Measures for the Use of the Red Cross Emblem of the People's Republic of China

为了维护红十字标志的严肃性，正确使用红十字标志，依照红十字会法的有关规定，制定本办法。

These Measures are formulated in accordance with the relevant provisions of the Red Cross Society Law to maintain the solemnity of the Red Cross emblem and ensure its correct use.

红十字标志是白底红十字。

The Red Cross emblem is a red cross on a white background.

红十字标志是国际人道主义保护标志，是武装力量医疗机构的特定标志，是红十字会的专用标志。

The Red Cross emblem is an international humanitarian protection symbol, a specific symbol for medical units of armed forces, and an exclusive symbol for the Red Cross Society.

除本办法规定的外，禁止任何组织或者个人使用红十字标志。

Except as provided in these Measures, no organization or individual is permitted to use the Red Cross emblem.

红十字标志具有保护作用和标明作用，二者不得混淆使用。

The Red Cross emblem has both protective and indicative functions, and these two uses shall not be confused.

地方各级人民政府依照本办法对本行政区域内红十字标志的使用实施监督管理。

Local people's governments at all levels shall supervise and manage the use of the Red Cross emblem within their respective administrative regions in accordance with these Measures.

地方各级红十字会应当协助本级人民政府对红十字标志的使用实施监督管理。

Local Red Cross societies at all levels shall assist the people's governments at the same level in supervising and managing the use of the Red Cross emblem.

红十字标志的保护性使用，是指在武装冲突中，冲突各方对依照本办法的规定佩带红十字标志的人员和标有红十字标志的处所及其物品、医务运输工具，必须予以保护和尊重。

Protective use of the Red Cross emblem means that during armed conflicts, all parties to the conflict must protect and respect persons wearing the Red Cross emblem and premises, articles, and medical transport vehicles marked with the Red Cross emblem in accordance with these Measures.

红十字作为保护性标志使用时，不得在标志上添加任何内容。

When the Red Cross emblem is used as a protective symbol, no content may be added to the emblem.

红十字作为保护性标志使用时，用在旗帜上的，红十字不得触及旗帜的边缘；用在臂章上的，红十字应当置于臂章的中间部位；用在建筑物上的，红十字应当置于建筑物顶部的明显部位。

When the Red Cross emblem is used as a protective symbol on a flag, the red cross shall not touch the edges of the flag; when used on an armband, the red cross shall be placed in the middle of the armband; when used on a building, the red cross shall be placed in a conspicuous position on the top of the building.

红十字作为保护性标志使用时，应当在尽可能远的地方或者不同的方向得以辨认；在夜间或者能见度低时，应当以灯光照明或者用发光物装饰。

When the Red Cross emblem is used as a protective symbol, it shall be recognizable from as far away as possible or from different directions; at night or in low visibility, it shall be illuminated by lights or decorated with luminous materials.

在武装冲突中，下列人员可以使用保护性红十字标志：

During armed conflicts, the following persons may use the protective Red Cross emblem:

(一)武装力量医疗机构的医务人员和工作人员；

(1) Medical personnel and staff of medical units of the armed forces;

(二)红十字会的工作人员和医务人员；

(2) Staff and medical personnel of the Red Cross Society;

(三)经国务院或者中央军事委员会批准的国际红十字组织和外国红十字组织的工作人员和医务人员；

(3) Staff and medical personnel of international Red Cross organizations and foreign Red Cross organizations approved by the State Council or the Central Military Commission;

(四)军用的和民用的医务运输工具上的医务人员和工作人员；

(4) Medical personnel and staff on military and civilian medical transport vehicles;

(五)经国务院或者中央军事委员会批准的国内外的志愿救助团体人员和民用医疗机构的医务人员。

(5) Personnel of domestic and foreign voluntary relief groups and medical personnel of civilian medical institutions approved by the State Council or the Central Military Commission.

在武装冲突中，下列机构或者组织及其处所、物品、医务运输工具可以使用保护性红十字标志：

During armed conflicts, the following institutions or organizations and their premises, articles, and medical transport vehicles may use the protective Red Cross emblem:

(一)武装力量的医疗机构；

(1) Medical units of the armed forces;

(二)参加救助活动的红十字会；

(2) Red Cross societies participating in relief activities;

(三)经国务院或者中央军事委员会批准的国内外的志愿救助团体和医疗机构；

(3) Domestic and foreign voluntary relief groups and medical institutions approved by the State Council or the Central Military Commission;

(四)经国务院或者中央军事委员会批准的国际组织。

(4) International organizations approved by the State Council or the Central Military Commission.

使用保护性红十字标志的人员，必须随身携带由国务院或者中央军事委员会授权的部门签发的身份证明。

Persons using the protective Red Cross emblem must carry an identity document issued by the State Council or a department authorized by the Central Military Commission.

武装力量医疗机构的人员、处所及其物品、医务运输工具，和平时期可以使用保护性红十字标志作为标记。

Medical personnel, premises, articles, and medical transport vehicles of the armed forces may use the protective Red Cross emblem as a mark during peacetime.

红十字标志的标明性使用，是指对与红十字活动有关的人或者物的标示。

Indicative use of the Red Cross emblem refers to the marking of persons or things related to Red Cross activities.

红十字作为标明性标志使用时，在红十字下方必须伴以红十字会的名称或者名称缩写，并不得将红十字置于建筑物顶部。

When the Red Cross emblem is used as an indicative mark, the name or abbreviation of the Red Cross Society must be placed below it, and the emblem shall not be placed on the top of a building.

