总 则
General Provisions
为了保证直接关系公共安全、人体健康、生命财产安全的重要工业产品的质量安全，贯彻国家产业政策，促进社会主义市场经济健康、协调发展，制定本条例。
These Regulations are formulated to ensure the quality and safety of important industrial products that directly affect public safety, human health, and the safety of life and property, to implement national industrial policies, and to promote the healthy and coordinated development of the socialist market economy.
国家对生产下列重要工业产品的企业实行生产许可证制度：
The State implements a production license system for enterprises producing the following important industrial products:
(一)乳制品、肉制品、饮料、米、面、食用油、酒类等直接关系人体健康的加工食品；
(1) Processed foods that directly affect human health, such as dairy products, meat products, beverages, rice, flour, edible oils, and alcoholic beverages;
(二)电热毯、压力锅、燃气热水器等可能危及人身、财产安全的产品；
(2) Products that may endanger personal or property safety, such as electric blankets, pressure cookers, and gas water heaters;
(三)税控收款机、防伪验钞仪、卫星电视广播地面接收设备、无线广播电视发射设备等关系金融安全和通信质量安全的产品；
(3) Products that affect financial security and communication quality safety, such as tax control cash registers, anti-counterfeit currency detectors, satellite television broadcasting ground receiving equipment, and wireless broadcasting and television transmitting equipment;
(四)安全网、安全帽、建筑扣件等保障劳动安全的产品；
(4) Products that ensure labor safety, such as safety nets, safety helmets, and building fasteners;
(五)电力铁塔、桥梁支座、铁路工业产品、水工金属结构、危险化学品及其包装物、容器等影响生产安全、公共安全的产品；
(5) Products that affect production safety and public safety, such as power transmission towers, bridge bearings, railway industrial products, hydraulic metal structures, hazardous chemicals and their packaging and containers;
(六)法律、行政法规要求依照本条例的规定实行生产许可证管理的其他产品。
(6) Other products that laws and administrative regulations require to be subject to production license management in accordance with these Regulations.
国家实行生产许可证制度的工业产品目录(以下简称目录)由国务院工业产品生产许可证主管部门会同国务院有关部门制定，并征求消费者协会和相关产品行业协会的意见，报国务院批准后向社会公布。
The catalogue of industrial products subject to the production license system (hereinafter referred to as the Catalogue) shall be formulated by the competent department for production licenses of industrial products under the State Council jointly with the relevant departments of the State Council, and after soliciting opinions from consumer associations and relevant product industry associations, shall be submitted to the State Council for approval and then published to the public.
工业产品的质量安全通过消费者自我判断、企业自律和市场竞争能够有效保证的，不实行生产许可证制度。
If the quality and safety of industrial products can be effectively guaranteed through consumer self-judgment, enterprise self-discipline, and market competition, the production license system shall not be implemented.
工业产品的质量安全通过认证认可制度能够有效保证的，不实行生产许可证制度。
If the quality and safety of industrial products can be effectively guaranteed through the certification and accreditation system, the production license system shall not be implemented.
国务院工业产品生产许可证主管部门会同国务院有关部门适时对目录进行评价、调整和逐步缩减，报国务院批准后向社会公布。
The competent department for production licenses of industrial products under the State Council shall, jointly with the relevant departments of the State Council, timely evaluate, adjust, and gradually reduce the Catalogue, and submit it to the State Council for approval before publishing it to the public.
在中华人民共和国境内生产、销售或者在经营活动中使用列入目录产品的，应当遵守本条例。
The production, sale, or use in business activities of products listed in the Catalogue within the territory of the People's Republic of China shall comply with these Regulations.
列入目录产品的进出口管理依照法律、行政法规和国家有关规定执行。
The import and export management of products listed in the Catalogue shall be implemented in accordance with laws, administrative regulations, and relevant state provisions.
任何企业未取得生产许可证不得生产列入目录的产品。任何单位和个人不得销售或者在经营活动中使用未取得生产许可证的列入目录的产品。
No enterprise may produce products listed in the Catalogue without obtaining a production license. No unit or individual may sell or use in business activities products listed in the Catalogue that have not obtained a production license.
国务院工业产品生产许可证主管部门依照本条例负责全国工业产品生产许可证统一管理工作，县级以上地方工业产品生产许可证主管部门负责本行政区域内的工业产品生产许可证管理工作。
The competent department for production licenses of industrial products under the State Council shall, in accordance with these Regulations, be responsible for the unified management of production licenses for industrial products nationwide. The competent departments for production licenses of industrial products at or above the county level shall be responsible for the management of production licenses for industrial products within their respective administrative regions.
国家对实行工业产品生产许可证制度的工业产品，统一目录，统一审查要求，统一证书标志，统一监督管理。
The State shall implement a unified catalogue, unified review requirements, unified certificate markings, and unified supervision and management for industrial products subject to the production license system.
工业产品生产许可证管理，应当遵循科学公正、公开透明、程序合法、便民高效的原则。
The management of production licenses for industrial products shall follow the principles of scientific fairness, openness and transparency, legal procedures, and convenience and efficiency for the people.
县级以上工业产品生产许可证主管部门及其人员、检验机构和检验人员，对所知悉的国家秘密和商业秘密负有保密义务。
The competent departments for production licenses of industrial products at or above the county level and their personnel, inspection institutions, and inspection personnel shall have a duty of confidentiality regarding state secrets and commercial secrets they become aware of.
