总 则
General Provisions
根据《中华人民共和国计量法》的规定，制定本细则。
These Regulations are formulated in accordance with the provisions of the Metrology Law of the People's Republic of China.
国家实行法定计量单位制度。法定计量单位的名称、符号按照国务院关于在我国统一实行法定计量单位的有关规定执行。
The State implements a system of legal measurement units. The names and symbols of legal measurement units shall be implemented in accordance with the relevant provisions of the State Council on the unified implementation of legal measurement units in China.
国家有计划地发展计量事业，用现代计量技术装备各级计量检定机构，为社会主义现代化建设服务，为工农业生产、国防建设、科学实验、国内外贸易以及人民的健康、安全提供计量保证，维护国家和人民的利益。
The State develops the metrology undertaking in a planned manner, equips metrological verification institutions at all levels with modern metrological technology, serves the socialist modernization drive, provides metrological assurance for industrial and agricultural production, national defense construction, scientific experiments, domestic and foreign trade, as well as the health and safety of the people, and safeguards the interests of the State and the people.
计量基准器具和计量标准器具
Measurementbenchmark Instruments and Measurement Standard Instruments
计量基准器具(简称计量基准，下同)的使用必须具备下列条件：
The use of measurementbenchmark instruments (hereinafter referred to as measurementbenchmark) must meet the following conditions:
(一)经国家鉴定合格；
(1) Having passed the national appraisal;
(二)具有正常工作所需要的环境条件；
(2) Having the environmental conditions required for normal operation;
(三)具有称职的保存、维护、使用人员；
(3) Having competent personnel for preservation, maintenance, and use;
(四)具有完善的管理制度。
(4) Having a complete management system.
符合上述条件的，经国务院计量行政部门审批并颁发计量基准证书后，方可使用。
Those meeting the above conditions may use the measurement benchmark only after approval by the metrology administrative department of the State Council and issuance of a measurement benchmark certificate.
非经国务院计量行政部门批准，任何单位和个人不得拆卸、改装计量基准，或者自行中断其计量检定工作。
Without the approval of the metrology administrative department of the State Council, no unit or individual may disassemble, modify, or independently interrupt the measurement verification work of a measurement benchmark.
计量基准的量值应当与国际上的量值保持一致。国务院计量行政部门有权废除技术水平落后或者工作状况不适应需要的计量基准。
The value of a measurement benchmark shall be consistent with international values. The metrology administrative department of the State Council has the authority to abolish measurement benchmarks that are technologically backward or whose working conditions are no longer suitable.
计量标准器具(简称计量标准，下同)的使用，必须具备下列条件：
The use of measurement standard instruments (hereinafter referred to as measurement standards) must meet the following conditions:
(一)经计量检定合格；
(1) Having passed measurement verification;
(二)具有正常工作所需要的环境条件；
(2) Having the environmental conditions required for normal work;
(三)具有称职的保存、维护、使用人员；
(3) Having competent personnel for preservation, maintenance, and use;
(四)具有完善的管理制度。
(4) Having a complete management system.
社会公用计量标准对社会上实施计量监督具有公证作用。县级以上地方人民政府计量行政部门建立的本行政区域内最高等级的社会公用计量标准，须向上一级人民政府计量行政部门申请考核；其他等级的，由当地人民政府计量行政部门主持考核。
Public measurement standards have notarial effect in implementing measurement supervision over society. The highest-level public measurement standard established by the metrology administrative department of a local people's government at or above the county level within its administrative region shall be submitted to the metrology administrative department of the people's government at the next higher level for assessment; other levels shall be assessed by the local people's government metrology administrative department.
经考核符合本细则第七条规定条件并取得考核合格证的，由当地县级以上人民政府计量行政部门审批颁发社会公用计量标准证书后，方可使用。
Those who have passed the assessment meeting the conditions specified in Article 7 of these Regulations and obtained the assessment certificate may use the social public measurement standard only after the local people's government metrological administrative department at or above the county level approves and issues the social public measurement standard certificate.
