National Defense Transportation Regulations

(Promulgated by Decree No. 173 of the State Council of the People's Republic of China and the Central Military Commission of the People's Republic of China on February 24, 1995, and revised in accordance with the Decision of the State Council on Repealing and Amending Certain Administrative Regulations on January 8, 2011)

为了加强国防交通建设，保障战时和特殊情况下国防交通顺畅，制定本条例。

These Regulations are formulated to strengthen national defense transportation construction and ensure smooth national defense transportation during wartime and special circumstances.

在中华人民共和国领域内从事国防交通活动，必须遵守本条例。

All national defense transportation activities conducted within the territory of the People's Republic of China must comply with these Regulations.

本条例所称国防交通，是指为国防建设服务的铁路、道路、水路、航空、管道、邮电通信等交通体系。

For the purposes of these Regulations, 'national defense transportation' refers to the transportation systems serving national defense construction, including railways, roads, waterways, aviation, pipelines, and postal and telecommunications.

国防交通工作实行统一领导、分级负责、全面规划、平战结合的原则。

National defense transportation work shall adhere to the principles of unified leadership, hierarchical responsibility, comprehensive planning, and integration of peacetime and wartime.

各级人民政府、军事机关应当重视国防交通建设，为国防交通工作提供必要条件。

People's governments at all levels and military organs shall attach importance to national defense transportation construction and provide necessary conditions for national defense transportation work.

县级以上人民政府交通管理部门和有关交通企业事业单位，应当做好国防交通工作。

Transportation administrative departments of people's governments at or above the county level and relevant transportation enterprises and institutions shall properly carry out national defense transportation work.

对在国防交通建设中做出重大贡献的单位和个人，各级人民政府、交通管理部门和军事机关应当给予奖励。

Units and individuals that have made significant contributions to national defense transportation construction shall be rewarded by people's governments at all levels, transportation administrative departments, and military organs.

国家国防交通主管机构在国务院、中央军事委员会领导下，负责全国国防交通工作，履行下列职责：

The national defense transportation authority under the State Council and the Central Military Commission is responsible for national defense transportation work nationwide and performs the following duties:

(一)拟订国防交通工作的方针、政策，草拟有关法律、行政法规；

(1) Formulate policies and guidelines for national defense transportation, and draft relevant laws and administrative regulations;

(二)规划全国国防交通网络布局，对国家交通建设提出有关国防要求的建议；

(2) Plan the national defense transportation network layout, and propose suggestions on defense requirements for national transportation construction;

(三)拟订全国国防交通保障计划，为重大军事行动和其他紧急任务组织交通保障；

(3) Formulate national defense transportation support plans, and organize transportation support for major military operations and other emergency tasks;

(四)组织全国国防交通科学技术研究；

(4) Organize national defense transportation science and technology research;

(五)指导检查国防交通工作，协调有关方面的关系；

(5) Guide and inspect national defense transportation work, and coordinate relationships among relevant parties;

(六)国务院、中央军事委员会赋予的其他职责。

(6) Other duties assigned by the State Council and the Central Military Commission.

军区国防交通主管机构和县级以上地方国防交通主管机构负责本地区国防交通工作，履行下列职责：

The military region defense transportation authority and local defense transportation authorities at or above the county level are responsible for regional defense transportation work and perform the following duties:

(一)贯彻执行国家国防交通工作的方针、政策和法律、法规、规章，拟订本地区有关国防交通工作的规定；

(1) Implement national policies, laws, regulations, and rules on defense transportation, and formulate local regulations on defense transportation;

(二)规划本地区国防交通网络布局，对本地区交通建设提出有关国防要求的建议，参加有关交通工程设施的勘察、设计鉴(审)定和竣工验收；

(2) Plan the regional defense transportation network layout, propose suggestions on defense requirements for local transportation construction, and participate in the survey, design review (approval), and completion acceptance of relevant transportation engineering facilities.

