Regulations of the People's Republic of China on the Administration of Military Products Export

(Issued by Order No. 234 of the State Council of the People's Republic of China and the Central Military Commission of the People's Republic of China on October 22, 1997, and revised in accordance with the Decision of the State Council and the Central Military Commission on Amending the Regulations of the People's Republic of China on the Administration of Military Products Export on October 15, 2002)

为了加强对军品出口的统一管理，维护正常的军品出口秩序，制定本条例。

These Regulations are formulated to strengthen the unified administration of military products export and maintain the normal order of military products export.

本条例所称军品出口，是指用于军事目的的装备、专用生产设备及其他物资、技术和有关服务的贸易性出口。

For the purposes of these Regulations, military products export refers to the trade export of equipment, specialized production equipment, and other materials, technologies, and related services used for military purposes.

前款所称军品出口，纳入军品出口管理清单。军品出口管理清单由国家军品出口主管部门制定、调整并公布。

The military products export mentioned in the preceding paragraph shall be included in the military products export control list. The military products export control list shall be formulated, adjusted, and published by the state military products export authority.

国家军品出口主管部门在国务院、中央军事委员会的领导下，主管全国的军品出口工作，对全国的军品出口实施监督管理。

The state military products export authority, under the leadership of the State Council and the Central Military Commission, shall be in charge of the military products export work nationwide and exercise supervision and administration over military products export nationwide.

国家实行统一的军品出口管理制度，禁止任何损害国家的利益和安全的军品出口行为，依法保障正常的军品出口秩序。

The state implements a unified military products export administration system, prohibits any act of military products export that harms the interests and security of the state, and ensures the normal order of military products export in accordance with the law.

军品出口应当遵循下列原则：

Military products export shall follow the following principles:

(一)有助于接受国的正当自卫能力；

(1) Contributing to the legitimate self-defense capability of the recipient state;

(二)不损害有关地区的和世界的和平、安全与稳定；

(2) Not harming the peace, security, and stability of the relevant region and the world;

(三)不干涉接受国的内政。

(3) Not interfering in the internal affairs of the recipient state.

中华人民共和国缔结或者参加的国际条约同本条例有不同规定的，适用国际条约的规定；但是，中华人民共和国声明保留的条款除外。

Where international treaties concluded or acceded to by the People's Republic of China contain provisions different from those of these Regulations, the provisions of the international treaties shall prevail, except for clauses that the People's Republic of China has declared reservations.

本条例所称军品贸易公司，是指依法取得军品出口经营权，并在核定的经营范围内从事军品出口经营活动的企业法人。

For the purposes of these Regulations, military products trading companies refer to enterprise legal persons that have lawfully obtained the right to operate military products export and engage in military products export activities within the approved business scope.

军品出口经营权由国家军品出口主管部门审查批准。具体办法由国家军品出口主管部门规定。

The right to operate military products export shall be examined and approved by the state military products export authority. Specific measures shall be prescribed by the state military products export authority.

军品贸易公司依法自主经营、自负盈亏。

Military products trading companies shall operate independently and assume sole responsibility for their profits and losses in accordance with the law.

军品贸易公司应当信守合同，保证商品质量，完善售后服务。

Military products trading companies shall abide by contracts, ensure product quality, and improve after-sales service.

军品贸易公司应当按照国家军品出口主管部门的规定，如实提交与其军品出口经营活动有关的文件及资料。国家军品出口主管部门应当为军品贸易公司保守商业秘密，维护军品贸易公司的合法权益。

Military products trading companies shall truthfully submit documents and materials related to their military products export activities in accordance with the provisions of the state military products export authority. The state military products export authority shall keep commercial secrets for military products trading companies and protect their lawful rights and interests.

军品贸易公司可以委托经批准的军品出口运输企业，办理军品出口运输及相关业务。具体办法由国家军品出口主管部门规定。

Military products trading companies may entrust approved military products export transportation enterprises to handle military products export transportation and related business. Specific measures shall be prescribed by the state military products export authority.

国家对军品出口实行许可制度。

The state implements a licensing system for military products export.

军品出口项目、合同，应当依照本条例的规定申请审查批准。军品出口，应当凭军品出口许可证。

Military products export projects and contracts shall be submitted for examination and approval in accordance with the provisions of these Regulations. Military products export shall be conducted with a military products export license.

军品出口项目，由国家军品出口主管部门或者由国家军品出口主管部门会同国务院、中央军事委员会的有关部门审查批准。

Military products export projects shall be examined and approved by the state military products export authority or by the state military products export authority jointly with the relevant departments of the State Council and the Central Military Commission.

