总则
General Provisions
为了规范自然灾害救助工作，保障受灾人员基本生活，制定本条例。
These Regulations are formulated to standardize natural disaster relief work and ensure the basic living conditions of affected persons.
自然灾害救助工作遵循以人为本、政府主导、分级管理、社会互助、灾民自救的原则。
Natural disaster relief work shall follow the principles of people-oriented approach, government leadership, hierarchical management, social mutual assistance, and self-rescue by disaster victims.
自然灾害救助工作实行各级人民政府行政领导负责制。
Natural disaster relief work shall implement a system of administrative leadership responsibility of people's governments at all levels.
国家减灾委员会负责组织、领导全国的自然灾害救助工作，协调开展重大自然灾害救助活动。国务院应急管理部门负责全国的自然灾害救助工作，承担国家减灾委员会的具体工作。国务院有关部门按照各自职责做好全国的自然灾害救助相关工作。
The National Disaster Reduction Committee is responsible for organizing and leading national natural disaster relief work and coordinating major natural disaster relief activities. The emergency management department of the State Council is responsible for national natural disaster relief work and undertakes the specific work of the National Disaster Reduction Committee. Relevant departments of the State Council shall perform their respective duties in national natural disaster relief work.
县级以上地方人民政府或者人民政府的自然灾害救助应急综合协调机构，组织、协调本行政区域的自然灾害救助工作。县级以上地方人民政府应急管理部门负责本行政区域的自然灾害救助工作。县级以上地方人民政府有关部门按照各自职责做好本行政区域的自然灾害救助相关工作。
People's governments at or above the county level or their comprehensive coordination bodies for natural disaster relief emergency response shall organize and coordinate natural disaster relief work within their administrative regions. The emergency management departments of local people's governments at or above the county level shall be responsible for natural disaster relief work within their administrative regions. Relevant departments of local people's governments at or above the county level shall perform their respective duties in natural disaster relief work within their administrative regions.
县级以上人民政府应当将自然灾害救助工作纳入国民经济和社会发展规划，建立健全与自然灾害救助需求相适应的资金、物资保障机制，将人民政府安排的自然灾害救助资金和自然灾害救助工作经费纳入财政预算。
People's governments at or above the county level shall incorporate natural disaster relief work into national economic and social development plans, establish and improve funding and material guarantee mechanisms that meet the needs of natural disaster relief, and include the natural disaster relief funds and work expenses arranged by the people's government in the fiscal budget.
村民委员会、居民委员会以及红十字会、慈善会和公募基金会等社会组织，依法协助人民政府开展自然灾害救助工作。
Villagers' committees, residents' committees, and social organizations such as the Red Cross, charitable organizations, and public fundraising foundations shall assist the people's government in carrying out natural disaster relief work in accordance with the law.
国家鼓励和引导单位和个人参与自然灾害救助捐赠、志愿服务等活动。
The State encourages and guides units and individuals to participate in natural disaster relief donations, volunteer services, and other activities.
各级人民政府应当加强防灾减灾宣传教育，提高公民的防灾避险意识和自救互救能力。
People's governments at all levels shall strengthen disaster prevention and mitigation publicity and education to enhance citizens' awareness of disaster prevention and risk avoidance, as well as their ability to self-rescue and mutual rescue.
村民委员会、居民委员会、企业事业单位应当根据所在地人民政府的要求，结合各自的实际情况，开展防灾减灾应急知识的宣传普及活动。
Villagers' committees, residents' committees, enterprises, and institutions shall, in accordance with the requirements of the local people's government and in light of their actual conditions, carry out publicity and popularization activities on disaster prevention and emergency response knowledge.
对在自然灾害救助中作出突出贡献的单位和个人，按照国家有关规定给予表彰和奖励。
Units and individuals that have made outstanding contributions in natural disaster relief shall be commended and rewarded in accordance with relevant state regulations.
救助准备
Relief Preparation
县级以上地方人民政府及其有关部门应当根据有关法律、法规、规章，上级人民政府及其有关部门的应急预案以及本行政区域的自然灾害风险调查情况，制定相应的自然灾害救助应急预案。
Local people's governments at or above the county level and their relevant departments shall formulate corresponding natural disaster relief emergency plans based on relevant laws, regulations, and rules, the emergency plans of the superior people's government and its relevant departments, and the natural disaster risk survey of their administrative region.
