Regulations of the People's Republic of China on Registered Architects

(Issued by Decree No. 184 of the State Council of the People's Republic of China on September 23, 1995; first revision in accordance with the Decision of the State Council on Amending Certain Administrative Regulations on April 23, 2019; second revision in accordance with the Decision of the State Council on Amending and Repealing Certain Administrative Regulations on January 30, 2026)

为了加强对注册建筑师的管理，提高建筑设计质量与水平，保障公民生命和财产安全，维护社会公共利益，制定本条例。

These Regulations are formulated to strengthen the management of registered architects, improve the quality and standard of architectural design, ensure the safety of life and property of citizens, and safeguard the public interest of society.

本条例所称注册建筑师，是指依法取得注册建筑师证书并从事房屋建筑设计及相关业务的人员。

For the purposes of these Regulations, a registered architect refers to a person who has lawfully obtained a registered architect certificate and is engaged in building design and related business.

注册建筑师分为一级注册建筑师和二级注册建筑师。

Registered architects are divided into Grade 1 Registered Architects and Grade 2 Registered Architects.

注册建筑师的考试、注册和执业，适用本条例。

These Regulations apply to the examination, registration, and practice of registered architects.

国务院建设行政主管部门、人事行政主管部门和省、自治区、直辖市人民政府建设行政主管部门、人事行政主管部门依照本条例的规定对注册建筑师的考试、注册和执业实施指导和监督。

The competent administrative department of construction and the competent administrative department of personnel of the State Council, and the competent administrative departments of construction and personnel of provinces, autonomous regions, and municipalities directly under the Central Government shall, in accordance with these Regulations, provide guidance and supervision over the examination, registration, and practice of registered architects.

全国注册建筑师管理委员会和省、自治区、直辖市注册建筑师管理委员会，依照本条例的规定负责注册建筑师的考试和注册的具体工作。

The National Registered Architect Management Committee and the provincial, autonomous region, and municipality directly under the Central Government Registered Architect Management Committees shall, in accordance with these Regulations, be responsible for the specific work of examination and registration of registered architects.

全国注册建筑师管理委员会由国务院建设行政主管部门、人事行政主管部门、其他有关行政主管部门的代表和建筑设计专家组成。

The National Registered Architect Management Committee shall be composed of representatives from the competent administrative department of construction, the competent administrative department of personnel, other relevant administrative departments of the State Council, and architectural design experts.

省、自治区、直辖市注册建筑师管理委员会由省、自治区、直辖市建设行政主管部门、人事行政主管部门、其他有关行政主管部门的代表和建筑设计专家组成。

The provincial, autonomous region, and municipality directly under the Central Government Registered Architect Management Committees shall be composed of representatives from the competent administrative departments of construction, personnel, other relevant administrative departments of the province, autonomous region, or municipality directly under the Central Government, and architectural design experts.

注册建筑师可以组建注册建筑师协会，维护会员的合法权益。

Registered architects may establish registered architect associations to protect the lawful rights and interests of their members.

国家实行注册建筑师全国统一考试制度。注册建筑师全国统一考试办法，由国务院建设行政主管部门会同国务院人事行政主管部门商国务院其他有关行政主管部门共同制定，由全国注册建筑师管理委员会组织实施。

The State implements a national unified examination system for registered architects. The measures for the national unified examination for registered architects shall be jointly formulated by the competent administrative department of construction of the State Council together with the competent administrative department of personnel of the State Council, after consultation with other relevant administrative departments of the State Council, and shall be organized and implemented by the National Registered Architect Management Committee.

符合下列条件之一的，可以申请参加一级注册建筑师考试：

A person who meets one of the following conditions may apply to take the Grade 1 Registered Architect examination:

(一)取得建筑学硕士以上学位或者相近专业工学博士学位，并从事建筑设计或者相关业务2年以上的；

(1) Having obtained a master's degree or higher in architecture or a doctoral degree in engineering in a related discipline, and having been engaged in architectural design or related business for more than 2 years;

(二)取得建筑学学士学位或者相近专业工学硕士学位，并从事建筑设计或者相关业务3年以上的；

(2) Having obtained a bachelor's degree in architecture or a master's degree in engineering in a related discipline, and having been engaged in architectural design or related business for more than 3 years;

