of solid waste;
(六)防止堆放、处理固体废弃物污染损害海洋环境的技术和措施;
(6) Technologies and measures to prevent pollution damage to the marine environment from piling up or disposal of solid waste;
(七)审批机关认为需要说明的其他事项。
(7) Other matters that the approving authority deems necessary to explain.
现有的固体废弃物临时堆放、处理场地,未经县级以上地方人民政府环境保护行政主管部门批准的,由县级以上地方人民政府环境保护行政主管部门责令限期补办审批手续。
For existing temporary solid waste piling up or disposal sites that have not been approved by the competent administrative department of environmental protection of the people's government at or above the county level, the competent administrative department of environmental protection of the people's government at or above the county level shall order the responsible party to complete the approval procedures within a specified time limit.
被批准设置废弃物堆放场、处理场的单位和个人,必须建造防护堤和防渗漏、防扬尘等设施,经批准设置废弃物堆放场、处理场的环境保护行政主管部门验收合格后方可使用。
Units and individuals approved to establish wastestockpile yard or treatment facilities must construct protective dikes and facilities for seepage prevention, dust prevention, etc., and may only use them after passing acceptance inspection by the environmental protection administrative department that approved the establishment.
在批准使用的废弃物堆放场、处理场内,不得擅自堆放、弃置未经批准的其他种类的废弃物。不得露天堆放含剧毒、放射性、易溶解和易挥发性物质的废弃物;非露天堆放上述废弃物,不得作为最终处置方式。
Within approved wastestockpile yard or treatment facilities, it is prohibited to arbitrarilystockpiling or discard other types of waste not approved. It is prohibited tostockpiling waste containing highly toxic, radioactive, easily soluble, or volatile substances in the open air; non-open-airstockpiling of such waste shall not be used as a final disposal method.
禁止在岸滩采用不正当的稀释、渗透方式排放有毒、有害废水。
It is prohibited to discharge toxic or harmful wastewater by improper dilution or infiltration methods on the shore or beach.
禁止向海域排放含高、中放射性物质的废水。
It is prohibited to discharge wastewater containing high or intermediate level radioactive substances into the sea.
向海域排放含低放射性物质的废水,必须执行国家有关放射防护的规定和标准。
Discharge of wastewater containing low-level radioactive substances into the sea must comply with national regulations and standards on radiation protection.
禁止向海域排放油类、酸液、碱液和毒液。
It is prohibited to discharge oils, acid liquids, alkali liquids, and toxic liquids into the sea.
向海域排放含油废水、含有害重金属废水和其他工业废水,必须经过处理,符合国家和地方规定的排放标准和有关规定。处理后的残渣不得弃置入海。
Wastewater containing oil, harmful heavy metals, and other industrial wastewater discharged into the sea must be treated to meet national and local discharge standards and relevant regulations. The residue after treatment shall not be discarded into the sea.
向海域排放含病原体的废水,必须经过处理,符合国家和地方规定的排放标准和有关规定。
Wastewater containing pathogens discharged into the sea must be treated to meet national and local discharge standards and relevant regulations.
向海域排放含热废水的水温应当符合国家有关规定。
The temperature of thermal wastewater discharged into the sea shall comply with relevant national regulations.
向自净能力较差的海域排放含有机物和营养物质的工业废水和生活废水,应当控制排放量;排污口应当设置在海水交换良好处,并采用合理的排放方式,防止海水富营养化。
For discharge of industrial and domestic wastewater containing organic matter and nutrients into sea areas with poor self-purification capacity, the discharge volume shall be controlled; the discharge outlet shall be located in areas with good seawater exchange, and a reasonable discharge method shall be adopted to prevent eutrophication.
禁止将失效或者禁用的药物及药具弃置岸滩。
It is prohibited to discard expired or banned drugs and medical devices on the shore or beach.
