总则
General Provisions
根据《中华人民共和国统计法》(以下简称统计法)，制定本条例。
These Regulations are formulated in accordance with the Statistics Law of the People's Republic of China (hereinafter referred to as the Statistics Law).
统计资料能够通过行政记录取得的，不得组织实施调查。通过抽样调查、重点调查能够满足统计需要的，不得组织实施全面调查。
Where statistical data can be obtained through administrative records, no survey shall be organized and implemented. Where sampling surveys or key-point surveys can meet statistical needs, no comprehensive survey shall be organized and implemented.
县级以上人民政府统计机构和有关部门应当加强统计规律研究，健全新兴产业等统计，完善经济、社会、科技、资源和环境统计，推进互联网、大数据、云计算等现代信息技术在统计工作中的应用，满足经济社会发展需要。
The statistical institutions of the people's governments at or above the county level and relevant departments shall strengthen research on statistical laws, improve statistics on emerging industries, etc., perfect statistics on economy, society, science and technology, resources, and environment, promote the application of modern information technologies such as the Internet, big data, and cloud computing in statistical work, and meet the needs of economic and social development.
地方人民政府、县级以上人民政府统计机构和有关部门应当根据国家有关规定，明确本单位防范和惩治统计造假、弄虚作假的责任主体，严格执行统计法和本条例的规定。
Local people's governments, statistical institutions of the people's governments at or above the county level, and relevant departments shall, in accordance with relevant state provisions, clearly define the entities responsible for preventing and punishing statistical fraud and falsification, and strictly implement the provisions of the Statistics Law and these Regulations.
地方人民政府、县级以上人民政府统计机构和有关部门及其负责人应当保障统计活动依法进行，不得侵犯统计机构、统计人员独立行使统计调查、统计报告、统计监督职权，不得非法干预统计调查对象提供统计资料，不得统计造假、弄虚作假。
Local people's governments, statistical institutions of the people's governments at or above the county level, and relevant departments and their responsible persons shall ensure that statistical activities are conducted in accordance with the law, shall not infringe upon the independent exercise of statistical investigation, statistical reporting, and statistical supervision powers by statistical institutions and statisticians, shall not illegally interfere with statistical survey respondents in providing statistical data, and shall not engage in statistical fraud or falsification.
统计调查对象应当依照统计法和国家有关规定，真实、准确、完整、及时地提供统计资料，拒绝、抵制弄虚作假等违法行为。
Statistical survey respondents shall, in accordance with the Statistics Law and relevant state provisions, provide statistical data truthfully, accurately, completely, and timely, and refuse and resist illegal acts such as falsification.
县级以上人民政府统计机构和有关部门不得组织实施营利性统计调查。
The statistical institutions of the people's governments at or above the county level and relevant departments shall not organize or implement for-profit statistical surveys.
国家有计划地推进县级以上人民政府统计机构和有关部门通过向社会购买服务组织实施统计调查和资料开发。
The state shall, in a planned manner, promote the statistical institutions of the people's governments at or above the county level and relevant departments to organize and implement statistical surveys and data development through the purchase of services from society.
统计调查项目
Statistical Survey Projects
部门统计调查项目、地方统计调查项目的主要内容不得与国家统计调查项目的内容重复、矛盾。
The main contents of departmental statistical survey projects and local statistical survey projects shall not duplicate or contradict the main contents of national statistical survey projects.
统计调查项目的制定机关(以下简称制定机关)应当就项目的必要性、可行性、科学性进行论证，征求有关地方、部门、统计调查对象和专家的意见，并由制定机关按照会议制度集体讨论决定。
The formulating authority of a statistical survey project (hereinafter referred to as the formulating authority) shall demonstrate the necessity, feasibility, and scientific nature of the project, solicit opinions from relevant localities, departments, statistical survey respondents, and experts, and make a decision through collective discussion in accordance with the meeting system.
重要统计调查项目应当进行试点。
Important statistical survey projects shall be piloted.
制定机关申请审批统计调查项目，应当以公文形式向审批机关提交统计调查项目审批申请表、项目的统计调查制度和工作经费来源说明。
When applying for approval of a statistical survey project, the formulating authority shall submit to the approving authority in the form of an official document the statistical survey project approval application form, the statistical survey system of the project, and a statement on the source of working funds.