申请与受理
Application and Acceptance
企业取得生产许可证，应当符合下列条件：
To obtain a production license, an enterprise shall meet the following conditions:
(一)有营业执照；
(1) Having a business license;
(二)有与所生产产品相适应的专业技术人员；
(2) Having professional and technical personnel suitable for the products produced;
(三)有与所生产产品相适应的生产条件和检验检疫手段；
(3) Having production conditions and inspection and quarantine means suitable for the products produced;
(四)有与所生产产品相适应的技术文件和工艺文件；
(4) Having technical documents and process documents suitable for the products produced;
(五)有健全有效的质量管理制度和责任制度；
(5) Having sound and effective quality management systems and responsibility systems;
(六)产品符合有关国家标准、行业标准以及保障人体健康和人身、财产安全的要求；
(6) The products comply with relevant national standards, industry standards, and requirements for protecting human health and personal and property safety;
(七)符合国家产业政策的规定，不存在国家明令淘汰和禁止投资建设的落后工艺、高耗能、污染环境、浪费资源的情况。
(7) Complying with the provisions of national industrial policies, and there is no situation of backward processes, high energy consumption, environmental pollution, or waste of resources that are explicitly eliminated or prohibited from investment by the State.
法律、行政法规有其他规定的，还应当符合其规定。
If there are other provisions in laws and administrative regulations, those provisions shall also be complied with.
国务院工业产品生产许可证主管部门依照本条例第九条规定的条件，根据工业产品的不同特性，制定并发布取得列入目录产品生产许可证的具体要求；需要对列入目录产品生产许可证的具体要求作特殊规定的，应当会同国务院有关部门制定并发布。
The competent department for production licenses of industrial products under the State Council shall, in accordance with the conditions specified in Article 9 of these Regulations and based on the different characteristics of industrial products, formulate and publish specific requirements for obtaining production licenses for products listed in the Catalogue; if special provisions are needed for the specific requirements for production licenses for products listed in the Catalogue, they shall be formulated and published jointly with the relevant departments of the State Council.
制定列入目录产品生产许可证的具体要求，应当征求消费者协会和相关产品行业协会的意见。
When formulating specific requirements for production licenses for products listed in the Catalogue, opinions shall be solicited from consumer associations and relevant product industry associations.
企业生产列入目录的产品，应当向企业所在地的省、自治区、直辖市工业产品生产许可证主管部门申请取得生产许可证。
An enterprise that produces products listed in the Catalogue shall apply to the competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government where the enterprise is located to obtain a production license.
企业正在生产的产品被列入目录的，应当在国务院工业产品生产许可证主管部门规定的时间内申请取得生产许可证。
If an enterprise is already producing a product that is subsequently included in the Catalogue, it shall apply for a production license within the time limit prescribed by the competent department for production licenses of industrial products under the State Council.
企业的申请可以通过信函、电报、电传、传真、电子数据交换和电子邮件等方式提出。
An enterprise's application may be submitted by means of letters, telegrams, telex, fax, electronic data interchange, or email.
省、自治区、直辖市工业产品生产许可证主管部门收到企业的申请后，应当依照《中华人民共和国行政许可法》的有关规定办理。
Upon receiving an enterprise's application, the competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government shall handle it in accordance with the relevant provisions of the Administrative License Law of the People's Republic of China.
省、自治区、直辖市工业产品生产许可证主管部门以及其他任何单位不得另行附加任何条件，限制企业申请取得生产许可证。
The competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government, and any other unit, shall not impose additional conditions to restrict an enterprise from applying for a production license.
审查与决定
Review and Decision
省、自治区、直辖市工业产品生产许可证主管部门受理企业申请后，应当组织对企业进行审查。依照列入目录产品生产许可证的具体要求，应当由国务院工业产品生产许可证主管部门组织对企业进行审查的，省、自治区、直辖市工业产品生产许可证主管部门应当自受理企业申请之日起5日内将全部申请材料报送国务院工业产品生产许可证主管部门。
After accepting an enterprise's application, the competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government shall organize a review of the enterprise. If, according to the specific requirements for production licenses for products listed in the Catalogue, the review should be organized by the competent department for production licenses of industrial products under the State Council, the competent department of the province, autonomous region, or municipality directly under the Central Government shall, within 5 days from the date of accepting the application, submit all application materials to the competent department under the State Council.
对企业的审查包括对企业的实地核查和对产品的检验。
The review of an enterprise includes on-site verification of the enterprise and inspection of the products.
对企业进行实地核查，国务院工业产品生产许可证主管部门或者省、自治区、直辖市工业产品生产许可证主管部门应当指派2至4名核查人员，企业应当予以配合。
For on-site verification of an enterprise, the competent department for production licenses of industrial products under the State Council or the competent department of the province, autonomous region, or municipality directly under the Central Government shall assign 2 to 4 verification personnel, and the enterprise shall cooperate.
核查人员经国务院工业产品生产许可证主管部门组织考核合格，取得核查人员证书，方可从事相应的核查工作。
Verification personnel may engage in corresponding verification work only after passing the assessment organized by the competent department for production licenses of industrial products under the State Council and obtaining a verification personnel certificate.