国务院有关主管部门和省、自治区、直辖市人民政府有关主管部门建立的本部门各项最高计量标准，经同级人民政府计量行政部门考核，符合本细则第七条规定条件并取得考核合格证的，由有关主管部门批准使用。
The highest measurement standards established by the relevant competent departments of the State Council and the relevant competent departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, after being assessed by the metrological administrative department of the people's government at the same level and meeting the conditions specified in Article 7 of these Regulations and obtaining the assessment certificate, be approved for use by the relevant competent department.
企业、事业单位建立本单位各项最高计量标准，须向与其主管部门同级的人民政府计量行政部门申请考核。乡镇企业向当地县级人民政府计量行政部门申请考核。经考核符合本细则第七条规定条件并取得考核合格证的，企业、事业单位方可使用，并向其主管部门备案。
Enterprises and institutions establishing their own highest measurement standards shall apply for assessment to the metrological administrative department of the people's government at the same level as their competent department. Township enterprises shall apply for assessment to the local county-level metrological administrative department of the people's government. After passing the assessment meeting the conditions specified in Article 7 of these Regulations and obtaining the assessment certificate, the enterprise or institution may use them and shall file them with their competent department.
计量检定
Metrological Verification
使用实行强制检定的计量标准的单位和个人，应当向主持考核该项计量标准的有关人民政府计量行政部门申请周期检定。
Units and individuals using measurement standards subject to compulsory verification shall apply for periodic verification to the relevant metrological administrative department of the people's government that presided over the assessment of such measurement standards.
使用实行强制检定的工作计量器具的单位和个人，应当向当地县(市)级人民政府计量行政部门指定的计量检定机构申请周期检定。当地不能检定的，向上一级人民政府计量行政部门指定的计量检定机构申请周期检定。
Units and individuals using working measuring instruments subject to compulsory verification shall apply for periodic verification to the metrological verification institution designated by the local county (city)-level metrological administrative department of the people's government. If local verification is not possible, they shall apply for periodic verification to the metrological verification institution designated by the metrological administrative department of the people's government at the next higher level.
企业、事业单位应当配备与生产、科研、经营管理相适应的计量检测设施，制定具体的检定管理办法和规章制度，规定本单位管理的计量器具明细目录及相应的检定周期，保证使用的非强制检定的计量器具定期检定。
Enterprises and institutions shall equip themselves with metrological testing facilities appropriate to production, scientific research, and operation management, formulate specific verification management measures and rules and regulations, specify the detailed catalog of measuring instruments managed by the unit and the corresponding verification cycles, and ensure that the non-compulsory verification measuring instruments in use are periodically verified.
计量检定工作应当符合经济合理、就地就近的原则，不受行政区划和部门管辖的限制。
Metrological verification work shall comply with the principles of economic rationality and local convenience, and shall not be restricted by administrative divisions or departmental jurisdiction.
计量器具的制造和修理
Manufacturing and Repair of Measuring Instruments
制造、修理计量器具的企业、事业单位和个体工商户须在固定的场所从事经营，具有符合国家规定的生产设施、检验条件、技术人员等，并满足安全要求。
Enterprises, institutions, and individual industrial and commercial households that manufacture or repair measuring instruments shall operate in fixed premises, have production facilities, inspection conditions, technical personnel, etc. that meet national regulations, and satisfy safety requirements.
凡制造在全国范围内从未生产过的计量器具新产品，必须经过定型鉴定。定型鉴定合格后，应当履行型式批准手续，颁发证书。在全国范围内已经定型，而本单位未生产过的计量器具新产品，应当进行样机试验。样机试验合格后，发给合格证书。凡未经型式批准或者未取得样机试验合格证书的计量器具，不准生产。
Any new measuring instrument product that has never been manufactured within the whole country must undergo type evaluation. After passing the type evaluation, the type approval procedure shall be fulfilled and a certificate shall be issued. For a new measuring instrument product that has already been type-approved nationwide but has not been manufactured by the unit, a prototype test shall be conducted. After passing the prototype test, a certificate of conformity shall be issued. No measuring instrument that has not undergone type approval or obtained a prototype test certificate of conformity shall be manufactured.