(三)具有建筑学专业大学本科毕业学历并从事建筑设计或者相关业务5年以上的，或者具有建筑学相近专业大学本科毕业学历并从事建筑设计或者相关业务7年以上的；

(3) Having obtained a university undergraduate diploma in architecture and having been engaged in architectural design or related business for more than 5 years, or having obtained a university undergraduate diploma in a related discipline and having been engaged in architectural design or related business for more than 7 years;

(四)取得高级工程师技术职称并从事建筑设计或者相关业务3年以上的，或者取得工程师技术职称并从事建筑设计或者相关业务5年以上的；

(4) Having obtained a senior engineer technical title and having been engaged in architectural design or related business for more than 3 years, or having obtained an engineer technical title and having been engaged in architectural design or related business for more than 5 years;

(五)不具有前四项规定的条件，但设计成绩突出，经全国注册建筑师管理委员会认定达到前四项规定的专业水平的。

(5) Not meeting the conditions specified in the preceding four items, but having outstanding design achievements and being recognized by the National Registered Architect Management Committee as meeting the professional level specified in the preceding four items.

前款第三项至第五项规定的人员应当取得学士学位。

Persons specified in items (3) to (5) of the preceding paragraph shall have obtained a bachelor's degree.

符合下列条件之一的，可以申请参加二级注册建筑师考试：

A person who meets one of the following conditions may apply to take the Grade 2 Registered Architect examination:

(一)具有建筑学或者相近专业大学本科毕业以上学历，从事建筑设计或者相关业务2年以上的；

(1) Having obtained a university undergraduate diploma or higher in architecture or a related discipline, and having been engaged in architectural design or related business for more than 2 years;

(二)具有建筑设计技术专业或者相近专业大专毕业以上学历，并从事建筑设计或者相关业务3年以上的；

(2) Having obtained a college diploma or higher in architectural design technology or a related discipline, and having been engaged in architectural design or related business for more than 3 years;

(三)具有建筑设计技术专业4年制中专毕业学历，并从事建筑设计或者相关业务5年以上的；

(3) Having obtained a 4-year secondary specialized school diploma in architectural design technology, and having been engaged in architectural design or related business for more than 5 years;

(四)具有建筑设计技术相近专业中专毕业学历，并从事建筑设计或者相关业务7年以上的；

(4) Having obtained a secondary specialized school diploma in a related discipline of architectural design technology, and having been engaged in architectural design or related business for more than 7 years;

(五)取得助理工程师以上技术职称，并从事建筑设计或者相关业务3年以上的。

(5) Having obtained an assistant engineer or higher technical title, and having been engaged in architectural design or related business for more than 3 years.

本条例施行前已取得高级、中级技术职称的建筑设计人员，经所在单位推荐，可以按照注册建筑师全国统一考试办法的规定，免予部分科目的考试。

Architectural design personnel who have obtained senior or intermediate technical titles before the implementation of these Regulations may, upon recommendation by their employer, be exempted from some subjects of the examination in accordance with the provisions of the national unified examination measures for registered architects.

注册建筑师考试合格，取得相应的注册建筑师资格的，可以申请注册。

A person who has passed the registered architect examination and obtained the corresponding registered architect qualification may apply for registration.

一级注册建筑师的注册，由全国注册建筑师管理委员会负责；二级注册建筑师的注册，由省、自治区、直辖市注册建筑师管理委员会负责。

The registration of Grade 1 Registered Architects shall be the responsibility of the National Registered Architect Management Committee; the registration of Grade 2 Registered Architects shall be the responsibility of the provincial, autonomous region, or municipality directly under the Central Government Registered Architect Management Committee.

有下列情形之一的，不予注册：

Registration shall be denied under any of the following circumstances:

(一)不具有完全民事行为能力的；

(1) Lacking full capacity for civil conduct;

(二)因受刑事处罚，自刑罚执行完毕之日起至申请注册之日止不满5年的；

(2) Having been subject to criminal punishment, and less than 5 years have elapsed since the completion of the execution of the punishment up to the date of application for registration;

(三)因在建筑设计或者相关业务中犯有错误受行政处罚或者撤职以上处分，自处罚、处分决定之日起至申请注册之日止不满2年的；

(3) Having committed errors in architectural design or related business and received administrative sanctions or disciplinary sanctions of removal from office or above, and less than 2 years have elapsed since the date of the sanction or disciplinary decision up to the date of application for registration;

(四)受吊销注册建筑师证书的行政处罚，自处罚决定之日起至申请注册之日止不满5年的；

(4) Having been subject to the administrative penalty of revocation of the registered architect certificate, and less than 5 years have elapsed since the date of the penalty decision up to the date of application for registration;

(五)有国务院规定不予注册的其他情形的。

(5) Other circumstances specified by the State Council that preclude registration.

