总 则
General Provisions
为了提高建设工程抗震防灾能力，降低地震灾害风险，保障人民生命财产安全，根据《中华人民共和国建筑法》、《中华人民共和国防震减灾法》等法律，制定本条例。
This Regulation is formulated in accordance with the Construction Law of the People's Republic of China, the Earthquake Prevention and Disaster Reduction Law of the People's Republic of China, and other laws, in order to improve the seismic resistance capacity of construction projects, reduce the risk of earthquake disasters, and protect the safety of people's lives and property.
在中华人民共和国境内从事建设工程抗震的勘察、设计、施工、鉴定、加固、维护等活动及其监督管理，适用本条例。
This Regulation applies to the survey, design, construction, appraisal, reinforcement, maintenance, and other activities related to seismic resistance of construction projects within the territory of the People's Republic of China, as well as the supervision and management thereof.
建设工程抗震应当坚持以人为本、全面设防、突出重点的原则。
Seismic resistance of construction projects shall adhere to the principles of people-oriented, comprehensive fortification, and highlighting key points.
国务院住房和城乡建设主管部门对全国的建设工程抗震实施统一监督管理。国务院交通运输、水利、工业和信息化、能源等有关部门按照职责分工，负责对全国有关专业建设工程抗震的监督管理。
The competent department of housing and urban-rural development under the State Council shall exercise unified supervision and management over the seismic resistance of construction projects nationwide. The relevant departments under the State Council, such as transportation, water resources, industry and information technology, and energy, shall be responsible for the supervision and management of the seismic resistance of relevant specialized construction projects nationwide according to their respective functions and duties.
县级以上地方人民政府住房和城乡建设主管部门对本行政区域内的建设工程抗震实施监督管理。县级以上地方人民政府交通运输、水利、工业和信息化、能源等有关部门在各自职责范围内，负责对本行政区域内有关专业建设工程抗震的监督管理。
The competent departments of housing and urban-rural development of local people's governments at or above the county level shall exercise supervision and management over the seismic resistance of construction projects within their respective administrative regions. The relevant departments of local people's governments at or above the county level, such as transportation, water resources, industry and information technology, and energy, shall be responsible for the supervision and management of the seismic resistance of relevant specialized construction projects within their respective administrative regions within the scope of their respective functions and duties.
县级以上人民政府其他有关部门应当依照本条例和其他有关法律、法规的规定，在各自职责范围内负责建设工程抗震相关工作。
Other relevant departments of people's governments at or above the county level shall, in accordance with the provisions of this Regulation and other relevant laws and regulations, be responsible for the work related to seismic resistance of construction projects within the scope of their respective functions and duties.
从事建设工程抗震相关活动的单位和人员，应当依法对建设工程抗震负责。
Units and individuals engaged in activities related to seismic resistance of construction projects shall be responsible for the seismic resistance of construction projects in accordance with the law.
国家鼓励和支持建设工程抗震技术的研究、开发和应用。
The State encourages and supports the research, development, and application of seismic resistance technologies for construction projects.
各级人民政府应当组织开展建设工程抗震知识宣传普及，提高社会公众抗震防灾意识。
People's governments at all levels shall organize the promotion and popularization of knowledge on seismic resistance of construction projects to enhance public awareness of seismic disaster prevention.
国家建立建设工程抗震调查制度。
The state establishes a survey system for seismic resistance of construction projects.
县级以上人民政府应当组织有关部门对建设工程抗震性能、抗震技术应用、产业发展等进行调查，全面掌握建设工程抗震基本情况，促进建设工程抗震管理水平提高和科学决策。
People's governments at or above the county level shall organize relevant departments to conduct surveys on the seismic performance, application of seismic technology, and industrial development of construction projects, to comprehensively grasp the basic situation of seismic resistance of construction projects, and to promote the improvement of seismic resistance management level and scientific decision-making.
建设工程应当避开抗震防灾专项规划确定的危险地段。确实无法避开的，应当采取符合建设工程使用功能要求和适应地震效应的抗震设防措施。
Construction projects shall avoid dangerous areas identified in the special plan for seismic disaster prevention. Where avoidance is truly impossible, seismic fortification measures that meet the functional requirements of the construction project and adapt to the seismic effects shall be adopted.
勘察、设计和施工
Survey, Design, and Construction
新建、扩建、改建建设工程，应当符合抗震设防强制性标准。
New construction, expansion, and renovation projects shall comply with mandatory standards for seismic fortification.
国务院有关部门和国务院标准化行政主管部门依据职责依法制定和发布抗震设防强制性标准。
Relevant departments of the State Council and the standardization administrative department of the State Council shall, in accordance with their duties, formulate and publish mandatory standards for seismic fortification according to law.