申请材料不齐全或者不符合法定形式的，审批机关应当一次性告知需要补正的全部内容，制定机关应当按照审批机关的要求予以补正。
If the application materials are incomplete or do not conform to the statutory form, the approving authority shall inform the formulating authority of all the contents that need to be supplemented or corrected at one time, and the formulating authority shall make supplements or corrections as required by the approving authority.
申请材料齐全、符合法定形式的，审批机关应当受理。
If the application materials are complete and conform to the statutory form, the approving authority shall accept the application.
统计调查项目符合下列条件的，审批机关应当作出予以批准的书面决定：
If a statistical survey project meets the following conditions, the approving authority shall make a written decision to approve it:
(一)具有法定依据或者确为公共管理和服务所必需；
(1) It has a legal basis or is indeed necessary for public management and services;
(二)与已批准或者备案的统计调查项目的主要内容不重复、不矛盾；
(2) It does not duplicate or contradict the main contents of approved or filed statistical survey projects;
(三)主要统计指标无法通过行政记录或者已有统计调查资料加工整理取得；
(3) The main statistical indicators cannot be obtained through administrative records or processing of existing statistical survey data;
(四)统计调查制度符合统计法律法规规定，科学、合理、可行；
(4) The statistical survey system complies with statistical laws and regulations, and is scientific, reasonable, and feasible;
(五)采用的统计标准符合国家有关规定；
(5) The statistical standards adopted comply with relevant national regulations;
(六)制定机关具备项目执行能力。
(6) The formulating authority has the capability to execute the project.
不符合前款规定条件的，审批机关应当向制定机关提出修改意见；修改后仍不符合前款规定条件的，审批机关应当作出不予批准的书面决定并说明理由。
If the conditions in the preceding paragraph are not met, the approving authority shall propose modification opinions to the formulating authority; if after modification the conditions are still not met, the approving authority shall make a written decision of disapproval and state the reasons.
统计调查项目涉及其他部门职责的，审批机关应当在作出审批决定前，征求相关部门的意见。
If a statistical survey project involves the responsibilities of other departments, the approving authority shall seek opinions from the relevant departments before making the approval decision.
审批机关应当自受理统计调查项目审批申请之日起20日内作出决定。20日内不能作出决定的，经审批机关负责人批准可以延长10日，并应当将延长审批期限的理由告知制定机关。
The approving authority shall make a decision within 20 days from the date of accepting the application for approval of a statistical survey project. If a decision cannot be made within 20 days, it may be extended by 10 days with the approval of the person in charge of the approving authority, and the reason for the extension shall be notified to the formulating authority.
制定机关修改统计调查项目的时间，不计算在审批期限内。
The time taken by the formulating authority to modify the statistical survey project shall not be counted within the approval period.
制定机关申请备案统计调查项目，应当以公文形式向备案机关提交统计调查项目备案申请表和项目的统计调查制度。
When applying for filing a statistical survey project, the formulating authority shall submit to the filing authority, in the form of an official document, the filing application form for the statistical survey project and the statistical survey system of the project.
统计调查项目的调查对象属于制定机关管辖系统，且主要内容与已批准、备案的统计调查项目不重复、不矛盾的，备案机关应当依法给予备案文号。
If the survey subjects of the statistical survey project belong to the jurisdiction system of the formulating authority, and the main content does not duplicate or conflict with approved or filed statistical survey projects, the filing authority shall grant a filing document number in accordance with the law.
统计调查项目经批准或者备案的，审批机关或者备案机关应当及时公布统计调查项目及其统计调查制度的主要内容。涉及国家秘密的统计调查项目除外。
For a statistical survey project that has been approved or filed, the approving or filing authority shall promptly publish the main contents of the statistical survey project and its statistical survey system, except for statistical survey projects involving state secrets.