(三)拟订本地区国防交通保障计划，组织国防交通保障队伍，为本地区内的军事行动和其他紧急任务组织交通保障；

(3) Formulate local national defense transportation support plans, organize national defense transportation support teams, and provide transportation support for military operations and other emergency tasks within the region;

(四)负责本地区的国防运力动员和运力征用；

(4) Be responsible for the mobilization and requisition of national defense transport capacity within the region;

(五)按照国家有关规定，制定和实施本地区的国防交通物资储备计划，调用国防交通物资；

(5) In accordance with relevant national regulations, formulate and implement plans for the reserve of national defense transportation materials within the region, and deploy national defense transportation materials;

(六)组织本地区国防交通科学技术研究及其成果的推广、应用；

(6) Organize scientific and technological research on national defense transportation within the region and the promotion and application of its achievements;

(七)指导、检查、监督本地区国防交通工作，协调处理有关问题；

(7) Guide, inspect, and supervise national defense transportation work within the region, and coordinate the resolution of related issues;

(八)上级国防交通主管机构和本级人民政府赋予的其他职责。

(8) Other duties assigned by the superior national defense transportation authority and the people's government at the same level.

国务院交通管理部门分别负责本系统的国防交通工作，履行下列职责：

The transportation management departments of the State Council shall respectively be responsible for national defense transportation work within their respective systems and perform the following duties:

(一)贯彻执行国家国防交通工作的方针、政策和法律、法规、规章；

(1) Implement the national guidelines, policies, laws, regulations, and rules concerning national defense transportation;

(二)制定并组织落实本系统的国防交通建设规划和技术规范；

(2) Formulate and organize the implementation of national defense transportation construction plans and technical specifications within their respective systems;

(三)制定本系统的国防交通保障计划，指导国防交通专业保障队伍建设；

(3) Formulate national defense transportation support plans within their respective systems and guide the construction of specialized national defense transportation support teams;

(四)按照国家有关规定，管理和使用本系统的国防交通资产；

(4) Manage and use the national defense transportation assets of this system in accordance with relevant state regulations;

(五)组织本系统国防交通科学技术研究及其成果的推广、应用；

(5) Organize scientific and technological research on national defense transportation within this system and promote and apply its achievements;

(六)指导、检查、监督本系统的国防交通工作，协调处理有关问题。

(6) Guide, inspect, and supervise the national defense transportation work of this system, and coordinate and handle related issues.

承担国防交通任务的交通企业事业单位，在国防交通工作中履行下列职责：

Transportation enterprises and institutions undertaking national defense transportation tasks shall perform the following duties in national defense transportation work:

(一)贯彻执行国家国防交通工作的方针、政策和法律、法规、规章；

(1) Implement the national guidelines, policies, laws, regulations, and rules concerning national defense transportation;

(二)参加有关国防交通工程设施的勘察、设计鉴(审)定和竣工验收；

(2) Participate in the survey, design review (approval), and completion acceptance of relevant national defense transportation engineering facilities;

(三)制定本单位国防交通保障计划，完成国防交通保障任务；

(3) Formulate the national defense transportation support plan of this unit and complete national defense transportation support tasks;

(四)按照国家有关规定，管理和使用本单位的国防交通资产；

(4) Manage and use the national defense transportation assets of this unit in accordance with relevant state regulations;

(五)负责本单位的国防交通专业保障队伍的组织、训练和管理工作。

(5) Be responsible for the organization, training, and management of the national defense transportation professional support team of this unit.

在特殊情况下，省级国防交通主管机构可以提请有关省、自治区、直辖市人民政府决定，由公安机关、港务监督机构分别在自己的职责范围内对局部地区的道路、水路实行交通管制。

Under special circumstances, the provincial-level national defense transportation authority may request the relevant provincial, autonomous region, or municipality people's government to decide that the public security organs and port supervision agencies shall, within their respective responsibilities, implement traffic control on roads and waterways in local areas.

本条例所称国防交通保障计划(以下简称保障计划)，是指保障战时和特殊情况下国防交通顺畅的预定方案，主要包括：国防交通保障的方针、任务，各项国防交通保障工作的技术措施和组织措施。

The term 'national defense transportation support plan' (hereinafter referred to as support plan) as used in these Regulations refers to a predetermined plan to ensure smooth national defense transportation during wartime and special circumstances, mainly including: the guidelines and tasks for national defense transportation support, and the technical and organizational measures for various national defense transportation support tasks.

保障计划分为：全国保障计划、军区保障计划、地区保障计划和专业保障计划。

Support plans are divided into: national support plan, military region support plan, regional support plan, and specialized support plan.

全国保障计划由国家国防交通主管机构组织国务院有关部门和有关军事机关拟订，报国务院、中央军事委员会批准。

The national support plan shall be drafted by the national defense transportation competent authority in conjunction with relevant departments of the State Council and relevant military organs, and submitted to the State Council and the Central Military Commission for approval.