建设单位应当对建设工程勘察、设计和施工全过程负责，在勘察、设计和施工合同中明确拟采用的抗震设防强制性标准，按照合同要求对勘察设计成果文件进行核验，组织工程验收，确保建设工程符合抗震设防强制性标准。
The construction unit shall be responsible for the entire process of survey, design, and construction of the construction project, specify the mandatory standards for seismic fortification to be adopted in the survey, design, and construction contracts, verify the survey and design outcome documents as required by the contract, organize project acceptance, and ensure that the construction project complies with the mandatory standards for seismic fortification.
建设单位不得明示或者暗示勘察、设计、施工等单位和从业人员违反抗震设防强制性标准，降低工程抗震性能。
The construction unit shall not explicitly or implicitly suggest that survey, design, construction, and other units and practitioners violate mandatory standards for seismic fortification to reduce the seismic performance of the project.
建设工程勘察文件中应当说明抗震场地类别，对场地地震效应进行分析，并提出工程选址、不良地质处置等建议。
The survey documents for construction projects shall specify the seismic site category, analyze the site seismic effects, and propose recommendations for project site selection and disposal of adverse geological conditions.
建设工程设计文件中应当说明抗震设防烈度、抗震设防类别以及拟采用的抗震设防措施。采用隔震减震技术的建设工程，设计文件中应当对隔震减震装置技术性能、检验检测、施工安装和使用维护等提出明确要求。
The design documents of construction projects shall specify the seismic fortification intensity、seismic fortification category, and the proposed seismic fortification measures。For construction projects adopting seismic isolation and energy dissipation technologies，the design documents shall specify the technical performance of seismic isolation and energy dissipation devices、inspection and testing、construction installation, use, and maintenance, among other clear requirements。
对位于高烈度设防地区、地震重点监视防御区的下列建设工程，设计单位应当在初步设计阶段按照国家有关规定编制建设工程抗震设防专篇，并作为设计文件组成部分：
For the following construction projects located in high-intensity fortification areas、and key earthquake monitoring and defense areas，the design unit shall, during the preliminary design stage, prepare a special chapter on seismic fortification for the construction project in accordance with relevant national regulations，and it shall be part of the design documents：
（一）重大建设工程；
（1）Major construction projects；
（二）地震时可能发生严重次生灾害的建设工程；
（2）Construction projects that may cause serious secondary disasters during an earthquake；
（三）地震时使用功能不能中断或者需要尽快恢复的建设工程。
（3）Construction projects whose functions cannot be interrupted or need to be restored as soon as possible during an earthquake。
对超限高层建筑工程，设计单位应当在设计文件中予以说明，建设单位应当在初步设计阶段将设计文件等材料报送省、自治区、直辖市人民政府住房和城乡建设主管部门进行抗震设防审批。住房和城乡建设主管部门应当组织专家审查，对采取的抗震设防措施合理可行的，予以批准。超限高层建筑工程抗震设防审批意见应当作为施工图设计和审查的依据。
For super-high-rise building projects exceeding code limits，the design unit shall explain in the design documents，the construction unit shall, during the preliminary design stage, submit the design documents and other materials to the provincial、autonomous region、or municipality's housing and urban-rural construction department for seismic fortification approval。The housing and urban-rural construction department shall organize expert review，if the proposed seismic fortification measures are reasonable and feasible，approval shall be granted。The seismic fortification approval opinion for super-high-rise building projects exceeding code limits shall serve as the basis for construction drawing design and review。
前款所称超限高层建筑工程，是指超出国家现行标准所规定的适用高度和适用结构类型的高层建筑工程以及体型特别不规则的高层建筑工程。
The term 'super-high-rise building projects exceeding code limits' as mentioned in the preceding paragraph，refers to high-rise building projects that exceed the applicable height and structural type limits specified in current national standards, as well as high-rise building projects with particularly irregular shapes。
工程总承包单位、施工单位及工程监理单位应当建立建设工程质量责任制度，加强对建设工程抗震设防措施施工质量的管理。
The general contracting unit、construction unit, and project supervision unit shall establish a construction project quality responsibility system，and strengthen the quality management of seismic fortification measures during construction。
国家鼓励工程总承包单位、施工单位采用信息化手段采集、留存隐蔽工程施工质量信息。
The state encourages general contracting units、and construction units to adopt information technology to collect、and retain quality information of concealed works。
施工单位应当按照抗震设防强制性标准进行施工。
The construction unit shall carry out construction in accordance with mandatory seismic fortification standards。
建设单位应当将建筑的设计使用年限、结构体系、抗震设防烈度、抗震设防类别等具体情况和使用维护要求记入使用说明书，并将使用说明书交付使用人或者买受人。
The construction entity shall record the specific circumstances such as the design service life, structural system, seismic fortification intensity, seismic fortification category, and usage and maintenance requirements of the building into the instruction manual, and deliver the instruction manual to the user or buyer.
