Regulation on the Construction of a Barrier-Free Environment

无障碍环境建设条例

This regulation establishes requirements for creating a barrier-free environment to ensure equal participation in social life for persons with disabilities and other members of society.

TranslationArticle 2

For the purposes of this Regulation, 'construction of a barrier-free environment' refers to construction activities carried out to facilitate the independent and safe passage of persons with disabilities and other members of society on roads, entry into and exit from relevant buildings, use of public transportation, exchange of information, and access to community services.

The competent department of housing and urban-rural development under the State Council shall be responsible for the supervision and management of the construction activities of barrier-free facilities nationwide, formulate construction standards for barrier-free facilities in conjunction with the relevant departments of the State Council, and conduct supervision and inspection of the construction of barrier-free facilities.

Barrier-free facility projects shall be designed, constructed, and accepted for use simultaneously with the main project. Newly built barrier-free facilities shall be connected with the surrounding barrier-free facilities.

Pedestrian overpasses and underpasses on major urban roads, in major commercial areas, and in large residential areas shall be equipped with barrier-free facilities in accordance with the construction standards for barrier-free facilities. 民用航空器、客运列车、客运船舶、公共汽车、城市轨道交通车辆等公共交通工具应当逐步达到无障碍设施的要求。有关主管部门应当制定公共交通工具的无障碍技术标准并确定达标期限。

Public transportation vehicles such as civil aircraft, passenger trains, passenger ships, buses, and urban rail transit vehicles shall gradually meet the requirements for barrier-free facilities. The relevant competent departments shall formulate barrier-free technical standards for public transportation vehicles and determine the deadlines for compliance.

城镇新建、改建、扩建道路、公共建筑、公共交通设施、居住建筑、居住区,不符合无障碍设施工程建设标准的,由住房和城乡建设主管部门责令改正,依法给予处罚。

无障碍环境建设主管部门工作人员滥用职权、玩忽职守、徇私舞弊的,依法给予处分;构成犯罪的,依法追究刑事责任。