核查人员依照本条例第九条规定的条件和列入目录产品生产许可证的具体要求对企业进行实地核查。
Verification personnel shall conduct on-site verification of the enterprise in accordance with the conditions specified in Article 9 of these Regulations and the specific requirements for production licenses for products listed in the Catalogue.
核查人员对企业进行实地核查，不得刁难企业，不得索取、收受企业的财物，不得谋取其他不当利益。
When conducting on-site verification of an enterprise, verification personnel shall not make things difficult for the enterprise, demand or accept property from the enterprise, or seek other improper benefits.
国务院工业产品生产许可证主管部门或者省、自治区、直辖市工业产品生产许可证主管部门应当自受理企业申请之日起30日内将对企业实地核查的结果书面告知企业。核查不合格的，应当说明理由。
The competent department for production licenses of industrial products under the State Council or the competent department of the province, autonomous region, or municipality directly under the Central Government shall, within 30 days from the date of accepting the application, inform the enterprise in writing of the results of the on-site verification. If the verification is unqualified, the reasons shall be stated.
企业经实地核查合格的，应当及时进行产品检验。需要送样检验的，核查人员应当封存样品，并告知企业在7日内将该样品送达具有相应资质的检验机构。需要现场检验的，由核查人员通知检验机构进行现场检验。
If an enterprise passes the on-site verification, it shall promptly conduct product inspection. If sample inspection is required, the verification personnel shall seal the samples and inform the enterprise to deliver the samples to an inspection institution with corresponding qualifications within 7 days. If on-site inspection is required, the verification personnel shall notify the inspection institution to conduct on-site inspection.
检验机构应当依照国家有关标准、要求进行产品检验，在规定时间内完成检验工作。
Inspection institutions shall conduct product inspection in accordance with relevant national standards and requirements and complete the inspection work within the prescribed time limit.
检验机构和检验人员应当客观、公正、及时地出具检验报告。检验报告经检验人员签字后，由检验机构负责人签署。检验机构和检验人员对检验报告负责。
Inspection institutions and inspection personnel shall issue inspection reports objectively, fairly, and promptly. The inspection report shall be signed by the inspection personnel and then signed by the person in charge of the inspection institution. Inspection institutions and inspection personnel shall be responsible for the inspection reports.
检验机构和检验人员进行产品检验，应当遵循诚信原则和方便企业的原则，为企业提供可靠、便捷的检验服务，不得拖延，不得刁难企业。
When conducting product inspection, inspection institutions and inspection personnel shall follow the principles of good faith and convenience for enterprises, providing reliable and convenient inspection services, and shall not delay or make things difficult for enterprises.
检验机构和检验人员不得从事与其检验的列入目录产品相关的生产、销售活动，不得以其名义推荐或者监制、监销其检验的列入目录产品。
Inspection institutions and inspection personnel shall not engage in production or sales activities related to the products listed in the Catalogue that they inspect, nor recommend, supervise the manufacture, or supervise the sale of such products in their own name.
由省、自治区、直辖市工业产品生产许可证主管部门组织对企业进行审查的，省、自治区、直辖市工业产品生产许可证主管部门应当在完成审查后将审查意见和全部申请材料报送国务院工业产品生产许可证主管部门。
If the review of an enterprise is organized by the competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government, that department shall, after completing the review, submit the review opinions and all application materials to the competent department for production licenses of industrial products under the State Council.
自受理企业申请之日起60日内，国务院工业产品生产许可证主管部门应当作出是否准予许可的决定，作出准予许可决定的，国务院工业产品生产许可证主管部门应当自作出决定之日起10日内向企业颁发工业产品生产许可证证书(以下简称许可证证书)；作出不准予许可决定的，国务院工业产品生产许可证主管部门应当书面通知企业，并说明理由。
Within 60 days from the date of accepting the application, the competent department for production licenses of industrial products under the State Council shall make a decision on whether to grant the license. If a decision to grant the license is made, the competent department under the State Council shall, within 10 days from the date of the decision, issue a production license certificate for industrial products (hereinafter referred to as the license certificate) to the enterprise; if a decision not to grant the license is made, the competent department under the State Council shall notify the enterprise in writing and state the reasons.
检验机构进行产品检验所需时间不计入前款规定的期限。
The time required for product inspection by the inspection institution shall not be counted in the time limit specified in the preceding paragraph.
国务院工业产品生产许可证主管部门应当将作出的相关产品准予许可的决定及时通报国务院发展改革部门、国务院卫生主管部门等有关部门。
The competent department for production licenses of industrial products under the State Council shall promptly notify the relevant departments such as the National Development and Reform Commission and the health administrative department under the State Council of the decisions to grant licenses for relevant products.
生产许可证有效期为5年，但是，食品加工企业生产许可证的有效期为3年。生产许可证有效期届满，企业继续生产的，应当在生产许可证有效期届满6个月前向所在地省、自治区、直辖市工业产品生产许可证主管部门提出换证申请。国务院工业产品生产许可证主管部门或者省、自治区、直辖市工业产品生产许可证主管部门应当依照本条例规定的程序对企业进行审查。
The validity period of a production license is 5 years; however, the validity period of a production license for a food processing enterprise is 3 years. If an enterprise continues production after the expiration of the production license, it shall apply for renewal to the competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government where it is located 6 months before the expiration of the production license. The competent department for production licenses of industrial products under the State Council or the competent department of the province, autonomous region, or municipality directly under the Central Government shall review the enterprise in accordance with the procedures prescribed in these Regulations.
