总则
General Provisions
为了规范事业单位的人事管理,保障事业单位工作人员的合法权益,建设高素质的事业单位工作人员队伍,促进公共服务发展,制定本条例。
This Regulation is formulated to standardize the personnel management of public institutions, protect the legitimate rights and interests of public institution staff, build a high-quality public institution workforce, and promote the development of public services.
事业单位人事管理,坚持党管干部、党管人才原则,全面准确贯彻民主、公开、竞争、择优方针。
Personnel management of public institutions shall adhere to the principles of the Party managing cadres and talents, and fully and accurately implement the guidelines of democracy, openness, competition, and merit selection.
国家对事业单位工作人员实行分级分类管理。
The State implements a hierarchical and classified management system for public institution staff.
中央事业单位人事综合管理部门负责全国事业单位人事综合管理工作。
The central comprehensive personnel management department for public institutions shall be responsible for the comprehensive personnel management of public institutions nationwide.
县级以上地方各级事业单位人事综合管理部门负责本辖区事业单位人事综合管理工作。
Comprehensive personnel management departments for public institutions at or above the county level shall be responsible for the comprehensive personnel management of public institutions within their respective jurisdictions.
事业单位主管部门具体负责所属事业单位人事管理工作。
The competent departments of public institutions shall be specifically responsible for the personnel management of their affiliated public institutions.
事业单位应当建立健全人事管理制度。
Public institutions shall establish and improve personnel management systems.
事业单位制定或者修改人事管理制度,应当通过职工代表大会或者其他形式听取工作人员意见。
When formulating or revising personnel management systems, public institutions shall solicit opinions from staff through staff representative meetings or other forms.
岗位设置
Post Setting
国家建立事业单位岗位管理制度,明确岗位类别和等级。
The State establishes a post management system for public institutions, specifying post categories and grades.
事业单位根据职责任务和工作需要,按照国家有关规定设置岗位。
Public institutions shall set posts in accordance with their responsibilities, tasks, and work needs, following relevant state regulations.
岗位应当具有明确的名称、职责任务、工作标准和任职条件。
Posts shall have clear names, responsibilities, work standards, and qualification requirements.
事业单位拟订岗位设置方案,应当报人事综合管理部门备案。
Public institutions shall submit their post setting plans to the comprehensive personnel management department for recordation.
公开招聘和竞聘上岗
Open Recruitment and Competitive Appointment
事业单位新聘用工作人员,应当面向社会公开招聘。但是,国家政策性安置、按照人事管理权限由上级任命、涉密岗位等人员除外。
Public institutions shall conduct open recruitment for new staff, except for personnel subject to state policy-based placement, appointment by superiors according to personnel management authority, and positions involving state secrets.
事业单位公开招聘工作人员按照下列程序进行:
Open recruitment by public institutions shall follow the following procedures:
(一)制定公开招聘方案;
(1) Formulating an open recruitment plan;
(二)公布招聘岗位、资格条件等招聘信息;
(2) Publishing recruitment information including post details and qualification requirements;
(三)审查应聘人员资格条件;
(3) Reviewing applicants' qualifications;
(四)考试、考察;
(4) Conducting examinations and assessments;
(五)体检;
(5) Physical examination;
(六)公示拟聘人员名单;
(6) Publicizing the list of proposed appointees;
(七)订立聘用合同,办理聘用手续。
(7) Concluding employment contracts and handling appointment procedures.
事业单位内部产生岗位人选,需要竞聘上岗的,按照下列程序进行:
Where a position within a public institution is to be filled internally and requires competitive selection, the following procedures shall be followed:
(一)制定竞聘上岗方案;
(1) Formulate a competitive selection plan;
(二)在本单位公布竞聘岗位、资格条件、聘期等信息;
(2) Announce the position, qualification conditions, and term of appointment within the institution;
(三)审查竞聘人员资格条件;
(3) Review the qualifications of candidates;
(四)考评;
(4) Conduct assessment;
(五)在本单位公示拟聘人员名单;
(5) Publicize the list of proposed appointees within the institution;
(六)办理聘任手续。
(6) Handle the appointment procedures.
事业单位工作人员可以按照国家有关规定进行交流。
Staff members of public institutions may be transferred in accordance with relevant state regulations.
聘用合同
Employment Contracts
事业单位与工作人员订立的聘用合同,期限一般不低于3年。
The term of an employment contract concluded between a public institution and its staff member shall generally be no less than 3 years.
初次就业的工作人员与事业单位订立的聘用合同期限3年以上的,试用期为12个月。
For staff members who are employed for the first time, if the term of the employment contract is 3 years or more, the probation period shall be 12 months.
事业单位工作人员在本单位连续工作满10年且距法定退休年龄不足10年,提出订立聘用至退休的合同的,事业单位应当与其订立聘用至退休的合同。
If a staff member of a public institution has continuously worked in the institution for 10 full years and is less than 10 years away from the statutory retirement age, and proposes to conclude a contract until retirement, the public institution shall conclude such a contract.
