为了加强对核出口的管制，防止核武器扩散，防范核恐怖主义行为，维护国家安全和社会公共利益，促进和平利用核能的国际合作，制定本条例。
These Regulations are formulated to strengthen the control of nuclear export, prevent the proliferation of nuclear weapons, guard against nuclear terrorism, safeguard national security and public interests, and promote international cooperation in the peaceful use of nuclear energy.
本条例所称核出口，是指《核出口管制清单》(以下简称《管制清单》)所列的核材料、核设备和反应堆用非核材料等物项及其相关技术的贸易性出口及对外赠送、展览、科技合作和援助等方式进行的转移。
For the purposes of these Regulations, 'nuclear export' refers to the commercial export and transfer by means of donation, exhibition, scientific and technological cooperation, and assistance of nuclear materials, nuclear equipment, non-nuclear materials for reactors, and related technologies listed in the Nuclear Export Control List (hereinafter referred to as the Control List).
国家对核出口实行严格管制，严格履行所承担的不扩散核武器的国际义务。
The State exercises strict control over nuclear export and strictly fulfills its international obligations of non-proliferation of nuclear weapons.
国家严格限制铀浓缩设施、设备，辐照燃料后处理设施、设备，重水生产设施、设备等物项及其相关技术等核扩散敏感物项，以及可以用于核武器或者其他核爆炸装置的材料的出口。
The State strictly restricts the export of nuclear proliferation-sensitive items such as uranium enrichment facilities and equipment, irradiated fuel reprocessing facilities and equipment, heavy water production facilities and equipment, and related technologies, as well as materials that can be used for nuclear weapons or other nuclear explosive devices.
核出口应当遵守国家有关法律、行政法规的规定，不得损害国家安全或者社会公共利益。
Nuclear export shall comply with the provisions of relevant laws and administrative regulations of the State and shall not harm national security or public interests.
核出口审查、许可，应当遵循下列准则：
The examination and approval of nuclear export shall follow the following criteria:
(一)接受方政府保证不将中国供应的核材料、核设备或者反应堆用非核材料以及通过其使用而生产的特种可裂变材料用于任何核爆炸目的。
(1) The government of the recipient state guarantees that the nuclear materials, nuclear equipment, or non-nuclear materials for reactors supplied by China, as well as the special fissionable materials produced through their use, will not be used for any nuclear explosive purpose.
(二)接受方政府保证对中国供应的核材料以及通过其使用而生产的特种可裂变材料采取适当的实物保护措施。
(2) The government of the recipient state guarantees to take appropriate physical protection measures for the nuclear materials supplied by China and the special fissionable materials produced through their use.
(三)接受方政府同国际原子能机构订有有效的全面保障协定。本项规定不适用于同国际原子能机构订有自愿保障协定的国家。
(3) The government of the recipient state has an effective comprehensive safeguards agreement with the International Atomic Energy Agency. This provision does not apply to states that have a voluntary safeguards agreement with the International Atomic Energy Agency.
(四)接受方保证，未经中国国家原子能机构事先书面同意，不向第三方再转让中国所供应的核材料、核设备或者反应堆用非核材料及其相关技术；经事先同意进行再转让的，接受再转让的第三方应当承担相当于由中国直接供应所承担的义务。
(4) The recipient state guarantees that, without the prior written consent of the China Atomic Energy Authority, it will not retransfer to any third party the nuclear materials, nuclear equipment, or non-nuclear materials for reactors supplied by China and related technologies; if retransfer is permitted with prior consent, the third party receiving the retransfer shall assume obligations equivalent to those assumed if directly supplied by China.
(五)接受方政府保证，未经中国政府同意，不得利用中国供应的铀浓缩设施、技术或者以此技术为基础的任何设施生产富集度高于20%的浓缩铀。
(5) The government of the recipient state guarantees that, without the consent of the Chinese government, it will not use the uranium enrichment facilities or technology supplied by China, or any facility based on such technology, to produce enriched uranium with an enrichment level higher than 20%.
核出口由国务院指定的单位专营，任何其他单位或者个人不得经营。
Nuclear export shall be handled exclusively by units designated by the State Council; no other unit or individual may engage in such export.