在生产许可证有效期内，产品的有关标准、要求发生改变的，国务院工业产品生产许可证主管部门或者省、自治区、直辖市工业产品生产许可证主管部门可以依照本条例的规定重新组织核查和检验。
If, during the validity period of a production license, the relevant standards or requirements for the product change, the competent department for production licenses of industrial products under the State Council or the competent department of the province, autonomous region, or municipality directly under the Central Government may reorganize verification and inspection in accordance with these Regulations.
在生产许可证有效期内，企业生产条件、检验手段、生产技术或者工艺发生变化的，企业应当及时向所在地省、自治区、直辖市工业产品生产许可证主管部门提出申请，国务院工业产品生产许可证主管部门或者省、自治区、直辖市工业产品生产许可证主管部门应当依照本条例的规定重新组织核查和检验。
If, during the validity period of a production license, the enterprise's production conditions, inspection means, production technology, or processes change, the enterprise shall promptly apply to the competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government where it is located, and the competent department under the State Council or the competent department of the province, autonomous region, or municipality directly under the Central Government shall reorganize verification and inspection in accordance with these Regulations.
国务院工业产品生产许可证主管部门认为需要听证的涉及公共利益的重大许可事项，应当向社会公告，并举行听证。
If the competent department for production licenses of industrial products under the State Council considers that a major licensing matter involving the public interest requires a hearing, it shall announce it to the public and hold a hearing.
国务院工业产品生产许可证主管部门作出的准予许可的决定应当向社会公布。
Decisions to grant licenses made by the competent department for production licenses of industrial products under the State Council shall be published to the public.
国务院工业产品生产许可证主管部门和省、自治区、直辖市工业产品生产许可证主管部门应当将办理生产许可证的有关材料及时归档，公众有权查阅。
The competent department for production licenses of industrial products under the State Council and the competent departments of provinces, autonomous regions, and municipalities directly under the Central Government shall promptly archive relevant materials for handling production licenses, and the public has the right to access them.
证书和标志
Certificates and Markings
许可证证书分为正本和副本。许可证证书应当载明企业名称和住所、生产地址、产品名称、证书编号、发证日期、有效期等相关内容。
The license certificate consists of an original and a duplicate. The license certificate shall indicate the enterprise name and domicile, production address, product name, certificate number, date of issuance, validity period, and other relevant content.
许可证证书格式由国务院工业产品生产许可证主管部门规定。
The format of the license certificate shall be prescribed by the competent department for production licenses of industrial products under the State Council.
企业名称发生变化的，企业应当及时向企业所在地的省、自治区、直辖市工业产品生产许可证主管部门提出申请，办理变更手续。
If the enterprise name changes, the enterprise shall promptly apply to the competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government where it is located to go through the change procedures.
企业应当妥善保管许可证证书，许可证证书遗失或者损毁，应当申请补领，企业所在地的省、自治区、直辖市工业产品生产许可证主管部门应当及时受理申请，办理补领手续。
An enterprise shall properly keep the license certificate. If the license certificate is lost or damaged, it shall apply for a replacement. The competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government where the enterprise is located shall promptly accept the application and handle the replacement procedures.
在生产许可证有效期内，企业不再从事列入目录产品的生产活动的，应当办理生产许可证注销手续。企业不办理生产许可证注销手续的，国务院工业产品生产许可证主管部门应当注销其生产许可证并向社会公告。
If, during the validity period of a production license, an enterprise no longer engages in the production of products listed in the Catalogue, it shall go through the cancellation procedures for the production license. If the enterprise does not go through the cancellation procedures, the competent department for production licenses of industrial products under the State Council shall cancel its production license and announce it to the public.
生产许可证的标志和式样由国务院工业产品生产许可证主管部门规定并公布。
The markings and styles of production licenses shall be prescribed and published by the competent department for production licenses of industrial products under the State Council.
企业必须在其产品或者包装、说明书上标注生产许可证标志和编号。
An enterprise must affix the production license marking and number on its products, packaging, or instructions.
裸装食品和其他根据产品的特点难以标注标志的裸装产品，可以不标注生产许可证标志和编号。
For unpackaged food and other unpackaged products that are difficult to affix markings due to the characteristics of the product, the production license marking and number may not be affixed.
销售和在经营活动中使用列入目录产品的企业，应当查验产品的生产许可证标志和编号。
Enterprises that sell or use products listed in the Catalogue in business activities shall verify the production license marking and number of the products.
任何单位和个人不得伪造、变造许可证证书、生产许可证标志和编号。取得生产许可证的企业不得出租、出借或者以其他形式转让许可证证书和生产许可证标志。
No unit or individual may forge or alter license certificates, production license markings, or numbers. Enterprises that have obtained production licenses shall not rent, lend, or otherwise transfer license certificates or production license markings.
监督检查
Supervision and Inspection
国务院工业产品生产许可证主管部门和县级以上地方工业产品生产许可证主管部门依照本条例规定负责对生产列入目录产品的企业以及核查人员、检验机构及其检验人员的相关活动进行监督检查。
The competent department for production licenses of industrial products under the State Council and the competent departments for production licenses of industrial products at or above the county level shall, in accordance with these Regulations, be responsible for supervising and inspecting the relevant activities of enterprises producing products listed in the Catalogue, as well as verification personnel, inspection institutions, and their inspection personnel.
