为了科学、有效地开展海关统计工作，保障海关统计的准确性、及时性、完整性，根据《中华人民共和国海关法》和《中华人民共和国统计法》的有关规定，制定本条例。
These Regulations are formulated in accordance with the Customs Law of the People's Republic of China and the Statistics Law of the People's Republic of China, with a view to conducting customs statistics work scientifically and effectively, and ensuring the accuracy, timeliness and completeness of customs statistics.
海关统计是海关依法对进出口货物贸易的统计，是国民经济统计的组成部分。
Customs statistics refer to the statistics on the import and export of goods conducted by the Customs in accordance with the law, and constitute a component of the national economic statistics.
海关统计的任务是对进出口货物贸易进行统计调查、统计分析和统计监督，进行进出口监测预警，编制、管理和公布海关统计资料，提供统计服务。
The tasks of customs statistics are to conduct statistical investigation, statistical analysis and statistical supervision on the import and export of goods, to carry out import and export monitoring and early warning, to compile, manage and publish customs statistical data, and to provide statistical services.
海关总署负责组织、管理全国海关统计工作。
The General Administration of Customs shall be responsible for organizing and managing the national customs statistics work.
海关统计机构、统计人员应当依照《中华人民共和国统计法》、《中华人民共和国统计法实施条例》及本条例的规定履行职责。
Customs statistical institutions and statisticians shall perform their duties in accordance with the Statistics Law of the People's Republic of China, the Implementing Regulations of the Statistics Law of the People's Republic of China, and these Regulations.
实际进出境并引起境内物质存量增加或者减少的货物，列入海关统计。
Goods that actually enter or leave the territory and cause an increase or decrease in the material stock within the territory shall be included in customs statistics.
进出境物品超过自用、合理数量的，列入海关统计。
Articles entering or leaving the territory that exceed the quantity for personal use or reasonable quantity shall be included in customs statistics.
下列进出口货物不列入海关统计：
The following import and export goods shall not be included in customs statistics:
(一)过境、转运和通运货物；
(1) Goods in transit, transshipment and through transport;
(二)暂时进出口货物；
(2) Temporary import or export goods;
(三)货币及货币用黄金；
(3) Currency and monetary gold;
(四)租赁期1年以下的租赁进出口货物；
(4) Import or export goods under lease with a lease term of less than one year;
(五)因残损、短少、品质不良或者规格不符而免费补偿或者更换的进出口货物；
(5) Import or export goods provided free of charge as replacement or compensation due to damage, shortage, poor quality or non-conformity with specifications;
(六)海关总署规定的不列入海关统计的其他货物。
(6) Other goods not included in customs statistics as prescribed by the General Administration of Customs.
进出口货物的统计项目包括：
The statistical items for import and export goods include:
(一)品名及编码；
(1) Name and code;
(二)数量、价格；
(2) Quantity and price;
(三)进出口货物收发货人；
(3) Importer or exporter;
(四)贸易方式；
(4) Trade mode;
(五)运输方式；
(5) Mode of transport;
(六)进口货物的原产国(地区)、启运国(地区)、境内目的地；
(6) Country (region) of origin, country (region) of consignment, and domestic destination for imported goods;
(七)出口货物的最终目的国(地区)、运抵国(地区)、境内货源地；
(7) Final destination country (region), country (region) of arrival, and domestic origin for exported goods;
(八)进出口日期；
(8) Date of import or export;
(九)关别；
(9) Customs office.
(十)海关总署规定的其他统计项目。
(10) Other statistical items prescribed by the General Administration of Customs.
根据国民经济发展和海关监管需要，海关总署可以对统计项目进行调整。
In light of national economic development and customs control needs, the General Administration of Customs may adjust the statistical items.
进出口货物的品名及编码，按照《中华人民共和国海关统计商品目录》归类统计。
The description and code of import and export goods shall be classified and counted in accordance with the Customs Statistics Commodity Catalogue of the People's Republic of China.
进出口货物的数量，按照《中华人民共和国海关统计商品目录》规定的计量单位统计。
The quantity of import and export goods shall be counted in accordance with the unit of measurement prescribed in the Customs Statistics Commodity Catalogue of the People's Republic of China.
《中华人民共和国海关统计商品目录》由海关总署公布。
The Customs Statistics Commodity Catalogue of the People's Republic of China shall be published by the General Administration of Customs.
进口货物的价格，按照货价、货物运抵中华人民共和国境内输入地点起卸前的运输及其相关费用、保险费之和统计。
The price of imported goods shall be counted as the sum of the cost of the goods, transport and related costs incurred before unloading at the place of entry within the territory of the People's Republic of China, and insurance premiums.
