(Promulgated by Decree No. 303 of the State Council of the People's Republic of China on April 21, 2001, and revised in accordance with the Decision of the State Council on Repealing and Amending Certain Administrative Regulations on January 8, 2011)
为了建立和完善全国统一、公平竞争、规范有序的市场体系，禁止市场经济活动中的地区封锁行为，破除地方保护，维护社会主义市场经济秩序，制定本规定。
These Provisions are formulated to establish and improve a national unified, fair competition, standardized and orderly market system, to prohibit regional blockade behaviors in market economic activities, to eliminate local protectionism, and to maintain the order of the socialist market economy.
各级人民政府及其所属部门负有消除地区封锁、保护公平竞争的责任，应当为建立和完善全国统一、公平竞争、规范有序的市场体系创造良好的环境和条件。
People's governments at all levels and their subordinate departments bear the responsibility of eliminating regional blockades and protecting fair competition, and shall create a favorable environment and conditions for establishing and improving a national unified, fair competition, standardized and orderly market system.
禁止各种形式的地区封锁行为。
All forms of regional blockade behaviors are prohibited.
禁止任何单位或者个人违反法律、行政法规和国务院的规定，以任何方式阻挠、干预外地产品或者工程建设类服务(以下简称服务)进入本地市场，或者对阻挠、干预外地产品或者服务进入本地市场的行为纵容、包庇，限制公平竞争。
No unit or individual may, in violation of laws, administrative regulations, and provisions of the State Council, in any way obstruct or interfere with the entry of products from other regions or construction engineering services (hereinafter referred to as services) into the local market, or connive at or cover up such obstruction or interference, thereby restricting fair competition.
地方各级人民政府及其所属部门(包括被授权或者委托行使行政权的组织，下同)不得违反法律、行政法规和国务院的规定，实行下列地区封锁行为：
Local people's governments at all levels and their subordinate departments (including organizations authorized or entrusted to exercise administrative powers, the same below) shall not, in violation of laws, administrative regulations, and provisions of the State Council, implement the following regional blockade behaviors:
(一)以任何方式限定、变相限定单位或者个人只能经营、购买、使用本地生产的产品或者只能接受本地企业、指定企业、其他经济组织或者个人提供的服务；
(1) In any way, limiting or implicitly limiting units or individuals to only operate, purchase, or use locally produced products or only accept services provided by local enterprises, designated enterprises, other economic organizations, or individuals;
(二)在道路、车站、港口、航空港或者本行政区域边界设置关卡，阻碍外地产品进入或者本地产品运出；
(2) Setting up checkpoints on roads, at stations, ports, airports, or at the boundaries of their administrative regions to obstruct the entry of products from other regions or the exit of local products;
(三)对外地产品或者服务设定歧视性收费项目、规定歧视性价格，或者实行歧视性收费标准；
(3) Imposing discriminatory fee items, setting discriminatory prices, or implementing discriminatory fee standards for products or services from other regions;
(四)对外地产品或者服务采取与本地同类产品或者服务不同的技术要求、检验标准，或者对外地产品或者服务采取重复检验、重复认证等歧视性技术措施，限制外地产品或者服务进入本地市场；
(4) Adopting different technical requirements or inspection standards for products or services from other regions compared to similar local products or services, or adopting discriminatory technical measures such as repeated inspections or repeated certifications for products or services from other regions, thereby restricting the entry of such products or services into the local market;
(五)采取专门针对外地产品或者服务的专营、专卖、审批、许可等手段，实行歧视性待遇，限制外地产品或者服务进入本地市场；
(5) Using means such as exclusive dealing, monopoly, approval, or licensing specifically targeting products or services from other regions, implementing discriminatory treatment, and restricting the entry of such products or services into the local market;
(六)通过设定歧视性资质要求、评审标准或者不依法发布信息等方式限制或者排斥外地企业、其他经济组织或者个人参加本地的招投标活动；
(6) Restricting or excluding enterprises, other economic organizations, or individuals from other regions from participating in local bidding activities by setting discriminatory qualification requirements, evaluation standards, or failing to publish information in accordance with the law;
(七)以采取同本地企业、其他经济组织或者个人不平等的待遇等方式，限制或者排斥外地企业、其他经济组织或者个人在本地投资或者设立分支机构，或者对外地企业、其他经济组织或者个人在本地的投资或者设立的分支机构实行歧视性待遇，侵害其合法权益；
(7) Restricting or excluding enterprises, other economic organizations, or individuals from other regions from investing or establishing branches locally by adopting unequal treatment compared to local enterprises, other economic organizations, or individuals, or implementing discriminatory treatment against such investments or branches, thereby infringing upon their legitimate rights and interests;
(八)实行地区封锁的其他行为。
(8) Other acts of regional blockade.