国务院工业产品生产许可证主管部门对县级以上地方工业产品生产许可证主管部门的生产许可证管理工作进行监督。
The competent department for production licenses of industrial products under the State Council shall supervise the production license management work of the competent departments for production licenses of industrial products at or above the county level.
县级以上工业产品生产许可证主管部门根据已经取得的违法嫌疑证据或者举报，对涉嫌违反本条例的行为进行查处并可以行使下列职权：
The competent departments for production licenses of industrial products at or above the county level may, based on obtained evidence of suspected violations or reports, investigate and handle acts suspected of violating these Regulations and may exercise the following powers:
(一)向有关生产、销售或者在经营活动中使用列入目录产品的单位和检验机构的法定代表人、主要负责人和其他有关人员调查、了解有关涉嫌从事违反本条例活动的情况；
(1) To investigate and understand the relevant circumstances of suspected violations of these Regulations from the legal representatives, principal responsible persons, and other relevant personnel of units and inspection institutions that produce, sell, or use products listed in the Catalogue in business activities;
(二)查阅、复制有关生产、销售或者在经营活动中使用列入目录产品的单位和检验机构的有关合同、发票、账簿以及其他有关资料；
(2) To consult and copy relevant contracts, invoices, account books, and other relevant materials of units and inspection institutions that produce, sell, or use products listed in the Catalogue in business activities;
(三)对有证据表明属于违反本条例生产、销售或者在经营活动中使用的列入目录产品予以查封或者扣押。
(3) To seal up or seize products listed in the Catalogue that are produced, sold, or used in business activities in violation of these Regulations, if there is evidence to that effect.
企业应当保证产品质量稳定合格，并定期向省、自治区、直辖市工业产品生产许可证主管部门提交报告。企业对报告的真实性负责。
Enterprises shall ensure stable and qualified product quality and regularly submit reports to the competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government. Enterprises shall be responsible for the authenticity of the reports.
国务院工业产品生产许可证主管部门和县级以上地方工业产品生产许可证主管部门应当对企业实施定期或者不定期的监督检查。需要对产品进行检验的，应当依照《中华人民共和国产品质量法》的有关规定进行。
The competent department for production licenses of industrial products under the State Council and the competent departments for production licenses of industrial products at or above the county level shall conduct regular or irregular supervision and inspection of enterprises. If product inspection is required, it shall be conducted in accordance with the relevant provisions of the Product Quality Law of the People's Republic of China.
实施监督检查或者对产品进行检验应当有2名以上工作人员参加并应当出示有效证件。
When conducting supervision and inspection or product inspection, at least 2 staff members shall participate and shall present valid credentials.
国务院工业产品生产许可证主管部门和县级以上地方工业产品生产许可证主管部门对企业实施监督检查，不得妨碍企业的正常生产经营活动，不得索取或者收受企业的财物或者谋取其他利益。
When conducting supervision and inspection of enterprises, the competent department for production licenses of industrial products under the State Council and the competent departments for production licenses of industrial products at or above the county level shall not hinder the normal production and business activities of the enterprises, nor demand or accept property from the enterprises or seek other benefits.
国务院工业产品生产许可证主管部门和县级以上地方工业产品生产许可证主管部门依法对企业进行监督检查时，应当对监督检查的情况和处理结果予以记录，由监督检查人员签字后归档。公众有权查阅监督检查记录。
When conducting supervision and inspection of enterprises in accordance with the law, the competent department for production licenses of industrial products under the State Council and the competent departments for production licenses of industrial products at or above the county level shall record the circumstances and results of the supervision and inspection, and the records shall be signed by the supervision and inspection personnel and archived. The public has the right to access the supervision and inspection records.
国务院工业产品生产许可证主管部门应当通过查阅检验报告、检验结论对比等方式，对检验机构的检验过程和检验报告是否客观、公正、及时进行监督检查。
The competent department for production licenses of industrial products under the State Council shall supervise and inspect whether the inspection process and inspection reports of inspection institutions are objective, fair, and timely by reviewing inspection reports, comparing inspection conclusions, and other means.
核查人员、检验机构及其检验人员刁难企业的，企业有权向国务院工业产品生产许可证主管部门和县级以上地方工业产品生产许可证主管部门投诉。国务院工业产品生产许可证主管部门和县级以上地方工业产品生产许可证主管部门接到投诉，应当及时进行调查处理。
If verification personnel, inspection institutions, or their inspection personnel make things difficult for an enterprise, the enterprise has the right to complain to the competent department for production licenses of industrial products under the State Council or the competent departments for production licenses of industrial products at or above the county level. Upon receiving a complaint, the competent department under the State Council or the competent department at or above the county level shall promptly investigate and handle it.
任何单位和个人对违反本条例的行为，有权向国务院工业产品生产许可证主管部门和县级以上地方工业产品生产许可证主管部门举报。国务院工业产品生产许可证主管部门和县级以上地方工业产品生产许可证主管部门接到举报，应当及时调查处理，并为举报人保密。
Any unit or individual has the right to report acts violating these Regulations to the competent department for production licenses of industrial products under the State Council or the competent departments for production licenses of industrial products at or above the county level. Upon receiving a report, the competent department under the State Council or the competent department at or above the county level shall promptly investigate and handle it and keep the reporter confidential.

