为了规范涉外收养登记行为，根据《中华人民共和国民法典》（以下简称民法典），制定本办法。
These Measures are formulated in accordance with the Civil Code of the People's Republic of China (hereinafter referred to as the Civil Code) for the purpose of regulating the registration of foreign-related adoptions.
外国人在中华人民共和国境内收养子女(以下简称外国人在华收养子女)，应当依照本办法办理登记。
Foreigners who adopt children within the territory of the People's Republic of China (hereinafter referred to as foreigners adopting children in China) shall complete the registration in accordance with these Measures.
收养人夫妻一方为外国人，在华收养子女，也应当依照本办法办理登记。
Where one spouse of the adoptive parents is a foreigner and they adopt a child in China, they shall also complete the registration in accordance with these Measures.
外国人在华收养子女，应当符合中国有关收养法律的规定，并应当符合收养人所在国有关收养法律的规定；因收养人所在国法律的规定与中国法律的规定不一致而产生的问题，由两国政府有关部门协商处理。
Foreigners adopting children in China shall comply with the relevant provisions of Chinese adoption laws and shall also comply with the relevant provisions of the adoption laws of the country of the adoptive parents; issues arising from inconsistencies between the laws of the country of the adoptive parents and Chinese laws shall be handled through consultation between the relevant government departments of the two countries.
外国人在华收养子女，应当通过所在国政府或者政府委托的收养组织(以下简称外国收养组织)向中国政府委托的收养组织(以下简称中国收养组织)转交收养申请并提交收养人的家庭情况报告和证明。
Foreigners adopting children in China shall submit their adoption application and provide reports and certificates on the adoptive parents' family situation through the government of their country or an adoption organization entrusted by the government (hereinafter referred to as the foreign adoption organization) to an adoption organization entrusted by the Chinese government (hereinafter referred to as the Chinese adoption organization).
前款规定的收养人的收养申请、家庭情况报告和证明，是指由其所在国有权机构出具，经其所在国外交机关或者外交机关授权的机构认证，并经中华人民共和国驻该国使馆或者领馆认证的，或者履行中华人民共和国缔结或者参加的国际条约规定的证明手续的下列文件：
The adoption application, family situation report, and certificates of the adoptive parents as specified in the preceding paragraph refer to the following documents issued by the competent authority of the country of the adoptive parents, authenticated by the foreign affairs authority of that country or an agency authorized by it, and authenticated by the embassy or consulate of the People's Republic of China in that country, or for which the certification procedures provided for in international treaties concluded or acceded to by the People's Republic of China have been fulfilled:
(一)跨国收养申请书；
(1) Intercountry adoption application form;
(二)出生证明；
(2) Birth certificate;
(三)婚姻状况证明；
(3) Certificate of marital status;
(四)职业、经济收入和财产状况证明；
(4) Certificate of occupation, economic income, and property status;
(五)身体健康检查证明；
(5) Certificate of physical health examination;
(六)有无受过刑事处罚的证明；
(6) Certificate of no criminal record;
(七)收养人所在国主管机关同意其跨国收养子女的证明；
(7) Certificate from the competent authority of the country of the adoptive parents approving the intercountry adoption;
(八)家庭情况报告，包括收养人的身份、收养的合格性和适当性、家庭状况和病史、收养动机以及适合于照顾儿童的特点等。
(8) Family situation report, including the identity of the adoptive parents, their suitability and appropriateness for adoption, family status and medical history, adoption motivation, and characteristics suitable for caring for children.
在华工作或者学习连续居住一年以上的外国人在华收养子女，应当提交前款规定的除身体健康检查证明以外的文件，并应当提交在华所在单位或者有关部门出具的婚姻状况证明，职业、经济收入或者财产状况证明，有无受过刑事处罚证明以及县级以上医疗机构出具的身体健康检查证明。
Where a foreigner who has resided continuously in China for more than one year for work or study adopts a child in China, they shall submit the documents specified in the preceding paragraph except for the physical health examination certificate, and shall also submit a certificate of marital status, certificate of occupation, economic income or property status, certificate of no criminal record issued by their employer or relevant department in China, and a physical health examination certificate issued by a medical institution at or above the county level.