出口货物的价格，按照货价、货物运抵中华人民共和国境内输出地点装卸前的运输及其相关费用、保险费之和统计，其中包含的出口关税税额，应当予以扣除。
The price of exported goods shall be counted as the sum of the cost of the goods, transport and related costs incurred before loading at the place of departure within the territory of the People's Republic of China, and insurance premiums, and any export customs duties included therein shall be deducted.
进口货物，应当分别统计其原产国(地区)、启运国(地区)和境内目的地。
For imported goods, the country (region) of origin, the country (region) of shipment, and the domestic destination shall be counted separately.
出口货物，应当分别统计其最终目的国(地区)、运抵国(地区)和境内货源地。
For exported goods, the final destination country (region), the country (region) of arrival, and the domestic place of origin of the goods shall be counted separately.
进出口货物收发货人，按照从事进出口经营活动的法人、其他组织或者个人统计。
The consignee or consignor of import and export goods shall be counted according to the legal person, other organization, or individual engaged in import and export business activities.
进出口货物的贸易方式，按照海关监管要求分类统计。
The trade mode of import and export goods shall be classified and counted in accordance with customs control requirements.
进出口货物的运输方式，按照货物进出境时的运输方式统计，包括水路运输、铁路运输、公路运输、航空运输及其他运输方式。
The mode of transport of import and export goods shall be counted according to the mode of transport at the time of entry or exit, including water transport, railway transport, road transport, air transport, and other modes of transport.
进口货物的日期，按照海关放行的日期统计；出口货物的日期，按照办结海关手续的日期统计。
The date of imported goods shall be counted according to the date of customs release; the date of exported goods shall be counted according to the date of completion of customs formalities.
进出口货物由接受申报的海关负责统计。
Import and export goods shall be counted by the customs office that accepts the declaration.
海关统计资料包括海关统计原始资料以及以原始资料为基础采集、整理的相关统计信息。
Customs statistical data include original customs statistical data and relevant statistical information collected and compiled on the basis of the original data.
前款所称海关统计原始资料，是指经海关确认的进出口货物报关单及其他有关单证。
The original customs statistical data referred to in the preceding paragraph means the customs declaration forms for import and export goods and other relevant documents confirmed by the customs.
海关总署应当定期、无偿地向国务院有关部门提供有关综合统计资料。
The General Administration of Customs shall regularly and free of charge provide relevant comprehensive statistical data to the relevant departments of the State Council.
直属海关应当定期、无偿地向所在地省、自治区、直辖市人民政府有关部门提供有关综合统计资料。
The directly subordinate customs offices shall regularly and free of charge provide relevant comprehensive statistical data to the relevant departments of the people's governments of the provinces, autonomous regions, and municipalities directly under the Central Government where they are located.
海关应当建立统计资料定期公布制度，向社会公布海关统计信息。
The customs shall establish a system for regular publication of statistical data and publish customs statistical information to the public.
海关可以根据社会公众的需要，提供统计服务。
The customs may provide statistical services based on the needs of the public.
海关统计人员对在统计过程中知悉的国家秘密、商业秘密负有保密义务。
Customs statistical personnel have the obligation to keep confidential any state secrets and commercial secrets learned during the statistical process.
当事人有权在保存期限内查询自己申报的海关统计原始资料及相关信息，对查询结果有疑问的，可以向海关申请核实，海关应当予以核实，并解答有关问题。
The parties concerned have the right to consult the original customs statistical data and related information they have declared within the retention period. If they have doubts about the results of the inquiry, they may apply to the customs for verification, and the customs shall verify and answer the relevant questions.
海关对当事人依法应当申报的项目有疑问的，可以向当事人提出查询，当事人应当及时作出答复。
If the customs has doubts about the items that the parties concerned should declare according to law, it may inquire of the parties concerned, and the parties concerned shall respond in a timely manner.
依法应当申报的项目未申报或者申报不实影响海关统计准确性的，海关应当责令当事人予以更正，需要予以行政处罚的，依照《中华人民共和国海关行政处罚实施条例》的规定予以处罚。
If items that should be declared according to law are not declared or are falsely declared, affecting the accuracy of customs statistics, the customs shall order the parties concerned to make corrections. If administrative penalties are necessary, penalties shall be imposed in accordance with the provisions of the Regulations of the People's Republic of China on the Implementation of Customs Administrative Penalties.
本条例自2006年3月1日起施行。
These Regulations shall come into force as of March 1, 2006.
