These Regulations are formulated to implement the Marine Environment Protection Law of the People's Republic of China, strictly control the dumping of wastes into the sea, prevent pollution damage to the marine environment, maintain ecological balance, protect marine resources, and promote the development of marine undertakings.

TranslationArticle 2

"Dumping" in these Regulations means the disposal of wastes and other substances from vessels, aircraft, platforms, and other conveyances into the sea; the abandonment of vessels, aircraft, platforms, and other man-made structures at sea; and the disposal into the sea of wastes and other substances generated from the exploration and development of seabed mineral resources and related offshore processing.

Any unit that needs to dump wastes into the sea shall submit an application to the competent authority in advance, fill in a waste dumping application form in the prescribed format, and attach a test report on the characteristics and composition of the wastes.

TranslationArticle 7

Foreign wastes shall not be transported to the sea areas under the jurisdiction of the People's Republic of China for dumping, including the abandonment of vessels, aircraft, platforms, and other man-made structures at sea. Violators may be ordered by the competent authority to rectify within a time limit, pay pollution cleanup costs, compensate for losses, and be subject to fines.

Any vessel or other conveyance transporting wastes through the sea areas under the jurisdiction of the People's Republic of China for the purpose of dumping shall notify the competent authority 15 days before entering the sea areas under the jurisdiction of the People's Republic of China, and at the same time report the time of entry, route, and the name, quantity, and composition of the wastes.

TranslationArticle 11

Wastes are classified into three categories based on their toxicity, content of hazardous substances, and impact on the marine environment. The classification standards shall be formulated by the competent authority. The competent authority may revise the annexes based on changes in the marine ecological environment, advances in science and technology, and the needs of marine environmental protection.

In case of emergency where disposal on land would seriously endanger human health, an emergency permit may be obtained with the approval of the State Oceanic Administration, and dumping may be carried out in designated areas in accordance with prescribed methods.

Translation

Verification shall be carried out according to the matters stated in the permit. If the competent authority finds that the actual loading does not match the contents stated in the permit, it shall order the suspension of loading; if the circumstances are serious, it shall suspend or revoke the permit.

The competent authority shall monitor and supervise marine dumping activities, and may send personnel on board when necessary. Dumping units shall provide convenience for accompanying official personnel.

Units approved to dump waste into the sea shall dump at the designated area within the time limit and under the conditions specified in the permit, truthfully and in detail fill in the dumping record form, and submit the record form to the competent authority as required by the permit. Vessels, aircraft, platforms, and other means of transport engaged in dumping shall have clear markings and signals, and shall record the dumping situation in detail in the logbook.

TranslationArticle 15

Vessels, aircraft, platforms, and other means of transport engaged in dumping that fall under the circumstances specified in Articles 89 and 91 of the Marine Environment Protection Law of the People's Republic of China may be exempted from liability for compensation.

为紧急避险或救助人命,未按许可证规定的条件和区域进行倾倒时,应尽力避免或减轻因倾倒而造成的污染损害,并在事后尽快向主管部门报告。倾倒单位和紧急避险或救助人命的受益者,应对由此所造成的污染损害进行补偿。

Translation

If dumping is carried out not in accordance with the conditions and areas specified in the permit due to emergency avoidance or rescue of human life, efforts shall be made to avoid or mitigate pollution damage caused by the dumping, and a report shall be submitted to the competent authority as soon as possible after the event. The dumping unit and the beneficiary of the emergency avoidance or rescue of human life shall compensate for the pollution damage caused thereby.

TranslationArticle 16

The competent authority shall regularly monitor the marine dumping areas, strengthen management, and avoid harmful effects on fishery resources and other maritime activities. When it is found that a dumping area is no longer suitable for dumping, the competent authority may decide to close it.

For violations of these Regulations causing marine environmental pollution damage, the competent authority may order the violator to rectify within a time limit, pay cleanup costs, compensate the injured party for losses caused thereby, and depending on the seriousness of the circumstances and the extent of pollution damage, impose a warning or a fine of not more than RMB 100,000.

Units and individuals claiming compensation for losses shall submit a pollution damage claim report to the competent authority as soon as possible. Units entrusted with cleanup operations shall, as soon as possible after the completion of the operation, submit a report to the competent authority requesting cleanup costs. The report shall include: the time and location of the cleanup, the manpower, machinery, and vessels deployed, the quantity and unit price of cleanup materials, calculation methods, management fees for organizing the cleanup, transportation costs, and other related expenses, the cleanup effect and situation, and other relevant evidence and supporting materials.

For persons directly responsible for violations of these Regulations that cause or are likely to cause marine environmental pollution damage, the competent authority may impose a warning or a fine, or both.

If a party is dissatisfied with the penalty decision of the competent authority, it may file a lawsuit with the People's Court within 15 days from the date of receipt of the penalty notice; if no lawsuit is filed within the time limit and the penalty decision is not complied with, the competent authority shall apply to the People's Court for compulsory enforcement.