企业未依照本条例规定申请取得生产许可证而擅自生产列入目录产品的，由工业产品生产许可证主管部门责令停止生产，没收违法生产的产品，处违法生产产品货值金额等值以上3倍以下的罚款；有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。
If an enterprise produces products listed in the Catalogue without applying for a production license in accordance with these Regulations, the competent department for production licenses of industrial products shall order it to stop production, confiscate the illegally produced products, and impose a fine of not less than the value of the illegally produced products but not more than 3 times that value; if there is illegal income, the illegal income shall be confiscated; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
取得生产许可证的企业生产条件、检验手段、生产技术或者工艺发生变化，未依照本条例规定办理重新审查手续的，责令停止生产、销售，没收违法生产、销售的产品，并限期办理相关手续；逾期仍未办理的，处违法生产、销售产品(包括已售出和未售出的产品，下同)货值金额3倍以下的罚款；有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。

取得生产许可证的企业名称发生变化，未依照本条例规定办理变更手续的，责令限期办理相关手续；逾期仍未办理的，责令停止生产、销售，没收违法生产、销售的产品，并处违法生产、销售产品货值金额等值以下的罚款；有违法所得的，没收违法所得。
If an enterprise that has obtained a production license changes its name without going through the change procedures in accordance with these Regulations, it shall be ordered to go through the relevant procedures within a time limit; if it fails to do so within the time limit, it shall be ordered to stop production and sales, confiscate the illegally produced and sold products, and impose a fine of not more than the value of the illegally produced and sold products; if there is illegal income, the illegal income shall be confiscated.
取得生产许可证的企业未依照本条例规定在产品、包装或者说明书上标注生产许可证标志和编号的，责令限期改正；逾期仍未改正的，处违法生产、销售产品货值金额30%以下的罚款；有违法所得的，没收违法所得；情节严重的，吊销生产许可证。
If an enterprise that has obtained a production license fails to affix the production license marking and number on its products, packaging, or instructions in accordance with these Regulations, it shall be ordered to correct within a time limit; if it fails to correct within the time limit, a fine of not more than 30% of the value of the illegally produced and sold products shall be imposed; if there is illegal income, the illegal income shall be confiscated; if the circumstances are serious, the production license shall be revoked.
销售或者在经营活动中使用未取得生产许可证的列入目录产品的，责令改正，处5万元以上20万元以下的罚款；有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。
If products listed in the Catalogue that have not obtained a production license are sold or used in business activities, the violator shall be ordered to correct and fined not less than 50,000 yuan but not more than 200,000 yuan; if there is illegal income, the illegal income shall be confiscated; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
取得生产许可证的企业出租、出借或者转让许可证证书、生产许可证标志和编号的，责令限期改正，处20万元以下的罚款；情节严重的，吊销生产许可证。违法接受并使用他人提供的许可证证书、生产许可证标志和编号的，责令停止生产、销售，没收违法生产、销售的产品，处违法生产、销售产品货值金额等值以上3倍以下的罚款；有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。
If an enterprise that has obtained a production license rents, lends, or transfers its license certificate, production license marking, or number, it shall be ordered to correct within a time limit and fined not more than 200,000 yuan; if the circumstances are serious, the production license shall be revoked. If a party illegally accepts and uses another party's license certificate, production license marking, or number, it shall be ordered to stop production and sales, confiscate the illegally produced and sold products, and impose a fine of not less than the value of the illegally produced and sold products but not more than 3 times that value; if there is illegal income, the illegal income shall be confiscated; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
擅自动用、调换、转移、损毁被查封、扣押财物的，责令改正，处被动用、调换、转移、损毁财物价值5%以上20%以下的罚款；拒不改正的，处被动用、调换、转移、损毁财物价值1倍以上3倍以下的罚款。
If sealed-up or seized property is moved, exchanged, transferred, or damaged without authorization, the violator shall be ordered to correct and fined not less than 5% but not more than 20% of the value of the property moved, exchanged, transferred, or damaged; if the violator refuses to correct, a fine of not less than 1 time but not more than 3 times the value of the property moved, exchanged, transferred, or damaged shall be imposed.
伪造、变造许可证证书、生产许可证标志和编号的，责令改正，没收违法生产、销售的产品，并处违法生产、销售产品货值金额等值以上3倍以下的罚款；有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。
If license certificates, production license markings, or numbers are forged or altered, the violator shall be ordered to correct, confiscate the illegally produced and sold products, and impose a fine of not less than the value of the illegally produced and sold products but not more than 3 times that value; if there is illegal income, the illegal income shall be confiscated; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
企业用欺骗、贿赂等不正当手段取得生产许可证的，由工业产品生产许可证主管部门处20万元以下的罚款，并依照《中华人民共和国行政许可法》的有关规定作出处理。
If an enterprise obtains a production license by improper means such as fraud or bribery, the competent department for production licenses of industrial products shall impose a fine of not more than 200,000 yuan and handle the matter in accordance with the relevant provisions of the Administrative License Law of the People's Republic of China.
取得生产许可证的企业未依照本条例规定定期向省、自治区、直辖市工业产品生产许可证主管部门提交报告的，由省、自治区、直辖市工业产品生产许可证主管部门责令限期改正。
If an enterprise that has obtained a production license fails to submit reports regularly to the competent department for production licenses of industrial products of the province, autonomous region, or municipality directly under the Central Government in accordance with these Regulations, the competent department of the province, autonomous region, or municipality directly under the Central Government shall order it to correct within a time limit.
