Port Inspection Measures of the People's Republic of China

为了加强对国际航行船舶进出中华人民共和国口岸的管理，便利船舶进出口岸，提高口岸效能，制定本办法。
These Measures are formulated to strengthen the management of international navigation vessels entering and leaving the ports of the People's Republic of China, facilitate the entry and exit of vessels, and improve port efficiency.
进出中华人民共和国口岸的国际航行船舶(以下简称船舶)及其所载船员、旅客、货物和其他物品，由本办法第三条规定的机关依照本办法实施检查；但是，法律另有特别规定的，或者国务院另有特别规定的，从其规定。
International navigation vessels (hereinafter referred to as vessels) entering and leaving the ports of the People's Republic of China, as well as their crew, passengers, cargo, and other articles, shall be subject to inspection by the authorities specified in Article 3 of these Measures in accordance with these Measures; however, if laws provide otherwise, or if the State Council provides otherwise, those provisions shall prevail.
中华人民共和国港务监督机构(以下简称港务监督机构)、中华人民共和国海关(以下简称海关)、中华人民共和国出入境边防检查机关是负责对船舶进出中华人民共和国口岸实施检查的机关(以下统称检查机关)。
The Port Superintendency of the People's Republic of China (hereinafter referred to as the Port Superintendency), the Customs of the People's Republic of China (hereinafter referred to as Customs), and the Exit-Entry Border Inspection Authorities of the People's Republic of China are the authorities responsible for inspecting vessels entering and leaving the ports of the People's Republic of China (hereinafter collectively referred to as the inspection authorities).
检查机关依照有关法律、行政法规的规定实施检查并对违法行为进行处理。
The inspection authorities shall conduct inspections in accordance with relevant laws and administrative regulations and shall handle violations of the law.
港务监督机构负责召集有其他检查机关参加的船舶进出口岸检查联席会议，研究、解决船舶进出口岸检查的有关问题。
The Port Superintendency shall convene joint meetings on vessel entry and exit inspection attended by other inspection authorities to study and resolve issues related to vessel entry and exit inspection.
船舶进出中华人民共和国口岸，由船方或其代理人依照本办法有关规定办理进出口岸手续。除本办法第十条第二款、第十一条规定的情形或者其他特殊情形外，检查机关不登船检查。
When a vessel enters or leaves a port of the People's Republic of China, the vessel owner or its agent shall complete the entry and exit formalities in accordance with the relevant provisions of these Measures. Except for the circumstances specified in Article 10, paragraph 2, Article 11, or other special circumstances, the inspection authorities shall not board the vessel for inspection.
船方或其代理人办理船舶进出口岸手续时，应当按照检查机关的有关规定准确填写报表，并如实提供有关证件、资料。
When completing the vessel entry and exit formalities, the vessel owner or its agent shall accurately fill in the forms in accordance with the relevant provisions of the inspection authorities and truthfully provide relevant certificates and materials.
船方或其代理人应当在船舶预计抵达口岸7日前(航程不足7日的，在驶离上一口岸时)，填写《国际航行船舶进口岸申请书》，报请抵达口岸的港务监督机构审批。
The vessel owner or its agent shall, no later than 7 days before the vessel is expected to arrive at the port (if the voyage is less than 7 days, at the time of departure from the previous port), fill in the "Application for Entry of International Navigation Vessel" and submit it to the Port Superintendency at the port of arrival for approval.
拟进入长江水域的船舶，船方或其代理人应当在船舶预计经上海港区7日前(航程不足7日的，在驶离上一口岸时)，填写《国际航行船舶进口岸申请书》，报请抵达口岸的港务监督机构审批。
For vessels intending to enter the Yangtze River waters, the vessel owner or its agent shall, no later than 7 days before the vessel is expected to pass through the Shanghai port area (if the voyage is less than 7 days, at the time of departure from the previous port), fill in the "Application for Entry of International Navigation Vessel" and submit it to the Port Superintendency at the port of arrival for approval.
船方或其代理人应当在船舶预计抵达口岸24小时前(航程不足24小时的，在驶离上一口岸时)，将抵达时间、停泊地点、靠泊移泊计划及船员、旅客的有关情况报告检查机关。
The vessel owner or its agent shall, no later than 24 hours before the vessel is expected to arrive at the port (if the voyage is less than 24 hours, at the time of departure from the previous port), report to the inspection authorities the time of arrival, berthing location, berthing and shifting plans, and information on crew and passengers.
船方或其代理人在船舶抵达口岸前未办妥进口岸手续的，须在船舶抵达口岸24小时内到检查机关办理进口岸手续。
If the shipowner or its agent has not completed the entry formalities before the vessel arrives at the port, they must complete the entry formalities at the inspection authorities within 24 hours of the vessel's arrival at the port.
船舶在口岸停泊时间不足24小时的，经检查机关同意，船方或其代理人在办理进口岸手续时，可以同时办理出口岸手续。
If the vessel's stay at the port is less than 24 hours, with the consent of the inspection authorities, the shipowner or its agent may simultaneously complete the exit formalities when completing the entry formalities.
船方或其代理人在船舶抵达口岸前已经办妥进口岸手续的，船舶抵达后即可上下人员、装卸货物和其他物品。
If the shipowner or its agent has completed the entry formalities before the vessel arrives at the port, personnel may board or disembark, and cargo and other items may be loaded or unloaded immediately after the vessel's arrival.
