为了加强密云水库水源保护，促进密云水库流域绿色发展，统筹地表水与地下水、当地水与外调水，多水源保障首都水安全，制定本条例。
These Regulations are formulated to strengthen the protection of water sources in Miyun Reservoir, promote green development in the Miyun Reservoir basin, coordinate surface water and groundwater, local water and diverted water, and ensure water security for the capital through multiple water sources.
本条例适用于密云水库及其上游潮河、白河干流和重要支流的水源保护及相关活动。
These Regulations apply to the protection of water sources in Miyun Reservoir and its upstream main streams of the Chao River and Bai River and important tributaries, as well as related activities.
本条例所称密云水库流域，是指密云水库及其上游潮河、白河干流和重要支流涉及的北京市密云区、怀柔区、延庆区和河北省赤城县、沽源县、滦平县、兴隆县、丰宁满族自治县的相关乡级行政区域。前述重要支流和相关乡级行政区域由北京市人民政府、河北省人民政府确定。
For the purposes of these Regulations, the Miyun Reservoir basin refers to the relevant township-level administrative areas in Miyun District, Huairou District, and Yanqing District of Beijing Municipality, and Chicheng County, Guyuan County, Luanping County, Xinglong County, and Fengning Manchu Autonomous County of Hebei Province, which are involved in Miyun Reservoir and its upstream main streams of the Chao River and Bai River and important tributaries. The aforementioned important tributaries and relevant township-level administrative areas shall be determined by the People's Government of Beijing Municipality and the People's Government of Hebei Province.
密云水库水源保护应当贯彻党和国家路线方针政策、决策部署，立足密云水库流域主体功能定位，坚持保护优先、统筹保护与发展，坚持源头控制、系统治理，强化区域协同联动，实现水源保护、绿色发展、民生改善相统一。
The protection of water sources in Miyun Reservoir shall implement the guidelines, policies, decisions, and deployments of the Party and the state, be based on the main functional orientation of the Miyun Reservoir basin, adhere to protection priority and coordinate protection with development, adhere to source control and systematic governance, strengthen regional coordination and linkage, and achieve the unity of water source protection, green development, and improvement of people's livelihoods.
密云水库水源保护应当与全面提升密云水库流域防洪等防灾减灾救灾能力相结合。
The protection of water sources in Miyun Reservoir shall be combined with the comprehensive enhancement of flood prevention and other disaster prevention, mitigation, and relief capabilities in the Miyun Reservoir basin.
北京市人民政府、河北省人民政府应当密切协作，加强对密云水库水源保护工作的统筹，协调解决工作中的重大问题，督促检查工作落实情况。
The People's Government of Beijing Municipality and the People's Government of Hebei Province shall closely cooperate, strengthen the overall planning of the protection of water sources in Miyun Reservoir, coordinate and resolve major issues in the work, and supervise and inspect the implementation of the work.
密云水库流域地方人民政府负责本行政区域内密云水库水源保护工作。密云水库流域县级以上地方人民政府有关部门按照职责分工负责本行政区域内密云水库水源保护相关工作。
Local people's governments in the Miyun Reservoir basin shall be responsible for the protection of water sources in Miyun Reservoir within their respective administrative areas. Relevant departments of local people's governments at or above the county level in the Miyun Reservoir basin shall be responsible for related work on the protection of water sources in Miyun Reservoir according to their respective functions and duties.
国务院生态环境、水行政、自然资源、农业农村等主管部门应当加强工作协同，加大对密云水库水源保护工作的支持力度，并依照法律、行政法规规定和职责分工，加强对密云水库水源保护工作的指导监督。
The competent departments of ecology and environment, water administration, natural resources, agriculture and rural affairs, etc., of the State Council shall strengthen work coordination, increase support for the protection of water sources in Miyun Reservoir, and, in accordance with laws, administrative regulations, and their respective functions and duties, strengthen guidance and supervision over the protection of water sources in Miyun Reservoir.
北京市人民政府、河北省人民政府应当共同制定密云水库水源保护总体方案，明确工作目标、重点任务、保障措施、落实机制等事项。
The People's Government of Beijing Municipality and the People's Government of Hebei Province shall jointly formulate an overall plan for the protection of water sources in Miyun Reservoir, specifying work objectives, key tasks, safeguard measures, implementation mechanisms, and other matters.
