总则
General Provisions
为了贯彻执行国家的价格方针、政策，加强价格管理，保持市场价格的基本稳定，安定人民生活，保障经济体制改革的顺利进行，促进社会主义有计划商品经济的发展，制定本条例。
These Regulations are formulated to implement the state's price guidelines and policies, strengthen price management, maintain basic stability of market prices, stabilize people's lives, ensure the smooth progress of economic system reform, and promote the development of a socialist planned commodity economy.
价格管理应当在保障国家利益的前提下，保护生产者、经营者和消费者的合法经济利益，正确处理中央、地方、部门、企业相互之间的经济利益关系。
Price management shall, under the premise of safeguarding state interests, protect the legitimate economic interests of producers, operators, and consumers, and correctly handle the economic interest relationships among the central government, local governments, departments, and enterprises.
国家对价格管理采取直接管理和间接控制相结合的原则，实行国家定价、国家指导价和市场调节价三种价格形式。
The state adopts the principle of combining direct management with indirect control in price management, implementing three price forms: state-set prices, state-guided prices, and market-regulated prices.
国家对价格工作实行统一领导、分级管理。
The state implements unified leadership and hierarchical management in price work.
各级人民政府物价管理机关(以下简称物价部门)，各级人民政府有关业务主管部门以及企业、事业单位价格管理机构和人员，应当严格遵守国家价格法规和政策，做好价格管理和监督工作。
The price management authorities of people's governments at all levels (hereinafter referred to as price departments), the relevant competent business departments of people's governments at all levels, as well as the price management institutions and personnel of enterprises and institutions, shall strictly abide by the state price regulations and policies and perform price management and supervision work well.
价格的制定和管理
Formulation and Management of Prices
本条例所指的价格包括：
The prices referred to in these Regulations include:
(一)各类商品的价格；
(1) Prices of various commodities;
(二)各种经营性服务的收费标准(以下简称收费标准)。
(2) Fee-charging standards for various operational services (hereinafter referred to as fee-charging standards).
商品价格构成包括生产商品的社会平均成本、税金、利润以及正常的流通费用。
The composition of commodity prices includes the social average cost of production, taxes, profits, and normal circulation expenses.
制定、调整实行国家定价和国家指导价的商品价格，应当接近商品价值，反映供求状况，符合国家政策要求，并且遵循下列原则：
When setting or adjusting commodity prices that are subject to state-set prices or state-guided prices, they shall be close to the commodity value, reflect supply and demand conditions, comply with national policy requirements, and follow the following principles:
(一)各类商品价格应当保持合理的比价关系；
(1) The price ratios among various commodities shall be maintained at a reasonable level;
(二)应当有明确的质量标准或者等级规格标准，实行按质定价；
(2) There shall be clear quality standards or grade specifications, and pricing shall be based on quality;
(三)在减少流通环节、降低流通费用的前提下，实行合理的购销差价、批零差价、地区差价和季节差价。
(3) On the premise of reducing circulation links and lowering circulation costs, reasonable purchase-sale price differentials, wholesale-retail price differentials, regional price differentials, and seasonal price differentials shall be implemented.
国家定价是指由县级以上(含县级，以下同)各级人民政府物价部门、业务主管部门按照国家规定权限制定的商品价格和收费标准。
State-set prices refer to commodity prices and fee-charging standards set by the price departments and competent business authorities of people's governments at or above the county level (including county level, the same below) in accordance with the authority prescribed by the state.
国家指导价是指由县级以上各级人民政府物价部门、业务主管部门按照国家规定权限，通过规定基准价和浮动幅度、差率、利润率、最高限价和最低保护价等，指导企业制定的商品价格和收费标准。
State-guided prices refer to commodity prices and fee-charging standards set by enterprises under the guidance of the price departments and competent business authorities of people's governments at or above the county level, through the prescription of base prices and floating ranges, differential rates, profit rates, maximum prices, minimum protective prices, etc., in accordance with the authority prescribed by the state.
市场调节价是指由生产者、经营者制定的商品价格和收费标准。
Market-adjusted prices refer to commodity prices and fee-charging standards set by producers and operators.