自然灾害救助应急预案应当包括下列内容：
Natural disaster relief emergency plans shall include the following contents:
(一)自然灾害救助应急组织指挥体系及其职责；
(1) The organizational command system for natural disaster relief emergency response and its responsibilities;
(二)自然灾害救助应急队伍；
(2) Natural disaster relief emergency response teams;
(三)自然灾害救助应急资金、物资、设备；
(3) Natural disaster relief emergency funds, materials, and equipment;
(四)自然灾害的预警预报和灾情信息的报告、处理；
(4) Early warning and forecasting of natural disasters, and reporting and handling of disaster information;
(五)自然灾害救助应急响应的等级和相应措施；
(5) Levels of natural disaster relief emergency response and corresponding measures;
(六)灾后应急救助和居民住房恢复重建措施。
(6) Post-disaster emergency relief and measures for the restoration and reconstruction of residents' housing.
县级以上人民政府应当建立健全自然灾害救助应急指挥技术支撑系统，并为自然灾害救助工作提供必要的交通、通信等装备。
People's governments at or above the county level shall establish and improve a technical support system for natural disaster relief emergency command, and provide necessary transportation, communication, and other equipment for natural disaster relief work.
国家建立自然灾害救助物资储备制度，由国务院应急管理部门分别会同国务院财政部门、发展改革部门、工业和信息化部门、粮食和物资储备部门制定全国自然灾害救助物资储备规划和储备库规划，并组织实施。其中，由国务院粮食和物资储备部门会同相关部门制定中央救灾物资储备库规划，并组织实施。
The State establishes a natural disaster relief material reserve system. The emergency management department of the State Council, together with the finance department, the development and reform department, the industry and information technology department, and the grain and material reserve department of the State Council, shall formulate national natural disaster relief material reserve plans and reserve warehouse plans, and organize their implementation. 设区的市级以上人民政府和自然灾害多发、易发地区的县级人民政府应当根据自然灾害特点、居民人口数量和分布等情况，按照布局合理、规模适度的原则，设立自然灾害救助物资储备库。
People's governments at or above the city with districts and county-level people's governments in areas prone to frequent natural disasters shall, based on the characteristics of natural disasters, the population size and distribution, and in accordance with the principles of reasonable layout and appropriate scale, establish natural disaster relief material reserve warehouses.
县级以上地方人民政府应当根据当地居民人口数量和分布等情况，利用公园、广场、体育场馆等公共设施，统筹规划设立应急避难场所，并设置明显标志。
Local people's governments at or above the county level shall, based on the local population size and distribution, utilize public facilities such as parks, squares, and sports venues to plan and establish emergency shelters with clear signage.
启动自然灾害预警响应或者应急响应，需要告知居民前往应急避难场所的，县级以上地方人民政府或者人民政府的自然灾害救助应急综合协调机构应当通过广播、电视、手机短信、电子显示屏、互联网等方式，及时公告应急避难场所的具体地址和到达路径。
When a natural disaster warning or emergency response is activated and residents need to be informed to go to emergency shelters, the local people's government at or above the county level or its comprehensive coordination body for natural disaster relief shall promptly announce the specific addresses and routes to the shelters via radio, television, SMS, electronic displays, the internet, or other means.
县级以上地方人民政府应当加强自然灾害救助人员的队伍建设和业务培训，村民委员会、居民委员会和企业事业单位应当设立专职或者兼职的自然灾害信息员。
Local people's governments at or above the county level shall strengthen the team building and professional training of natural disaster relief personnel. Villagers' committees, residents' committees, and enterprises and institutions shall appoint full-time or part-time natural disaster information officers.