入海河口处发生陆源污染物污染损害海洋环境事故,确有证据证明是由河流携带污染物造成的,由入海河口处所在地的省、自治区、直辖市人民政府环境保护行政主管部门调查处理;河流跨越省、自治区、直辖市的,由入海河口处所在省、自治区、直辖市人民政府环境保护行政主管部门和水利部门会同有关省、自治区、直辖市人民政府环境保护行政主管部门、水利部门和流域管理机构调查处理。
When a pollution accident caused by land-sourced pollutants occurs at a sea-entering river mouth, and there is evidence that it was caused by pollutants carried by the river, the environmental protection administrative department of the province, autonomous region, or municipality directly under the Central Government where the river mouth is located shall investigate and handle the matter; if the river crosses provinces, autonomous regions, or municipalities, the environmental protection administrative department and water conservancy department of the province where the river mouth is located shall jointly investigate and handle the matter with the environmental protection administrative departments, water conservancy departments, and river basin management agencies of the relevant provinces.
沿海相邻或者相向地区向同一海域排放陆源污染物的,由有关地方人民政府协商制定共同防治陆源污染物污染损害海洋环境的措施。
When adjacent or opposite coastal areas discharge land-sourced pollutants into the same sea area, the relevant local people's governments shall negotiate and formulate joint measures to prevent and control pollution damage to the marine environment by land-sourced pollutants.
一切单位和个人造成陆源污染物污染损害海洋环境事故时,必须立即采取措施处理,并在事故发生后四十八小时内,向当地人民政府环境保护行政主管部门作出事故发生的时间、地点、类型和排放污染物的数量、经济损失、人员受害等情况的初步报告,并抄送有关部门。事故查清后,应当向当地人民政府环境保护行政主管部门作出书面报告,并附有关证明文件。
When any unit or individual causes a pollution accident of land-sourced pollutants damaging the marine environment, they must immediately take measures to handle it, and within 48 hours after the accident, submit a preliminary report to the local environmental protection administrative department of the people's government, including the time, location, type, quantity of pollutants discharged, economic losses, and personnel injuries, and copy it to relevant departments. After the accident is clarified, a written report shall be submitted to the local environmental protection administrative department, along with relevant supporting documents.
各级人民政府环境保护行政主管部门接到陆源污染物污染损害海洋环境事故的初步报告后,应当立即会同有关部门采取措施,消除或者减轻污染,并由县级以上人民政府环境保护行政主管部门会同有关部门或者由县级以上人民政府环境保护行政主管部门授权的部门对事故进行调查处理。
Upon receiving the preliminary report of a pollution accident of land-sourced pollutants damaging the marine environment, the environmental protection administrative departments of people's governments at all levels shall immediately take measures jointly with relevant departments to eliminate or mitigate the pollution, and the environmental protection administrative department of the people's government at or above the county level shall investigate and handle the accident jointly with relevant departments or by a department authorized by it.
县级以上人民政府环境保护行政主管部门,按照项目管理权限,可以会同项目主管部门对排放陆源污染物的单位和个人进行现场检查,被检查者必须如实反映情况、提供资料。检查者有责任为被检查者保守技术秘密和业务秘密。法律法规另有规定的除外。
The environmental protection administrative departments of people's governments at or above the county level may, in accordance with project management authority, conduct on-site inspections of units and individuals discharging land-sourced pollutants jointly with the project competent department. The inspected party must truthfully reflect the situation and provide materials. The inspectors have the duty to keep confidential the technical and business secrets of the inspected party, unless otherwise provided by laws and regulations.
违反本条例规定,具有下列情形之一的,由县级以上人民政府环境保护行政主管部门责令改正,并可处以三百元以上三千元以下的罚款:
In violation of these regulations, under any of the following circumstances, the environmental protection administrative department of the people's government at or above the county level shall order correction and may impose a fine of not less than 300 yuan but not more than 3,000 yuan:
(一)拒报或者谎报排污申报登记事项的;
(1) Refusing to report or falsely reporting pollutant discharge registration items;
(二)拒绝、阻挠环境保护行政主管部门现场检查,或者在被检查中弄虚作假的。
(2) Refusing or obstructing on-site inspection by the environmental protection administrative department, or practicing fraud during inspection.
废弃物堆放场、处理场的防污染设施未经环境保护行政主管部门验收或者验收不合格而强行使用的,由环境保护行政主管部门责令改正,并可处以五千元以上二万元以下的罚款。
If the pollution prevention facilities of a wastestockpile yard or treatment facility are used without passing acceptance inspection by the environmental protection administrative department or after failing acceptance inspection, the environmental protection administrative department shall order correction and may impose a fine of not less than 5,000 yuan but not more than 20,000 yuan.
