为了加强对国家行政机关工作人员在对外公务活动中赠送和接受礼品的管理，严肃外事纪律，保持清廉，制定本规定。
These Provisions are formulated to strengthen the management of the giving and receiving of gifts by state administrative personnel in foreign official activities, to strictly enforce foreign affairs discipline, and to maintain integrity.
本规定所称的礼品，是指礼物、礼金、有价证券。
For the purposes of these Provisions, "gifts" refer to presents, cash gifts, and marketable securities.
根据国际惯例和对外工作需要，必要时可以对外赠送礼物。礼物的金额标准另行规定。
In accordance with international practice and the needs of foreign affairs, gifts may be given to foreign parties when necessary. The monetary standards for gifts shall be separately prescribed.
对外赠送礼物必须贯彻节约、从简的原则。礼物应当以具有民族特色的纪念品、传统手工艺品和实用物品为主。
The giving of gifts to foreign parties must adhere to the principles of frugality and simplicity. Gifts should primarily consist of souvenirs with ethnic characteristics, traditional handicrafts, and practical items.
对来访的外宾，不主动赠送礼物。外宾向我方赠送礼物的，可以适当回赠礼物。
Gifts shall not be proactively given to visiting foreign guests. If foreign guests present gifts to our side, appropriate return gifts may be given.
对外赠送礼物或者回赠礼物，必须经国务院所属部门或者省、自治区、直辖市人民政府批准，或者由其授权的机关批准。审批时，应当从严掌握。
The giving of gifts or return gifts to foreign parties must be approved by a department under the State Council or by a people's government of a province, autonomous region, or municipality directly under the Central Government, or by an organ authorized by them. Approval shall be exercised with strict control.
在对外公务活动中接受的礼物，应当妥善处理。价值按我国市价折合人民币二百元以上的，自接受之日起(在国外接受礼物的，自回国之日起)一个月内填写礼品申报单并将应上缴的礼物上缴礼品管理部门或者受礼人所在单位；不满二百元的，归受礼人本人或者受礼人所在单位。
Gifts received in foreign official activities shall be properly handled. If the value, converted at domestic market prices, is 200 yuan or more in RMB, a gift declaration form shall be filled out within one month from the date of receipt (or from the date of return to China if the gift was received abroad), and the gift that should be turned over shall be delivered to the gift management department or the recipient's unit. If the value is less than 200 yuan, the gift shall belong to the recipient or the recipient's unit.
在对外公务活动中，对方赠送礼金、有价证券时，应当予以谢绝；确实难以谢绝的，所收礼金、有价证券必须一律上缴国库。
In foreign official activities, if the other party offers cash gifts or marketable securities, they shall be declined; if it is truly difficult to decline, all cash gifts and marketable securities received must be turned over to the state treasury.
在对外公务活动中，不得私相授受礼品，不得以明示或者暗示的方式索取礼品。
In foreign official activities, gifts shall not be given or received privately, nor shall gifts be solicited explicitly or implicitly.
国务院机关事务管理局负责保管、处理国务院各部门上缴的礼品。
The Government Offices Administration of the State Council shall be responsible for the custody and disposal of gifts turned over by departments under the State Council.
县级以上地方各级人民政府指定专门单位负责保管、处理该级人民政府各部门上缴的礼品。
Local people's governments at or above the county level shall designate specialized units to be responsible for the custody and disposal of gifts turned over by departments under those people's governments.
礼品管理部门及有关部门对于收缴的礼品，应当登记造册，妥善保管，及时处理。礼品保管部门应当每年向受礼单位通报礼品处理情况。受礼单位应当将礼品处理情况告知受礼人。
Gift management departments and relevant departments shall register, properly keep, and promptly dispose of the gifts collected. The gift custody department shall annually inform the recipient units of the status of gift disposal. The recipient unit shall inform the recipient of the gift disposal status.
国家行政监察机关按照有关规定负责对对外赠送和接受礼品的情况进行监督、检查。
State administrative supervisory organs shall, in accordance with relevant provisions, supervise and inspect the giving and receiving of gifts in foreign affairs.
国家行政机关工作人员违反本规定的，对负直接责任的机关有关领导人和直接责任人，给予行政处分；构成犯罪的，由司法机关依法追究刑事责任。
If a state administrative staff member violates these Provisions, the responsible leaders of the organ directly responsible and the directly responsible persons shall be given administrative sanctions; if the act constitutes a crime, the judicial authorities shall pursue criminal liability according to law.
对国家行政机关工作人员的行政处分，按照干部管理权限和规定程序办理。
Administrative sanctions against state administrative staff members shall be handled in accordance with the authority and procedures for personnel management.
国家行政机关工作人员在公务活动中向华侨和香港、澳门、台湾地区的居民赠送礼品和接受其礼品，依照本规定执行。
The giving and receiving of gifts by state administrative staff members to or from residents of overseas Chinese, Hong Kong, Macao, and Taiwan regions in official activities shall be handled in accordance with these Provisions.
本规定由国务院办公厅负责解释。
These Provisions shall be interpreted by the General Office of the State Council.
本规定自发布之日起施行。
These Provisions shall come into force as of the date of promulgation.