计量器具新产品定型鉴定，由国务院计量行政部门授权的技术机构进行；样机试验由所在地方的省级人民政府计量行政部门授权的技术机构进行。
The type evaluation of new measuring instrument products shall be carried out by technical institutions authorized by the metrology administrative department of the State Council; prototype tests shall be carried out by technical institutions authorized by the metrology administrative department of the provincial people's government where the unit is located.
计量器具新产品的型式，由当地省级人民政府计量行政部门批准。省级人民政府计量行政部门批准的型式，经国务院计量行政部门审核同意后，作为全国通用型式。
The type of a new measuring instrument product shall be approved by the local provincial metrology administrative department. The type approved by the provincial metrology administrative department, after review and consent by the metrology administrative department of the State Council, shall serve as the nationally applicable type.
申请计量器具新产品定型鉴定和样机试验的单位，应当提供新产品样机及有关技术文件、资料。
Units applying for type evaluation and prototype testing of new measuring instrument products shall provide prototypes of the new product and relevant technical documents and materials.
负责计量器具新产品定型鉴定和样机试验的单位，对申请单位提供的样机和技术文件、资料必须保密。
Units responsible for type evaluation and prototype testing of new measuring instrument products must keep confidential the prototypes and technical documents and materials provided by the applicant.
对企业、事业单位制造、修理计量器具的质量，各有关主管部门应当加强管理，县级以上人民政府计量行政部门有权进行监督检查，包括抽检和监督试验。凡无产品合格印、证，或者经检定不合格的计量器具，不准出厂。
For the quality of measuring instruments manufactured or repaired by enterprises and institutions, the relevant competent departments shall strengthen management, and the metrology administrative departments of people's governments at or above the county level have the right to conduct supervision and inspection, including random inspection and supervision tests. Any measuring instrument without a qualified product seal or certificate, or that fails inspection, shall not leave the factory.
计量器具的销售和使用
Sale and Use of Measuring Instruments
外商在中国销售计量器具，须比照本细则第十五条的规定向国务院计量行政部门申请型式批准。
Foreign businessmen selling measuring instruments in China shall apply to the metrology administrative department of the State Council for type approval in accordance with the provisions of Article 15 of these Regulations.
县级以上地方人民政府计量行政部门对当地销售的计量器具实施监督检查。凡没有产品合格印、证标志的计量器具不得销售。
The metrology administrative departments of local people's governments at or above the county level shall conduct supervision and inspection of measuring instruments sold locally. No measuring instrument without a qualified product seal or certificate mark shall be sold.
任何单位和个人不得经营销售残次计量器具零配件，不得使用残次零配件组装和修理计量器具。
No unit or individual may operate or sell defective measuring instrument spare parts, nor use defective spare parts to assemble or repair measuring instruments.
任何单位和个人不准在工作岗位上使用无检定合格印、证或者超过检定周期以及经检定不合格的计量器具。在教学示范中使用计量器具不受此限。
No unit or individual may use measuring instruments at the workplace that lack a verificationqualified seal or certificate, or that have exceeded the verification period, or that have been verified as unqualified. This restriction does not apply to the use of measuring instruments for teaching demonstrations.