统计调查项目有下列情形之一的，审批机关或者备案机关应当简化审批或者备案程序，缩短期限：
Where a statistical survey project falls under any of the following circumstances, the approving or filing authority shall simplify the approval or filing procedures and shorten the time limit:
(一)发生突发事件需要迅速实施统计调查；
(1) An emergency occurs requiring the rapid implementation of a statistical survey;
(二)统计调查制度内容未作变动，统计调查项目有效期届满需要延长期限。
(2) The contents of the statistical survey system remain unchanged, and the validity period of the statistical survey project has expired and needs to be extended.
统计法第十七条第二款规定的国家统计标准是强制执行标准。各级人民政府、县级以上人民政府统计机构和有关部门组织实施的统计调查活动，应当执行国家统计标准。
The national statistical standards specified in the second paragraph of Article 17 of the Statistics Law are mandatory standards. Statistical survey activities organized and implemented by people's governments at all levels, statistical institutions of people's governments at or above the county level, and relevant departments shall implement the national statistical standards.
制定国家统计标准，应当征求国务院有关部门的意见。
When formulating national statistical standards, opinions from relevant departments of the State Council shall be solicited.
统计调查的组织实施
Organization and Implementation of Statistical Surveys
统计机构、统计人员组织实施统计调查，应当就统计调查对象的法定填报义务、主要指标涵义和有关填报要求等，向统计调查对象作出说明。
When organizing and implementing a statistical survey, statistical institutions and statisticians shall explain to the respondents the statutory obligation to fill in the survey, the main meanings of indicators, and relevant filling requirements.
国家机关、企业事业单位或者其他组织等统计调查对象提供统计资料，应当由填报人员和单位负责人签字，并加盖公章。个人作为统计调查对象提供统计资料，应当由本人签字。统计调查制度规定不需要签字、加盖公章的除外。
When providing statistical data, state organs, enterprises, public institutions, or other organizations that are statistical survey respondents shall have the person filling in the data and the person in charge of the unit sign, and affix the official seal. When an individual provides statistical data as a statistical survey respondent, the individual shall sign. This does not apply where the statistical survey system stipulates that signatures and official seals are not required.
统计调查对象使用网络提供统计资料的，按照国家有关规定执行。
Where statistical survey respondents provide statistical data via the internet, they shall comply with the relevant provisions of the state.
县级以上人民政府统计机构、有关部门推广使用网络报送统计资料，应当采取有效的网络安全保障措施。
When promoting and using network reporting of statistical data, the statistical institutions and relevant departments of the people's governments at or above the county level shall adopt effective network security measures.
县级以上人民政府统计机构、有关部门和乡、镇统计人员，应当对统计调查对象提供的统计资料进行审核。统计资料不完整或者存在明显错误的，应当由统计调查对象依法予以补充或者改正。
The statistical institutions and relevant departments of the people's governments at or above the county level, as well as township statistical personnel, shall review the statistical data provided by the respondents of statistical surveys. If the statistical data are incomplete or contain obvious errors, the respondents shall supplement or correct them in accordance with the law.
国家统计局应当建立健全统计数据质量监控和评估制度，加强对各省、自治区、直辖市重要统计数据的监控和评估。
The National Bureau of Statistics shall establish and improve a statistical data quality monitoring and evaluation system, and strengthen the monitoring and evaluation of important statistical data of all provinces, autonomous regions, and municipalities directly under the Central Government.
统计资料的管理和公布
Management and Publication of Statistical Data
县级以上人民政府统计机构、有关部门和乡、镇人民政府应当妥善保管统计调查中取得的统计资料。
The statistical institutions and relevant departments of the people's governments at or above the county level, as well as the people's governments of townships and towns, shall properly preserve the statistical data obtained from statistical surveys.
国家建立统计资料灾难备份系统。
The state establishes a statistical data disaster backup system.
统计调查中取得的统计调查对象的原始资料，应当至少保存2年。
The original data of respondents obtained from statistical surveys shall be preserved for at least 2 years.
汇总性统计资料应当至少保存10年，重要的汇总性统计资料应当永久保存。法律法规另有规定的，从其规定。
Aggregated statistical data shall be preserved for at least 10 years, and important aggregated statistical data shall be preserved permanently. Where laws and regulations provide otherwise, such provisions shall prevail.
统计调查对象按照国家有关规定设置的原始记录和统计台账，应当至少保存2年。
The original records and statistical ledgers set up by respondents of statistical surveys in accordance with relevant state regulations shall be preserved for at least 2 years.