军品出口项目经批准后，军品贸易公司可以对外签订军品出口合同。军品出口合同签订后，应当向国家军品出口主管部门申请审查批准；国家军品出口主管部门应当自收到申请之日起20日内作出决定。军品出口合同获得批准，方可生效。

After a military products export project is approved, the military products trading company may sign a military products export contract with a foreign party. After the military products export contract is signed, it shall be submitted to the state military products export authority for examination and approval; the state military products export authority shall make a decision within 20 days from the date of receipt of the application. The military products export contract shall become effective only after approval.

军品贸易公司向国家军品出口主管部门申请批准军品出口合同时，应当附送接受国的有效证明文件。

When applying to the state military products export authority for approval of a military products export contract, the military products trading company shall attach valid certification documents from the recipient state.

重大的军品出口项目、合同，应当经国家军品出口主管部门会同国务院、中央军事委员会的有关部门审查，报国务院和中央军事委员会批准。

Major military product export projects and contracts shall be reviewed by the state military product exportcompetent authority in conjunction with the relevant departments of the State Council and the Central Military Commission, and submitted to the State Council and the Central Military Commission for approval.

军品贸易公司在军品出口前，应当凭军品出口合同批准文件，向国家军品出口主管部门申请领取军品出口许可证；符合军品出口合同规定的，国家军品出口主管部门应当自收到申请之日起10日内签发军品出口许可证。

Before exporting military products, a military trade company shall, based on the approval document for the military product export contract, apply to the state military product exportcompetent authority for a military product export license; if the export complies with the contract, the state military product exportcompetent authority shall issue the license within 10 days of receiving the application.

海关凭军品出口许可证接受申报，并按照国家有关规定验放。

Customs shall accept declarations based on the military product export license and inspect and release the goods in accordance with relevant state regulations.

军品出口项目、合同的审查批准办法和军品出口许可证的签发办法，由国家军品出口主管部门制定。

The procedures for reviewing and approving military product export projects and contracts, and for issuing military product export licenses, shall be formulated by the state military product exportcompetent authority.

军品出口，由国家军品出口主管部门会同有关部门下达军品出口通知。有关部门和地方人民政府收到军品出口通知后，应当按照国家有关规定认真履行职责，保证军品出口的安全、迅速、准确。

For military product exports, the state military product exportcompetent authority, together with relevant departments, shall issue a military product export notice. After receiving the notice, the relevant departments and local people's governments shall conscientiously perform their duties in accordance with relevant state regulations to ensure the safe, rapid, and accurate export of military products.

未取得军品出口经营权的任何单位或者组织，不得从事军品出口经营活动。

No unit or organization that has not obtained the right to operate military product exports may engage in military product export activities.

国家禁止个人从事军品出口经营活动。

The state prohibits individuals from engaging in military product export activities.

军品贸易公司在军品出口经营活动中，应当遵守法律和行政法规的规定，维护正常的军品出口秩序。

Military trade companies shall, in their military product export activities, comply with laws and administrative regulations and maintain normal order in military product exports.

军品贸易公司在军品出口经营活动中，不得有下列行为：

Military trade companies shall not engage in the following acts in their military product export activities:

(一)危害国家安全或者社会公共利益；

(1) Endangering national security or public interests;

(二)以不正当竞争手段排挤竞争对手；

(2) Using unfair competition means to exclude competitors;

(三)侵害中华人民共和国法律保护的知识产权；

(3) Infringing upon intellectual property rights protected by the laws of the People's Republic of China;

(四)伪造、变造、骗取或者转让军品出口项目批准文件、合同批准文件、许可证和接受国的有效证明文件等单证；

(4) Forging, altering, obtaining by fraud, or transferring documents such as approval documents for military product export projects, contract approval documents, licenses, and valid certification documents from the recipient country;

(五)超越核定的经营范围经营；

(5) Operating beyond the approved scope of business;

(六)违反法律和行政法规规定的其他行为。

(6) Other acts that violate laws and administrative regulations.

国家军品出口主管部门认为必要时或者根据军品贸易公司的请求，可以对妨碍正常的军品出口秩序的行为进行处理。

When the state military product exportcompetent authority deems it necessary or upon the request of a military trade company, it may handle acts that disrupt the normal order of military product exports.