建筑工程根据使用功能以及在抗震救灾中的作用等因素，分为特殊设防类、重点设防类、标准设防类和适度设防类。学校、幼儿园、医院、养老机构、儿童福利机构、应急指挥中心、应急避难场所、广播电视等建筑，应当按照不低于重点设防类的要求采取抗震设防措施。
Construction projects are divided into special fortification category, key fortification category, standard fortification category, and moderate fortification category based on factors such as usage function and role in earthquake relief. Buildings such as schools, kindergartens, hospitals, elderly care institutions, child welfare institutions, emergency command centers, emergency shelters, and radio and television stations shall adopt seismic fortification measures at a level not lower than the key fortification category.
位于高烈度设防地区、地震重点监视防御区的新建学校、幼儿园、医院、养老机构、儿童福利机构、应急指挥中心、应急避难场所、广播电视等建筑应当按照国家有关规定采用隔震减震等技术，保证发生本区域设防地震时能够满足正常使用要求。
Newly built schools, kindergartens, hospitals, elderly care institutions, child welfare institutions, emergency command centers, emergency shelters, and radio and television stations located in high-intensity fortification areas or key earthquake monitoring and defense areas shall adopt technologies such as isolation and energy dissipation in accordance with relevant national regulations to ensure normal use requirements can be met during a design earthquake in the region.
国家鼓励在除前款规定以外的建设工程中采用隔震减震等技术，提高抗震性能。
The state encourages the adoption of technologies such as isolation and energy dissipation in construction projects other than those specified in the preceding paragraph to improve seismic performance.
国务院有关部门和国务院标准化行政主管部门应当依据各自职责推动隔震减震装置相关技术标准的制定，明确通用技术要求。鼓励隔震减震装置生产企业制定严于国家标准、行业标准的企业标准。
The relevant departments of the State Council and the standardization administrative department of the State Council shall, based on their respective responsibilities, promote the formulation of relevant technical standards for isolation and energy dissipation devices and clarify general technical requirements. Enterprises producing isolation and energy dissipation devices are encouraged to develop enterprise standards that are stricter than national standards or industry standards.
隔震减震装置生产经营企业应当建立唯一编码制度和产品检验合格印鉴制度，采集、存储隔震减震装置生产、经营、检测等信息，确保隔震减震装置质量信息可追溯。隔震减震装置质量应当符合有关产品质量法律、法规和国家相关技术标准的规定。
Enterprises engaged in the production and operation of isolation and energy dissipation devices shall establish a unique coding system and a product inspection and certification seal system, collect and store information on the production, operation, and testing of isolation and energy dissipation devices, and ensure traceability of quality information of isolation and energy dissipation devices. The quality of isolation and energy dissipation devices shall comply with relevant product quality laws, regulations, and national technical standards.
建设单位应当组织勘察、设计、施工、工程监理单位建立隔震减震工程质量可追溯制度，利用信息化手段对隔震减震装置采购、勘察、设计、进场检测、安装施工、竣工验收等全过程的信息资料进行采集和存储，并纳入建设项目档案。
The construction entity shall organize the survey, design, construction, and project supervision entities to establish a traceability system for the quality of isolation and energy dissipation projects, use information technology to collect and store information and data on the entire process of procurement, survey, design, incoming inspection, installation construction, and completion acceptance of isolation and energy dissipation devices, and incorporate them into the construction project archives.
隔震减震装置用于建设工程前，施工单位应当在建设单位或者工程监理单位监督下进行取样，送建设单位委托的具有相应建设工程质量检测资质的机构进行检测。禁止使用不合格的隔震减震装置。
Before isolation and energy dissipation devices are used in a construction project, the construction entity shall, under the supervision of the construction entity or the project supervision entity, take samples and send them to an institution with corresponding construction engineering quality testing qualifications entrusted by the construction entity for testing. The use of unqualified isolation and energy dissipation devices is prohibited.
实行施工总承包的，隔震减震装置属于建设工程主体结构的施工，应当由总承包单位自行完成。
Where construction general contracting is implemented, isolation and energy dissipation devices are part of the main structure construction of the construction project and shall be completed by the general contracting entity itself.
工程质量检测机构应当建立建设工程过程数据和结果数据、检测影像资料及检测报告记录与留存制度，对检测数据和检测报告的真实性、准确性负责，不得出具虚假的检测数据和检测报告。
Engineering quality testing institutions shall establish a system for recording and retaining construction process data and result data, testing image data, and testing reports, be responsible for the authenticity and accuracy of testing data and testing reports, and shall not issue false testing data or testing reports.
鉴定、加固和维护
Appraisal, Reinforcement and Maintenance
国家实行建设工程抗震性能鉴定制度。
The State implements a seismic performance appraisal system for construction projects.
按照《中华人民共和国防震减灾法》第三十九条规定应当进行抗震性能鉴定的建设工程，由所有权人委托具有相应技术条件和技术能力的机构进行鉴定。
For construction projects that require seismic performance appraisal in accordance with Article 39 of the Law of the People's Republic of China on Protecting Against and Mitigating Earthquake Disasters, the owner shall entrust an institution with appropriate technical conditions and capabilities to conduct the appraisal.