军区保障计划由军区国防交通主管机构组织本地区省、自治区、直辖市人民政府有关部门和有关军事机关拟订，征求国家国防交通主管机构的意见后，报军区批准。

The military region support plan shall be drafted by the military region defense transportation competent authority in conjunction with relevant departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government in the region and relevant military organs, and after soliciting opinions from the national defense transportation competent authority, submitted to the military region for approval.

地区保障计划由县级以上地方国防交通主管机构组织本级人民政府有关部门和有关军事机关拟订，征求上一级国防交通主管机构意见后，报本级人民政府批准。

The regional support plan shall be drafted by the local defense transportation competent authority at or above the county level in conjunction with relevant departments of the people's government at the same level and relevant military organs, and after soliciting opinions from the defense transportation competent authority at the next higher level, submitted to the people's government at the same level for approval.

专业保障计划由国务院交通管理部门在各自的职责范围内分别制定，征求国务院其他有关部门意见后，报国家国防交通主管机构同意。

The specialized support plan shall be formulated separately by the transportation management departments of the State Council within their respective responsibilities, and after soliciting opinions from other relevant departments of the State Council, submitted to the national defense transportation competent authority for consent.

本条例所称国防交通工程设施，是指为保障战时和特殊情况下国防交通顺畅而建造的下列建筑和设备：

The term 'national defense transportation engineering facilities' as used in these Regulations refers to the following buildings and equipment constructed to ensure smooth national defense transportation during wartime and special circumstances:

(一)国家修建的主要为国防建设服务的交通基础设施；

(1) Transportation infrastructure constructed mainly for national defense construction by the state;

(二)专用的指挥、检修、仓储、防护等工程与设施；

(2) Dedicated command, inspection, storage, protection and other engineering facilities;

(三)专用的车辆、船舶、航空器；

(3) Dedicated vehicles, vessels, and aircraft;

(四)国防需要的其他交通工程设施。

(4) Other transportation engineering facilities needed for national defense.

建设国防交通工程设施，应当兼顾经济建设的需要。

The construction of national defense transportation engineering facilities shall take into account the needs of economic construction.

建设其他交通工程设施或者研制重要交通工具，应当兼顾国防建设的需要。

The construction of other transportation engineering facilities or the development of important means of transportation shall take into account the needs of national defense construction.

国防交通主管机构拟订的国防交通建设规划，应当送本级人民政府计划部门和交通管理部门综合平衡。

The national defense transportation construction plan drafted by the national defense transportation authority shall be submitted to the planning department and the transportation management department of the people's government at the same level for comprehensive balancing.

县级以上人民政府计划部门和交通管理部门在制定交通建设规划时，应当征求本级国防交通主管机构的意见，并将已经确定的国防交通工程设施建设项目和需要贯彻国防要求的建设项目，列入交通建设规划。

When formulating transportation construction plans, the planning department and the transportation management department of the people's government at or above the county level shall solicit opinions from the national defense transportation authority at the same level, and shall include the determined national defense transportation engineering facility construction projects and the construction projects that need to implement national defense requirements into the transportation construction plan.

交通建设规划中有关贯彻国防要求的建设项目，必须按照国防要求进行建设。

Construction projects in the transportation construction plan that involve implementing national defense requirements must be constructed in accordance with national defense requirements.

国防交通工程设施建设项目和有关贯彻国防要求的建设项目，其设计鉴(审)定、竣工验收应当经有关的国防交通主管机构同意。

For national defense transportation engineering facility construction projects and related construction projects that implement national defense requirements, their design review (approval) and completion acceptance shall be subject to the consent of the relevant national defense transportation authority.

国防交通工程设施的管理单位，必须加强对国防交通工程设施的维护管理。

The management unit of national defense transportation engineering facilities must strengthen the maintenance and management of national defense transportation engineering facilities.

改变国防交通工程设施的用途或者将其作报废处理的，必须经管理单位的上一级国防交通主管机构批准。

Any change of use or scrapping of national defense transportation engineering facilities must be approved by the next higher level national defense transportation authority of the managing unit.

国家对国防交通工程设施的建设实行优惠政策。具体办法由国家国防交通主管机构会同国务院有关部门制定。

The state implements preferential policies for the construction of national defense transportation engineering facilities. Specific measures shall be formulated by the national defense transportation authority jointly with the relevant departments of the State Council.