国家统计局统计调查取得的全国性统计数据和分省、自治区、直辖市统计数据，由国家统计局公布或者由国家统计局授权其派出的调查机构或者省级人民政府统计机构公布。
National statistical data and statistical data by province, autonomous region, and municipality directly under the Central Government obtained from statistical surveys conducted by the National Bureau of Statistics shall be published by the National Bureau of Statistics or by its dispatched survey institutions or the statistical institutions of provincial people's governments as authorized by the National Bureau of Statistics.
国务院有关部门统计调查取得的统计数据，由国务院有关部门按照国家有关规定和已批准或者备案的统计调查制度公布。
Statistical data obtained from statistical surveys conducted by relevant departments of the State Council shall be published by those departments in accordance with relevant state regulations and the approved or filed statistical survey system.
县级以上地方人民政府有关部门公布其统计调查取得的统计数据，比照前款规定执行。
The publication of statistical data obtained from statistical surveys by relevant departments of local people's governments at or above the county level shall be carried out by applying the provisions of the preceding paragraph mutatis mutandis.
已公布的统计数据按照国家有关规定需要进行修订的，县级以上人民政府统计机构和有关部门应当及时公布修订后的数据，并就修订依据和情况作出说明。
Where published statistical data need to be revised in accordance with relevant state regulations, the statistical agencies and relevant departments of the people's governments at or above the county level shall promptly publish the revised data and provide explanations regarding the basis and circumstances of the revision.
县级以上人民政府统计机构和有关部门应当及时公布主要统计指标涵义、调查范围、调查方法、计算方法、抽样调查样本量等信息，对统计数据进行解释说明。
Statistical agencies and relevant departments of the people's governments at or above the county level shall promptly publish information such as the meaning of major statistical indicators, survey scope, survey methods, calculation methods, and sample size of sample surveys, and provide explanations of the statistical data.
公布统计资料应当按照国家有关规定进行。公布前，任何单位和个人不得违反国家有关规定对外提供，不得利用尚未公布的统计资料谋取不正当利益。
The publication of statistical materials shall be carried out in accordance with relevant state regulations. Before publication, no unit or individual shall provide such materials externally in violation of relevant state regulations, nor shall they use unpublished statistical materials to seek improper benefits.
统计法第二十五条规定的能够识别或者推断单个统计调查对象身份的资料包括：
Materials that can identify or infer the identity of an individual statistical survey respondent as specified in Article 25 of the Statistics Law include:
(一)直接标明单个统计调查对象身份的资料；
(1) Materials that directly indicate the identity of an individual statistical survey respondent;
(二)虽未直接标明单个统计调查对象身份，但是通过已标明的地址、编码等相关信息可以识别或者推断单个统计调查对象身份的资料；
(2) Materials that, although not directly indicating the identity of an individual statistical survey respondent, can identify or infer the identity of an individual statistical survey respondent through marked addresses, codes, or other related information;
(三)可以推断单个统计调查对象身份的汇总资料。
(3) Aggregated materials from which the identity of an individual statistical survey respondent can be inferred.
统计调查中获得的能够识别或者推断单个统计调查对象身份的资料应当依法严格管理，除作为统计执法依据外，不得直接作为对统计调查对象实施行政许可、行政处罚等具体行政行为的依据，不得用于完成统计任务以外的目的。
Materials obtained in statistical surveys that can identify or infer the identity of an individual statistical survey respondent shall be strictly managed in accordance with the law. Except for use as a basis for statistical law enforcement, they shall not be directly used as a basis for specific administrative actions such as administrative licensing or administrative penalties against statistical survey respondents, nor shall they be used for purposes other than completing statistical tasks.
国家建立健全统计信息共享机制，实现县级以上人民政府统计机构和有关部门统计调查取得的资料共享。制定机关共同制定的统计调查项目，可以共同使用获取的统计资料。
The state shall establish and improve a statistical information sharing mechanism to realize the sharing of data obtained from statistical investigations conducted by the statistical institutions of the people's governments at or above the county level and relevant departments. The formulating authorities that jointly formulate statistical investigation projects may jointly use the statistical data obtained.
