为了规范收养登记行为，根据《中华人民共和国民法典》(以下简称民法典)，制定本办法。
These Measures are formulated in accordance with the Civil Code of the People's Republic of China (hereinafter referred to as the Civil Code) for the purpose of regulating adoption registration.
中国公民在中国境内收养子女或者协议解除收养关系的，应当依照本办法的规定办理登记。
Chinese citizens who adopt children within the territory of China or dissolve adoption relationships by agreement shall register in accordance with these Measures.
办理收养登记的机关是县级人民政府民政部门。
The authority for adoption registration is the civil affairs department of the people's government at the county level.
收养登记工作应当坚持中国共产党的领导，遵循最有利于被收养人的原则，保障被收养人和收养人的合法权益。
Adoption registration work shall adhere to the leadership of the Communist Party of China, follow the principle of best interests of the adopted child, and protect the lawful rights and interests of the adopted child and the adopter.
收养社会福利机构抚养的查找不到生父母的弃婴、儿童和孤儿的，在社会福利机构所在地的收养登记机关办理登记。
Adoption of abandoned infants, children, and orphans raised by social welfare institutions whose biological parents cannot be found shall be registered at the adoption registration authority where the social welfare institution is located.
收养非社会福利机构抚养的查找不到生父母的弃婴和儿童的，在弃婴和儿童发现地的收养登记机关办理登记。
Adoption of abandoned infants and children not raised by social welfare institutions whose biological parents cannot be found shall be registered at the adoption registration authority where the abandoned infants or children were found.
收养生父母有特殊困难无力抚养的子女或者由监护人监护的孤儿的，在被收养人生父母或者监护人常住户口所在地(组织作监护人的，在该组织所在地)的收养登记机关办理登记。
Adoption of children whose biological parents have special difficulties and are unable to raise them, or orphans under the guardianship of a guardian, shall be registered at the adoption registration authority where the biological parents or guardian of the adopted child have their permanent residence (if an organization acts as guardian, at the location of that organization).
收养三代以内同辈旁系血亲的子女，以及继父或者继母收养继子女的，在被收养人生父或者生母常住户口所在地的收养登记机关办理登记。
Adoption of children of collateral relatives by blood within three generations, and adoption of stepchildren by stepfather or stepmother, shall be registered at the adoption registration authority where the biological father or mother of the adopted child has their permanent residence.
收养关系当事人应当亲自到收养登记机关办理成立收养关系的登记手续。
Parties to an adoption relationship shall personally go to the adoption registration authority to complete the registration procedures for establishing the adoption relationship.
夫妻共同收养子女的，应当共同到收养登记机关办理登记手续；一方因故不能亲自前往的，应当书面委托另一方办理登记手续，委托书应当经过村民委员会或者居民委员会证明或者经过公证。
If a couple jointly adopts a child, they shall jointly go to the adoption registration authority to complete the registration procedures; if one party cannot go in person for a valid reason, they shall entrust the other party in writing to complete the registration procedures, and the power of attorney shall be certified by the villagers' committee or residents' committee or notarized.
收养人应当向收养登记机关提交收养申请书和下列证件、证明材料：
The adopter shall submit to the adoption registration authority an adoption application and the following certificates and evidentiary materials:
(一)收养人的居民户口簿和居民身份证；
(1) The adopter's residence booklet and resident identity card;
(二)由收养人所在单位或者村民委员会、居民委员会出具的本人婚姻状况和抚养教育被收养人的能力等情况的证明，以及收养人出具的子女情况声明；
(2) A certificate issued by the adopter's work unit or the villagers' committee or residents' committee regarding the adopter's marital status and ability to raise and educate the adopted child, as well as a declaration by the adopter regarding their own children;
(三)县级以上医疗机构出具的未患有在医学上认为不应当收养子女的疾病的身体健康检查证明。
(3) A physical health examination certificate issued by a medical institution at or above the county level certifying that the adopter does not suffer from any disease medically considered unsuitable for adopting a child.