船方或其代理人在船舶抵达口岸前未办妥进口岸手续的，船舶抵达后，除检查机关办理进口岸检查手续的工作人员和引航员外，其他人员不得上下船舶、不得装卸货物和其他物品；船舶进出的上一口岸是中华人民共和国口岸的，船舶抵达后即可上下人员、装卸货物和其他物品，但是应当立即办理进口岸手续。
If the shipowner or its agent has not completed the entry formalities before the vessel arrives at the port, after the vessel's arrival, except for the inspection authorities' staff conducting entry inspection procedures and the pilot, no other personnel may board or disembark, and no cargo or other items may be loaded or unloaded; if the previous port of departure or arrival is a port of the People's Republic of China, personnel may board or disembark, and cargo and other items may be loaded or unloaded immediately after the vessel's arrival, but the entry formalities must be completed promptly.
海关对船舶实施电讯检疫。持有卫生证书的船舶，其船方或其代理人可以向海关申请电讯检疫。
The customs authority implements telecommunication quarantine for vessels. For vessels holding a sanitary certificate, the shipowner or its agent may apply to the customs authority for telecommunication quarantine.
对来自疫区的船舶，载有检疫传染病染疫人、疑似检疫传染病染疫人、非意外伤害而死亡且死因不明尸体的船舶，未持有卫生证书或者证书过期或者卫生状况不符合要求的船舶，海关应当在锚地实施检疫。
For vessels from epidemic areas, vessels carrying persons infected with quarantinable infectious diseases, persons suspected of being infected with quarantinable infectious diseases, or corpses that died from non-accidental causes with unknown cause of death, vessels without a sanitary certificate or with an expired certificate or with unsanitary conditions, the customs authority shall implement quarantine at the anchorage.
海关对来自动植物疫区的船舶和船舶装载的动植物、动植物产品及其他检疫物，可以在锚地实施检疫。
The customs authority may implement quarantine at the anchorage for vessels from animal or plant epidemic areas and for animals, plants, animal products, plant products, and other quarantine items carried by the vessel.
船方或其代理人应当在船舶驶离口岸前4小时内(船舶在口岸停泊时间不足4小时的，在抵达口岸时)，到检查机关办理必要的出口岸手续。有关检查机关应当在《船舶出口岸手续联系单》上签注；船方或其代理人持《船舶出口岸手续联系单》和港务监督机构要求的其他证件、资料，到港务监督机构申请领取出口岸许可证。
The shipowner or its agent shall, within 4 hours before the vessel departs from the port (if the vessel's stay at the port is less than 4 hours, at the time of arrival), complete the necessary exit formalities at the inspection authorities. The relevant inspection authorities shall endorse the "Vessel Exit Clearance Contact Sheet"; the shipowner or its agent shall, holding the "Vessel Exit Clearance Contact Sheet" and other required documents and materials from the harbor superintendency authority, apply to the harbor superintendency authority for an exit clearance permit.
船舶领取出口岸许可证后，情况发生变化或者24小时内未能驶离口岸的，船方或其代理人应当报告港务监督机构，由港务监督机构商其他检查机关决定是否重新办理出口岸手续。
After the vessel obtains the exit clearance permit, if circumstances change or the vessel fails to depart from the port within 24 hours, the shipowner or its agent shall report to the harbor superintendency authority, and the harbor superintendency authority shall consult with other inspection authorities to decide whether to re-process the exit formalities.
定航线、定船员并在24小时内往返一个或者一个以上航次的船舶，船方或其代理人可以向港务监督机构书面申请办理定期进出口岸手续。受理申请的港务监督机构商其他检查机关审查批准后，签发有效期不超过7天的定期出口岸许可证，在许可证有效期内对该船舶免办进口岸手续。
For vessels operating on a fixed route, with a fixed crew, and making one or more round trips within 24 hours, the shipowner or its agent may apply in writing to the harbor superintendency authority for regular entry and exit formalities. After the harbor superintendency authority receiving the application consults with other inspection authorities and approves, it shall issue a regular exit clearance permit valid for no more than 7 days, and within the validity period of the permit, entry formalities for such vessels are exempted.
检查机关及其工作人员必须秉公执法，恪尽职守，及时实施检查和办理船舶进出口岸的申请。
The inspection authorities and their staff must enforce the law impartially, fulfill their duties diligently, and promptly carry out inspections and process applications for vessel entry and exit.
本办法下列用语的含义：
The meanings of the following terms used in these Measures:
(一)国际航行船舶，是指进出中华人民共和国口岸的外国籍船舶和航行国际航线的中华人民共和国国籍船舶。
(1) International voyage ships refer to foreign-flagged ships and Chinese-flagged ships navigating international routes that enter or leave the ports of the People's Republic of China.
(二)口岸，是指国家批准可以进出国际航行船舶的港口。
(2) Ports refer to harbors approved by the state for the entry and exit of international voyage ships.
(三)船方，是指船舶所有人或者经营人。
(3) Ship party refers to the ship owner or operator.
本办法自发布之日起施行。经国务院批准，1961年10月24日由交通部、对外贸易部、公安部、卫生部发布的《进出口船舶联合检查通则》同时废止。
These Measures shall come into force on the date of promulgation. The General Rules for Joint Inspection of Import and Export Ships, promulgated by the Ministry of Communications, the Ministry of Foreign Trade, the Ministry of Public Security, and the Ministry of Health on October 24, 1961, with the approval of the State Council, shall be abolished simultaneously.