统计调查制度应当对统计信息共享的内容、方式、时限、渠道和责任等作出规定。
The statistical investigation system shall stipulate the content, methods, time limits, channels, and responsibilities for statistical information sharing.
统计机构和统计人员
Statistical Institutions and Statistical Personnel
县级以上地方人民政府统计机构受本级人民政府和上级人民政府统计机构的双重领导，在统计业务上以上级人民政府统计机构的领导为主。
The statistical institutions of the local people's governments at or above the county level shall be under the dual leadership of the people's government at the same level and the statistical institution of the people's government at the next higher level, with the leadership of the statistical institution of the people's government at the next higher level being primary in statistical operations.
乡、镇人民政府应当设置统计工作岗位，配备专职或者兼职统计人员，履行统计职责，在统计业务上受上级人民政府统计机构领导。乡、镇统计人员的调动，应当征得县级人民政府统计机构的同意。
Township and town people's governments shall set up statistical posts, equip full-time or part-time statistical personnel to perform statistical duties, and be under the leadership of the statistical institution of the people's government at the next higher level in statistical operations. The transfer of township and town statistical personnel shall obtain the consent of the statistical institution of the county people's government.
县级以上人民政府有关部门在统计业务上受本级人民政府统计机构指导。
The relevant departments of the people's governments at or above the county level shall be under the guidance of the statistical institution of the people's government at the same level in statistical operations.
县级以上人民政府统计机构和有关部门应当完成国家统计调查任务，执行国家统计调查项目的统计调查制度，组织实施本地方、本部门的统计调查活动。
The statistical institutions and relevant departments of the people's governments at or above the county level shall complete national statistical investigation tasks, implement the statistical investigation system of national statistical investigation projects, and organize and carry out statistical investigation activities in their own localities and departments.
国家机关、企业事业单位和其他组织应当加强统计基础工作，为履行法定的统计资料报送义务提供组织、人员和工作条件保障。
State organs, enterprises, public institutions, and other organizations shall strengthen basic statistical work and provide organizational, personnel, and working condition guarantees for fulfilling the statutory obligation to submit statistical data.
对在统计工作中做出突出贡献、取得显著成绩的单位和个人，按照国家有关规定给予表彰和奖励。
Units and individuals that have made outstanding contributions and achieved remarkable results in statistical work shall be commended and rewarded in accordance with relevant state regulations.
监督检查
Supervision and Inspection
县级以上人民政府统计机构从事统计执法工作的人员，应当具备必要的法律知识和统计业务知识，参加统计执法培训，并取得由国家统计局统一印制的统计执法证。
Personnel engaged in statistical law enforcement work in the statistical institutions of people's governments at or above the county level shall possess the necessary legal knowledge and statistical business knowledge, participate in statistical law enforcement training, and obtain a statistical law enforcement certificate uniformly printed by the National Bureau of Statistics.
任何单位和个人不得拒绝、阻碍对统计工作的监督检查和对统计违法行为的查处工作，不得包庇、纵容统计违法行为。
No unit or individual may refuse or obstruct the supervision and inspection of statistical work and the investigation and handling of statistical violations, nor may they cover up or condone statistical violations.
任何单位和个人有权向县级以上人民政府统计机构举报统计违法行为。
Any unit or individual has the right to report statistical violations to the statistical institutions of people's governments at or above the county level.
县级以上人民政府统计机构应当公布举报统计违法行为的方式和途径，依法受理、核实、处理举报，并为举报人保密。
The statistical institutions of people's governments at or above the county level shall publish the methods and channels for reporting statistical violations, accept, verify, and handle reports in accordance with the law, and maintain confidentiality for the whistleblowers.
县级以上人民政府统计机构负责查处统计违法行为；法律、行政法规对有关部门查处统计违法行为另有规定的，从其规定。
The statistical institutions of people's governments at or above the county level are responsible for investigating and handling statistical violations; where laws and administrative regulations provide otherwise for the investigation and handling of statistical violations by relevant departments, those provisions shall prevail.