红十字会的工作人员、会员和其他有关人员履行职责时，应当佩带标有红十字的小尺寸臂章；不履行职责时，可以佩带标有红十字的小尺寸胸针或者胸章。

Staff members, members, and other relevant personnel of the Red Cross Society shall wear small-sized armbands bearing the Red Cross emblem when performing duties; when not performing duties, they may wear small-sized lapel pins or badges bearing the Red Cross emblem.

下列人员可以使用标明性红十字标志：

The following persons may use the indicative Red Cross emblem:

(一)红十字会工作人员；

(1) Staff members of the Red Cross Society;

(二)红十字会会员；

(2) Members of the Red Cross Society;

(三)红十字青少年会员。

(3) Junior Red Cross members.

下列场所可以使用标明性红十字标志：

The following premises may use the indicative Red Cross emblem:

(一)红十字会使用的建筑物；

(1) Buildings used by the Red Cross Society;

(二)红十字会所属的医疗机构；

(2) Medical institutions affiliated with the Red Cross Society;

(三)红十字会开展符合其宗旨的活动场所。

(3) Venues where the Red Cross Society carries out activities consistent with its purposes.

下列物品、运输工具可以使用标明性红十字标志：

The following articles and transport vehicles may use the indicative Red Cross emblem:

(一)红十字会的徽章、奖章、证章；

(1) Badges, medals, and insignia of the Red Cross Society;

(二)红十字会的印刷品、宣传品；

(2) Printed materials and promotional items of the Red Cross Society;

(三)红十字会的救灾、救护物资及运输工具。

(3) Disaster relief and medical rescue supplies and transport vehicles of the Red Cross Society.

在本办法规定的范围以外需要使用标明性红十字标志的，由红十字会总会批准。

Use of the indicative Red Cross emblem beyond the scope specified in these Measures shall be approved by the Red Cross Society of China.

红十字标志不得用于：

The Red Cross emblem shall not be used for:

(一)商标或者商业性广告；

(1) Trademarks or commercial advertisements;

(二)非红十字会或者非武装力量的医疗机构；

(2) Medical institutions that are not affiliated with the Red Cross Society or the armed forces;

(三)药店、兽医站；

(3) Pharmacies or veterinary stations;

(四)商品的包装；

(4) Packaging of goods;

(五)公司的标志；

(5) Company logos;

(六)工程设计、产品设计；

(6) Engineering design, product design;

(七)本办法规定可以使用红十字标志以外的其他情形。

(7) Other circumstances where the use of the Red Cross emblem is permitted under these Regulations.

对违反本办法的规定，有下列情形之一的，红十字会有权予以劝阻，并要求其停止使用；拒绝停止使用的，红十字会可以提请人民政府责令停止使用：

For violations of these Regulations under any of the following circumstances, the Red Cross Society has the right to dissuade and demand cessation of use; if the party refuses to cease use, the Red Cross Society may request the people's government to order cessation of use:

(一)红十字会的工作人员、会员、红十字青少年会员以外的人员使用标明性红十字标志的；

(1) Use of the indicative Red Cross emblem by persons other than staff members, members, and Red Cross youth members of the Red Cross Society;

(二)非红十字会使用的建筑物及其他场所使用标明性红十字标志的；

(2) Use of the indicative Red Cross emblem on buildings and other premises not used by the Red Cross Society;

(三)非红十字会的医疗机构使用标明性红十字标志的；

(3) Use of the indicative Red Cross emblem by medical institutions not affiliated with the Red Cross Society;

(四)不属于红十字会的物品、运输工具等使用标明性红十字标志的；

(4) Use of the indicative Red Cross emblem on items, means of transport, etc., not belonging to the Red Cross Society;

(五)有违反本办法规定使用红十字标志的其他情形的。

(5) Other circumstances where the use of the Red Cross emblem violates these Regulations.

违反本办法第十八条的规定，擅自使用红十字标志的，由县级以上人民政府责令停止使用，没收非法所得，并处1万元以下的罚款。

Whoever, in violation of Article 18 of these Regulations, uses the Red Cross emblem without authorization shall be ordered by the people's government at or above the county level to cease use, confiscate illegal gains, and be fined not more than 10,000 yuan.

阻碍红十字会工作人员依法履行职责的，依法给予治安管理处罚或者追究刑事责任。

Whoever obstructs Red Cross staff members from performing their duties according to law shall be subject to public security penalties or criminal liability according to law.

武装力量中的组织和人员有违反本办法规定行为的，由军队有关部门处理。

Organizations and personnel within the armed forces that violate these Regulations shall be dealt with by the relevant military authorities.

本办法有关红十字标志保护性使用的规定未尽事宜，依照日内瓦公约及其附加议定书的有关规定执行。

Matters not covered by the provisions on protective use of the Red Cross emblem in these Regulations shall be implemented in accordance with the relevant provisions of the Geneva Conventions and their Additional Protocols.

前款日内瓦公约及其附加议定书是指《中华人民共和国红十字会法》第二十七条规定的公约和议定书。

The Geneva Conventions and their Additional Protocols referred to in the preceding paragraph are the conventions and protocols specified in Article 27 of the Red Cross Society Law of the People's Republic of China.

本办法自发布之日起施行。

These Regulations shall come into force as of the date of promulgation.