任何地方不得制定实行地区封锁或者含有地区封锁内容的规定，妨碍建立和完善全国统一、公平竞争、规范有序的市场体系，损害公平竞争环境。
No locality may formulate provisions that implement regional blockades or contain regional blockade content, thereby hindering the establishment and improvement of a national unified, fair competition, standardized and orderly market system and damaging the fair competition environment.
地方各级人民政府所属部门的规定属于实行地区封锁或者含有地区封锁内容的，由本级人民政府改变或者撤销；本级人民政府不予改变或者撤销的，由上一级人民政府改变或者撤销。
If provisions of a department subordinate to a local people's government implement regional blockades or contain regional blockade content, the local people's government at the same level shall modify or repeal them; if the local people's government at the same level fails to modify or repeal them, the people's government at the next higher level shall modify or repeal them.
省、自治区、直辖市以下地方各级人民政府的规定属于实行地区封锁或者含有地区封锁内容的，由上一级人民政府改变或者撤销；上一级人民政府不予改变或者撤销的，由省、自治区、直辖市人民政府改变或者撤销。
If provisions of a local people's government below the level of province, autonomous region, or municipality directly under the Central Government implement regional blockades or contain regional blockade content, the people's government at the next higher level shall modify or repeal them; if the people's government at the next higher level fails to modify or repeal them, the people's government of the province, autonomous region, or municipality directly under the Central Government shall modify or repeal them.
省、自治区、直辖市人民政府的规定属于实行地区封锁或者含有地区封锁内容的，由国务院改变或者撤销。
If provisions of a people's government of a province, autonomous region, or municipality directly under the Central Government implement regional blockades or contain regional blockade content, the State Council shall modify or repeal them.
地方各级人民政府或者其所属部门设置地区封锁的规定或者含有地区封锁内容的规定，是以国务院所属部门不适当的规定为依据的，由国务院改变或者撤销该部门不适当的规定。
If provisions of a local people's government or its subordinate department that set regional blockades or contain regional blockade content are based on inappropriate provisions of a department under the State Council, the State Council shall modify or repeal such inappropriate provisions of that department.
以任何方式限定、变相限定单位或者个人只能经营、购买、使用本地生产的产品或者只能接受本地企业、指定企业、其他经济组织或者个人提供的服务的，由省、自治区、直辖市人民政府组织经济贸易管理部门、工商行政管理部门查处，撤销限定措施。
Where any unit or individual is limited or implicitly limited to only operate, purchase, or use locally produced products or only accept services provided by local enterprises, designated enterprises, other economic organizations, or individuals, the people's government of the province, autonomous region, or municipality directly under the Central Government shall organize the economic and trade administrative department and the administrative department for industry and commerce to investigate and handle the case, and revoke the restrictive measures.
在道路、车站、港口、航空港或者在本行政区域边界设置关卡，阻碍外地产品进入和本地产品运出的，由省、自治区、直辖市人民政府组织经济贸易管理部门、公安部门和交通部门查处，撤销关卡。
Where checkpoints are set up on roads, at stations, ports, airports, or at the boundaries of an administrative region to obstruct the entry of products from other regions or the exit of local products, the people's government of the province, autonomous region, or municipality directly under the Central Government shall organize the economic and trade administrative department, the public security department, and the transportation department to investigate and handle the case, and remove the checkpoints.
对外地产品或者服务设定歧视性收费项目、规定歧视性价格，或者实行歧视性收费标准的，由省、自治区、直辖市人民政府组织财政部门和价格部门查处，撤销歧视性收费项目、价格或者收费标准。
Where discriminatory fee items are imposed, discriminatory prices are set, or discriminatory fee standards are implemented for products or services from other regions, the people's government of the province, autonomous region, or municipality directly under the Central Government shall organize the financial department and the price department to investigate and handle the case, and revoke the discriminatory fee items, prices, or fee standards.