土地管理部门和城市规划主管部门，应当将经批准的预定抢建重要国防交通工程设施的土地作为国防交通控制用地，纳入土地利用总体规划和城市规划。

Land management departments and urban planning authorities shall include the land approved for the scheduled emergency construction of important national defense transportation engineering facilities as national defense transportation control land, and incorporate it into the overall land use plan and urban plan.

未经土地管理部门、城市规划主管部门和国防交通主管机构批准，任何单位或者个人不得占用国防交通控制用地。

Without the approval of the land management department, urban planning authority, and national defense transportation authority, no unit or individual may occupy national defense transportation control land.

任何单位或者个人进行生产和其他活动，不得影响国防交通工程设施的正常使用，不得危及国防交通工程设施的安全。

No unit or individual may, in production or other activities, affect the normal use of national defense transportation engineering facilities or endanger the safety of such facilities.

本条例所称国防交通保障队伍，是指战时和特殊情况下执行抢修、抢建、防护国防交通工程设施、抢运国防交通物资和通信保障任务的组织。

For the purposes of these Regulations, national defense transportation support teams refer to organizations that perform tasks of emergency repair, emergency construction, protection of national defense transportation engineering facilities, emergency transportation of national defense transportation materials, and communication support during wartime and under special circumstances.

国防交通保障队伍，分为专业保障队伍和交通沿线保障队伍。

National defense transportation support teams are divided into professional support teams and transportation route support teams.

专业保障队伍，由交通管理部门以本系统交通企业生产单位为基础进行组建；执行交通保障任务时，由国防交通主管机构统一调配。

Professional support teams shall be formed by the transportation management department based on the production units of transportation enterprises within its system; when performing transportation support tasks, they shall be uniformly deployed by the national defense transportation authority.

交通沿线保障队伍，由当地人民政府和有关军事机关负责组织。

Transportation route support teams shall be organized by the local people's government and relevant military authorities.

交通管理部门负责专业保障队伍的训练，战时应当保持专业保障队伍人员稳定。

The transportation management department is responsible for the training of professional support teams, and shall maintain the stability of professional support team personnel during wartime.

有关军事机关负责组织交通沿线保障队伍的专业训练；国防交通主管机构负责提供教材、器材和业务指导。

The relevant military authorities are responsible for organizing the professional training of support teams along transportation lines; the national defense transportation authority is responsible for providing teaching materials, equipment, and operational guidance.

县级以上人民政府及有关部门，对专业保障队伍应当给予必要的扶持。

People's governments at or above the county level and relevant departments shall provide necessary support to professional support teams.

交通保障队伍的车辆、船舶和其他机动设备，应当按照国家国防交通主管机构的规定，设置统一标志；在战时和特殊情况下可以优先通行。

Vehicles, vessels, and other motorized equipment of transportation support teams shall be marked with a unified symbol in accordance with the regulations of the national defense transportation authority; they may be given priority passage during wartime and under special circumstances.

本条例所称运力动员，是指战时国家发布动员令，对任何单位和个人所拥有的运载工具、设备以及操作人员，进行统一组织和调用的活动。

For the purposes of these Regulations, 'transport capacity mobilization' refers to the activity of the state issuing a mobilization order during wartime to uniformly organize and deploy the transport vehicles, equipment, and operating personnel owned by any unit or individual.

本条例所称运力征用，是指在特殊情况下，省、自治区、直辖市人民政府依法采取行政措施，调用单位和个人所拥有的运载工具、设备以及操作人员的活动。

For the purposes of these Regulations, 'transport capacity requisition' refers to the activity of the people's government of a province, autonomous region, or municipality directly under the Central Government taking administrative measures in accordance with the law to call up the transport vehicles, equipment, and operating personnel owned by units or individuals under special circumstances.

县级以上人民政府交通管理部门和其他有关部门应当向国防交通主管机构提供运力注册登记的有关资料。

The transportation management departments and other relevant departments of people's governments at or above the county level shall provide the national defense transportation authority with relevant information on the registration of transport capacity.

战时军队需要使用动员的运力的，应当向所在地的军区国防交通主管机构提出申请。武装警察部队、民兵组织和其他单位需要使用动员的运力的，应当向当地国防交通主管机构提出申请。

If the military needs to use mobilized transport capacity during wartime, it shall submit an application to the national defense transportation authority of the military region where it is located. If the Armed Police Force, militia organizations, or other units need to use mobilized transport capacity, they shall submit an application to the local national defense transportation authority.