实行国家定价、国家指导价的商品分工管理目录、收费项目分工管理目录，由国家物价部门和国家物价部门授权省、自治区、直辖市人民政府物价部门制定、调整。
The catalogs for the classified management of commodities and fee-charging items subject to state-set prices and state-guided prices shall be formulated and adjusted by the state price department and the price departments of provinces, autonomous regions, and municipalities directly under the Central Government authorized by the state price department.
制定、调整商品价格和收费标准，必须按照国家规定的权限和程序执行。任何地区、部门、单位和个人，都不得超越权限擅自制定、调整商品价格和收费标准。
The formulation and adjustment of commodity prices and service fees must be carried out in accordance with the authority and procedures prescribed by the state. No region, department, unit, or individual may exceed their authority to arbitrarily formulate or adjust commodity prices and service fees.
国务院有关业务主管部门、地方各级人民政府应当掌握市场商品价格信息，通过国营工商企业、物资供销企业、供销社组织货源，参与市场调节，平抑市场商品价格。在市场调节价出现暴涨暴落时，物价部门可以在一定时期内对部分商品价格规定最高限价、最低保护价和提价申报制度。
The relevant competent business departments of the State Council and local people's governments at all levels shall keep abreast of market commodity price information, organize the supply of goods through state-owned industrial and commercial enterprises, material supply and marketing enterprises, and supply and marketing cooperatives, participate in market regulation, and stabilize market commodity prices. When market-regulated prices experience sharp rises or falls, the price control department may, within a certain period, prescribe maximum price limits, minimum protective prices, and a price increase reporting system for some commodities.
物价部门应当对城乡集贸市场和个体工商户的价格加强管理和监督。
The price control department shall strengthen the management and supervision of prices in urban and rural trade markets and of individual industrial and commercial households.
价格管理职责
Price Management Responsibilities
国家物价部门在价格管理方面履行下列职责：
The State Price Control Department shall perform the following duties in price management:
(一)研究拟订国家的价格方针、政策、计划和改革方案，经国务院批准后组织实施；
(1) Research and draft the state's price policies, guidelines, plans, and reform schemes, and organize their implementation after approval by the State Council;
(二)研究拟订价格法规草案；
(2) Research and draft price regulations and rules;
(三)负责全国的价格管理和综合平衡工作；
(3) Be responsible for nationwide price management and comprehensive balance work;
(四)按照价格管理权限，规定商品和收费的作价原则、作价办法，制定、调整分管的商品价格和收费标准，重要的商品价格和收费标准的制定、调整，应当会商国务院有关业务主管部门后报国务院批准；
(4) In accordance with the price management authority, prescribe the pricing principles and methods for commodities and fees, formulate and adjust the prices and fees under its jurisdiction; the formulation and adjustment of important commodity prices and fee standards shall be reported to the State Council for approval after consultation with the relevant competent business departments of the State Council;
(五)指导、监督国务院业务主管部门和省、自治区、直辖市人民政府的价格工作，检查、处理违反价格法规和政策的行为(以下简称价格违法行为)；
(5) Guide and supervise the price work of the competent business departments of the State Council and the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government; inspect and handle acts that violate price regulations and policies (hereinafter referred to as price violations);
(六)协调、处理国务院业务主管部门之间，省、自治区、直辖市之间，国务院业务主管部门与省、自治区、直辖市之间的价格争议；
(6) Coordinate and handle price disputes between business departments under the State Council, between provinces, autonomous regions, and municipalities directly under the Central Government, and between business departments under the State Council and provinces, autonomous regions, and municipalities directly under the Central Government;
(七)建立全国价格信息网络，开展价格信息服务工作；
(7) Establish a national price information network and carry out price information services;
(八)国务院赋予的其他职责。
(8) Other duties assigned by the State Council.