对外地产品或者服务采取和本地同类产品或者服务不同的技术要求、检验标准，或者对外地产品或者服务采取重复检验、重复认证等歧视性技术措施，限制外地产品或者服务进入本地市场的，由省、自治区、直辖市人民政府组织质量技术监督部门查处，撤销歧视性技术措施。
Where different technical requirements or inspection standards are adopted for products or services from other regions compared to similar local products or services, or discriminatory technical measures such as repeated inspections or repeated certifications are adopted for products or services from other regions, thereby restricting the entry of such products or services into the local market, the people's government of the province, autonomous region, or municipality directly under the Central Government shall organize the quality and technical supervision department to investigate and handle the case, and revoke the discriminatory technical measures.
采取专门针对外地产品或者服务的专营、专卖、审批、许可等手段，实行歧视性待遇，限制外地产品或者服务进入本地市场的，由省、自治区、直辖市人民政府组织经济贸易管理部门、工商行政管理部门、质量技术监督部门和其他有关主管部门查处，撤销歧视性待遇。
Where means such as exclusive dealing, monopoly, approval, or licensing specifically targeting products or services from other regions are used to implement discriminatory treatment and restrict the entry of such products or services into the local market, the people's government of the province, autonomous region, or municipality directly under the Central Government shall organize the economic and trade administrative department, the administrative department for industry and commerce, the quality and technical supervision department, and other relevant competent departments to investigate and handle the case, and revoke the discriminatory treatment.
通过设定歧视性资质要求、评审标准或者不依法发布信息等方式，限制或者排斥外地企业、其他经济组织或者个人参加本地的招投标活动的，由省、自治区、直辖市人民政府组织有关主管部门查处，消除障碍。
Where enterprises, other economic organizations, or individuals from other regions are restricted or excluded from participating in local bidding activities by setting discriminatory qualification requirements, evaluation standards, or failing to publish information in accordance with the law, the people's government of the province, autonomous region, or municipality directly under the Central Government shall organize the relevant competent departments to investigate and handle the case, and remove the obstacles.
以采取同本地企业、其他经济组织或者个人不平等的待遇等方式，限制或者排斥外地企业、其他经济组织或者个人在本地投资或者设立分支机构，或者对外地企业、其他经济组织或者个人在本地的投资或者设立的分支机构实行歧视性待遇的，由省、自治区、直辖市人民政府组织经济贸易管理部门、工商行政管理部门查处，消除障碍。
Where any entity restricts or excludes foreign enterprises, other economic organizations, or individuals from investing or establishing branches locally, or imposes discriminatory treatment on their investments or branches, by means such as unequal treatment compared to local enterprises, other economic organizations, or individuals, the people's government of the province, autonomous region, or municipality directly under the Central Government shall organize the economic and trade administrative department and the administrative department for industry and commerce to investigate and eliminate the obstacles.
实行本规定第四条第(一)项至第(七)项所列行为以外的其他地区封锁行为的，由省、自治区、直辖市人民政府组织经济贸易管理部门、工商行政管理部门、质量技术监督部门和其他有关主管部门查处，消除地区封锁。
Where any regional blockade act other than those listed in Article 4, items (1) to (7) is committed, the people's government of the province, autonomous region, or municipality directly under the Central Government shall organize the economic and trade administrative department, the administrative department for industry and commerce, the quality and technical supervision department, and other relevant competent departments to investigate and eliminate the regional blockade.
省、自治区、直辖市人民政府依照本规定第十条至第十七条的规定组织所属有关部门对地区封锁行为进行查处，处理决定由省、自治区、直辖市人民政府作出；必要时，国务院经济贸易管理部门、国务院工商行政管理部门、国务院质量监督检验检疫部门或者国务院其他有关部门可以对涉及省、自治区、直辖市人民政府的地区封锁行为进行查处。
The people's government of the province, autonomous region, or municipality directly under the Central Government shall, in accordance with Articles 10 to 17 of these Provisions, organize its relevant departments to investigate regional blockade acts, and the decision on handling shall be made by the people's government of the province, autonomous region, or municipality directly under the Central Government; when necessary, the economic and trade administrative department of the State Council, the administrative department for industry and commerce of the State Council, the quality supervision, inspection and quarantine department of the State Council, or other relevant departments of the State Council may investigate regional blockade acts involving the people's government of the province, autonomous region, or municipality directly under the Central Government.
地方各级人民政府及其所属部门不得以任何名义、方式阻挠、干预依照本规定对地区封锁行为进行的查处工作。
Local people's governments at all levels and their subordinate departments shall not, in any name or manner, obstruct or interfere with the investigation of regional blockade acts conducted in accordance with these Provisions.