应急救助
Emergency Relief
县级以上人民政府或者人民政府的自然灾害救助应急综合协调机构应当根据自然灾害预警预报启动预警响应，采取下列一项或者多项措施：
The people's government at or above the county level or its comprehensive coordination body for natural disaster relief shall, based on natural disaster warnings and forecasts, activate a warning response and take one or more of the following measures:
(一)向社会发布规避自然灾害风险的警告，宣传避险常识和技能，提示公众做好自救互救准备；
(1) Issue warnings to the public about natural disaster risks, publicize knowledge and skills for avoidance, and remind the public to prepare for self-rescue and mutual aid;
(二)开放应急避难场所，疏散、转移易受自然灾害危害的人员和财产，情况紧急时，实行有组织的避险转移；
(2) Open emergency shelters, evacuate and relocate persons and property vulnerable to natural disasters, and in emergencies, conduct organized evacuation;
(三)加强对易受自然灾害危害的乡村、社区以及公共场所的安全保障；
(3) Strengthen safety guarantees for villages, communities, and public places vulnerable to natural disasters;
(四)责成应急管理等部门做好基本生活救助的准备。
(4) Instruct emergency management and other departments to prepare for basic living assistance.
自然灾害发生并达到自然灾害救助应急预案启动条件的，县级以上人民政府或者人民政府的自然灾害救助应急综合协调机构应当及时启动自然灾害救助应急响应，采取下列一项或者多项措施：
When a natural disaster occurs and meets the conditions for activating a natural disaster relief emergency plan, the people's government at or above the county level or its comprehensive coordination body for natural disaster relief shall promptly activate the natural disaster relief emergency response and take one or more of the following measures:
(一)立即向社会发布政府应对措施和公众防范措施；
(1) Immediately release government response measures and public prevention measures to the public;
(二)紧急转移安置受灾人员；
(2) Urgently relocate and resettle affected persons;
(三)紧急调拨、运输自然灾害救助应急资金和物资，及时向受灾人员提供食品、饮用水、衣被、取暖、临时住所、医疗防疫等应急救助，保障受灾人员基本生活；
(3) Urgently allocate and transport natural disaster relief emergency funds and materials, promptly provide affected persons with food, drinking water, clothing, heating, temporary shelter, medical and epidemic prevention, and other emergency assistance to ensure their basic living needs;
(四)抚慰受灾人员，处理遇难人员善后事宜；
(4) Comfort affected persons and handle the aftermath of deceased persons;
(五)组织受灾人员开展自救互救；
(5) Organize affected persons to carry out self-rescue and mutual aid;
(六)分析评估灾情趋势和灾区需求，采取相应的自然灾害救助措施；
(6) Analyze and assess disaster trends and the needs of the affected areas, and take corresponding natural disaster relief measures;
(七)组织自然灾害救助捐赠活动。
(7) Organize natural disaster relief donation activities.
对应急救助物资，各交通运输主管部门应当组织优先运输。
For emergency relief materials, the competent transportation departments at all levels shall organize priority transportation.
在自然灾害救助应急期间，县级以上地方人民政府或者人民政府的自然灾害救助应急综合协调机构可以在本行政区域内紧急征用物资、设备、交通运输工具和场地，自然灾害救助应急工作结束后应当及时归还，并按照国家有关规定给予补偿。
During the period of natural disaster relief emergency, the local people's government at or above the county level or its comprehensive coordination body for natural disaster relief may urgently requisition materials, equipment, means of transportation, and venues within its administrative region. After the emergency relief work ends, they shall promptly return them and provide compensation in accordance with relevant state regulations.
自然灾害造成人员伤亡或者较大财产损失的，受灾地区县级人民政府应急管理部门应当立即向本级人民政府和上一级人民政府应急管理部门报告。
When a natural disaster causes casualties or significant property losses, the emergency management department of the county-level people's government in the affected area shall immediately report to the people's government at the same level and the emergency management department at the next higher level.
自然灾害造成特别重大或者重大人员伤亡、财产损失的，受灾地区县级人民政府应急管理部门应当按照有关法律、行政法规和国务院应急预案规定的程序及时报告，必要时可以直接报告国务院。
When a natural disaster causes particularly significant or major casualties or property losses, the emergency management department of the county-level people's government in the affected area shall promptly report in accordance with the procedures stipulated by relevant laws, administrative regulations, and the State Council's emergency plan, and may directly report to the State Council if necessary.