取得生产许可证的产品经产品质量国家监督抽查或者省级监督抽查不合格的，由工业产品生产许可证主管部门责令限期改正；到期复查仍不合格的，吊销生产许可证。
If a product that has obtained a production license fails a national or provincial product quality supervision spot check, the competent department for production licenses of industrial products shall order it to correct within a time limit; if it still fails a re-inspection upon expiration of the time limit, the production license shall be revoked.
企业被吊销生产许可证的，在3年内不得再次申请同一列入目录产品的生产许可证。
If an enterprise's production license is revoked, it may not apply again for a production license for the same product listed in the Catalogue within 3 years.
承担发证产品检验工作的检验机构伪造检验结论或者出具虚假证明的，由工业产品生产许可证主管部门责令改正，对单位处5万元以上20万元以下的罚款，对直接负责的主管人员和其他直接责任人员处1万元以上5万元以下的罚款；有违法所得的，没收违法所得；情节严重的，撤销其检验资格；构成犯罪的，依法追究刑事责任。
If an inspection institution responsible for inspecting licensed products forges inspection conclusions or issues false certificates, the competent department for production licenses of industrial products shall order it to correct, impose a fine of not less than 50,000 yuan but not more than 200,000 yuan on the institution, and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan on the directly responsible person in charge and other directly responsible personnel; if there is illegal income, the illegal income shall be confiscated; if the circumstances are serious, its inspection qualification shall be revoked; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
检验机构和检验人员从事与其检验的列入目录产品相关的生产、销售活动，或者以其名义推荐或者监制、监销其检验的列入目录产品的，由工业产品生产许可证主管部门处2万元以上10万元以下的罚款；有违法所得的，没收违法所得；情节严重的，撤销其检验资格。
If an inspection institution or inspection personnel engages in production or sales activities related to the products listed in the Catalogue that they inspect, or recommends, supervises the manufacture, or supervises the sale of such products in their own name, the competent department for production licenses of industrial products shall impose a fine of not less than 20,000 yuan but not more than 100,000 yuan; if there is illegal income, the illegal income shall be confiscated; if the circumstances are serious, its inspection qualification shall be revoked.
检验机构和检验人员利用检验工作刁难企业，由工业产品生产许可证主管部门责令改正；拒不改正的，撤销其检验资格。
If an inspection institution or inspection personnel makes things difficult for an enterprise by using inspection work, the competent department for production licenses of industrial products shall order it to correct; if it refuses to correct, its inspection qualification shall be revoked.
县级以上地方工业产品生产许可证主管部门违反本条例规定，对列入目录产品以外的工业产品设定生产许可的，由国务院工业产品生产许可证主管部门责令改正，或者依法予以撤销。
If a competent department for production licenses of industrial products at or above the county level, in violation of these Regulations, sets production licenses for industrial products not listed in the Catalogue, the competent department for production licenses of industrial products under the State Council shall order it to correct or revoke the licenses in accordance with the law.
工业产品生产许可证主管部门及其工作人员违反本条例的规定，有下列情形之一的，由其上级行政机关或者监察机关责令改正；情节严重的，对直接负责的主管人员和其他直接责任人员依法给予行政处分：
If the competent department for production licenses of industrial products or its staff members violate these Regulations in any of the following circumstances, the superior administrative organ or the supervisory organ shall order it to correct; if the circumstances are serious, administrative sanctions shall be imposed on the directly responsible person in charge and other directly responsible personnel in accordance with the law:
(一)对符合本条例规定的条件的申请不予受理的；
(1) Failing to accept an application that meets the conditions specified in these Regulations;
(二)不在办公场所公示依法应当公示的材料的；
(2) Failing to display materials that should be disclosed according to law at the office premises;
(三)在受理、审查、决定过程中，未向申请人、利害关系人履行法定告知义务的；
(3) Failing to fulfill the statutory obligation to inform the applicant or interested party during the acceptance, review, and decision process;
(四)申请人提交的申请材料不齐全、不符合法定形式，不一次告知申请人必须补正的全部内容的；
(4) Failing to inform the applicant at one time of all the contents that need to be supplemented when the application materials are incomplete or do not conform to the statutory form;
(五)未依法说明不受理申请或者不予许可的理由的；
(5) Failing to explain the reasons for not accepting an application or not granting a license in accordance with the law;
(六)依照本条例和《中华人民共和国行政许可法》应当举行听证而不举行听证的。
(6) Failing to hold a hearing when a hearing should be held in accordance with these Regulations and the Administrative License Law of the People's Republic of China.
工业产品生产许可证主管部门的工作人员办理工业产品生产许可证、实施监督检查，索取或者收受他人财物或者谋取其他利益，构成犯罪的，依法追究刑事责任；尚不构成犯罪的，依法给予行政处分。
If a staff member of the competent department for production licenses of industrial products, when handling production licenses or conducting supervision and inspection, demands or accepts property from others or seeks other benefits, if a crime is constituted, criminal liability shall be pursued in accordance with the law; if a crime is not constituted, administrative sanctions shall be imposed in accordance with the law.