地区封锁行为属于根据地方人民政府或者其所属部门的规定实行的，除依照本规定第十条至第十七条的规定查处、消除地区封锁外，并应当依照本规定第六条至第九条的规定，对有关规定予以改变或者撤销。
Where a regional blockade act is implemented based on provisions of a local people's government or its subordinate departments, in addition to investigating and eliminating the regional blockade in accordance with Articles 10 to 17 of these Provisions, the relevant provisions shall be changed or revoked in accordance with Articles 6 to 9 of these Provisions.
任何单位和个人均有权对地区封锁行为进行抵制，并向有关省、自治区、直辖市人民政府或者其经济贸易管理部门、工商行政管理部门、质量技术监督部门或者其他有关部门直至国务院经济贸易管理部门、国务院工商行政管理部门、国务院质量监督检验检疫部门或者国务院其他有关部门检举。
Any unit or individual has the right to resist regional blockade acts and to report to the relevant people's government of the province, autonomous region, or municipality directly under the Central Government, or its economic and trade administrative department, administrative department for industry and commerce, quality and technical supervision department, or other relevant departments, or even to the economic and trade administrative department of the State Council, the administrative department for industry and commerce of the State Council, the quality supervision, inspection and quarantine department of the State Council, or other relevant departments of the State Council.
有关省、自治区、直辖市人民政府或者其经济贸易管理部门、工商行政管理部门、质量技术监督部门或者其他有关部门接到检举后，应当自接到检举之日起5个工作日内，由省、自治区、直辖市人民政府责成有关地方人民政府在30个工作日内调查、处理完毕，或者由省、自治区、直辖市人民政府在30个工作日内依照本规定直接调查、处理完毕；特殊情况下，调查、处理时间可以适当延长，但延长的时间不得超过30个工作日。
After receiving a report, the relevant people's government of the province, autonomous region, or municipality directly under the Central Government, or its economic and trade administrative department, administrative department for industry and commerce, quality and technical supervision department, or other relevant departments shall, within 5 working days from the date of receiving the report, have the relevant local people's government complete investigation and handling within 30 working days, or the people's government of the province, autonomous region, or municipality directly under the Central Government shall directly complete investigation and handling within 30 working days in accordance with these Provisions; under special circumstances, the investigation and handling time may be appropriately extended, but the extension shall not exceed 30 working days.
国务院经济贸易管理部门、国务院工商行政管理部门、国务院质量监督检验检疫部门或者国务院其他有关部门接到检举后，应当在5个工作日内，将检举材料转送有关省、自治区、直辖市人民政府。
After receiving a report, the economic and trade administrative department of the State Council, the administrative department for industry and commerce of the State Council, the quality supervision, inspection and quarantine department of the State Council, or other relevant departments of the State Council shall, within 5 working days, transfer the report materials to the relevant people's government of the province, autonomous region, or municipality directly under the Central Government.
接受检举的政府、部门应当为检举人保密。对检举有功的单位和个人，应当给予奖励。
The government or department that receives the report shall keep the reporter confidential. Units and individuals that have rendered meritorious service in reporting shall be rewarded.
对地方人民政府或者其所属部门违反本规定，实行地区封锁的，纵容、包庇地区封锁的，或者阻挠、干预查处地区封锁的，由省、自治区、直辖市人民政府给予通报批评；省、自治区、直辖市人民政府违反本规定，实行地区封锁的，纵容、包庇地区封锁的，或者阻挠、干预查处地区封锁的，由国务院给予通报批评。对直接负责的主管人员和其他直接责任人员，按照法定程序，根据情节轻重，给予降级或者撤职的行政处分；构成犯罪的，依法追究刑事责任。
Where a local people's government or its subordinate department violates these Provisions by implementing a regional blockade, conniving at or covering up a regional blockade, or obstructing or interfering with the investigation of a regional blockade, the people's government of the province, autonomous region, or municipality directly under the Central Government shall give a notice of criticism; where the people's government of the province, autonomous region, or municipality directly under the Central Government violates these Provisions by implementing a regional blockade, conniving at or covering up a regional blockade, or obstructing or interfering with the investigation of a regional blockade, the State Council shall give a notice of criticism. The directly responsible person in charge and other directly responsible persons shall, in accordance with legal procedures and depending on the severity of the circumstances, be given administrative sanctions of demotion or removal from office; if a crime is constituted, criminal liability shall be pursued according to law.