送养人应当向省、自治区、直辖市人民政府民政部门提交本人的居民户口簿和居民身份证(社会福利机构作送养人的，应当提交其负责人的身份证件)、被收养人的户籍证明等情况证明，并根据不同情况提交下列有关证明材料：
The person placing out the child for adoption shall submit to the civil affairs department of the people's government of the province, autonomous region, or municipality directly under the Central Government their own residence booklet and resident identity card (if a social welfare institution is the person placing out the child, it shall submit the identity document of its responsible person), the household registration certificate of the child to be adopted, and other relevant certificates, and shall also submit the following relevant supporting materials according to different circumstances:
(一)被收养人的生父母(包括已经离婚的)为送养人的，应当提交生父母有特殊困难无力抚养的证明和生父母双方同意送养的书面意见；其中，被收养人的生父或者生母因丧偶或者一方下落不明，由单方送养的，并应当提交配偶死亡或者下落不明的证明以及死亡的或者下落不明的配偶的父母不行使优先抚养权的书面声明；
(1) Where the biological parents (including those who have divorced) of the child to be adopted are the persons placing out the child, they shall submit a certificate proving that the biological parents have special difficulties and are unable to raise the child, and a written opinion of both biological parents consenting to the placement; where the biological father or mother of the child to be adopted places out the child alone due to the death of the spouse or the whereabouts of one spouse being unknown, they shall also submit a certificate of the spouse's death or disappearance and a written declaration from the parents of the deceased or missing spouse that they will not exercise their priority right to raise the child;
(二)被收养人的父母均不具备完全民事行为能力，由被收养人的其他监护人作送养人的，应当提交被收养人的父母不具备完全民事行为能力且对被收养人有严重危害的证明以及监护人有监护权的证明；
(2) Where both parents of the child to be adopted lack full civil capacity and another guardian of the child acts as the person placing out the child, they shall submit a certificate proving that the parents lack full civil capacity and pose a serious harm to the child, and a certificate proving the guardian's guardianship;
(三)被收养人的父母均已死亡，由被收养人的监护人作送养人的，应当提交其生父母的死亡证明、监护人实际承担监护责任的证明，以及其他有抚养义务的人同意送养的书面意见；
(3) Where both parents of the child to be adopted have died and the guardian of the child acts as the person placing out the child, they shall submit the death certificates of the biological parents, a certificate proving that the guardian actually bears the guardianship responsibility, and a written opinion from other persons with maintenance obligations consenting to the placement;
(四)由社会福利机构作送养人的，应当提交弃婴、儿童被遗弃和发现的情况证明以及查找其父母或者其他监护人的情况证明；被收养人是孤儿的，应当提交孤儿父母的死亡或者宣告死亡证明，以及有抚养孤儿义务的其他人同意送养的书面意见。
(4) Where a social welfare institution acts as the person placing out the child, it shall submit certificates proving the circumstances of the abandonment and discovery of the abandoned infant or child, and certificates proving the search for their parents or other guardians; where the child to be adopted is an orphan, it shall submit certificates of the death or declared death of the orphan's parents, and a written opinion from other persons with the obligation to raise the orphan consenting to the placement.
送养残疾儿童的，还应当提交县级以上医疗机构出具的该儿童的残疾证明。
Where a child with a disability is placed out for adoption, a disability certificate issued by a medical institution at or above the county level shall also be submitted.
省、自治区、直辖市人民政府民政部门应当对送养人提交的证件和证明材料进行审查，对查找不到生父母的弃婴和儿童公告查找其生父母；认为被收养人、送养人符合民法典规定条件的，将符合民法典规定的被收养人、送养人名单通知中国收养组织，同时转交下列证件和证明材料：
The civil affairs department of the people's government of the province, autonomous region, or municipality directly under the Central Government shall examine the certificates and supporting materials submitted by the person placing out the child, and shall publicly search for the biological parents of abandoned infants and children whose parents cannot be found; if it considers that the child to be adopted and the person placing out the child meet the conditions of the Civil Code, it shall notify the Chinese adoption organization of the list of children to be adopted and persons placing out the child that meet the conditions of the Civil Code, and shall simultaneously transfer the following certificates and supporting materials:
(一)送养人的居民户口簿和居民身份证(社会福利机构作送养人的，为其负责人的身份证件)复制件；
(1) Copies of the residence booklet and resident identity card of the person placing out the child (if a social welfare institution is the person placing out the child, copies of the identity document of its responsible person);
(二)被收养人是弃婴或者孤儿的证明、户籍证明、成长情况报告和身体健康检查证明的复制件及照片。
(2) Copies and photographs of the certificate proving that the child to be adopted is an abandoned infant or orphan, household registration certificate, growth report, and physical health examination certificate.
