机动车所有人的住所在公安机关交通管理部门管辖区域内迁移、机动车所有人的姓名(单位名称)或者联系方式变更的,应当向登记该机动车的公安机关交通管理部门备案。

机动车所有人将机动车作为抵押物抵押的,机动车所有人应当向登记该机动车的公安机关交通管理部门申请抵押登记。

If the motor vehicle owner mortgages the motor vehicle as collateral, the motor vehicle owner shall apply for mortgage registration to the traffic management department of the public security organ where the motor vehicle is registered.

已注册登记的机动车达到国家规定的强制报废标准的,公安机关交通管理部门应当在报废期满的2个月前通知机动车所有人办理注销登记。机动车所有人应当在报废期满前将机动车交售给机动车回收企业,由机动车回收企业将报废的机动车登记证书、号牌、行驶证交公安机关交通管理部门注销。机动车所有人逾期不办理注销登记的,公安机关交通管理部门应当公告该机动车登记证书、号牌、行驶证作废。

If a registered motor vehicle reaches the compulsory scrapping standard prescribed by the state, the traffic management department of the public security organ shall notify the motor vehicle owner to go through the deregistration formalities two months before the expiration of the scrapping period. The motor vehicle owner shall, before the expiration of the scrapping period, sell the motor vehicle to a motor vehicle recycling enterprise, which shall deliver the scrapped motor vehicle registration certificate, license plate, and driving permit to the traffic management department of the public security organ for deregistration. If the motor vehicle owner fails to go through the deregistration formalities within the time limit, the traffic management department of the public security organ shall announce the invalidation of the motor vehicle registration certificate, license plate, and driving permit.

If the motor vehicle registration certificate, license plate, or driving permit is lost or damaged, the motor vehicle owner applying for a reissue shall submit his/her identity certificate and application materials to the traffic management department of the public security organ. After verification with the motor vehicle registration file, the traffic management department of the public security organ shall reissue the documents within 15 days from the date of receiving the application.

Motor vehicle license plates shall be hung at the designated positions at the front and rear of the vehicle, kept clear and complete. Heavy and medium trucks, their trailers, tractors, and their trailers shall have enlarged license plate numbers sprayed on the rear of the body or carriage, with the characters being neat and kept clear.

用于公路营运的载客汽车、重型载货汽车、半挂牵引车应当安装、使用符合国家标准的行驶记录仪。交通警察可以对机动车行驶速度、连续驾驶时间以及其他行驶状态信息进行检查。安装行驶记录仪可以分步实施,实施步骤由国务院机动车产品主管部门会同有关部门规定。

Passenger vehicles used for highway operation, heavy trucks, and semi-trailer tractors shall be installed with and use tachographs that meet national standards. Traffic police may inspect the driving speed, continuous driving time, and other driving status information of motor vehicles. The installation of tachographs may be implemented in stages, and the implementation steps shall be prescribed by the competent department of motor vehicle products of the State Council together with relevant departments.

Motor vehicle safety technical inspections shall be carried out by motor vehicle safety technical inspection institutions. Motor vehicle safety technical inspection institutions shall inspect motor vehicles in accordance with national motor vehicle safety technical inspection standards and bear legal liability for the inspection results.

When a registered motor vehicle undergoes safety technical inspection, if the registration content recorded in the motor vehicle driving license does not match the relevant information of the motor vehicle, or if the compulsory third-party liability insurance certificate for motor vehicles is not provided as required, the inspection shall not be passed.

To learn to drive a motor vehicle, one must first study road traffic safety laws, regulations, and related knowledge, and after passing the examination, then learn motor vehicle driving skills.

Translation

Learning to drive on the road shall be conducted on the routes and at the times designated by the traffic management department of the public security organ. Learning motor vehicle driving skills on the road shall use a training vehicle, under the guidance of a coach, and persons unrelated to the teaching shall not ride in the training vehicle. If a student commits a road traffic safety violation or causes a traffic accident during learning to drive, the coach shall bear responsibility.

公安机关交通管理部门应当对申请机动车驾驶证的人进行考试,对考试合格的,在5日内核发机动车驾驶证;对考试不合格的,书面说明理由。

The traffic management department of the public security organ shall conduct examinations for persons applying for a motor vehicle driving license. For those who pass the examination, a motor vehicle driving license shall be issued within 5 days; for those who fail, the reasons shall be explained in writing.

公安机关交通管理部门对机动车驾驶人的道路交通安全违法行为除给予行政处罚外,实行道路交通安全违法行为累积记分(以下简称记分)制度,记分周期为12个月。对在一个记分周期内记分达到12分的,由公安机关交通管理部门扣留其机动车驾驶证,该机动车驾驶人应当按照规定参加道路交通安全法律、法规的学习并接受考试。考试合格的,记分予以清除,发还机动车驾驶证;考试不合格的,继续参加学习和考试。

TranslationArticle 23

In addition to imposing administrative penalties for road traffic safety violations committed by motor vehicle drivers, the traffic management department of the public security organ shall implement a cumulative scoring system for road traffic safety violations (hereinafter referred to as scoring), with a scoring cycle of 12 months. For those whose cumulative score reaches 12 points within a scoring cycle, the traffic management department of the public security organ shall detain their motor vehicle driving license, and the motor vehicle driver shall participate in the study of road traffic safety laws and regulations and take an examination as required. If the examination is passed, the score shall be cleared and the motor vehicle driving license shall be returned; if the examination is failed, the study and examination shall continue.

机动车驾驶人在一个记分周期内记分未达到12分,所处罚款已经缴纳的,记分予以清除;记分虽未达到12分,但尚有罚款未缴纳的,记分转入下一记分周期。

TranslationArticle 24

If a motor vehicle driver has not accumulated 12 demerit points within a scoring cycle and has paid all fines, the demerit points shall be cleared; if the demerit points have not reached 12 but there are still unpaid fines, the demerit points shall be carried over to the next scoring cycle.

If a motor vehicle driver accumulates 12 demerit points two or more times within a scoring cycle, in addition to the detention of the driver's license, participation in study, and acceptance of examination as provided in Article 23, the driver shall also undergo a driving skills test. If the test is passed, the demerit points shall be cleared and the driver's license shall be returned; if the test is failed, the driver shall continue to participate in study and take the test again.

If a motor vehicle driver accumulates 12 demerit points and refuses to participate in the study notified by the traffic management department of the public security organ and also refuses to take the examination, the traffic management department of the public security organ shall announce the suspension of the driver's license.

If a motor vehicle driver has not accumulated 12 demerit points in any scoring cycle within the 6-year validity period of the driver's license, the driver shall be issued a driver's license with a 10-year validity period; if the driver has not accumulated 12 demerit points in any scoring cycle within the 10-year validity period, the driver shall be issued a driver's license with indefinite validity.

If a motor vehicle driver's license is lost or damaged, and the driver applies for a replacement, the driver shall submit identity certification and application materials to the traffic management department of the public security organ. After verification with the driver's license archives, the traffic management department of the public security organ shall issue a replacement within 3 days from the date of receiving the application.
