一、关于重新组建仲裁机构的原则
I. Principles for Reorganizing Arbitration Institutions
(一)全面、准确地把握《中华人民共和国仲裁法》(以下简称仲裁法)精神，严格依照仲裁法组建。
(1) Comprehensively and accurately grasp the spirit of the Arbitration Law of the People's Republic of China (hereinafter referred to as the Arbitration Law) and strictly reorganize in accordance with the Arbitration Law.
(二)体现全心全意为人民服务的宗旨，保证仲裁能够按照公正、及时的原则解决经济纠纷。
(2) Reflect the purpose of serving the people wholeheartedly and ensure that arbitration can resolve economic disputes in accordance with the principles of fairness and timeliness.
(三)从实际情况出发，根据需要与可能进行组建。
(3) Proceed from actual conditions and reorganize based on necessity and feasibility.
(四)统一认识，加强领导，调动各方面的积极因素，保证仲裁工作平稳过渡。
(4) Unify understanding, strengthen leadership, mobilize positive factors from all sides, and ensure a smooth transition of arbitration work.
二、关于仲裁委员会
II. Regarding Arbitration Committees
(一)依法可以设立仲裁委员会的市只能组建一个统一的仲裁委员会，不得按照不同专业设立专业仲裁委员会或者专业仲裁庭。
(1) A city that may legally establish an arbitration committee may only establish one unified arbitration committee and shall not establish specialized arbitration committees or specialized arbitration tribunals based on different professions.
(二)新组建的仲裁委员会的名称应当规范，一律在仲裁委员会之前冠以仲裁委员会所在市的地名(地名＋仲裁委员会)，如北京仲裁委员会、广州仲裁委员会、深圳仲裁委员会等。
(2) The name of a newly established arbitration committee shall be standardized, and shall always be prefixed with the name of the city where the arbitration committee is located (place name + Arbitration Committee), such as Beijing Arbitration Committee, Guangzhou Arbitration Committee, Shenzhen Arbitration Committee, etc.
(三)仲裁委员会由主任1人、副主任2至4人和委员7至11人组成。其中，驻会专职组成人员1至2人，其他组成人员均为兼职。
(3) An arbitration committee shall consist of 1 chairperson, 2 to 4 vice chairpersons, and 7 to 11 members. Among them, 1 to 2 members shall be full-time resident members, and the other members shall be part-time.
仲裁委员会的组成人员由院校、科研机构、国家机关等方面的专家和有实际工作经验的人员担任。仲裁委员会的组成人员可以是仲裁员，也可以不是仲裁员。
The members of the arbitration committee shall be composed of experts and personnel with practical work experience from institutions of higher learning, scientific research institutions, state organs, and other fields. The members of the arbitration committee may be arbitrators or may not be arbitrators.
第一届仲裁委员会的组成人员，由政府法制、经贸、体改、司法、工商、科技、建设等部门和贸促会、工商联等组织协商推荐，由市人民政府聘任。
The members of the first arbitration committee shall be recommended through consultation by departments such as government legal affairs, economy and trade, system reform, justice, industry and commerce, science and technology, construction, and organizations such as the China Council for the Promotion of International Trade and the Federation of Industry and Commerce, and shall be appointed by the municipal people's government.
(四)仲裁委员会设秘书长1人。秘书长可以由驻会专职组成人员兼任。
(4) The arbitration committee shall have one secretary general. The secretary general may be concurrently held by a full-time member of the committee.
(五)仲裁委员会下设办事机构，负责办理仲裁案件受理、仲裁文书送达、档案管理、仲裁费用的收取与管理等事务。办事机构日常工作由仲裁委员会秘书长负责。
(5) The arbitration committee shall establish an administrative office responsible for handling matters such as acceptance of arbitration cases, service of arbitration documents, file management, and collection and management of arbitration fees. The daily work of the administrative office shall be under the responsibility of the secretary general of the arbitration committee.
办事机构的设置和人员配备应当遵循精简、高效的原则。仲裁委员会设立初期，办事机构不宜配备过多的工作人员。以后随着仲裁工作量的增加，人员可以适当增加。
The establishment and staffing of the administrative office shall follow the principles of simplification and efficiency. In the initial stage of the arbitration committee, the administrative office should not be staffed with too many personnel. Later, as the workload of arbitration increases, the number of personnel may be appropriately increased.
办事机构工作人员应当具备良好的思想品质、业务素质，择优聘用。
Staff of the administrative office shall possess good ideological quality and professional competence, and shall be employed on a merit basis.
三、关于仲裁员
III. Regarding Arbitrators
(一)仲裁委员会不设专职仲裁员。
(1) The arbitration committee shall not have full-time arbitrators.
(二)仲裁员由依法重新组建的仲裁委员会聘任。
(2) Arbitrators shall be appointed by the arbitration committee reorganized in accordance with the law.
仲裁委员会应当主要在本省、自治区、直辖市范围内符合仲裁法第十三条规定的人员中聘任仲裁员。
The arbitration committee shall mainly appoint arbitrators from among persons within the province, autonomous region, or municipality directly under the Central Government who meet the requirements stipulated in Article 13 of the Arbitration Law.
国家公务员及参照实行国家公务员制度的机关工作人员符合仲裁法第十三条规定的条件，并经所在单位同意，可以受聘为仲裁员，但是不得因从事仲裁工作影响本职工作。
National civil servants and staff of organs implementing the national civil servant system who meet the conditions stipulated in Article 13 of the Arbitration Law and have obtained consent from their employing unit may be appointed as arbitrators, but they shall not affect theirmain job due to engaging in arbitration work.
仲裁委员会要按照不同专业设置仲裁员名册。
The arbitration committee shall establish an arbitrator roster according to different specialties.