计量监督
Metrology Supervision
国务院计量行政部门和县级以上地方人民政府计量行政部门监督和贯彻实施计量法律、法规的职责是：
The metrology administrative department of the State Council and the metrology administrative departments of local people's governments at or above the county level shall supervise and implement the metrology laws and regulations, with the following responsibilities:
(一)贯彻执行国家计量工作的方针、政策和规章制度，推行国家法定计量单位；
(1) Implement national metrology policies, guidelines, rules, and regulations, and promote the national legal metrological units;
(二)制定和协调计量事业的发展规划，建立计量基准和社会公用计量标准，组织量值传递；
(2) Formulate and coordinate the development plan for metrology, establish metrology benchmarks and public metrology standards, and organize the transmission of quantity values;
(三)对制造、修理、销售、使用计量器具实施监督；
(3) Supervise the manufacture, repair, sale, and use of measuring instruments;
(四)进行计量认证，组织仲裁检定，调解计量纠纷；
(4) Conduct metrology certification, organize arbitration verification, and mediate metrology disputes;
(五)监督检查计量法律、法规的实施情况，对违反计量法律、法规的行为，按照本细则的有关规定进行处理。
(5) Supervise and inspect the implementation of metrology laws and regulations, and handle violations of metrology laws and regulations in accordance with the relevant provisions of these Rules.
县级以上人民政府计量行政部门的计量管理人员，负责执行计量监督、管理任务；计量监督员负责在规定的区域、场所巡回检查，并可根据不同情况在规定的权限内对违反计量法律、法规的行为，进行现场处理，执行行政处罚。
Metrology management personnel of the metrology administrative departments of local people's governments at or above the county level shall be responsible for carrying out metrology supervision and management tasks; metrology supervisors shall be responsible for conducting patrol inspections in designated areas and places, and may, depending on the circumstances, handle violations of metrology laws and regulations on the spot within the prescribed authority and impose administrative penalties.
计量监督员必须经考核合格后，由县级以上人民政府计量行政部门任命并颁发监督员证件。
Metrology supervisors must pass assessment and be appointed by the metrology administrative department of the people's government at or above the county level, and be issued a supervisor certificate.
县级以上人民政府计量行政部门依法设置的计量检定机构，为国家法定计量检定机构。其职责是：负责研究建立计量基准、社会公用计量标准，进行量值传递，执行强制检定和法律规定的其他检定、测试任务，起草技术规范，为实施计量监督提供技术保证，并承办有关计量监督工作。
Metrological verification institutions established according to law by the metrological administrative departments of the people's governments at or above the county level shall be the national legal metrological verification institutions. Their duties are: to be responsible for researching and establishing metrological benchmarks and social public metrological standards, conducting value transfer, performing compulsory verification and other verification and testing tasks as prescribed by law, drafting technical specifications, providing technical guarantees for the implementation of metrological supervision, and undertaking relevant metrological supervision work.
国家法定计量检定机构的计量检定人员，必须经考核合格。
Metrological verification personnel of national legal metrological verification institutions must pass assessment.
计量检定人员的技术职务系列，由国务院计量行政部门会同有关主管部门制定。
The technical job series of metrological verification personnel shall be formulated by the metrological administrative department of the State Council jointly with the relevant competent departments.
县级以上人民政府计量行政部门可以根据需要，采取以下形式授权其他单位的计量检定机构和技术机构，在规定的范围内执行强制检定和其他检定、测试任务：
The metrological administrative departments of the people's governments at or above the county level may, as needed, adopt the following forms to authorize the metrological verification institutions and technical institutions of other units to perform compulsory verification and other verification and testing tasks within the specified scope:
(一)授权专业性或区域性计量检定机构，作为法定计量检定机构；
(1) Authorize professional or regional metrological verification institutions to serve as legal metrological verification institutions;
(二)授权建立社会公用计量标准；
(2) Authorize the establishment of social public metrological standards;
(三)授权某一部门或某一单位的计量检定机构，对其内部使用的强制检定计量器具执行强制检定；
(3) Authorize the metrological verification institution of a certain department or unit to perform compulsory verification on the compulsory verification measuring instruments used internally;
(四)授权有关技术机构，承担法律规定的其他检定、测试任务。
(4) Authorize relevant technical institutions to undertake other verification and testing tasks as prescribed by law.