地方人民政府或者其所属部门违反本规定，制定实行地区封锁或者含有地区封锁内容的规定的，除依照本规定第六条至第九条的规定对有关规定予以改变或者撤销外，对该地方人民政府或者其所属部门的主要负责人和签署该规定的负责人，按照法定程序，根据情节轻重，给予降级或者撤职的行政处分。
Where a local people's government or its subordinate department violates these Provisions by formulating provisions that implement a regional blockade or contain regional blockade content, in addition to changing or revoking the relevant provisions in accordance with Articles 6 to 9 of these Provisions, the principal responsible person of the local people's government or its subordinate department and the responsible person who signed the provisions shall, in accordance with legal procedures and depending on the severity of the circumstances, be given administrative sanctions of demotion or removal from office.
接到检举地区封锁行为的政府或者有关部门，不在规定期限内进行调查、处理或者泄露检举人情况的，对直接负责的主管人员和其他直接责任人员，按照法定程序，根据情节轻重，给予降级、撤职直至开除公职的行政处分。
Where the government or relevant department that receives a report of a regional blockade act fails to investigate and handle it within the prescribed time limit or discloses the identity of the reporter, the directly responsible person in charge and other directly responsible persons shall, in accordance with legal procedures and depending on the severity of the circumstances, be given administrative sanctions of demotion, removal from office, or even dismissal from public employment.
采取暴力、威胁等手段，欺行霸市、强买强卖，阻碍外地产品或者服务进入本地市场，构成违反治安管理行为的，由公安机关依照《中华人民共和国治安管理处罚法》的规定予以处罚；构成犯罪的，依法追究刑事责任。
Where anyone uses violence, threats, or other means to engage in market bullying, forced buying or selling, or obstructs the entry of foreign products or services into the local market, constituting a violation of public security administration, the public security organ shall impose penalties in accordance with the Public Security Administration Punishments Law of the People's Republic of China; if a crime is constituted, criminal liability shall be pursued according to law.
经营单位有前款规定行为的，并由工商行政管理部门依法对该经营单位予以处罚，直至责令停产停业、予以查封并吊销其营业执照。
If a business unit commits the acts specified in the preceding paragraph, the administrative department for industry and commerce shall impose penalties on the business unit according to law, up to ordering suspension of production or business, sealing up, and revoking its business license.
地方人民政府或者其所属部门滥用行政权力，实行地区封锁所收取的费用及其他不正当收入，应当返还有关企业、其他经济组织或者个人；无法返还的，由上一级人民政府财政部门予以收缴。
Fees and other improper income collected by a local people's government or its subordinate department through abuse of administrative power to implement a regional blockade shall be returned to the relevant enterprises, other economic organizations, or individuals; if return is impossible, the financial department of the people's government at the next higher level shall confiscate them.
地方人民政府或者其所属部门的工作人员对检举地区封锁行为的单位或者个人进行报复陷害的，按照法定程序，根据情节轻重，给予降级、撤职直至开除公职的行政处分；构成犯罪的，依法追究刑事责任。
Where a staff member of a local people's government or its subordinate department retaliates against a unit or individual that reports a regional blockade act, the staff member shall, in accordance with legal procedures and depending on the severity of the circumstances, be given administrative sanctions of demotion, removal from office, or even dismissal from public employment; if a crime is constituted, criminal liability shall be pursued according to law.
监察机关依照行政监察法的规定，对行政机关及其工作人员的地区封锁行为实施监察。
Supervisory organs shall, in accordance with the Administrative Supervision Law, supervise the regional blockade acts of administrative organs and their staff.
本规定自公布之日起施行。
These Provisions shall come into force as of the date of promulgation.
自本规定施行之日起，地方各级人民政府及其所属部门的规定与本规定相抵触或者部分相抵触的，全部或者相抵触的部分自行失效。
As of the date of implementation of these Provisions, any provisions of local people's governments at all levels and their subordinate departments that conflict with these Provisions, in whole or in part, shall automatically become invalid in whole or in the conflicting part.
依据宪法和有关法律关于地方性法规不得同宪法、法律和行政法规相抵触的规定，自本规定施行之日起，地方性法规同本规定相抵触的，应当执行本规定。
In accordance with the provisions of the Constitution and relevant laws that local regulations shall not conflict with the Constitution, laws, and administrative regulations, as of the date of implementation of these Provisions, where local regulations conflict with these Provisions, these Provisions shall prevail.