全国注册建筑师管理委员会和省、自治区、直辖市注册建筑师管理委员会依照本条例第十三条的规定，决定不予注册的，应当自决定之日起15日内书面通知申请人；申请人有异议的，可以依法申请行政复议，也可以依法提起行政诉讼。

If the National Registered Architect Management Committee or the provincial, autonomous region, or municipality directly under the Central Government Registered Architect Management Committee decides to deny registration in accordance with Article 13 of these Regulations, it shall notify the applicant in writing within 15 days from the date of the decision; if the applicant disagrees, it may apply for administrative reconsideration or initiate administrative litigation in accordance with the law.

全国注册建筑师管理委员会应当将准予注册的一级注册建筑师名单报国务院建设行政主管部门备案；省、自治区、直辖市注册建筑师管理委员会应当将准予注册的二级注册建筑师名单报省、自治区、直辖市人民政府建设行政主管部门备案。

The National Registered Architect Management Committee shall report the list of approved Grade 1 Registered Architects to the competent administrative department of construction of the State Council for record; the provincial, autonomous region, or municipality directly under the Central Government Registered Architect Management Committee shall report the list of approved Grade 2 Registered Architects to the competent administrative department of construction of the provincial, autonomous region, or municipality directly under the Central Government for record.

国务院建设行政主管部门或者省、自治区、直辖市人民政府建设行政主管部门发现有关注册建筑师管理委员会的注册不符合本条例规定的，应当通知有关注册建筑师管理委员会撤销注册，收回注册建筑师证书。

If the competent administrative department of construction of the State Council or the competent administrative department of construction of the provincial, autonomous region, or municipality directly under the Central Government finds that the registration by the relevant Registered Architect Management Committee does not comply with these Regulations, it shall notify the relevant Registered Architect Management Committee to revoke the registration and withdraw the registered architect certificate.

准予注册的申请人，分别由全国注册建筑师管理委员会和省、自治区、直辖市注册建筑师管理委员会核发由国务院建设行政主管部门统一制作的一级注册建筑师证书或者二级注册建筑师证书。

For approved applicants, the National Registered Architect Management Committee and the provincial, autonomous region, or municipality directly under the Central Government Registered Architect Management Committee shall respectively issue a Grade 1 Registered Architect certificate or a Grade 2 Registered Architect certificate uniformly produced by the competent administrative department of construction of the State Council.

注册建筑师注册的有效期为2年。有效期届满需要继续注册的，应当在期满前30日内办理注册手续。

The validity period of registration for a registered architect is 2 years. If renewal of registration is required upon expiration, the registration procedures shall be completed within 30 days before the expiration.

已取得注册建筑师证书的人员，除本条例第十五条第二款规定的情形外，注册后有下列情形之一的，由准予注册的全国注册建筑师管理委员会或者省、自治区、直辖市注册建筑师管理委员会撤销注册，收回注册建筑师证书：

For a person who has obtained a registered architect certificate, except as provided in the second paragraph of Article 15 of these Regulations, if any of the following circumstances occurs after registration, the National Registered Architect Management Committee or the provincial, autonomous region, or municipality directly under the Central Government Registered Architect Management Committee that approved the registration shall revoke the registration and withdraw the registered architect certificate:

(一)完全丧失民事行为能力的；

(1) Complete loss of capacity for civil conduct;

(二)受刑事处罚的；

(2) Subject to criminal punishment;

(三)因在建筑设计或者相关业务中犯有错误，受到行政处罚或者撤职以上处分的；

(3) Having committed errors in architectural design or related business and received administrative sanctions or disciplinary sanctions of removal from office or above;

(四)自行停止注册建筑师业务满2年的。

(4) Having voluntarily ceased registered architect business for a full 2 years.