动员国务院交通管理部门所属的运力，应当经国务院、中央军事委员会批准。动员地方交通管理部门所属的运力或者社会运力，应当经省、自治区、直辖市人民政府批准。

Mobilization of transport capacity belonging to the transportation management department of the State Council shall be approved by the State Council and the Central Military Commission. Mobilization of transport capacity belonging to local transportation management departments or social transport capacity shall be approved by the people's government of the province, autonomous region, or municipality directly under the Central Government.

在特殊情况下，军队或者其他单位需要使用征用的运力的，应当向当地国防交通主管机构提出申请，由省、自治区、直辖市人民政府批准。

Under special circumstances, if the military or other units need to use requisitioned transport capacity, they shall submit an application to the local defense transportation authority, and approval shall be obtained from the people's government of the province, autonomous region, or municipality directly under the Central Government.

被动员或者被征用运力的单位和个人必须依法履行义务，保证被动员或者被征用的运载工具和设备的技术状况良好，并保证随同的操作人员具有相应的技能。

Units and individuals whose transport capacity is mobilized or requisitioned must perform their obligations according to law, ensure that the mobilized or requisitioned vehicles and equipment are in good technical condition, and ensure that the accompanying operators possess the corresponding skills.

需要对动员或者征用的运载工具、设备作重大改造的，必须经相应的国防交通主管机构批准。

If major modifications need to be made to mobilized or requisitioned vehicles or equipment, approval must be obtained from the corresponding defense transportation authority.

对被动员和被征用运力的操作人员的抚恤优待，按照国家有关规定执行；运载工具、设备的补偿办法另行规定。

The pension and preferential treatment for operators of mobilized and requisitioned transport capacity shall be implemented in accordance with relevant state regulations; compensation methods for vehicles and equipment shall be separately stipulated.

交通管理部门和交通企业应当优先安排军事运输计划，重点保障紧急、重要的军事运输。运输军事人员、装备及其他军用物资，应当迅速准确、安全保密。

Transportation management departments and transportation enterprises shall prioritize military transportation plans and focus on ensuring urgent and important military transportation. The transportation of military personnel, equipment, and other military materials shall be rapid, accurate, safe, and confidential.

地方各级人民政府和有条件的承运单位，应当为实施军事运输的人员提供饮食、住宿和医疗方便。

Local people's governments at all levels and qualified carrier units shall provide food, accommodation, and medical convenience for personnel implementing military transportation.

军队可以在铁路、水路、航空等交通运输单位或其所在地区派驻军事代表，会同有关单位共同完成军事运输和交通保障任务。

The military may station military representatives at railway, waterway, aviation, and other transportation units or in their regions, and work together with relevant units to complete military transportation and transportation support tasks.

国家建立国防交通物资储备制度，保证战时和特殊情况下国防交通顺畅的需要。

The state establishes a national defense transportation material reserve system to ensure the smooth flow of national defense transportation during wartime and under special circumstances.

国防交通物资储备分为国家储备、部门储备和地方储备，分别列入县级以上各级人民政府和有关部门的物资储备计划。

The reserve of national defense transportation materials is divided into state reserve, departmental reserve, and local reserve, which shall be included in the material reserve plans of people's governments at or above the county level and relevant departments respectively.

负责储备国防交通物资的单位，必须对所储备的物资加强维护和管理，不得损坏、丢失。

Units responsible for storing national defense transportation materials must strengthen maintenance and management of the stored materials, and shall not damage or lose them.

未经国防交通主管机构批准，任何单位或者个人不得动用储备的国防交通物资。

Without approval from the competent national defense transportation authority, no unit or individual may use the stored national defense transportation materials.

经批准使用储备的国防交通物资，应当按照规定支付费用。

Those approved to use stored national defense transportation materials shall pay the costs in accordance with regulations.

由地方人民政府或者交通管理部门管理的用作战费、支前费、军费购置的交通保障物资，应当列入国防交通物资储备。

Transportation support materials purchased with war funds, front-support funds, or military funds and managed by local people's governments or transportation administrative departments shall be included in the national defense transportation material reserve.

交通管理部门和交通企业事业单位，应当对本系统、本单位的人员进行国防交通教育。

Transportation administrative departments and transportation enterprises and institutions shall conduct national defense transportation education for their own personnel.

交通运输院校和邮电通信院校，应当在相关课程中设置国防交通的内容。

Transportation and post and telecommunications schools shall include national defense transportation content in relevant courses.