(三)仲裁员办理仲裁案件，由仲裁委员会依照仲裁规则的规定给付报酬。仲裁员没有办理仲裁案件的，不能取得报酬或者其他费用。
(3) Arbitrators handling arbitration cases shall be paid remuneration by the arbitration committee in accordance with the arbitration rules. Arbitrators who do not handle arbitration cases shall not receive remuneration or other expenses.
四、关于仲裁委员会的编制、经费和用房
IV. Regarding the staffing, funding, and office space of the arbitration committee
仲裁委员会设立初期，其所在地的市人民政府应当参照有关事业单位的规定，解决仲裁委员会的人员编制、经费、用房等。仲裁委员会应当逐步做到自收自支。
In the initial stage of establishment of the arbitration committee, the people's government of the city where it is located shall, with reference to the provisions applicable to public institutions, resolve issues such as staffing, funding, and office space for the arbitration committee. The arbitration committee shall gradually achieve self-financing.
五、关于新组建的仲裁委员会与现有仲裁机构的衔接
V. Regarding the connection between the newly established arbitration committee and existing arbitration institutions
(一)聘任仲裁员、聘用办事机构工作人员，应当优先从现有仲裁机构符合条件的仲裁员、工作人员中考虑。
(1) When appointing arbitrators and hiring office staff, priority shall be given to considering qualified arbitrators and staff from existing arbitration institutions.
(二)当事人在现有仲裁机构依法终止之前达成仲裁协议，在现有仲裁机构依法终止之后又达成补充协议选定新的仲裁委员会的，可以依照仲裁法向重新选定的仲裁委员会申请仲裁；当事人达不成补充协议的，原仲裁协议无效。
(2) If the parties have reached an arbitration agreement before the lawful termination of the existing arbitration institution, and after the lawful termination of the existing arbitration institution, they have reached a supplementary agreement selecting a new arbitration committee, they may apply for arbitration to the newly selected arbitration committee in accordance with the Arbitration Law; if the parties fail to reach a supplementary agreement, the original arbitration agreement shall be invalid.

总则
General Provisions
为了规范本仲裁委员会的行为，保证公正、及时地仲裁经济纠纷，保护当事人的合法权益，根据《中华人民共和国仲裁法》(以下简称仲裁法)，制定本章程。
This charter is formulated in accordance with the Arbitration Law of the People's Republic of China (hereinafter referred to as the Arbitration Law) for the purpose of regulating the conduct of this Arbitration Commission, ensuring fair and timely arbitration of economic disputes, and protecting the lawful rights and interests of the parties.
平等主体的公民、法人和其他组织之间发生合同纠纷和其他财产权益纠纷，可以依法向本仲裁委员会申请仲裁。
Disputes over contracts and other disputes over property rights and interests between citizens, legal persons, and other organizations with equal status may apply for arbitration to this Arbitration Commission in accordance with the law.
本仲裁委员会不受理因劳动争议和农业集体经济组织内部的农业承包合同纠纷提出的仲裁申请。
This Arbitration Commission does not accept arbitration applications for labor disputes and agricultural contract disputes within agricultural collective economic organizations.
本仲裁委员会(以下简称仲裁委员会)会址设在××市。
The seat of this Arbitration Commission (hereinafter referred to as the Arbitration Commission) is located in [City Name].
仲裁委员会
The Arbitration Commission
仲裁委员会由主任1人、副主任2至4人和委员7至11人组成。其中，驻会专职组成人员1至2人，其他组成人员均为兼职。
The Arbitration Commission shall consist of one chairperson, two to four vice chairpersons, and seven to eleven members. Among them, one to two members shall be full-time resident members, and the other members shall be part-time.
仲裁委员会设秘书长1人。秘书长可以由驻会专职组成人员兼任。
The Arbitration Commission shall have one secretary-general. The secretary-general may be concurrently held by a full-time resident member.
仲裁委员会组成人员名单报中国仲裁协会备案。
The list of members of the Arbitration Commission shall be reported to the China Arbitration Association for record.
仲裁委员会每届任期3年。任期届满，更换1/3组成人员。
The term of office of the Arbitration Commission is three years. Upon expiration of the term, one-third of the members shall be replaced.
仲裁委员会任期届满的2个月前，应当完成下届仲裁委员会组成人员的更换；有特殊情况不能完成更换的，应当在任期届满后3个月内完成更换。
Two months before the expiration of the term of the arbitration committee, the replacement of the members of the next arbitration committee shall be completed; if replacement cannot be completed due to special circumstances, it shall be completed within three months after the expiration of the term.
上一届仲裁委员会履行职责到新一届仲裁委员会组成为止。
The previous arbitration committee shall perform its duties until the new arbitration committee is formed.
新一届仲裁委员会组成人员由上一届仲裁委员会主任会议商市人民政府有关部门、商会后提名，由市人民政府聘任。
The members of the new arbitration committee shall be nominated by the chairperson's meeting of the previous arbitration committee after consultation with the relevant municipal government departments and chambers of commerce, and shall be appointed by the municipal people's government.
仲裁委员会会议由主任或者主任委托的副主任主持。每次会议须有2/3以上的组成人员出席，方能举行。修改章程或者对仲裁委员会作出解散决议，须经全体组成人员的2/3以上通过，其他决议须经出席会议组成人员的2/3以上通过。
Meetings of the arbitration committee shall be presided over by the chairperson or a vice chairperson authorized by the chairperson. Each meeting shall be held only if more than two-thirds of the members are present. Amendments to the charter or resolutions to dissolve the arbitration committee shall require approval by more than two-thirds of all members; other resolutions shall require approval by more than two-thirds of the members present at the meeting.
