为了加强对废旧金属收购业的治安管理，保护合法经营，预防和打击违法犯罪活动，制定本办法。
These Measures are formulated to strengthen the public security administration of the scrap metal acquisition industry, protect lawful operations, and prevent and combat illegal and criminal activities.
本办法所称废旧金属，是指生产性废旧金属和非生产性废旧金属。生产性废旧金属和非生产性废旧金属的具体分类由公安部会同有关部门规定。
For the purposes of these Measures, scrap metal refers to production scrap metal and non-production scrap metal. The specific classification of production scrap metal and non-production scrap metal shall be prescribed by the Ministry of Public Security in conjunction with relevant departments.
生产性废旧金属，按照国务院有关规定由有权经营生产性废旧金属收购业的企业收购。收购废旧金属的其他企业和个体工商户只能收购非生产性废旧金属，不得收购生产性废旧金属。
Production scrap metal shall be acquired by enterprises authorized to engage in the acquisition of production scrap metal in accordance with relevant regulations of the State Council. Other enterprises and individual industrial and commercial households that acquire scrap metal may only acquire non-production scrap metal and shall not acquire production scrap metal.
收购废旧金属的企业和个体工商户，应当在取得营业执照后15日内向所在地县级人民政府公安机关备案。
Enterprises and individual industrial and commercial households that acquire scrap metal shall, within 15 days after obtaining a business license, file a record with the public security organ of the local county people's government.
备案事项发生变更的，收购废旧金属的企业和个体工商户应当自变更之日起15日内(属于工商登记事项的自工商登记变更之日起15日内)向县级人民政府公安机关办理变更手续。
If the recorded items change, the enterprise or individual industrial and commercial household acquiring scrap metal shall, within 15 days from the date of change (or within 15 days from the date of change in industrial and commercial registration if it is an industrial and commercial registration matter), go through the change procedures with the public security organ of the county people's government.
公安机关可以通过网络等方式，便利企业和个体工商户备案。
Public security organs may facilitate the filing of records by enterprises and individual industrial and commercial households through online means or other methods.
收购废旧金属的企业应当有固定的经营场所。收购废旧金属的个体工商户应当有所在地常住户口或者暂住户口。
Enterprises acquiring scrap metal shall have a fixed place of business. Individual industrial and commercial households acquiring scrap metal shall have a permanent residence or temporary residence registration in the locality.
在铁路、矿区、油田、港口、机场、施工工地、军事禁区和金属冶炼加工企业附近，不得设点收购废旧金属。
No acquisition point for scrap metal shall be established near railways, mining areas, oil fields, ports, airports, construction sites, military restricted zones, or metal smelting and processing enterprises.
收购废旧金属的企业在收购生产性废旧金属时，应当查验出售单位开具的证明，对出售单位的名称和经办人的姓名、住址、身份证号码以及物品的名称、数量、规格、新旧程度等如实进行登记。
When acquiring production scrap metal, an enterprise acquiring scrap metal shall inspect the certificate issued by the selling unit, and truthfully register the name of the selling unit, the name, address, and ID number of the handler, as well as the name, quantity, specifications, and degree of wear of the items.
收购废旧金属的企业和个体工商户不得收购下列金属物品：
Enterprises and individual industrial and commercial households acquiring scrap metal shall not acquire the following metal items:
(一)枪支、弹药和爆炸物品；
(1) Firearms, ammunition, and explosive materials;
(二)剧毒、放射性物品及其容器；
(2) Highly toxic and radioactive substances and their containers;
(三)铁路、油田、供电、电信通讯、矿山、水利、测量和城市公用设施等专用器材；
(3) Specialized equipment for railways, oil fields, power supply, telecommunications, mines, water conservancy, surveying, and urban public facilities;
(四)公安机关通报寻查的赃物或者有赃物嫌疑的物品。
(4) Stolen goods or items suspected of being stolen goods that are publicly notified by public security organs for investigation.
收购废旧金属的企业和个体工商户发现有出售公安机关通报寻查的赃物或者有赃物嫌疑的物品的，应当立即报告公安机关。
If an enterprise or individual industrial and commercial household acquiring scrap metal discovers that someone is selling stolen goods or items suspected of being stolen goods that are publicly notified by public security organs for investigation, it shall immediately report to the public security organ.