灾情稳定前，受灾地区人民政府应急管理部门应当每日逐级上报自然灾害造成的人员伤亡、财产损失和自然灾害救助工作动态等情况，并及时向社会发布。
Before the disaster situation stabilizes, the emergency management department of the people's government in the affected area shall report daily, level by level, on the casualties, property losses, and the dynamics of natural disaster relief work, and shall promptly release this information to the public.
灾情稳定后，受灾地区县级以上人民政府或者人民政府的自然灾害救助应急综合协调机构应当评估、核定并发布自然灾害损失情况。
After the disaster situation stabilizes, the people's government at or above the county level in the affected area or its comprehensive coordination body for natural disaster relief shall assess, verify, and release the natural disaster loss situation.
灾后救助
Post-Disaster Assistance
受灾地区人民政府应当在确保安全的前提下，采取就地安置与异地安置、政府安置与自行安置相结合的方式，对受灾人员进行过渡性安置。
The people's government in the affected area shall, under the premise of ensuring safety, adopt a combination of on-site resettlement and off-site resettlement, government resettlement and self-resettlement, to provide transitional resettlement for affected persons.
就地安置应当选择在交通便利、便于恢复生产和生活的地点，并避开可能发生次生自然灾害的区域，尽量不占用或者少占用耕地。
On-site resettlement shall be conducted in locations with convenient transportation, conducive to resuming production and daily life, and avoiding areas prone to secondary natural disasters, and shall try not to occupy or occupy less farmland.
受灾地区人民政府应当鼓励并组织受灾群众自救互救，恢复重建。
The people's government of the affected area shall encourage and organize the affected people to help themselves and each other, and to restore and rebuild.
自然灾害危险消除后，受灾地区人民政府应当统筹研究制订居民住房恢复重建规划和优惠政策，组织重建或者修缮因灾损毁的居民住房，对恢复重建确有困难的家庭予以重点帮扶。
After the natural disaster danger is eliminated, the people's government of the affected area shall comprehensively study and formulate plans and preferential policies for the restoration and reconstruction of residential housing, organize the reconstruction or repair of residential housing damaged by the disaster, and provide key assistance to families that have genuine difficulties in restoration and reconstruction.
居民住房恢复重建应当因地制宜、经济实用，确保房屋建设质量符合防灾减灾要求。
The restoration and reconstruction of residential housing shall be adapted to local conditions, economical and practical, and ensure that the quality of housing construction meets the requirements for disaster prevention and mitigation.
受灾地区人民政府应急管理等部门应当向经审核确认的居民住房恢复重建补助对象发放补助资金和物资，住房城乡建设等部门应当为受灾人员重建或者修缮因灾损毁的居民住房提供必要的技术支持。
The emergency management and other departments of the people's government of the affected area shall distribute subsidy funds and materials to the verified recipients of subsidies for the restoration and reconstruction of residential housing, and the housing and urban-rural construction and other departments shall provide necessary technical support for the affected people to rebuild or repair residential housing damaged by the disaster.
居民住房恢复重建补助对象由受灾人员本人申请或者由村民小组、居民小组提名。经村民委员会、居民委员会民主评议，符合救助条件的，在自然村、社区范围内公示；无异议或者经村民委员会、居民委员会民主评议异议不成立的，由村民委员会、居民委员会将评议意见和有关材料提交乡镇人民政府、街道办事处审核，报县级人民政府应急管理等部门审批。
The recipients of subsidies for the restoration and reconstruction of residential housing shall be applied for by the affected persons themselves or nominated by villager groups or resident groups. After democratic appraisal by the villagers' committee or residents' committee, those who meet the relief conditions shall be publicized within the natural village or community; if there is no objection or if the objection is not established after democratic appraisal by the villagers' committee or residents' committee, the villagers' committee or residents' committee shall submit the appraisal opinions and relevant materials to the township people's government or subdistrict office for review, and then report to the emergency management department of the county people's government for approval.
自然灾害发生后的当年冬季、次年春季，受灾地区人民政府应当为生活困难的受灾人员提供基本生活救助。
In the winter of the year when the natural disaster occurs and the following spring, the people's government of the affected area shall provide basic living assistance to the affected people who have difficulties in life.