仲裁委员会会议的主要职责是：
The main responsibilities of the arbitration committee meeting are:
(一)审议仲裁委员会的工作方针、工作计划等重要事项，并作出相应的决议；
(1) To review important matters such as the work policy and work plan of the arbitration committee, and make corresponding resolutions;
(二)审议、通过仲裁委员会秘书长提出的年度工作报告和财务报告；
(2) To review and approve the annual work report and financial report submitted by the secretary-general of the arbitration committee;
(三)决定仲裁委员会秘书长、专家咨询机构负责人人选；
(3) To decide on the candidates for the secretary-general of the arbitration committee and the head of the expert advisory body;
(四)审议、通过仲裁委员会办事机构设置方案；
(4) To review and approve the plan for the establishment of the working bodies of the arbitration committee;
(五)决定仲裁员的聘任、解聘和除名；
(5) To decide on the appointment, removal, and expulsion of arbitrators.
(六)仲裁委员会主任担任仲裁员的，决定主任的回避；
(6) Where the chairperson of the arbitration committee serves as an arbitrator, decide on the recusal of the chairperson;
(七)修改仲裁委员会章程；
(7) Amend the charter of the arbitration committee;
(八)决议解散仲裁委员会；
(8) Resolve to dissolve the arbitration committee;
(九)仲裁法、仲裁规则和本章程规定的其他职责。
(9) Other duties as provided by the Arbitration Law, arbitration rules, and this charter.
仲裁委员会主任、副主任和秘书长组成主任会议，在仲裁委员会会议闭会期间，负责仲裁委员会的重要日常工作。
The chairperson, vice chairpersons, and secretary-general of the arbitration committee shall form a chairperson's meeting, which shall be responsible for the important daily work of the arbitration committee when the arbitration committee is not in session.
仲裁委员会可以根据需要设立专家咨询机构，为仲裁委员会和仲裁员提供对疑难问题的咨询意见。
The arbitration committee may, as needed, establish an expert advisory body to provide advisory opinions on difficult issues to the arbitration committee and arbitrators.
专家咨询机构设负责人1人，由仲裁委员会副主任兼任。
The expert advisory body shall have one head, who shall be concurrently held by a vice chairperson of the arbitration committee.
仲裁委员会会议作出解散决议并经市人民政府同意，仲裁委员会应当终止。
If the arbitration committee adopts a resolution for dissolution and obtains the consent of the municipal people's government, the arbitration committee shall terminate.
办事机构
Administrative Office
仲裁委员会下设办事机构。办事机构在仲裁委员会秘书长领导下负责处理仲裁委员会的日常工作。
The arbitration committee shall establish an administrative office. The administrative office shall be responsible for handling the daily work of the arbitration committee under the leadership of the secretary-general.
办事机构的主要职责是：
The main duties of the administrative office are:
(一)具体办理仲裁案件受理、仲裁文书送达、档案管理等程序性事务；
(1) Specifically handling procedural matters such as accepting arbitration cases, serving arbitration documents, and managing archives;
(二)收取和管理仲裁费用；
(2) Collecting and managing arbitration fees;
(三)办理仲裁委员会交办的其他事务。
(3) Handling other affairs assigned by the arbitration commission.
办事机构工作人员，由仲裁委员会主任会议决定聘用。
Staff of the administrative office shall be employed by decision of the chairperson's meeting of the arbitration commission.
仲裁员
Arbitrators
仲裁员名单由仲裁委员会主任会议提出，经仲裁委员会会议审议通过后，由仲裁委员会聘任，发给聘书。
The list of arbitrators shall be proposed by the chairperson's meeting of the arbitration commission, reviewed and approved by the arbitration commission meeting, and then appointed by the arbitration commission with a letter of appointment.
仲裁员的聘任期为3年，期满可以继续聘任。
The term of appointment for arbitrators is 3 years, and may be renewed upon expiration.
仲裁委员会按照不同专业设立仲裁员名册。
The arbitration commission shall establish an arbitrator roster based on different specialties.
仲裁员名册报中国仲裁协会备案。
The arbitrator roster shall be filed with the China Arbitration Association for record.
仲裁员应当严格遵守仲裁规则的规定，保证当事人行使仲裁规则规定的权利。
Arbitrators shall strictly comply with the provisions of the arbitration rules and ensure that the parties exercise the rights provided for in the arbitration rules.
仲裁员应当平等对待双方当事人，不得代表或者偏袒任何一方当事人。
Arbitrators shall treat both parties equally and shall not represent or favor any party.
仲裁员接受案件后，应当认真、详细审阅当事人提交的全部证据和材料，做好审理的准备工作。
After accepting a case, arbitrators shall carefully and thoroughly review all evidence and materials submitted by the parties and make preparations for the hearing.
仲裁员开庭审理仲裁案件的，应当充分听取双方当事人的陈述，认真查明事实。
When conducting a hearing in an arbitration case, arbitrators shall fully listen to the statements of both parties and diligently ascertain the facts.
仲裁员经仲裁庭或者仲裁委员会同意会见当事人、代理人，应当在仲裁委员会办公地点进行；未经仲裁庭或者仲裁委员会同意的，仲裁员不得私自会见任何一方当事人、代理人，不得单独接受一方当事人、代理人提供的证据、材料或者与一方当事人、代理人交谈有关仲裁案件的情况。
If an arbitrator meets with a party or its representative with the consent of the arbitration tribunal or the arbitration commission, the meeting shall take place at the office of the arbitration commission; without such consent, the arbitrator shall not privately meet with any party or its representative, shall not separately accept evidence or materials provided by a party or its representative, or discuss matters related to the arbitration case with a party or its representative.
仲裁员应当在案件审理终结后及时进行合议，并按规定制作仲裁裁决书。
Arbitrators shall promptly conduct deliberations after the conclusion of the case hearing and prepare the arbitration award in accordance with the regulations.