公安机关对赃物或者有赃物嫌疑的物品应当予以扣留，并开付收据。有赃物嫌疑的物品经查明不是赃物的，应当及时退还；赃物或者有赃物嫌疑的物品经查明确属赃物的，依照国家有关规定处理。
The public security organ shall detain the stolen goods or items suspected of being stolen goods and issue a receipt. If the items suspected of being stolen goods are found not to be stolen goods after investigation, they shall be returned promptly; if the stolen goods or items suspected of being stolen goods are confirmed to be stolen goods after investigation, they shall be handled in accordance with relevant state regulations.
公安机关应当对收购废旧金属的企业和个体工商户进行治安业务指导和检查。收购企业和个体工商户应当协助公安人员查处违法犯罪分子，据实反映情况，不得知情不报或者隐瞒包庇。
Public security organs shall provide guidance and inspection on public security operations to enterprises and individual industrial and commercial households acquiring scrap metal. The acquiring enterprises and individual industrial and commercial households shall assist public security personnel in investigating and dealing with illegal and criminal elements, truthfully report the situation, and shall not withhold information or conceal or shield offenders.
有下列情形之一的，由公安机关给予相应处罚：
In any of the following circumstances, the public security organ shall impose corresponding penalties:
(一)违反本办法第四条第一款规定，未履行备案手续收购生产性废旧金属的，予以警告，责令限期改正，逾期拒不改正的，视情节轻重，处以500元以上2000元以下的罚款；未履行备案手续收购非生产性废旧金属的，予以警告或者处以500元以下的罚款；
(1) Violating the provisions of Article 4, paragraph 1, by acquiring production scrap metal without fulfilling the record-filing procedures, a warning shall be given, and a deadline for correction shall be set; if correction is refused beyond the deadline, depending on the severity of the circumstances, a fine of not less than 500 yuan but not more than 2,000 yuan shall be imposed; if non-production scrap metal is acquired without fulfilling the record-filing procedures, a warning or a fine of not more than 500 yuan shall be imposed;
(二)违反本办法第四条第二款规定，未向公安机关办理变更手续的，予以警告或者处以200元以下的罚款；
(2) Violating the provisions of Article 4, paragraph 2, by failing to go through the change procedures with the public security organ, a warning or a fine of not more than 200 yuan shall be imposed;
(三)违反本办法第六条规定，非法设点收购废旧金属的，予以取缔，没收非法收购的物品及非法所得，可以并处5000元以上10000元以下的罚款；
(3) Violating the provisions of Article 6 by illegally setting up a point to acquire scrap metal, the point shall be banned, the illegally acquired items and illegal gains shall be confiscated, and a fine of not less than 5,000 yuan but not more than 10,000 yuan may be concurrently imposed;
(四)违反本办法第七条规定，收购生产性废旧金属时未如实登记的，视情节轻重，处以2000元以上5000元以下的罚款或者责令停业整顿；
(4) Violating the provisions of Article 7 by failing to truthfully register when acquiring production scrap metal, depending on the severity of the circumstances, a fine of not less than 2,000 yuan but not more than 5,000 yuan shall be imposed, or the business shall be ordered to suspend operations for rectification;
(五)违反本办法第八条规定，收购禁止收购的金属物品的，视情节轻重，处以2000元以上10000元以下的罚款或者责令停业整顿。
(5) Violating the provisions of Article 8 by acquiring prohibited metal items, depending on the severity of the circumstances, a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed, or the business shall be ordered to suspend operations for rectification.
有前款所列第(一)、(三)、(四)、(五)项情形之一，构成犯罪的，依法追究刑事责任。
If any of the circumstances listed in items (1), (3), (4), or (5) of the preceding paragraph constitutes a crime, criminal liability shall be pursued in accordance with the law.
当事人对公安机关作出的具体行政行为不服的，可以自得知该具体行政行为之日起15日内向上一级公安机关申请复议；对复议决定不服的，可以自接到复议决定通知之日起15日内向人民法院提起诉讼。
If a party is dissatisfied with a specific administrative act taken by a public security organ, it may apply for reconsideration to the public security organ at the next higher level within 15 days from the date of learning of the specific administrative act; if dissatisfied with the reconsideration decision, it may file a lawsuit with the people's court within 15 days from the date of receiving the notice of the reconsideration decision.
对严格执行本办法，协助公安机关查获违法犯罪分子，作出显著成绩的单位和个人，由公安机关给予表彰或者奖励。
Units and individuals that strictly implement these Measures and assist public security organs in detecting criminals and making outstanding achievements shall be commended or rewarded by the public security organs.
本办法自发布之日起施行。
These Measures shall come into force as of the date of promulgation.