出口《管制清单》所列物项及其相关技术，应当向国家原子能机构提出申请，填写核出口申请表并提交下列文件：
To export items and related technologies listed in the Control List, an application shall be submitted to the China Atomic Energy Authority, filling in a nuclear export application form and submitting the following documents:
(一)申请人从事核出口的专营资格证明；
(1) Certificate of the applicant's exclusive qualification for engaging in nuclear export;
(二)申请人的法定代表人、主要经营管理人以及经办人的身份证明；
(2) Identity certificates of the legal representative, principal management personnel, and handling personnel of the applicant;
(三)合同或者协议的副本；
(3) Copy of the contract or agreement;
(四)核材料或者反应堆用非核材料分析报告单；
(4) Analysis report of nuclear materials or non-nuclear materials for reactors;
(五)最终用户证明；
(5) End-user certificate;
(六)接受方依照本条例第五条规定提供的保证证明；
(6) Guarantee certificate provided by the recipient state in accordance with Article 5 of these Regulations;
(七)审查机关要求提交的其他文件。
(7) Other documents required by the reviewing authority.
申请人应当如实填写核出口申请表。
The applicant shall truthfully fill in the nuclear export application form.
核出口申请表由国家原子能机构统一印制。
The nuclear export application form shall be uniformly printed by the China Atomic Energy Authority.
核出口申请表上填报的事项发生变化的，申请人应当及时提出修正，或者重新提出出口申请。
If the items filled in the nuclear export application form change, the applicant shall promptly make corrections or submit a new export application.
申请人中止核出口时，应当及时撤回核出口申请。
If the applicant suspends the nuclear export, it shall promptly withdraw the nuclear export application.
国家原子能机构应当自收到核出口申请表及本条例第七条所列文件之日起15个工作日内，提出审查意见，并通知申请人；经审查同意的，应当区分情况，依照下列规定处理：
The National Atomic Energy Agency shall, within 15 working days from the date of receipt of the nuclear export application form and the documents listed in Article 7 of these Regulations, provide a review opinion and notify the applicant; if the review approves, it shall, depending on the circumstances, handle as follows:
(一)出口核材料的，转送国防科学技术工业委员会复审或者国防科学技术工业委员会会同有关部门复审；
(1) For export of nuclear materials, transfer to the Commission of Science, Technology and Industry for National Defense for re-examination or the Commission of Science, Technology and Industry for National Defense together with relevant departments for re-examination;
(二)出口核设备或者反应堆用非核材料及其相关技术的，转送商务部复审或者商务部会同国防科学技术工业委员会等有关部门复审。
(2) For export of nuclear equipment or non-nuclear materials for reactors and related technologies, transfer to the Ministry of Commerce for re-examination or the Ministry of Commerce together with the Commission of Science, Technology and Industry for National Defense and other relevant departments for re-examination.
国防科学技术工业委员会、商务部应当自收到国家原子能机构转送的核出口申请表和本条例第七条所列文件及审查意见之日起15个工作日内提出复审意见，并通知申请人。
The Commission of Science, Technology and Industry for National Defense and the Ministry of Commerce shall, within 15 working days from the date of receipt of the nuclear export application form, the documents listed in Article 7 of these Regulations, and the review opinion transferred by the National Atomic Energy Agency, provide a re-examination opinion and notify the applicant.
国家原子能机构、国防科学技术工业委员会、商务部因特殊情况，需要延长审查或者复审期限的，可以延长15个工作日，但是应当通知申请人。
If the National Atomic Energy Agency, the Commission of Science, Technology and Industry for National Defense, or the Ministry of Commerce needs to extend the review or re-examination period due to special circumstances, it may extend by 15 working days, but shall notify the applicant.
对国家安全、社会公共利益或者外交政策有重要影响的核出口，国家原子能机构、国防科学技术工业委员会、商务部审查或者复审时，应当会商外交部等有关部门；必要时，应当报国务院审批。
For nuclear exports that have a significant impact on national security, public interests, or foreign policy, the National Atomic Energy Agency, the Commission of Science, Technology and Industry for National Defense, and the Ministry of Commerce shall, during review or re-examination, consult with the Ministry of Foreign Affairs and other relevant departments; if necessary, the matter shall be submitted to the State Council for approval.
报国务院审批的，不受本条例第十条规定时限的限制。
Matters submitted to the State Council for approval are not subject to the time limits stipulated in Article 10 of these Regulations.
核出口申请依照本条例规定经复审或者审批同意的，由商务部颁发核出口许可证。
If a nuclear export application is approved after re-examination or approval in accordance with these Regulations, the Ministry of Commerce shall issue a nuclear export license.
核出口许可证持有人改变原申请出口的物项及其相关技术的，应当交回原许可证，并依照本条例的规定，重新申请、领取核出口许可证。
If the holder of a nuclear export license changes the items or related technologies originally applied for export, the original license shall be returned, and a new nuclear export license shall be reapplied for and obtained in accordance with these Regulations.