密云水库流域县级以上地方人民政府编制本行政区域国土空间规划，应当充分考虑密云水库水源保护需要，落实密云水库水源保护要求。
When preparing territorial spatial plans for their respective administrative areas, local people's governments at or above the county level in the Miyun Reservoir basin shall fully consider the needs of protecting water sources in Miyun Reservoir and implement the requirements for protecting water sources in Miyun Reservoir.
密云水库流域产业结构和布局应当与流域生态系统、资源环境承载能力以及密云水库水源保护要求相适应。
The industrial structure and layout in the Miyun Reservoir basin shall be compatible with the carrying capacity of the basin's ecosystem and resources and environment, as well as the requirements for protecting water sources in Miyun Reservoir.
密云水库流域县级以上地方人民政府应当加快密云水库流域产业结构调整和布局优化，按照密云水库流域主体功能定位，依法加强对各类开发建设活动的管理，严禁不符合主体功能定位的各类开发建设活动。
Local people's governments at or above the county level in the Miyun Reservoir basin shall accelerate the adjustment of industrial structure and optimization of layout in the Miyun Reservoir basin, strengthen the management of various development and construction activities in accordance with the main functional orientation of the Miyun Reservoir basin, and strictly prohibit all types of development and construction activities that do not conform to the main functional orientation.
密云水库流域县级以上地方人民政府应当结合密云水库水源保护要求，严格用水总量和强度控制，落实水资源管控指标。
Local people's governments at or above the county level in the Miyun Reservoir basin shall, in conjunction with the requirements for protecting water sources in Miyun Reservoir, strictly control the total amount and intensity of water use, and implement water resource control indicators.
北京市人民政府、河北省人民政府应当组织开展密云水库流域总氮等主要水污染物来源调查、溯源解析以及迁移转化规律研究，共同确定主要水污染物控制的重点领域、区域和主要措施，并纳入密云水库流域有关地方规划。
The People's Government of Beijing Municipality and the People's Government of Hebei Province shall organize the investigation of sources, traceability analysis, and research on migration and transformation patterns of major water pollutants such as total nitrogen in the Miyun Reservoir basin, jointly determine the key areas, regions, and main measures for controlling major water pollutants, and incorporate them into relevant local plans for the Miyun Reservoir basin.
根据密云水库水源保护需要，北京市人民政府、河北省人民政府可以对密云水库流域制定严于国家水污染物排放标准的地方水污染物排放标准，报国务院生态环境主管部门备案。
According to the needs of protecting water sources in Miyun Reservoir, the People's Government of Beijing Municipality and the People's Government of Hebei Province may formulate local water pollutant discharge standards that are stricter than the national water pollutant discharge standards for the Miyun Reservoir basin, and report them to the competent department of ecology and environment of the State Council for recordation.
密云水库流域县级以上地方人民政府应当在密云水库流域依法划定畜禽禁养区。
Local people's governments at or above the county level in the Miyun Reservoir basin shall designate livestock and poultryprohibited breeding area (no-breeding zones) in the Miyun Reservoir basin in accordance with the law.
畜禽禁养区内禁止新建、扩建畜禽规模养殖场，现有的畜禽规模养殖场应当逐步关闭或者搬迁。
Within the livestock and poultryprohibited breeding area, the construction of new or expanded large-scale livestock and poultry breeding farms is prohibited, and existing large-scale livestock and poultry breeding farms shall be gradually closed or relocated.
密云水库流域地方人民政府应当在密云水库流域开展下列工作：
Local people's governments in the Miyun Reservoir basin shall carry out the following work in the Miyun Reservoir basin:
(一)组织开展农业面源污染综合防治，推广农作物病虫害绿色防控产品和技术，建立农业投入品使用监测机制；
(1) Organize comprehensive prevention and control of agricultural non-point source pollution, promote green prevention and control products and technologies for crop diseases and insect pests, and establish a monitoring mechanism for the use of agricultural inputs;
(二)组织开展密云水库周边村庄，潮河、白河干流和重要支流沿线村庄生活垃圾治理，促进生活垃圾规范化收集、运输、处理；
(2) Organize the treatment of domestic waste in villages around Miyun Reservoir and villages along the main streams of the Chao River and Bai River and important tributaries, and promote the standardized collection, transportation, and treatment of domestic waste;
(三)加大农村生活污水治理力度，通过在密云水库周边村庄，潮河、白河干流和重要支流沿线村庄建设生活污水收集处理设施等措施，实现生活污水收集处理全覆盖；
(3) Increase efforts in the treatment of rural domestic sewage, and achieve full coverage of domestic sewage collection and treatment through measures such as constructing domestic sewage collection and treatment facilities in villages around Miyun Reservoir and villages along the main streams of the Chao River and Bai River and important tributaries;
(四)组织开展生态清洁小流域建设。
(4) Organize the construction of ecologically clean small watersheds.