根据本细则第二十七条规定被授权的单位，应当遵守下列规定：
Units authorized in accordance with Article 27 of these Regulations shall comply with the following provisions:
(一)被授权单位执行检定、测试任务的人员，必须经考核合格；
(1) Personnel performing verification and testing tasks in the authorized unit must pass assessment;
(二)被授权单位的相应计量标准，必须接受计量基准或者社会公用计量标准的检定；
(2) The corresponding measurement standards of the authorized unit must undergo verification against measurement benchmarks or public measurement standards;
(三)被授权单位承担授权的检定、测试工作，须接受授权单位的监督；
(3) The authorized unit, when undertaking authorized verification and testing work, must accept supervision from the authorizing unit;
(四)被授权单位成为计量纠纷中当事人一方时，在双方协商不能自行解决的情况下，由县级以上有关人民政府计量行政部门进行调解和仲裁检定。
(4) When the authorized unit becomes a party to a metrological dispute, if the parties cannot resolve it through consultation, the relevant metrological administrative department of the people's government at or above the county level shall conduct mediation and arbitration verification.
产品质量检验机构的计量认证
Metrological Certification of Product Quality Inspection Institutions
为社会提供公证数据的产品质量检验机构，必须经省级以上人民政府计量行政部门计量认证。
Product quality inspection institutions that provide notarized data to the public must obtain metrological certification from the metrological administrative department of the people's government at or above the provincial level.
产品质量检验机构计量认证的内容：
The content of metrological certification for product quality inspection institutions includes:
(一)计量检定、测试设备的性能；
(1) The performance of metrological verification and testing equipment;
(二)计量检定、测试设备的工作环境和人员的操作技能；
(2) The working environment and personnel operational skills for metrological verification and testing equipment;
(三)保证量值统一、准确的措施及检测数据公正可靠的管理制度。
(3) Management systems that ensure the uniformity and accuracy of measurement values and the reliability and impartiality of testing data.
产品质量检验机构提出计量认证申请后，省级以上人民政府计量行政部门应指定所属的计量检定机构或者被授权的技术机构按照本细则第三十条规定的内容进行考核。考核合格后，由接受申请的省级以上人民政府计量行政部门发给计量认证合格证书。产品质量检验机构自愿签署告知承诺书并按要求提交材料的，按照告知承诺相关程序办理。未取得计量认证合格证书的，不得开展产品质量检验工作。
After a product quality inspection institution submits an application for metrological certification, the metrological administrative department of the people's government at or above the provincial level shall designate its subordinate metrological verification institution or an authorized technical institution to conduct an assessment in accordance with the content specified in Article 30 of these Regulations. No product quality inspection work may be carried out without obtaining a metrological certification certificate.
省级以上人民政府计量行政部门有权对计量认证合格的产品质量检验机构，按照本细则第三十条规定的内容进行监督检查。
The metrological administrative departments of the people's governments at or above the provincial level have the right to conduct supervision and inspection of product quality inspection institutions that have passed metrological certification, in accordance with the contents specified in Article 30 of these Regulations.
已经取得计量认证合格证书的产品质量检验机构，需新增检验项目时，应按照本细则有关规定，申请单项计量认证。
If a product quality inspection institution that has already obtained a metrological certification certificate needs to add new inspection items, it shall apply for individual metrological certification in accordance with the relevant provisions of these Regulations.
计量调解和仲裁检定
Metrological Mediation and Arbitration Verification
县级以上人民政府计量行政部门负责计量纠纷的调解和仲裁检定，并可根据司法机关、合同管理机关、涉外仲裁机关或者其他单位的委托，指定有关计量检定机构进行仲裁检定。
The metrological administrative departments of the people's governments at or above the county level are responsible for the mediation and arbitration verification of metrological disputes, and may, upon the entrustment of judicial organs, contract management organs, foreign-related arbitration organs, or other units, designate relevant metrological verification institutions to carry out arbitration verification.
在调解、仲裁及案件审理过程中，任何一方当事人均不得改变与计量纠纷有关的计量器具的技术状态。
During the process of mediation, arbitration, and case trial, neither party shall change the technical status of the measuring instruments related to the metrological dispute.