省、自治区、直辖市人民政府民政部门查找弃婴或者儿童生父母的公告应当在省级地方报纸上刊登。自公告刊登之日起满60日，弃婴和儿童的生父母或者其他监护人未认领的，视为查找不到生父母的弃婴和儿童。
The announcement by the civil affairs department of the provincial, autonomous region, or municipality directly under the Central Government to search for the biological parents of an abandoned infant or child shall be published in a provincial-level local newspaper. If the biological parents or other guardians of the abandoned infant or child do not claim the child within 60 days from the date of publication, the child shall be deemed as an abandoned infant or child whose biological parents cannot be found.
中国收养组织对外国收养人的收养申请和有关证明进行审查后，应当在省、自治区、直辖市人民政府民政部门报送的符合民法典规定条件的被收养人中，参照外国收养人的意愿，选择适当的被收养人，并将该被收养人及其送养人的有关情况通过外国政府或者外国收养组织送交外国收养人。外国收养人同意收养的，中国收养组织向其发出来华收养子女通知书，同时通知有关的省、自治区、直辖市人民政府民政部门向送养人发出被收养人已被同意收养的通知。
After reviewing the adoption application and relevant documents of the foreign adopter, the Chinese adoption organization shall, among the adoptees submitted by the civil affairs department of the provincial, autonomous region, or municipality directly under the Central Government who meet the conditions stipulated in the Civil Code, select an appropriate adoptee with reference to the foreign adopter's wishes, and send the relevant information of the adoptee and the person placing out the child for adoption to the foreign adopter through the foreign government or foreign adoption organization. If the foreign adopter agrees to the adoption, the Chinese adoption organization shall issue a notice of coming to China for adoption to the foreign adopter, and simultaneously notify the relevant civil affairs department of the provincial, autonomous region, or municipality directly under the Central Government to issue a notice to the person placing out the child for adoption that the adoptee has been approved for adoption.
外国人来华收养子女，应当亲自来华办理登记手续。夫妻共同收养的，应当共同来华办理收养手续；一方因故不能来华的，应当书面委托另一方。委托书应当经所在国公证和认证。中华人民共和国缔结或者参加的国际条约另有规定的，按照国际条约规定的证明手续办理。
Foreigners coming to China to adopt children shall come to China in person to go through the registration procedures. If a couple adopts jointly, they shall come to China together to go through the adoption procedures; if one party cannot come to China for some reason, that party shall entrust the other party in writing. The power of attorney shall be notarized and authenticated in the country of residence. If an international treaty concluded or acceded to by the People's Republic of China provides otherwise, the certification procedures stipulated in the international treaty shall be followed.
收养人对外国主管机关依据本办法第四条第二款和前款提及的国际条约出具的证明文书的真实性负责，签署书面声明，并承担相应法律责任。
The adopter shall be responsible for the authenticity of the certification documents issued by the competent foreign authority in accordance with Article 4, paragraph 2 of these Measures and the international treaties mentioned in the preceding paragraph, sign a written statement, and bear corresponding legal liability.
外国人来华收养子女，应当与送养人订立书面收养协议。协议一式三份，收养人、送养人各执一份，办理收养登记手续时收养登记机关收存一份。
Foreigners coming to China to adopt children shall conclude a written adoption agreement with the person placing out the child for adoption. The agreement shall be made in triplicate, with one copy held by the adopter, one by the person placing out the child for adoption, and one kept by the adoption registration authority when going through the adoption registration procedures.
书面协议订立后，收养关系当事人应当共同到被收养人常住户口所在地的省、自治区、直辖市人民政府民政部门办理收养登记。
After the written agreement is concluded, the parties to the adoption relationship shall jointly go to the civil affairs department of the provincial, autonomous region, or municipality directly under the Central Government where the adoptee's permanent residence is located to go through the adoption registration.
收养关系当事人办理收养登记时，应当填写外国人来华收养子女登记申请书并提交收养协议，同时分别提供有关材料。
When going through the adoption registration, the parties to the adoption relationship shall fill in the Application Form for Registration of Adoption of Children by Foreigners and submit the adoption agreement, and also provide relevant materials respectively.