密云水库流域地方人民政府应当组织开展密云水库流域生态保护修复，采取下列措施恢复和增强水体自净能力，减少入河入库污染物对密云水库水质的影响：
Local people's governments in the Miyun Reservoir basin shall organize ecological protection and restoration in the Miyun Reservoir basin, and take the following measures to restore and enhance the self-purification capacity of water bodies and reduce the impact of pollutants entering rivers and reservoirs on the water quality of Miyun Reservoir:
(一)建设水源涵养林；
(1) Construct water conservation forests;
(二)在水库周边建设库滨带；
(2) Construct reservoir riparian zones around the reservoir;
(三)在水库入库口建设生态廊道；
(3) Construct ecological corridors at the reservoir inlets;
(四)依托现有排水沟渠建设植草过滤带；
(4) Construct grass filtration belts relying on existing drainage ditches;
(五)科学规范增殖放流；
(5) Scientifically and standardly conductstock enhancement (stock enhancement);
(六)其他生态保护修复措施。
(6) Other ecological protection and restoration measures.
密云水库流域生态保护修复涉及的重大工程，依法纳入国家级、省级生态保护修复重大工程规划。
Major projects involving ecological protection and restoration in the Miyun Reservoir basin shall be included in national or provincial major ecological protection and restoration project plans in accordance with the law.
在密云水库流域新建、改建、扩建建设项目，应当依法履行建设项目水土流失防治责任，采取有效措施加强水土流失防治。
When constructing, renovating, or expanding construction projects in the Miyun Reservoir basin, the responsibility for preventing and controlling soil erosion shall be fulfilled in accordance with the law, and effective measures shall be taken to strengthen the prevention and control of soil erosion.
在密云水库管理范围以及潮河、白河干流河道管理范围内，禁止实施下列行为：
Within the management scope of Miyun Reservoir and the management scope of the main stream channels of the Chao River and Bai River, the following acts are prohibited:
(一)违法建设建筑物、构筑物；
(1) Illegally constructing buildings or structures;
(二)未经处理达标、直接排放污水；
(2) Discharging sewage without treatment to meet standards;
(三)施用化肥农药；
(3) Applying chemical fertilizers and pesticides;
(四)采砂或者堆放矿渣、石渣、煤灰、垃圾等固体废物；
(4) Sand mining or stockpiling solid wastes such as ore slag, stone slag, coal ash, and garbage;
(五)网箱养殖；
(5) Cage culture;
(六)法律、行政法规规定禁止实施的其他行为。
(6) Other acts prohibited by laws and administrative regulations.
在密云水库管理范围以及潮河、白河干流河道管理范围外100米范围内，除生态修复设施、水工程设施、公用基础设施以及北京市人民政府、河北省人民政府确定的不造成水污染的必要项目外，禁止新建、扩建其他建设项目。
Within 100 meters outside the management scope of Miyun Reservoir and the management scope of the main stream channels of the Chao River and Bai River, except for ecological restoration facilities, water engineering facilities, public infrastructure, and necessary projects determined by the People's Government of Beijing Municipality and the People's Government of Hebei Province that do not cause water pollution, the construction of new or expanded other construction projects is prohibited.
前款规定区域内严格控制化肥、农药施用，具体办法由北京市人民政府、河北省人民政府制定。
The application of chemical fertilizers and pesticides in the areas specified in the preceding paragraph shall be strictly controlled, and specific measures shall be formulated by the People's Government of Beijing Municipality and the People's Government of Hebei Province.
在密云水库管理范围以及潮河、白河干流河道管理范围外1000米范围内，禁止新建、扩建尾矿库、化工园区和化工项目。
Within 1000 meters outside the management scope of Miyun Reservoir and the management scope of the main stream channels of the Chao River and Bai River, the construction of new or expanded tailings ponds, chemical industry parks, and chemical projects is prohibited.
根据密云水库水源保护需要，北京市人民政府、河北省人民政府可以确定在前款规定区域内禁止或者限制新建、扩建的其他建设项目。
According to the needs of protecting water sources in Miyun Reservoir, the People's Government of Beijing Municipality and the People's Government of Hebei Province may determine other construction projects that are prohibited or restricted from being newly built or expanded within the areas specified in the preceding paragraph.