违反本条例规定,具有下列情形之一的,由县级以上人民政府环境保护行政主管部门责令改正,并可处以五千元以上十万元以下的罚款:
In violation of these regulations, under any of the following circumstances, the environmental protection administrative department of the people's government at or above the county level shall order correction and may impose a fine of not less than 5,000 yuan but not more than 100,000 yuan:
(一)未经所在地环境保护行政主管部门同意和原批准部门批准,擅自改变污染物排放的种类、增加污染物排放的数量、浓度或者拆除、闲置污染物处理设施的;
(1) Without the consent of the local environmental protection administrative department and the approval of the original approving department, arbitrarily changing the type of pollutants discharged, increasing the quantity or concentration of pollutants discharged, or dismantling or leaving idle pollutant treatment facilities;
(二)在本条例第八条第一款规定的区域内兴建排污口的。
(2) Establishing a discharge outlet in the area specified in the first paragraph of Article 8 of these Regulations.
违反本条例规定,具有下列情形之一的,由县级以上人民政府环境保护行政主管部门责令改正,并可处以一千元以上二万元以下的罚款;情节严重的,可处以二万元以上十万元以下的罚款:
In violation of these regulations, under any of the following circumstances, the environmental protection administrative department of the people's government at or above the county level shall order correction and may impose a fine of not less than 1,000 yuan but not more than 20,000 yuan; if the circumstances are serious, a fine of not less than 20,000 yuan but not more than 100,000 yuan may be imposed:
(一)在岸滩采用不正当的稀释、渗透方式排放有毒、有害废水的;
(1) Discharging toxic or harmful wastewater by improper dilution or infiltration methods on the shore or beach;
(二)向海域排放含高、中放射性物质的废水的;
(2) Discharging wastewater containing high or medium radioactive substances into the sea;
(三)向海域排放油类、酸液、碱液和毒液的;
(3) Discharging oils, acid liquids, alkaline liquids, or toxic liquids into the sea;
(四)向岸滩弃置失效或者禁用的药物和药具的;
(4) Abandoning expired or prohibited drugs and medical devices on the shore or beach;
(五)向海域排放含油废水、含病原体废水、含热废水、含低放射性物质废水、含有害重金属废水和其他工业废水超过国家和地方规定的排放标准和有关规定或者将处理后的残渣弃置入海的;
(5) Discharging oily wastewater, wastewater containing pathogens, thermal wastewater, wastewater containing low-level radioactive substances, wastewater containing harmful heavy metals, or other industrial wastewater into the sea in excess of national or local discharge standards and relevant provisions, or disposing of treated residues into the sea;
(六)未经县级以上地方人民政府环境保护行政主管部门批准,擅自在岸滩堆放、弃置和处理废弃物或者在废弃物堆放场、处理场内,擅自堆放、处理未经批准的其他种类的废弃物或者露天堆放含剧毒、放射性、易溶解和易挥发性物质的废弃物的。
(6) Without approval from the environmental protection administrative department of the local people's government at or above the county level, arbitrarily piling up, disposing of, or treating wastes on the shore or beach, or arbitrarily piling up or treating other types of wastes not approved in waste storage or treatment sites, or openly piling up wastes containing highly toxic, radioactive, easily soluble, or volatile substances.
对逾期未完成限期治理任务的企业事业单位,征收两倍的超标准排污费,并可根据危害和损失后果,处以一万元以上十万元以下的罚款,或者责令停业、关闭。
For enterprises and institutions that fail to complete the rectification task within the prescribed time limit, a double surcharge for exceeding the discharge standard shall be levied, and depending on the harm and loss consequences, a fine of not less than 10,000 yuan but not more than 100,000 yuan may be imposed, or the enterprise or institution may be ordered to suspend operations or close down.
罚款由环境保护行政主管部门决定。责令停业、关闭,由作出限期治理决定的人民政府决定;责令国务院各部门直接管辖的企业事业单位停业、关闭,须报国务院批准。
The fine shall be decided by the environmental protection administrative department. The order to suspend operations or close down shall be decided by the people's government that made the rectification deadline decision; for enterprises and institutions directly under the jurisdiction of the departments of the State Council, the order to suspend operations or close down must be reported to the State Council for approval.