仲裁员应当严格保守仲裁秘密，不得对外界透露案件审理过程、仲裁庭合议情况、案件涉及的商业秘密等内容。
Arbitrators shall strictly maintain the confidentiality of arbitration and shall not disclose to outsiders the process of the case hearing, the deliberations of the arbitration tribunal, or the trade secrets involved in the case.
仲裁员有下列情形之一的，仲裁委员会应当予以解聘：
The arbitration commission shall dismiss an arbitrator under any of the following circumstances:
(一)隐瞒应当回避的情形，对案件审理产生不良影响的；
(1) Concealing circumstances that should lead to withdrawal, which adversely affects the hearing of the case;
(二)无正当理由不到庭审理案件的；
(2) Failing to appear at the hearing without justifiable reasons;
(三)有不宜继续担任仲裁员的其他情形的。
(3) There are other circumstances that make the person unsuitable to continue serving as an arbitrator.
仲裁员私自会见当事人、代理人，或者接受当事人、代理人的请客送礼，或者在仲裁案件时有索贿受贿，徇私舞弊，枉法裁决行为的，应当依法承担法律责任，仲裁委员会应当将其除名。
If an arbitrator privately meets with a party or agent, accepts gifts or entertainment from a party or agent, or engages in bribery, malpractice, or perversion of justice in arbitrating a case, the arbitrator shall bear legal liability accordingly, and the arbitration commission shall expel the arbitrator.
财务
Finance
仲裁委员会的财务实行独立核算。
The finance of an arbitration commission shall be independently accounted.
仲裁委员会的经费来源是：
The funding sources of an arbitration commission are:
(一)政府的资助；
(1) Government subsidies;
(二)当事人交纳的仲裁费；
(2) Arbitration fees paid by the parties;
(三)其他合法收入。
(3) Other lawful income.
仲裁委员会终止，应当对财产进行清算。清算后，剩余财产归国家所有。
When an arbitration commission is terminated, its property shall be liquidated. After liquidation, the remaining property shall belong to the state.
附则
Supplementary Provisions
本章程由仲裁委员会负责解释。
This charter shall be interpreted by the Arbitration Committee.
本章程自市人民政府批准之日起生效。
This charter shall come into effect on the date of approval by the Municipal People's Government.

Model Text of Provisional Arbitration Rules of the Arbitration Committee
总则
General Provisions
为了保证公正、及时地仲裁经济纠纷，保护当事人的合法权益，根据《中华人民共和国仲裁法》(以下简称仲裁法)和《中华人民共和国民事诉讼法》(以下简称民事诉讼法)的有关规定，制定本暂行规则。
These provisional rules are formulated in accordance with the relevant provisions of the Arbitration Law of the People's Republic of China (hereinafter referred to as the Arbitration Law) and the Civil Procedure Law of the People's Republic of China (hereinafter referred to as the Civil Procedure Law) to ensure fair and timely arbitration of economic disputes and to protect the legitimate rights and interests of the parties.
平等主体的公民、法人和其他组织之间发生合同纠纷和其他财产权益纠纷，可以依法向本仲裁委员会申请仲裁。
Disputes over contracts and other disputes over property rights and interests between citizens, legal persons, and other organizations with equal status may apply for arbitration to this Arbitration Committee in accordance with the law.
本仲裁委员会不受理因劳动争议和农业集体经济组织内部的农业承包合同纠纷提出的仲裁申请。
This Arbitration Committee shall not accept arbitration applications for labor disputes and agricultural contract disputes within agricultural collective economic organizations.
当事人采用仲裁方式解决纠纷，应当双方自愿，达成仲裁协议。没有仲裁协议，一方申请仲裁的，本仲裁委员会不予受理。
The parties shall voluntarily reach an arbitration agreement to resolve disputes through arbitration. If there is no arbitration agreement and one party applies for arbitration, this Arbitration Committee shall not accept the case.
仲裁协议包括合同中订立的仲裁条款和以其他书面方式在纠纷发生前或者纠纷发生后达成的请求仲裁的协议。
Arbitration agreements include arbitration clauses stipulated in contracts and agreements to request arbitration reached in other written forms before or after the dispute arises.
仲裁协议应当具有下列内容：
An arbitration agreement shall contain the following content:
(一)请求仲裁的意思表示；
(1) An expression of intention to request arbitration;
(二)仲裁事项；
(2) Matters subject to arbitration;
(三)选定本仲裁委员会的意思表示。
(3) An expression of intention to select this Arbitration Commission.
仲裁协议独立存在，合同的变更、解除、终止或者无效，不影响仲裁协议的效力。
An arbitration agreement shall exist independently. The modification, rescission, termination or invalidity of the contract shall not affect the validity of the arbitration agreement.
仲裁庭有权确认合同的效力。
The arbitral tribunal has the power to confirm the validity of the contract.
当事人对仲裁协议的效力有异议的，可以请求本仲裁委员会作出决定或者请求人民法院作出裁定。一方请求本仲裁委员会作出决定，另一方请求人民法院作出裁定的，由人民法院裁定。
If a party challenges the validity of the arbitration agreement, it may request this Arbitration Commission to make a decision or request a people's court to make a ruling. If one party requests this Arbitration Commission to make a decision and the other party requests a people's court to make a ruling, the people's court shall make the ruling.
当事人对仲裁协议的效力有异议，应当在仲裁庭首次开庭前提出；当事人协议不开庭的，应当在首次提交答辩书前提出。
A party's challenge to the validity of the arbitration agreement shall be raised before the first hearing of the arbitral tribunal; if the parties agree not to hold a hearing, it shall be raised before the first submission of the statement of defense.