本条例第十四条、第十五条、第十六条规定的区域与依法划定的饮用水水源保护区重合的部分，其保护措施依照有关法律、行政法规关于饮用水水源保护区的规定执行。
For parts of the areas specified in Articles 14, 15, and 16 that overlap with legally designated drinking water source protection zones, the protection measures shall be implemented in accordance with the provisions of relevant laws and administrative regulations on drinking water source protection zones.
密云水库流域县级以上地方人民政府应当健全完善水量水质监测网络，建立断面考核机制和监测信息共享机制。
Local people's governments at or above the county level in the Miyun Reservoir basin shall improve and perfect the water quantity and quality monitoring network, and establish a cross-section assessment mechanism and a monitoring information sharing mechanism.
潮河、白河干流和重要支流水量水质的省界监测断面、监测指标、监测标准等事项，由北京市人民政府、河北省人民政府共同确定。省界监测断面设有国家水文站点、水质监测站点的，可以直接采用其监测数据。
Matters such as the provincial boundary monitoring sections, monitoring indicators, and monitoring standards for water quantity and quality of the main streams of the Chao River and Bai River and important tributaries shall be jointly determined by the People's Government of Beijing Municipality and the People's Government of Hebei Province. If national hydrological stations or water quality monitoring stations are located at the provincial boundary monitoring sections, their monitoring data may be directly used.
密云水库流域县级以上地方人民政府生态环境、水行政、自然资源、农业农村等主管部门应当按照职责分工加强日常监管，并建立健全部门联合执法和信息共享机制，及时查处违反密云水库水源保护有关规定的违法行为。
The competent departments of ecology and environment, water administration, natural resources, agriculture and rural affairs, etc., of local people's governments at or above the county level in the Miyun Reservoir basin shall strengthen daily supervision according to their respective functions and duties, and establish and improve mechanisms for joint law enforcement and information sharing among departments, and promptly investigate and punish illegal acts that violate the provisions on the protection of water sources in Miyun Reservoir.
北京市人民政府、河北省人民政府应当推进密云水库水源保护区域联合执法，推动执法标准统一。
The People's Government of Beijing Municipality and the People's Government of Hebei Province shall promote joint law enforcement in the water source protection area of Miyun Reservoir and promote the unification of law enforcement standards.
密云水库流域各级河长应当认真履行职责，加强对河道环境的日常巡查管护，及时推动整改发现的河道环境问题。
River chiefs at all levels in the Miyun Reservoir basin shall conscientiously perform their duties, strengthen daily patrol and management of the river environment, and promptly promote the rectification of river environment problems discovered.
密云水库流域县级以上地方人民政府及其有关部门、乡镇人民政府应当采取多种方式，加强对水源保护、绿色发展以及有关法律、法规的宣传教育。
Local people's governments at or above the county level in the Miyun Reservoir basin, their relevant departments, and township people's governments shall adopt various methods to strengthen publicity and education on water source protection, green development, and relevant laws and regulations.
国务院有关部门和相关地方人民政府加大对密云水库流域绿色发展的支持力度。
Relevant departments of the State Council and relevant local people's governments shall increase support for green development in the Miyun Reservoir basin.
国务院有关部门应当结合各自职责，加强对密云水库流域绿色发展的指导，并在公共资源配置、绿色产业布局、就业促进等方面依法依规给予支持。
Relevant departments of the State Council shall, in light of their respective functions and duties, strengthen guidance on green development in the Miyun Reservoir basin, and provide support in terms of public resource allocation, green industry layout, employment promotion, etc., in accordance with laws and regulations.
鼓励、支持金融机构按照市场化、法治化原则提供与密云水库流域绿色发展相适应的金融服务，引导社会资本依法依规参与密云水库流域绿色发展。
Financial institutions are encouraged and supported to provide financial services compatible with green development in the Miyun Reservoir basin in accordance with market-oriented and rule-of-law principles, and social capital is guided to participate in green development in the Miyun Reservoir basin in accordance with laws and regulations.
密云水库流域县级以上地方人民政府应当制定专项政策，明确支持和促进密云水库流域绿色发展的具体措施。
Local people's governments at or above the county level in the Miyun Reservoir basin shall formulate special policies to specify specific measures to support and promote green development in the Miyun Reservoir basin.