事业单位工作人员连续旷工超过15个工作日,或者1年内累计旷工超过30个工作日的,事业单位可以解除聘用合同。
If a staff member of a public institution is absent from work without leave for more than 15 consecutive working days, or for a cumulative total of more than 30 working days within one year, the public institution may terminate the employment contract.
事业单位工作人员年度考核不合格且不同意调整工作岗位,或者连续两年年度考核不合格的,事业单位提前30日书面通知,可以解除聘用合同。
If a staff member of a public institution fails the annual assessment and refuses to accept a job transfer, or fails the annual assessment for two consecutive years, the public institution may terminate the employment contract after giving 30 days' written notice.
事业单位工作人员提前30日书面通知事业单位,可以解除聘用合同。但是,双方对解除聘用合同另有约定的除外。
A staff member of a public institution may terminate the employment contract by giving 30 days' written notice to the institution, unless otherwise agreed by both parties.
事业单位工作人员受到开除处分的,解除聘用合同。
If a staff member of a public institution is subjected to the sanction of dismissal, the employment contract shall be terminated.
自聘用合同依法解除、终止之日起,事业单位与被解除、终止聘用合同人员的人事关系终止。
From the date of lawful rescission or termination of the employment contract, the personnel relationship between the public institution and the person whose contract has been rescinded or terminated shall cease.
考核和培训
Assessment and Training
事业单位应当根据聘用合同规定的岗位职责任务,全面考核工作人员的表现,重点考核工作绩效。考核应当听取服务对象的意见和评价。
A public institution shall comprehensively assess the performance of its staff members based on the duties and tasks specified in the employment contract, with a focus on work performance. The assessment shall take into account the opinions and evaluations of service recipients.
考核分为平时考核、年度考核和聘期考核。
Assessments are divided into routine assessments, annual assessments, and term assessments.
年度考核的结果可以分为优秀、合格、基本合格和不合格等档次,聘期考核的结果可以分为合格和不合格等档次。
The results of annual assessments may be graded as excellent, qualified, basically qualified, or unqualified; the results of term assessments may be graded as qualified or unqualified.
考核结果作为调整事业单位工作人员岗位、工资以及续订聘用合同的依据。
Assessment results shall serve as the basis for adjusting the position, salary, and renewal of employment contracts of staff members in public institutions.
事业单位应当根据不同岗位的要求,编制工作人员培训计划,对工作人员进行分级分类培训。
A public institution shall, according to the requirements of different positions, formulate training plans for staff members and conduct training by level and category.
工作人员应当按照所在单位的要求,参加岗前培训、在岗培训、转岗培训和为完成特定任务的专项培训。
Staff members shall, in accordance with the requirements of their employing institution, participate in pre-job training, on-the-job training, job-transfer training, and special training for completing specific tasks.
培训经费按照国家有关规定列支。
Training funds shall be allocated in accordance with relevant state regulations.
奖励和处分
Rewards and Sanctions
事业单位工作人员或者集体有下列情形之一的,给予奖励:
A public institution staff member or collective shall be rewarded under any of the following circumstances:
(一)长期服务基层,爱岗敬业,表现突出的;
(1) Long-term service at the grassroots level, with dedication and outstanding performance;
(二)在执行国家重要任务、应对重大突发事件中表现突出的;
(2) Outstanding performance in executing important national tasks or responding to major emergencies;
(三)在工作中有重大发明创造、技术革新的;
(3) Significant inventions, creations, or technological innovations in work;
(四)在培养人才、传播先进文化中作出突出贡献的;
(4) Outstanding contributions in cultivating talent or disseminating advanced culture;
(五)有其他突出贡献的。
(5) Other outstanding contributions.
奖励坚持精神奖励与物质奖励相结合、以精神奖励为主的原则。
Rewards shall adhere to the principle of combining spiritual rewards with material rewards, with spiritual rewards as the main focus.
奖励分为嘉奖、记功、记大功、授予荣誉称号。
Rewards are divided into commendation, merit citation, major merit citation, and conferral of honorary title.
事业单位工作人员有下列行为之一的,给予处分:
A public institution staff member shall be subject to disciplinary sanction under any of the following circumstances:
(一)损害国家声誉和利益的;
(1) Damaging the national reputation or interests;
(二)失职渎职的;
(2) Dereliction of duty or malfeasance;
(三)利用工作之便谋取不正当利益的;
(3) Using work convenience to seek improper benefits;
(四)挥霍、浪费国家资财的;
(4) Squandering or wasting state assets;
(五)严重违反职业道德、社会公德的;
(5) Serious violation of professional ethics or social morality;
(六)其他严重违反纪律的。
(6) Other serious violations of discipline.
处分分为警告、记过、降低岗位等级或者撤职、开除。
Disciplinary sanctions are divided into warning, demerit, demotion of post level or removal from post, and dismissal.
受处分的期间为:警告,6个月;记过,12个月;降低岗位等级或者撤职,24个月。
The duration of sanctions is: warning, 6 months; demerit, 12 months; demotion of post level or removal from post, 24 months.
给予工作人员处分,应当事实清楚、证据确凿、定性准确、处理恰当、程序合法、手续完备。
When imposing a sanction on a staff member, the facts shall be clear, evidence conclusive, characterization accurate, handling appropriate, procedures lawful, and formalities complete.