收养查找不到生父母的弃婴、儿童的，并应当提交收养人经常居住地卫生健康主管部门出具的收养人生育情况证明；其中收养非社会福利机构抚养的查找不到生父母的弃婴、儿童的，收养人应当提交下列证明材料：
For adoption of abandoned infants or children whose biological parents cannot be found, the adopter shall also submit a certificate of the adopter's fertility status issued by the health authority of the adopter's habitual residence; among these, for adoption of abandoned infants or children not raised by social welfare institutions whose biological parents cannot be found, the adopter shall submit the following evidentiary materials:
(一)收养人经常居住地卫生健康主管部门出具的收养人生育情况证明；
(1) A certificate of the adopter's fertility status issued by the health authority of the adopter's habitual residence;
(二)公安机关出具的捡拾弃婴、儿童报案的证明。
(2) A certificate issued by the public security authority confirming the report of finding the abandoned infant or child.
收养继子女的，可以只提交居民户口簿、居民身份证和收养人与被收养人生父或者生母结婚的证明。
For adoption of a stepchild, only the residence booklet, resident identity card, and the marriage certificate between the adopter and the biological father or mother of the adopted child need to be submitted.
对收养人出具的子女情况声明，登记机关可以进行调查核实。
The registration authority may investigate and verify the declaration made by the adopter regarding their own children.
送养人应当向收养登记机关提交下列证件和证明材料：
The person placing the child for adoption shall submit to the adoption registration authority the following certificates and evidentiary materials:
(一)送养人的居民户口簿和居民身份证(组织作监护人的，提交其负责人的身份证件)；
(1) The residence booklet and resident identity card of the person placing the child for adoption (if an organization acts as guardian, submit the identity document of its responsible person);
(二)民法典规定送养时应当征得其他有抚养义务的人同意的，并提交其他有抚养义务的人同意送养的书面意见。
(2) Where the Civil Code requires the consent of other persons with maintenance obligations when placing a child for adoption, submit the written consent of such other persons.
社会福利机构为送养人的，并应当提交弃婴、儿童进入社会福利机构的原始记录，公安机关出具的捡拾弃婴、儿童报案的证明，或者孤儿的生父母死亡或者宣告死亡的证明。
If a social welfare institution is the person placing the child for adoption, it shall also submit the original records of the abandoned infant or child entering the social welfare institution, a certificate issued by the public security authority confirming the report of finding the abandoned infant or child, or a certificate of death or declaration of death of the orphan's biological parents.
监护人为送养人的，并应当提交实际承担监护责任的证明，孤儿的父母死亡或者宣告死亡的证明，或者被收养人生父母无完全民事行为能力并对被收养人有严重危害的证明。
If a guardian is the person placing the child for adoption, the guardian shall also submit a certificate of actual assumption of guardianship responsibilities, a certificate of death or declaration of death of the orphan's parents, or a certificate that the adopted child's biological parents lack full civil capacity and pose a serious harm to the adopted child.
生父母为送养人，有特殊困难无力抚养子女的，还应当提交送养人有特殊困难的声明；因丧偶或者一方下落不明由单方送养的，还应当提交配偶死亡或者下落不明的证明。对送养人有特殊困难的声明，登记机关可以进行调查核实；子女由三代以内同辈旁系血亲收养的，还应当提交公安机关出具的或者经过公证的与收养人有亲属关系的证明。
If the birth parents are the persons placing the child for adoption and have special difficulties making them unable to raise the child, they shall also submit a declaration of special difficulties; if the child is placed for adoption by a single parent due to the death of the spouse or the spouse being missing, a certificate of the spouse's death or disappearance shall also be submitted. The registration authority may investigate and verify the declaration of special difficulties; if the child is adopted by a collateral relative by blood within three generations, a certificate of kinship with the adopter issued by the public security organ or notarized shall also be submitted.
被收养人是残疾儿童的，并应当提交县级以上医疗机构出具的该儿童的残疾证明。
If the adopted child is a disabled child, a disability certificate issued by a medical institution at or above the county level shall also be submitted.