国家鼓励对除前款规定以外的未采取抗震设防措施或者未达到抗震设防强制性标准的已经建成的建设工程进行抗震性能鉴定。
The State encourages seismic performance appraisal of completed construction projects other than those specified in the preceding paragraph that have not adopted seismic measures or have not met the mandatory seismic fortification standards.
抗震性能鉴定结果应当对建设工程是否存在严重抗震安全隐患以及是否需要进行抗震加固作出判定。
The seismic performance appraisal results shall determine whether the construction project has serious seismic safety hazards and whether seismic reinforcement is necessary.
抗震性能鉴定结果应当真实、客观、准确。
The seismic performance appraisal results shall be truthful, objective, and accurate.
建设工程所有权人应当对存在严重抗震安全隐患的建设工程进行安全监测，并在加固前采取停止或者限制使用等措施。
The owner of a construction project with serious seismic safety hazards shall conduct safety monitoring and take measures such as stopping or restricting use before reinforcement.
对抗震性能鉴定结果判定需要进行抗震加固且具备加固价值的已经建成的建设工程，所有权人应当进行抗震加固。
For completed construction projects that are determined by seismic performance appraisal to require seismic reinforcement and have reinforcement value, the owner shall carry out seismic reinforcement.
位于高烈度设防地区、地震重点监视防御区的学校、幼儿园、医院、养老机构、儿童福利机构、应急指挥中心、应急避难场所、广播电视等已经建成的建筑进行抗震加固时，应当经充分论证后采用隔震减震等技术，保证其抗震性能符合抗震设防强制性标准。
When carrying out seismic reinforcement of completed buildings such as schools, kindergartens, hospitals, elderly care institutions, child welfare institutions, emergency command centers, emergency shelters, and radio and television stations located in high-intensity seismic fortification areas or key earthquake monitoring and defense areas, technologies such as isolation and energy dissipation shall be adopted after full demonstration to ensure that their seismic performance meets the mandatory seismic fortification standards.
抗震加固应当依照《建设工程质量管理条例》等规定执行，并符合抗震设防强制性标准。
Seismic reinforcement shall be carried out in accordance with the Regulations on Quality Management of Construction Projects and other relevant provisions, and shall meet the mandatory seismic fortification standards.
竣工验收合格后，应当通过信息化手段或者在建设工程显著部位设置永久性标牌等方式，公示抗震加固时间、后续使用年限等信息。
After the completion and acceptance of a construction project, information such as the time of seismic reinforcement and the subsequent service life shall be disclosed through information technology or by setting up permanent signs in prominent parts of the construction project.
建设工程所有权人应当按照规定对建设工程抗震构件、隔震沟、隔震缝、隔震减震装置及隔震标识进行检查、修缮和维护，及时排除安全隐患。
The owner of a construction project shall inspect, repair, and maintain the seismic components, seismic isolation ditches, seismic isolation joints, seismic isolation and damping devices, and seismic identification signs of the construction project in accordance with regulations, and promptly eliminate safety hazards.
任何单位和个人不得擅自变动、损坏或者拆除建设工程抗震构件、隔震沟、隔震缝、隔震减震装置及隔震标识。
No unit or individual may alter, damage, or remove the seismic components, seismic isolation ditches, seismic isolation joints, seismic isolation and damping devices, or seismic identification signs of a construction project without authorization.
任何单位和个人发现擅自变动、损坏或者拆除建设工程抗震构件、隔震沟、隔震缝、隔震减震装置及隔震标识的行为，有权予以制止，并向住房和城乡建设主管部门或者其他有关监督管理部门报告。
Any unit or individual that discovers unauthorized alteration, damage, or removal of seismic components, seismic isolation ditches, seismic isolation joints, seismic isolation and damping devices, or seismic identification signs of a construction project has the right to stop such acts and report to the competent department of housing and urban-rural development or other relevant supervisory departments.
农村建设工程抗震设防
Seismic Fortification of Rural Construction Projects
各级人民政府和有关部门应当加强对农村建设工程抗震设防的管理，提高农村建设工程抗震性能。
People's governments at all levels and relevant departments shall strengthen the management of seismic fortification of rural construction projects and improve the seismic performance of rural construction projects.
县级以上人民政府对经抗震性能鉴定未达到抗震设防强制性标准的农村村民住宅和乡村公共设施建设工程抗震加固给予必要的政策支持。
The people's government at or above the county level shall provide necessary policy support for the seismic reinforcement of rural residential houses and rural public facilities that have been assessed through seismic performance appraisal as not meeting the mandatory seismic fortification standards.
实施农村危房改造、移民搬迁、灾后恢复重建等，应当保证建设工程达到抗震设防强制性标准。
When implementing rural dilapidated house renovation, relocation due to migration, or post-disaster reconstruction, it shall be ensured that the construction projects meet the mandatory seismic fortification standards.