法律责任
Legal Liability
下列情形属于统计法第三十七条第四项规定的对严重统计违法行为失察，对地方人民政府、政府统计机构或者有关部门、单位的负责人，由任免机关或者监察机关依法给予处分，并由县级以上人民政府统计机构予以通报：
The following circumstances constitute the neglect of serious statistical violations as specified in Article 37, Item 4 of the Statistics Law, and the responsible persons of local people's governments, government statistical institutions, or relevant departments and units shall be given sanctions by the appointing authority or supervisory authority in accordance with the law, and shall be notified by the statistical institutions of people's governments at or above the county level:
(一)本地方、本部门、本单位大面积发生或者连续发生统计造假、弄虚作假；
(1) Widespread or continuous occurrence of statistical fraud and falsification in the locality, department, or unit;
(二)本地方、本部门、本单位统计数据严重失实，应当发现而未发现；
(2) Statistical data in the locality, department, or unit is seriously inaccurate and should have been discovered but was not;
(三)发现本地方、本部门、本单位统计数据严重失实不予纠正。
(3) Failure to correct serious inaccuracies in statistical data discovered in the locality, department, or unit.
县级以上人民政府统计机构或者有关部门组织实施营利性统计调查的，由本级人民政府、上级人民政府统计机构或者本级人民政府统计机构责令改正，予以通报；有违法所得的，没收违法所得。
Where a statistical agency of a people's government at or above the county level or a relevant department organizes and implements for-profit statistical surveys, the people's government at the same level, the statistical agency of the people's government at a higher level, or the statistical agency of the people's government at the same level shall order correction and circulate a notice; if there is illegal income, the illegal income shall be confiscated.
地方各级人民政府、县级以上人民政府统计机构或者有关部门及其负责人，侵犯统计机构、统计人员独立行使统计调查、统计报告、统计监督职权，或者采用下发文件、会议布置以及其他方式授意、指使、强令统计调查对象或者其他单位、人员编造虚假统计资料的，由上级人民政府、本级人民政府、上级人民政府统计机构或者本级人民政府统计机构责令改正，予以通报。
Where local people's governments at all levels, statistical agencies of people's governments at or above the county level or relevant departments and their responsible persons infringe upon the independent exercise of statistical agencies and statisticians' powers of statistical survey, statistical report, and statistical supervision, or use methods such as issuing documents, arranging meetings, or other means to instruct, direct, or compel statistical survey respondents or other units or persons to fabricate false statistical data, the people's government at a higher level, the people's government at the same level, the statistical agency of the people's government at a higher level, or the statistical agency of the people's government at the same level shall order correction and circulate a notice.
县级以上人民政府统计机构或者有关部门在组织实施统计调查活动中有下列行为之一的，由本级人民政府、上级人民政府统计机构或者本级人民政府统计机构责令改正，予以通报：
Where a statistical agency of a people's government at or above the county level or a relevant department commits any of the following acts in organizing and implementing statistical survey activities, the people's government at the same level, the statistical agency of the people's government at a higher level, or the statistical agency of the people's government at the same level shall order correction and circulate a notice:
(一)违法制定、审批或者备案统计调查项目；
(1) Illegally formulating, approving, or filing statistical survey projects;
(二)未按照规定公布经批准或者备案的统计调查项目及其统计调查制度的主要内容；
(2) Failing to publish the main contents of approved or filed statistical survey projects and their statistical survey systems in accordance with regulations;
(三)未执行国家统计标准；
(3) Failing to implement national statistical standards;
(四)未执行统计调查制度；
(4) Failing to implement statistical survey systems;
(五)自行修改单个统计调查对象的统计资料。
(5) Unauthorizedly modifying statistical data of a single statistical survey respondent.
乡、镇统计人员有前款第三项至第五项所列行为的，责令改正，依法给予处分。
Where township or town statisticians commit any of the acts listed in items (3) to (5) of the preceding paragraph, they shall be ordered to correct and given sanctions according to law.
县级以上人民政府统计机构或者有关部门违反本条例第二十四条、第二十五条规定公布统计数据的，由本级人民政府、上级人民政府统计机构或者本级人民政府统计机构责令改正，予以通报。
Where a statistical agency of a people's government at or above the county level or a relevant department publishes statistical data in violation of the provisions of Articles 24 and 25 of these Regulations, the people's government at the same level, the statistical agency of the people's government at a higher level, or the statistical agency of the people's government at the same level shall order correction and circulate a notice.