申请和受理
Application and Acceptance
当事人申请仲裁应当符合下列条件：
A party applying for arbitration shall meet the following conditions:
(一)有仲裁协议；
(1) There is an arbitration agreement;
(二)有具体的仲裁请求和事实、理由；
(2) There is a specific arbitration request and facts and reasons;
(三)属于本仲裁委员会的受理范围。
(3) The matter falls within the scope of acceptance of this arbitration commission.
申请人申请仲裁，应当向本仲裁委员会递交仲裁协议、仲裁申请书及副本。
When applying for arbitration, the applicant shall submit to this arbitration commission the arbitration agreement, the arbitration application, and copies thereof.
仲裁申请书应当载明下列事项：
The arbitration application shall specify the following matters:
(一)申请人和被申请人的姓名、性别、年龄、职业、工作单位和住所，法人或者其他组织的名称、住所和法定代表人或者主要负责人的姓名、职务；
(1) The name, gender, age, occupation, work unit, and domicile of the applicant and the respondent, and if a legal person or other organization, its name, domicile, and the name and position of its legal representative or principal responsible person;
(二)仲裁请求和所根据的事实、理由；
(2) The arbitration request and the facts and reasons on which it is based;
(三)证据和证据来源、证人姓名和住所。
(3) The evidence and the source of evidence, and the names and domiciles of witnesses.
本仲裁委员会收到仲裁申请书之日起5日内，认为符合受理条件的，应当受理，并通知当事人，也可以当即受理，并通知当事人；认为不符合受理条件的，应当书面通知当事人不予受理，并说明理由。
Within 5 days from the date of receipt of the arbitration application, if this arbitration commission considers that the conditions for acceptance are met, it shall accept the case and notify the parties; it may also accept the case immediately and notify the parties. If it considers that the conditions for acceptance are not met, it shall notify the parties in writing of the rejection and state the reasons.
本仲裁委员会收到仲裁申请书后，认为仲裁申请书不符合本暂行规则第九条规定的，可以要求当事人限期补正；逾期不补正的，视为未申请。
After receiving the arbitration application, if this arbitration commission considers that the arbitration application does not comply with the provisions of Article 9 of these Interim Rules, it may require the parties to make corrections within a specified time limit; if the corrections are not made within the time limit, the application shall be deemed not to have been filed.
本仲裁委员会受理仲裁申请后，应当在15日内将本暂行规则和仲裁员名册送达申请人，并将仲裁申请书副本和暂行规则、仲裁员名册送达被申请人。
After accepting an arbitration application, this Arbitration Commission shall, within 15 days, deliver these Provisional Rules and the roster of arbitrators to the applicant, and serve a copy of the arbitration application, the Provisional Rules, and the roster of arbitrators to the respondent.
被申请人收到仲裁申请书副本后，应当在15日内向仲裁委员会提交答辩书。仲裁委员会收到答辩书后，应当在15日内将答辩书副本送达申请人。被申请人未提交答辩书的，不影响仲裁程序的进行。
After receiving the copy of the arbitration application, the respondent shall submit a statement of defense to the Arbitration Commission within 15 days. After receiving the statement of defense, the Arbitration Commission shall, within 15 days, serve a copy of the statement of defense to the applicant. Failure by the respondent to submit a statement of defense shall not affect the conduct of the arbitration proceedings.
申请人可以放弃或者变更仲裁请求。被申请人可以承认或者反驳仲裁请求，有权提出反请求。
The applicant may waive or amend its arbitration claims. The respondent may accept or rebut the arbitration claims and has the right to file counterclaims.
本仲裁委员会应当在收到被申请人提出反请求申请书之日起15日内，将反请求申请书副本送达申请人。
This Arbitration Commission shall, within 15 days from the date of receiving the application for counterclaim filed by the respondent, serve a copy of the counterclaim application to the applicant.
申请人应当自收到反请求申请书之日起15日内向本仲裁委员会提出书面答辩；未提出书面答辩的，不影响仲裁程序的进行。
The applicant shall submit a written defense to this Arbitration Commission within 15 days from the date of receiving the copy of the counterclaim application; failure to submit a written defense shall not affect the conduct of the arbitration proceedings.
一方当事人因另一方当事人的行为或者其他原因，可能使裁决不能执行或者难以执行的，可以申请财产保全。
If, due to the conduct of the other party or other reasons, an award may be impossible or difficult to enforce, a party may apply for property preservation.
当事人申请财产保全的，本仲裁委员会应当将当事人的申请依照民事诉讼法的有关规定提交人民法院。
If a party applies for property preservation, this Arbitration Commission shall submit the party's application to the people's court in accordance with the relevant provisions of the Civil Procedure Law.
申请有错误的，申请人应当赔偿被申请人因财产保全遭受的损失。
If the application is erroneous, the applicant shall compensate the respondent for losses suffered due to the property preservation.
当事人、法定代理人可以委托律师和其他代理人进行仲裁活动。委托律师和其他代理人进行仲裁活动的，应当向本仲裁委员会提交授权委托书。
Parties and their legal representatives may appoint lawyers and other agents to conduct arbitration activities. To appoint lawyers and other agents for arbitration activities, a power of attorney shall be submitted to this Arbitration Commission.
仲裁庭的组成
Formation of the Arbitral Tribunal
仲裁庭可以由3名仲裁员或者1名仲裁员组成。由3名仲裁员组成的，设首席仲裁员。
An arbitration tribunal may be composed of three arbitrators or a single arbitrator. Where it is composed of three arbitrators, a presiding arbitrator shall be appointed.