收养登记机关收到收养登记申请书及有关材料后，应当自次日起30日内进行审查。对符合民法典规定条件的，为当事人办理收养登记，发给收养登记证，收养关系自登记之日起成立；对不符合民法典规定条件的，不予登记，并对当事人说明理由。
Upon receiving the adoption registration application and relevant materials, the adoption registration authority shall conduct a review within 30 days from the next day. For those meeting the conditions stipulated in the Civil Code, the authority shall handle the adoption registration, issue the adoption registration certificate, and the adoptive relationship shall be established from the date of registration; for those not meeting the conditions stipulated in the Civil Code, registration shall be denied, and the reasons shall be explained to the parties.
收养查找不到生父母的弃婴、儿童的，收养登记机关应当在登记前公告查找其生父母；自公告之日起满60日，弃婴、儿童的生父母或者其他监护人未认领的，视为查找不到生父母的弃婴、儿童。公告期间不计算在登记办理期限内。
For the adoption of an abandoned infant or child whose birth parents cannot be found, the adoption registration authority shall publish a notice to search for the birth parents before registration; if the birth parents or other guardians of the abandoned infant or child do not claim the child within 60 days from the date of the notice, the child shall be deemed as an abandoned infant or child whose birth parents cannot be found. The notice period shall not be counted within the registration processing period.
收养关系成立后，需要为被收养人办理户口登记或者迁移手续的，由收养人持收养登记证到户口登记机关按照国家有关规定办理。
After the adoptive relationship is established, if household registration or relocation procedures are needed for the adopted child, the adopter shall go to the household registration authority with the adoption registration certificate and handle the procedures in accordance with relevant state regulations.
收养关系当事人协议解除收养关系的，应当持居民户口簿、居民身份证、收养登记证和解除收养关系的书面协议，共同到被收养人常住户口所在地的收养登记机关办理解除收养关系登记。
If the parties to the adoptive relationship agree to dissolve the adoption, they shall jointly go to the adoption registration authority at the place of the adopted child's permanent residence with their household registration books, identity cards, the adoption registration certificate, and a written agreement on the dissolution of the adoption to register the dissolution.
收养登记机关收到解除收养关系登记申请书及有关材料后，应当自次日起30日内进行审查；对符合民法典规定的，为当事人办理解除收养关系的登记，收回收养登记证，发给解除收养关系证明。
Upon receiving the application for dissolution of adoption registration and relevant materials, the adoption registration authority shall conduct a review within 30 days from the next day; for those meeting the provisions of the Civil Code, the authority shall handle the dissolution of adoption registration, retrieve the adoption registration certificate, and issue a certificate of dissolution of adoption.
为收养关系当事人出具证明材料的组织，应当如实出具有关证明材料。出具虚假证明材料的，由收养登记机关没收虚假证明材料，并建议有关组织对直接责任人员给予批评教育，或者依法给予行政处分、纪律处分。
Organizations that issue certification materials for the parties to the adoptive relationship shall truthfully issue relevant certification materials. If false certification materials are issued, the adoption registration authority shall confiscate the false certification materials and recommend that the relevant organization give criticism and education to the directly responsible personnel, or impose administrative or disciplinary sanctions according to law.
收养关系当事人弄虚作假骗取收养登记的，收养关系无效，由收养登记机关撤销登记，收缴收养登记证。
If the parties to the adoptive relationship obtain adoption registration by fraud, the adoptive relationship shall be invalid, and the adoption registration authority shall revoke the registration and confiscate the adoption registration certificate.
本办法规定的收养登记证、解除收养关系证明的式样，由国务院民政部门制订。
The formats of the adoption registration certificate and the certificate of dissolution of adoption as specified in these Measures shall be formulated by the civil affairs department of the State Council.
华侨以及居住在香港、澳门、台湾地区的中国公民在内地收养子女的，申请办理收养登记的管辖以及所需要出具的证件和证明材料，按照国务院民政部门的有关规定执行。
For overseas Chinese and Chinese citizens residing in Hong Kong, Macao, or Taiwan who adopt children in mainland China, the jurisdiction for applying for adoption registration and the required documents and certification materials shall be handled in accordance with the relevant provisions of the civil affairs department of the State Council.
本办法自发布之日起施行。
These Measures shall come into force as of the date of promulgation.