国务院业务主管部门在价格管理方面履行下列职责：
The business departments under the State Council shall perform the following duties in price management:
(一)负责组织、监督本系统、本行业贯彻执行国家的价格方针、政策和法规；
(1) Be responsible for organizing and supervising the implementation of the state's price policies, principles, and regulations within their respective systems and industries;
(二)按照价格管理权限，规定商品和收费的作价原则、作价办法，制定、调整分管的商品价格和收费标准；
(2) In accordance with the price management authority, stipulate the pricing principles and methods for commodities and fees, and formulate and adjust the commodity prices and fee standards under their management;
(三)组织、监督本系统、本行业执行规定的商品价格和收费标准；
(3) Organize and supervise the implementation of prescribed commodity prices and fee standards within their respective systems and industries;
(四)指导本系统、本行业价格工作，协调、处理本系统、本行业内的价格争议，协助物价检查机构查处价格违法行为；
(4) Guide the price work within their respective systems and industries, coordinate and handle price disputes within their respective systems and industries, and assist price inspection agencies in investigating and dealing with illegal pricing acts;
(五)对国家物价部门管理的商品价格和收费标准提供有关资料，提出价格调整方案；
(5) Provide relevant data on commodity prices and fee standards managed by the state price department, and propose price adjustment plans;
(六)建立本系统、本行业的价格信息网络，开展价格信息服务工作。
(6) Establish price information networks within their respective systems and industries, and carry out price information services.
省、自治区、直辖市人民政府物价部门在价格管理方面履行下列职责：
The price departments of the people's governments of provinces, autonomous regions, and directly administered municipalities shall perform the following duties in price management:
(一)贯彻执行国家的价格方针、政策和法规；
(1) Implement the state's price policies, principles, and regulations;
(二)组织、监督有关部门实施国家物价部门和国务院业务主管部门制定的商品价格和收费标准；
(2) Organize and supervise relevant departments to implement the commodity prices and fee standards set by the state price department and the competent business departments of the State Council;
(三)负责本地区的价格管理和综合平衡工作，会同有关部门拟订本地区价格计划草案，经批准后组织实施；
(3) Be responsible for price management and comprehensive balance work in the region, and work with relevant departments to draft the regional price plan, which shall be implemented after approval;
(四)按照价格管理权限，规定商品和收费的作价原则、作价办法，制定、调整分管的商品价格和收费标准，重要的商品价格和收费标准应当报省、自治区、直辖市人民政府批准，并报国家物价部门和国务院有关业务主管部门备案；
(4) In accordance with the scope of price management authority, stipulate the pricing principles and methods for commodities and fees, formulate and adjust the prices and fee standards under their management, and report important commodity prices and fee standards to the people's government of the province, autonomous region, or directly administered municipality for approval, and file them with the state price department and the relevant competent business departments of the State Council;
(五)指导、监督同级业务主管部门、下级人民政府以及本地区内企业、事业单位的价格工作，检查、处理价格违法行为；
(5) Guide and supervise the price work of the competent business departments at the same level, the people's governments at lower levels, and enterprises and institutions within the region, and inspect and handle illegal pricing acts;
(六)协调、处理本地区内的价格争议；
(6) Coordinate and handle price disputes within the region;
(七)建立本地区价格信息网络，开展价格信息服务工作；
(7) Establish a regional price information network and carry out price information services;
(八)省、自治区、直辖市人民政府赋予的其他职责。
(8) Other duties assigned by the people's government of the province, autonomous region, or directly administered municipality.
省、自治区、直辖市人民政府业务主管部门和市、县人民政府的物价部门、业务主管部门的价格管理职责，由省、自治区、直辖市人民政府参照本章的有关条款规定。
The price management duties of the competent business departments of the people's governments of provinces, autonomous regions, and directly administered municipalities, and the price departments and competent business departments of the people's governments of cities and counties, shall be stipulated by the people's governments of provinces, autonomous regions, and directly administered municipalities with reference to the relevant provisions of this chapter.
企业的价格权利和义务
Pricing Rights and Obligations of Enterprises
企业在价格方面享有下列权利：
Enterprises shall enjoy the following rights in terms of pricing:
(一)对实行国家指导价的商品和收费项目，按照有关规定制定商品价格和收费标准；
(1) For commodities and fee items subject to state-guided prices, set commodity prices and fee standards in accordance with relevant regulations;
(二)制定实行市场调节价的商品价格和收费标准；
(2) Set commodity prices and fee standards for commodities and fee items subject to market-adjusted prices;
(三)对经有关部门鉴定确认、物价部门批准实行优质加价的产品，在规定的加价幅度内制定商品价格，按照规定权限确定残损废次商品的处理价格；
(3) For products that have been identified and confirmed by relevant departments and approved by the price authority for premium pricing due to high quality, set commodity prices within the prescribed premium range, and determine the disposal prices for damaged, defective, or substandard goods according to the prescribed authority;
(四)在国家规定期限内制定新产品的试销价格；
(4) Set trial prices for new products within the period prescribed by the state;
(五)对实行国家定价、国家指导价的商品价格和收费标准的制定、调整提出建议。
(5) Propose suggestions regarding the formulation and adjustment of commodity prices and fee standards subject to state-fixed prices and state-guided prices.