当事人约定由3名仲裁员组成仲裁庭的，应当各自选定或者各自委托本仲裁委员会主任指定1名仲裁员，第三名仲裁员由当事人共同选定或者共同委托本仲裁委员会主任指定。第三名仲裁员是首席仲裁员。
If the parties agree to have the arbitration tribunal composed of three arbitrators, each party shall select or entrust the chairman of this arbitration commission to appoint one arbitrator. The third arbitrator shall be selected jointly by the parties or jointly entrusted to the chairman of this arbitration commission for appointment. The third arbitrator shall be the presiding arbitrator.
当事人约定由1名仲裁员成立仲裁庭的，应当由当事人共同选定或者共同委托本仲裁委员会主任指定仲裁员。
If the parties agree to have the arbitration tribunal composed of a single arbitrator, the arbitrator shall be selected jointly by the parties or jointly entrusted to the chairman of this arbitration commission for appointment.
当事人自收到受理仲裁通知之日起15日内没有约定仲裁庭的组成方式或者选定仲裁员的，由本仲裁委员会主任指定。
If the parties fail to agree on the method of composition of the arbitration tribunal or to select the arbitrators within 15 days from the date of receiving the notice of arbitration, the chairman of this arbitration commission shall make the appointment.
仲裁庭组成后，本仲裁委员会应当自仲裁庭组成之日起5日内，将仲裁庭的组成情况书面通知当事人，也可以在仲裁庭组成当日将仲裁庭的组成情况书面通知当事人。
After the arbitration tribunal is formed, this arbitration commission shall notify the parties in writing of the composition of the arbitration tribunal within 5 days from the date of its formation, or may notify the parties in writing of the composition on the date of formation.
仲裁员有下列情形之一的，必须回避，当事人也有权提出回避申请：
An arbitrator must withdraw from the case under any of the following circumstances, and the parties also have the right to apply for withdrawal:
(一)是本案当事人或者当事人、代理人的近亲属；
(1) The arbitrator is a party to the case or a close relative of a party or agent;
(二)与本案有利害关系；
(2) The arbitrator has an interest in the case;
(三)与本案当事人、代理人有其他关系，可能影响公正仲裁的；
(3) The arbitrator has another relationship with a party or agent that may affect impartial arbitration;
(四)私自会见当事人、代理人，或者接受当事人、代理人的请客送礼的。
(4) The arbitrator has privately met with a party or agent, or accepted gifts or entertainment from a party or agent.
当事人提出回避申请，应当说明理由，在首次开庭前提出。回避事由在首次开庭后知道的，可以在最后一次开庭终结前提出。
A party that applies for the withdrawal of an arbitrator shall state the reasons and submit the application before the first hearing. If the grounds for withdrawal become known after the first hearing, the application may be submitted before the conclusion of the last hearing.
仲裁员是否回避，由本仲裁委员会主任决定；仲裁委员会主任担任仲裁员时，由本仲裁委员会会议决定。
Whether an arbitrator shall withdraw shall be decided by the chairman of the arbitration commission; if the chairman of the arbitration commission serves as an arbitrator, the decision shall be made by the meeting of the arbitration commission.
仲裁员因回避或者其他原因不能履行职责的，应当依照仲裁法和本暂行规则的规定重新选定或者指定仲裁员。
If an arbitrator is unable to perform his duties due to withdrawal or other reasons, a substitute arbitrator shall be selected or appointed in accordance with the Arbitration Law and these Interim Rules.
因回避而重新选定或者指定仲裁员后，当事人可以请求已进行的仲裁程序重新进行，是否准许，由仲裁庭决定；仲裁庭也可以自行决定已进行的仲裁程序是否重新进行。
After a substitute arbitrator is selected or appointed due to withdrawal, the parties may request that the arbitration proceedings already conducted be repeated; whether to allow such repetition shall be decided by the arbitral tribunal. The arbitral tribunal may also decide on its own whether to repeat the proceedings already conducted.
仲裁员私自会见当事人、代理人，或者接受当事人、代理人请客送礼，情节严重的，或者仲裁员在仲裁案件时有索贿受贿，徇私舞弊，枉法裁决行为的，应当依法承担法律责任，本仲裁委员会应当将其除名。
If an arbitrator privately meets with a party or agent, or accepts gifts or entertainment from a party or agent, and the circumstances are serious, or if an arbitrator engages in bribery, malpractice for personal gain, or perversion of the law in rendering an award during the arbitration of a case, he shall bear legal liability accordingly, and the arbitration commission shall expel him.
开庭和裁决
Hearing and Award
仲裁应当开庭进行。当事人协议不开庭的，仲裁庭可以根据仲裁申请书、答辩书以及其他材料作出裁决。
Arbitration shall be conducted by oral hearing. If the parties agree not to hold an oral hearing, the arbitral tribunal may render an award based on the application for arbitration, the statement of defense, and other materials.
仲裁不公开进行。当事人协议公开的，可以公开进行，但是涉及国家秘密的除外。
Arbitration shall not be conducted in public. If the parties agree to hold a public hearing, the hearing may be public, except where state secrets are involved.
仲裁委员会应当在仲裁庭开庭10日前将开庭日期通知双方当事人；双方当事人经商仲裁庭同意，可以提前开庭。当事人有正当理由的，可以在开庭前7日内请求延期开庭；是否延期，由仲裁庭决定。
The arbitration commission shall notify both parties of the hearing date at least 10 days before the hearing. With the consent of the arbitral tribunal, the parties may agree to hold the hearing earlier. If a party has a valid reason, it may request a postponement of the hearing within 7 days before the hearing; whether to postpone shall be decided by the arbitral tribunal.
申请人经书面通知，无正当理由不到庭或者未经仲裁庭许可中途退庭的，可以视为撤回仲裁申请。
If the claimant, after being notified in writing, fails to appear before the tribunal without valid reason or leaves the hearing without the permission of the arbitral tribunal, the application for arbitration may be deemed withdrawn.