受灾地区县级人民政府应急管理部门应当在每年10月底前统计、评估本行政区域受灾人员当年冬季、次年春季的基本生活困难和需求，核实救助对象，编制工作台账，制定救助工作方案，经本级人民政府批准后组织实施，并报上一级人民政府应急管理部门备案。
The emergency management department of the county people's government in the affected area shall, before the end of October each year, count and assess the basic living difficulties and needs of the affected people in its administrative area for the winter of that year and the following spring, verify the recipients of assistance, compile a work ledger, formulate an assistance work plan, organize its implementation after approval by the people's government at the same level, and report it to the emergency management department of the people's government at the next higher level for record.
救助款物管理
Management of Relief Funds and Materials
县级以上人民政府财政部门、应急管理部门负责自然灾害救助资金的分配、管理并监督使用情况。
The finance department and the emergency management department of the people's government at or above the county level shall be responsible for the allocation, management, and supervision of the use of natural disaster relief funds.
县级以上人民政府应急管理部门负责调拨、分配、管理自然灾害救助物资。
The emergency management department of the people's government at or above the county level shall be responsible for the allocation, distribution, and management of natural disaster relief materials.
人民政府采购用于自然灾害救助准备和灾后恢复重建的货物、工程和服务，依照有关政府采购和招标投标的法律规定组织实施。自然灾害应急救助和灾后恢复重建中涉及紧急抢救、紧急转移安置和临时性救助的紧急采购活动，按照国家有关规定执行。
The people's government's procurement of goods, projects, and services for natural disaster relief preparation and post-disaster restoration and reconstruction shall be organized and implemented in accordance with the legal provisions on government procurement and bidding. Emergency procurement activities involving emergency rescue, emergency relocation, and temporary assistance in natural disaster emergency relief and post-disaster restoration and reconstruction shall be carried out in accordance with the relevant provisions of the state.
自然灾害救助款物专款(物)专用，无偿使用。
Natural disaster relief funds and materials shall be used exclusively for their designated purposes and provided free of charge.
定向捐赠的款物，应当按照捐赠人的意愿使用。政府部门接受的捐赠人无指定意向的款物，由县级以上人民政府应急管理部门统筹安排用于自然灾害救助；社会组织接受的捐赠人无指定意向的款物，由社会组织按照有关规定用于自然灾害救助。
Donated funds and materials with designated purposes shall be used in accordance with the donor's wishes. For donated funds and materials accepted by government departments without designated purposes, the emergency management department of the people's government at or above the county level shall make overall arrangements for natural disaster relief; for donated funds and materials accepted by social organizations without designated purposes, the social organizations shall use them for natural disaster relief in accordance with relevant provisions.
自然灾害救助款物应当用于受灾人员的紧急转移安置，基本生活救助，医疗救助，教育、医疗等公共服务设施和住房的恢复重建，自然灾害救助物资的采购、储存和运输，以及因灾遇难人员亲属的抚慰等项支出。
Natural disaster relief funds and materials shall be used for emergency relocation of affected people, basic living assistance, medical assistance, restoration and reconstruction of public service facilities such as education and medical care and housing, procurement, storage and transportation of natural disaster relief materials, and consolation for the relatives of those who died in the disaster.
受灾地区人民政府应急管理、财政等部门和有关社会组织应当通过报刊、广播、电视、互联网，主动向社会公开所接受的自然灾害救助款物和捐赠款物的来源、数量及其使用情况。
The emergency management, finance and other departments of the people's government of the affected area and relevant social organizations shall proactively disclose to the public through newspapers, radio, television, and the internet the sources, quantities, and usage of the natural disaster relief funds and materials and donated funds and materials they have accepted.
受灾地区村民委员会、居民委员会应当公布救助对象及其接受救助款物数额和使用情况。
The villagers' committee or residents' committee of the affected area shall disclose the recipients of assistance and the amounts and usage of relief funds and materials they have received.
各级人民政府应当建立健全自然灾害救助款物和捐赠款物的监督检查制度，并及时受理投诉和举报。
People's governments at all levels shall establish and improve the supervision and inspection system for natural disaster relief funds and materials and donated funds and materials, and shall promptly accept complaints and reports.
