When preparing the overall development plan for an oil (gas) field, the enterprise or operator must simultaneously prepare a marine environmental impact report and submit it to the Ministry of Urban and Rural Construction and Environmental Protection of the People's Republic of China. The Ministry of Urban and Rural Construction and Environmental Protection, together with the State Oceanic Administration and the Ministry of Petroleum Industry, shall organize the examination and approval in accordance with the provisions of the state on environmental protection management for capital construction projects.

Enterprises, institutions and operators shall have the emergency response capability to prevent oil pollution accidents, formulate emergency plans, and be equipped with oil recovery facilities, oil containment and oil dispersing equipment commensurate with the scale of their offshore oil exploration and development activities.

一九八三年三月一日以前,已经在中华人民共和国管辖海域从事石油勘探开发的固定式和移动式平台,防污设备达不到规定要求的,应采取有效措施,防止污染,并在本条例颁布后三年内使防污设备达到规定的要求。

For fixed and mobile platforms that were already engaged in offshore oil exploration and development in the sea areas under the jurisdiction of the People's Republic of China before March 1, 1983, if their anti-pollution equipment does not meet the specified requirements, effective measures shall be taken to prevent pollution, and the anti-pollution equipment shall meet the specified requirements within three years after the promulgation of these Regulations.

When offshore oil exploration and development requires explosive blasting or other operations harmful to fishery resources in important fishery waters, effective measures shall be taken to avoid the spawning, breeding, and fishing seasons of major economic fish and shrimp species. The operation shall be reported to the competent authority before commencement, and obvious signs and signals shall be displayed during the operation.

(3) In emergency situations where floating oil on the sea surface may cause fire or seriously endanger human life and property safety, and recovery methods cannot be used, and the use of chemical dispersant can reduce pollution and avoid worsening the accident consequences, the quantity of chemical dispersant used and the reporting procedure may not be subject to the restrictions of paragraph (2) of this Article. Units and individuals suffering damage from offshore oil exploration and development pollution and seeking compensation shall, in accordance with Article 32 of the Environmental Protection Law of the People's Republic of China and Article 42 of the Marine Environment Protection Law of the People's Republic of China, apply to the competent authority for handling and demand compensation for losses from the party causing the pollution damage. 由于不可抗力发生污染损害事故的企业、事业单位、作业者,要求免于承担赔偿责任的,应向主管部门提交报告。该报告应能证实污染损害确实属于《中华人民共和国海洋环境保护法》第四十三条所列的情况之一,并经过及时采取合理措施仍不能避免的。

Enterprises, institutions, and operators that cause pollution damage accidents due to force majeure and seek exemption from liability for compensation shall submit a report to the competent authority. The report shall be able to prove that the pollution damage indeed falls under one of the circumstances listed in Article 43 of the Marine Environment Protection Law of the People's Republic of China and could not be avoided even after timely and reasonable measures were taken.

The competent authority may conduct mediation in handling disputes over liability for pollution damage and the amount of compensation from offshore oil exploration and development that it accepts, after investigation and understanding.

The competent authority may order enterprises, institutions, and operators that violate the Marine Environment Protection Law of the People's Republic of China and these Regulations to rectify within a time limit, pay cleanup costs, and compensate for national losses; if pollutants are discharged exceeding standards, they may be ordered to pay pollutant discharge fees.

If a party disagrees with the penalty decision of the competent authority, the matter shall be handled in accordance with Article 41 of the Marine Environment Protection Law of the People's Republic of China.

主管部门对主动检举、揭发企业、事业单位、作业者匿报石油勘探开发污染损害事故,或者提供证据,或者采取措施减轻污染损害的单位和个人,给予表扬和奖励。