工业产品生产许可证主管部门有下列情形之一的，由其上级行政机关、监察机关或者有关机关责令改正，依法处理；对直接负责的主管人员和其他直接责任人员依法给予降级或者撤职的行政处分；构成犯罪的，依法追究刑事责任：
If the competent department for production licenses of industrial products has any of the following circumstances, its superior administrative organ, supervisory organ, or relevant organ shall order it to correct and handle it in accordance with the law; administrative sanctions of demotion or removal from office shall be imposed on the directly responsible person in charge and other directly responsible personnel in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law:
(一)对不符合本条例规定条件的申请人准予许可或者超越法定职权作出准予许可决定的；
(1) Granting a license to an applicant who does not meet the conditions specified in these Regulations or making a decision to grant a license beyond statutory authority;
(二)对符合本条例规定条件的申请人不予许可或者不在法定期限内作出准予许可决定的；
(2) Failing to grant a license to an applicant who meets the conditions specified in these Regulations or failing to make a decision to grant a license within the statutory time limit;
(三)发现未依照本条例规定申请取得生产许可证擅自生产列入目录产品，不及时依法查处的；
(3) Failing to promptly investigate and handle the production of products listed in the Catalogue without applying for a production license in accordance with these Regulations when discovered;
(四)发现检验机构的检验报告、检验结论严重失实，不及时依法查处的；
(4) Failing to promptly investigate and handle when discovering that the inspection reports or inspection conclusions of inspection institutions are seriously inaccurate;
(五)违反法律、行政法规或者本条例的规定，乱收费的。
(5) Charging fees in violation of laws, administrative regulations, or these Regulations.
工业产品生产许可证主管部门违法实施许可，给当事人的合法权益造成损害的，应当依照《中华人民共和国国家赔偿法》的规定给予赔偿。
If the competent department for production licenses of industrial products illegally implements a license, causing damage to the legitimate rights and interests of the parties, it shall provide compensation in accordance with the State Compensation Law of the People's Republic of China.
工业产品生产许可证主管部门不依法履行监督职责或者监督不力，造成严重后果的，由其上级行政机关或者监察机关责令改正，对直接负责的主管人员和其他直接责任人员依法给予行政处分；构成犯罪的，依法追究刑事责任。
If the competent department for production licenses of industrial products fails to perform its supervision duties in accordance with the law or performs supervision inadequately, causing serious consequences, its superior administrative organ or the supervisory organ shall order it to correct, and administrative sanctions shall be imposed on the directly responsible person in charge and other directly responsible personnel in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
本条例规定的吊销生产许可证的行政处罚由工业产品生产许可证主管部门决定。工业产品生产许可证主管部门应当将作出的相关产品吊销生产许可证的行政处罚决定及时通报发展改革部门、卫生主管部门等有关部门。
The administrative penalty of revoking a production license as provided in these Regulations shall be decided by the competent department for production licenses of industrial products. The competent department for production licenses of industrial products shall promptly notify the development and reform department, health administrative department, and other relevant departments of the administrative penalty decision to revoke the production license for the relevant product.
法律、行政法规对行使行政处罚权的机关另有规定的，依照有关法律、行政法规的规定执行。
If laws or administrative regulations provide otherwise regarding the organs exercising the power of administrative penalties, those provisions shall prevail.
附 则
Supplementary Provisions
法律、行政法规对工业产品管理另有规定的，从其规定。
If laws or administrative regulations provide otherwise regarding the management of industrial products, those provisions shall prevail.
国务院工业产品生产许可证主管部门和省、自治区、直辖市工业产品生产许可证主管部门办理工业产品生产许可证的收费项目依照国务院财政部门、价格主管部门的有关规定执行，工业产品生产许可证的收费标准依照国务院价格主管部门、财政部门的有关规定执行，并应当公开透明；所收取的费用必须全部上缴国库，不得截留、挪用、私分或者变相私分。财政部门不得以任何形式向其返还或者变相返还所收取的费用。
The fee items for handling production licenses for industrial products by the competent department for production licenses of industrial products under the State Council and the competent departments of provinces, autonomous regions, and municipalities directly under the Central Government shall be implemented in accordance with the relevant provisions of the financial department and the price department under the State Council. The fee standards for production licenses for industrial products shall be implemented in accordance with the relevant provisions of the price department and the financial department under the State Council, and shall be open and transparent; all fees collected must be turned over to the state treasury in full, and shall not be withheld, misappropriated, privately divided, or covertly divided. The financial department shall not return or covertly return the fees collected in any form.
根据需要，省、自治区、直辖市工业产品生产许可证主管部门可以负责部分列入目录产品的生产许可证审查发证工作，具体办法由国务院工业产品生产许可证主管部门另行制定。
As needed, the competent departments for production licenses of industrial products of provinces, autonomous regions, and municipalities directly under the Central Government may be responsible for the review and issuance of production licenses for some products listed in the Catalogue. The specific measures shall be formulated separately by the competent department for production licenses of industrial products under the State Council.
个体工商户生产或者销售列入目录产品的，依照本条例的规定执行。
If individual industrial and commercial households produce or sell products listed in the Catalogue, they shall implement these Regulations.
本条例自2005年9月1日起施行。国务院1984年4月7日发布的《工业产品生产许可证试行条例》同时废止。
These Regulations shall come into effect as of September 1, 2005. The Trial Regulations on Production Licenses for Industrial Products promulgated by the State Council on April 7, 1984, shall be simultaneously abolished.