工作人员受开除以外的处分,在受处分期间没有再发生违纪行为的,处分期满后,由处分决定单位解除处分并以书面形式通知本人。
If a staff member subject to a sanction other than dismissal does not commit any further disciplinary violation during the sanction period, the sanction shall be lifted by the sanction-imposing unit upon expiration of the period, and the staff member shall be notified in writing.
工资福利和社会保险
Wages, Benefits, and Social Insurance
国家建立激励与约束相结合的事业单位工资制度。
The state shall establish a wage system for public institutions that combines incentives with constraints.
事业单位工作人员工资包括基本工资、绩效工资和津贴补贴。
The wages of public institution staff members include basic wages, performance-based wages, and allowances and subsidies.
事业单位工资分配应当结合不同行业事业单位特点,体现岗位职责、工作业绩、实际贡献等因素。
Wage distribution in public institutions shall take into account the characteristics of different industries and reflect factors such as job responsibilities, work performance, and actual contributions.
国家建立事业单位工作人员工资的正常增长机制。
The state shall establish a mechanism for the normal growth of wages for public institution staff members.
事业单位工作人员的工资水平应当与国民经济发展相协调、与社会进步相适应。
The salary level of public institution staff shall be coordinated with national economic development and adapted to social progress.
事业单位工作人员享受国家规定的福利待遇。
Public institution staff shall enjoy the welfare benefits prescribed by the state.
事业单位执行国家规定的工时制度和休假制度。
Public institutions shall implement the working hours system and leave system prescribed by the state.
事业单位及其工作人员依法参加社会保险,工作人员依法享受社会保险待遇。
Public institutions and their staff shall participate in social insurance in accordance with the law, and staff shall enjoy social insurance benefits in accordance with the law.
事业单位工作人员符合国家规定退休条件的,应当退休。
Public institution staff who meet the retirement conditions prescribed by the state shall retire.
人事争议处理
Handling of Personnel Disputes
事业单位工作人员与所在单位发生人事争议的,依照《中华人民共和国劳动争议调解仲裁法》等有关规定处理。
If a personnel dispute arises between a public institution staff member and the institution, it shall be handled in accordance with the relevant provisions of the Labor Dispute Mediation and Arbitration Law of the People's Republic of China and other regulations.
事业单位工作人员对涉及本人的考核结果、处分决定等不服的,可以按照国家有关规定申请复核、提出申诉。
If a public institution staff member disagrees with the assessment results, disciplinary decision, or other matters concerning themselves, they may apply for review or lodge an appeal in accordance with state regulations.
负有事业单位聘用、考核、奖励、处分、人事争议处理等职责的人员履行职责,有下列情形之一的,应当回避:
Personnel responsible for duties such as recruitment, assessment, reward, disciplinary action, and handling of personnel disputes in public institutions shall recuse themselves under any of the following circumstances:
(一)与本人有利害关系的;
(1) Having a personal interest in the matter;
(二)与本人近亲属有利害关系的;
(2) Having a personal interest with a close relative;
(三)其他可能影响公正履行职责的。
(3) Other circumstances that may affect the impartial performance of duties.
对事业单位人事管理工作中的违法违纪行为,任何单位或者个人可以向事业单位人事综合管理部门、主管部门或者监察机关投诉、举报,有关部门和机关应当及时调查处理。
Any unit or individual may file a complaint or report illegal or non-compliant conduct in the personnel management of public institutions to the comprehensive personnel management department of public institutions, the competent department, or the supervisory authority. The relevant departments and authorities shall promptly investigate and handle the matter.
法律责任
Legal Liability
事业单位违反本条例规定的,由县级以上事业单位人事综合管理部门或者主管部门责令限期改正;逾期不改正的,对直接负责的主管人员和其他直接责任人员依法给予处分。
If a public institution violates the provisions of these Regulations, the comprehensive personnel management department of public institutions at or above the county level or the competent department shall order it to rectify within a specified period; if it fails to rectify within the time limit, the directly responsible supervisor and other directly responsible personnel shall be given disciplinary sanctions in accordance with the law.
对事业单位工作人员的人事处理违反本条例规定给当事人造成名誉损害的,应当赔礼道歉、恢复名誉、消除影响;造成经济损失的,依法给予赔偿。
If a personnel decision concerning a public institution staff member violates these Regulations and causes damage to the party's reputation, the institution shall apologize, restore the party's reputation, and eliminate the adverse effects; if economic losses are caused, compensation shall be made in accordance with the law.
事业单位人事综合管理部门和主管部门的工作人员在事业单位人事管理工作中滥用职权、玩忽职守、徇私舞弊的,依法给予处分;构成犯罪的,依法追究刑事责任。
If staff members of the comprehensive personnel management department of public institutions or the competent department abuse their power, neglect their duties, or engage in favoritism and fraud in the personnel management of public institutions, they shall be given disciplinary sanctions in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
附则
Supplementary Provisions
本条例自2014年7月1日起施行。
These Regulations shall come into force on July 1, 2014.