被撤销注册的当事人对撤销注册、收回注册建筑师证书有异议的，可以依法申请行政复议，也可以依法提起行政诉讼。

If the person whose registration has been revoked disagrees with the revocation of registration and withdrawal of the registered architect certificate, they may apply for administrative reconsideration or initiate administrative litigation in accordance with the law.

被撤销注册的人员可以依照本条例的规定重新注册。

A person whose registration has been revoked may re-register in accordance with these Regulations.

注册建筑师的执业范围：

The scope of practice of a registered architect includes:

(一)建筑设计；

(1) Architectural design;

(二)建筑设计技术咨询；

(2) Technical consulting on architectural design;

(三)建筑物调查与鉴定；

(3) Building investigation and appraisal;

(四)对本人主持设计的项目进行施工指导和监督；

(4) Construction guidance and supervision for projects designed by the architect;

(五)国务院建设行政主管部门规定的其他业务。

(5) Other business specified by the competent administrative department of construction of the State Council.

注册建筑师执行业务，应当加入建筑设计单位。

A registered architect shall join an architectural design unit to practice.

建筑设计单位的资质等级及其业务范围，由国务院建设行政主管部门规定。

The qualification grade and business scope of an architectural design unit shall be specified by the competent administrative department of construction of the State Council.

一级注册建筑师的执业范围不受建筑规模和工程复杂程度的限制。二级注册建筑师的执业范围不得超越国家规定的建筑规模和工程复杂程度。

The practice scope of a Grade 1 Registered Architect is not limited by building scale or engineering complexity. The practice scope of a Grade 2 Registered Architect shall not exceed the building scale and engineering complexity specified by the State.

注册建筑师执行业务，由建筑设计单位统一接受委托并统一收费。

When a registered architect practices, the architectural design unit shall accept the commission uniformly and collect fees uniformly.

因设计质量造成的经济损失，由建筑设计单位承担赔偿责任；建筑设计单位有权向签字的注册建筑师追偿。

Economic losses caused by design quality shall be borne by the architectural design unit as compensation; the architectural design unit has the right to seek recourse from the registered architect who signed the design.

注册建筑师有权以注册建筑师的名义执行注册建筑师业务。

A registered architect has the right to practice registered architect business in the name of a registered architect.

非注册建筑师不得以注册建筑师的名义执行注册建筑师业务。二级注册建筑师不得以一级注册建筑师的名义执行业务，也不得超越国家规定的二级注册建筑师的执业范围执行业务。

Non-registered architects shall not practice registered architect business in the name of a registered architect. A Grade 2 Registered Architect shall not practice business in the name of a Grade 1 Registered Architect, nor shall they practice beyond the practice scope of Grade 2 Registered Architects specified by the State.

国家规定的一定跨度、跨径和高度以上的房屋建筑，应当由注册建筑师进行设计。

Building construction with a certain span, clear span, or height above the standards specified by the State shall be designed by a registered architect.

任何单位和个人修改注册建筑师的设计图纸，应当征得该注册建筑师同意；但是，因特殊情况不能征得该注册建筑师同意的除外。

Any unit or individual that modifies the design drawings of a registered architect shall obtain the consent of that registered architect; however, this does not apply when it is impossible to obtain such consent due to special circumstances.

注册建筑师应当履行下列义务：

A registered architect shall fulfill the following obligations:

(一)遵守法律、法规和职业道德，维护社会公共利益；

(1) Comply with laws, regulations, and professional ethics, and safeguard the public interest of society;

(二)保证建筑设计的质量，并在其负责的设计图纸上签字；

(2) Ensure the quality of architectural design and sign the design drawings for which they are responsible;

(三)保守在执业中知悉的单位和个人的秘密；

(3) Keep confidential the secrets of units and individuals learned during practice;

(四)不得同时受聘于二个以上建筑设计单位执行业务；

(4) Not be employed by more than two architectural design units simultaneously to practice;

(五)不得准许他人以本人名义执行业务。

(5) Not allow others to practice business in their name.

以不正当手段取得注册建筑师考试合格资格或者注册建筑师证书的，由全国注册建筑师管理委员会或者省、自治区、直辖市注册建筑师管理委员会取消考试合格资格或者吊销注册建筑师证书；对负有直接责任的主管人员和其他直接责任人员，依法给予处分。

If a person obtains registered architect examination qualification or a registered architect certificate by improper means, the National Registered Architect Management Committee or the provincial, autonomous region, or municipality directly under the Central Government Registered Architect Management Committee shall cancel the examination qualification or revoke the registered architect certificate; the directly responsible supervisors and other directly responsible personnel shall be given sanctions in accordance with the law.