计量纠纷当事人对仲裁检定不服的，可以在接到仲裁检定通知书之日起15日内向上一级人民政府计量行政部门申诉。上一级人民政府计量行政部门进行的仲裁检定为终局仲裁检定。
If a party to a metrological dispute is dissatisfied with the arbitration verification, it may appeal to the metrological administrative department of the people's government at the next higher level within 15 days from the date of receiving the arbitration verification notice. The arbitration verification conducted by the metrological administrative department of the people's government at the next higher level shall be the final arbitration verification.
费 用
Fees
建立计量标准申请考核，使用计量器具申请检定，制造计量器具新产品申请定型和样机试验，以及申请计量认证和仲裁检定，应当缴纳费用，具体收费办法或收费标准，由国务院计量行政部门会同国家财政、物价部门统一制定。
Fees shall be paid for applying for assessment of establishing metrological standards, applying for verification of using measuring instruments, applying for type evaluation and prototype testing of new measuring instrument products, and applying for metrological certification and arbitration verification. The specific fee collection methods or fee standards shall be uniformly formulated by the metrological administrative department of the State Council together with the national financial and price departments.
县级以上人民政府计量行政部门实施监督检查所进行的检定和试验不收费。被检查的单位有提供样机和检定试验条件的义务。
Verification and testing conducted by the metrological administrative departments of the people's governments at or above the county level in the implementation of supervision and inspection shall not be charged. The inspected unit has the obligation to provide prototypes and testing conditions.
县级以上人民政府计量行政部门所属的计量检定机构，为贯彻计量法律、法规，实施计量监督提供技术保证所需要的经费，按照国家财政管理体制的规定，分别列入各级财政预算。
The funds required for the metrological verification institutions affiliated with the metrological administrative departments of the people's governments at or above the county level to provide technical guarantees for implementing metrological laws and regulations and conducting metrological supervision shall be included in the fiscal budgets at various levels respectively, in accordance with the provisions of the national financial management system.
法律责任
Legal Liability
违反本细则第二条规定，使用非法定计量单位的，责令其改正；属出版物的，责令其停止销售，可并处1000元以下的罚款。
Whoever violates Article 2 of these Regulations by using illegal units of measurement shall be ordered to make corrections; if it involves publications, they shall be ordered to stop sales and may also be fined not more than 1,000 yuan.
违反《中华人民共和国计量法》第十四条规定，制造、销售和进口非法定计量单位的计量器具的，责令其停止制造、销售和进口，没收计量器具和全部违法所得，可并处相当其违法所得10%至50%的罚款。
Whoever violates Article 14 of the Metrology Law of the People's Republic of China by manufacturing, selling, or importing measuring instruments with illegal units of measurement shall be ordered to stop manufacturing, selling, and importing, and the measuring instruments and all illegal gains shall be confiscated, and a fine of not less than 10% but not more than 50% of the illegal gains may also be imposed.
部门和企业、事业单位的各项最高计量标准，未经有关人民政府计量行政部门考核合格而开展计量检定的，责令其停止使用，可并处1000元以下的罚款。
If the highest measurement standards of departments, enterprises, and institutions are used for measurement verification without being examined and approved by the relevant people's government metrology administrative department, they shall be ordered to stop use and may also be fined not more than 1,000 yuan.
属于强制检定范围的计量器具，未按照规定申请检定和属于非强制检定范围的计量器具未自行定期检定或者送其他计量检定机构定期检定的，以及经检定不合格继续使用的，责令其停止使用，可并处1000元以下的罚款。
If measuring instruments subject to compulsory verification are not submitted for verification as required, or measuring instruments not subject to compulsory verification are not periodically verified by the user or sent to other measurement verification institutions for periodic verification, or if they continue to be used after failing verification, they shall be ordered to stop use and may also be fined not more than 1,000 yuan.
制造、销售未经型式批准或样机试验合格的计量器具新产品的，责令其停止制造、销售，封存该种新产品，没收全部违法所得，可并处3000元以下的罚款。
Whoever manufactures or sells new measuring instrument products that have not passed type approval or prototype test shall be ordered to stop manufacturing and selling, the new products shall be sealed up, all illegal gains shall be confiscated, and a fine of not more than 3,000 yuan may also be imposed.