被申请人经书面通知，无正当理由不到庭或者未经仲裁庭许可中途退庭的，可以缺席裁决。
If the respondent, after being served with a written notice, fails to appear before the arbitral tribunal without justifiable reasons, or leaves the hearing midway without the tribunal's permission, the tribunal may make an award by default.
当事人应当对自己的主张提供证据。
Each party shall provide evidence in support of its own claims.
仲裁庭认为有必要收集的证据，可以自行收集。
The arbitral tribunal may collect evidence on its own if it considers such evidence necessary.
书证应当提交原件。物证应当提交原物。提交原件或者原物确有困难的，可以提交复制品、照片、副本、节录本。
Documentary evidence shall be submitted in the original. Physical evidence shall be submitted in its original form. If it is truly difficult to submit the original or original form, copies, photographs, duplicates, or excerpts may be submitted.
提交外文书证，应当附有中文译本。
If foreign language documentary evidence is submitted, a Chinese translation shall be attached.
仲裁庭对专门性问题认为需要鉴定的，可以交由当事人约定的鉴定部门鉴定，也可以由仲裁庭指定的鉴定部门鉴定。
If the arbitral tribunal considers that an expert appraisal is necessary for a specialized issue, it may refer the matter to an appraisal institution agreed upon by the parties, or to an appraisal institution designated by the tribunal.
根据当事人的请求或者仲裁庭的要求，鉴定部门应当派鉴定人参加开庭。当事人经仲裁庭许可，可以向鉴定人提问。
Upon the request of a party or the requirement of the arbitral tribunal, the appraisal institution shall send an appraiser to attend the hearing. With the permission of the tribunal, the parties may question the appraiser.
证据应当在开庭时出示，当事人可以互相质证。
Evidence shall be presented during the hearing, and the parties may cross-examine each other's evidence.
在证据可能灭失或者以后难以取得的情况下，当事人可以申请证据保全。当事人申请证据保全的，本仲裁委员会应当将当事人的申请提交证据所在地的基层人民法院。
If evidence is likely to be destroyed or become difficult to obtain later, a party may apply for evidence preservation. When a party applies for evidence preservation, this arbitration commission shall submit the party's application to the basic people's court at the place where the evidence is located.
当事人在仲裁过程中有权进行辩论。辩论终结时，首席仲裁员或者独任仲裁员应当征询当事人的最后意见。
The parties have the right to debate during the arbitration proceedings. At the conclusion of the debate, the presiding arbitrator or the sole arbitrator shall solicit the parties' final opinions.
仲裁庭应当将开庭情况记入笔录。当事人和其他仲裁参与人认为对自己陈述的记录有遗漏或者差错的，有权申请补正；如果不予补正，应当记录该申请。
The arbitration tribunal shall record the hearing in writing. If a party or other participant in the arbitration considers that there is an omission or error in the record of their own statements, they have the right to apply for correction; if the correction is not made, the application shall be recorded.
笔录由仲裁员、记录人员、当事人和其他仲裁参与人签名或者盖章。
The record shall be signed or sealed by the arbitrators, the recorder, the parties, and other participants in the arbitration.
当事人申请仲裁后，可以自行和解。达成和解协议的，可以请求仲裁庭根据和解协议作出裁决书，也可以撤回仲裁申请。
After applying for arbitration, the parties may reach a settlement on their own. If a settlement agreement is reached, they may request the arbitration tribunal to render an award based on the settlement agreement, or they may withdraw the arbitration application.
当事人达成和解协议，撤回仲裁申请后反悔的，可以根据仲裁协议申请仲裁。
If a party withdraws the arbitration application after reaching a settlement agreement and later retracts, they may apply for arbitration again in accordance with the arbitration agreement.
仲裁庭在作出裁决前，可以先行调解。当事人自愿调解的，仲裁庭应当调解。调解不成的，仲裁庭应当及时作出裁决。
Before rendering an award, the arbitration tribunal may conduct mediation first. If the parties voluntarily mediate, the arbitration tribunal shall mediate. If mediation fails, the arbitration tribunal shall render an award promptly.
调解达成协议的，仲裁庭应当制作调解书或者根据协议的结果制作裁决书。调解书与裁决书具有同等法律效力。
If a mediation agreement is reached, the arbitration tribunal shall prepare a mediation statement or render an award based on the result of the agreement. The mediation statement and the award have equal legal effect.
调解书应当写明仲裁请求和当事人协议的结果。调解书由仲裁员签名，加盖本仲裁委员会印章，送达双方当事人。
The mediation statement shall state the arbitration claims and the result agreed upon by the parties. The mediation statement shall be signed by the arbitrators, sealed with the seal of the arbitration commission, and served to both parties.
调解书经双方当事人签收后，即发生法律效力。
The mediation statement becomes legally effective upon receipt and signature by both parties.
在调解书签收前当事人反悔的，仲裁庭应当及时作出裁决。
If a party retracts before signing the mediation statement, the arbitration tribunal shall render an award promptly.
裁决应当按照多数仲裁员的意见作出，少数仲裁员的不同意见可以记入笔录。仲裁庭不能形成多数意见时，裁决应当按照首席仲裁员的意见作出。
The award shall be made in accordance with the opinion of the majority of the arbitrators, and the dissenting opinion of a minority of arbitrators may be recorded in the record. If the arbitration tribunal cannot form a majority opinion, the award shall be made in accordance with the opinion of the chief arbitrator.
仲裁庭仲裁纠纷时，其中一部分事实已经清楚，可以就该部分先行裁决。
When an arbitration tribunal arbitrates a dispute, if part of the facts are already clear, it may render an award on that part first.