县级以上人民政府监察机关、审计机关应当依法对自然灾害救助款物和捐赠款物的管理使用情况进行监督检查，应急管理、财政等部门和有关社会组织应当予以配合。
The supervisory organs and audit organs of the people's government at or above the county level shall, in accordance with the law, supervise and inspect the management and use of natural disaster relief funds and materials and donated funds and materials, and the emergency management, finance and other departments and relevant social organizations shall cooperate.
法律责任
Legal Liability
行政机关工作人员违反本条例规定，有下列行为之一的，由任免机关或者监察机关依照法律法规给予处分；构成犯罪的，依法追究刑事责任：
If a staff member of an administrative organ violates the provisions of these Regulations and commits any of the following acts, the appointing authority or supervisory organ shall impose sanctions in accordance with laws and regulations; if a crime is constituted, criminal liability shall be investigated in accordance with the law:
(一)迟报、谎报、瞒报自然灾害损失情况，造成后果的；
(1) Delaying, falsely reporting, or concealing the loss situation of natural disasters, causing consequences;
(二)未及时组织受灾人员转移安置，或者在提供基本生活救助、组织恢复重建过程中工作不力，造成后果的；
(2) Failing to organize the relocation and resettlement of affected people in a timely manner, or failing to work effectively in the process of providing basic living assistance or organizing restoration and reconstruction, causing consequences;
(三)截留、挪用、私分自然灾害救助款物或者捐赠款物的；
(3) Intercepting, misappropriating, or privately distributing natural disaster relief funds and materials or donated funds and materials;
(四)不及时归还征用的财产，或者不按照规定给予补偿的；
(4) Failing to return expropriated property in a timely manner, or failing to provide compensation in accordance with regulations.
(五)有滥用职权、玩忽职守、徇私舞弊的其他行为的。
(5) Other acts of abuse of power, dereliction of duty, or engaging in malpractice for personal gain.
采取虚报、隐瞒、伪造等手段，骗取自然灾害救助款物或者捐赠款物的，由县级以上人民政府应急管理部门责令限期退回违法所得的款物；构成犯罪的，依法追究刑事责任。
Whoever, by means of false reporting, concealment, forgery, or other means, fraudulently obtains natural disaster relief funds, materials, or donated funds or materials shall be ordered by the emergency management department of the people's government at or above the county level to return the illegally obtained funds and materials within a specified time limit; if a crime is constituted, criminal liability shall be pursued according to law.
抢夺或者聚众哄抢自然灾害救助款物或者捐赠款物的，由县级以上人民政府应急管理部门责令停止违法行为；构成违反治安管理行为的，由公安机关依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
Whoever seizes or gathers a crowd to snatch natural disaster relief funds, materials, or donated funds or materials shall be ordered by the emergency management department of the people's government at or above the county level to cease the illegal act; if the act constitutes a violation of public security administration, the public security organ shall impose a public security administration penalty according to law; if a crime is constituted, criminal liability shall be pursued according to law.
以暴力、威胁方法阻碍自然灾害救助工作人员依法执行职务，构成违反治安管理行为的，由公安机关依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。
Whoever obstructs a natural disaster relief worker from performing duties according to law by means of violence or threat, if the act constitutes a violation of public security administration, the public security organ shall impose a public security administration penalty according to law; if a crime is constituted, criminal liability shall be pursued according to law.
附则
Supplementary Provisions
发生事故灾难、公共卫生事件、社会安全事件等突发事件，需要由县级以上人民政府应急管理部门开展生活救助的，参照本条例执行。
Where an emergency such as an accident disaster, public health event, or social security event occurs and the emergency management department of the people's government at or above the county level needs to carry out livelihood relief, these Regulations shall be applied mutatis mutandis.
法律、行政法规对防灾、抗灾、救灾另有规定的，从其规定。
Where laws or administrative regulations otherwise provide for disaster prevention, resistance, and relief, those provisions shall prevail.
本条例自2010年9月1日起施行。
These Regulations shall come into force as of September 1, 2010.