军品贸易公司违反本条例第十一条规定的，由国家军品出口主管部门责令限期改正，予以警告；逾期不改正的，处2万元以上10万元以下的罚款，暂停直至撤销其军品出口经营权。

If a military trade company violates Article 11 of these Regulations, the state military product exportcompetent authority shall order it to rectify within a specified period and issue a warning; if it fails to rectify within the period, a fine of not less than 20,000 yuan but not more than 100,000 yuan shall be imposed, and its military product export right may be suspended or revoked.

军品贸易公司违反本条例第二十二条第(四)项、第(五)项规定，触犯刑律的，依照刑法关于非法经营罪，伪造、变造、买卖国家机关公文、证件、印章罪或者其他罪的规定，依法追究刑事责任；尚不够刑事处罚的，由国家军品出口主管部门予以警告，没收违法所得，并处违法所得1倍以上3倍以下的罚款，没有违法所得或者违法所得不足10万元的，处10万元以上30万元以下的罚款，暂停直至撤销其军品出口经营权。

If a military trade company violates subparagraphs (4) or (5) of Article 22 of these Regulations and the act constitutes a crime, criminal liability shall be pursued in accordance with the provisions of the Criminal Law on the crime of illegal business operation, the crime of forging, altering, or buying or selling official documents, certificates, or seals of state organs, or other crimes; if the act does not constitute a crime, the state military product exportcompetent authority shall issue a warning, confiscate illegal gains, and impose a fine of not less than one time but not more than three times the illegal gains; if there are no illegal gains or the illegal gains are less than 100,000 yuan, a fine of not less than 100,000 yuan but not more than 300,000 yuan shall be imposed, and its military product export right may be suspended or revoked.

军品贸易公司违反本条例第二十二条第(一)项、第(二)项、第(三)项规定或者其他法律、行政法规规定的，由国家有关主管部门依照有关法律和行政法规的规定予以处罚，国家军品出口主管部门并可以暂停直至撤销其军品出口经营权；触犯刑律的，依照刑法有关规定，依法追究刑事责任。

If a military trade company violates subparagraphs (1), (2), or (3) of Article 22 of these Regulations or other laws or administrative regulations, the relevant statecompetent authority shall impose penalties in accordance with relevant laws and administrative regulations, and the state military product exportcompetent authority may also suspend or revoke its military product export right; if the act constitutes a crime, criminal liability shall be pursued in accordance with the relevant provisions of the Criminal Law.

违反本条例第二十条规定的，由国家军品出口主管部门取缔非法活动；触犯刑律的，依照刑法关于非法经营罪或者其他罪的规定，依法追究刑事责任；尚不够刑事处罚的，由国家军品出口主管部门予以警告，没收违法所得，并处违法所得1倍以上5倍以下的罚款，没有违法所得或者违法所得不足10万元的，处10万元以上50万元以下的罚款。

If a person violates Article 20 of these Regulations, the state military product exportcompetent authority shall ban the illegal activities; if the act constitutes a crime, criminal liability shall be pursued in accordance with the provisions of the Criminal Law on the crime of illegal business operation or other crimes; if the act does not constitute a crime, the state military product exportcompetent authority shall issue a warning, confiscate illegal gains, and impose a fine of not less than one time but not more than five times the illegal gains; if there are no illegal gains or the illegal gains are less than 100,000 yuan, a fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed.

军品贸易公司对国家军品出口主管部门作出的具体行政行为不服的，应当先依法申请行政复议；对行政复议决定仍不服的，可以依法向人民法院提起行政诉讼。

If a military trade company is dissatisfied with a specific administrative act taken by the state military product exportcompetent authority, it shall first apply for administrative reconsideration in accordance with the law; if it is still dissatisfied with the reconsideration decision, it may file an administrative lawsuit with a people's court in accordance with the law.

国家军品出口管理工作人员滥用职权、玩忽职守或者利用职务上的便利收受、索取他人财物，触犯刑律的，依照刑法关于滥用职权罪、玩忽职守罪、受贿罪或者其他罪的规定，依法追究刑事责任；尚不够刑事处罚的，依法给予行政处分。

If a staff member of the state military product export administration abuses power, neglects duty, or uses their position to accept or solicit property from others, and the act constitutes a crime, criminal liability shall be pursued in accordance with the provisions of the Criminal Law on the crime of abuse of power, the crime of neglect of duty, the crime of bribery, or other crimes; if the act does not constitute a crime, administrative sanctions shall be imposed in accordance with the law.

警用装备的出口适用本条例。

The export of police equipment shall be governed by these Regulations.

本条例自1998年1月1日起施行。

These Regulations shall come into force as of January 1, 1998.