不按规定缴纳超标准排污费的,除追缴超标准排污费及滞纳金外,并可由县级以上人民政府环境保护行政主管部门处以一千元以上一万元以下的罚款。
If the surcharge for exceeding the discharge standard is not paid in accordance with regulations, in addition to recovering the surcharge and late payment fees, the environmental protection administrative department of the people's government at or above the county level may impose a fine of not less than 1,000 yuan but not more than 10,000 yuan.
对造成陆源污染物污染损害海洋环境事故,导致重大经济损失的,由县级以上人民政府环境保护行政主管部门按照直接损失百分之三十计算罚款,但最高不得超过二十万元。
For accidents causing pollution damage to the marine environment by land-sourced pollutants resulting in significant economic losses, the environmental protection administrative department of the people's government at or above the county level shall calculate the fine at 30% of the direct losses, but the maximum shall not exceed 200,000 yuan.
县级人民政府环境保护行政主管部门可处以一万元以下的罚款,超过一万元的罚款,报上级环境保护行政主管部门批准。
The environmental protection administrative department of the county people's government may impose a fine of not more than 10,000 yuan; fines exceeding 10,000 yuan shall be reported to the superior environmental protection administrative department for approval.
省辖市级人民政府环境保护行政主管部门可处以五万元以下的罚款,超过五万元的罚款,报上级环境保护行政主管部门批准。
The environmental protection administrative department of the people's government at the level of a city divided into districts may impose a fine of not more than 50,000 yuan; fines exceeding 50,000 yuan shall be reported to the superior environmental protection administrative department for approval.
省、自治区、直辖市人民政府环境保护行政主管部门可处以二十万元以下的罚款。
The environmental protection administrative department of the people's government of a province, autonomous region, or municipality directly under the Central Government may impose a fine of not more than 200,000 yuan.
罚款全部上交国库,任何单位和个人不得截留、分成。
All fines shall be turned over to the state treasury, and no unit or individual may retain or share them.
缴纳超标准排污费或者被处以罚款的单位、个人,并不免除消除污染、排除危害和赔偿损失的责任。
Units or individuals that pay the surcharge for exceeding the discharge standard or are fined are not exempted from the responsibility of eliminating pollution, removing hazards, and compensating for losses.
当事人对行政处罚决定不服的,可以在接到处罚通知之日起十五日内,依法申请复议;对复议决定不服的,可以在接到复议决定之日起十五日内,向人民法院起诉。当事人也可以在接到处罚通知之日起十五日内,直接向人民法院起诉。当事人逾期不申请复议、也不向人民法院起诉、又不履行处罚决定的,由作出处罚决定的机关申请人民法院强制执行。
If a party is dissatisfied with the administrative penalty decision, it may, within 15 days from the date of receipt of the penalty notice, apply for reconsideration in accordance with the law; if dissatisfied with the reconsideration decision, it may, within 15 days from the date of receipt of the reconsideration decision, file a lawsuit with the people's court. The party may also directly file a lawsuit with the people's court within 15 days from the date of receipt of the penalty notice. If the party neither applies for reconsideration nor files a lawsuit within the time limit nor complies with the penalty decision, the organ that made the penalty decision shall apply to the people's court for compulsory enforcement.
环境保护行政主管部门工作人员滥用职权、玩忽职守、徇私舞弊的,由其所在单位或者上级主管机关给予行政处分;构成犯罪的,依法追究刑事责任。
If staff members of the environmental protection administrative department abuse their power, neglect their duties, or engage in malpractice for personal gain, they shall be given administrative sanctions by their unit or the competent authority at a higher level; if the conduct constitutes a crime, criminal liability shall be pursued in accordance with the law.
沿海省、自治区、直辖市人民政府,可以根据本条例制定实施办法。
The people's governments of coastal provinces, autonomous regions, and municipalities directly under the Central Government may formulate implementation measures in accordance with these Regulations.
本条例由国务院环境保护行政主管部门负责解释。
These Regulations shall be interpreted by the environmental protection administrative department of the State Council.
本条例自一九九〇年八月一日起施行。
These Regulations shall come into force as of August 1, 1990.