交通管理部门和有关的科研机构，应当加强国防交通科学技术研究。国防交通科学技术研究项目，应当纳入各级科学技术研究规划。

Transportation administrative departments and relevant scientific research institutions shall strengthen scientific and technological research on national defense transportation. National defense transportation science and technology research projects shall be included in scientific research plans at all levels.

违反本条例有关规定，有下列行为之一的，对负有直接责任的主管人员和其他直接责任人员依法给予行政处分；构成犯罪的，依法追究刑事责任：

Whoever, in violation of the relevant provisions of these Regulations, commits any of the following acts shall be given administrative sanctions according to law against the directly responsible supervisors and other directly responsible persons; if a crime is constituted, criminal liability shall be pursued according to law:

(一)应当贯彻国防要求的交通工程设施，在施工过程中没有贯彻国防要求的；

(1) Where a transportation engineering facility that should implement national defense requirements fails to implement national defense requirements during construction;

(二)对国防交通工程设施管理不善，造成损失的，或者擅自改变国防交通工程设施的用途或者擅自作报废处理的；

(2) Where a national defense transportation engineering facility is poorly managed, causing losses, or the use of the national defense transportation engineering facility is changed without authorization, or it is disposed of as scrapped without authorization;

(三)对储备的国防交通物资管理不善，造成损失的；

(3) Where stored national defense transportation materials are poorly managed, causing losses;

(四)未经批准动用储备的国防交通物资的。

(4) Where stored national defense transportation materials are used without approval.

危及国防交通工程设施安全或者侵占国防交通控制用地的，由国防交通主管机构责令停止违法行为，给予警告，可以并处5万元以下的罚款；造成经济损失的，应当依法赔偿。

Whoever endangers the safety of national defense transportation engineering facilities or encroaches on land reserved for national defense transportation control shall be ordered by the national defense transportation competent authority to cease the illegal act, given a warning, and may be concurrently fined not more than 50,000 yuan; if economic losses are caused, compensation shall be made according to law.

逃避或者抗拒运力动员或者运力征用的，由国防交通主管机构给予警告，可以并处相当于被动员或者被征用的运载工具、设备价值2倍以下的罚款。

Whoever evades or resists transportation capacity mobilization or transportation capacity requisition shall be given a warning by the national defense transportation competent authority and may be concurrently fined not more than twice the value of the mobilized or requisitioned means of transport or equipment.

有下列行为之一的，依照《中华人民共和国治安管理处罚法》的有关规定给予处罚；构成犯罪的，依法追究刑事责任：

Whoever commits any of the following acts shall be punished according to the relevant provisions of the Public Security Administration Punishments Law of the People's Republic of China; if a crime is constituted, criminal liability shall be pursued according to law:

(一)扰乱、妨碍军事运输和国防交通保障的；

(1) Disrupting or obstructing military transportation and national defense transportation support;

(二)扰乱、妨碍国防交通工程设施建设的；

(2) Disrupting or obstructing the construction of national defense transportation engineering facilities.

(三)破坏国防交通工程设施的；

(3) Damaging national defense transportation engineering facilities;

(四)盗窃、哄抢国防交通物资的。

(4) Stealing or plundering national defense transportation materials.

国防交通主管机构的工作人员，滥用职权、玩忽职守的，依法给予行政处分；构成犯罪的，依法追究刑事责任。

Staff members of the national defense transportation competent authority who abuse their power or neglect their duties shall be given administrative sanctions according to law; if a crime is constituted, criminal liability shall be pursued according to law.

本条例下列用语的含义：

The meanings of the following terms in these Regulations:

(一)特殊情况，是指局部战争、武装冲突和其他突发事件；

(1) Special circumstances refer to local wars, armed conflicts, and other emergencies;

(二)交通管理部门，是指主管铁路、道路、水路、航空和邮电通信的行业管理部门。

(2) Transportation management departments refer to the industry management departments in charge of railways, roads, waterways, aviation, and postal and telecommunications.

国防交通经费由中央、地方、部门、企业共同承担。具体办法由国家国防交通主管机构会同国务院有关部门制定。

National defense transportation funds shall be jointly borne by the central government, local governments, departments, and enterprises. Specific measures shall be formulated by the national defense transportation competent authority of the state together with the relevant departments of the State Council.

本条例自发布之日起施行。

These Regulations shall come into force as of the date of promulgation.