县级以上地方人民政府应当编制、发放适合农村的实用抗震技术图集。
The local people's government at or above the county level shall compile and distribute practical seismic technical drawings suitable for rural areas.
农村村民住宅建设可以选用抗震技术图集，也可以委托设计单位进行设计，并根据图集或者设计的要求进行施工。
Rural residential house construction may adopt seismic technical drawings or entrust a design unit to carry out design, and construction shall be carried out according to the drawings or design requirements.
县级以上地方人民政府应当加强对农村村民住宅和乡村公共设施建设工程抗震的指导和服务，加强技术培训，组织建设抗震示范住房，推广应用抗震性能好的结构形式及建造方法。
Local people's governments at or above the county level shall strengthen guidance and services for seismic resistance of rural residential houses and public facilities construction projects, enhance technical training, organize the construction of model seismic-resistant houses, and promote the application of structural forms and construction methods with good seismic performance.
保障措施
Safeguard Measures
县级以上人民政府应当加强对建设工程抗震管理工作的组织领导，建立建设工程抗震管理工作机制，将相关工作纳入本级国民经济和社会发展规划。
People's governments at or above the county level shall strengthen the organizational leadership of seismic management of construction projects, establish a working mechanism for seismic management of construction projects, and incorporate relevant work into the national economic and social development plan at the corresponding level.
县级以上人民政府应当将建设工程抗震工作所需经费列入本级预算。
People's governments at or above the county level shall include the necessary funds for seismic work of construction projects in the budget at the corresponding level.
县级以上地方人民政府应当组织有关部门，结合本地区实际开展地震风险分析，并按照风险程度实行分类管理。
Local people's governments at or above the county level shall organize relevant departments to carry out seismic risk analysis based on the actual conditions of the region and implement classified management according to the degree of risk.
县级以上地方人民政府对未采取抗震设防措施或者未达到抗震设防强制性标准的老旧房屋抗震加固给予必要的政策支持。
Local people's governments at or above the county level shall provide necessary policy support for seismic strengthening of old houses that have not taken seismic fortification measures or do not meet the mandatory seismic fortification standards.
国家鼓励建设工程所有权人结合电梯加装、节能改造等开展抗震加固，提升老旧房屋抗震性能。
The state encourages owners of construction projects to carry out seismic strengthening in conjunction with elevator installation, energy-saving renovation, etc., to improve the seismic performance of old houses.
国家鼓励金融机构开发、提供金融产品和服务，促进建设工程抗震防灾能力提高，支持建设工程抗震相关产业发展和新技术应用。
The state encourages financial institutions to develop and provide financial products and services to enhance the seismic disaster prevention capacity of construction projects and support the development of seismic-related industries and the application of new technologies.
县级以上地方人民政府鼓励和引导社会力量参与抗震性能鉴定、抗震加固。
Local people's governments at or above the county level encourage and guide social forces to participate in seismic performance appraisal and seismic strengthening.
国家鼓励科研教育机构设立建设工程抗震技术实验室和人才实训基地。
The state encourages scientific research and educational institutions to establish seismic technology laboratories and talent training bases for construction projects.
县级以上人民政府应当依法对建设工程抗震新技术产业化项目用地、融资等给予政策支持。
People's governments at or above the county level shall, in accordance with the law, provide policy support for land use、and financing of industrialization projects for new seismic technologies in construction projects。
县级以上人民政府住房和城乡建设主管部门或者其他有关监督管理部门应当制定建设工程抗震新技术推广目录，加强对建设工程抗震管理和技术人员的培训。
The housing and urban-rural construction department or other relevant supervisory departments of people's governments at or above the county level shall formulate a catalog for promoting new seismic technologies in construction projects，and strengthen training for personnel in seismic management and technology of construction projects。
地震灾害发生后，县级以上人民政府住房和城乡建设主管部门或者其他有关监督管理部门应当开展建设工程安全应急评估和建设工程震害调查，收集、保存相关资料。
After an earthquake disaster occurs，the housing and urban-rural construction department or other relevant supervisory departments of people's governments at or above the county level shall conduct emergency safety assessments of construction projects and seismic damage surveys，collect、and preserve relevant materials。
监督管理
Supervision and Management
县级以上人民政府住房和城乡建设主管部门和其他有关监督管理部门应当按照职责分工，加强对建设工程抗震设防强制性标准执行情况的监督检查。
The housing and urban-rural construction department and other relevant supervisory departments of people's governments at or above the county level shall, according to their respective responsibilities，strengthen supervision and inspection of the implementation of mandatory seismic fortification standards for construction projects。
县级以上人民政府住房和城乡建设主管部门应当会同有关部门建立完善建设工程抗震设防数据信息库，并与应急管理、地震等部门实时共享数据。
The housing and urban-rural construction department of people's governments at or above the county level shall, together with relevant departments, establish and improve a database of seismic fortification data for construction projects，and share data in real time with emergency management、and seismic departments。
县级以上人民政府住房和城乡建设主管部门或者其他有关监督管理部门履行建设工程抗震监督管理职责时，有权采取以下措施：
When performing seismic supervision and management duties for construction projects, the housing and urban-rural construction department or other relevant supervisory departments of people's governments at or above the county level，have the authority to take the following measures：
（一）对建设工程或者施工现场进行监督检查；
（(1)）Conduct supervision and inspection of construction projects or construction sites；
（二）向有关单位和人员调查了解相关情况；
（(2)）Investigate and understand relevant circumstances from relevant units and personnel；
（三）查阅、复制被检查单位有关建设工程抗震的文件和资料；
（(3)）Review、and copy documents and materials related to seismic measures of construction projects from the inspected units；
（四）对抗震结构材料、构件和隔震减震装置实施抽样检测；

（六）发现可能影响抗震质量的问题时，责令相关单位进行必要的检测、鉴定。
(6) When discovering issues that may affect seismic quality, order the relevant entities to conduct necessary testing and appraisal.