企业在价格方面应当履行下列义务：
Enterprises shall fulfill the following obligations in terms of pricing:
(一)遵照执行国家的价格方针、政策和法规，执行国家定价、国家指导价；
(1) Comply with and implement the state's pricing principles, policies, and regulations, and implement state-fixed prices and state-guided prices;
(二)如实上报实行国家定价、国家指导价的商品和收费项目的有关定价资料；
(2) Truthfully report relevant pricing materials for commodities and fee items subject to state-fixed prices and state-guided prices;
(三)服从物价部门的价格管理，接受价格监督检查，如实提供价格检查所必需的成本、帐簿等有关资料；
(3) Submit to the price management of the price authority, accept price supervision and inspection, and truthfully provide the costs, accounts, and other relevant materials necessary for price inspection;
(四)执行物价部门规定的商品价格和收费标准的申报、备案制度；
(4) Implement the declaration and filing system for commodity prices and fee standards as prescribed by the price authority;
(五)零售商业、饮食行业、服务行业等，必须按照规定明码标价。
(5) Retail businesses, catering industries, service industries, etc., must clearly mark prices in accordance with regulations.
事业单位、个体工商户在价格方面的权利和义务，参照本条例第十七条、第十八条的规定执行。
The rights and obligations of institutions and individual industrial and commercial households in terms of price shall be implemented by reference to the provisions of Articles 17 and 18 of these Regulations.
价格监督检查
Price Supervision and Inspection
各级物价部门的物价检查机构，依法行使价格监督检查和处理价格违法行为的职权。对同级人民政府业务主管部门、下级人民政府以及本地区内的企业、事业单位和个体工商户执行价格法规、政策进行监督检查。
The price inspection agencies of price authorities at all levels shall exercise the authority to conduct price supervision and inspection and handle price violations in accordance with the law. They shall supervise and inspect the implementation of price laws, regulations, and policies by the competent business departments of the same level of government, the people's governments at lower levels, and enterprises, institutions, and individual industrial and commercial households within their respective regions.
物价检查机构受上级物价检查机构的业务指导。地方各级物价检查机构主要负责人的任免，应当事前征得上一级物价部门的同意。
Price inspection agencies shall receive professional guidance from higher-level price inspection agencies. The appointment and removal of principal responsible persons of local price inspection agencies at all levels shall be subject to prior consent from the price authority at the next higher level.
物价检查机构应当依靠和发动群众监督检查价格，协同工会和街道办事处组织职工价格监督站和群众价格监督站，开展群众性的价格监督检查活动。
Price inspection agencies shall rely on and mobilize the masses to supervise and inspect prices, and coordinate with trade unions and subdistrict offices to organize employee price supervision stations and mass price supervision stations to carry out mass price supervision and inspection activities.
物价部门要发挥消费者协会监督价格的作用，依法查处消费者协会反映的价格违法行为。
The price authority shall give full play to the role of consumer associations in supervising prices, and investigate and deal with price violations reported by consumer associations in accordance with the law.
群众价格监督组织监督检查的重点，应当是同人民生活关系密切的消费品价格和服务收费标准。
The focus of supervision and inspection by mass price supervision organizations shall be on consumer goods prices and service fee standards that are closely related to people's lives.
群众价格监督人员进行价格监督检查活动时，应当佩带标志，出示价格检查证。
When conducting price supervision and inspection activities, public price supervision personnel shall wear badges and present price inspection certificates.
地方各级人民政府应当加强对价格监督检查工作的领导，组织有关部门和社会有关方面人员定期或者不定期地对价格法规、政策的执行情况进行监督检查。
Local people's governments at all levels shall strengthen leadership over price supervision and inspection work, organizing relevant departments and social personnel to conduct regular or irregular inspections on the implementation of price regulations and policies.