违反国家有关规定对外提供尚未公布的统计资料或者利用尚未公布的统计资料谋取不正当利益的，由任免机关或者监察机关依法给予处分，并由县级以上人民政府统计机构予以通报。
Whoever, in violation of the relevant provisions of the state, provides unpublished statistical data to the outside or uses unpublished statistical data to seek illegitimate benefits shall be given a sanction by the appointing authority or the supervisory authority in accordance with the law, and shall be notified by the statistical institution of the people's government at or above the county level.
统计机构及其工作人员有下列行为之一的，由本级人民政府或者上级人民政府统计机构责令改正，予以通报：
Where a statistical institution or its staff commits any of the following acts, the people's government at the same level or the statistical institution of the people's government at a higher level shall order it to make corrections and circulate a notice of criticism:
(一)拒绝、阻碍对统计工作的监督检查和对统计违法行为的查处工作；
(1) Refusing or obstructing the supervision and inspection of statistical work and the investigation and handling of statistical violations;
(二)包庇、纵容统计违法行为；
(2) Covering up or conniving at statistical violations;
(三)向有统计违法行为的单位或者个人通风报信，帮助其逃避查处；
(3) Leaking information to units or individuals that have committed statistical violations to help them evade investigation;
(四)未依法受理、核实、处理对统计违法行为的举报；
(4) Failing to accept, verify, or handle reports of statistical violations in accordance with the law;
(五)泄露对统计违法行为的举报情况。
(5) Disclosing information about reports of statistical violations.
地方各级人民政府、县级以上人民政府有关部门拒绝、阻碍统计监督检查或者转移、隐匿、篡改、毁弃原始记录和凭证、统计台账、统计调查表及其他相关证明和资料的，由上级人民政府、上级人民政府统计机构或者本级人民政府统计机构责令改正，予以通报。
Where a local people's government at any level or a relevant department of a people's government at or above the county level refuses or obstructs statistical supervision and inspection, or transfers, conceals, alters, or destroys original records and vouchers, statistical ledgers, statistical survey forms, and other relevant certificates and materials, the people's government at a higher level, the statistical institution of the people's government at a higher level, or the statistical institution of the people's government at the same level shall order it to make corrections and circulate a notice of criticism.
地方各级人民政府、县级以上人民政府统计机构和有关部门有本条例第四十一条至第四十七条所列违法行为之一的，对直接负责的主管人员和其他直接责任人员，由任免机关或者监察机关依法给予处分。
Where a local people's government at any level, a statistical institution of a people's government at or above the county level, or a relevant department commits any of the illegal acts listed in Articles 41 to 47 of these Regulations, the directly responsible person in charge and other directly responsible persons shall be given a sanction by the appointing authority or the supervisory authority in accordance with the law.
乡、镇人民政府有统计法第三十八条第一款、第三十九条第一款所列行为之一的，依照统计法第三十八条、第三十九条的规定追究法律责任。
Where a people's government of a township or town commits any of the acts listed in Paragraph 1 of Article 38 or Paragraph 1 of Article 39 of the Statistics Law, it shall be investigated for legal liability in accordance with Articles 38 and 39 of the Statistics Law.
下列情形属于统计法第四十一条第二款规定的情节严重行为：
The following circumstances constitute serious violations as stipulated in the second paragraph of Article 41 of the Statistics Law:
(一)使用暴力或者威胁方法拒绝、阻碍统计调查、统计监督检查；
(1) Using violence or threats to refuse or obstruct statistical investigation or statistical supervision and inspection;
(二)拒绝、阻碍统计调查、统计监督检查，严重影响相关工作正常开展；
(2) Refusing or obstructing statistical investigation or statistical supervision and inspection, seriously affecting the normal conduct of related work;
(三)提供不真实、不完整的统计资料，造成严重后果或者恶劣影响；
(3) Providing untrue or incomplete statistical data, causing serious consequences or adverse effects;
(四)有统计法第四十一条第一款所列违法行为之一，1年内被责令改正3次以上。
(4) Committing any of the illegal acts listed in the first paragraph of Article 41 of the Statistics Law, and being ordered to make corrections three or more times within one year.