县级以上人民政府住房和城乡建设主管部门或者其他有关监督管理部门开展监督检查时，可以委托专业机构进行抽样检测、抗震性能鉴定等技术支持工作。
When conducting supervision and inspection, the competent department of housing and urban-rural development of a people's government at or above the county level or other relevant supervisory departments may entrust professional institutions to provide technical support such as sampling tests and seismic performance appraisal.
县级以上人民政府住房和城乡建设主管部门或者其他有关监督管理部门应当建立建设工程抗震责任企业及从业人员信用记录制度，将相关信用记录纳入全国信用信息共享平台。
The competent department of housing and urban-rural development of a people's government at or above the county level or other relevant supervisory departments shall establish a credit record system for construction enterprises and practitioners responsible for seismic construction, and incorporate relevant credit records into the national credit information sharing platform.
任何单位和个人对违反本条例规定的违法行为，有权进行举报。
Any entity or individual has the right to report violations of the provisions of these Regulations.
接到举报的住房和城乡建设主管部门或者其他有关监督管理部门应当进行调查，依法处理，并为举报人保密。
The competent department of housing and urban-rural development or other relevant supervisory department that receives the report shall investigate, handle according to law, and keep the reporter confidential.

Legal Liability
违反本条例规定，住房和城乡建设主管部门或者其他有关监督管理部门工作人员在监督管理工作中玩忽职守、滥用职权、徇私舞弊的，依法给予处分。
Where, in violation of these Regulations, staff members of the competent department of housing and urban-rural development or other relevant supervisory departments neglect their duties, abuse their power, or engage in malpractice for personal gain, they shall be given sanctions according to law.
违反本条例规定，建设单位明示或者暗示勘察、设计、施工等单位和从业人员违反抗震设防强制性标准，降低工程抗震性能的，责令改正，处20万元以上50万元以下的罚款；情节严重的，处50万元以上500万元以下的罚款；造成损失的，依法承担赔偿责任。
Where, in violation of these Regulations, a construction entity explicitly or implicitly instructs survey, design, construction, and other entities and practitioners to violate mandatory seismic fortification standards and reduce the seismic performance of the project, it shall be ordered to correct and fined not less than 200,000 yuan but not more than 500,000 yuan; if the circumstances are serious, it shall be fined not less than 500,000 yuan but not more than 5,000,000 yuan; if losses are caused, it shall bear compensation liability according to law.
违反本条例规定，建设单位未经超限高层建筑工程抗震设防审批进行施工的，责令停止施工，限期改正，处20万元以上100万元以下的罚款；造成损失的，依法承担赔偿责任。
Where, in violation of these Regulations, a construction entity carries out construction without obtaining seismic fortification approval for an over-limit high-rise building project, it shall be ordered to stop construction and rectify within a time limit, and be fined not less than 200,000 yuan but not more than 1,000,000 yuan; if losses are caused, it shall bear compensation liability according to law.
违反本条例规定，建设单位未组织勘察、设计、施工、工程监理单位建立隔震减震工程质量可追溯制度的，或者未对隔震减震装置采购、勘察、设计、进场检测、安装施工、竣工验收等全过程的信息资料进行采集和存储，并纳入建设项目档案的，责令改正，处10万元以上30万元以下的罚款；造成损失的，依法承担赔偿责任。
Where, in violation of these Regulations, a construction entity fails to organize the survey, design, construction, and project supervision entities to establish a quality traceability system for isolation and damping projects, or fails to collect and store information data on the entire process of procurement, survey, design, entry inspection, installation construction, completion acceptance, etc., of isolation and damping devices, and incorporate them into the project archives, it shall be ordered to rectify and be fined not less than 100,000 yuan but not more than 300,000 yuan; if losses are caused, it shall bear compensation liability according to law.