工商行政管理、审计、财政、税务、公安、标准、计量以及银行等部门，应当积极配合物价检查机构做好价格监督检查和处理价格违法行为的工作。
Departments of industry and commerce administration, audit, finance, taxation, public security, standards, metrology, and banks shall actively cooperate with price inspection agencies in conducting price supervision and inspection and handling price violations.
对价格违法行为，任何单位和个人都有权检举揭发。物价检查机构应当为检举者保密，并按规定对检举揭发或者协助查处价格违法行为有功人员给予奖励。
Any unit or individual has the right to report price violations. Price inspection agencies shall keep the reporter confidential and, in accordance with regulations, reward those who have made meritorious contributions in reporting or assisting in the investigation of price violations.
对群众价格监督组织中工作有成绩者，应当按规定给予奖励。
Those who have achieved results in public price supervision organizations shall be rewarded in accordance with regulations.
对检举揭发或者查处价格违法行为者进行打击、报复的，依法追究责任。
Anyone who retaliates against or persecutes those who report or investigate price violations shall be held legally responsible.
物价检查人员必须依法办事。对滥用职权、贪污受贿、徇私舞弊、玩忽职守的，依照国家有关规定给予处分；情节严重，构成犯罪的，由司法机关依法追究刑事责任。
Price inspection personnel must act in accordance with the law. Those who abuse their power, engage in corruption, accept bribes, practice favoritism, or neglect their duties shall be disciplined in accordance with relevant state regulations; if the circumstances are serious and constitute a crime, they shall be investigated for criminal responsibility by the judicial authorities.
罚则
Penalty Provisions
下列行为属于价格违法行为：
The following acts constitute price violations:
(一)不执行国家定价收购、销售商品或者收取费用的；
(1) Failing to implement state pricing when purchasing or selling goods or charging fees;
(二)违反国家指导价的定价原则，制定、调整商品价格或者收费标准的；
(2) Violating the pricing principles of state-guided prices by setting or adjusting commodity prices or fee standards;
(三)抬级抬价、压级压价的；
(3) Raising or lowering prices by grade;
(四)违反规定将计划内生产资料转为计划外高价出售的；
(4) Violating regulations by converting planned production materials into plan-external high-priced sales;
(五)将定量内供应城镇居民的商品按议价销售的；
(5) Selling commodities supplied to urban residents within rationed quantities at negotiated prices;
(六)违反规定层层加价销售商品的；
(6) Violating regulations by adding layers of markup when selling commodities;
(七)自立名目滥收费用的；
(7) Arbitrarily charging fees under fabricated names;
(八)采取以次充好、短尺少秤、降低质量等手段，变相提高商品价格或者收费标准的；
(8) Using means such as passing off inferior goods, short measures, or reducing quality to covertly raise commodity prices or fee standards;
(九)企业之间或者行业组织商定垄断价格的；
(9) Enterprises or industry organizations colluding to set monopoly prices;
(十)不执行提价申报制度的；
(10) Failing to implement the price reporting system;
(十一)不按规定明码标价的；
(11) Failing to clearly mark prices as required;
(十二)泄露国家价格机密的；
(12) Disclosing state price secrets;
(十三)其他违反价格法规、政策的行为。
(13) Other acts violating price regulations or policies.
对有前条行为之一的，物价检查机构应当根据情节按照下列规定处罚：
For any act listed in the preceding article, the price inspection authority shall, based on the circumstances, impose penalties according to the following provisions:
(一)通报批评；
(1) Circulating a notice of criticism;
(二)责令将非法所得退还购买者或者用户；
(2) Ordering the return of illegal gains to the purchaser or user;
(三)不能退还的非法所得由物价检查机构予以没收；
(3) Confiscating illegal gains that cannot be returned by the price inspection authority;
(四)罚款；
(4) Imposing a fine;
(五)提请工商行政管理机关吊销营业执照；
(5) Requesting the administrative authority for industry and commerce to revoke the business license;
(六)对企业、事业单位的直接责任人员和主管人员处以罚款，并可以建议有关部门给予处分。
(6) Imposing fines on the directly responsible persons and supervisory personnel of enterprises or institutions, and may recommend that the relevant departments impose disciplinary sanctions.