制造、修理的计量器具未经出厂检定或者经检定不合格而出厂的，责令其停止出厂，没收全部违法所得；情节严重的，可并处3000元以下的罚款。
If measuring instruments manufactured or repaired are shipped out without factory verification or after failing factory verification, the manufacturer or repairer shall be ordered to stop shipment, all illegal gains shall be confiscated; if the circumstances are serious, a fine of not more than 3,000 yuan may also be imposed.
使用不合格计量器具或者破坏计量器具准确度和伪造数据，给国家和消费者造成损失的，责令其赔偿损失，没收计量器具和全部违法所得，可并处2000元以下的罚款。
Whoever uses unqualified measuring instruments, or damages the accuracy of measuring instruments, or falsifies data, causing losses to the state or consumers, shall be ordered to compensate for the losses, and the measuring instruments and all illegal gains shall be confiscated, and a fine of not more than 2,000 yuan may also be imposed.
经营销售残次计量器具零配件的，责令其停止经营销售，没收残次计量器具零配件和全部违法所得，可并处2000元以下的罚款；情节严重的，由工商行政管理部门吊销其营业执照。
Whoever operates or sells defective spare parts of measuring instruments shall be ordered to stop operation and sales, the defective spare parts and all illegal gains shall be confiscated, and a fine of not more than 2,000 yuan may also be imposed; if the circumstances are serious, the business license shall be revoked by the administrative department for industry and commerce.
制造、销售、使用以欺骗消费者为目的的计量器具的单位和个人，没收其计量器具和全部违法所得，可并处2000元以下的罚款；构成犯罪的，对个人或者单位直接责任人员，依法追究刑事责任。
For units or individuals that manufacture, sell, or use measuring instruments for the purpose of deceiving consumers, the measuring instruments and all illegal gains shall be confiscated, and a fine of not more than 2,000 yuan may also be imposed; if the act constitutes a crime, the directly responsible person of the individual or unit shall be investigated for criminal liability according to law.
个体工商户制造、修理国家规定范围以外的计量器具或者不按照规定场所从事经营活动的，责令其停止制造、修理，没收全部违法所得，可并处以500元以下的罚款。
If an individual industrial or commercial household manufactures or repairs measuring instruments beyond the scope prescribed by the state, or engages in business operations not at the designated place, it shall be ordered to stop manufacturing or repairing, all illegal gains shall be confiscated, and a fine of not more than 500 yuan may be imposed concurrently.
未取得计量认证合格证书的产品质量检验机构，为社会提供公证数据的，责令其停止检验，可并处1000元以下的罚款。
If a product quality inspection institution that has not obtained a metrology certification certificate provides notarized data to the public, it shall be ordered to stop inspection, and a fine of not more than 1,000 yuan may be imposed concurrently.
伪造、盗用、倒卖强制检定印、证的，没收其非法检定印、证和全部违法所得，可并处2000元以下的罚款；构成犯罪的，依法追究刑事责任。
If anyone forges, misappropriates, or scalds compulsory verification stamps or certificates, the illegal stamps, certificates, and all illegal gains shall be confiscated, and a fine of not more than 2,000 yuan may be imposed concurrently; if the act constitutes a crime, criminal liability shall be pursued according to law.
计量监督管理人员违法失职，徇私舞弊，情节轻微的，给予行政处分；构成犯罪的，依法追究刑事责任。
If a metrology supervision and management personnel violates the law, neglects duty, or engages in malpractice for personal gain, and the circumstances are minor, administrative sanctions shall be imposed; if the act constitutes a crime, criminal liability shall be pursued according to law.
负责计量器具新产品定型鉴定、样机试验的单位，违反本细则第十七条第二款规定的，应当按照国家有关规定，赔偿申请单位的损失，并给予直接责任人员行政处分；构成犯罪的，依法追究刑事责任。
If a unit responsible for the type evaluation or prototype testing of new measuring instruments violates the provisions of the second paragraph of Article 17 of these Rules, it shall compensate the applicant unit for losses in accordance with relevant state regulations, and administrative sanctions shall be imposed on the directly responsible personnel; if the act constitutes a crime, criminal liability shall be pursued according to law.