违反本条例规定，设计单位有下列行为之一的，责令改正，处10万元以上30万元以下的罚款；情节严重的，责令停业整顿，降低资质等级或者吊销资质证书；造成损失的，依法承担赔偿责任：
Where, in violation of these Regulations, a design entity commits any of the following acts, it shall be ordered to rectify and be fined not less than 100,000 yuan but not more than 300,000 yuan; if the circumstances are serious, it shall be ordered to suspend operations for rectification, its qualification grade shall be lowered, or its qualification certificate shall be revoked; if losses are caused, it shall bear compensation liability according to law:
（一）未按照超限高层建筑工程抗震设防审批意见进行施工图设计；
(1) failing to carry out construction drawing design in accordance with the seismic fortification approval opinion for the over-limit high-rise building project;
（二）未在初步设计阶段将建设工程抗震设防专篇作为设计文件组成部分；
(2) failing to include the special chapter on seismic fortification of the construction project as a component of the design documents at the preliminary design stage;
（三）未按照抗震设防强制性标准进行设计。
(3) failing to carry out design in accordance with the mandatory seismic fortification standards.
违反本条例规定，施工单位在施工中未按照抗震设防强制性标准进行施工的，责令改正，处工程合同价款2%以上4%以下的罚款；造成建设工程不符合抗震设防强制性标准的，负责返工、加固，并赔偿因此造成的损失；情节严重的，责令停业整顿，降低资质等级或者吊销资质证书。
Where, in violation of these Regulations, a construction entity fails to carry out construction in accordance with the mandatory seismic fortification standards during construction, it shall be ordered to rectify and be fined not less than 2% but not more than 4% of the contract price of the project; if the construction project fails to meet the mandatory seismic fortification standards, it shall be responsible for rework and reinforcement, and compensate for the losses caused thereby; if the circumstances are serious, it shall be ordered to suspend operations for rectification, its qualification grade shall be lowered, or its qualification certificate shall be revoked.
违反本条例规定，施工单位未对隔震减震装置取样送检或者使用不合格隔震减震装置的，责令改正，处10万元以上20万元以下的罚款；情节严重的，责令停业整顿，并处20万元以上50万元以下的罚款，降低资质等级或者吊销资质证书；造成损失的，依法承担赔偿责任。
Where, in violation of these Regulations, a construction entity fails to take samples of isolation and damping devices for inspection or uses unqualified isolation and damping devices, it shall be ordered to rectify and be fined not less than 100,000 yuan but not more than 200,000 yuan; if the circumstances are serious, it shall be ordered to suspend operations for rectification and be fined not less than 200,000 yuan but not more than 500,000 yuan, its qualification grade shall be lowered, or its qualification certificate shall be revoked; if losses are caused, it shall bear compensation liability according to law.
违反本条例规定，工程质量检测机构未建立建设工程过程数据和结果数据、检测影像资料及检测报告记录与留存制度的，责令改正，处10万元以上30万元以下的罚款；情节严重的，吊销资质证书；造成损失的，依法承担赔偿责任。
Where, in violation of these Regulations, an engineering quality testing institution fails to establish a system for recording and retaining process data and result data, testing image data, and testing reports of construction projects, it shall be ordered to rectify and be fined not less than 100,000 yuan but not more than 300,000 yuan; if the circumstances are serious, its qualification certificate shall be revoked; if losses are caused, it shall bear compensation liability according to law.
违反本条例规定，工程质量检测机构出具虚假的检测数据或者检测报告的，责令改正，处10万元以上30万元以下的罚款；情节严重的，吊销资质证书和负有直接责任的注册执业人员的执业资格证书，其直接负责的主管人员和其他直接责任人员终身禁止从事工程质量检测业务；造成损失的，依法承担赔偿责任。
Where, in violation of these Regulations, an engineering quality testing institution issues false testing data or testing reports, it shall be ordered to rectify and be fined not less than 100,000 yuan but not more than 300,000 yuan; if the circumstances are serious, its qualification certificate and the practice qualification certificates of the registered practitioners directly responsible shall be revoked, and the directly responsible person in charge and other directly responsible persons shall be permanently prohibited from engaging in engineering quality testing business; if losses are caused, it shall bear compensation liability according to law.
违反本条例规定，抗震性能鉴定机构未按照抗震设防强制性标准进行抗震性能鉴定的，责令改正，处10万元以上30万元以下的罚款；情节严重的，责令停业整顿，并处30万元以上50万元以下的罚款；造成损失的，依法承担赔偿责任。
Where, in violation of these Regulations, a seismic performance assessment institution fails to conduct seismic performance assessment in accordance with the mandatory standards for seismic fortification, it shall be ordered to make corrections and be fined not less than 100,000 yuan but not more than 300,000 yuan; if the circumstances are serious, it shall be ordered to suspend operations for rectification and be fined not less than 300,000 yuan but not more than 500,000 yuan; if losses are caused, it shall bear compensation liability in accordance with the law.