商务部颁发核出口许可证后，应当书面通知国家原子能机构。
After issuing a nuclear export license, the Ministry of Commerce shall notify the National Atomic Energy Agency in writing.
核出口专营单位进行核出口时，应当向海关出具核出口许可证，依照海关法的规定办理海关手续，并接受海关监管。
When a specialized nuclear export unit conducts nuclear export, it shall present the nuclear export license to the customs, go through customs formalities in accordance with the Customs Law, and accept customs supervision.
海关可对出口经营者出口的物项及其技术是否需要办理核出口证件提出质疑，并可要求其向商务部申请办理是否属于核出口管制范围的证明文件；属于核出口管制范围的，应当依照本条例的规定申请取得核出口许可证。
Customs may question whether the items and technologies exported by an export operator require nuclear export documents, and may require the operator to apply to the Ministry of Commerce for a certificate proving whether the items fall within the scope of nuclear export control; if they fall within the scope of nuclear export control, a nuclear export license shall be applied for and obtained in accordance with these Regulations.
接受方或者其政府违反其依照本条例第五条规定作出的保证，或者出现核扩散、核恐怖主义危险时，国防科学技术工业委员会、商务部会同外交部等有关部门，有权作出中止出口有关物项或者相关技术的决定，并书面通知海关执行。
If the recipient or its government violates the assurances made in accordance with Article 5 of these Regulations, or if there is a risk of nuclear proliferation or nuclear terrorism, the Commission of Science, Technology and Industry for National Defense and the Ministry of Commerce, together with the Ministry of Foreign Affairs and other relevant departments, have the authority to decide to suspend the export of the relevant items or related technologies, and notify the customs in writing for implementation.
违反本条例规定，出口核材料、核设备、反应堆用非核材料的，依照海关法的规定处罚。
Anyone who violates these Regulations by exporting nuclear materials, nuclear equipment, or non-nuclear materials for reactors shall be punished in accordance with the Customs Law.
违反本条例规定，出口《管制清单》所列有关技术的，由商务部给予警告，处违法经营额1倍以上5倍以下罚款；违法经营额不足5万元的，处5万元以上25万元以下罚款；有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。
Anyone who violates these Regulations by exporting technologies listed in the Control List shall be given a warning by the Ministry of Commerce and fined between 1 and 5 times the illegal turnover; if the illegal turnover is less than 50,000 yuan, a fine of between 50,000 and 250,000 yuan shall be imposed; any illegal gains shall be confiscated; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law.
伪造、变造、买卖核出口许可证，或者以欺骗等不正当手段获取核出口许可证的，依照有关法律、行政法规的规定处罚；构成犯罪的，依法追究刑事责任。
Anyone who forges, alters, or trades nuclear export licenses, or obtains nuclear export licenses by fraud or other improper means, shall be punished in accordance with relevant laws and administrative regulations; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law.
国家核出口管制工作人员玩忽职守、徇私舞弊或者滥用职权，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。
If state personnel responsible for nuclear export control neglect their duties, engage in malpractice for personal gain, or abuse their power, and if the act constitutes a crime, criminal liability shall be pursued in accordance with the law; if it does not constitute a crime, administrative sanctions shall be imposed in accordance with the law.
国家原子能机构会同国防科学技术工业委员会、商务部、外交部、海关总署等有关部门根据实际情况，可以对《管制清单》进行调整，并予以公布。
The National Atomic Energy Agency, together with the Commission of Science, Technology and Industry for National Defense, the Ministry of Commerce, the Ministry of Foreign Affairs, the General Administration of Customs, and other relevant departments, may adjust the Control List based on actual circumstances and publish it.
中华人民共和国缔结或者参加的国际条约同本条例有不同规定的，适用国际条约的规定；但是，中华人民共和国声明保留的条款除外。
If an international treaty concluded or acceded to by the People's Republic of China contains provisions different from those of these Regulations, the provisions of the international treaty shall apply, except for clauses on which the People's Republic of China has declared reservations.
《管制清单》所列物项及其相关技术从保税仓库、保税区、出口加工区等海关特殊监管区域、保税场所出口，适用本条例的规定。
The export of items and related technologies listed in the Control List from bonded warehouses, bonded zones, export processing zones, and other special customs supervision areas or bonded premises shall be governed by these Regulations.
《管制清单》所列物项及其相关技术的过境、转运、通运，参照本条例的规定执行。
The transit, transshipment, and through shipment of items and related technologies listed in the Control List shall be handled with reference to these Regulations.
本条例自发布之日起施行。
These Regulations shall come into force as of the date of promulgation.