统计违法行为涉嫌犯罪的，县级以上人民政府统计机构应当将案件移送司法机关处理。
If a statistical violation is suspected of constituting a crime, the statistical institution of the people's government at or above the county level shall transfer the case to the judicial authority for handling.
附则
Supplementary Provisions
中华人民共和国境外的组织、个人需要在中华人民共和国境内进行统计调查活动的，应当委托中华人民共和国境内具有涉外统计调查资格的机构进行。涉外统计调查资格应当依法报经批准。统计调查范围限于省、自治区、直辖市行政区域内的，由省级人民政府统计机构审批；统计调查范围跨省、自治区、直辖市行政区域的，由国家统计局审批。
If an organization or individual outside the territory of the People's Republic of China needs to conduct statistical survey activities within the territory of the People's Republic of China, they shall entrust an institution within the territory of the People's Republic of China that has the qualification for foreign-related statistical surveys. The qualification for foreign-related statistical surveys shall be approved in accordance with the law. If the scope of the statistical survey is limited to the administrative region of a province, autonomous region, or municipality directly under the Central Government, it shall be examined and approved by the statistical institution of the provincial people's government; if the scope of the statistical survey spans provinces, autonomous regions, or municipalities directly under the Central Government, it shall be examined and approved by the National Bureau of Statistics.
涉外社会调查项目应当依法报经批准。统计调查范围限于省、自治区、直辖市行政区域内的，由省级人民政府统计机构审批；统计调查范围跨省、自治区、直辖市行政区域的，由国家统计局审批。
Foreign-related social survey projects shall be approved in accordance with the law. If the scope of the statistical survey is limited to the administrative region of a province, autonomous region, or municipality directly under the Central Government, it shall be examined and approved by the statistical institution of the provincial people's government; if the scope of the statistical survey spans provinces, autonomous regions, or municipalities directly under the Central Government, it shall be examined and approved by the National Bureau of Statistics.
国家统计局或者省级人民政府统计机构对涉外统计违法行为进行调查，有权采取统计法第三十五条规定的措施。
The National Bureau of Statistics or the statistical institution of the provincial people's government shall investigate foreign-related statistical violations and have the authority to take the measures stipulated in Article 35 of the Statistics Law.
对违法从事涉外统计调查活动的单位、个人，由国家统计局或者省级人民政府统计机构责令改正或者责令停止调查，有违法所得的，没收违法所得；违法所得50万元以上的，并处违法所得1倍以上3倍以下的罚款；违法所得不足50万元或者没有违法所得的，处200万元以下的罚款；情节严重的，暂停或者取消涉外统计调查资格，撤销涉外社会调查项目批准决定；构成犯罪的，依法追究刑事责任。
For entities or individuals that illegally engage in foreign-related statistical survey activities, the National Bureau of Statistics or the provincial-level people's government statistical institution shall order correction or order cessation of the survey; if there are illegal gains, the illegal gains shall be confiscated; if the illegal gains are 500,000 yuan or more, a fine of not less than one time but not more than three times the illegal gains shall be imposed; if the illegal gains are less than 500,000 yuan or there are no illegal gains, a fine of not more than 2,000,000 yuan shall be imposed; if the circumstances are serious, the qualification for foreign-related statistical surveys shall be suspended or revoked, and the approval decision for foreign-related social survey projects shall be revoked; if a crime is constituted, criminal liability shall be pursued according to law.
本条例自2017年8月1日起施行。1987年1月19日国务院批准、1987年2月15日国家统计局公布，2000年6月2日国务院批准修订、2000年6月15日国家统计局公布，2005年12月16日国务院修订的《中华人民共和国统计法实施细则》同时废止。
These Regulations shall come into force on August 1, 2017. The Detailed Rules for the Implementation of the Statistics Law of the People's Republic of China, approved by the State Council on January 19, 1987, promulgated by the National Bureau of Statistics on February 15, 1987, approved for revision by the State Council on June 2, 2000, promulgated by the National Bureau of Statistics on June 15, 2000, and revised by the State Council on December 16, 2005, shall be simultaneously abolished.