违反本条例规定，抗震性能鉴定机构出具虚假鉴定结果的，责令改正，处10万元以上30万元以下的罚款；情节严重的，责令停业整顿，并处30万元以上50万元以下的罚款，吊销负有直接责任的注册执业人员的执业资格证书，其直接负责的主管人员和其他直接责任人员终身禁止从事抗震性能鉴定业务；造成损失的，依法承担赔偿责任。
Where, in violation of these Regulations, a seismic performance assessment institution issues false assessment results, it shall be ordered to make corrections and be fined not less than 100,000 yuan but not more than 300,000 yuan; if the circumstances are serious, it shall be ordered to suspend operations for rectification and be fined not less than 300,000 yuan but not more than 500,000 yuan, and the practice qualification certificates of the directly responsible registered practitioners shall be revoked, and the directly responsible persons in charge and other directly responsible persons shall be permanently prohibited from engaging in seismic performance assessment business; if losses are caused, it shall bear compensation liability in accordance with the law.
违反本条例规定，擅自变动、损坏或者拆除建设工程抗震构件、隔震沟、隔震缝、隔震减震装置及隔震标识的，责令停止违法行为，恢复原状或者采取其他补救措施，对个人处5万元以上10万元以下的罚款，对单位处10万元以上30万元以下的罚款；造成损失的，依法承担赔偿责任。
Where, in violation of these Regulations, seismic structural components, seismic isolation trenches, seismic isolation joints, seismic isolation and damping devices, and seismic isolation identification signs of a construction project are altered, damaged, or removed without authorization, the violator shall be ordered to cease the illegal act, restore the original condition or take other remedial measures, and be fined not less than 50,000 yuan but not more than 100,000 yuan for an individual, and not less than 100,000 yuan but not more than 300,000 yuan for a unit; if losses are caused, it shall bear compensation liability in accordance with the law.
依照本条例规定，给予单位罚款处罚的，对其直接负责的主管人员和其他直接责任人员处单位罚款数额5%以上10%以下的罚款。
Where a unit is fined in accordance with these Regulations, the directly responsible persons in charge and other directly responsible persons shall be fined not less than 5% but not more than 10% of the amount of the fine imposed on the unit.
本条例规定的降低资质等级或者吊销资质证书的行政处罚，由颁发资质证书的机关决定；其他行政处罚，由住房和城乡建设主管部门或者其他有关监督管理部门依照法定职权决定。
The administrative penalties of downgrading the qualification grade or revoking the qualification certificate as provided for in these Regulations shall be decided by the authority that issued the qualification certificate; other administrative penalties shall be decided by the competent department of housing and urban-rural construction or other relevant supervisory and administrative departments in accordance with their statutory functions and powers.
违反本条例规定，构成犯罪的，依法追究刑事责任。
Where a violation of these Regulations constitutes a crime, criminal liability shall be pursued in accordance with the law.
附 则
Supplementary Provisions
本条例下列用语的含义：
The meanings of the following terms in these Regulations:
（一）建设工程：主要包括土木工程、建筑工程、线路管道和设备安装工程等。
(1) Construction projects: mainly include civil engineering, building engineering, line, pipeline and equipment installation engineering, etc.
（二）抗震设防强制性标准：是指包括抗震设防类别、抗震性能要求和抗震设防措施等内容的工程建设强制性标准。
(2) Mandatory standards for seismic fortification: refer to the mandatory construction standards that include contents such as seismic fortification category, seismic performance requirements, and seismic fortification measures.
（三）地震时使用功能不能中断或者需要尽快恢复的建设工程：是指发生地震后提供应急医疗、供水、供电、交通、通信等保障或者应急指挥、避难疏散功能的建设工程。
(3) Construction projects whose functions cannot be interrupted or need to be restored as soon as possible during an earthquake: refers to construction projects that provide emergency medical care, water supply, power supply, transportation, communication, or other support, or functions such as emergency command and evacuation shelter after an earthquake.
（四）高烈度设防地区：是指抗震设防烈度为8度及以上的地区。
(4) High-intensity fortification area: refers to an area with a seismic fortification intensity of 8 degrees or above.
（五）地震重点监视防御区：是指未来5至10年内存在发生破坏性地震危险或者受破坏性地震影响，可能造成严重的地震灾害损失的地区和城市。
(5) Key earthquake monitoring and defense area: refers to areas and cities where there is a risk of a destructive earthquake or may be affected by a destructive earthquake within the next 5 to 10 years, potentially causing severe earthquake disaster losses.
抢险救灾及其他临时性建设工程不适用本条例。
This regulation does not apply to emergency rescue, disaster relief, and other temporary construction projects.
军事建设工程的抗震管理，中央军事委员会另有规定的，适用有关规定。
For the seismic management of military construction projects, if the Central Military Commission has other provisions, those provisions shall apply.
本条例自2021年9月1日起施行。
This regulation shall come into force on September 1, 2021.