计量检定人员有下列行为之一的，给予行政处分；构成犯罪的，依法追究刑事责任：
If a metrology verification personnel commits any of the following acts, administrative sanctions shall be imposed; if the act constitutes a crime, criminal liability shall be pursued according to law:
(一)伪造检定数据的；
(1) Forging verification data;
(二)出具错误数据，给送检一方造成损失的；
(2) Issuing erroneous data, causing losses to the party submitting for inspection;
(三)违反计量检定规程进行计量检定的；
(3) Conducting metrology verification in violation of metrology verification regulations;
(四)使用未经考核合格的计量标准开展检定的；
(4) Using metrology standards that have not passed assessment to carry out verification;
(五)未经考核合格执行计量检定的。
(5) Performing metrological verification without having passed the qualification assessment.
本细则规定的行政处罚，由县级以上地方人民政府计量行政部门决定。罚款1万元以上的，应当报省级人民政府计量行政部门决定。没收违法所得及罚款一律上缴国库。
The administrative penalties prescribed in these Regulations shall be decided by the metrological administrative department of the people's government at or above the county level. Fines of more than 10,000 yuan shall be reported to the metrological administrative department of the provincial people's government for decision. Confiscated illegal gains and fines shall be turned over to the state treasury.
本细则第四十六条规定的行政处罚，也可以由工商行政管理部门决定。
The administrative penalties prescribed in Article 46 of these Regulations may also be decided by the administrative department for industry and commerce.
附 则
Supplementary Provisions
本细则下列用语的含义是：
The meanings of the following terms in these Regulations are:
(一)计量器具是指能用以直接或间接测出被测对象量值的装置、仪器仪表、量具和用于统一量值的标准物质，包括计量基准、计量标准、工作计量器具。
(1) Measuring instruments refer to devices, instruments, meters, gauges, and standard materials used to directly or indirectly measure the quantity values of the measured objects, including metrological benchmarks, metrological standards, and working measuring instruments.
(二)计量检定是指为评定计量器具的计量性能，确定其是否合格所进行的全部工作。
(2) Metrological verification refers to all work performed to evaluate the metrological performance of measuring instruments and determine whether they are qualified.
(三)定型鉴定是指对计量器具新产品样机的计量性能进行全面审查、考核。
(3) Type approval refers to the comprehensive review and assessment of the metrological performance of prototypes of new measuring instruments.
(四)计量认证是指政府计量行政部门对有关技术机构计量检定、测试的能力和可靠性进行的考核和证明。
(4) Metrological certification refers to the assessment and certification by the government metrological administrative department of the capability and reliability of relevant technical institutions in metrological verification and testing.
(五)计量检定机构是指承担计量检定工作的有关技术机构。
(5) Metrological verification institutions refer to relevant technical institutions that undertake metrological verification work.
(六)仲裁检定是指用计量基准或者社会公用计量标准所进行的以裁决为目的的计量检定、测试活动。
(6) Arbitration verification refers to metrological verification and testing activities conducted using metrological benchmarks or public metrological standards for the purpose of adjudication.
中国人民解放军和国防科技工业系统涉及本系统以外的计量工作的监督管理，亦适用本细则。
These Regulations also apply to the supervision and management of metrological work involving systems other than those of the People's Liberation Army and the national defense science, technology, and industry system.
本细则有关的管理办法、管理范围和各种印、证标志，由国务院计量行政部门制定。
The management measures, management scope, and various seals and certification marks related to these Regulations shall be formulated by the metrological administrative department of the State Council.
本细则由国务院计量行政部门负责解释。
These Regulations shall be interpreted by the metrological administrative department of the State Council.
本细则自发布之日起施行。
These Regulations shall come into force on the date of promulgation.