以上处罚，可以并处。
The above penalties may be imposed concurrently.
对拒缴非法所得或者罚款的，物价检查机构可以按照有关规定通知其开户银行予以划拨。对没有银行帐户或者银行帐户内无资金的，物价检查机构有权将其商品变卖抵缴。
For those who refuse to pay illegal gains or fines, the price inspection agency may notify their bank to transfer the funds accordingly. If the party has no bank account or insufficient funds, the price inspection agency has the right to sell their goods to cover the amount.
被处罚的单位和个体工商户，其退还或者被收缴的非法所得，应当抵减其结案年度的销售收入或者营业收入。企业、事业单位的罚款应当在自有资金、预算包干经费或者预算外资金中支出。
For the punished entities and individual businesses, the illegal gains that are returned or confiscated shall be deducted from their sales revenue or operating income for the year in which the case is concluded. Fines for enterprises and institutions shall be paid from their own funds, budgeted lump-sum funds, or extra-budgetary funds.
被处罚的单位和个人对处罚决定不服的，可以在收到处罚通知之日起十五日内，向上一级物价检查机构申请复议。上一级物价检查机构应当在收到复议申请之日起三十日内作出复议决定。复议期间，原处罚决定照常执行。申诉人对复议决定不服的，可以在收到复议通知之日起十五日内，向人民法院起诉。
If the punished entity or individual disagrees with the penalty decision, they may apply for reconsideration to the higher-level price inspection agency within 15 days of receiving the penalty notice. The higher-level agency shall make a reconsideration decision within 30 days of receiving the application. During reconsideration, the original penalty decision shall be executed. If the applicant disagrees with the reconsideration decision, they may file a lawsuit with the People's Court within 15 days of receiving the reconsideration notice.
国家物价部门对各级物价检查机构、上级物价检查机构对下级物价检查机构已经生效的处罚决定，如果发现确有错误，有权纠正或者责令重新处理。
If the national price authority or a higher-level price inspection agency finds that a penalty decision made by a lower-level agency is erroneous, it has the right to correct it or order a new handling.
拒绝、阻碍物价检查人员依法执行职务的，由公安机关依照《中华人民共和国治安管理处罚条例》的规定予以处罚；情节严重，构成犯罪的，由司法机关依法追究刑事责任。
Those who refuse or obstruct price inspectors from performing their duties according to law shall be punished by the public security authorities in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; if the circumstances are serious and constitute a crime, criminal liability shall be pursued by the judicial authorities according to law.
各级人民政府物价部门、业务主管部门及其工作人员违反价格管理权限、程序，制定、调整商品价格或者收费标准的，由上级物价部门或者同级物价部门负责纠正，并按干部管理权限追究有关人员的责任。
If price departments of people's governments at all levels, competent business departments, and their staff violate price management authority or procedures in setting or adjusting commodity prices or fee standards, the higher-level price department or the price department at the same level shall correct it and pursue the responsibility of the relevant personnel according to the cadre management authority.
对泄露国家价格机密的，依法追究责任。
Those who disclose state price secrets shall be held accountable according to law.
附则
Supplementary Provisions
对行政性收费、事业性收费，物价部门应当根据国家的价格方针、政策进行管理和监督，并会同有关部门核定收费标准。
For administrative fees and institutional fees, the price department shall manage and supervise according to the state's price policies and guidelines, and shall verify the fee standards together with relevant departments.
在我国境内设立的外商投资企业价格管理按照国家有关规定执行。
Price management for foreign-invested enterprises established within China shall be implemented in accordance with relevant state regulations.
本条例由国家物价局负责解释；施行细则由国家物价局制定。
These Regulations shall be interpreted by the State Price Bureau; the implementing rules shall be formulated by the State Price Bureau.
本条例自发布之日起施行，1982年7月7日国务院发布的《物价管理暂行条例》同时废止。
These Regulations shall come into force as of the date of promulgation, and the Provisional Regulations on Price Control promulgated by the State Council on July 7, 1982 shall be repealed simultaneously.