北京市人民政府、河北省人民政府应当就密云水库水源保护协商建立地区间横向生态保护补偿机制，综合考虑密云水库水源保护现状、保护成本、保护成效以及地区经济社会发展水平、财政承受能力等因素，合理确定、动态调整补偿标准。
The People's Government of Beijing Municipality and the People's Government of Hebei Province shall negotiate and establish a regional horizontal ecological protection compensation mechanism for the protection of water sources in Miyun Reservoir, and reasonably determine and dynamically adjust the compensation standards by comprehensively considering factors such as the current status of water source protection in Miyun Reservoir, protection costs, protection effectiveness, and the level of regional economic and social development and financial affordability.
北京市人民政府、河北省人民政府统筹使用不同渠道生态保护补偿资金，对密云水库水源保护实施财政纵向补偿。中央财政按照生态保护补偿制度有关规定予以支持。
The People's Government of Beijing Municipality and the People's Government of Hebei Province shall coordinate the use of ecological protection compensation funds from different channels to implement vertical fiscal compensation for the protection of water sources in Miyun Reservoir. The central finance shall provide support in accordance with the relevant provisions of the ecological protection compensation system.
鼓励充分发挥市场机制在密云水库流域生态保护补偿中的作用，推进生态保护补偿市场化发展。
The role of market mechanisms in ecological protection compensation in the Miyun Reservoir basin is encouraged to be fully utilized, and the market-oriented development of ecological protection compensation is promoted.
密云水库流域地方人民政府及其有关部门在密云水库水源保护工作中不履行或者不正确履行职责的，依照法律、法规和国家有关规定追究责任，对直接负责的主管人员和其他直接责任人员依法给予处分；构成犯罪的，依法追究刑事责任。
If local people's governments in the Miyun Reservoir basin and their relevant departments fail to perform or incorrectly perform their duties in the protection of water sources in Miyun Reservoir, they shall be held accountable in accordance with laws, regulations, and relevant provisions of the state; the directly responsible persons in charge and other directly responsible persons shall be given sanctions in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
违反本条例第十条第二款、第十三条、第十四条规定的，依照有关法律、行政法规的规定予以处罚。有关法律、行政法规对本条例第十四条第三项、第五项行为未作处罚规定的，由密云水库流域县级以上地方人民政府生态环境、水行政、农业农村等主管部门按照职责分工，责令停止违法行为；情节严重的，对单位处2万元以上5万元以下的罚款，对个人处500元以上2000元以下的罚款；有违法所得的，没收违法所得。
Violations of Article 10, paragraph 2, Article 13, and Article 14 shall be punished in accordance with the provisions of relevant laws and administrative regulations. If the relevant laws and administrative regulations do not provide for penalties for the acts specified in Article 14, items (3) and (5), the competent departments of ecology and environment, water administration, agriculture and rural affairs, etc., of local people's governments at or above the county level in the Miyun Reservoir basin shall, according to their respective functions and duties, order the cessation of the illegal act; if the circumstances are serious, a fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed on the unit, and a fine of not less than 500 yuan but not more than 2,000 yuan shall be imposed on the individual; if there is illegal income, the illegal income shall be confiscated.
违反本条例第十五条第一款、第十六条规定的，由密云水库流域县级以上地方人民政府生态环境、水行政、自然资源等主管部门按照职责分工，责令停止违法行为，限期恢复原状，处5万元以上20万元以下的罚款；情节严重的，处20万元以上100万元以下的罚款；有违法所得的，没收违法所得；构成犯罪的，依法追究刑事责任。
Violations of Article 15, paragraph 1, and Article 16 shall be ordered by the competent departments of ecology and environment, water administration, natural resources, etc., of local people's governments at or above the county level in the Miyun Reservoir basin, according to their respective functions and duties, to cease the illegal act, restore the original state within a time limit, and impose a fine of not less than 50,000 yuan but not more than 200,000 yuan; if the circumstances are serious, a fine of not less than 200,000 yuan but not more than 1,000,000 yuan shall be imposed; if there is illegal income, the illegal income shall be confiscated; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
密云水库水源保护及相关活动除应当遵守本条例外，还应当遵守生态环境保护、防灾减灾救灾等有关法律、行政法规的规定。
In addition to complying with these Regulations, the protection of water sources in Miyun Reservoir and related activities shall also comply with the provisions of relevant laws and administrative regulations on ecological and environmental protection, disaster prevention, mitigation and relief, etc.
本条例自2025年12月1日起施行。
These Regulations shall come into force as of December 1, 2025.