仲裁庭应当在仲裁庭组成后4个月内作出仲裁裁决。有特殊情况需要延长的，由首席仲裁员或者独任仲裁员报经本仲裁委员会主任批准，可以适当延长。
The arbitration tribunal shall render an arbitration award within four months after the tribunal is constituted. If an extension is necessary due to special circumstances, the presiding arbitrator or the sole arbitrator may report to the director of the arbitration commission for approval to extend the time appropriately.
裁决书应当写明仲裁请求、争议事实、裁决理由、裁决结果、仲裁费用的负担和裁决日期。
The award document shall state the arbitration claims, the facts of the dispute, the reasons for the award, the result of the award, the allocation of arbitration costs, and the date of the award.
当事人协议不愿写明争议事实和裁决理由的，可以不写。
If the parties agree not to state the facts of the dispute and the reasons for the award, they may be omitted.
裁决书由仲裁员签名。对裁决持不同意见的仲裁员，可以签名，也可以不签名。
The award document shall be signed by the arbitrators. An arbitrator who disagrees with the award may sign or not sign.
裁决书经仲裁员签名后，仲裁委员会应当加盖本仲裁委员会印章。
After the award document is signed by the arbitrators, the arbitration commission shall affix its seal to the award document.
裁决书自作出之日起发生法律效力。
The award document shall become legally effective from the date it is made.
对裁决书中的文字、计算错误或者对仲裁庭已经裁决但在裁决书中遗漏的事项，仲裁庭应当补正；当事人自收到裁决书之日起30日内，可以请求仲裁庭补正。
If there are typographical or calculation errors in the award document, or if matters that have been decided by the arbitration tribunal are omitted from the award document, the arbitration tribunal shall correct them; within 30 days from the date of receipt of the award document, a party may request the arbitration tribunal to make corrections.
当事人提出证据证明裁决有下列情形之一的，可以自收到仲裁裁决书之日起6个月内向本仲裁委员会所在地的中级人民法院申请撤销裁决：
If a party provides evidence that the award falls under any of the following circumstances, it may apply to the intermediate people's court at the place where the arbitration commission is located to set aside the award within six months from the date of receipt of the arbitration award:
(一)没有仲裁协议的；
(1) There is no arbitration agreement;
(二)裁决的事项不属于仲裁协议的范围或者仲裁委员会无权仲裁的；
(2) The matters decided in the award fall outside the scope of the arbitration agreement or the arbitration commission has no jurisdiction over them;
(三)仲裁庭的组成或者仲裁的程序违反法定程序的；
(3) The composition of the arbitral tribunal or the arbitration procedure was not in accordance with statutory procedures;
(四)裁决所根据的证据是伪造的；
(4) The evidence on which the award is based was forged;
(五)对方当事人隐瞒了足以影响公正裁决的证据的；
(5) The other party concealed evidence sufficient to affect the impartiality of the award;
(六)仲裁员在仲裁该案时有索贿受贿，徇私舞弊，枉法裁决行为的。
(6) The arbitrator(s) engaged in bribery, graft, favoritism, or perverted the law in arbitrating the case.
当事人应当在仲裁裁决书确定的期限内履行裁决。未确定履行期限的，当事人应当立即履行。
The parties shall perform the arbitral award within the time limit specified in the award. If no time limit is specified, the parties shall perform immediately.
一方当事人不履行仲裁裁决的，另一方当事人可以依照民事诉讼法的有关规定向人民法院申请执行。
If one party fails to perform the arbitral award, the other party may apply to the people's court for enforcement in accordance with the relevant provisions of the Civil Procedure Law.
附则
Supplementary Provisions
法律对仲裁时效有规定的，从其规定；法律对仲裁时效没有规定的，适用诉讼时效的规定。
Where the law provides for a limitation period for arbitration, such provisions shall apply; where the law does not provide for a limitation period for arbitration, the limitation period for litigation shall apply.
除当事人另有约定或者仲裁庭另有要求外，仲裁文书、通知、材料可以直接送达当事人、代理人，或者以邮寄、传真、电报等方式送达当事人、代理人。
Unless otherwise agreed by the parties or required by the arbitral tribunal, arbitration documents, notices, and materials may be served directly on the parties or their agents, or served by mail, fax, telegram, or other means.
期间以时、日、月、年计算。期间开始的时和日，不计算在期间内。
Periods shall be calculated by the hour, day, month, and year. The hour and day from which a period begins shall not be counted within the period.
期间届满的最后一日是节假日的，以节假日后的第一日为期间届满的日期。
If the last day of a period falls on a holiday, the day after the holiday shall be regarded as the last day of the period.
期间不包括在途时间，仲裁文书、材料、通知在期满前交邮、交发的，不算过期。
The period shall not include the time in transit. If arbitration documents, materials, or notices are mailed or dispatched before the expiration of the period, they shall not be deemed overdue.
当事人因不可抗拒的事由或者其他正当理由耽误期限的，在障碍消除后的10日内，可以申请顺延期限；是否准许，由本仲裁委员会或者仲裁庭决定。
If a party misses a deadline due to force majeure or other justifiable reasons, it may apply for an extension within 10 days after the obstacle is removed. Whether to grant the extension shall be decided by this Arbitration Commission or the arbitral tribunal.
仲裁员报酬由本仲裁委员会按照仲裁员办理仲裁案件的工作时间、难易程度、争议大小等情况确定。
The remuneration of arbitrators shall be determined by this Arbitration Commission based on factors such as the working time spent by the arbitrator on the arbitration case, the complexity of the case, and the amount in dispute.
仲裁员报酬从本仲裁委员会收取的仲裁案件受理费中支付。
The remuneration of arbitrators shall be paid from the case acceptance fees collected by this Arbitration Commission.
本暂行规则自 年 月 日起生效。
These Provisional Rules shall come into effect on [year] [month] [day].