收养人应当提供下列材料：
The adopter shall provide the following materials:
(一)中国收养组织发出的来华收养子女通知书；
(1) The notice of coming to China for adoption issued by the Chinese adoption organization;
(二)收养人的身份证件和照片。
(2) The adopter's identification documents and photos.
送养人应当提供下列材料：
The person placing out the child for adoption shall provide the following materials:
(一)省、自治区、直辖市人民政府民政部门发出的被收养人已被同意收养的通知；
(1) The notice issued by the civil affairs department of the provincial, autonomous region, or municipality directly under the Central Government that the adoptee has been approved for adoption;
(二)送养人的居民户口簿和居民身份证(社会福利机构作送养人的，为其负责人的身份证件)、被收养人的照片。
(2) The household registration booklet and resident identity card of the person placing out the child for adoption (if a social welfare institution is the person placing out the child for adoption, the identification documents of its responsible person), and photos of the adoptee.
收养登记机关收到外国人来华收养子女登记申请书和收养人、被收养人及其送养人的有关材料后，应当自次日起7日内进行审查，对符合本办法第十条规定的，为当事人办理收养登记，发给收养登记证书。收养关系自登记之日起成立。
After receiving the Application Form for Registration of Adoption of Children by Foreigners and the relevant materials of the adopter, the adoptee, and the person placing out the child for adoption, the adoption registration authority shall conduct a review within 7 days from the next day. If the requirements of Article 10 of these Measures are met, the authority shall go through the adoption registration for the parties and issue an adoption registration certificate. The adoption relationship shall be established from the date of registration.
收养登记机关应当将登记结果通知中国收养组织。
The adoption registration authority shall notify the Chinese adoption organization of the registration result.
收养关系当事人办理收养登记后，各方或者一方要求办理收养公证的，应当到收养登记地的具有办理涉外公证资格的公证机构办理收养公证。
After the parties to the adoption relationship go through the adoption registration, if any or all parties request notarization of the adoption, they shall go to a notary institution with the qualification to handle foreign-related notarization at the place of adoption registration to handle the adoption notarization.
被收养人出境前，收养人应当凭收养登记证书到收养登记地的公安机关为被收养人办理出境手续。
Before the adoptee leaves the country, the adopter shall, with the adoption registration certificate, go to the public security organ at the place of adoption registration to handle the exit procedures for the adoptee.
外国人在华收养子女，应当向登记机关交纳登记费。登记费的收费标准按照国家有关规定执行。
Foreigners adopting children in China shall pay registration fees to the registration authority. The charging standard for registration fees shall be implemented in accordance with relevant state regulations.
中国收养组织是非营利性公益事业单位，为外国收养人提供收养服务，可以收取服务费。服务费的收费标准按照国家有关规定执行。
The Chinese adoption organization is a non-profit public welfare institution. It may charge service fees for providing adoption services to foreign adopters. The charging standard for service fees shall be implemented in accordance with relevant state regulations.
为抚养在社会福利机构生活的弃婴和儿童，国家鼓励外国收养人、外国收养组织向社会福利机构捐赠。受赠的社会福利机构必须将捐赠财物全部用于改善所抚养的弃婴和儿童的养育条件，不得挪作它用，并应当将捐赠财物的使用情况告知捐赠人。受赠的社会福利机构还应当接受有关部门的监督，并应当将捐赠的使用情况向社会公布。
For the purpose of raising abandoned infants and children living in social welfare institutions, the state encourages foreign adopters and foreign adoption organizations to make donations to social welfare institutions. The recipient social welfare institution must use all donated property to improve the upbringing conditions of the abandoned infants and children under its care, and shall not misappropriate it for other purposes. It shall also inform the donor of the use of the donated property. The recipient social welfare institution shall also accept supervision from relevant departments and shall publicly announce the use of donations to the society.
中国收养组织的活动受国务院民政部门监督。
The activities of the Chinese adoption organization shall be supervised by the civil affairs department of the State Council.
本办法自发布之日起施行。1993年11月3日国务院批准，1993年11月10日司法部、民政部发布的《外国人在中华人民共和国收养子女实施办法》同时废止。
These Measures shall come into force as of the date of promulgation. The "Implementation Measures for the Adoption of Children by Foreigners in the People's Republic of China" approved by the State Council on November 3, 1993, and promulgated by the Ministry of Justice and the Ministry of Civil Affairs on November 10, 1993, shall be abolished simultaneously.