未经注册擅自以注册建筑师名义从事注册建筑师业务的，由县级以上人民政府建设行政主管部门责令停止违法活动，没收违法所得，并可以处以违法所得5倍以下的罚款；造成损失的，应当承担赔偿责任。

If a person engages in registered architect business in the name of a registered architect without registration, the competent administrative department of construction of the people's government at or above the county level shall order the cessation of the illegal activities, confiscate the illegal income, and may impose a fine of up to 5 times the illegal income; if losses are caused, liability for compensation shall be borne.

注册建筑师违反本条例规定，有下列行为之一的，由县级以上人民政府建设行政主管部门责令停止违法活动，没收违法所得，并可以处以违法所得5倍以下的罚款；情节严重的，可以责令停止执行业务或者由全国注册建筑师管理委员会或者省、自治区、直辖市注册建筑师管理委员会吊销注册建筑师证书：

If a registered architect violates these Regulations by committing any of the following acts, the competent administrative department of construction of the people's government at or above the county level shall order the cessation of the illegal activities, confiscate the illegal income, and may impose a fine of up to 5 times the illegal income; if the circumstances are serious, the architect may be ordered to cease practice, or the National Registered Architect Management Committee or the provincial, autonomous region, or municipality directly under the Central Government Registered Architect Management Committee may revoke the registered architect certificate:

(一)以个人名义承接注册建筑师业务、收取费用的；

(1) Accepting registered architect business and collecting fees in their own name;

(二)同时受聘于二个以上建筑设计单位执行业务的；

(2) Being employed by more than two architectural design units simultaneously to practice;

(三)在建筑设计或者相关业务中侵犯他人合法权益的；

(3) Infringing upon the lawful rights and interests of others in architectural design or related business;

(四)准许他人以本人名义执行业务的；

(4) Allowing others to practice business in their name;

(五)二级注册建筑师以一级注册建筑师的名义执行业务或者超越国家规定的执业范围执行业务的。

(5) A Grade 2 Registered Architect practicing business in the name of a Grade 1 Registered Architect or practicing beyond the practice scope specified by the State.

因建筑设计质量不合格发生重大责任事故，造成重大损失的，对该建筑设计负有直接责任的注册建筑师，由县级以上人民政府建设行政主管部门责令停止执行业务；情节严重的，由全国注册建筑师管理委员会或者省、自治区、直辖市注册建筑师管理委员会吊销注册建筑师证书。

If a major liability accident occurs due to substandard architectural design quality, causing significant losses, the registered architect directly responsible for the architectural design shall be ordered by the competent administrative department of construction of the people's government at or above the county level to cease practice; if the circumstances are serious, the National Registered Architect Management Committee or the provincial, autonomous region, or municipality directly under the Central Government Registered Architect Management Committee shall revoke the registered architect certificate.

违反本条例规定，未经注册建筑师同意擅自修改其设计图纸的，由县级以上人民政府建设行政主管部门责令纠正；造成损失的，应当承担赔偿责任。

If a person modifies the design drawings of a registered architect without the architect's consent in violation of these Regulations, the competent administrative department of construction of the people's government at or above the county level shall order correction; if losses are caused, liability for compensation shall be borne.

违反本条例规定，构成犯罪的，依法追究刑事责任。

If a violation of these Regulations constitutes a crime, criminal liability shall be pursued in accordance with the law.

本条例所称建筑设计单位，包括专门从事建筑设计的工程设计单位和其他从事建筑设计的工程设计单位。

For the purposes of these Regulations, architectural design units include engineering design units specializing in architectural design and other engineering design units engaged in architectural design.

外国人申请参加中国注册建筑师全国统一考试和注册以及外国建筑师申请在中国境内执行注册建筑师业务，按照对等原则办理。

Foreigners applying to take the national unified examination for registered architects in China and for registration, as well as foreign architects applying to practice registered architect business within China, shall be handled on the principle of reciprocity.

本条例自发布之日起施行。

These Regulations shall come into force as of the date of promulgation.
